Cusanus, Abstract As a rule Cusanus is interpreted in a theological way, under strong theological presuppositions and within the range of religion. This may be quite understandable since he was a cardinal and had important functions in the Papal States. But, what are the results, when we read his texts under pure philosophical conditions? We may see then that some of his texts are meant neither to assert a belief nor to search for reasons for it, but only to reflect (...) upon the presuppositions of this belief and its different traditions. Instead of asserting his belief Cusanus is beginning to reflect upon his presupositions. We try to give an exemple for this shift with the first proposition in the collection of propositions that follow the dialog De non aliud: „definitio quae se et omnia definit, ea est, quae per omnem mentem quaeritur.“ We will see a quite another Cusanus. Cusanus picks up „definitio“ in the sense of self-determination, developped in the dialog. He begins in quite a traditional manner and ends in a supremely abstract and speculative intuition. The 'Not-other' determines itself in a vision; this vision is an order in which every thing gets its proper place; we as human beings aspire to repeat this vision in our mental life in contact with the world. In this way Cusanus does what all great philosophers do: he reflects in a given set of opinions what is the meaning of „to be“. (shrink)

In a thought-provoking article – or how she herself named it, ‘a thought experiment’ – the philosopher-medical ethicist Anna Smajdor analyzed in this journal the idea of whole-body gestational donation (WBGD) in brain-dead female patients, as an alternative means of gestation for prospective women who cannot or prefer not to become pregnant themselves. We have serious legal, economical, medical and ethical concerns about this proposal. First, consent for eight months of ICU treatment can never be assumed to be derived from (...) consent for post-mortem organ donation; these two are of an incomparable and entirely different medical and ethical order. Moreover, the brain-dead woman is very likely to be medically unfit for high-tech surrogacy and the brain-dead state poses a high risk for deficient embryo/fetal development. Second, from a scarcity perspective, occupying an ICU bed for eight months appears to be unjust. The costs for eight months of ICU treatment are far too high compared to the costs of surrogacy for a living, selected, and healthy woman. Neither insurance companies nor prospective parents will want to pay these exceptionally high costs for a dead woman if a living surrogate mother can be hired for a considerably lower amount. Third, there is an increased risk for harm of the child to be in WBGD. And finally, WBGD risks violating the brain-dead woman’s dignity and harming the interests of her loved ones. In short, there is simply no need for brain-dead women as surrogates. (shrink)

The present text is the revised and corrected English translation of the book published in German by the Lang Verlag, Bern 2008. Unfortunately the text still has some minor flaws (especially in the Index Locorum) but they do not concern the main thesis or the arguments. It will still be the final version, especially considering my age. It is among the most widespread and the least questioned convictions that in Metaphysics Lambda Aristotle presents a theology which has its basis in (...) a metaphysics of substance. Doubts about theological interpretation are beginning to stir in a growing number of publications, but nevertheless the majority of research literature, compendiums and histories of philosophy argues within this frame. A closer look at the facts reveals that this conviction has no basis in the text. Quite the contrary it is based on a reception with theological interests. It arised over centuries, starting from Patristic times and the Middle Ages; it was influenced by Neoplatonic texts as the Liber de Causis or the Theologia Aristotelis, texts for a long time considered as original Aristotelian books. And, if you read not translations but the Greek text, you see that the word 'god' occurs much less than in a theological book should be. In some translations we find more occurences of that word, and especially in French, Italian, English translations some words as le Bien, l'Intelligence etc. are written with capitals to inticate that it is about god. To make it even more clear, we read often the term 'First Mover' or 'Unmoved Mover' as an other name for god, but this expression is never used by Aristotle. So the reader has the impression that Aristotle speaks continuously about god. In addition, in the present book you will find arguments which clean up with the outdated concept of substance in the Aristotelian text, a concept which was developed for quite other problems than Aristotle had, namely theolgical ones. And, if there is no substance, there is no corresponding metaphysics of substance and no theology or onto-theology. If substance, metyphysics, theology play no role in Metaphysics Lambda, what else is its content and aim? That is not so difficult to say because Aristotle says it sufficiently clear in his first sentence, περὶ οὐσίας ἡ θεωρία: our inquiry is about being; its aim is to develop the Frage nach dem Sein and to state a speculative answer: being is noesis, Sein ist Gewahren. Globalisation Considering the Multitude of Worlds This book deals with globalisation, its foundations, its rise and fall and the question of its future. It discusses the conditions that have led, each in its own way, to the reduction of the many worlds to one. The first foundations were laid in the time of the discoveries, the earth was recognised and measured as a unified space. Missionary work and colonisation have made the geographical unit into a unity of fundamental beliefs, values (...) and Western European languages. The brisk trade with the colonies also unified the financial and economic situation of the conquered foreign worlds, which were managed according to Western patterns. The small gain of the political independence of the states achieved in the decolonisation movement was unfortunately destroyed by the great losses already suffered in the area of the fundamental values of the original worlds, their languages, their ways of living, their faith. In the new situation it became apparent that the economic dependence on the former colonial states was increasing rather than decreasing, the way of doing politics had remained by habit that of the colonial powers. Decolonisation was not a way back to the old world. Two metaphysical assumptions of globalisation are discussed in more detail. One is the assumption of realism that the world is one. This assumption justifies missionary and colonialist action. On the other hand, there is the thesis of liberalism that the being of the beings is its economic value. Against the realistic assumption of the one world, arguments are put forward which justify and make plausible the opposite assumption of a multitude of worlds. Now that the world is de facto one thanks to globalisation, and now that it is suffering from problems that affect all people, a new kind of globalisation is needed, one that recognises and respects different worlds on the one hand, but is nevertheless capable of tackling environmental, financial and social problems together. Depending on the subject, two very different ways of reasoning are used. In the preparatory historical part, the arguments are empirical and stick to details; in the part dealing with the justification of the multiplicity of worlds, the argumentation is theoretical, not to say speculative. Severe Traumatic Brain Injury (TBI) remains a major cause of death and disability afflicting mostly young adult males and elderly people, resulting in high economic costs to society. Therapeutic approaches focus on reducing the risk on secondary brain injury. Specific ethical issues pertaining in clinical testing of pharmacological neuroprotective agents in TBI include the emergency nature of the research, the incapacity of the patients to informed consent before inclusion, short therapeutic time windows, and a risk-benefit ratio based on concept that (...) in relation to the severity of the trauma, significant adverse side effects may be acceptable for possible beneficial treatments. Randomized controlled phase III trials investigating the safety and efficacy of agents in TBI with promising benefit, conducted in acute emergency situations with short therapeutic time windows, should allow randomization under deferred consent or waiver of consent. Making progress in knowledge of treatment in acute neurological and other intensive care conditions is only possible if national regulations and legislations allow waiver of consent or deferred consent for clinical trials. The three essays reprinted in this book were first published in 1963 as individual chapters of a psychiatric treatise entitled Psychiatrie der Gegen wart (Psychiatry of the Present Day). The editors, W. H. GRUHLE (Bonn), R. JUNG (Freiburg/Br. ), W. MAYER-GROSS (Birmingham, England), M. MUL LER (Bern, Switzerland), had not planned an encyclopedic presentation; they did not intend to present a "handbook" which would be as complete as possible in details and bibliographic reference. Their intention was to "raze the walls" (...) separating Continental and Anglo-Saxon psychiatries and to offer a synopsis of developments in psychiatry during the last decades on an international basis. The editors requested, therefore, cooperation of scholars from many foreign countries, large and small, on both sides of the Atlantic. A section entitled "Borderlands of Psychiatry", in which MARGARET MEAD (New York) discusses the relation of "Psychiatry and Ethnology", HANS HEIMAN (Bern), the relation of "Religion und Psychiatrie", and ROBERT VOLMER (Paris), "Art et Psychiatrie", is a good illustration of the trilingual character of the whole work. Two of the editors, GRUHLE and MAYER-GROSS, died before the publi cation had been completed. In a kind of posthumous eulogy, Professor JUNG and Professor MULLER praised the initiative and accomplishments of MAYER-GROSS, "who during the last five years of his life had given a great deal of his time to this work. He had set his mind on a synthesis of German and Anglo-Saxon psychiatry. (shrink)

Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. The opportunities lie in education, curriculum development and availability of dedicated proponents. Cultural barriers, limited resources, lack of awareness, differenc... (shrink)

The European Union is working towards harmonizing legislation across Europe, in order to improve cross-border interchange of legal information. This goal is supported for instance via standards such as the European Law Identifier and the European Case Law Identifier, which provide technical specifications for Web identifiers and suggestions for vocabularies to be used to describe metadata pertaining to legal documents in a machine readable format. Notably, these ECLI and ELI metadata standards adhere to the RDF data format which forms the (...) basis of Linked Data, and therefore have the potential to form a basis for a pan-European legal Knowledge Graph. Unfortunately, to date said specifications have only been partially adopted by EU member states. In this paper we describe a methodology to transform the existing legal information system used in Austria to such a legal knowledge graph covering different steps from modeling national specific aspects, to population, and finally the integration of legal data from other countries through linked data. We demonstrate the usefulness of this approach by exemplifying practical use cases from legal information search, which are not possible in an automated fashion so far. (shrink)

This project continues our interdisciplinary research into computational and cognitive aspects of narrative comprehension. Our ultimate goal is the development of a computational theory of how humans understand narrative texts. The theory will be informed by joint research from the viewpoints of linguistics, cognitive psychology, the study of language acquisition, literary theory, geography, philosophy, and artificial intelligence. The linguists, literary theorists, and geographers in our group are developing theories of narrative language and spatial understanding that are being tested by the (...) cognitive psychologists and language researchers in our group, and a computational model of a reader of narrative text is being developed by the AI researchers, based in part on these theories and results and in part on research on knowledge representation and reasoning. This proposal describes the knowledge-representation and natural-language-processing issues involved in the computational implementation of the theory; discusses a contrast between communicative and narrative uses of language and of the relation of the narrative text to the story world it describes; investigates linguistic, literary, and hermeneutic dimensions of our research; presents a computational investigation of subjective sentences and reference in narrative; studies children’s acquisition of the ability to take third-person perspective in their own storytelling; describes the psychological validation of various linguistic devices; and examines how readers develop an understanding of the geographical space of a story. Zehn Autorinnen und Autoren äusserten sich zu wesentlichen Fragen des literarischen Schreibens und gewährten einen sehr persönlichen Blick hinter die Kulissen. Wo und wann beginnt Literatur? Ist Schreiben erlernbar? Wann wird Sprache literarisch? Ist Scheitern die Voraussetzung für etwas Neues? Wer (...) bestimmt die Kriterien, was Qualität ist und was nicht? Wenn unsicher geworden ist, wer oder was das bestimmt, was faktisch geschieht, wenn die Welt uns körperlich und seelisch bedrängt und die einzige Gewissheit in der Zukunft unser Tod ist, wenn uns (...) unsere Bedürfnisse und die Grenzen ihrer Befriedigung unklar geworden sind, dann hilft nichts mehr als das Nachdenken – das Nachdenken über unsere Natur und ihren Platz in der Welt, über die Hierarchie unserer Bedürfnisse, darüber, wie wir das Gelingen unseres Lebens mit Vernunft und Gerechtigkeit in Einklang bringen. Kurz, es hilft nichts als der Epikureismus. ********** Do we know who or what determines the course of our lives? Do we even know what is going on inside and outside of us? The only certain thing is our death, but what good is the certainty of our death if it remains uncertain when it will come? We know our needs, but where are the limits to their fulfilment? When it has become uncertain who or what determines what actually happens, when the world oppresses us physically and emotionally and the only certainty in the future is our death, when our needs and the limits of their fulfilment have become unclear to us, then nothing helps more than reflection - reflection on our nature and its place in the world, thinking about the hierarchy of our needs, about how we can harmonise the success of our lives with reason and justice. Objections arise to the concept of artistic intention based upon the psychology of a period. Here too we experience trends or volitions which can only be explained by precisely those artistic creations which in their own turn demand an explanation on the basis of these trends and volitions. Thus "Gothic" man or the "primitive" from whose alleged existence we wish to explain a particular artistic product is in truth the hypostatized impression which has been culled from the works of art (...) themselves. Or it is a question of intentions and evaluations which have become conscious as they find their formulation in the contemporary theory of art or in contemporary art criticism. Thus these formulations, just like the individual theoretical statements of the artists themselves, can once more only be phenomena parallel to the artistic products of the epoch; they cannot already contain their interpretation. Here again this parallel phenomenon would, in its entirety, represent an extraordinarily interesting object of humanistic investigation, but it would be incapable of defining in detail a methodologically comprehensible volition. So, too, the view of art which accompanies a period's artistic output can express the artistic volition of the period in itself but cannot put a name to it for us. This view can be of eminent significance when we are seeking a logical explanation for the perception of tendencies dominating at a given time and thus also for the judgment of artistic volition at that time, which must also be interpreted.Erwin Panofsky, the renowned art historian, was professor at the Institute for Advanced Study, Princeton University, until his death in 1968. In this work, first published in two volumes in 1890 and 1894, Erwin Rohde, the German classical scholar and friend of Nietzsche, describes the ancient Greek cult of souls and establishes the sources of the belief in the immortality of the soul, exploring its relation to life both before and after death. This belief in the survival of the soul already existed in the earliest Greek writings, but when and from where did it originate? In Volume 1 Rohde examines (...) belief in the soul as it appears in Homeric poetry and within local cults, and finds that the idea of an afterlife is already represented in different forms in the works of Hesiod and Aeschylus. He also discusses burial rites and the Eleusinian Mysteries. Psyche, reissued here in the 1898 edition, remains a standard reference work on this topic. (shrink)
