In the ground-breaking 2018 judgment of Navtej Singh Johar v. Union of India, the Hon'ble Supreme Court of India ushered in a new era by decriminalizing homosexuality, marking a pivotal moment in the country's legal history. However, this progressive stride was accompanied by persistent questions concerning homosexual rights that remained unexplored within both cultural and legal frameworks. Despite the legal acknowledgment, members of the homosexual community are often professed merely as 'individuals' and not fully integrated into mainstream society. This perception (...) is aggravated by the absence of a societal 'stamp of marriage,' reinforcing their marginalization. In the realm of Hindu law, the sanctity of marriage is deeply rooted in the scriptures, which explicitly define it as the union of 'two souls.' Remarkably, these very scriptures also assert that a soul is inherently without gender, elucidating that gender is a characteristic exclusive to the human body. It is crucial to recognize that Hindu law, including the relevant Acts, draws extensively from these scriptures, making them a fundamental source of legal principles. The legislation, such as the Hindu Marriage Act, essentially serves to codify and organize the pre-existing Hindu law without seeking to undermine the intrinsic values enshrined within the Holy Scriptures. This article aims to delve into the unaddressed aspects of homosexual rights within the contemporary legal framework, shedding light on the denied rights that persist. While global attitudes are progressing towards recognizing and safeguarding homosexual rights, the Indian government and cultural factors appear hesitant to renounce orthodox and conservative stances. This article seeks to analyse and critique these aspects, exploring the challenges hindering the full acceptance and integration of homosexual individuals into the broader societal fabric despite the transformative legal landscape initiated by the Navtej Singh Johar case. Vedānta is one of the oldest philosophical systems. While there are many detailed commentaries on Vedānta, there are very few mathematical descriptions of the different concepts developed there. This article shows how ideas from theoretical computer science can be used to explain Vedānta. The standard ideas of transition systems and modal logic are used to develop a formal description for the different ideas in Vedānta. The generality of the formalism is illustrated via a number of examples including saṃsāra, Patañjali’s Yogasūtras, (...) karma, the three avasthās from the Māṇḍūkya Upaniṣad and the key difference between advaita and dvaita in relation to mokṣa. In this paper we show how defeasible logic could formally account for the non-monotonic properties involved in motivational attitudes like intention and obligation. Usually, normal modal operators are used to represent such attitudes wherein classical logical consequence and the rule of necessitation comes into play, i.e., ⊢A/⊢ □A, that is from ⊢A derive ⊢ □A. This means that such formalisms are affected by the Logical Omniscience problem. We show that policy-based intentions exhibit non-monotonic behaviour which could be captured through a (...) non-monotonic system like defeasible logic. To this end we outline a defeasible logic of intention that specifies how modalities can be introduced and manipulated in a non-monotonic setting without giving rise to the problem of logical omniscience. In a similar way we show how to add deontic modalities defeasibly and how to integrate them with other motivational attitudes like beliefs and goals. Finally we show that the basic aspect of the BOID architecture is captured by this extended framework. (shrink)

Agrobiodiversity is an evident outcome of a long-lasting human–nature relationship, as the continuous use, conservation and management of crops has resulted in biological as well as cultural diversity of seeds and breeds. This paper aims to understand the interlocking of formal and informal seed supply routes by considering the dynamic flow of seeds within networks across the intersections of gender, ethnicity and age in South India as social categories structuring human–nature relations. This changing relationship under formal and informal institutional settings (...) has consequences on performance for men and women in rice seed systems. Undertaking an empirical analysis of the organization of seed management and exchange, we seek to shed light on the gendered organization of agrobiodiversity as a social network. The study builds on Net-Map interviews conducted in 2012, embedded in the larger BioDIVA project in the district of Wayanad in Kerala, India. Based on network analysis, the interactive method employed has enabled identification of important actors in the seed system and the characteristics of their relationships. We look into the gendered structure of information exchange regarding seed varieties and actual seed transactions, while also examining clusters of actors collaborating regarding seed supply. Finally, we identify the institutional gap concerning seed sources left by formal and informal institutions, like the availability of varieties. We show how informal and formal seed systems coexist and overlap due to actors moving between systems and argue that the degree and areas of overlap are shaped by gendered human–nature relations. German philosopher G. W. F. Hegel problematized the term “aesthetics” in his writings on art. This article attempts to capture the tension between Hegel's theory of art and philosophy of art and its impact on the subsequent theorization of art in the twentieth century as consumer or emancipatory. Music, poetry and plastic arts seem to resonate differently with philosophers such as Plato, Aristotle, Kant, Hegel and Adorno. Plato considered music soothing to the soul. In Aristotle, one could trace the oblique (...) beginnings of the tension between a theory of art and a philosophy of art as he questioned the role of art in philosophy. While Kant's approach is more formal and deals with concepts such as beauty, sublime, genius, and the status of aesthetic objects, Hegel grapples with the rational and emotional aspects of works of art which determine whether art is free or under the thralldom of nature. Both Kant and Hegel distinguished artistic from natural beauty. Critical theorists such as Adorno were also influenced by Hegel. Adorno's analysis of concepts such as mimesis forms an important part of his critique of culture industry. Adorno was also emphatic that classical art could only exist as a product of an epoch. Yet in its dialectical form, art serves as a critique of ideology. Progressively, from the nineteenth to the twentieth century, what began as a crevice between a philosophy of art and a theory of art became a chasm. Thus, begins a contentious relationship between art as a pursuit in itself and art for consumption, that is, art as an integral aspect of consumer culture. The new phenomenon of AI art also poses interesting questions about the paradigmatic shift in dynamics between human element and technology. This article would also attempt to trace how art continues to defy reification, while in the process being consumed constantly, recreating and reinventing itself. (shrink)

The action for a massive particle in special relativity can be expressed as the invariant proper length between the end points. In principle, one should be able to construct the quantum theory for such a system by the path integral approach using this action. On the other hand, it is well known that the dynamics of a free, relativistic, spinless massive particle is best described by a scalar field which is equivalent to an infinite number of harmonic oscillators. We clarify (...) the connection between these two—apparently dissimilar—approaches by obtaining the Green function for the system of oscillators from that of the relativistic particle. This is achieved through defining the path integral for a relativistic particle rigorously by two separate approaches. This analysis also shows a connection between square root Lagrangians and the system of harmonic oscillators which is likely to be of value in more general context. (shrink)

Standard models of adolescent risk taking posit that the cognitive abilities of adolescents and adults are equivalent, and that increases in risk taking that occur during adolescence are the result of socio emotional differences in impulsivity, sensation seeking, and lack of self-control. Fuzzy-trace theory incorporates these socio emotional differences. However, it predicts that there are also cognitive differences between adolescents and adults, specifically that there are developmental increases in gist-based intuition that reflects understanding. Gist understanding, as opposed to verbatim-based analysis, (...) generally has been hypothesized to have a protective effect on risk taking in adolescence. Gist understanding is also an essential element of informed consent regarding risks in medical decision- making. Evidence thus supports the argument that adolescents’ status as mature minors should be treated as an exception rather than a presumption, because accuracy in verbatim analysis is not mature gist understanding. Use of the exception should be accompanied by medical experts’ input on the bottom-line gist of risks involved in treatment. (shrink)

This book examines the idea of cosmopolitanism, its reconceptualisations and critiques. It explores the specific institutional and philosophical challenges in constructing a cosmopolitan political community and critically engages with assumptions about the nature and direction of global politics. The volume presents a post-colonial critique of 'Western' cosmopolitanism and suggests alternative frameworks.

The purpose. Critical social philosophy of education strives to provide a radical critique of existing models of education in the so-called Western models of democracy, creating progressive alternative models. In this context, the proposed integrative metatheory, which is based on classical and modern sources, concepts, aims for a comprehensive understanding and reconstruction of the phenomenon of education. One of the main tasks in the sphere of education’s democratization today, therefore, is to bring to education the results of restructuring and democratization (...) of the society, to reflect changes in conditions of life and thinking, experience and transformation of subjectivity in the context of the technological revolution and globalization. Methodology. The critical social theory, which developed in the framework of contemporary neo-Marxism, indicates the need for a thorough analysis of society, however, unlike other theoretical concepts and research programs in order to analyze not a fixation and a statement of the existing social givens. On the contrary, critical analysis of society involves the identification of existing antagonistic, alienating factors that distort public communication.The subject of social analysis is the whole sphere of human and non-human nature, which interacts a person depend on it, the whole system of relations between society and nature, society and man, which is covered by the historical practice of conscious – "praxis". The representative of "pure science" isn't the learning, research subject. He is a public a person, which is the totality of all social definitions included in society and its constituent individuals. For such a "total subject" Object of interest is not something external; on the contrary, the latter appears as a product of his own activity. The scientific novelty examines trends in educational institutions and models of globalizing society in the context of our particular relationship of education and society, man and the state, and processes. The research and systematic analysis of neoliberal reforms at the level of society in general and education in particular are conducted. It examines substantive, structural and functional characteristics of the concept of «critical social philosophy of education» in the context of institutional tendencies of social life, as well as forms and possibilities of its methodological application. It consider a model of «critical social philosophy of education», as embodied in the programs of social development and learning, which are primarily designed to teach people how to lead an independent and original research themselves, society and knowledge systems. However, it is proved that the models and programs should not be cut off from any individual and the collective system of moral and social values, theoretical and applied training, nor from further use of the acquired values, norms and skills in everyday life, science, or in production, sphere of all social institutions. Conclusions. Critical philosophical, educational, pedagogical-psychological surprisingly theory, its models and concepts seek to redefine public and private and the public mind. Based on these grounds, in the future, it allows philosophy of education to develop a more inclusive philosophical vision of education, to apply directly to the problems of democratization and changes in social relations in the direction of equality and social justice in the field of education. The point of view of socio-philosophical and philosophical-еducational, pedagogical-psychological, normative understanding and social critics also requires the use of active efforts in the reconstruuction of education and society, the social vision of what education and human life can be and what their specific limitations in existing societies. Moral philosophers have often felt the need of a concept which would cover all those cases where we are prevented from achieving our ends through no fault of our own: a criterion for saying when failure is not blameworthy. The deontologists thought we were not to blame for actions done in genuine ignorance of the facts. Kant declared in a famous passage that we were not morally responsible for failures due to the “niggardliness of stepmother nature.” In this article I (...) want to introduce into moral philosophy a new concept for clarifying the failures for which we are not to blame: the notion of scarcity, taken from economic theory. In this paper we take a fresh look at the information retrieval problem of balancing recall with precision in electronic document extraction. We examine the IR constructs of uncertainty, context and relevance, proposing a new process model for context learning, and introducing a new IT artifact designed to support user driven learning by leveraging explicit knowledge to discover implicit knowledge within a corpus of documents. The IT artifact is a prototype designed to present a small set of extracted documents from (...) a targeted corpus based upon user inputted criteria. The prototype provides the user with the opportunity to balance exploration and exploitation, via iterative relevance feedback to address the problem of imprecision resulting from uncertainty. We model the problem as an exploration–exploitation dilemma and apply it to a specific case of IR called eDiscovery. We conduct a series of behavioral experiments to evaluate the model and the artifact. Our initial findings indicate that the proposed model and the artifact improve performance in the IR result. Quantum theories constructed on the noncommutative spacetime called the Groenewold–Moyal plane exhibit many interesting properties such as Lorentz and CPT noninvariance, causality violation and twisted statistics. We show that such violations lead to many striking features that may be tested experimentally. These theories predict Pauli forbidden transitions due to twisted statistics, anisotropies in the cosmic microwave background radiation due to correlations of observables in spacelike regions and Lorentz and CPT violations in scattering amplitudes.

The importance of communities in strengthening the ethics of international collaborative research is increasingly highlighted, but there has been much debate about the meaning of the term ‘community’ and its specific normative contribution. We argue that ‘community’ is a contingent concept that plays an important normative role in research through the existence of morally significant interplay between notions of community and individuality. We draw on experience of community engagement in rural Kenya to illustrate two aspects of this interplay: (i) that (...) taking individual informed consent seriously involves understanding and addressing the influence of communities in which individuals’ lives are embedded; (ii) that individual participation can generate risks and benefits for communities as part of the wider implications of research. We further argue that the contingent nature of a community means that defining boundaries is generally a normative process itself, with ethical implications. Community engagement supports the enactment of normative roles; building mutual understanding and trust between researchers and community members have been important goals in Kilifi, requiring a broad range of approaches. Ethical dilemmas are continuously generated as part of these engagement activities, including the risks of perverse outcomes related to existing social relations in communities and conditions of ‘half knowing’ intrinsic to processes of developing new understandings. He presents Kant's premises and conclusions on the major issues and provides a detailed discussion of Rand's criticisms of Kant. Walsh argues that Rand has seriously misread Kant on several points. Her interpretation—that Kant saw our sensory grasp of the world as "delusion," rather than knowledge—resembles that of Arthur Schopenhauer, except that the latter declares Kant's doctrine worthy of praise instead of (...) condemnation.
