The paper discusses Sosa’s view of intuitional knowledge and raises the question of the nature of reflective justification of intuitional beliefs. It is assumed, in agreement with Sosa, that pieces of belief of good researchers are typically reflectively justified, in addition to being immediately, first-level justified. Sosa has convincingly argued that reflective justification typically mobilizes and indeed should mobilize capacities distinct from the original capacity that has produced the belief-candidate for being justified, in order to assess (...) the reliability of the original capacity. It has to go beyond justifiers that are of the same-kind as first-level immediate ones, in order to enlarge the circle of justification, and is, therefore, holistic and coherentist. But if this holds, it seems that reflective justifi cation of armchair beliefs, presumably produced by intuition and some reasoning, should revert to empirical considerations testifying to the reliability of intuition and reasoning. Therefore, it typically combines, in an articulated way, a posteriori elements contributing to the thinker’s reflective trust in her armchair capacities. In short, the paper argues that Sosa’s own view of second-order justification goes better with a more aposteriorist view, if it does not even force such a view. (shrink)

This open access book provides the first explicit case study for an application of the method of reflective equilibrium (RE), using it to develop and defend a precautionary principle. It thereby makes an important and original contribution to questions of philosophical method and methodology. The book shows step-by-step how RE is applied, and develops a methodological framework which will be useful for everyone who wishes to use reflective equilibrium. With respect to precautionary principles, the book demonstrates how a (...) rights-based precautionary principle can be constructed and defended. The case study succeeds in demonstrating that RE can be successfully applied and puts real constraints on the justification process. This is all the more remarkable as the case study was designed as an open-ended process, without presupposing any specific results. This book will be highly relevant both to people interested in philosophical methodology and epistemology, as well as to researchers who are interested in using philosophical methods and tools and applying them to practical problems. The second part of this study, called "Agrippa and the Problem of Justification," examines Agrippa's contribution to Pyrrhonism, a systematic reduction of its procedures which came to be known as the "Five Modes Leading to the Suspension of Belief." These modes present a completely general procedure for refuting any claim a dogmatist might make. Though largely unnoticed, there is, according to Fogelin, an uncanny resemblance between problems posed by Agrippa's "Five Modes" and those that contemporary epistemologists address under the heading of a theory of justification. Fogelin examines the strongest contemporary theories of justification--in both foundationalist and anti-foundationalist forms. The conclusion is that recent philosophical writings on justification have made no significant progress in responding to the Pyrrhonian problems these writings have addressed. (shrink)

Carson Strong has recently argued that wide reflective equilibrium (WRE) is an unacceptable method of justification in bioethics. In its place, Strong recommends a methodology in which certain foundational moral judgments play a central role in the justification of moral beliefs, and coherence plays a limited justificatory role in that the rest of our judgments are made to cohere with these foundational judgments. In this paper, I argue that Strong’s chief criticisms of WRE are unsuccessful and that (...) his proposed alternative is in fact just another version of WRE. In the course of doing so, I specify which theses are central to WRE and which are not, and thus, provide a response to an additional objection, advanced by Peter Singer, that WRE is vacuous. I conclude by arguing that there may be better prospects for advancing the debate regarding methodology in bioethics if we focus on restricted epistemic and methodological theses rather than broad approaches, such as WRE, that come in many different varieties. How should we proceed when searching for justified answers to normative questions? A prominent proposal is to use the method of reflective equilibrium (RE). Its basic Idea—that we should start from our existing judgments about relevant cases and bring them into equilibrium with systematic principles—is readily recited, but beyond that, conceptions of RE often stay sketchy. RE is seldom explicitly implemented, which makes it difficult to critically evaluate the method and to assess its potential. In my dissertation, I present (...) the first explicit and detailed case study for an application of RE, using it to develop and defend a precautionary principle. -/- The dissertation is divided in two parts, a theoretical and an applied part. In part I, I introduce and operationalize a specific conception of RE. I first describe the central elements of RE by drawing on the most elaborate and fleshed-out conceptions of RE that can be found in the literature. Then, I survey and analyze previous applications of RE in order to both learn from them and identify desiderata for my own case study. Based on a small-scale, exploratory case study, the method is further concretized and operationalized for the implementation in my main case study on the justification of a precautionary principle. -/- In part II, this operationalization is tested in a complex case study that aims at justifying a precautionary principle which is applicable to problems arising from global climate change. In order to be able to select relevant commitments about central problems concerning precautionary principles (PPs), I start with a literature survey. The survey gives an overview on existing proposals for PPs, on which grounds they are defended, and the main objections against them. On this basis, I develop and describe the initial setup for the case study, which is conducted in three main steps and allows to examine different aspects of a RE-application. Thereby, I show that RE can be applied successfully to real problems. I go on to discuss a number of points that are not given sufficient attention in the RE literature so far. With respect to precautionary principles, I show how the commonly discussed principles fail to do justice to ethical considerations, and argue that the application of such principles should instead be triggered by threats of rights violations. In A Theory of Justice (1971), John Rawls introduces the concept of “reflective equilibrium.” Although there are innumerable references to and discussions of this concept in the literature, there is, to the present author's knowledge, no discussion of the most important question: Why reflective equilibrium? In particular, the question arises: Is the method of reflective equilibrium applicable to the choice of this method itself? Rawls's drawing of parallels between Kant's moral theory and his own suggests that his (...) concept of “reflective equilibrium” is on a par with Kant's concept of “transcendental deduction.” Treating these two approaches to justification as paradigmatic, I consider their respective merits in meeting the reflexive challenge, i.e., in offering a justification for choice of mode of justification. My enquiry into this topic comprises three parts. In this first part, I raise the issue of the reflexivity of justification and question whether the reflexive challenge can be met within the framework of A Theory of Justice. (shrink)

This is not a work of historical scholarship, but a provocative attempt to apply ancient Pyrrhonism and the later Wittgenstein to the problems of contemporary analytic epistemology.

The paper addresses the possibility of providing a meta-justification of what appears to be crucial epistemic desiderata involved in the method of reflective equilibrium. I argue that although the method of reflective equilibrium appears to be widely in use in moral theorising, the prospects of providing a meta-justification of crucial epistemic desiderata are rather bleak. Nor is the requirement that a meta-justification be provided obviously misguided. Healthcare priority-setting institutions have good reason to want to demonstrate that their decisions are morally justified—and those who contribute to and use the health service have good reason to hope for the same. However, finding a moral basis on which to evaluate healthcare priority-setting is difficult. Substantive approaches are vulnerable to reasonable disagreement about the appropriate grounds for allocating resources, while procedural approaches may be indeterminate and insufficient to ensure a just distribution. In this paper, we set out a complementary, (...) coherence-based approach to the evaluation of healthcare priority-setting. Drawing on Rawls, we argue that an institutional priority-setter’s claim to moral justification can be assessed, in part, based on the extent to which its many normative commitments are mutually supportive and free from dissonance; that is, on the ability to establish narrow reflective equilibrium across the normative content of a priority-setter’s policy and practice. While we do not suggest that the establishment of such equilibrium is sufficient for moral justification, we argue that failure to do so might—like the proverbial canary in the coalmine—act as a generalised warning that something is awry. We offer a theoretical argument in support of this view and briefly outline a practical method for systematically examining coherence across priority-setting policy and practice. (shrink)

Smithies presents an account of justification that ties it to an idealized view of reflection. I argue that no such account can work. More than this, I argue that the kind of idealization which Smithies offers loses contact with the very phenomenon of reflection which he intends to illuminate. I also discuss how Smithies's view bears on the internalism/externalism controversy.

This book is a collection of essays on various problems arising in connection with John Rawls's theory of justice. Its focus is the method of wide reflective equilibrium. The first half of the book begins with Daniels's well-known essay "Wide Reflective Equilibrium and Theory Acceptance in Ethics" and ends with an excellent discussion of the role of reflective equilibrium in Rawls's Political Liberalism. The essays in the second part discuss justice in health care. They are of interest (...) in their own right, and also as illustrating Daniels's view that for those practicing the method of reflective equilibrium, applied moral philosophy is integral to the process of moral theorizing. Daniels says that the essays do not constitute a systematic treatment of wide reflective equilibrium. But they display a much higher degree of thematic coherence than is usual in a collection, and they read much like the chapters of a monograph. (shrink)

This text assumes that reflection on the environment requires consideration of the role of technology and that reflection on technology cannot responsibly omit considering the environment. Furthermore, reflection on the environment-as-encountered and technology-as-encountered and the correlative types of encountering cannot stop before facing the problems of justifying action and valuing as well as cognition. Eleven reflective analyses are included and it is hoped that discussion of them in small groups will not only foster deeper insight into these issues but (...) also greater skill at phenomenological investigation, i.e., reflective analysis. Justification as Ignorance offers an original account of epistemic justification as both non-factive and luminous, vindicating core internalist intuitions without construing justification as an internal condition knowable by reflection alone. Sven Rosenkranz conceives of justification, in its doxastic and propositional varieties, as a kind of epistemic possibility of knowing and of being in a position to know. His account contrasts with recent alternative views that characterize justification in terms of the metaphysical possibility of knowing. Instead, (...) he develops a suitable non-normal multi-modal epistemic logic for knowledge and being in a position to know that respects the finding that these notions create hyperintensional contexts. In the third, longest part I offer a new perspective on the soterioriological significance of „good works“ on the basis of a new relationship between creator and creature, a concrete anthropology of action as mediation between subjectivity and objectivity, and the irreducible involvement of the free and responsible subject in the very believing relationship to God. I try to reinstate „good works“ as the human way, as a free and responsible being, of „participating“ in God’s own redemptive work, not as „cooperating with“ divine grace or as „contributing to“ God’s redeeming work, or as „causing“ one’s own redemption. This chapter is guided by the hypothesis that the point and purpose of using the concept of justification in epistemic evaluation is tied to its role in the practice of critical reflection. In section one, I propose an analysis of justification as the epistemic property in virtue of which a belief has the potential to survive ideal critical reflection. In section two, I use this analysis in arguing for a form of access internalism on which one has (...) class='Hi'>justification to believe a proposition if and only if one has higher-order justification to believe that one has justification to believe that proposition. In section three, I distinguish between propositional and doxastic versions of access internalism and argue that the propositional version avoids familiar objections to the doxastic version. In section four, I argue that the propositional version of access internalism also explains and vindicates internalist intuitions about cases. In section five, I conclude with some reflections on the relationship between critical reflection, responsibility and personhood. (shrink)

Among epistemologists, it is not uncommon to relate various forms of epistemic luck to the vexed debate between internalists and externalists. But there are many internalism/externalism debates in epistemology, and it is not always clear how these debates relate to each other. In the present paper I investigate the relation between epistemic luck and prominent internalist and externalist accounts of epistemic justification. I argue that the dichotomy between internalist and externalist concepts of justification can be characterized in terms (...) of epistemic luck. Whereas externalist theories of justification are incompatible with veritic luck but not with reflective luck, the converse is true for internalist theories of justification. These results are found to explain and cohere with some recent findings from elsewhere in epistemology, and support a surprising picture of justification, on which internalism and externalism are complementary rather than contradictory positions. Norman Daniels is perhaps best known as one of America’s foremost champions of coherentist moral epistemology, and the justificatory method of wide reflective equilibrium in particular. The striking coherence of Daniels’s career itself is evident in this collection of sixteen of his essays, composed over an eighteen-year period. To a large extent, these essays extend the work of John Rawls—either by attempting to make greater theoretical sense of WRE, or by applying abstract Rawlsian arguments to concrete social problems in (...) applied ethics. These thoroughly engaging essays are uniformly of high calibre. They are tightly argued, carefully researched, and intellectually rich and rewarding. Daniels’s writing is a model of clarity, and, while his work genuinely breaks much new ground, he is refreshingly honest about the limitations of his findings, and cognizant of the force of opposing viewpoints. A critique of reflective equilibrium as an account of epistemic justification.

In moral epistemology, the method of reflective equilibrium is often characterized in terms of intuitions or understood as a method for justifying intuitions. An analysis of reflective equilibrium and current theories of moral intuitions reveals that this picture is problematic. Reflective equilibrium cannot be adequately characterized in terms of intuitions. Although the method presupposes that we have initially credible commitments, it does not presuppose that they are intuitions. Nonetheless, intuitions can enter the process of developing a (...) class='Hi'>reflective equilibrium and, if the process is successful, be justified. Since the method of reflective equilibrium does not essentially involve intuitions, it does not constitute a form of intuitionism in any substantial sense. It may be classified as intuitionist only in the minimal sense of not reducing justification to a matter of inference relations alone. (shrink)

In his book, On Reflection, Hilary Kornblith criticizes what he regards as a chronic tendency in philosophy towards inflating the significance of reflection in ways that manifest a combination of philosophical naiveté and scientific ignorance about how reflection actually works. In these comments, I respond to Kornblith's challenge by sketching an account of the philosophical significance of reflection in the theory of epistemic justification.

According to a traditional Cartesian epistemology of perception, perception does not provide one with direct knowledge of the external world. Instead, your immediate perceptual evidence is limited to facts about your own visual experience, from which conclusions about the external world must be inferred. Cartesianism faces well-known skeptical challenges. But this chapter argues that any anti-Cartesian view strong enough to avoid these challenges must license a way of updating one’s beliefs in response to anticipated experiences that seems diachronically irrational. To (...) avoid this result, the anti-Cartesian must either license an unacceptable epistemic chauvinism, or else claim that merely reflecting on one’s experiences defeats perceptual justification. This leaves us with a puzzle: Although Cartesianism faces problems, avoiding them brings a new set of problems. (shrink)
