In the domain of legal information retrieval, an important challenge is to compute similarity between two legal documents. Precedents play an important role in The Common Law system, where lawyers need to frequently refer to relevant prior cases. Measuring document similarity is one of the most crucial aspects of any document retrieval system which decides the speed, scalability and accuracy of the system. Text-based and network-based methods for computing similarity among case reports have already been proposed in prior works but (...) not without a few pitfalls. Since legal citation networks are generally highly disconnected, network based metrics are not suited for them. Till date, only a few text-based and predominant embedding based methods have been employed, for instance, TF-IDF based approaches, Word2Vec and Doc2Vec based approaches. We investigate the performance of 56 different methodologies for computing textual similarity across court case statements when applied on a dataset of Indian Supreme Court Cases. Among the 56 different methods, thirty are adaptations of existing methods and twenty-six are our proposed methods. The methods studied include models such as BERT and Law2Vec. It is observed that the more traditional methods that rely on a bag-of-words representation performs better than the more advanced context-aware methods for computing document-level similarity. Finally we nominate, via empirical validation, five of our best performing methods as appropriate for measuring similarity between case reports. Among these five, two are adaptations of existing methods and the other three are our proposed methods. (shrink)

In a Common Law system, legal practitioners need frequent access to prior case documents that discuss relevant legal issues. Case documents are generally very lengthy, containing complex sentence structures, and reading them fully is a strenuous task even for legal practitioners. Having a concise overview of these documents can relieve legal practitioners from the task of reading the complete case statements. Legal catchphrases are (multi-word) phrases that provide a concise overview of the contents of a case document, and automated generation (...) of catchphrases is a challenging problem in legal analytics. In this paper, we propose a novel supervised neural sequence tagging model for the extraction of catchphrases from legal case documents. Specifically, we show that incorporating document-specific information along with a sequence tagging model can enhance the performance of catchphrase extraction. We perform experiments over a set of Indian Supreme Court case documents, for which the gold-standard catchphrases (annotated by legal practitioners) are obtained from a popular legal information system. The performance of our proposed method is compared with that of several existing supervised and unsupervised methods, and our proposed method is empirically shown to be superior to all baselines. In today’s competitive economy, the war for talent has intensified. Organizations are increasingly investing in student engagement initiatives to build a robust talent pipeline. Among these initiatives, the offering of internship placements is a popular choice as it not only helps identify suitable talent, students can also benefit with valuable opportunities to develop work-related skills and gain experience. However, ensuring mutually beneficial outcomes for all stakeholders involved remains a challenge due to diverging expectations among stakeholder groups. This study aims to (...) enhance our understanding of high-quality internship design by applying stakeholder theory (ST) and the expectancy theory of motivation (ET) as theoretical frameworks. Qualitative research methods were employed, including semi-structured interviews with key stakeholders from higher education institutions, human resources managers, and front-line supervisors as well as a focus group with graduating business students. Thematic analysis of the data revealed several key themes related to stakeholder priorities and interests. The findings of this paper contribute to the fields of ST and ET by addressing an under-researched area: the motivations of supervisors as crucial stakeholders in delivering the internship experience. Scholars and practitioners have largely overlooked this aspect. From a managerial perspective, the findings highlight opportunities for fostering more synergistic partnerships between stakeholders, not only at the institutional level but also among internal stakeholder groups, including top management, human resources functions, and front-line supervisors. In this book, Roy Bhaskar sets out to revindicate ontology, critiquing the reduction of being in favor of knowledge, which he calls the "epistemic fallacy".

The primary narrative problem of the analyst is, then, not how to tell a normative chronological life history; rather, it is how to tell the several histories of each analysis. From this vantage point, the event with which to start the model analytic narration is not the first occasion of thought—Freud's wish-fulfilling hallucination of the absent breast; instead, one should start from a narrative account of the psychoanalyst's retelling of something told by an analysand and the analysand's response to that (...) narrative transformation. In the narration of this moment of dialogue lies the structure of the analytic past, present, and future. It is from this beginning that the accounts of early infantile development are constructed. Those traditional developmental accounts, over which analysts labored so hard, may now be seen in a new light: less as positivistic sets of factual findings about mental development and more as hermeneutically filled-in narrative structures. The narrative structures that have been adopted control the telling of the events of the analysis, including the many tellings and retellings of the analysand's life history. The time is always present. The event is always an outgoing dialogue. This book, first published in 1993, sets itself three main aims: the development of a general theory of dialectic, of which Hegelian dialectic can be seen to be a special case; the dialectical enrichment and deepening of critical realism, viz. into the system of dialectical critical realism; and the outline of the elements of a totalizing critique of Western philosophy. The first chapter clarifies the rational core of Hegelian dialectic. (...) Chapter two then proceeds to develop a general theory of dialectic. Isolating the fallacy of 'ontological monovalence', Roy Bhaskar then shows how absence and other negating concepts such as contradiction have a legitimate and necessary ontological employment. He then goes on to give a synoptic account of key dialectical concepts such as the concrete universal; to sketch the further dialectical development of critical naturalism through an account of what he calls four-planar social being; and following consideration of the dialectical critique of analytical reason, he moves on to the real definition of dialectic as absenting absence and in the human sphere, the axiology of freedom. The Transforming growth factor beta (TGF‐β) family of secreted proteins regulates a variety of key events in normal development and physiology. In mammals, this family, represented by 33 ligands, including TGF‐β, activins, nodal, bone morphogenetic proteins (BMPs), and growth and differentiation factors (GDFs), regulate biological processes as diverse as cell proliferation, differentiation, apoptosis, metabolism, homeostasis, immune response, wound repair, and endocrine functions. In Drosophila, only 7 members of this family are present, with 4 TGF‐β/BMP and 3 TGF‐β/activin ligands. Studies in (...) the fly have illustrated the role of TGF‐β/BMP ligands during embryogenesis and organ patterning, while the TGF‐β/activin ligands have been implicated in the control of wing growth and neuronal functions. In this review, we focus on the emerging roles of Drosophila TGF‐β/activins in inter‐organ communication via long‐distance regulation, especially in systemic lipid and carbohydrate homeostasis, and discuss findings relevant to metabolic diseases in humans. -/- . Using labelled formulae, a cut-free sequent calculus for intuitionistic propositional logic is presented, together with an easy cut-admissibility proof; both extend to cover, in a uniform fashion, all intermediate logics characterised by frames satisfying conditions expressible by one or more geometric implications. Each of these logics is embedded by the Gödel–McKinsey–Tarski translation into an extension of S4. Faithfulness of the embedding is proved in a simple and general way by constructive proof-theoretic methods, without appeal to semantics other than in the (...) explanation of the rules. (shrink)

This text maps the network of concepts that constitute the general catagory of reason. In the process it shows that some famous philosophical doctrines are based on mistaken assumptions in this conceptual area. In particular, it aims to undermine the arguments of Hume and is modern followers to the effect that reason can be theoretical but not practical (can govern thought but not action) and that value judgements cannot be validly inferred from facts.

It has been argued that affordances are not meaningful and are thus not useful to be applied in contexts where specifically meaningfulness of experience is at stake (e.g. clinical contexts or discussions of autonomous agency). This paper aims to reconceptualize affordances such as to make them relevant and applicable in such contexts. It starts by investigating the ‘ambiguity’ of (possibilities for) action. In both philosophy of action and affordance research, this ambiguity is typically resolved by adhering to the agents intentions (...) and concerns. I discuss some recent accounts of affordances that highlight these concerns but argue that they tend to adopt an ‘atomistic’ approach where there is no acknowledgement of how these concerns are embedded in the agents wider concerns, values, projects and commitments. An holistic approach that does acknowledge this can be found in psychological research on agents having a sense of what they’re doing. I will discuss this research in the second part of the paper and argue that agents can analogously have a sense of what is afforded. This is deemed the entry point for understanding the meaningfulness of affordances. In the final part of the paper I apply this analysis to recent attempts which seek to make sense of authentic and autonomous agency in terms of affordances. (shrink)

That every first-order theory has a coherent conservative extension is regarded by some as obvious, even trivial, and by others as not at all obvious, but instead remarkable and valuable; the result is in any case neither sufficiently well-known nor easily found in the literature. Various approaches to the result are presented and discussed in detail, including one inspired by a problem in the proof theory of intermediate logics that led us to the proof of the present paper. It can (...) be seen as a modification of Skolem’s argument from 1920 for his “Normal Form” theorem. “Geometric” being the infinitary version of “coherent”, it is further shown that every infinitary first-order theory, suitably restricted, has a geometric conservative extension, hence the title. The results are applied to simplify methods used in reasoning in and about modal and intermediate logics. We include also a new algorithm to generate special coherent implications from an axiom, designed to preserve the structure of formulae with relatively little use of normal forms. (shrink)

Affordances are possibilities for action offered by the environment. Recent research on affordances holds that there are differences in how people experience such possibilities for action. However, these differences have not been properly investigated. In this paper I start by briefly scrutinizing the existing literature on this issue, and then argue for two claims. First, that whether an affordance solicits action or not depends on its relevance to the agent’s concerns. Second, that the experiential character of how an affordance solicits (...) action depends on the character of the concern to which it is relevant. Concerns are conceived of as bodily forms of responsiveness, and solicitations are experienced through this responsiveness. The main aim of this paper is to make clear that an understanding of experiential differences in solicitations has to be based on a phenomenological appreciation of how one experiences one’s responsiveness to those solicitations. In the remainder of the paper I show how such a phenomenological appreciation reveals several characteristics of our responsiveness and I briefly explore three of them: valence, force and mineness. In the final section I discuss the self-referentiality of affordances in light of the current proposal, and argue that this self-referentiality is broader than is typically acknowledged. (shrink)

First, we draw on empirical findings to argue that self-ambiguity is a ubiquitous phenomenon. We suggest that these findings are best explained by a multidimensional account, according to which selves consist of various dimensions that mutually affect each other. On such an account, any change to any particular self-aspect may change other self-aspects and thereby alter the overall structural pattern of self-aspects, potentially leading (...) to self-ambiguity. Second, we propose that self-ambiguity comes in degrees and should be understood as a spectrum (as opposed to there being qualitative differences among instances of self-ambiguity). Third, we argue that complexity is the most useful dimension to organize cases of self-ambiguity, with mundane instances of self-ambiguity on the one end and self-illness ambiguity on the other end of the spectrum. Interdisciplinarity and Climate Change is a major new book addressing one of the most challenging questions of our time. It is widely thought that the acceptability of an abstraction principle is a feature of the cardinalities at which it is satisfiable. This view is called into question by a recent observation by Richard Heck. We show that a fix proposed by Heck fails but we analyze the interesting idea on which it is based, namely that an acceptable abstraction has to “generate” the objects that it requires. We also correct and complete the classification of proposed criteria for acceptable abstraction.

Second, building on previous work by Shaun Gallagher, we propose a modified ‘pattern-theory of self’, which provides a richer picture of the possible consequences of DBS treatment.
