But because they lower the implicit marginal taxation rate of individuals entering the workforce, they have the effect of increasing economic inequality between those who opt out of the workforce and those who choose to participate. This article examines the effect that an increase in this income gap can be expected to have on the perceived adequacy of (...)

  7. Two Concepts of Meaningful Work.Willem van der Deijl - 2022 - Journal of Applied Philosophy 41 (2):202-217.
The concept of meaningful work is used to evaluate the quality of work. Typical cases of meaningless work that have been used to clarify this concept are assembly line work, and work involving other types of mindless tasks, but also David Graeber's ‘bullshit jobs’. I argue that there are at least two fundamental reasons to care about meaningful work: reasons from the wellbeing of the worker and reasons pertaining to meaningfulness of the worker's life. I first argue that a concept (...)

  9. Student-to-school counselor ratios: understanding the history and ethics behind professional staffing recommendations and realities in the United States.Carleton H. Brown & David Knight - forthcoming - Ethics and Behavior.
This manuscript explores the argument for lower student-to-school counselor ratios in U.S. public education. Drawing upon a comprehensive historical review and existing research, we establish the integral role of school counselors and the notable benefits of reduced student-to-counselor ratios. Our analysis of national data exposes marked disparities across states and districts, with the most underfunded often serving higher percentages of low-income students and students of color. This situation raises significant ethical concerns, prompting a call for conscientious policy reform and targeted (...)

  10. Educating against intellectual vices.Noel L. Clemente - 2024 - Ethics and Education 19 (1):109-123.

To respond to these challenges, this paper considers the aim of educating against intellectual vices (EAIV) – teaching students not to develop intellectual vices or weakening those that they have already developed (...)

This paper re-examines the tension between professional and liberal education by revisiting The Idea of the University (1852), the seminal mid-nineteenth century treatise of John Henry Newman. In returning to Newman’s classic text, we are interested in the significance of his lectures for a contemporary Higher Education increasingly under pressure to be ‘useful:’ on this understanding, ‘useful’ denotes an arguably limited and utilitarian sense where the university guarantees its students a well-paying job on graduation. In pressing on this distinction between (...)

  12. Affirming educative violence: Walter Benjamin on divine violence and schooling.Ori Rotlevy & Itay Snir - 2024 - Ethics and Education 19 (1):59-75.
In his ‘Towards the Critique of Violence’, Walter Benjamin introduces the concept of ‘educative violence’ as a contemporary manifestation of ‘divine violence’. In this paper, we aim to interpret ‘educative violence’ by examining other instances where the young Benjamin addresses pedagogical issues. By connecting the concept of divine violence to Benjamin’s ideas of education in tradition and of the schooling of Geist, our goal is twofold: firstly, to comprehend the productive role that violence may play in the pedagogical context, and (...)

  13. Exploring contract cheating in further education: student engagement and academic integrity challenges.Roya Rahimi, Jenni Jones & Carol Bailey - 2024 - Ethics and Education 19 (1):38-58.
Contract cheating is a challenging problem facing higher and further education providers (HE and FE) worldwide. In the UK, contract cheating has been identified as a growing problem by the HEA and, more recently, the Quality Assurance Agency for Higher Education and the Department for Education. The high rate of contact cheating among students suggests that 8–9% of degrees awarded in the UK are unsafe. To address this issue, the current study with a new approach seeks to investigate student’s motivations, (...)

  14. Being in tension: the dependent response in social education.María Castillo-López - 2024 - Ethics and Education 19 (1):76-92.
Social Education implies a constant exposition to human experiences of vulnerability and suffering. In this paper, Levinas’s philosophy of alterity and, specifically, the notion of hospitality constitutes our ethical lens to explore educational encounters in non-formal contexts within the Spanish Social Sector. The study is developed from a hermeneutic phenomenological approach into the depth of lived experiences of eight social educators who currently work with different populations groups. The testimonies, explored through semi-structured interviews, are presented in a conversational, dialogic, poetic (...)

  15. The resonance approach for non-alienated relationships: beyond slowness in higher education.José L. López-González - 2024 - Ethics and Education 19 (1):21-37.
Critical studies in higher education often embrace the ideas of the slowness movement to address time pressure. However, this desirable horizon presents some limitations. On the one hand, by emphasizing solutions at the individual level, boosting slowness may promote tactics incapable of producing changes to the underlying structural dynamics of time pressure. On the other hand, approaches based on slowness may also inadvertently foster a form of ethical paternalism within the context of ethical pluralism by prescribing substantive models of practice (...)

  16. Teaching teachers how to not solve moral dilemmas.Sergei Talanker - 2024 - Ethics and Education 19 (1):1-20.
Our survey of literature on moral dilemmas in teaching reveals that scholars declare the need to unequivocally resolve them yet refrain from doing so. This phenomenon is rooted in falure to distinguish between the different moral conflicts. The methods of resolving abstract hypothetical dilemmas, advocated but not implemented by the scholars, are poorly suited to deal with conflicts involving social pressure and high-stakes consequences for the parties involved, like most of the conflicts that teachers report. Thus, textbooks invite teachers to (...)

This article considers the morality of children's activism, in particular via participation in political protests. In Section 3 of the article I consider whether children can be competent to engage in activism. I argue that even if we believe children are not competent to vote it will still be true that many children are indeed competent to engage in activism. In Section 4 I consider the wellbeing effects of activism on children. I argue that political activity stands in tension with (...)

  19. Between Continuity and Change in the Italian Legal Profession – Boutique Law Firms as the Last Bastion of Professionalism.Salvatore Caserta - forthcoming - Legal Ethics:1-17.
This paper provides an empirical study of Italian ‘boutique law firms’. By building on seventeen semi-structured interviews with lawyers, the paper explores institutional, professional, and societal features of such firms and their lawyers. The article shows that, while the rise of large law firms triggered a partitioning of the Italian legal field in the past decades, more recently this small, but economically important, sector of the profession revived the classic model of delivering legal services characterised by a strong sense of (...)

  20. The participant’s voice: crowdsourced and undergraduate participants’ views toward ethics consent guidelines.Nadine S. J. Stirling & Melanie K. T. Takarangi - forthcoming - Ethics and Behavior.
The informed consent process presents challenges for psychological trauma research (e.g. Institutional Review Board [IRB] apprehension). While previous research documents researcher and IRB-member perspectives on these challenges, participant views remain absent. Thus, using a mixed-methods approach, we investigated participant views on consent guidelines in two convenience samples: crowdsourced (N = 268) and undergraduate (N = 265) participants. We also examined whether trauma-exposure influenced participant views. Overall, participants were satisfied with current guidelines, providing minor feedback and ethical reminders for researchers. Moreover, (...)

  21. What Relational Egalitarians Should (Not) Believe.Andreas Bengtson & Lauritz Aastrup Munch - 2024 - Journal of Ethics and Social Philosophy 27 (2).
Relational egalitarianism is a theory of justice according to which justice requires that people relate as equals. According to some relational egalitarians, X and Y relate as equals if, and only if, they (1) regard each other as equals; and (2) treat each other as equals. In this paper, we argue that relational egalitarians must give up 1.

  22. An emotionally vulnerable profession? Profession values and emotions within legal practice.Emma Jones - forthcoming - Legal Ethics:1-20.
Applying Fineman’s vulnerability theory, this paper will explore the role of emotions within the legal profession and the specific vulnerabilities that arise from their traditional and contemporary treatment within law. It will consider how the notion of professionalism in law has traditionally disregarded or excluded emotions as irrelevant or even dangerous in a manner which is philosophically and psychologically flawed as well as damaging to mental health and wellbeing. This approach has created longstanding unacknowledged vulnerabilities for the profession as a (...)

  23. Ethical lawyering in the Anthropocene.Vivien Holmes - forthcoming - Legal Ethics:1-18.
Law must evolve to play its part in addressing the anthropogenic threats of climate change and biodiversity loss. Lawyers have a key role to play in assisting that evolution, and the ethics that govern lawyers’ work will play a large part in determining its success. This article explains how four core approaches to legal ethics support lawyers in their work to address climate change and to facilitate more sustainable ways of living.

In the context of digitalization and artificial intelligence (AI), data protection and digital ethics are trending topics. However, they are rarely considered in conjunction even though they are inextricably linked. This volume sets out to close this gap. Informational self-determination is an expression of a European understanding of values, particularly with regard to smart technologies and AI applications. In addition to socially relevant dimensions of data protection and digital ethics, the authors of this edited collection point out and analyze the (...)

  25. Interpreting ‘What One Would Have Wanted’.Stephanie Beardman - forthcoming - Journal of Applied Philosophy.
When making decisions on behalf of someone, is asking what they would have wanted a good way to respect their autonomy? Against prevalent assumptions, I argue that in decisions about the care and treatment of those with advanced dementia, the notion of ‘what one would have wanted’ is conceptually, epistemically, and practically problematic. The problem stems from the disparity between the first-person subjectivity of the past person and that of the present person. The transformative nature of dementia renders the very (...)

Is it wrong for a man to buy sex from a woman? In this book, Holly Lawford-Smith argues that it is wrong: commercial sex is quintessentially hierarchical sex, and it is wrong both to have, and to perpetuate a market in, hierarchical sex. Angie Pepper argues that it isn’t wrong: men are permitted to buy sex from those women who freely choose to sell it. -/- Important but different interests are at stake in these two positions. According to the first, (...)

  27. (Mis)representations of Kant’s moral theory in applied ethics textbooks: emphasis on universalizability, absence of autonomy.Louai Rahal - 2024 - International Journal of Ethics Education 9 (1):105-117.
This study examined representations of Kant’s theory of ethics in three applied ethics open textbooks. In two of the three textbooks, the concept of autonomy, which is the foundational concept in Kant’s theory, was generally missing. The three textbooks introduced and explained Kant’s emphasis on duty, but only one of them explicated the connection between duty and autonomy. All three textbooks introduced and explained Kant’s concept of universalizability. All of them also introduced the Formula of Humanity (FH), however, none of (...)

  28. Why do We Need to Employ Exemplars in Moral Education? Insights from Recent Advances in Research on Artificial Intelligence.Hyemin Han - forthcoming - Ethics and Behavior.
In this paper, I examine why moral exemplars are useful and even necessary in moral education despite several critiques from researchers and educators. To support my point, I review recent AI research demonstrating that exemplar-based learning is superior to rule-based learning in model performance in training neural networks, such as large language models. I particularly focus on why education aiming at promoting the development of multifaceted moral functioning can be done effectively by using exemplars, which is similar to exemplar-based learning (...)

  34. Liberal egalitarianism and critical legal studies: articles of conciliation.Matthew McManus - forthcoming - Legal Ethics:1-18.
Liberal egalitarian jurisprudence and critical legal studies have often been at odds, despite sharing a core of set of political and analytical commitments. This paper makes the case for their conciliation in the 21st century on the basis that both traditions have much to offer one another. Liberal egalitarians offer the theoretical tools for developing an egalitarian normative approach to law, and critical legal theorists offer a vital realism about power.

  35. Consequentialism and problem of role morality in legal ethics.Martin Hapla - forthcoming - Legal Ethics:1-18.
One of the frequent philosophical problems of legal ethics is the conflict between common and role morality. This situation is where a lawyer's actions are evaluated differently by these two sets of moral norms. The article seizes on this as a conflict between two conventional moralities that need to be resolved with the help of a justificatory morality and thus an appropriate theory of normative ethics. It offers as a possible response a variant of consequentialism that draws on utilitarianism and (...)

  36. Should judges be temperate in their speech?Jana Stehlíková - forthcoming - Legal Ethics:1-21.
It is not easy to find a fair balance between inappropriate speech on the one hand and the appearance of constraint and inaccessibility on the other. Also judges must deal with this difficult task. They must take care not to endanger values that are protected to secure the functionality of justice. This article deals with questions of why and how judges can fulfil this task and what might happen if they fail to do so. The article argues in favour of (...)

  38. Sensitivity to moral goodness under different aesthetic contexts.Chenjing Wu, Hongyan Zhu, Yameng Zhang, Wei Zhang & Xianyou He - 2024 - Ethics and Behavior 34 (4):279-293.
Does context influence our appreciation of beauty? To answer this question, two experiments were conducted to determine the effect of contextual aesthetics on the recognition of moral behavior. Experiment 1 demonstrated that individuals in a high-aesthetic context had a quicker recognition time for moral behavior than those in a low-aesthetic context. In a low-aesthetic context, individuals recognize immoral behavior more quickly than in a high aesthetic context. Individuals showed greater recognition rates for moral behavior in a high aesthetic context and (...)

  39. The effect of leader unethical pro-organizational behaviour on subordinate silence: the mediating role of moral ownership.Silu Chen, Chenling Tian, Huan Cheng & Jiaxin Lai - 2024 - Ethics and Behavior 34 (4):264-278.
This study explores the psychological mechanism underlying and the boundary condition affecting the relationship between leader unethical pro-organizational behavior (UPB) and subordinate silence. Drawing on social cognitive theory (SCT), we posit that leader UPB may decrease subordinate moral ownership, which in turn might trigger subordinate silence; we further hypothesize that corporate social responsibility (CSR) directed toward employees may weaken the relationship between leader UPB and subordinate moral ownership as well as the indirect relationship between leader UPB and subordinate silence via (...)

  41. Nature and causes of questionable research practice and research misconduct from a philosophy of science perspective.Bor Luen Tang - 2024 - Ethics and Behavior 34 (4):294-302.
Misconduct in science is often viewed and analyzed through the lenses of normative ethics and moral philosophy. However, notions and methods in the philosophy of science could also provide rather penetrative explanatory insights into the nature and causes of scientific misconduct. A brief illustration in this regard, using as examples the widely popular Popperian falsification and the Kuhnian scientific paradigm, is provided. In multiple areas of scientific research, failure to seek falsification in a Popperian manner constitutes a questionable research practice (...)

  42. The blind obedience of others: a better than average effect in a Milgram-like experiment.Laurent Bègue & Kevin Vezirian - 2024 - Ethics and Behavior 34 (4):235-245.
In two highly powered studies (total N = 1617), we showed that individuals estimated that they would stop earlier than others in a Milgram-like biomedical task leading to the death of an animal, confirming the relevance of the Better than Average Effect (BTAE) in a new research setting. However, this effect was not magnified among participants displaying high self-esteem. We also showed that participants who already knew obedience studies expected that others would be more obedient and would administer more damaging (...)

  43. Double Jeopardy, Autrefois Acquit and the Legal Ethics of the Rule Against Unreasonably Splitting a Case.Zia Akhtar - forthcoming - Criminal Justice Ethics.
Section 75 of the Criminal Justice Act (CJA) of 2003 overturned the principle in English law that a person cannot be retried for an offense of which he has been acquitted, recognizing advances in forensic science that uses modern analysis of DNA in adducing in evidence. The special plea of autrefois acquit can be overturned based on finding of compelling evidence after a previous acquittal of a suspect who can now be tried again for the same offense. The double jeopardy (...)

  44. Population Aging and the Retirement Age.Daniel Halliday - forthcoming - Journal of Applied Philosophy.
Numerous jurisdictions have recently raised the age of retirement or plan to do so. Pressure to extend people's working lives is due to population aging, which makes it harder to fund retirement through existing methods. Raising the retirement age can improve the ‘dependency ratio’ by increasing the fraction of the population that works (and pays taxes) relative to the fraction retired. This article gives sustained attention to connecting the case for retirement with one view about wellbeing, according to which old (...)

  45. Moral Gratitude.Romy Eskens - forthcoming - Journal of Applied Philosophy.
There are many examples of persons who appear to be grateful to other people's benefactors. In at least some of these examples, such third-party gratitude also seems fitting. However, these observations conflict with a widespread assumption in the philosophical literature about gratitude: that only beneficiaries can be fittingly grateful to benefactors. In this article, I argue that third-party gratitude exists and can be fitting, and that the assumption is therefore mistaken. More specifically, I defend two claims: (i) that there exists (...)

  46. Social Reasons.Kevin Richardson - forthcoming - Journal of Applied Philosophy.
The goal of this article is to motivate the idea of a social reason and demonstrate its usefulness in social theorizing. For example, in a society that values getting married young, the fact that one is young is a reason to get married. In racist and sexist societies, we have social reasons to be racist and sexist. Social reasons give rise to social requirements and obligations, where these requirements often conflict with prudential and moral requirements. My application of reasons to (...)

  47. Why Moral Agreement is Not Enough to Address Algorithmic Structural Bias.P. Benton - 2022 - Communications in Computer and Information Science 1551:323-334.
One of the predominant debates in AI Ethics is the worry and necessity to create fair, transparent and accountable algorithms that do not perpetuate current social inequities. I offer a critical analysis of Reuben Binns’s argument in which he suggests using public reason to address the potential bias of the outcomes of machine learning algorithms. In contrast to him, I argue that ultimately what is needed is not public reason per se, but an audit of the implicit moral assumptions of (...)

  48. The Complementary Relation Between the Right and the Good in Justice as Fairness: Implications for Liberal Democracies (PhD Thesis).P. Benton - 2023 - Dissertation, University of Pretoria
I claim that the revisions John Rawls made to his theory of justice—as seen in his political conception of justice as fairness in the revised edition of Political Liberalism and Justice as Fairness: A Restatement—result in him being able to secure justice for all persons even in their private lives. Thus, I defend his theory against common communitarian and feminist criticisms, viz the lack of moral community and inability to secure justice for individuals in the private domain. I demonstrate that (...)

Work has always been a significant source of ethical questions, philosophical reflection, and political struggle. Although the future of work in a sense is always at stake, the issue is particularly relevant right now, in light of the advent of advanced AI systems and the collective experience of the COVID-19 pandemic. This has reinvigorated philosophical discussion and interest in the study of the future of work. The purpose of this survey article is to provide an overview of the emerging philosophical (...)

In this paper, I discuss a subset of preferences in which a person desires the fulfillment of a choice they have made, even if it involves the violation of their desires, as in rape fantasies. I argue that such cases provide us with a unique insight into personal autonomy from a proceduralist standpoint. In its first part, I analyze some examples in light of Frankfurt's endorsement theory and argue that even when we cannot endorse a practical decision that involves being (...)
