Popular sovereignty - the doctrine that the public powers of state originate in a concessive grant of power from 'the people' - is perhaps the cardinal doctrine of modern constitutional theory, placing full constitutional authority in the people at large, rather than in the hands of judges, kings, or a political elite. Although its classic formulation is to be found in the major theoretical treatments of the modern state, such as in the treatises of Hobbes, Locke, and Rousseau, this book (...) explores the intellectual origins of this doctrine and investigates its chief source in late medieval and early modern thought. Long regarded the principal source for modern legal reasoning, Roman law had a profound impact on the major architects of popular sovereignty such as François Hotman, Jean Bodin, and Hugo Grotius. Adopting the juridical language of obligations, property, and personality as well as the model of the Roman constitution, these jurists crafted a uniform theory that located the right of sovereignty in the people at large as the legal owners of state authority. In recovering the origins of popular sovereignty, the book demonstrates the importance of the Roman law as a chief source of modern constitutional thought. (shrink)

Jean Bodin’s analysis in Six Livres de la République is often understood as evidence of his alleged political absolutism. This article examines Bodin’s theory of offices to argue that this is a misguided view of Bodin’s political thought. I begin by revisiting Bodin’s distinction between the “sovereignty” and the “government” of the state. It is in the analysis of the latter that Bodin constructs a normative doctrine warning of the dangers of “seigneurial” rule. As I show, Bodin’s purpose was to (...) reject seigneurial rule by contrasting it with lawful rule, the mode of government in which public power was discharged according to law and custom, not by seigneurial will. Essential to Bodin’s analysis was a concept of public office that envisioned the officer as an independent intermediary “borrowing” public powers, not from higher magistrates or from the prince (as medieval lawyers traditionally argued), but only from the impersonal state. This article investigates the influence of constitutional debates emerging from the Prussian reform movement, 1810-9, on Hegel's theory of the modern constitutional state, as articulated in the Philosophy of Right. I argue that Hegel's theory, which combined constitutional monarchy with a sheme of corporate representation in assembled estates, was not simply a product of an abstract rationalist philosophy but rather, a deeply ideological vision of the medieval origins of modern Germany. Sketched in somewhat general terms, there are two basic ways of going about teaching ethics: the moral indoctrination approach, which is essentially a rote learning exercise; and the moral engagement approach, which emphasizes listening to others in an open-minded manner and coming to carefully considered conclusions only after thoughtful reflection about differing views concerning matters of controversy. For reasons both practical and philosophical, the second approach, which emphasizes the development of critical thinking skills, is vastly preferable. Most modern evangelicals classify the Abrahamic covenant as unconditional. But the label is ambiguous. A review of the covenant passages strongly suggests that the blessings promised to Abraham were conditioned on his obedience – making the covenant, in this sense, conditional. On the other hand, once Abraham obeyed God’s commands, the covenant became prophetically guaranteed – and is, in this sense, unconditional.The nuance is more than theological trivia, for God’s dealings with Abraham have profound implications for us. Abraham received imputed (...) righteousness by faith, without conditions of obedience. But his justification did not guarantee him historic/prophetic prominence. That flowed from his submission to Yahweh. ABSTRACTIn Inventing the Individual, Larry Siedentop traces the origins of Western liberal individualism to Christianity, which broke the hold of classical religiosity. In the classical view, according to Siedentop, there was no conceptual space for individuals, as society was seen as consisting of families, each worshipping its own god. Paul’s doctrine that everyone is equally a child of God enabled an individual-focused understanding of society to emerge. This began to happen with the rise of the Roman Empire and then the (...) ObjectiveCochlear explantation for purely elective (e.g. psychological and emotional) reasons is not well studied. Herein, we aim to provide data and expert commentary about elective cochlear implant (CI) removal that may help to guide clinical decision-making and formulate guidelines related to CI explantation.Data sourcesWe address these objectives via three approaches: case report of a patient who desired elective CI removal; review of literature and expert discussion by surgeon, audiologist, bioethicist, CI user and member of Deaf community.Review methodsA systematic review using (...) three scientific online databases was performed. Included articles addressed the benefits and/or complications of cochlear implantation in young children, CI explantation with or without revision surgery and the ethical debate between the medical and Deaf communities on cochlear implantation and explantation.ConclusionsThe medical and audiological perspectives identify a host of risks related to implant removal without reimplantation, including risk from surgery, general anaesthesia, cochlear ossification and poor audiometric outcomes. The member of the deaf community and bioethicist argue that physicians need to guide the principles of beneficence, non-maleficence and patient autonomy. Taken together, patient desires should be seen as paramount, if the patient is otherwise fit for surgery and well informed.Implications for practiceSimilar to the case of device implantation, device explantation should be a multidisciplinary and collaborative decision with the patient and the family’s desires at the centre. While every case is different, we offer a CI explantation discussion to assist in clinical decision-making, patient counselling and education. (shrink)

Inductive generalization, where people go beyond the data provided, is a basic cognitive capability, and it underpins theoretical accounts of learning, categorization, and decision making. To complete the inductive leap needed for generalization, people must make a key ‘‘sampling’’ assumption about how the available data were generated. Previous models have considered two extreme possibilities, known as strong and weak sampling. In strong sampling, data are assumed to have been deliberately generated as positive examples of a concept, whereas in weak sampling, (...) data are assumed to have been generated without any restrictions. We develop a more general account of sampling that allows for an intermediate mixture of these two extremes, and we test its usefulness. In two experiments, we show that most people complete simple one-dimensional generalization tasks in a way that is consistent with their believing in some mixture of strong and weak sampling, but that there are large individual differences in the relative emphasis different people give to each type of sampling. We also show experimentally that the relative emphasis of the mixture is influenced by the structure of the available information. We discuss the psychological meaning of mixing strong and weak sampling, and possible extensions of our modeling approach to richer problems of inductive generalization. (shrink)

Although scholarship in the social construction of technology has contributed much to illuminating technological development, most work using this theoretical approach is committed to an agency-centered approach. SCOT scholars have made only limited contributions to illustrating the influence of social structures. In this article, the authors argue for the importance of structural concepts to understanding technological development. They summarize the SCOT conceptual framework defined by Trevor Pinch and Wiebe Bijker and survey some of the methodological and explanatory difficulties that arise (...) with their approach. Then the authors present concepts from organizational sociology and political economy that illuminate structural influences in shaping phenomena of interest to SCOT scholars. These structural concepts can be applied to the study of the design, development, and transformation of technology. The authors conclude that the limited amount of scholarship on structural factors in the social shaping of technological development presents numerous opportunities for research. (shrink)

We achieve several results. First, we develop a variant of the theory of absolute Galois groups in the context of many sorted structures. Second, we provide a method for coding absolute Galois groups of structures, so they can be interpreted in some monster model with an additional predicate. Third, we prove the “Weak Independence Theorem” for pseudo-algebraically closed (PAC) substructures of an ambient structure with no finite cover property (nfcp) and the property [Formula: see text]. Fourth, we describe Kim-dividing in (...) these PAC substructures and show several results related to the SOPnhierarchy. Fifth, we characterize the algebraic closure in PAC structures. (shrink)

Through a discursive and organizational analysis we seek to understand the Biosafety Protocol and the place of socioeconomic regulation of agricultural biotechnology in it. The literature on the Protocol has been fairly extensive, but little of it has explored debates over socioeconomic regulation during the negotiation process or the regulatory requirements specified in the final document. This case is especially important at a time when the spread of neoliberalism is increasingly associated with deregulation, because it sheds light on the conditions (...) under which circumvention of the market is deemed legitimate and socio-economic regulation of agricultural technology is possible. This study aims to contribute to the understanding of business news coverage of corporate social responsibility within a comparative international context by investigating two business newspapers, The Wall Street Journal from the United States and The Financial Times from the United Kingdom. Drawing on the news framing research and the implicit and explicit CSR framework of Matten and Moon, this content analysis shows that business news coverage of CSR in the United States and in the United Kingdom differs in terms (...) of news framing, motive attributions of CSR as a concept, motive attributions of referenced companies in relation to CSR, general tone toward the concept of CSR, and the general tone toward referenced companies in relation to CSR. Most significantly, findings suggest that business news plays different roles in constructing and legitimizing CSR in the two countries. In the United States, CSR’s legitimacy and its conceptual positivity may be more implied through the coverage of singular events or actors, whereas in the United Kingdom, CSR’s illegitimacy and its conceptual negativity may be more exposed for further discussion through the coverage of larger societal contexts. Historical analyses of the genesis of the National Science Foundation have given insufficient attention to the role of business in the legislative struggle to establish a postwar research policy agency. This has led to an incomplete understanding of the defining characteristics of the final NSF legislation. Agency focus on basic research has heretofore been interpreted largely as a response to scientists' interests rather than to those of scientists and business. Moreover, the concern of industry with the intellectual property provisions of (...) the legislation has also been underappreciated. In this article, the standard history of the genesis of the National Science Foundation is revised by dissecting the concerns of business with NSF legislation and the role of business in shaping the legislation. The character and influence of industry on proposals for a National Science Foundation are clarified through an examination of three distinct ways in which industry shaped National Science Foundation legislation. The article concludes that in the debate over the establishment of the NSF, interests and influence must be seen as layered, overlapping, and blurred. (shrink)

We generalize a well-known theorem binding the elementary equivalence relation on the level of PAC fields and the isomorphism type of their absolute Galois groups. Our results concern two cases: saturated PAC structures and nonsaturated PAC structures.

This article utilizes the ongoing debates over the role of certain agricultural insecticides in causing Colony Collapse Disorder —the phenomenon of accelerated bee die-offs in the United States and elsewhere—as an opportunity to contribute to the emerging literature on the social production of ignorance. In our effort to understand the social contexts that shape knowledge/nonknowledge production in this case, we develop the concept of epistemic form. Epistemic form is the suite of concepts, methods, measures, and interpretations that shapes the ways (...) in which actors produce knowledge and ignorance in their professional/intellectual fields of practice. In the CCD controversy, we examine how the privileging of certain epistemic forms intersects with the social dynamics of academic, regulatory, and corporate organizations to lead to the institutionalization of three interrelated and overlapping types of ignorance. We consider the effects of these types of ignorance on US regulatory policy and on the lives of different stakeholders. (shrink)

Two experiments investigated whether infants represent goal‐directed actions of others in a way that allows them to draw inferences to unobserved states of affairs (such as unseen goal states or occluded obstacles). We measured looking times to assess violation of infants' expectations upon perceiving either a change in the actions of computer‐animated figures or in the context of such actions. The first experiment tested whether infants would attribute a goal to an action that they had not seen completed. The second (...) experiment tested whether infants would infer from an observed action the presence of an occluded object that functions as an obstacle. The looking time patterns of 12‐month‐olds indicated that they were able to make both types of inferences, while 9‐month‐olds failed in both tasks. These results demonstrate that, by the end of the first year of life, infants use the principle of rational action not only for the interpretation and prediction of goal‐directed actions, but also for making productive inferences about unseen aspects of their context. We discuss the underlying mechanisms that may be involved in the developmental change from 9 to 12 months of age in the ability to infer hypothetical (unseen) states of affairs in teleological action representations. The structural representation (S-representation) account provides an increasingly popular way of understanding the role and value of representation in cognitive science. Yet critics remain unconvinced that the account has the resources to rescue representationalism. This paper reviews problems faced by the S-representation account. In doing so, it offers a novel taxonomy that divides objections into two broad camps that ought to be disambiguated: ‘conceptual’ and ‘empirical’. It further shows how these objections can be met, bolstering existing responses in the literature (...) with novel solutions, thus strengthening the S-representation account. Finally, this paper suggests that the types of objections identified provide a generalisable taxonomy for a better understanding of any version of anti-representationalism. Volunteering, or taking part in unpaid work for the benefit of others, can be a powerful positive experience with returns to both individual well-being and community projects. Volunteering is positively associated with mental health in observational studies with community samples but has not been systematically examined as a potential part of treatment interventions with clinical adolescent samples. In this manuscript, we review the empirical evidence base connecting volunteerism to mental health and well-being, outline potential mechanisms based in the theoretical literature (...) from developmental science, and discuss the existing clinical approaches that support community volunteering as a part of treatment. Drawing on this review, we propose that including volunteering as a component of clinical treatment approaches for adolescent depression can be a powerful intervention for adolescents. (shrink)
