This article is a very brief introduction to the work of John Rawls, the topic of this special edition of this journal.

Some people are multi-billionaires; others die because they are too poor to afford food or medications. In many countries, people are denied rights to free speech, to participate in political life, or to pursue a career, because of their gender, religion, race or other factors, while their fellow citizens enjoy these rights. In many societies, what best predicts your future income, or whether you will attend college, is your parents’ income. -/- To many, these facts seem unjust. Others disagree: even (...) if these facts are regrettable, they aren’t issues of justice. A successful theory of justice must explain why clear injustices are unjust and help us resolve current disputes. -/- John Rawls (1921-2002) was a Harvard philosopher best known for his A Theory of Justice (1971), which attempted to define a just society. To this mode of thought, constructing a model of the good society in any but the general terms of "exchange" and "reciprocity" is unfaithful to the human community, whose operations have (...) been from the beginning beyond the grasp of any individual mind within the society, and in which since the rise of the market system we participate largely unmediated by ritual. Rather than providing a template for the "good society," originary thinking provides a touchstone for ethical progress: act so as to contribute to reciprocal exchange, negatively, by aiding those who need help to participate in the exchange system more fully, and positively, by creating new foci of desire that enrich the system of exchange, the circulation of desire and satisfaction. The result of these acts is to reduce or "defer" resentment, negatively, by removing grievances, and positively, by creating new opportunities for recycling resentment into productive activity.These precepts notwithstanding, the "moral model" of reciprocal exchange, as exemplified in the exchange of signs around the sacred center in the hypothetical originary event, provides the basis for a recurrent temptation to create utopias. The theoretical gesture of measuring a given social order against a moral ideal is an extension of the moral intuition we apply in judging all human actions; whatever our degree of resignation, we cannot help but resent any suggestion—even when it is "objectively" false—that we have been victims of a failure of reciprocity. Both the theory and the personal intuition are direct descendants of the originary exchange of representations, as are the moral "theories" that are explicitly grounded in the sacred. Abstract moral theorizing must ultimately appeal to either transcendence or intuition, and the appeal to the former differs only in its rhetoric from the appeal to the latter.Finally, these "timeless" reflections must be situated in history. Determining the proper relationship between universal morality and historically [End Page 149] particular ethics poses a particularly acute problem in the postmodern era. The question that has remained with us since the end of World War II is how to overcome the paralysis of Auschwitz—how to acknowledge the necessary deferral of reciprocity without condoning genocide. If we hold history's institutions to the touchstone of the moral model, they will always be found wanting, yet this historical experience tells us that if we do not so hold them, anything is possible. The fact that accusations of Nazism (or "fascism") continue to be made today—notably against Israel itself—is a sign that the moral dilemma has not yet been resolved. But unlike metaphysical thought, originary thinking takes the Holocaust as a sign not of the need to construct a social model that will resolve this dilemma, but of the inappropriateness of confronting it directly. Making the world a better place not only does not require but is in fact incompatible with a prior image of the world made good.The most serious attempt by mainstream Anglo-American social thought to grapple with this postmodern quandary is that of the late Harvard philosopher John Rawls (1921–2002), whose A Theory of Justice (1971) remains the era's most important work of moral philosophy. To sum up in my own terms Rawls's basic idea: if we imagine ourselves in an "original position" when society has not yet come into existence, so that our (future) place in it is hidden from us by a "veil of ignorance," then we will be able to agree on the criteria of a good society, since our uncertainty will convince us all equally of the necessity to protect ourselves from unfairness in the event we are assigned one of society's less desirable roles. What points of contact, if any, are there between the current investment in ethics in literary theory, and the elaboration of ethics in contemporary philosophy? In other words, does an interdisciplinarity exist? Second, what reasons might literary theorists have, or have they had, to be aware and take stock of (...) developments in philosophical ethics? That is to say, what might be gained from interdisciplinary work? A third question emanates from the first two: where a cross-disciplinary engagement with philosophy has taken place, has there occurred any transformation of literary theory? I hope to show in what follows that, when we consider ethics in literary theory, no less than in philosophy, it is necessary to attend both to method within each discipline and to the nature of relations between them.The first of my questions begs the question of what contemporary philosophy is. Literary theorists entering into ethics have tended to draw on the work of Emmanuel Lévinas, Jacques Derrida, Michel Foucault, and Luce Irigaray, and more recently that of Giorgio Agamben and Alain Badiou. If the last has, in a spirit of polemic, professed to displace the "other" in the name of the "Same,"1 the dominant paradigm, when it [End Page 3] comes to ethics, remains one of alterity and difference. There are fundamental reasons why this should be the case: operating in figural language, literature, or the literary, differs from itself in response to an other. To borrow, translate, and adapt an Afrikaans term from the South African poet Breyten Breytenbach,2 literature engages in a process of andersmaak, of other-making or making-other: in making-other and, in so doing, inventing others, it makes itself other. Literature is an other-maker. It is to this activity that literary theory must attend. That is why it is natural for it to turn to ethics—not only the nexus Lévinas-Derrida and the other thinkers mentioned above, but also, for instance, to psychoanalysis: what may have begun as the teasing out of hidden meanings (the received idea is that this is what psychoanalysis and literary criticism share) has, following Lacan's "return to Freud," evolved into a consideration of the ethics of psychoanalysis in the context of reading and listening [see, for example, Felman and Laub].Literature may be an other-maker, and reading may be exemplary in the topoi of current theory for responsibility before the other,3 but it is not clear that literary theorists have been equal to setting this responsibility to work fully when it comes to responding to philosophy. There has been relatively little attention among literary theorists to developments in disciplinary philosophy—where, in recent decades, in North America and the Anglophone world generally, the tendency in ethics has been to bring moral reflection to bear on questions in political theory. The pólis in question is, however, no longer only the nation-state; the politics that engages political thought is transnational and global. Whether or not a given thinker subscribes to the idea of world citizenship, the horizon for thought is cosmopolitan.PhilosophyAlthough thinkers have continued to enter into basic questions in ethics,4 the writings of Charles Taylor, Will Kymlicka, Iris Young, Seyla Benhabib, and others attest to a shift from ethics to politics powerfully influenced by John Rawls (1921-2002)—notably in A Theory of Justice (1971) and Political Liberalism (1993)—and the ensuing criticisms of these works. The function of rationality in A Theory of Justice (1971), which is of paramount importance for John Rawls’ (1921–2002) project, is often criticised as ambiguous.David Gauthier, for example, claims that Rawls develops principles for recipients who essentially share his intuitions of morality, without managing to prove theirvalidity. In Political Liberalism (1993), Justice as Fairness (2001) and other writings Rawls himself embarks upon the task to throw more light on this issue, making the Kantian distinction (...) between ‘rational’ and ‘reasonable’. I intend to demonstrate that in A Theory of Justice the formulation and the compliance with the principles of justice are based on the interaction between the rationality, represented in the idea of the good, and the sense of justice of individuals. On the twentieth anniversary of the death of one of the most important contemporary political and social philosophers, John B. Rawls (1921–2002), in this paper the authors deal with his understanding of the relationship between civil disobedience and freedom within the framework of a liberal constitutional democracy based on the rule of law. The fundamental starting point of Rawls’s theory, and thus of this work, is that civil disobedience expresses disobedience to the law within the (...) limits of fidelity to the law, although it is at the outer edge thereof. If the freedom of thought expressing disobedience to unjust laws is one of the fundamental freedoms, then civil disobedience can be understood not only as a corrective to liberal constitutional democracy but also as a realistic attempt to “save” it. This is an important topic of contemporary political philosophy, considering the increasingly widespread discourse about the crisis of liberalism in general today, and the impact of that crisis on the institutions of liberal constitutional democracy, among which the state stands out, but in fact law and the legal system as a whole. How can what is of value associated with our human world exist and best flourish embedded as it is in the physical universe? Or, as we may put it, how can the God-of-Cosmic-Value exist and best flourish embedded as it is in the God-of-Cosmic-Power? This, I argue, is our fundamental problem – fundamental in both intellectual and practical terms. Here, I tackle the practical aspect of the problem. I consider briefly five global problems – climate change, war, population growth, world (...) poverty, habitat destruction and extinction of species – and argue that, in order to solve them it is essential to bring about a revolution in universities round the world so that the basic aim becomes wisdom and not just knowledge. I conclude by indicating recent developments which suggest the revolution may already be underway. (shrink)
