In multiple essays, CLR James lays out what a theory of subjectivity must account for to resolve issues stemming from reducing subjectivity to a singular identity. Most proposals for a theory of subjectivity do so by making the subject the object of another’s propositions or claims about the world. I argue that this is an identity claim. The converse of this process is also true, that the subject who claims another as the object of their proposition must also be the (...) object of a proposition themselves, leaving the capacity to form these expressions untouched. In Black Cultural studies, there has been a lot of attention paid to the capacity for one to become the object of their own propositions due to the conception that Black identity overdetermines Black subjects’ expressions prior to their articulation. Our reorientation to the study of subjectivity posits an entity whose operation functions to mobilise as well as implement identity claims. Subjectivity is a capacity while identity becomes the object of that capacity, an object shared between subjects that are known by becoming the object of propositions regarding the world, including their own. This essay attempts to resolve the conflicts that arise once the mistake of conflating subjectivity with identity claims is made and proposes a model whereby the concept of Black subjectivity can be explained. Two interpretations of the precautionary principle are considered. According to the normative interpretation, the precautionary principle should be characterised in terms of what it urges doctors and other decision makers to do. According to the epistemic interpretation, the precautionary principle should be characterised in terms of what it urges us to believe. This paper recommends against the use of the precautionary principle as a decision rule in medical decision making, based on an impossibility theorem presented in Peterson . However, (...) the main point of the paper is an argument to the effect that decision theoretical problems associated with the precautionary principle can be overcome by paying greater attention to its epistemic dimension. In Australia and other countries, certain groups of women have traditionally been denied access to assisted reproductive technologies . These typically are single heterosexual women, lesbians, poor women, and those whose ability to rear children is questioned, particularly women with certain disabilities or who are older. The arguments used to justify selection of women for ARTs are most often based on issues such as scarcity of resources, and absence of infertility , or on social concerns: that it “goes against nature”; (...) particular women might not make good mothers; unconventional families are not socially acceptable; or that children of older mothers might be orphaned at an early age. The social, medical, legal, and ethical reasoning that has traditionally promoted this lack of equity in access to ARTs, and whether the criteria used for client deselection are ethically appropriate in any particular case, are explored by this review. In addition, the issues of distribution and just “gatekeeping” practices associated with these sensitive medical services are examined. (shrink)

Biological theories of religious belief are sometimes understood to undermine the very beliefs they are describing, proposing an alternative explanation for the causes of belief different from that given by religious believers themselves. This article surveys three categories of biological theorizing derived from evolutionary biology, cognitive science of religion, and neuroscience. Although each field raises important issues and in some cases potential challenges to the legitimacy of religious belief, in most cases the significance of these theories for the holding of (...) religious beliefs is not very great. A transformative decision rule transforms a given decision probleminto another by altering the structure of the initial problem,either by changing the framing or by modifying the probability orvalue assignments. Metaethical constructivism aims to explain morality’s authority and relevance by basing it in agency, in a capacity of the creatures who are in fact morally bound. But constructivists have struggled to wring anything recognizably moral from an appropriately minimal conception of agency. Even if they could, basing our reasons in our individual agency seems to make other people reason-giving for us only indirectly. This paper argues for a constructivism based on a social conception of agency, on which our capacity to (...) recognize ourselves as having reasons ties us inescapably to others. It argues that mutual recognition is a pervasive feature of linguistic concepts, and builds this into a view called transformative expressivism. (shrink)

Australia II became the first foreign yacht to win the America's Cup in 1983. The boat had a revolutionary wing keel and a better underwater hull form. In official documents, Ben Lexcen is credited with the design. He is also listed as the sole inventor of the wing keel in a patent application submitted on February 5, 1982. However, as reported in _New York Times_, _Sydney Morning Herald_, and _Professional Boatbuilder_, the wing keel was in fact designed by engineer Peter (...) van Oossanen at the Netherlands Ship Model Basin in Wageningen, assisted by Dr. Joop Slooff at the National Aerospace Laboratory in Amsterdam. Based on telexes, letters, drawings, and other documents preserved in his personal archive, this paper presents van Oossanen’s account of how the revolutionary wing keel was designed. This is followed by an ethical analysis by Martin Peterson, in which he applies the American NSPE and Dutch KIVI codes of ethics to the information provided by van Oossanen. The NSPE and KIVI codes give conflicting advice about the case, and it is not obvious which document is most relevant. This impasse is resolved by applying a method of applied ethics in which similarity-based reasoning is extended to cases that are not fully similar. The key idea, presented in Peterson’s book _The Ethics of Technology_ (Peterson, The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, 2017), is to use moral paradigm cases as reference points for constructing a “moral map”. Armchair philosophers have questioned the significance of recent work in experimental philosophy by pointing out that experiments have been conducted on laypeople and undergraduate students. To challenge a practice that relies on expert intuitions, so the armchair objection goes, one needs to demonstrate that expert intuitions rather than those of ordinary people are sensitive to contingent facts such as cultural, linguistic, socio-economic, or educational background. This article does exactly that. Based on two empirical studies on populations of 573 and 203 (...) trained philosophers, respectively, it demonstrates that expert intuitions vary dramatically according to at least one contingent factor, namely, the linguistic background of the expert: philosophers make different intuitive judgments if their native language is English rather than Dutch, German, or Swedish. These findings cast doubt on the common armchair assumption that philosophical theories based on armchair intuitions are valid beyond the linguistic background against which they were developed. The essay draws on Michel Serres’ writings on education in order to derive from them a general theory. Though the polyglot philosopher never presented his philosophy of education as a formal system, it was a lifelong concern that he addressed from the perspectives of mathematics and physics; literature and myth; art and aesthetics; justice and the law. Ever elusive in his prose style, Serres was a magnetic and infectious educator who, ironically, and perhaps understandably, did not gain the sort of (...) following enjoyed by other French philosophers with whom he cuts such a contrast. The essay assesses the Serresian pedagogy in three key areas: the mutual translatability of the pedagogies of the humanities and arts versus those of the social and hard sciences; the urgent need for an environmental ethics of education; and the permeation of effective instruction by aesthetics. A central notion to our theory of science are "advances" (ideas, data, etc.), which are units passed among scientists and which would be conserved in passing from one possible history to another. Advances are connected to each other by nets of causal influence, and we distinguish strong and weak influences. Around sixty types of advances are grouped into ten classes. As our case study, we examine the beginning of the (...) Old Quantum Theory, using a computer to store and process historical information. Despite its imperative to include all gendered positions under one umbrella, ‘trans’ is continually riven by intramural confrontation over the differences between its masculine and feminine iterations. Whether in political organizing, on social media or in the pages of academic trans theory, it sometimes seems like ‘trans’ is subject to an interminable and gendered custody battle. Dissatisfied with the terms of masc–femme antagonism, this essay uses the gendered interfaces of critique and autotheory to enmesh the work of Jules Gill-Peterson (...) and Paul B. Preciado. Reading into the interdependence of Gill-Peterson’s and Preciado’s texts yields a different theory: trans as an auto-antonym, a word that produces opposite meanings depending on context. Treating trans as auto-antonymic conjures a relational and even erotic escape from the naturalization of gendered antagonism in trans theory, affirming the unexpected bridges, reversals or ‘sex changes’ of specifically trans writing. To examine Heidegger's pedagogy is to be invited into a particular era and cultural reality—starting in Weimar Germany and progressing into the rise and fall of the Third Reich. In his attempt to reform the German university in a strictly hierarchical, authoritarian and nationalistic mold, Heidegger addressed one group of students and professors and not another. The petit‐bourgeois student and the future philosophers he invited with his ‘logic of recruitment’ into the corps of instructors, would share his coded language with (...) its built‐in taboos and censorship. The result was a rhetoric of absolute self‐reference and a semiotic of pure propaganda, based on the evocation of the ancient Greeks in which the philosopher meant to project all that was properly Germanic. Heidegger's rhetoric is exclusionary; its politics and its philosophy are interpenetrating. His lecture courses grew increasingly poeticized, and thus mired in ambiguity, evasion, elision, avoidance, grandiloquence. Parallels are drawn in this essay between Heidegger and our time. Is Heidegger's insistence on autocratic controls within the German university comparable to the corporate positions taken today by some educators? How does the shifting relation between disciplines affect the role of the specialist? How might the sciences morales or humanities, along with the much maligned ‘humanism’, be redefined morally and holistically? (shrink)

Although some attention has been devoted to assessing the attitudes and concerns of businesspeople toward ethics, relatively little attention has focused on the attitudes and concerns of tomorrow's business leaders, today's college students. In this investigation a national sample was utilized to study college students' attitudes toward business ethics, with the results being analyzed by academic classification, academic major, and sex. Results of the investigation indicate that college students are currently somewhat concerned about business ethics in general, and that female (...) students in particular are more concerned about ethical issues than are their male counterparts. In these skeptical and disillusioned times, there are still groups of people scattered throughout the world who are trying to live out utopian dreams. These communities challenge the inevitability and morality of dominant political and economic models. By putting utopian religious ethics into practice, they attest to the real possibility of social alternatives. In Seeds of the Kingdom, Anna L. Peterson reflects on the experiences of two very different communities, one inhabited by impoverished former refugees in the mountains of (...) El Salvador and the other by Amish farmers in the Midwestern U.S. What makes these groups stand out among advocates of environmental protection, political justice, and sustainable development is their religious orientation. They aim, without apology, to embody the reign of God on earth. The Salvadoran community is grounded in Roman Catholic social thought, while the Amish adhere to Anabaptist tradition. Peterson offers a detailed portrait of these communities' history, social organization, religious life, environmental values, and agricultural practices. She discovers both practical and ideological commonalities in these two comparatively successful and sustainable communities, including a strong collective identity, deep attachment to local landscapes, a desire to preserve non-human as well as human lives, and, perhaps unexpectedly, a utopian horizon that provides both goals and the hope of reaching them. By examining the process by which people struggle to live according to a transcendent value system, she sheds light on both the actual and the potential place of religion in public life. Peterson argues that the Amish and Salvadoran communities, geographically and culturally removed from the industrialized West, have relevance for the political and environmental problems of the developed world. These communities have succeeded in the face of significant internal and external challenges, offering important practical and theoretical lessons on how to achieve ecological sustainability and social justice in the wider world. The Philosophy of Nature does not begin, as we expect, with nature. Instead, Hegel describes the practical and theoretical approaches we make to nature as philosophers; that is, in thought and, metaphorically, with our teeth. This ledge on the climb into nature is often overlooked as we rush from the logic into space and time. There may be two reasons for this. The first is a natural expectation that a philosophy of nature begin by describing natural phenomena, not our approaches (...) to them. The second is that the terms ‘practical’ and ‘theoretical’, familiar from the Logic and Philosophy of Spirit, may seem at first glance to be out of place here. As such, "[t]he level of connotation of the visual sign, of its contextual reference and positioning in different discursive fields of meaning and association, is the point where already coded signs intersect with the deep semantic codes of a culture and take on additional more active ideological dimensions" (Hall 56). Coordinates within this domain encode signifying practices, revitalizing the traditional concept of signification as a function of what's signified with respect to a signifier. This book presents the first systematic typological analysis of applicatives across African, American Indian, and East Asian languages. It is also the first to address their functions in discourse, the derivation of their semantic and syntactic properties, and how and why they have changed over time.Applicative constructions are typically described as transitivizing because they allow an intransitive base verb to have a direct object. The term originates from the seventeenth-century missionary grammars of Uto-Aztecan languages. Constructions designated as prepositional, benefactive, and (...) instrumental may refer to the same or similar phenomena. Applicative constructions have been deployed in the development of a range of syntactic theories which have then often been used to explain their functions, usually within the context of Bantu languages. Dr Peterson provides a wealth of cross-linguistic information on discourse-functional, diachronic, and typological aspects of applicative constructions. He documents their unexpected synchronic variety and the diversity of diachronic sources about them. He argues that many standard assumptions about applicatives are unfounded, and provides a clear guide for future language-specific and cross-linguistic research and analysis. (shrink)

Biodiversity informatics produces global biodiversity knowledge through the collection and analysis of biodiversity data using informatics techniques. To do so, biodiversity informatics relies upon data accrual, standardization, transferability, openness, and “invisible” infrastructure. What biodiversity informatics mean to society, however, cannot be adequately understood without recognizing what organizes biodiversity data. Using insights from science and technology studies, we story the organizing “visions” behind the growth of biodiversity informatics infrastructures in Sweden—an early adopter of digital technologies and significant contributor to global biodiversity (...) data—through interviews, scientific literature, governmental reports and popular publications. This case story discloses the organizational formation of Swedish biodiversity informatics infrastructures from the 1970s to the present day, illustrating how situated perspectives or “visions” shaped the philosophies, directions and infrastructures of its biodiversity informatics communities. Specifically, visions related to scientific progress and species loss, their institutionalization, and the need to negotiate external interests from governmental organizations led to unequal development across multiple infrastructures that contribute differently to biodiversity knowledge. We argue that such difference highlights that the social and organizational hurdles for combining biodiversity data are just as significant as the technological challenges and that the seemingly inconsequential organizational aspects of its infrastructure shape what biodiversity data can be brought together, modelled and visualised. This essay argues that the reigning medical and scientific understanding of the endocrine system, which insists on its fundamental biological plasticity, was historically constructed through a dual child–animal metaphor. The work accomplished by such organic metaphors, as Donna Haraway terms them, returns us to the endocrine laboratories and clinics in which they were built in Europe and the United States in the first half of the twentieth century. The child and animal metaphors implanted the concept of plasticity into the human (...) body to the effect of bringing sexed and gendered life under the jurisdiction of science and medicine, where it could not only be normalized in a sense long appreciated by transgender studies but also cultivated towards the ostensible “improvement” and “perfection” of the human. This is also, then, a history of the eugenic heritage of modern endocrinology, which has been largely ignored in recent discussions of plasticity and the body’s materiality. To interrogate the role of foundational organic metaphors in endocrinology is to open up plasticity not only to its historical context but also to radical contestation, making the contemporary assumptions of transgender medicine untimely, particularly the medicalization of the transgender child. This essay discusses a core tenet of pessimism, Afropessimism, in particular. Pessimism claims to be a metatheory analyzing the assumptive logics of the system it critiques. Afropessimists hold that a logical treatment of pessimism is unwarranted because pessimism does not employ a logical treatment of its object. We’ll discuss Afropessimism and, by extension, pessimism, in general, on their own terms as metatheory. We’ll see that a metatheory indirectly follows the logic its object follows directly. From this, a metatheory must hold (...) an assumptive logic of its own, even if superficially disavowed. Consequently, we’ll arrive at a puzzling result when, in this particular case, the metatheory’s claims empty its object of its content, hence the pessimism. (shrink)

Por meio do estudo bibliográfico e jurisprudencial, buscou-se definir o conteúdo do direito à liberdade de expressão e o seu exercício através da internet. Em seguida, passou-se a examinar o polêmico Inquérito das “fake news” (4.781 DF), do qual emanaram-se decisões colidentes com as garantias conferidas à liberdade de expressão. Infant A was born at term with an antenatal diagnosis of gastroschisis. His parents were well informed about the condition and understood that he would require surgery. However, at delivery, his bowel was found to be severely compromised. Infant A returned from theatre with only four centimeters of small bowel. This is physiologically devastating and easily qualifies as ultrashort bowel syndrome. Whilst the prognosis from ultrashort bowel syndrome is greatly improving, the condition continues to carry a significant risk of mortality (...) and morbidity, in part attributable to treatment itself. The cornerstone of management of USBS is provision of intravenous parenteral nutrition. This is not a physiologically normal route of nutrition; it is a medical treatment. Infant A’s parents questioned whether continuation of active treatment was appropriate. If a treatment is not in the patient’s best interests, then it can be argued it is not justified to administer it. Decisions about quality of life are intensely personal. Where there is a significant burden of treatment, even when there is a potential for increased survival, whether the course of treatment is in the child’s best interests must be taken with huge emphasis on the parental perspective and their family values. For well-informed, realistic parents who are welcoming of the full picture of information and implications of their decision, I argue that parents are best placed to make the decision for their child. Long-term PN for USBS may well be a medically encouraged treatment. However, it should not be medically mandated. (shrink)
