This study aims to analyse the pros and cons of imposing penalties or fines in law enforcement regulations for violating health protocols in Indonesia. Some people consider that the norm of the fine sanctions in statutory provisions regulating health protocol violators is unconstitutional, but others say it is constitutional. As a country with the largest Muslim population in the world, a study of the perspective of Islamic law is essential. This article uses a normative legal research methodology using two main (...) approaches: the statutory and conceptual approaches. The results show that fines are found in the criminal law clusters and state administrative law. Penalties in state administrative law in their enforcement do not require intervention from other institutions. Still, they can be carried out directly by government officials whose authority has been determined in the laws and regulations. Meanwhile, from the Islamic perspective, the fine sanctions can be applied, in the context of hifz Al-Insan, in Maslahah Mursalah as part of the maqasid al-Syari’ah. The obligation to obey government regulations is part of a person’s obedience to God’s commands. Contribution: This study’s findings can support the government in enforcing the law to combat the spread of the coronavirus disease 2019 (COVID-19) in Indonesia and other countries because, constitutionally, the law is legal. Then, the legality of fines for violators of the COVID-19 health protocol, from an Islamic perspective, does not contradict maqasid al-shari’ah. So, there should be no doubts for Muslims to obey these regulations. (shrink)

This paper describes an axiomatic theory BT, which is a suitable formal theory for developing constructive mathematics, due to its expressive language with countable number of set types and its constructive properties such as the existence and disjunction properties, and consistency with the formal Church thesis. BT has a predicative comprehension axiom and usual combinatorial operations. BT has intuitionistic logic and is consistent with classical logic. BT is mutually interpretable with a so called theory of arithmetical truth PATr and with (...) a second-order arithmetic SA that contains infinitely many sorts of sets of natural numbers. We compare BT with some standard second-order arithmetics and investigate the proof-theoretical strengths of fragments of BT, PATr and SA. (shrink)

This paper describes axiomatic theories SA and SAR, which are versions of second order arithmetic with countably many sorts for sets of natural numbers. The theories are intended to be applied in reverse mathematics because their multi-sorted language allows to express some mathematical statements in more natural form than in the standard second order arithmetic. We study metamathematical properties of the theories SA, SAR and their fragments. We show that SA is mutually interpretable with the theory of arithmetical truth PATr (...) obtained from the Peano arithmetic by adding infinitely many truth predicates. Corresponding fragments of SA and PATr are also mutually interpretable. We compare the proof-theoretical strengths of the fragments; in particular, we show that each fragment SAs with sorts <=s is weaker than next fragment SAs+1. (shrink)

Public awareness of the problems of inclusion, as overcoming social inequality, is in the stage of formation in Ukraine and needs a socio-philosophical implementation. he main purpose of the article is to analyze the problem of social space of the city, which is convenient for the life of citizens with different set of opportunities, and the expediency of including disability as a social phenomenon in the broad philosophical context (...) of study. The field of thinking about the city in the study is outlined in the following concepts: the right to the city, the urban space for human development, social communications and the just principles of being. It is important to understand the vector of the development of the socio-cultural field of the city in terms of overcoming the "soulless indifference" (bliss) and for the development of communication between the citizens. The novelty of the work is determined by the rationale for the transformation of traditional disability models in modern conditions of social development. The relevance of the study is associated with the complexity of the phenomenon of disability, insufficient knowledge of the factors and problems of inclusion of people with special needs in society. With the growing number of people with disabilities in society, the problem of developing a culture of disability becomes urgent, the low level of which should be considered a challenge. A culture of disability implies a mutual desire of people with disabilities and society to move towards each other. The practical aspect of the research is related to the need for change of social consciousness, inclusion of persons with disabilities in the social space, development of social competences of people with disabilities and transformation of these people from the object of social assistance into an active subject and participant of the processes taking place in society., implementation of projects based on justice and citizenship. Unfortunately, she largely dismisses recent advances in behavior genetics and its huge potential in contributing to a better prediction and understanding of complex traits in social sciences.

This article presents Epistemic Spatialization as a new framework for investigating the interconnected patterns of biases when identifying objects with convolutional neural networks. It draws upon Foucault’s notion of spatialized knowledge to guide its method of enquiry. We argue that decisions involved in the creation of algorithms, alongside the labeling, ordering, presentation, and commercial prioritization of objects, together create a distorted “nomination of the visible”: they harden the visibility of some objects, make other objects excessively visible, and consign yet others (...) to permanent or haphazard invisibility. Our approach differs from those who focus on high-stakes misidentifications, such as errors tied to structural racism. Examining the far more dominant series of low-stakes mistakes shows the scope of errors, destabilizing the goal of image content identification with considerable societal impact. We explore these issues by closely examining the demonstration video of a popular convnet. This examination reveals an interlocking series of biases undermining the content identification process. The picture we paint is crucial for a better understanding of the errors that result as these convnets become further embedded in everyday products. The framework is valuable for critical work on computer vision, AI studies, and large-scale visual analysis. (shrink)

New technologies provide new forums for the expression and challenging of racism. This article explores the potential of an interactive blog about asylum-seekers to serve as part of the Habermasian ‘public sphere’, facilitating debate between those with opposing views. We offer evidence that pro- and anti-asylum seeker arguments made in blogs construct a binary between those in favour and those against. Arguments are collectively constructed producing relatively coherent discourses, despite being articulated by different individuals. We then explore the ways in (...) which pro-asylum seeker postings utilize strategies which social scientists have identified as effective in challenging racism. As such, the blog is a site where what has come to be called ‘bystander anti-racism’ is being practised, producing a counter-hegemonic discourse. Our evidence suggests that despite arguments to the contrary, blogs are potentially useful sites for the development of communicative consciousness in relation to race issues, particularly the challenging of racism. This study aims at reducing, and even eliminating, the thoughts of small Muslim groups in Indonesia, which state that the replacement of Pancasila as a Khilafah will raise the Indonesian state to become a developed country. This study uses a normative legal research methodology with two approaches: a historical and a conceptual approach. The historical approach was used to review the history of the implementation of the Khilafah system in Islam and the early history of the emergence of Pancasila as (...) a national government system. Meanwhile, the conceptual approach was used as a road map to examine the Khilafah and Pancasila concepts in the constitutional system. The results of this study revealed that Pancasila represents the Indonesian nation's ideology, which is in tune with Islamic law, and can answer all the needs of its people. Through Pancasila, the Indonesian people can live in harmony amidst existing pluralism. Therefore, there is no space for ideology other than Pancasila to fill and become the foundation of the Indonesian nation.CONTRIBUTION: This article attempts to answer Muslim people's doubts with extremist ideology who want to change Pancasila into Khilafah. In 2008, Dutch anti-Islam Member of Parliament Geert Wilders produced a short video called Fitna to visualize his argument that Islam is a dangerous religion. Thousands of men and women across the globe uploaded their own videos to YouTube to criticize or support the film. In this article, we look at these alternative videos from a feminist perspective, contrasting the gender portrayal and narratives in Fitna with those in the alternative videos. We contend that Fitna expressed an extremist Orientalist discourse, (...) in which women are presented as the current and future victims of the oppression of Muslim men and Islam. In contrast, the YouTube videos give voice to women themselves who come from across the globe, are relatively young and often active Muslims. Second, they express different view points in generically new ways, criticizing and ridiculing Wilders or producing serious and committed explanations of their own understanding of Islam. Third, although relatively few women appeared in the videos, those that did speak for themselves, not only take on Wilders, but also claim their right to speak within Islam. We propose to understand these videos as acts of citizenships through which women constitute themselves as global citizens, in some cases by engaging in ‘deliberation’ as it is understood in feminist political theory, in other cases by taking a ‘voice’ that can be responded to. The literature on the construction of places of worship has predominantly shown difficulties, rejection and disharmony among religious communities. This study aims to describe and analyzed the success story of the construction of the Santa Monica church in Tangerang. This is a qualitative study conducted over a month-long period using primary and secondary data. Primary data were obtained through observation and interviews, while secondary data were obtained through formal and informal policy reviews available online. The informants involved in this study (...) amounted to eight people consisting of church leaders and administrators, local leaders, religious leaders, religious organizations and the Ministry of Religious Affairs. Data were analyzed using content analysis methods. The results of the study show that the ability of church leaders and administrators to build good social and cultural relations with the community was a key element in their success in obtaining permission to build the church. This was achieved through effective communication, dialogue and cooperation between the Catholic community, leaders and the predominantly Islamic local community. Active involvement in daily activities had a positive impact, fostering mutual trust and peaceful coexistence, ultimately resulting in the local community’s support and approval for the establishment of the place of worship. Thus, the church construction committee was able to meet all administrative requirements as stipulated by government regulations. This study recommends the importance of good social and cultural relations as the fundamental basis and determinant of success for religious communities seeking to construct places of worship.Contribution: This article contributes to the goal of HTS Theological Studies in promoting the transdisciplinary aspect of religious studies in the international theological arena, particularly in the study of religious harmony among communities in Indonesia. ART and, in particular, IVF and ICSI, are essentially a laboratory experiment, but which, due to its specificity, goes beyond the disciplinary boundaries, explicitly acquiring an ethical-axiological dimension in the interaction zone of the members of a particular community involved in child-bearing. At the same time, it is noted that the activity and choice of a way to solve problems with childbirth has a characteristic severity, due to the traditions and level of civil and social maturity of a country, due, (...) among other things, to the level and achievements of technical equipment in this industry of knowledge and practice. According to foreign studies, about half of all subfertile people in developed countries are trying to overcome their infertility with the help of medicine, and research data indicate that the proportion of such individuals is growing. The most difficult problems of reproduction are associated with low quality of oocytes or low ovarian reserve ; aspermia and deep teratozoospermia, can not give hope to a couple to have genetically related offspring. However, donor programs create additional opportunities for social motherhood / paternity. Donation of oocytes is found in ART programs at least 3 times more often than donation of spermatozoa. At the moment, donation of gametes and embryos raises a number of ethical, legal, medical and socio-psychological issues that require competent support from experts of a wide range of specialists, as well as competent, non-commercial, primarily due to the interaction between donors and recipients. The analysis of possible modifications of family and kinship ties is based on the idea of transforming social relations, in which assisted reproductive technologies play a fundamental role, building a system of “new kinship and new family.” By entering into the intimate process of the birth of life and acting as a regulator of the composition of participants in this process through the stimulation of responsibility to present and future relatives, reproductive technologies affect the initial moral requirements in the community, redefining universal values based on the specific situation. Scenarios of childbearing through ART with the involvement of additional participants are possible in the context of the legal field, but legally fixed anonymity of the donor leaves many unresolved issues related to the problems of hereditary diseases, genetic abnormalities and epigenetic changes; in addition, there is a problem associated with the possibility of unintentional incest, as well as the difficulties of the child’s self-identification and the closeness of his genealogy. Solutions to these issues are postponed until later, thereby initiating future dramatic situations, ethical conflicts and dilemmas with a poorly predictable positive outcome. (shrink)

Este artículo estudia cómo historiadores árabes tan influyentes y renombrados como Ibn Ḫaldūn (m. 808/1406) y al-Maqrīzī (m. 845/1442) describen los reinados de los reyes cristianos de Iberia que fueron contemporáneos suyos, y, especialmente, cómo describen el reinado de Pedro I de Castilla (g. 1350-1366 y 1367-1369). El artículo ofrece un análisis en profundidad de los fragmentos dedicados a Pedro I, al que Ibn Ḫaldūn conoció personalmente, y muestra que su muerte a manos de su medio hermano Enrique II (g. (...) 1366-1367 y 1369-1379) recibió gran atención en Kitāb al-ʿIbar de Ibn Ḫaldūn y Durar al-ʿuqūd al-farīda de al-Maqrīzī. Pone de relieve asimismo que la información sobre el reino de Castilla que proporcionan ambos autores, aunque alterada, guarda relación con fuentes castellanas contemporáneas, y que parte de esa información relativa a la dār al-ḥarb en el otro extremo del Mediterráneo llegó de alguna manera al Egipto mameluco, donde Ibn Ḫaldūn y al-Maqrīzī (y su coetáneo al-Qalqašandī a través de Ibn Ḫaldūn) la incorporaron a sus respectivas obras. V prvi polovici 18. stoletja je bila objavljena serija devetih oziroma desetih latinskih tiskov z naslovom Lakonsko ogledalo Evrope (Laconicum Europae speculum). Podobe z napisi je zasnoval Paul Decker mlajši (1685-1742), Johann Wolfgang Baumgartner (1709-1761) je postavil le tisk za Nizozemca, same bakroreze so izdelali različni bakrorezci (Christian Friedrich Lottes, Johann Georg Pinz, Philipp Andreas Kilian, Andreas Hoffer), uredil in izdal pa jih je Martin Engelbrecht (1684–1756) v Augsburgu okrog leta 1730. Celotni naslov je daljši, Lakonsko ogledalo Evrope, v katerem (...) je brez predsodkov, posmehovanja ali zaničevanja predstavljenih njenih devet posebej uglednih narodov in ljudstev, ki se v določenih lastnostih in znamenjih razlikujejo, vse zaradi radovednosti in zabave (Laconicum Europae speculum: quo IX. illius praecipuae nationes et populi, absque omni praeiudicio, ludibrio et opprobrio, saltem curiositatis et oblectationis gratia, certis characteribus et symbolis discernuntur, ob oculos positum).1 V naslovu je torej pojasnjen tudi razlog za nastanek teh tiskov, izšli so ≫zaradi radovednosti in zabave≪ (curiositatis et oblectationis gratia). Podobno kot ostale razpredelnice ljudstev ti bakrorezi niso bili mišljeni kot predstavitev realnih podob, temveč so bili namenjeni tudi zabavi. (shrink)

Since the days of Merula it has been regularly assumed by editors and critics of Ennius that, despite the express statement of Cicero to the contrary, the Annales did contain some narrative of the events of the first Punic War. Familiar as the passage in the Brutus is, it must be quoted once again: “Tamen illius quem uatibus et Faunis annumerat Ennius Bellum Punicum quasi Myronis opus delectat. Sit Ennius sane, ut est certe, perfectior: qui, si ilium, ut simulat, (...) contemneret, non omnia bella persequens, primm illud Punicum, acerrimum bellum, reliquisset”. (shrink)

‘uester, de uno, per indignationem’ says Achilles Statius at the first of these two places, and again ‘uester, de uno’ at the second. Muretus on the other hand explains ‘uestrae saeuitiae, ferocitatis illius, uobis omnibus, qui formosi estis, innatae.’ Most commentators have taken part with Muretus, and deny that uester in these two passages means tuus; nor is the usage recognised in the lexicons. But when it comes to explaining what, if not tuus, uester does mean, the interpreters are (...) not agreed: they contradict one another, and they even contradict themselves. (shrink)

Miriam Griffin drew attention to the comment of Justus Lipsius: ‘a defendant (...) might have to make such a declaration in cases involving financial penalties, such as extortion and peculation, for when the litis aestimatio [‘assessment of damages’] was made, it would be important to know who the other claimants to the convicted man's assets were, and how encumbered his property was.’ No further elucidation, however, has been made since Lipsius. Mommsen failed to record this passage in his Staatsrecht and Strafrecht, and, as far as we know, no monograph on Roman criminal law mentions the passage of Seneca. (shrink)
