Diese Fragen werden systematisch differenziert und historisch diskutiert. Die Autorin verdeutlicht mit dem Nachweis der entscheidenden Funktion der Urteilskraft die Verbindungen und Bruchstellen zwischen theoretischer und praktischer Philosophie. Der Urteilskraft kommt als einer individuellen Fähigkeit die Aufgabe zu, die Reaktion Anderer auf (...) das eigene Fürwahrhalten ohne eine letzte allgemeine Regel einzuschätzen. Im Beitrag werden Veränderungen der Kommunikation durch digitale Medien, ihre psychischen Bedeutungen und Folgen, u. a. anhand von empirischen Befunden zu Social-Media-Praktiken von Jugendlichen und von Eltern thematisiert. Bezugsrahmen der Analyse sind dabei kulturelle Wandlungen sowie soziale und psychische Bedeutungen von Aufmerksamkeit: geteilte Aufmerksamkeit als ein Kern der Kommunikation, aber auch die für psychische Entwicklung notwendige geschenkte, für den anderen oder für anderes offene Aufmerksamkeit als ein wesentliches Moment der Zuwendung, Empathie und Bezogenheit – im Gegensatz zu selbstbezogener Aufmerksamkeit und (...) instrumenteller Aufmerksamkeitslenkung. Überdies werden Folgen fragmentierter Aufmerksamkeit, wie sie aus der Überlagerung von Online- und Offline-Kommunikation resultiert, für psychische Entwicklungen betrachtet. (shrink)

Dieses Werk stellt das Denken zweier Geistesgrößen, Leibnizens und Fichtes sich gegenüber und vergleicht es. Fichte sieht in Leibniz einen Vorläufer und erwähnt ihn mit liebevoller Bewunderung. Fichtes Wissenschaftslehre von 1801/02 wird Leibnizens „Monadologie“ aufgreifen und Leibnizens Gedanken einer prästabilierten Harmonie. Beide Philosophen verstehen sich als Freiheitsapostel, wobei bei Leibniz Gott eine genaue Notion jedes Individuums hat, die Freiheit ein mentaler Akt ist, bei Fichte jedes Individuum ein je bestimmtes Soll hat, das es, Freiheit verwirklichend, im Leben zu erfüllen gilt. (...) Fichte erkennt in Leibniz einen Vorläufer der eigenen Transzendentalphilosophie. Ein Unterschied zwischen den beiden Denkern besteht darin, dass Leibniz stets die Individualität im Auge hat, wo Fichte vom reinen Vernunftwesen ausgeht, dessen individuelle Pathologien ihn nicht interessieren. Beide Philosophen supponieren, dass die Welt ein Ende habe, Leibniz, auf dass das Weltgericht stattfinden könne, Fichte, auf dass in einer neuen Welt nur noch die sittlichen Individuen wiedergeboren werden. Der vorliegende Text versucht auch, den Bogen zu schlagen von der philosophischen Tradition des Abendlandes, und insbesondere von Leibniz, Kant und Fichte zu einer Gotteslehre auf Grund der modernen Physik. Die hochenergetische Urmaße wird gefasst als psychophysische Energeia, die sich – im Leibnizschen Sinne Wissen, Macht und Wollen – aus dem Nichts kontrahiert hat und nun ins All explodiert. In der Kontraktion aus dem ursprünglich Verwobenen hat das Absolute sich vom Nichts, das Gute sich vom Bösen geschieden, entsteht das Übel als privatio boni. (shrink)

Wie kann der Prozess des Denkens erfasst werden, wenn doch unsere Reflexionen bereits das Resultat dessen sind, was erfasst werden soll? Die Tatigkeit des Denkens in Worte zu fassen, scheint dazu verurteilt zu sein, hinter dem Phanomen her zu hinken, das erfasst werden sollte. Das Denken zu untersuchen, ohne seine Prozesshaftigkeit auszuklammern, kann als radikale Reflexion bezeichnet werden. Sie behauptet nicht, ihren Gegenstand als unabhangig von der Art des Herangehens "gegeben" zu beschreiben, sondern stellt sich der Denkerfahrung und auch den (...) Gefuhlsnuancen, die eine wichtige Rolle beim Denken und Artikulieren spielen. Sie manifestiert sich in originellen Ansatzen aus Philosophie, Psychotherapie, Anthropologie und Kognitionswissenschaften und bringt innovative Denkstile jenseits hergebrachter Dualismen hervor. One implication of Vetter's theory of modality is that necessity and possibility are regarded as unitary natural kinds. In this paper, I argue that from the perspective of the philosophy of causation, there are good reasons to distinguish between different kinds of necessity: causal necessity, which is nomologically necessary, and non-causal necessity, which is metaphysically necessary. One challenge for Vetter's approach is to explain this distinction.

Zusammenfassung Im internationalen Diskurs sind feministische Perspektiven auf die Medizinethik bereits etabliert. Demgegenüber scheinen diese bislang nur vereinzelt in den deutschsprachigen medizinethischen Diskurs eingebracht zu werden. In diesem Artikel untersuchen wir, welche feministischen Perspektiven im deutschsprachigen medizinethischen Diskurs vertreten sind, und schlagen weitere Ansätze für eine feministische Medizinethik vor. Zu diesem Zweck zeichnen wir mittels einer systematisierten Literaturrecherche feministische Perspektiven im deutschsprachigen medizinethischen Diskurs seit der Etablierung der Medizinethik als eigenständiger institutionalisierter Disziplin nach. Wir analysieren, welche Themen bereits innerhalb der (...) Medizinethik aus einer feministischen Perspektive untersucht worden sind, und identifizieren Leerstellen. Basierend auf der Literaturrecherche, unseren eigenen Vorarbeiten sowie der Zusammenarbeit in der Arbeitsgruppe in der Akademie für Ethik in der Medizin „Feministische Perspektiven in der Bio- und Medizinethik“ stellen wir drei Thesen vor, die aus unserer Sicht einer Weiterentwicklung des deutschsprachigen medizinethischen Diskurses dienen können. Die erste These bezieht sich auf die Ziele feministischer Medizinethiken und besagt, dass diese (epistemische) Gerechtigkeit anstreben. Die zweite These stellt zentrale Eigenschaften von feministischen Medizinethiken als kritisch und kontext-sensibel heraus. In der dritten These diskutieren wir Intersektionalität und Postkolonialismus als theoretische Ansätze, die zu einer epistemisch gerechten, kritischen und kontext-sensiblen Medizinethik beitragen können. Wir argumentieren, dass feministische Perspektiven grundständig verankert werden sollten. Lassen sich alle derartigen Zustände auf Hirnzustände reduzieren? Was genau zeichnet mentale Zustände aus, und was können wir über die mentalen Zustände unserer Mitmenschen wissen? Dieses Handbuch liefert einen systematischen Überblick über Positionen und Fragestellungen in der Philosophie des Geistes. Ein zentrales Themengebiet ist dabei das Verhältnis zwischen mentalen Zuständen und Hirnzuständen: physikalistische und nicht-physikalistische Ansätze sowie das Problem der mentalen Verursachung. Darüber hinaus werden (...) Fragestellungen zum Charakter des Mentalen und zu verschiedenen Typen mentaler Zustände in den Blick genommen, etwa die Debatten über Qualia, Intentionalität, Gedächtnis und das Verhältnis zwischen Denken und Sprache. Die vorliegende Arbeit hat zum Ziel, „dem Latinisten/Romanisten für eine Reihe vulgärlat. Phänomene griech. Belege zur Verfügung zu stellen“…; „wer ein primär gräzistisches Interesse verfolgt, ….wird eine Antwort auf die Frage finden, welche „ungewöhnlichen“ Schreibungen (in griechischen Texten JNP) Verf. für den Niederschlag von Prozessen der lat. Sprachgeschichte hält“ (S. 18). Die Verf. geht dem gr.-lat. Sprachkontakt der Kaiserzeit, der früh- und mittelbyzantinischen Epoche nach (bis etwa zur Jahrtausendwende), und zwar anhand der lat. Lehnwörter (LWW) im Gr. von der Antike (...) bis in die neugriechischen Dialekte, nicht wie üblich dem umgekehrten Einfluss. „Lehnwörter sind eine ausgezeichnete sprachgeschichtliche Quelle sowohl für die Nehmer – als auch für die Gebersprache“, …„Zeugen eines historischen Vorgangs, nämlich des Sprachkontakts und damit Kulturkontakts;“… an ihnen „lassen sich …Akkulturationsphänomene zeigen“ (S. 1). Dass das byz. Gr. und das Ngr. eine Fülle von lat. LWW enthalten, die durch die historische Rolle Byzanz‘ als Nachfolger des Römischen Reiches, aber auch durch die Präsenz von Romanen in Südosteuropa bis heute (Rumänen, Vlachen/Aromunen) zu erklären sind, hat die Forschung am Ende des 19. und in den ersten Dezennien des 20. Jhd. stärker beschäftigt, und die Verf. setzt sich in ihrer „Einführung“ ausführlich mit den Ergebnissen ihrer Vorgänger auseinander: Gleich, ob diese einen altertumswissenschaftlichen (L. Hahn), papyrologischen, epigraphischen, romanistischen oder byzantinistisch-neogräzistischen Hintergrund (G. Meyer, M. Triantaphyllides) hatten – das Thema, so stellt die Verf. zu Recht fest, ist nach den Veröffentlichungen Zilliacus' (1935) und Dölgers umfangreicher Rez. (BZ 36, 108-117) seit den dreissiger Jahren praktisch liegengeblieben, wenn man von der Arbeit der beiden Kahanes absieht, in denen freilich (S. 15)„Lautliches und Morphologisches ausser Betracht bleibe“ (S. 15). So ist denn für die Romanistik, ausser für J. Kramer und seine Schule, das „Balkanlatein“ weiterhin eine feste Grösse: Zu ihm wird traditionell das Rumänische mit seinen Dialekten (Aromunisch und Megleno – Rumänisch), der lat. This is the third part of a „controversy“, in which I respond to comments from Vera Hoffmann-Kolss, Johannes Hübner, Boris Kment, Kathrin Koslicki, Annina Loets, and Ulrich Metschl concerning my earlier paper „Möglichkeit ohne mögliche Welten“ („possibility without possible worlds“).

In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. Metaphysical anti-realism is a large and heterogeneous group of views that do not share a common thesis but only share a certain family resemblance. Views as different as mathematical nominalism—the view that numbers do not exist—, ontological relativism—the view that what exists depends on a perspective—, and modal conventionalism—-the view that modal facts are conventional—all are versions of metaphysical anti-realism. As the latter two examples suggest, relativist ideas play a starring role in many versions of metaphysical anti-realism. But what does (...) it mean for the existence of something to “depend on” a perspective, or for a modal fact to “depend on” a convention? We can distinguish between various dependence relations, giving rise to an array of drastically different forms of metaphysical anti-realism. This article offers a guided tour. I develop a systematic distinction between various forms of metaphysical anti-realism with a focus on the role of relativist ideas in this landscape. (shrink)

New York: SUNY P, 2008. 258 pp.This collection takes up the uses of psychoanalysis for cultural studies in the new millennium. Its editors and contributors ask, “Where is psychoanalysis in contemporary thought?” At a time when the empirically based psychologies have long repudiated (...) the “talking cure” to the extent that the unconscious is not visible or easily measured, and when, on the other hand, psychoanalysis has been associated in the humanities with a radical political and social agenda, disappointed hopes for change have led many to throw the baby of psychoanalysis out with the bathwater of a utopian vision of transformation. The question now remains: “Whither psychoanalysis?” To answer this question (which is also a demand), the editors first acknowledge that the critique and curtailing of psychoanalytic thought in the cultural studies programs across the country in the last decade or so has been influenced by the works of Michel Foucault, his disciples, and the New Historicism. At the same time, they believe that the political, psychological, and moral dangers of embracing a knowing and cynical postmodernism that fosters hollow consumerism premised on modes of subjectivity that “neither ‘express’ interiority nor bear any relation to a lived past” are a real and present danger in contemporary life. “That the triumph of such a view has coincided with intellectuals’ renewed suspicion of psychoanalysis should, we believe, give us pause” (8). The essays that constitute the present volume thus insist on the persistence of the desire of the analyst: for knowledge of self and other, and by those who long for interpretive insight into interior lives and social places. The volume thus poses for its readers twin questions: “Why do we continue to desire psychoanalysis, and what should its role be in the cultural criticism of the new millennium?”This collection grew out of a conference organized around this question and thus reflects the varied but not necessarily interconnected papers offered in that setting. In an effort to provide some interconnections, the collection is divided into four sections grouped around the topics of psychoanalysis and the future of cultural criticism, collectivity, the author, and sexuality. The grouping does not, in my estimation, provide unity or coherence to the volume as a whole; nevertheless, each article emerges on its own terms as a strong contribution to the general field of psychoanalytic cultural criticism and critical theory. Henry Sussman’s “Psychoanalysis, Religion, and Cultural Criticism at the Millennium” provides an anchoring perspective to the volume, addressing with particular urgency the mutually transformative desire of and for analysis modeled on the transference/countertransference clinical encounter. This analogy [End Page 153] suggestively sets the stage for a like transformative intervention by the analyst in a cultural critique, while acknowledging that cultural studies provides the best interpretation and assessment of the ways that psychoanalysis operates historically and clinically in contemporary society. Sussman—and indeed many of the contributors—underscores the editors’ organizing declaration that since psychoanalysis derived from lived human experience it stands to reason that “analysis is both the product of and answer to suffering” (15).Thus it comes as something of a surprise that one of its editors, Greg Forter, in “F. Scott Fitzgerald, Psychobiography, and the Fin-de-Siecle Crisis in Masculinity,” locks the subject of psychoanalysis into a stranglehold with his presuppositions about the limits of history and the origins of psychoanalysis in the modern moment: “Because the theory and techniques of psychoanalysis were developed by analyzing modern men and women, psychoanalysis may be a theory of modern subjectivity rather than of subjectivity as such, and its mode of inquiry may be best suited to analyzing the phenomena of modernity” (148). Contrast this limiting and limited sense of the place of psychoanalysis in history (and the concomitant restriction of its utility expressed ironically in a volume with two major articles on premodern cultural texts!) to recent remarks in a new book by Christopher Bollas: “For thousands of years there has been an unconscious preconception of psychoanalysis. The aim of this paper is to show some of my contributions to the exegesis of Quine’s philosophy, emphasizing the role played by notions such as empathy and transcendence in his philosophical system. I hold that Quine is a rigorous systematic philosopher, and that in order to understand each one of his theses and critiques we need to analyze them within the totality of his philosophical investigations. I believe that his system derives from what we call his epistemological project and (...) that all his philosophical theses are founded in his theory of language learning. I also maintain that Quine’s philosophy shows a very strong pragmatic aspect more closely related to Wittgenstein’s tradition and that one of speech acts theorists than to the Skinnerian tradition with which Quine is often associated. In addition I believe that the overall position of his theses has been presented in Word and Object, and that all his subsequent works served to clarify or complement his ideas, not to change them. Thus, I do not agree with those who argue that Quine changed his philosophical position in the course of time. (shrink)

We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

Health care often involves ethically difficult situations that may disquiet the conscience. The purpose of this study was to develop a questionnaire for identifying various perceptions of conscience within a framework based on the literature and on explorative interviews about perceptions of conscience (Perceptions of Conscience Questionnaire). The questionnaire was tested on a sample of 444 registered nurses, enrolled nurses, nurses’ assistants and physicians. The data were analysed using principal component analysis to explore possible dimensions of perceptions of conscience. The (...) results showed six dimensions, found also in theory and empirical health care studies. Conscience was perceived as authority, a warning signal, demanding sensitivity, an asset, a burden and depending on culture. We conclude that the Perceptions of Conscience Questionnaire is valid for assessing some perceptions of conscience relevant to health care providers. (shrink)

Incest is a crime in most societies. In the United States, incest is punishable in almost every state with sentences going as far as 20 and 30 years in prison, and even a life sentence. Yet the reasons traditionally proffered in justification of criminalization of incest—respecting religion and universal tradition; avoiding genetic abnormalities; protecting the family unit; preventing sexual abuse and sexual imposition; and precluding immorality—at a close examination, reveal their under- and over-inclusiveness, inconsistency or outright inadequacy. It appears that (...) the true reason behind the long history of the incest laws is the feeling of repulsion and disgust this tabooed practice tends to evoke in the majority of population. However, in the absence of wrongdoing, neither a historic taboo nor the sense of repulsion and disgust legitimizes criminalization of an act. (shrink)

Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

Plants synthesize with photons, so we commonly say. This article on photosynthesis introduces a notion of concepts that are to be thought of as capital and yet natural. They constitute a metaphysics of meteora alloys and copiousness through “actively lacking” a “proper” notion of conception.

The defense of necessity, also known as the “choice of evils,” reflects popular moral intuitions and common sense: sometimes, breaking the rules is the right—indeed, the only—thing to do in order to avoid a greater evil. Citing a classic example, mountain climbers may break into a cabin to wait out a deadly snow storm and appropriate the owner’s provisions because their property violations are a lesser evil compared to the loss of life. At the same time, this defense contradicts the (...) fundamental principles of criminal responsibility in that it authorizes violation of rights of innocent bystanders. By allowing the mountain climbers to override the property rights of the cabin owner, the defense effectively forbids the cabin owner to use force in response—a different rule would perpetuate violence. This outcome is at odds with the basic criminal law doctrines. There is no general duty to rescue in Anglo-American law. Yet, by forbidding the cabin owner to use force, the defense of necessity essentially imposes on him the duty to forego his interests in favor of those of the mountain climbers. The paper explores the origins and boundaries of the defense of necessity. It argues that the existing public and private theories of necessity are unsatisfactory and concludes that a viable theory of necessity should be able to explain why it is sometimes permissible to override individual rights of citizens without their consent or fault. In this article, I try to go beyond the traditional objections to strict liability public welfare offenses and confront other possible justifications for punishing non-culpable conduct. Specifically, I consider the following arguments:Penalties for public welfare offenses are punishment by name only, thus traditional justifications for punishment are not needed;Even if those penalties are punishment, punishing those who produce or threaten significant harm to others is not necessarily unjust; andEven if such punishment is not entirely just, it is consistent with other (...) widely accepted criminal law doctrines. A large network of alchemical agents spread from the tiny, land-locked duchy of Saxe- Gotha-Altenburg outward across Europe. At its centre, Duke Friedrich I meticulously documented his interactions with many alchemical personalities during the 1670s and 1680s. The story of one such personality illustrates the changing meanings of distant alchemical knowledge both to the inner circle of courtly alchemists and to a larger alchemical republic. Born near Gotha, Johann Otto von Hellwig built his pan-European career on a youthful stay on (...) Java. To some, this indicated his access to exotic naturalia which might be imported to a centre of collection, such as Gotha. For others, Hellwig could access a wisdom hidden abroad since ancient Egypt, which should be disseminated among widely dispersed adepts. These viewpoints indicate different functions for distant knowledge, as well as differing desired trajectories for this knowledge. (shrink)

Departing from the premise that the poststructuralist paradigm still reigns supreme in feminist and gender theory, that is, despite the niche efforts made in the past two decades to challenge it linked to the so called “speculative” turn or the materialisms (and realisms) emerging from the feminist field itself (such as the Utrecht School, inspired by Rosi Braidotti), we set the call for papers for the issue before you in terms that would invite authors ready to challenge the dominant epistemic (...) framework. We invited papers that engage with materialism(s), realism(s), sciences and projects engaged in rethinking the post-human beyond the poststructuralist (and, we dare say, postmodern/ist) norm. -/- . A claim made by Buddhist or Buddhism-affine scholars such as Michael LaTorra and James Hughes is that transhumanism, neuroscience, and the teachings of Buddhism are compatible because they aim to alleviate suffering and pain and attain a stable state of happiness. This claim can be challenged. At first glance, the approach seems valid, because since the 1980s there have been dialogues and scientific collaborations with representatives of Tibetan Buddhism and scientists on the topics of neuroscience, consciousness, ethics and technology, and (...) in this context new interpretations of Buddhist thought have emerged such as ‘Buddhist modernism’ (E. Thompson). In this discussion note, however, two main arguments are advanced as to why the claim and terminology of Buddhist transhumanism are difficult to reconcile with Buddhist terminology, values, and methods: (1) the difference between the use of such methods as meditation and contemplation and the application of so-called human enhancement technologies (2) and differences concerning self-understanding in Western science and Buddhism. According to the doctrine of Super-Humeanism, the world’s mosaic consists only of permanent matter points and changing spatial relations, while all the other entities and features figuring in scientific theories are nomological parameters, whose role is merely to build the best law system. In this paper, I develop an argument against Super-Humeanism by pointing out that it is vulnerable to and does not have the resources to solve the well-known problem of immanent comparisons. Firstly, I show that it cannot endorse (...) a fundamentalist solution à la Lewis, since its two pillars—a minimalist ontology and a best system account of lawhood—would generate, together, a tedious problem of internal coherence. Secondly, I consider anti-fundamentalist strategies, proposed within Humeanism, and find them inapplicable to the Super-Humean doctrine. The concern is that, since it is impossible to choose the best law system within Super-Humeanism, this doctrine may be charged with incoherence. (shrink)

In this paper, I discuss whether the results of loop quantum gravity (LQG) constitute a fatal blow to Humeanism. There is at least a prima facie reason for believing so: while Humeanism regards spatiotemporal relations as fundamental, LQG describes the fundamental layer of our reality in terms of spin networks, which are not in spacetime. However, the question should be tackled more carefully. After explaining the importance of the debate on the tenability of Humeanism in light of LQG, and having (...) presented the Humean doctrine, I review two cases which present serious threats to Humeanism, one concerning the fundamentality of vectorial quantities and the other concerning quantum entanglement. In particular, I recall the strategies that are usually employed in these two cases in order to save Humeanism: in the first case, the strategy consists in amending the characterization of the Humean mosaic; in the second case, it consists in adopting a realist or nomological interpretation of the wave function. These solutions will turn out to be helpful in my discussion of LQG where, after describing LQG, I show that Humeans might save their doctrine either by endorsing a realist interpretation of spin networks, or by giving them a nomological status and, at the same time, by revisiting the characterization of the Humean mosaic.
