Social roles theorists claim that differences between the sexes are of limited consequence. Such misperceptions lead to misunderstanding the important role of sexual selection in explaining phenotypic differences both between species and within humans. Countering these claims, we explain how sexual dimorphism in humans affect expressions of artistic display and patterns of male and female aggression across the ovulatory cycle.

The mental model theory claims that the ability to falsify is at the core of human rationality. We assume that cognitive conflicts (CCs) and socio-cognitive conflicts (SCCs) induce falsification, and thus improve syllogistic reasoning performance. Our first study assesses adults’ ability to reason in two different conditions in a single experimental session. In both conditions the participants are presented with conclusions alternative to their own. In the CC condition they are told that these conclusions are casual, in the SCC condition (...) they are told they have been produced by another individual. The second study is analogous to the first, with the exception that the participants deal with the two conditions in two different experimental sessions. The overall results reveal that falsification is enhanced by conflicts experienced at the cognitive level. The results also reveal that learning to reason occurs in adults, when tested in two distinct experimental periods. (shrink)

In this study we analyze a recent controversy within the biomedical world, concerning the evaluation of safety of certain vaccines. This specific struggle took place among experts: the Danish epidemiologist Peter Gøtzsche on one side and a respected scientific institution, the Cochrane, on the other. However, given its relevance, the consequences of such a conflict invest a much larger spectrum of actors, last but not least the public itself. Our work is aimed at dissecting a specific aspect happening in this (...) complex scenario: strategy. In other words, we want to highlight the value and the impact of strategic decisions when complex issues, as those analyzed, are at stake. In order to address this we have decided to adopt a game-theoretic approach. Our work will be structured as it follows. First, we will introduce the controversy and the two main actors: Peter Gøtzsche and the Cochrane. Second, we will explain why this controversy is important and its value beyond its academic relevance. Third, we will frame the controversy as a game and will provide several models representing different situations, also furnishing an analysis of these distinct scenarios. In the end we will argue why such game-theoretic approach can be useful in dissecting this type of issues. (shrink)

The philosophy of emotions has long been dominated by the view called «cognitivism». According to it, emotions are characterized not by mere physical impulses but by a cognitive evaluation of their object. However, despite their success, cognitive theories have to deal with various objections and are divided on how to answer to them. In this essay I want to defend the form of cognitivism claimed by Martha Nussbaum from the most common criticisms. After a brief summary of her account, I (...) confront some of the objections that have been raised against it. In Section 2 I deal with the classic problem of emotions in infants and animals, which lack linguistic abilities. Later, I confront the potential problem represented by cases in which one’s emotion and reasoned judgment seem to differ: in paragraph 3 I consider irrational phobias and fears, to show how they can be accounted for in terms of judgments and thoughts, and not only of perceptions; in paragraph 4 I deal with the objection that «judgementalist» theories violate the «principle of charity», for they ascribe an excessive irrationality to people. I argue that experimental evidence suggest that it is not implausible to assume that people have contradictory beliefs under conditions of uncertainty, and that perceptual theories of emotion fail to account for some fundamental aspects of these phenomena. Finally, in paragraph 5, I deal with the objection according to which a cognitive-evaluative theory cannot explain the sense of passivity that we commonly experience in emotions. (shrink)

The capabilities approach is the theory according to which, in order to assess people's quality of life and reflect on the basic political entitlements, we should consider what people are capable of doing and being. Focusing mostly on Nussbaum's account, a number of scholars analysed the metaethical structure underlying the approach, showing her Aristotelian and Kantian sources. This article explores another aspect of Nussbaum's theory which has so far been somewhat overlooked: the role of emotions in the justification and motivational (...) support of the approach. After showing the importance Nussbaum places on compassion (and other benevolent emotions) to warrant her moral theory, I argue that – assuming her own cognitive account of compassion – her argument begs the question. I will then contend that Nussbaum's case does not have the inner tools to overcome such a circularity, trying to suggest, in conclusion, a possible way out which is consistent with it. (shrink)

The current study sought to determine research scientists’ sensitivity to various justifications for engaging in behaviors typically considered to be questionable research practices by asking them to evaluate the appropriateness and ethical defensibility of each. Utilizing a within-subjects design, 107 National Institutes of Health principal investigators responded to an invitation to complete an online survey in which they read a series of research behaviors determined, in prior research, to either be ambiguous or unambiguous in their ethical defensibility. Additionally, each behavior (...) was paired with either an ostensibly sound or unsound reason for the behavior. Consistent with hypotheses, the results indicated that scientists perceived QRPs as more appropriate and defensible when paired with a justifiable motive relative to when paired with a clearly unethical motive, particularly for QRPs that are more ambiguous in their ethicality. In fact, ambiguous QRPs were perceived as categorically defensible when given a justifiable motive. This suggests scientists are sensitive to contextual factors related to QRPs’ appropriateness, which could inform how institutions develop appropriate training modules for research integrity. The term ‘recalcitrant emotions’ refers to those cases where we feel an emotion that apparently contradicts our better judgements. For instance, one may be afraid of flying while claiming not to believe that it is dangerous. This phenomenon is commonly conceived as an objection to cognitivism, according to which emotions are based on the subject's beliefs, insofar as it would force us to ascribe to the subject who feels them an excessive degree of irrationality, comparing recalcitrant emotions to contradictory beliefs. For this reason, many philosophers have developed perceptual theories which describe emotions as forms of perception, allowing us to explain recalcitrant emotions without attributing to the subject contradictory beliefs, treating them as perceptual illusions. Facing the most compelling of these attempts, the article shows that perceptual accounts fail to explain in what sense recalcitrant emotions (and people who feel them) are irrational, keeping the comparison with optical illusions, which are not. Having rebutted three popular perceptual proposals, I conclude that the analogy between emotions and perceptions is flawed and that the appeal of these theories lies on a surreptitious shift in the meaning of the term ‘perceive’. Feminist thinkers have commonly interpreted Edith Stein’s “dual anthropology” as a form of essentialism and difference feminism. For them, men and women have (or should have) different functions and capabilities. The article argues against this traditional account. Starting from two distinct criticisms of difference feminism – that of Judith Butler and that of Martha Nussbaum – it claims that the best way to read Stein’s position is to consider it a liberal feminism, for the emphasis that she puts on the (...) uniqueness of every single human being. In everyday language those who are violent are often compared to beasts. “Beast” it is said of one who tortures and rapes, or of one who traffics in women, men and children. But the poor beasts are angels when compared to certain human beings whose imagination is completely devoted to the humiliation and submission of others: they torture, rape and kill as if it were their natural right.

The paper aims to ques- tion the traditional view of the early Royal Society of London, the oldest scientific institution in continuous existence. According to that view, the institutional life of the Society in the early decades of activity was characterized by a strictly Baconian methodology. But the re- construction of the discussions about fossils and natural history within the Society shows that this monolithic image is far from being correct. Despite the persistent reference to the Baconian Solomon House, the (...) Society did not impose or support a common programme of research in the field of the natural history of the Earth. (shrink)

This special theme issue of Big Data & Society presents leading-edge, interdisciplinary research that focuses on examining how health-related information is circulating on social media. In particular, we are focusing on how computational and Big Data approaches can help to provide a better understanding of the ongoing COVID-19 infodemic and to develop effective strategies to combat it.

It is more difficult to feel emotions for future generations than for those who currently exist, and this seems to be one of the reasons why we struggle to care for the future. According to a number of authors, who have recently focused on the psychological flaws that prevent us from dealing with transgenerational issues, the main problem is “future discounting”. Challenging this common view, we argue that the main reason we struggle to care about future generations lies in two (...) features of our daily emotions: the «identified victim effect» and the decrease in empathy for people who are different from us. These traits give rise to two puzzles we call the problem of the indeterminateness of future persons and the problem of dissimilarity. After having analyzed these problems of our moral psychology, we show how they allow us to account for some differences in affectivity towards a number of entities that do not currently exist, such as future generations, past generations and fictional characters. Bearing in mind the real limits of our emotions when dealing with future people, we sketch an alternative proposal on how to develop emotions to provide citizens of liberal democracies with a motivation to act in favor of future generations. An excerpt from Sergei M. Eisenstein's memoirs describing a night visit to the museum of Chichén Itzá in Mexico is set forth as a real life example reflecting, both from a visual and theoretical perspective, the architecture of Aby Warburg's Bilderatlas Mnemosyne and his concept of Denkraum. Drawing upon Warburg's own writings and F. T. Vischer's theory of symbol, the paper looks at Eisenstein's experience at the museum as highlighting the dynamic relation between man's religious/magical and scientific/rational psychic poles, and (...) the in-between space of thought inherent to the concept of Denkraum and visually represented by the empty dark intervals separating the images in the Bilderatlas. Adding significance to its argumentation, the paper also hints at an affinity between Eisenstein's film montaging and Warburg's image assembling criteria. (shrink)

The essay explores the possibilities afforded by Heidegger’s thought for addressing the question of the reality of the phenomenon within the framework of the theory of quantum mechanics. Heidegger’s conception of the task of phenomenology is seen to provide a crucial axis along which the phenomenon of quantum physics can be connected both to its appearance in language and to the historical unfolding of the horizon that grounds the possibility of an encounter with the phenomenon itself. The determinations of this (...) horizon, i.e. of the order of “phenomenality” that makes the appearance of the phenomenon possible, are analyzed in the instance of quantum mechanics, and compared to the ones presented by Heidegger in his considerations concerning the appearing of the phenomenon in Aristotelian and classical physics. The three main directives that structure the analysis of this order of phenomenality are the determinations of the conditions of experience of the phenomenon, of the function of language that makes this appearance possible, and of the subject function that constitutes, and is in turn constituted by, this experience. Observing the phenomenon of cultural appropriation in a case of theatre: Kanata the controversial spectacle by the Québecois Robert Lepage raises issues of aesthetics. The specific cultural, political and social context, together with the singularity of theatre as an art form, makes this a unique case study shedding light on that phenomenon and causing us to rethink some long-standing principles of aesthetics.

The dramaturgical principle of montage has a crucial importance in the mechanism of transposition from the novel to the staging and also includes the operations of quotation and translation. Heiner Müller’s transposition of the Liaisons dangereuses by Choderlos de Laclos into the pièce Quartett is an exemplary case for studying these dynamics, as well as the staging by Valter Malosti. The article intends to explore the fruitful intellectual exchange between the historian of art and culture Aby Warburg and the philosopher Ernst Cassirer starting from their first meeting in 1924 and developed over ten years. The author analyses how the Cassirer’s concept of “symbolic form” and the Warburg’s conception that took shape in the Bilderatlas Mnemosyne are deeply linked to the interests of both for the origins of modern physics. The figure of Kepler as a “transitional figure between mythical and (...) mathematical thought” on which they focus on their first meeting has a central role in this reflection. The author wants to demonstrate how the analysis of the theory of symbol is inseparable from the study of the theory of myth, connected to cosmological, astrological and astronomical themes. The principles that inaugurate the scientific revolution of the modern age, present in nuce in the science of physics inaugurated by Kepler, are observed in the more mature results of Einstein's theory of relativity. A theory which played an important role both in Cassirer’s theory and in Warburg’s reflections. (shrink)

This study explored how disclosure of financial conflicts of interest influences naïve or “lay” individuals’ perceptions of the ethicality of researcher conduct. On a between-subjects basis, participants read ten scenarios in which researchers disclosed or failed to disclose relevant financial conflicts of interest. Participants evaluated the extent to which each vignette represented a FCOI, its possible influence on researcher objectivity, and the ethics of the financial relationship. Participants were then asked if they had completed a college-level ethics course. Results indicated (...) that FCOI disclosure significantly influenced participants’ perceptions of the ethicality of the situation, but only marginally affected perceptions of researcher objectivity and had no significant influence on perceptions of the existence of FCOIs. Participants who had previously completed a college-level ethics course appeared more sensitive to the importance of FCOI disclosure than those who lacked such background. This result suggests that formal ethical training may help individuals become more critical consumers of scientific research. (shrink)

IntroductionIn this study, we tested a simple, active “ethical consistency” intervention aimed at reducing researchers’ endorsement of questionable research practices (QRPs).MethodsWe developed a simple, active ethical consistency intervention and tested it against a control using an established QRP survey instrument. Before responding to a survey that asked about attitudes towards each of fifteen QRPs, participants were randomly assigned to either a consistency or control 3–5-min writing task. A total of 201 participants completed the survey: 121 participants were recruited from a (...) database of currently funded NSF/nih scientists, and 80 participants were recruited from a pool of active researchers at a large university medical center in the southeastern US. Narrative responses to the writing prompts were coded and analyzed to assist post hoc interpretation of the quantitative data.ResultsWe hypothesized that participants in the consistency condition would find ethically ambiguous QRPs less defensible and would indicate less willingness to engage in them than participants in the control condition. The results showed that the consistency intervention had no significant effect on respondents’ reactions regarding the defensibility of the QRPs or their willingness to engage in them. Exploratory analyses considering the narrative themes of participants’ responses indicated that participants in the control condition expressed lower perceptions of QRP defensibility and willingness.ConclusionThe results did not support the main hypothesis, and the consistency intervention may have had the unwanted effect of inducing increased rationalization. These results may partially explain why RCR courses often seem to have little positive effect. (shrink)

Disclosure has become the preferred way of addressing the threat to researcher objectivity arising from financial conflicts of interest. This article argues that the effectiveness of disclosure at protecting science from the corrupting effects of FCOIs—particularly the kind of disclosure mandated by US federal granting agencies—is more limited than is generally acknowledged. Current NIH and NSF regulations require disclosed FCOIs to be reviewed, evaluated, and managed by officials at researchers’ home institutions. However, these reviewers are likely to have institutional and (...) personal interests of their own that may undermine the integrity of their evaluations. This paper presents experimental findings suggesting that such interests affect third-party assessments of FCOIs. Over 200 participants gauged the ethical significance of various hypothetical yet realistic FCOIs in academic research settings. Drawing from field theory, Gestalt therapy conceives psychological suffering and psychotherapy as two intentional field phenomena, where unprocessed and chaotic experiences seek the opportunity to emerge and be assimilated through the contact between the patient and the therapist (i.e., the intentionality of contacting). This therapeutic approach is based on the therapist’s aesthetic experience of his/her embodied presence in the flow of the healing process because (1) the perception of beauty can provide the therapist with feedback on the assimilation of unprocessed (...) experiences; (2) the therapist’s attentional focus on intrinsic aesthetic diagnostic criteria can facilitate the modification of rigid psychopathological fields by supporting the openness to novel experiences. The aim of the present manuscript is to review recent evidence from psychophysiology, neuroaesthetic research, and neurocomputational models of cognition, such as the free energy principle (FEP), which support the notion of the therapeutic potential of aesthetic sensibility in Gestalt psychotherapy. Drawing from neuroimaging data, psychophysiology and recent neurocognitive accounts of aesthetic perception, we propose a novel interpretation of the sense of beauty as a self-generated reward motivating us to assimilate an ever-greater spectrum of sensory and affective states in our predictive representation of ourselves and the world and supporting the intentionality of contact. Expecting beauty, in the psychotherapeutic encounter, can help therapists tolerate uncertainty avoiding impulsive behaviours and to stay tuned to the process of change. (shrink)

Increasingly, scholarly journals have begun retracting published articles for reasons other than those described by advisory organizations such as the Committee on Publication Ethics (COPE). Numerous research articles have been retracted of late due to political concerns. Additionally, some articles have been retracted for behavioral misconduct, which was also the subject of a recent COPE discussion forum. ‘Behavioral misconduct’ denotes harmful or immoral behavior of one or more authors that is unrelated to the article’s findings or content. We investigated whether (...) federally funded research scientists considered behavioral misconduct a valid reason for retracting published findings and whether the type of behavioral misconduct involved, the level of the expected scientific impact of the article in question, or the kind of editorial action taken affected their support of retraction. Of the 464 participants who took our survey, we found that researchers largely oppose retraction of a published article or removing an author when scientists commit behavioral misconduct, regardless of the type of misconduct involved. However, there was greater support for retraction when the misconduct was financial as compared to racial or sexual misconduct. Not surprisingly, researchers were more likely to use the published information in question in their own work when its impact was high. Future studies should investigate the extent to which these findings are moderated by researchers’ editorial experience and other demographic factors. (shrink)

The purpose of this study was to investigate emotion recognition and processing in patients with mild cognitive impairment in order to update the state of current literature on this important but undervalued topic. We identified 15 papers published between 2012 and 2022 that meet the inclusion criteria. Paper search, selection, and extraction followed the PRISMA guidelines. We used a narrative synthesis approach in order to report a summary of the main findings taken from all papers. The results collected are still (...) ambiguous: some studies did not find any differences between MCI and healthy controls groups in emotion recognition and processing, and other results reported emotion-specific deficits in emotion recognition regarding MCI patients. It is essential to underline that these findings could not be generalized to the whole MCI population due to the heterogeneous use of measures and composition of the sample. This does not allow us to make a comprehensive comparison between the results. Our suggestion for future research is to align the results using the same type of tests and emotion recognition assessment. (shrink)

BackgroundAdults with ADHD exhibit a neuropsychological profile that may present deficits in many cognitive domains, particularly attention and executive functions. However, some authors do not consider executive disfunction as an important part of the clinical profile of the syndrome; this could be related to the use of inappropriate neuropsychological tests, probably not adapted and not sufficiently ecological. Moreover, new data are required on specific correlation of attentive-executive symptoms with socio-demographic factors. Therefore, the aim of this study is to analyze the (...) neuropsychological performance of a group of adults with ADHD, also evaluating the influence of gender, age and education level.MethodsWe retrospectively collected health-related personal data of 40 adult ADHD patients, clinically diagnosed and evaluated via a battery of 4 neuropsychological tests and 1 self-administered questionnaire. Gender, age and years of education differences were assessed.ResultsAttention and EFs deficits have been highlighted mainly on the d2-R and 5-point neuropsychological tests, which therefore seem to be more sensitive in measuring the attention-executive dysfunction in an adult ADHD population, than TAP Go/No-go and ROCFT. ADHD patients also manifested subjective behavioral impulsivity disorders on BIS-11. There were no statistically significant gender differences in cognitive performance. On the contrary, younger patients performed worse on subscales TAP Go/No-go errors and 5-points number of drawings, while participants with a higher education level performed better on subscales d2-R speed of execution and d2-R errors. This supports a reduction in the number of errors and the execution time as a function of older age and a higher level of education. Finally, patients with higher education also self-reported greater impulsivity in planning.ConclusionOur preliminary findings suggest that adult ADHD is not a lifelong stable disorder, but it may change over time. Moreover, attention-executive deficits may be influenced and partially counterbalanced by experience and a higher level of education. This could underlie the development of specific psycho-behavioral and cognitive compensatory strategies. The use of self-administered questionnaires is therefore recommended to highlight attentional and executive difficulties that may not result in neuropsychological tests. (shrink)

Parental substance use is a major risk factor for child development, heightening the risk of drug problems in adolescence and young adulthood, and exposing offspring to several types of traumatic event. First, prenatal drug exposure can be considered a form of trauma itself, with subtle but long-lasting sequalae at the neuro-behavioural level. Second, parents’ addiction often entails a childrearing environment characterised by poor parenting skills, disadvantaged contexts and adverse childhood experiences, leading to dysfunctional outcomes. Young adults born from/raised by parents (...) with drug problems and who develop a Substance Used Disorder (SUD) themselves might display a particularly severe condition in terms of cognitive deficits and impaired personality function. This preliminary study aims to investigate the role of early exposure to drugs as a traumatic event, capable of affecting the psychological status of young drug addicts. In particular, it intends to examine the neuropsychological functioning and personality profile of young adults with severe SUDs who were exposed to drugs early in their family context. The research involved 3 groups each consisting of 15 young adults (aged 18-24): a group of inpatients diagnosed with SUDs and exposed to drugs early, a comparison group of non-exposed inpatients and a group of non-exposed youth without SUDs. A neuropsychological battery (Esame Neuropsicologico Breve-2), an assessment procedure for personality disorders (Shedler-Westen Assessment Procedure-200) and the Symptom CheckList-90-Revised were administered. According to present preliminary results, young drug addicts exposed to drugs during their developmental age were characterised by elevated rates of neuropsychological impairments, especially at the expense of attentive and executive functions; personality disorders were also common but did not differentiate them from non-exposed young people with SUDs. Alternative multi-focused prevention and intervention programs are needed for children of drug-misusing parents, addressing executive functions and adopting a trauma-focused approach. (shrink)

As concern over the use of questionable research practices in academic science has increased over the last couple of decades, some reforms have been implemented and many others have been debated and recommended. While many of these proposals have merit, efforts to improve scientific practices are more likely to succeed when they are responsive to the prevailing views and concerns of scientists themselves. To date, there have been few efforts to solicit wide-ranging input from researchers on the topic of needed (...) reforms. This article is a qualitative report of responses from federally funded scientists to the question of what should be done to address the problem of QRPs in their disciplines. Overall, participants were concerned about how institutional and career-oriented incentives encourage the use of QRPs. Compared to previous recommendations, participants had surprisingly little confidence in the ability of ethics training to improve research integrity. (shrink)

Contained in the face is a vast body of social information, both fixed and flexible. Across multiple lines of converging evidence it has become increasingly clear that face processing is subject to one of the most potent and best understood of social cognitive phenomena: social categorization. This article reviews this research at the juncture of social psychology and face perception showing the interplay between social categorization and face processing. It lays out evidence indicating that social categories are extracted easily from (...) faces, suggesting that the effects of social categories can occur quickly and unintentionally. Recent evidence that social categories can affect perception of both invariant and variant facial characteristics is discussed. Finally, the article summarizes recent evidence indicating that the motivational consequences of social categories can affect which faces are remembered and how faces are processed. (shrink)

BackgroundLiving labs are realistic environments designed to create links between technology developers and end-users (i.e. mostly older adults). Research in LLH (Living labs in health) covers a wide range of studies from non-interventional studies to CT (clinical trials) and should involve patients with neurocognitive disorders. However, the ethical issues raised by the design, development, and implementation of research and development projects in LLH have been the subject of only little interest thus far.ObjectiveOur aim was to determine a pragmatic, ethical and (...) regulatory correct approach to seek the informed consent of patients with neurocognitive disorders according to the different types of studies carried out in European LLH, with a focus on the French context.MethodsA narrative review of regulatory texts and clinical articles was conducted, and a pragmatic procedure to determine the decision-making capacity of older adults in LLH was proposed.ResultsIndividuals must be adequately informed and freely agree to participate in CT. The capacity to consent should be assessed in CT including cognitively impaired older adults. We propose the following steps: first to assess for delirium using the 4 ‘A’s Test (4AT) or the 3-min Diagnostic interview for Confusion Assessment Method (3D-CAM), second to search for medical history of major neurocognitive disorder, and third to assess the decision capacity using the University of California, San Diego Brief Assessment of Capacity to Consent (UBACC).ConclusionsIncluding individuals with neurocognitive disorders in research implies using an efficient and pragmatic strategy to inform participants and obtain their consent. The tool we offer here may be useful in the routine operation of LLH but can also be extended to all CT with this population. (shrink)

Rodolfo Sacco developed the idea of “mute behaviours” during his studies on mute law. The notion of “mute behaviours” denotes an action that is able to mould a legal relationship without any use of language. Certainly, this concept may give rise to some doubts in relation to the attribution—to a behaviour qualified as mute—of the capability to affect dynamics involving a plurality of people. Aiming to clarify the idea of “mute behaviours” by this point of view, the authors analysed (...) the semiotic terminology used by Sacco himself to explain this notion and the issue of its silent nature. Therefore, the terms “signifying signs” and “symptoms”, deemed by Sacco—respectively—incompatible and compatible with the theory of mute behaviours were considered. The former term was traced back to the notion of conventional and arbitrary sign, the notion of the latter was reconstructed linking it to the concept of signs based on signification and suggesting a possible framework in view of the idea of “presentative meanings” developed by the philosopher Guido Morpurgo-Tagliabue. Clarified this dichotomy by a terminological analysis, the authors noticed—as affirmed by Rodolfo Sacco himself—the impossibility to ascribe the notion of gesture to the mute behaviour’s category, as some exegetes proposed. Consequently to this last remark, the authors tried to analyse the relationship between gestures and “mute behaviours”, identifying the category of “sema-pragmatic acts”, that includes gestures and may be seen as an intermediate phase between “mute behaviours” and legally relevant behaviours operated by speaking. This article highlights certain aspects of Rodolfo Sacco’s theoretical work on comparative law. Rather than offering an exhaustive discussion, it outlines key points in his intellectual journey to help the reader understand how certain themes gained prominence in his work. An outstanding figure in the comparative law community since the 1970s, he remained active until the end of his life, well into the twenty-first century. Through his many contributions to the field, Sacco took comparative law research in new (...) directions. He developed a more nuanced and complex analysis of the tasks of the comparative lawyer, elaborating an approach to comparison that does justice to the multiple components of all legal systems (“legal formants”) and their dynamics. We owe him a fine study of the silent, implicit dimensions of law that have a major impact on its application (“cryptotypes”), and a reflection on the relationship between law and language that shows how comparative law is deeply implicated in the process of translation. It explores two pivotal aspects of his research that continue to significantly influence the work of a young scholar—the theory of legal formant and exploration of the relationship between law and language. The article also briefly highlights the relevance of legal comparison in the contemporary European legal context.

Notas al pie de Gaza es una novela gráfica del artista Joe Sacco en la que se retoma el conflicto palestino-israelí ya tratado en Palestina: En la Franja de Gaza. En esta obra se abocará a la investigación de dos matanzas cometidas el año 1956 en territorio palestino.. En este trabajo nos centraremos en el controvertido final de la novela, en la que Sacco, mediante una notable técnica gráfica, obliga al lector a convertirse en una de las víctimas (...) de la matanza de Rafah. ¿Es esta técnica válida o éticamente cuestionable? Para contestar a esta pregunta buscaremos orientación mediante conceptos descriptivos de Dominick LaCapra y de Judith Butler. Retractions have traditionally been reserved for correcting the scientific record and discouraging research misconduct. Nonetheless, the potential for actual societal harm resulting from accurately reported published scientific findings, so-called information hazards, has been the subject of several recent article retractions. As these instances increase, the extent of support for such decisions among the scientific community and lay public remains unclear. Undergraduates (Study 1) and federally funded researchers (Study 2) reported their support for retraction decisions described as due to misconduct, honest (...) errors, or potential information hazards. Participants supported retraction on the former two grounds more than the latter. Despite limited support, women remained more receptive to retractions based on information hazards. Activist tendencies additionally predicted undergraduate men’s receptivity. Receptivity toward retraction due to information hazards was unrelated to scientists’ engagement in activism, suggesting that formal scientific training affords researchers an ability to separate personal and professional values in scientific discourse. Findings could inform the development of educational materials that may aid less experienced scientists and the lay public in understanding retraction ethics. (shrink)

Folk-economic beliefs may be regarded as “evidential fictions” that exploit the natural tendency of human cognition to organize itself in narrative form. Narrative counter-arguments are likely more effective than logical debunking. The challenge is to convey sound economic reasoning in narratively conspicuous forms – an opportunity for economics to rethink its role and agency in public discourse, in the spirit of its old classics.
