The power of finance vis-à-vis the nonfinancial sector is changing. Macroeconomic developments and financial innovations have reduced financial actors’ exit options, thus diminishing exit-based structural power. At the same time, shareholdings have become more concentrated in the hands of large asset managers, thus increasing control-based power. This article documents these trends, before examining whether asset managers wield their power and why, despite being universal shareholders, they have not steered corporate behavior toward decarbonization. Rather than assuming orderly, good-faith interactions between shareholders (...) and managers, this article argues that in the United States today, political considerations govern the use of control-based power. Asset managers’ corporate governance policies are subservient to the—increasingly inconsistent—goals of maximizing assets under management while avoiding regulatory backlash. Unlike exit-based power, control-based power is constrained by being highly visible and, therefore, easily politicized. (shrink)

Mathematics is often positioned as either neutral or non-neutral by mathematicians. However, in practice, issues of neutrality arise in situated contexts, and the positioning of mathematics as either neutral or non-neutral is done for many purposes. We interpret positioning of mathematical work, with different degrees of neutrality, as a response to conflicts of interest and power dynamics. Using a framework from ecofeminist critical theory, we examine the ways that mathematical neutrality is positioned and communicated to different audiences in ways that (...) can appear contradictory. Our goal is to demonstrate that the neutral/non-neutral dualism is insufficient for the analysis of neutrality in mathematics, which requires instead a robust analytical lens. We situate our discussion of these issues in the context of communication regarding the mathematical analysis of partisan gerrymandering in the United States. Through a study of communication to different audiences by mathematicians regarding mathematical techniques used to study partisan gerrymandering, we illustrate various ways in which dualistic views of neutrality are insufficient to describe and understand the complicated role of neutrality in this context. This chapter offers a proceduralist argument against capital punishment. More specifically, it contends that the possibility of irrevocable mistakes precludes the just administration of the death penalty. At stake is a principle of political morality: legal institutions must strive to remedy their mistakes and to compensate those who suffer from wrongful sanctions. The incompatibility of remedy and execution is the crux of the irrevocability argument: because the wrongly executed cannot enjoy the morally required compensation, execution is impermissible. Along with defending (...) his key premises, Yost explains the complicated role that sentencing uncertainty plays in the argument. We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

Examines the development of the philosophy, culture, and civilization of ancient China and discusses the history of Taoism and Confucianism.

The right temporo-parietal junction (rTPJ) has been associated with two apparently disparate functional roles: in attention and in social cognition. According to one account, the rTPJ initiates a “circuit-breaking” signal that interrupts ongoing attentional processes, effectively reorienting attention. It is argued this primary function of the rTPJ has been extended beyond attention, through a process of evolutionarily cooption, to play a role in social cognition. We propose an alternative account, according to which the capacity for social cognition depends on a (...) network which is both distinct from and in tension with brain areas involved in focused attention and target detection: the default mode network. Theory characterizing the rTPJ based on the area’s purported role in reorienting may be falsely guided by the co-occurrence of two distinct effects in contiguous regions: activation of the supramarginal gyrus (SMG), associated with its functional role in target detection; and the transient release, during spatial reorienting, of suppression of the angular gyrus (AG) associated with focused attention. Findings based on meta-analysis and resting functional connectivity are presented which support this alternative account. We find distinct regions, possessing anti-correlated patterns of resting connectivity, associated with social reasoning (AG) and target detection (SMG) at the rTPJ. The locus for reorienting was spatially intermediate between the AG and SMG and showed a pattern of connectivity with similarities to social reasoning and target detection seeds. These findings highlight a general methodological concern for brain imaging. Given evidence that certain tasks not only activate some areas but also suppress activity in other areas, it is suggested that researchers need to distinguish two distinct putative mechanisms, either of which may produce an increase in activity in a brain area: functional engagement in the task versus release of suppression. Evidential Decision Theory and Causal Decision Theory are the leading contenders as theories of rational action, but both face counterexamples. We present some new counterexamples, including one in which the optimal action is causally dominated. We also present a novel decision theory, Functional Decision Theory, which simultaneously solves both sets of counterexamples. Instead of considering which physical action of theirs would give rise to the best outcomes, FDT agents consider which output of their decision function would give rise to the (...) best outcome. This theory relies on a notion of subjunctive dependence, where multiple implementations of the same mathematical function are considered to have identical results for logical rather than causal reasons. Taking these subjunctive dependencies into account allows FDT agents to outperform CDT and EDT agents in, for example, the presence of accurate predictors. (shrink)

It is a testament to the progress of empirical inquiry into mass incarceration that it has already yielded and transcended a “standard story.” By contrast, mass incarceration is only just beginning to emerge as a particular problem for the philosophy of punishment. In this chapter, Ewing offers a critical review of recent work by criminal law theorists, arguing that traditional justifications of punishment are ill-equipped to explain the distinctive injustice of mass incarceration. He then argues that the problem of mass (...) incarceration should force us to reconsider neglected distributive dimensions of criminal justice. And he begins to reflect on what appears unjust about mass incarceration when criminal justice is reconceived as the problem of how to produce and fairly allocate security against crime and punishment. In 1894, the British sociologist Benjamin Kidd published Social Evolution, an influential book that summarised and evaluated the prevailing social theories at the end of the nineteenth century: Karl Marx's socialism and Herbert Spencer's social Darwinism. Both of these conflicting theories were based on Darwinian evolutionary theory. In this book, Kidd discusses the immense changes that applied science has brought to the world and the interconnectedness of everyone. The book's ten chapters include discussions of the conditions of human progress, (...) the function of religious beliefs, and the organisation of the working classes. Kidd found flaws in both Karl Marx's and Herbert Spencer's vision of society's future and concluded that religion was essential for the evolution of society because it acts in the interest of generational group survival rather than individual competition. Social Evolution called for a comprehensive study of society because a new era in Western civilisation was beginning. (shrink)

According to the expressivist objection, laws that only allow assisted dying for those suffering from certain medical conditions express the judgement that their lives are not worth living. I have recently argued that an autonomy-based approach that legally allows assisted suicide for all who make an autonomous request is a way to avoid the expressivist objection. In response to this, Thomas Donaldson has argued that rather than avoiding the expressivist objection, an autonomy-based approach extends this objection. According to Donaldson, this (...) is because helping a person achieve a goal requires endorsement of that goal. In this reply, I show that Donaldson misunderstands the target of the expressivist objection: it is not aimed at an individual’s attitude towards another person’s death but rather at a legal regulation. Moreover, helping someone end their life does not necessarily require endorsing this goal—instead, respect for a person’s autonomous choice can be another reason for providing assisted suicide. Donaldson also assumes that the autonomy-based approach requires doctors to accept autonomous requests for assisted dying. Yet, this approach merely makes it legal for individuals (not necessarily only doctors) to provide assisted suicide to autonomous persons but does not require anyone to do so. (shrink)

This article argues that teachers of environmental ethics must more aggressively entertain questions of private property in their work and in their teaching. To make this case, it first introduces the three primary positions on property: occupation arguments, labor theory of value arguments, and efficiency arguments. It then contextualizes these arguments in light of the contemporary U.S. wise-use movement, in an attempt to make sense of the concerns that motivate wise-use activists, and also to demonstrate how intrinsic value arguments miss (...) the mark. Finally, it offers some suggestions about further directions for environmental ethics, reasoning that there is a good deal of headway to be gained for environmental ethics by accepting that nature can be owned as property, but nevertheless engaging the idea of private property critically. This paper has two aims. The first is to present and defend a new argument for rights contributionism – the view that the notion of a moral claim-right is a contributory (or pro tanto) rather than overall normative notion. The argument is an inference to the best explanation: it is argued that (i) there are contributory moral factors that contrast with standard moral reasons by way of having a number of formal properties that are characteristic of rights, even though they (...) can be overridden, and (ii) that this is best explained by a view that takes these factors to correlate with rights. The second aim is to show that the truth of rights contributionism matters for normative ethics. More specifically, it is argued that rights contributionism clears the way for deontologists to justify the pre-theoretically plausible verdict that we have a duty to save the greater number in so-called Taurek scenarios – scenarios in which we have to choose between saving either a greater or a smaller number of different people. The chapter offers a novel and distinctively deontological explanation of this verdict that is based on the assumption that everyone has a pro tanto right to be saved in a Taurek scenario. (shrink)

In this essay, I argue that contractualism, even when it is actually used to construe our moral duties towards non-human animals, does not do so naturally. We can infer from our experiences with companion animals that we owe moral duties to them because of special relationships we are in with them. We can further abstract that we owe general moral duties to non-human animals because they are the kinds of beings that we can have relationships with, and because of the (...) capacities that make possible this relational capacity. This type of approach better explains our duties to non-human animals and other non-rational beings than does the trustee account that Scanlon leaves room for in his contractualism. (shrink)

Written to be accessible for undergraduates and general readers, but comprehensive enough to (...) be a useful reference work for researchers in a variety of related fields, it promises to be an invaluable resource for better understanding the ethical landscape of our environmental world. Gadamer has written several powerful studies of Platonic dialectic. His emphasis on shared understanding, the fusing of horizons and other hermeneutic notions are partially drawn from a study of Plato’s elenctic dialogues. However, Socrates in Gorgias makes a claim about the imperative of self-refutation that not only complicates our understanding of Socratic method, but Gadamer’s reading of it as well. This article is meant to explore just how the imperative of self-refutation causes difficulty for Gadamer’s understanding of dialectic, especially his (...) distinction between authentic and inauthentic dialectic. After considering the nature of ‘refutation’, this article will examine whether Gadamer’s notions of shared understanding, the ‘facts of the matter’, and self-understanding help us to resolve this problem. It shall be concluded that the teacher must take any refutations of his/her own views seriously, but has no special obligation to refute (introspectively) any of their own views, even those beliefs, theories, principles or criteria that enable him to guide the argument. We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

Evidential Decision Theory is flawed, but its flaws are not fully understood. David Lewis (1981) famously charged that EDT recommends an irrational policy of managing the news and “commends the ostrich as rational”. Lewis was right, but the case he appealed to—Newcomb’s Problem—does not demonstrate his conclusion. Indeed, decision theories other than EDT, such as Committal Decision Theory and Functional Decision Theory, agree with EDT's verdicts in Newcomb’s Problem, but their flaws, whatever they may be, do not stem from any (...) ostrich-like recommendations. We offer a new case which shows that EDT mismanages the news, thus vindicating Lewis’s original charge. We argue that this case reveals a flaw in the “Why ain’cha rich?” defense of EDT. We argue further that this case is an advance on extant putative counterexamples to EDT. (shrink)

Many of the moral and political disputes that loom large today involve claims (1) in the register of respect and offense that are (2) linked to membership in a subordinated social group and (3) occasioned by symbolic or expressive items or acts. This essay seeks to clarify the nature, stakes, and characteristic challenges of these recurring, but often disorienting, conflicts. Drawing on a body of philosophical work elaborating the moral function of etiquette, I first argue that the claims at issue (...) implicate a communicative apparatus of the same basic kind—a system that I term the “etiquette of equality.” That regime, I suggest, can serve a kindred function of facilitating the expression of morally appropriate attitudes. I also argue, however, that the etiquette of equality exhibits three problematic features that counsel ambivalence about its mounting significance: (1) the costly overdetermination of relevant signals; (2) a recursive tendency toward inflation in respect’s demands; and (3) a related set of incentives for testing, and then affirming, a group’s status through the assertion and symbolic remediation of dignitary harm. The upshot is a better understanding of the trade-offs and predicaments we face in a vital area of public life. (shrink)

Die Studie untersucht die Entstehung der modernen Philosophiegeschichte, wie sie sich im Übergang vom Barock zur Aufklärung als philosophische Disziplin innerhalb des gelehrten Diskurses der historia literaria konstituierte. Die Auffassung, daß Philosophie ein Produkt menschlicher Verstandestätigkeit sei und mit dem Denken der Griechen beginne, erweist sich dabei als Resultat eines Traditionsbruchs, mit dem die entstehende Aufklärung sich vom christlichen Aristotelismus der Schulphilosophie sowie von den platonisch-hermetischen Spekulationen der Schwärmer und Pansophen absetzte. In der Umbruchphase zwischen Barock und Aufklärung entsteht so (...) der moderne philosophiegeschichtliche Kanon, der sich fundamental von der zuvor gültigen historischen Logik der Wissenschaftsgeschichte unterscheidet. Die Geschichte der Philosophie wird nun nicht länger als Sammelbecken unterschiedlich perfekter Ausformulierungen einer archetypischen Weisheit verstanden, sondern im Kontext der 'Entdeckung der geschichtlichen Welt' als ein kontingenter temporaler Prozeß menschlicher Wissenschaftsentwicklung begriffen. Wie es zu dieser Entdeckung der Philosophiegeschichte kam und worin ihre wissenschaftsgeschichtlichen Implikationen bestehen, ist Gegenstand der Darstellung, die gegenüber der bisherigen Forschung verstärkt die Interdependenzen zwischen theologischem, philosophischem, rechts- und literärgeschichtlichem Diskurs berücksichtigt. L’interactivité est communément perçue comme la marque caractéristique des technologies digitales et, par extension, de différentes formes de fictions, de médias ou d’œuvres numériques – de la littérature hypertextuelle et des jeux vidéo au net art. On peut toutefois s’interroger sur le sens précis qu’il convient de donner à cette notion, ainsi que sur les promesses auxquelles elle est souvent associée. À défaut de pouvoir cerner un concept unique et maxi-englobant d’interactivité, nous suggérons qu’il est plus profitable de tenter d’identifier (...) des types et des degrés d’interactivité. Nous tentons de montrer pourquoi cette théorie pluraliste et gradualiste est plus attrayante que d’autres approches développées dans la littérature récente. Nous mettons enfin cette conception à l’épreuve du jeu vidéo, en montrant qu’elle permet de réévaluer le rôle que joue l’interactivité dans ce médium, mais qu’elle met aussi au jour les limitations inhérentes des fictions interactives que l’on y trouve. Il n’est pas étonnant que Cora Diamond fasse un cas de toutes ces expériences : ce qu’elle nomme « une difficulté (...) de la réalité », c’est-à-dire un point d’achoppement entre la pensée et ce qu’elle essaye de saisir, le réel, qui est susceptible de nous faire perdre nos concepts. Je me propose dans ce texte d’explorer les voies de cette difficulté, qui sont souvent des voies contournées ou des déviations. Historian Dmitry Peretolchin quotes several of my publications on the creation and application of political technologies in the United States in his program about Saul Alinsky on the House of Cards podcast on the Den TV channel. An advertisement for the conference "Russian World Against the Global Reich" was inserted into this broadcast. This article: analyzes the statements of the podcast about Alinsky and his main ideas; showes that the main source of Alinsky's political technologies is the experience of professional (...) revolutionaries in Russia and that they in no way confirm the idea of a global Reich; describes the political technology that Alexander Prokhanov and his media complex uses to implement the Fifth Empire project, which is currently merged with the ideology of the Russian World; analyzes the ideological orientation of the House of Cards podcast and the Picture of the World club on the Den channel. The articles illustrates how the authors of the podcast are working to substantiate the propaganda direction of the media complex. The article also aims to show that political technologies, in particular, technologies of co-organization continue to develop and be implemented in countries with different political systems and can be applied to various types of social movements. In this thesis, William Alston’s influential defense of divine command theory is critically evaluated. It is argued that Alston, in positing evaluative particularism, undermines his defense because moral particularism, a rival theory of moral obligation, follows from evaluative particularism. Furthermore, the moral particularist need not deny that God has moral obligations. Even if evaluative particularism did not entail moral particularism, it fails to makes God’s commands non-arbitrary, contrary to Alston’s claims. On divine command theory, God does not make commands for (...) moral reasons, which is a fundamental principle of moral agency, necessary for any moral action to be non-arbitrary. Also, the divine nature does not uniquely pick out particular good actions to be obligatory. It is also objected that Alston’s evaluative particularism posits a God which is either conceptually incoherent or non-existent, demonstrated by an evidential argument from evil given in the paper. New data-driven technologies yield benefits and potentials, but also confront different agents and stakeholders with challenges in retaining control over their data. Our goal in this study is to arrive at a clear picture of what is meant by data sovereignty in such problem settings. To this end, we review 341 publications and analyze the frequency of different notions such as data sovereignty, digital sovereignty, and cyber sovereignty. We go on to map agents they concern, in which context they appear, (...) and which values they allude to. While our sample reveals a considerable degree of divergence and an occasional lack of clarity about intended meanings of data sovereignty, we propose a conceptual grid to systematize different dimensions and connotations. Each of them relates in some way to meaningful control, ownership, and other claims to data articulated by a variety of agents ranging from individuals to countries. Data sovereignty alludes to a nuanced mixture of normative concepts such as inclusive deliberation and recognition of the fundamental rights of data subjects. (shrink)

I defend a deontological social contract justification of punishment for philosophers who deny free will and moral responsibility (FW/MR). Environmental ethicists often make claims about the intrinsic value of nature or parts thereof. Advances in intrinsic value theory, most notably Ben Bradley’s ‘Two Concepts of Intrinsic Value,’ successfully cleave the concept of intrinsic value into two: a Moorean and Kantian variety. This paper seeks to classify and organize different environmental theorists within a Bradley-inspired framework, helping to bring clarity and charity to the claims of older and newer environmental ethicists. These two types of intrinsic value help explain why different (...) thinkers have differing intuitions on e.g., culling cases. As well as valuing nature suis generis, the paper considers the value that might accrue from other relational properties in nature, such as beauty, biodiversity, and rarity. (shrink)

In this paper, I present a dilemma for those who believe in the afterlife: either we won’t survive death (or an eternal life) in the sense that most matters to us or we will become bored if we do. First, I argue that even if we – in a strict sense – survive death, there is practical sense in which we don’t survive death. This applies, I contend, to all accounts of the afterlife that: eventually, we lose our practical identity. (...) I show that our practical identity is more important to us than our numerical identity. But, as we’ll see, our practical identity is not just lost in an afterlife, but also with an eternal or immortal life. Theists have a strategy to resist this line of argument: they can argue that God will help us to retain our current practical identities. However, those that pursue this line of argument fall onto the second horn of my proposed dilemma: if we cannot change our practical identities then it seems that eventually we will become bored, and eternally so. La Conscience malheureuse est un ouvrage majeur de la philosophie existentielle des années trente. Jeune poète et critique roumain expatrié en France en 1923, Benjamin Fondane (1898-1944) fait partie de ces auteurs hantés par l'absence de Dieu dans la culture rationaliste moderne marquée par le positivisme. D'abord proche de l'esprit subversif du dadaïsme, il identifie rapidement sa révolte par l'absurde à la démarche ironique et irrationaliste du philosophe russe émigré en France Léon Chestov. C'est l'adhésion sans conditions à sa (...) philosophie existentielle à partir de 1929 qui lui permet de déconstruire la tradition du logos issue d'Athènes. Il ne cessera dès lors de dénoncer un conflit profond entre le " réel " construit par la culture rationaliste et l'existant singulier, entre le savoir et le " non-voir " des poètes et de certains mystiques, entre Athènes et Jérusalem: ce divorce intime, c'est celui de la " conscience malheureuse ".
