As sharing and secondary research use of biospecimens increases, IRBs and researchers face the challenge of protecting and respecting donors without comprehensive regulations addressing the human subject protection issues posed by biobanking. Variation in IRB biobanking policies about these issues has not been well documented.

How do we know right from wrong? Do we even have moral knowledge? Moral epistemology studies these and related questions about our understanding of virtue and vice. It is one of philosophy’s perennial problems, reaching back to Plato, Aristotle, Aquinas, Locke, Hume and Kant, and has recently been the subject of intense debate as a result of findings in developmental and social psychology. There is a tension in Emilie Du Châtelet’s thought on mathematics. The objects of mathematics are ideal or fictional entities; nevertheless, mathematics is presented as indispensable for an account of the physical world. After outlining Du Châtelet’s position, and showing how she departs from Christian Wolff’s pessimism about Newtonian mathematical physics, I show that the tension in her position is only apparent. Du Châtelet has a worked-out defense of the explanatory and epistemic need for mathematical objects, consistent with their metaphysical (...) nonfundamentality. I conclude by sketching how Du Châtelet’s conception of mathematical indispensability differs interestingly from many contemporary approaches. (shrink)

For Émilie Du Châtelet, I argue, a central role of the principle of sufficient reason is to discriminate between better and worse explanations. Her principle of sufficient reason does not play this role for just any conceivable intellect: it specifically enables understanding for minds like ours. She develops this idea in terms of two criteria for the success of our explanations: “understanding how” and “understanding why.” These criteria can respectively be connected to the determinateness and contrastivity of explanations. The crucial (...) role Du Châtelet’s principle of sufficient reason plays in identifying good explanations is often overlooked in the literature, or else run together with questions about the justification and likelihood of explanations. An auxiliary goal of the article is to situate Du Châtelet’s principle of sufficient reason with respect to some of the general epistemological and metaphysical commitments of her Institutions de Physique, clarifying how it fits into the broader project of that work. Merold Westphal's book is a wonderful introduction to the history of philosophy.

It is widely held that, in his pre-Critical works, Kant endorsed a necessitation account of laws of nature, where laws are grounded in essences or causal powers. Against this, I argue that the early Kant endorsed the priority of laws in explaining and unifying the natural world, as well as their irreducible role in in grounding natural necessity. Laws are a key constituent of Kant’s explanatory naturalism, rather than undermining it. By laying out neglected distinctions Kant draws among types of (...) natural law, grounding relations, and ontological levels, I show that his early works present a coherent and sophisticated laws-first account of the natural order. In his recent article, ‘A Gift to Theology? Jean-Luc Marion's ‘Saturated Phenomena’ in Christological Perspective’, Brian Robinette has critiqued Marion's phenomenology for confining theology to a one-sided approach to Christology, one that stresses only the passive, mystical reception of Christ. To correct this imbalance, Robinette brings Marion into dialogue with those more active Christologies or ‘prophetical-ethical’ liberation theologies of Gustavo Gutierrez, Johann Baptist Metz and others that stress a life-praxis focused on confronting evil and suffering. In this essay I am (...) arguing that Robinette has not fully developed the ‘logic’ of Marion's phenomenology of the ‘call and the gifted’, in which both a passive and an active element are operative. I explore more fully that very dynamic phenomenological process of the call-and-the-gifted as developed in Marion's work Being Given: Toward a Phenomenology of Givenness. Once viewed in Christological perspective, and especially in light of Christ's death and resurrection, Marion's phenomenology entails an ethical trope consistent with the mission of Christ as rendered in Scriptural revelation, and thus the gap between Marion's work and the prophetical-ethical theologies of Gutierrez and Baptist Metz becomes narrowed. abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

The aim of this paper is to bring recent work on metaphysical grounding to bear on the phenomenon of social construction. It is argued that grounding can be used to analyze social construction and that the grounding framework is helpful for articulating various claims and commitments of social constructionists, especially about social identities, e.g., gender and race. Edited by Ivette Fred-Rivera and Jessica Leech. What is the relationship between ontology and modality: between what there is, and what there could be, must be, or might have been? Throughout a distinguished career, Bob Hale’s work has addressed this question on a number of fronts, through the development of a Fregean approach to ontology, an essentialist theory of modality, and in his work on neo-logicism in the philosophy of mathematics. This collection of new essays engages with these themes (...) in Hale’s work in order to make further progress in our understanding of ontology, modality, and the relations between them. Some essays directly address questions in modal metaphysics, drawing on ontological concerns. Others raise questions in modal epistemology and its links to matters of ontology, such as the challenge to give an epistemology of essence. There are also several essays engaging with questions of what might be called ‘modal ontology’: the study of whether and what things exist necessarily or contingently. Such issues can be raised and addressed directly, but they also have an important bearing on the kinds of semantic commitments engendered in logic and mathematics, e.g., to the existence of sets, or numbers, or properties, and so on. It is thus explored in some chapters to what extent one’s ontology—and indeed, one’s ontology of necessary beings—interacts with other plausible assumptions and commitments. (shrink)

Obligations to reduce one’s green house gas emissions appear to be difficult to justify prior to large-scale collective action because an individual’s emissions have virtually no impact on the environmental problem. However, I show that individuals’ emissions choices raise the question of whether or not they can be justified as fair use of what remains of a safe global emissions budget. This is true both before and after major mitigation efforts are in place. Nevertheless, it remains difficult to establish an (...) obligation to reduce personal emissions because it appears unlikely that governments will in fact maintain safe emissions budgets. The result, I claim, is that under current conditions we lack outcome, fairness, promotional, virtue or duty based grounds for seeing personal emissions reductions as morally obligatory. (shrink)

Genetic research in human beings poses deep ethical problems, one being the problem of distributive justice. If we suppose that genetic technologies are able to produce visible benefits for the well being of people, and that these benefits are affordable to only a favored portion of society, then the consequence is obvious. We are introducing a new source of inequality. In the first section of this paper, I attempt to justify some concern for the distributive consequences of applying genetics to (...) human beings. This concern transcends a mere preoccupation for material equality. I argue that genetic inequality can undermine the very basis of social cooperation, at least regarding health care. The second section is more practical. My aim is to defend how, at least in some legal and cultural frameworks , the undesired distributive consequences of genetics are more likely to arise and more difficult to avoid. (shrink)

Hannah Arendt's essays about the 1957 crisis over efforts of a group of youth, the “Little Rock Nine,” to desegregate a high school in Little Rock, Arkansas, reveal a tension in her vision of the “public.” In this article Aaron Schutz and Marie Sandy look closely at the experiences of the youth desegregating the school, especially those of Elizabeth Eckford, drawing upon them to trace a continuum of forms of public engagement in Arendt's work. This ranges from arenas of (...) “deliberative friendship,” where unique individuals collaborate on common efforts, to a more conflictual “public stage,” where groups act in solidarity to change aspects of the public world. While Arendt famously asserted in her essay “The Crisis in Education” that political capacities should not be taught in schools, it makes more sense to see this argument as focused on what she sometimes called the conflictual “public stage,” reflecting the experience of the Little Rock Nine. In contrast, Schutz and Sandy argue that Arendt's own work implies that “deliberative friendship,” as described in her essay “Philosophy and Politics” and elsewhere, should be part of everyday practices in classrooms and schools. Adam Smith sought to explain the persistence of slavery as an institution in Wealth of Nations and Lectures on Jurispridence. In order to accomplish this he also drew on arguments he had developed in the Theory of Moral Sentiments. The result was a sophisticated explanation which bridged economic, psychological, and moral considerations. After presenting Smith’s explanation I will consider a discussion of the moral wrong of slavery in Ottobah Cugoano, the author of the incisive criticism of the slave trade Thoughts (...) and Sentiments on the Evil of Slavery (1787). I will suggest that Cugoano’s account of what is morally wrong in slavery shows an important lacuna in Smith‘s views. (shrink)

Timothy Williamson has argued that a person S ’s total evidence is constituted solely by propositions that S knows. This theory of evidence entails that a false belief can not be a part of S ’s evidence base for a conclusion. I argue by counterexample that this thesis (E = K for now) forces an implausible separation between what it means for a belief to be justified and rational from one’s perspective and what it means to base one’s beliefs on (...) the evidence. Furthermore, I argue that E = K entails the implausible result that there are cases in which a well-evidenced belief necessarily can not serve as evidence for a further proposition. (shrink)

The expansion of extractive corporations’ overseas business operations has led to serious concerns regarding human rights–related impacts. As theseapprehensions grow, we see a countervailing rise in calls for government intervention and in levels of socially conscious shareholder advocacy. I focus on the latter as manifested in recent use of the shareholder proposal mechanism found in corporate law. Shareholder proposals, while under-theorized, provide a valuable lens through which to consider the argument that economic behaviour is embedded within social relations. In doing (...) so, I situate my analysis within Third World Approaches to International Law (TWAIL) scholarship. Elsewhere, I have supported the use of corporate law tools in advancing the international human rights enterprise and argued that investment activism can be an essential component of this advancement. This paper represents a reflexive pause. Using the case study of a recent proposal submitted to Goldcorp Inc., I seek to problematize the shareholder proposal as a human rights advocacy tool and to examine it as a site of contestation. I examine the link between extensionality principles of classical mereology and the anti‐symmetry of parthood. Varzi's most recent defence of extensionality depends crucially on assuming anti‐symmetry. I examine the notions of proper parthood, weak supplementation and non‐well‐foundedness. By rejecting anti‐symmetry, the anti‐extensionalist has a unified, independently grounded response to Varzi's arguments. I give a formal construction of a non‐extensional mereology in which anti‐symmetry fails. If the notion of ‘mereological equivalence’ is made explicit, this non‐anti‐symmetric mereology recaptures all of the structure (...) of classical mereology. (shrink)

I reconstruct J. H. Lambert’s views on how practical grounds relate to epistemic features, such as certainty. I argue, first, that Lambert’s account of moral certainty does not involve any distinctively practical influence on theoretical belief. However, it does present an interesting form of fallibilism about justification as well as a denial of a tight link between knowledge and action. Second, I argue that for Lambert, the persistence principle that underwrites induction is supported by practical reasons to believe; this indicates (...) that Lambert is a moderate pragmatist about reasons for theoretical belief. Bayesian Conditionalization is a widely used proposal for how to update one’s beliefs upon the receipt of new evidence. This is in part because of its attention to the totality of one’s evidence, which often includes facts about what one’s new evidence is and how one has come to have it. However, an increasingly popular position in epistemology holds that one may gain new evidence, construed as knowledge, without being in a position to know that one has gained this evidence. (...) These are cases of KK-Failure, cases where one knows p but is not in a position to know that one knows p. How to reciprocate a precious gift? In this case the gift was given to us twice. First, in the shape of Paget Henry’s pioneering reinvention of René Ménil’s “Aesthetic Marxism.” Through it, second, we’re led to rediscover the fantastic world of Ménil’s hitherto ignored but crucial contribution to contemporary philosophy: his systematization of the poetics of revolt. Our debt with Ménil and Henry is unpayable. Our humble response in this essay is to offer readers a map to the treasure that (...) is Ménil’s thought. We aim to offer a path across and beyond the sedimentation and pacifying effects of given frames of judgment and the imagination in today’s post-classical public sphere. Abstract: Philosophers interested in Kant's relevance to contemporary debates over the nature of mental content—notably Robert Hanna and Lucy Allais—have argued that Kant ought to be credited with being the original proponent of the existence of ‘nonconceptual content’. However, I think the ‘nonconceptualist’ interpretations that Hanna and Allais give do not show that Kant allowed for nonconceptual content as they construe it. I argue, on the basis of an analysis of certain sections of the A and B editions of the (...) Transcendental Deduction, for a ‘conceptualist’ reading of Kant's Critique of Pure Reason. My contention is that since Kant's notion of empirical intuition makes essential reference to the categories, it must be true for him that no empirical intuition can be given in sensibility independently of the understanding and its categories. This paper is concerned with the relation between two important metaphysical notions, ‘truthmaking’ and ‘grounding’. I begin by considering various ways in which truthmaking could be explicated in terms of grounding, noting both strengths and weaknesses of these analyses. I go on to articulate a problem for any attempt to analyze truthmaking in terms of a generic and primitive notion of grounding based on differences we find among examples of grounding. Finally, I outline a more complex view of how truthmaking (...) and grounding could relate. On the view explored, truthmaking is a species of grounding differentiated from other species of grounding by the unique form of dependence it involves. (shrink)

The distribution of moral properties supervenes on the distribution of natural properties, and this provides a puzzle for non-naturalism: what could explain supervenience if moral properties are not natural properties? Enoch claims moral principles explain supervenience. But this solution is incomplete without an account of what moral principles and properties are, and what relation holds between them. This paper begins to develop such an account by exploring analogous issues for Realism about Laws of nature in philosophy of science. Appealing to (...) Mumford’s Central Dilemma for Realism about Laws, I argue that for moral principles to explain supervenience, moral properties must be ontologically dependent on the principles. I suggest that moral properties are relations between moral principles and natural properties. I also explore what it would take to adapt this explanation to a pluralistic theory of morality. In this paper the author reflects upon the past, the present and the future of philosophical education within the framework of a democratic mode of living, integrating three levels of argumentation: an autobiographic level, triggered by the encounter with an old school notebook that belonged to the author’s father; a conceptual level, in which the author recalls John Dewey’s pragmatist approach to philosophy; and a descriptive and proactive level, in which the author examines recent developments concerning the teaching of philosophy (...) and proposes a perspective on philosophical education in tune with these. The author underscores the importance of different displacements and transformations undergone by the practice of teaching philosophy during the last century, and sets up a contrast between the old practices, intended to provide a “correct view of the world”, and the urge for philosophy to provide a critique of society and knowledge. In this way, the author draws on Dewey’s ideal, according to which philosophy should carry out both a critique and a reconstruction of present experience. Finally, the author sets forth ten challenges for future philosophical education. (shrink)

This article examines a specific case of lying, at the same time judicial and mediatic, promoted from the highest levels of political power, the Leon Trotsky case, from the perspective of the work done by the International Commission of Investigation chaired by the American philosopher John Dewey. After a general justification and contextualization of the subject, and a historical account of the events that surrounded the “Moscow Trials” and the constitution of the Dewey Commission, some of the reasons why the (...) commission concluded that such processes had been judicial assemblies are reported. It closes with a reference to the way Dewey later denounced the media falsification of these events through the book Mission to Moscow. (shrink)

El objetivo de este escrito es mostrar la originalidad de los planteamientos de Freud sobre el tópico, a través de un análisis comparativo con las aproximaciones propias de las corrientes socioantropológicas de la escuela de Cultura y Personalidad y de la Sociología Francesa. La interpretación del material freudiano se organizó según tres tópicos: a) la afirmación de la determinación simbólica del síntoma, b) la borradura metodológica de la distinción individuo sociedad, y c) la teorización de una eficacia mítica, transindividual y transhistórica. Concluimos subrayando los aportes del pensamiento de Freud a la discusión: la afirmación de la determinación simbólica ofrece las condiciones para la superación de la relación de externalidad entre el polo del individuo y el de la sociedad, y el consecuente rechazo a una relación especular entre ambos. The aim of this paper is to show the originality of Sigmund Freud's ideas about the topic, through a comparative analysis with the approaches of the socio-anthropological currents of the school of Culture and Personality and of French Sociology. Our research was based on a bibliographical analysis of some key socio-anthropological texts on this debate, as well as the relevant Freudian production. The interpretation of the Freudian material was organized according to three topics: a) the affirmation of the symbolic determination of symptoms, b) the methodological erasure of the individual society distinction, and c) the theorization of a mythical, transindividual and transhistorical efficacy. We conclude by emphasizing the contributions of Freud's thought to the discussion: the affirmation of symbolic determination offers the conditions for overcoming the externality relation between the pole of the individual and that of society, and the consequent rejection of a specular relationship between the two. En el presente artículo, se sostiene que el actual escenario internacional se ha caracterizado por una profunda interrelación, y la integración emerge como una estrategia de inserción global de relevancia, especialmente para países como Chile. Esta integración no es sólo económica sino que también incluye el movimiento de personas. No obstante, la integración y la movilidad de personas se ven afectadas por los prejuicios y las desconfianzas, lo que se ha reflejado en el fenómeno migratorio peruano en Chile. Desde esta (...) perspectiva, la construcción de un marco institucional para alcanzar mayores grados de integración de los inmigrantes peruanos en Chile, no sólo requiere avances en el ámbito económico-laboral, sino que también en el área educacional-cultural, promoviendo una educación basada en la interculturalidad, capaz de marcar el camino hacia una mayor tolerancia e integración entre ambas sociedades, y así superar quiebres históricos, como lo fue la Guerra del Pacifico. The American conservative movement is a force of anti-reflexivity insofar as it attacks two key elements of reflexive modernization: the environmental movement and environmental impact science. Learning from its mistakes in overtly attacking environmental regulations in the early 1980s, this counter-movement has subsequently exercised a more subtle form of power characterized by non-decision-making. We examine the conservative movement’s efforts to undermine climate science and policy in the USA over the last two decades by using this second dimension of power. The (...) conservative movement has employed four non-decision-making techniques to challenge the legitimacy of climate science and prevent progress in policy-making. We argue that reflexive modernization scholars should focus more attention on similar forces of anti-reflexivity that continue to shape the overall direction of our social, political and economic order, and the life chances of many citizens. Indeed, better understanding of the forces and effectiveness of anti-reflexivity may very well be crucial for societal resilience and adaptation, especially in the face of global environmental problems like climate change. The goal of this paper is to make headway on a metaphysics of social construction. In recent work, I’ve argued that social construction should be understood in terms of metaphysical grounding. However, I agree with grounding skeptics like Wilson that bare claims about what grounds what are insufficient for capturing, with fine enough grain, metaphysical dependence structures. To that end, I develop a view on which the social construction of human social kinds is a kind of realization relation. Social kinds, (...) I argue, are multiply realizable kinds. I depart from the Wilson by further arguing that an appeal to grounding is not otiose when it comes to social construction. Social construction, I claim, belongs to the “big-G” Grounding genus, but it is the specific “small-g” relation of realization at work in cases of human kind social construction. (shrink)

“ Moral luck” alludes to the fact of being responsible for things over which we have no control. Typically, we have neither control over the consequences of our acts of will nor over the circumstances in which these acts are performed. The Kantian thesis on oral responsibility claims that every kind of moral responsibility claims that every kind of moral luck should be eliminated from our moral language and practice. In the case of consequences, this aim does not seem impossible. (...) But circumstances are more difficult to avoid because the act of will itself has to be performed within the framework of circumstances that the agent cannot control at all, and these circumstances will dramatically bear on his/her responsibility. Therefore, the following anti-Kantian argument can be construed. Either we reject circumstantial luck argument can be construed. Either we reject circumstantial luck or we accept it. If we reject it, then every attribution of responsibility becomes impossible. If we accept it, then we no longer have a good argument against consequential luck, the core of the Kantian rejection of moral luck. In this paper, I defend the Kantian position from this argument, claiming that both kinds of moral luck are relevantly different. This will, nevertheless, lead to a revision of the scope of our judgments of responsibility. They compare how someone acted with how others would act in identical 8or similar) circumstances. (shrink)
