This article provides a critical and philosophical assessment of arguments invoked for and against the constitutional protection of commercial expression and the regulation of commercial speech with a focus on the commercialization of unhealthy food products.

Este artículo busca responder a la siguiente pregunta: ¿Qué tipo de relación sostiene la Ciencia de la lógica con la tradición metafísica? Hay en ello un doble motivo de reflexión: por un lado, se trata de distinguir los sentidos de la crítica y los de la transformación científica de la metafísica tanto en Kant como en Hegel, y, por otro lado, de concebir el inicio [Anfang] y el principio [Prinzip] de la Lógica como dos modos de relación que permitirían hacer (...) tal distinción aunque únicamente de manera introductoria. El inicio de esta Lógica es así el primer fin de un círculo que vuelve a abrirse; anverso del límite, o estudio lógico de reverso fenomenológico; unidad de un carácter genitivo doble ‒de la Ciencia de la conciencia y del Concepto de la Ciencia‒, que hace del saber puro el fin del inicio fenomenológico, y al mismo tiempo el inicio de su propia exposición. Inicio inmanente al desarrollo de la Ciencia y que es por lo tanto un momento de saber-puro-ser. Es, dicho en breve, el inicio de una Lógica pura, objetiva y subjetiva, ya liberada de la oposición en sí/concepto, y que al ser el desarrollo del pensar objetivo se constituye en el “sistema de la razón pura”. Este trabajo analiza, desde una perspectiva sociodemográfica, el comportamiento de la mortalidad adolescente en Argentina, más allá de las causas externas, en los trienios 2005-2007 y 2015-2017. Para ello, se calculan y analizan tasas de mortalidad por sexo, grupo de edad, causas seleccionadas y regiones geográficas, con base en datos de la Dirección de Estadística e Información de Salud de la Nación y del Instituto Nacional de Estadísticas y Censos. También se calculan el Coeficiente de Gini y los Años de (...) Esperanza de Vida Perdidos a nivel regional para profundizar el análisis de la dinámica espacial de la mortalidad. Los resultados muestran una reducción de la mortalidad adolescente para el conjunto de causas no externas. Sin embargo, se observan además: (a) mayores tasas de mortalidad masculina; (b) un aumento de la mortalidad en la población de 15 a 19 años de ambos sexos; (c) el predominio de los tumores como principal causa de muerte no externa; (d) un aumento de la mortalidad por enfermedades del sistema nervioso central, del aparato circulatorio, respiratorias y causas maternas, fundamentalmente entre los 15 y 19 años; y (e) la persistencia de diferencias interregionales, mayormente en detrimento del Noreste y del Noroeste. Estos resultados refuerzan la importancia de emprender medidas focalizadas en las particularidades de cada región y los factores que inciden en la ocurrencia de las muertes registradas. Todo ello en favor de procurar una atención más integral de la salud de la población adolescente, y lograr así sociedades más saludables y sostenibles a futuro. (shrink)

As possibilidades do cinema no ensino das humanidades Resumo: Tradicionalmente usado como ilustração e sensibilização de conteúdos curriculares, propomos neste artigo um outro modo de usar cinema como recurso didático no ensino de humanidades. Em um primeiro momento, fazemos uma crítica acerca das práticas mais usuais, levantando o problema se com elas o cinema de fato pensa. Em um segundo momento, a partir da concepção proposta por Gilles Deleuze, propomos encarar o cinema como instaurador de processos mentais através de suas (...) técnicas de enquadramento, decupagem e montagem. Confrontamos a proposta de Deleuze com a de Julio Cabrera para analisar criticamente a relação do pensamento com o cinema. Discutimos teoricamente esta distinção e também apresentamos práticas didáticas possíveis relacionadas a ambos os procedimentos. O artigo procura refletir tanto sobre as teorias quanto as práticas possíveis tendo em vista a relação pensamento e cinema. Palavras-chave: ensino; filosofia do cinema; humanidades; cinema. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Presenting a fascinating analysis of the idea of what can't be said, this book ascertains whether the notion of there being a truth, or a state of affairs, or knowledge that can't be expressed linguistically is a coherent notion. The author distinguishes different senses in which it might be said that something can't be said. The first part looks at the question of whether ineffability is a coherent idea. Part two evaluates two families of arguments regarding whether ineffable states of (...) affairs actually exist: the argument from mysticism and the argument from epistemic boundedness. Part three looks more closely at the relation between mystic and non-mystic stances. In the fourth and final part the author distinguishes five qualitatively different types of ineffability. _Ineffability and Philosophy_ is a significant contribution to this area of research and will be essential reading for philosophers and those researching and studying the philosophy of language. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. In this challenging study, André Gallois proposes and defends a thesis about the character of our knowledge of our own intentional states. Taking up issues at the centre of attention in contemporary analytic philosophy of mind and epistemology, he examines accounts of self-knowledge by such philosophers as Donald Davidson, Tyler Burge and Crispin Wright, and advances his own view that, without relying on observation, we are able justifiably to attribute to ourselves propositional attitudes, such as belief, that we consciously hold. Despite journalism’s commitment to ethical principles such as accuracy, humanity and diversity, compliance with the gender perspective in content is still minimal in approximately one hundred countries. This inequality reinforces misperceptions, imbalances, and perceived differences between men and women. To address this situation, from 2010 to 2021, eight Spanish media companies appointed a new editorial position responsible for self-regulating gender equality. This qualitative study focused on 10 journalists who currently exercise or have exercised that job, to detect, describe and propose (...) the implementation of this new professional role. This study suggests that gender editing has advanced equality in parity of sourcing and the presence of women in the opinion sections, but implementation of equality in overall content is more difficult. Gender editors’ daily work is hampered by a lack of management support and an absence of independence in editorial decisions. (shrink)

Resumen El objetivo principal del presente trabajo es analizar la atenuación en los actos asertivos en entrevistas sociolingüísticas a fin de entender cómo se construye la imagen de afiliación en la cultura mexicana. En este trabajo la imagen de afiliación se define como el deseo de ser aceptado por un grupo. Nos interesa determinar si la realización de estos actos asertivos son amenazas eventuales a la imagen social de los informantes y si tienen una función atenuadora. El corpus que se (...) analizó consistió en segmentos seleccionados de 12 entrevistas, 6 de hombres y 6 de mujeres, del corpus oral “El habla de Monterrey–PRESEEA” correspondientes a informantes entre 35 y 54 años que concluyeron sus estudios de licenciatura. El análisis de este corpus oral muestra aspectos importantes, a saber, nos presenta que existen similitudes y diferencias entre los dos grupos pues tanto hombres como mujeres utilizaron la justificación para atenuar su punto de vista. En cuanto a diferencias, las mujeres emplearon más estrategias de atenuación que los hombres. Por otra parte, el análisis de los datos sugiere que la atenuación, como categoría pragmática, contribuye a caracterizar la imagen de afiliación de nuestros informantes. (shrink)

This paper aims to contribute to the existing literature on normative cognition by providing a lineage explanation of human social norm psychology. This approach builds upon theories of goal-directed behavioral control in the reinforcement learning and control literature, arguing that this form of control defines an important class of intentional normative mental states that are instrumental in nature. I defend the view that great ape capacities for instrumental reasoning and our capacity (or family of capacities) for shared intentionality coadapted to (...) each other and argue that the evolution of this capacity has allowed the representation of social norms and the emergence of our capacity for normative guidance. Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

Nonprofit organizations (NPOs), are quite complex in terms of organizational structure, diversity at the workplace, as well as motivational mechanisms and values rationality. Nevertheless, from an Organizational Psychology perspective, the systematic analysis of this context is scarce in the literature, particularly regarding conflicts. This qualitative study analyzes types, prevalence and consequences of conflicts in a large NPO organization considering as theoretical framework several consolidated Organizational Psychology theories: Conflict Theory, Social Comparison Theory and the Equity Theory. Conflicts were analyzed taking into (...) account volunteers’ perspective, who has been consistently protagonist on NPOs research, but also considering paid staff’s perspective, as one of the main stakeholders in these organizations, whose relative power has increase in the past decade due the professionalization of the NPO’s sector. Results confirmed the existence of four types of conflicts: task, process, status and relationship conflicts. Relationship conflict is the least reported type, revealing the protection factor that values and engagement with a social aim have on this organizational context. The most relevant finding is the strong difference between paid staff and volunteers in conflict perceptions, showing paid staff, overall, higher levels of conflicts than volunteers. Findings also show stronger negative consequences for paid staff compared to volunteers. Theoretical and practical implications are discussed. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

The second wave of devastating consequences of the COVID-19 pandemic has been linked to dramatic declines in well-being. While much of the well-being literature is based on descriptive and correlational studies, this paper evaluates a growing body of causal evidence from high-quality randomized controlled trials (RCTs) that test the efficacy of positive psychology interventions (PPIs). This systematic review analyzed the findings from 25 meta-analyses, 42 review papers, and the high-quality RCTs of PPIs designed to generate well-being that were included within (...) those studies. Findings reveal PPIs have the potential to generate well-being even during a global pandemic, with larger effect sizes in non-Western countries. Four exemplar PPIs—that have been tested with a high-quality RCT, have positive effects on well-being, and could be implemented during a global pandemic—are presented and discussed. Future efforts to generate well-being can build on this causal evidence and emulate the most efficacious PPIs to be as effective as possible at generating well-being. However, the four exemplars were only tested in WEIRD (Western, Educated, Industrial, Rich, and Democratic) countries but seem promising for implementation and evaluation in non-WEIRD contexts. This review highlights the overall need for more rigorous research on PPIs with more diverse populations and in non-WEIRD contexts to ensure equitable access to effective interventions that generate well-being for all. I shall then move on to explain not only why there is nothing Nazi—or even antisemitic—about Schmitt’s concept of the political, but rather the other way around: Schmitt’s concept of the political not only must have been used against National Socialism but it did not fail to have his fair share of Jewish, or (...) at the very least Zionist, enthusiasts. This paper offers a new interpretation for Wittgenstein`s treatment of mathematical identities. As it is widely known, Wittgenstein`s mature philosophy of mathematics includes a general rejection of abstract objects. On the other hand, the traditional interpretation of mathematical identities involves precisely the idea of a single abstract object – usually a number –named by both sides of an equation.

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. This thesis focuses on the evolution of human social norm psychology. More precisely, I want to show how the emergence of our distinctive capacity to follow social norms and make social normative judgments is connected to the lineage explanation of our capacity to form shared intentions, and how such capacity is related to a diverse cluster of prototypical moral judgments. I argue that in explaining the evolution of this form of normative cognition we also require an understanding of the developmental (...) trajectory of this capacity. For this purpose, the thesis is organized as follow. In the first chapter, I make some methodological remarks and provide the general overview and plan for the dissertation. In the second chapter, I explain what my explanatory target is and why it matters. On the view I am defending, shared intentional psychology gives rise to a special form of psychology that enables us to engage in social normative thinking. These norms are represented as shared intentional states. Moral psychology, in contrast, is more diverse. For moral judgments define a quite heterogeneous class of mental states—although some moral judgments may involve the representation and execution of norms, certainly not all of them do. I show that although much of our distinctive social norm psychology can be explained within the framework of shared intentionality, moral judgments cannot be unified in the same way. In the third chapter, I provide the baseline of social-cognitive capacities that serve as starting point for my lineage explanation. I argue that hominin social cognition was for a very long period of our evolutionary history essentially a matter of low-level cognitive and motivational processes. On this picture, bottom-up affective processes regulated the social lives of early hominins without requiring any special top-down mechanism of normative thinking such as a capacity for understanding and representing social norms. In the fourth chapter, I argue that human-like social norm psychology evolved as a result of the selective pressures that gave rise to shared intentionality, especially the demands that came from collective hunting. Yet collective hunting was not the whole story of the evolution of shared intentionality, for our capacity to form shared intentional mental states emerged from the interplay between the selective pressures that led to cooperative breeding in humans as well as organized, goal-oriented, collective hunting. Thus, I propose an evo-devo account of shared intentionality and its normative dimension since I argue that explaining the evolution of this particular form of normative thinking crucially depends on information about the developmental trajectory of this capacity. Finally, in the fifth chapter, I focus on how social norms are acquired and how the way we learn them gives rise to some prototypical cluster of moral judgments. Thus, this chapter returns to some of themes and arguments of the first chapter by explaining how the distinction between moral judgments and nonmoral judgments can be culturally transmitted. This chapter is divided into three parts. In the first, I ask whether there is a human right to be spared extreme poverty. The answer is ‘Not necessarily’ if a human right is a legal right, and I argue that ‘human right’ either means a right in international law and associated policy, or else the term has an unacceptably wide sense. In the second section I consider microcredit as a poverty-alleviating mechanism, distinguishing between extreme and relative poverty in developing countries. (...) I argue that credit may not be a good way of alleviating extreme poverty, and that methods of collecting debt used by microcredit providers may have moral drawbacks. In the third section I consider the fit between the class of agents currently involved in offering financial services to the poor, and the class of agents recognized as duty-bearers by human rights law and policy. Unless states become highly involved in microcredit, it is not clear that microfinance providers are or can be human rights duty bearers. (shrink)

Assurément, la lecture d'Origène par Erasme est d'abord un plaisir du texte. L'étude d'André Goin en éclaire les prolongements historico- théologiques. Erasme s'est d'abord employé à délivrer Origène de la "caverne des ombres" d'où de nombreux humanistes, dont Pic de la Mirandole, n'avaient pu le tirer. Avec son génie propre, et alliant l'audace calculée et l'enthousiasme sincère pour la spiritualité origienne, Erasme fait une exégèse subtile fondée sur un réemploi, massif et sélectif, de l'énorme matériau emprunté à Origène, une tentative (...) de dépassement des problèmes posés par l'orthodoxie d'Origène, et enfin, s'impose comme traducteur et éditeur d'Origène. De grote uitdagingen op politiek, economisch en vooral ecologisch gebied hebben geleid tot een teneur van apocalyptisch denken: het einde van de wereld en de mensheid zou nabij zijn. Dit ondergangsdenken is geen nieuw verschijnsel, door de geschiedenis heen is vaak verkondigd dat het met de wereld gedaan zou zijn. André Klukhuhn onderwerpt het cultuurpessimisme aan nader onderzoek en vraagt zich af wat wij kunnen leren van het apocalyptische denken in het verleden. Speciale aandacht heeft hij voor vier denkers die (...) geboren zijn in het fin de siècle en die in het interbellum bekendheid verwierven met hun cultuurpessimistische theorieën: Oswald Spengler, José Ortega y Gasset, Johan Huizinga en Sinclair Lewis. Aan de hand van hun denken pleit Klukhuhn voor een radicale verandering in ons denken en handelen om ons te verweren tegen de huidige ecologische crisis. (shrink)

Peer competition and peer cooperation can be intuitively seen as opposing phenomena. However, depending on multiple factors, they might be complementary. In a population divided into groups, for instance, members of each group may cooperate with their peers in order to compete with neighboring groups. Alternatively, they may compete with their peers as a means of choosing the best cooperative partners and demonstrate that they are reliable cooperative partners. The existence of causal explanations in science has been an issue of interest in Western philosophy from its very beginnings. That is the reason this work, following an idea of Mario Bunge, makes a historical review of this matter. The modern treatment of this subject takes place since the postulation by Popper and Hempel of the D-N model of scientific explanation, whose viability is scrutinized here from different points of view in the current philosophy of science. The main object of (...) this paper is to present two arguments against the possibility of causal explanations in theoretical physics. The first one concerns the existence, in certain cases, of inter-theoretical incompatibilities, and the second refers to the need to resort, in other cases, to concatenations of laws of different theories and disciplines. The final conclusion will be the defence of a form of theoretical explanation, which follows the Popper-Hempel model, but devoid of any ontological and metaphysical connotations. (shrink)

Cet ouvrage s'inscrit dans la série des travaux que le Centre de Recherche Philosophique de l'Université de Lille III consacre à l'étude des cosmologies grecques. Après le système classique d'Empédocle et la réflexion critique d'Epicure à l'époque hellénistique, on s'intéresse ici à un penseur charnière, le dernier représentant de l' "ancienne physique".La notoriété de Diogène d'Apollonie est faible, au-delà du cercle restreint des spécialistes du Ve siècle grec. Ce tard venu n'a pas le renom d'Anaximandre ou d'Empédocle, ni celui de (...) Démocrite, dont il est contemporain. Et pourtant, sa pensée n'est pas seulement l'ultime avatar d'une lignée dont il serait au fond indigne. Elle représente au contraire une forme d'achèvement, offrant une solution possible, dans le cadre du paradigme cosmologique hérité, au problème, laissé ouvert par le système d'Anaxagore, du mode d'action de "l'intellect" (νούς) dans le monde. La pertinence et la spécificité de la démarche, qui induit une doctrine de l'immanence, ressortent clairement quand on la confronte avec la célèbre critique d'Anaxagore menée par Socrate au nom de la téléologie dans le Phédon de Platon, et qui signe l'arrêt de mort de la spéculation présocratique. El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. En este artículo se propone un fundacionalismo confiabilista, inspirado en Goldman, aunque con cambios importantes respecto a su teoría. A diferencia de Goldman, considero que no todas las creencias tienen que ser verdaderas, ni toda justificación de las creencias requiere de la verdad. Adicionalmente, las creencias verdaderas, expresadas mediante oraciones asertóricas, estarían fundadas (...) en creencias aún más básicas, cuya justificación proviene del uso del lenguaje. (shrink)
