Is socialism morally preferable to free market capitalism? G. A. Cohen (2009) has argued that even when the economic inequalities produced by free markets are not the result of injustice, they nevertheless ought to be avoided because they are community undermining. As free markets inevitably lead to economic inequalities and Socialism does not, Socialism is morally preferable. This argument has been the subject of recent criticism. Chad Van Schoelandt (2014) argues that it depends on a conception of community that (...) is incompatible with pluralism while Richard Miller (2010) argues that it rules out individualistic pursuits. This volume contains the English translation of Felix Kaufmann's (1895-1945) main work Methodenlehre der Sozialwissenschaften (1936). In this book, Kaufmann develops a general theory of knowledge of the social sciences in his role as a cross-border commuter between Husserl's phenomenology, Kelsen's pure theory of law and the logical positivism of the Vienna Circle. This multilayered inquiry connects the value-oriented reflections of a general philosophy of science with the specificity of the methods and theories of the social sciences, as opposed to (...) abstract natural science and psychology. The core focus of the study is the attempt to elucidate how and under what conditions scientific knowledge about social facts, empirically justified and theoretically embedded, can be obtained. The empirical basis of knowledge within the social sciences forms a phenomenological concept of experience. According to Kaufmann, this concept of experience exhibits a complex structure. Within the meaning-interpretation of human action as the core of knowledge in the social sciences, this structure reaches out across the isolated act of verification toward the synthesis of external and internal experiences. The book opens with a detailed and useful introduction by Ingeborg K. Helling, which introduces the historical and theoretical background of Kaufmann's study and specifically illuminates his relation to Alfred Schütz and John Dewey. En este artículo me propongo considerar los alcances que tiene la descripción fenomenológica para esclarecer la experiencia de un cuerpo que danza. Parto de las siguientes hipótesis: 1) La distinción entre bailar y danzar permite clarificar la diferencia entre la experiencia de la danza en tanto vivida en el propio cuerpo, a la que llamo bailar, y la experiencia de la danza de un_ otr_, que llamo danzar. 2) L_s bailarin_s poseen un conjunto de conocimientos prácticos acerca de su práctica (...) que se ponen en juego pre reflexivamente en todo bailar. 3) La fenomenología brinda una herramienta para hacer esos conocimientos compartibles. En primer lugar, desarrollaré por qué propongo hacer uso de las posibilidades que da el español (así como también el italiano) de distinguir entre “bailar” y “danzar”. En segundo lugar, abordaré el concepto de conocimiento práctico de Alfred Schutz[1] y sus posibilidades para comprender la experiencia de l_s bailarin_s. In his 1920 monograph Relativitätstheorie und Erkenntnis apriori the young Reichenbach distinguished between two meanings of the a priori: ‚apodictically valid, true for all time‘ and ‚constituting the concept of object‘. At the end of the 1990s Michael Friedman drew again the attention of philosophers of science to this forgotten distinction. In the spirit of Reichenbach’s early Kantianism Friedman attempted to construct a relativized or temporally variable a priori, which is nevertheless constitutive of the object of knowledge. Friedman rejects an (...) alternative historicized version of the a priori elaborated by the Marburg school and in particular by Cassirer. According to Friedman, Cassirer defended a regulative, but absolute version of the a priori, the existence of a yet-to-be-found set of final principles that are conditions of all scientific experience. This paper suggests that using the constitutive/regulative distinction as a basis for comparison is misleading. In order to understand the Marburg school’s conception of the a priori one should get back to Hermann Cohen’s interpretation of Kant and in particular to his own distinction between two meanings of the a priori. A more suitable comparison is that between Cohen’s opposition metaphysical-vs.-transcendental a priori and Reichenbach’s distinction apodictic-vs.-constitutive a priori. If the comparison is conducted along these lines—as already suggested in the mid-1920 s by the Dutch neo-Kantian Alfred C. Elsbach—it turns out that Cohen and the Marburg school and not Reichenbach provided a good example of a relativized a priori. (shrink)

The Structures of the Life-World is the final focus of twenty-seven years of Alfred Schutz's labor, encompassing the fruits of his work between 1932 and his death in 1959. This book represents Schutz's seminal attempt to achieve a comprehensive grasp of the nature of social reality. Here he integrates his theory of relevance with his analysis of social structures. Thomas Luckmann, a former student of Schutz's, completed the manuscript for publication after Schutz's untimely death.

Each of the following claims has been defended in the scientific literature on free will and consciousness: your brain routinely decides what you will do before you become conscious of its decision; there is only a 100 millisecond window of opportunity for free will, and all it can do is veto conscious decisions, intentions, or urges; intentions never play a role in producing corresponding actions; and free will is an illusion. In Effective Intentions Alfred Mele shows that the evidence (...) offered to support these claims is sorely deficient. He also shows that there is strong empirical support for the thesis that some conscious decisions and intentions have a genuine place in causal explanations of corresponding actions. In short, there is weighty evidence of the existence of effective conscious intentions or the power of conscious will. Mele examines the accuracy of subjects' reports about when they first became aware of decisions or intentions in laboratory settings and develops some implications of warranted skepticism about the accuracy of these reports. In addition, he explores such questions as whether we must be conscious of all of our intentions and why scientists disagree about this. In this paper, I explore the possibility of developing a Kantian account of the ethics of belief by deploying the tools provided by Kant's ethics. To do so, I reconstruct epistemic concepts and arguments on the model of their ethical counterparts, focusing on the notions of epistemic principle, epistemic maxim and epistemic universalizability test. On this basis, I suggest that there is an analogy between our position as moral agents and as cognizers: our actions and our thoughts are subject to (...) the same rational norm. (shrink)

In Mindblindness, Simon Baron-Cohen presents a model of the evolution and development of "mindreading." He argues that we mindread all the time, effortlessly, automatically, and mostly unconsciously. It is the natural way in which we interpret, predict, and participate in social behavior and communication. We ascribe mental states to people: states such as thoughts, desires, knowledge, and intentions. Building on many years of research, Baron-Cohen concludes that children with autism, suffer from "mindblindness" as a result of a selective (...) impairment in mindreading. For these children, the world is essentially devoid of mental things. Baron-Cohen develops a theory that draws on data from comparative psychology, from developmental, and from neuropsychology. He argues that specific neurocognitive mechanisms have evolved that allow us to mindread, to make sense of actions, to interpret gazes as meaningful, and to decode "the language of the eyes." A dissertation in the tradition of logical positivism includes a discussion of the functions and methods of philosophy and a critique of ethics and theology.

We use a new model of metarepresentational development to predict a cognitive deficit which could explain a crucial component of the social impairment in childhood autism. One of the manifestations of a basic metarepresentational capacity is a ‘ theory of mind ’. We have reason to believe that autistic children lack such a ‘ theory ’. If this were so, then they would be unable to impute beliefs to others and to predict their behaviour. This hypothesis was tested using Wimmer (...) and Perner’s puppet play paradigm. Normal children and those with Down’s syndrome were used as controls for a group of autistic children. Even though the mental age of the autistic children was higher than that of the controls, they alone failed to impute beliefs to others. Thus the dysfunction we have postulated and demonstrated is independent of mental retardation and specific to autism. (shrink)

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

We shall formulate an analysis of the ordinary notion of intentional action that clarifies a commonsense distinction between intentional and nonintentional action. Our analysis will build on some typically neglected considerations about relations between lucky action and intentional action. It will highlight the often- overlooked role of evidential considerations in intentional action, thus identifying the key role of certain epistemological considerations in action theory.
