This chapter offers a proceduralist argument against capital punishment. More specifically, it contends that the possibility of irrevocable mistakes precludes the just administration of the death penalty. At stake is a principle of political morality: legal institutions must strive to remedy their mistakes and to compensate those who suffer from wrongful sanctions. The incompatibility of remedy and execution is the crux of the irrevocability argument: because the wrongly executed cannot enjoy the morally required compensation, execution is impermissible. Along with defending (...) his key premises, Yost explains the complicated role that sentencing uncertainty plays in the argument. We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

Capital punishment—the legally authorized killing of a criminal offender by an agent of the state for the commission of a crime—stands in special need of moral justification. This is because execution is a particularly severe punishment. Execution is different in kind from monetary and custodial penalties in an obvious way: execution causes the death of an offender. While fines and incarceration set back some of one’s interests, death eliminates the possibility of setting and pursuing ends. While fines and incarceration narrow (...) one’s routes to happiness, death eliminates its possibility. Not surprisingly, there is much debate about the moral permissibility of capital punishment. This entry maps the terrain of this debate. The first section discusses justifications of the death penalty as they appear in major theories of punishment. The second section surveys moral objections to execution that apply to most justifications. The third addresses procedural criticisms, which do not target the morality of execution so much as the justice of its implementation. (shrink)

At least some of your beliefs are commitments. When you believe that P as a commitment, your stance on P is such that you believe it on the basis of your considered judgement. Sometimes, you also believe that you believe P. Such self‐beliefs can also be commissive in a sense, as when they are reflective endorsements of your lower‐order commissive beliefs. In this paper I argue that one's commissive self‐beliefs ontologically constitute one's lower‐order commissive beliefs because one's commissive self‐beliefs instantiate (...) the same inferential dispositions that are constitutive of one's lower‐order commissive beliefs. Constitutive relations between commissive self‐beliefs and first‐order commissive beliefs are maximally epistemically secure because they do not result from any epistemic procedure by which one must try (and possibly fail) to detect one's first‐order commissive beliefs. This maximal epistemic security suffices to warrant one's commissive self‐beliefs, such that one possesses commissive self‐knowledge of an especially privileged sort. (shrink)

Kant famously insists that free will is a condition of morality. The difficulty of providing a demonstration of freedom has left him vulnerable to devastating criticism: critics charge that Kant's post-Groundwork justification of morality amounts to a dogmatic assertion of morality's authority. My paper rebuts this objection, showing that Kant offers a cogent demonstration of freedom. My central claim is that the demonstration must be understood in practical rather than theoretical terms. A practical demonstration of x works by bringing x (...) into existence, and what the demonstration of freedom brings into existence is a moral will, a will regulated by the moral law and capable of acting in accordance with it. Since to act morally is to act freely, bringing a moral will into existence actualizes our capacity for freedom and demonstrates that we possess it. To confirm the viability of such a demonstration, Kant must establish that agents can regulate their wills by practical principles, and that practical judgments are efficacious of themselves (i.e., that non-Humean motivational internalism is true). Kant, I argue, is successful on both counts. (shrink)

Nietzsche distinguished between two forces in art: Apollonian, which represents order and reason, and Dionysian, which represents chaos and energy. Economists, Ward argues, have operated for too long under the assumption that their work reflects the scientific, Apollonian principals that inform physics when they simply do not apply to economics: 'constants' in economics stand in for variables, and the core scientific principles of prediction and replication are all but ignored by economists. Ward encourages economists to reintegrate the standard rigor of (...) the scientific method into their work while embracing the fact of the shape-shifting changeability of human beings. Economists can still aspire to scientific standards, as is demonstrated by the success of biology, in which there is considerable Dionysian variability. Economists must avoid the temptation to wish away dynamic complexity and diversity and must recognize, among other things, that the desire to take risks is fundamentally human. The second half of the book takes some first steps toward creating this new Dionysian Economics. (shrink)

Spatestens seit dem emotional turn in den Kulturwissenschaften zu Anfang dieses Jahrhunderts ist die Leibphanomenologie von Hermann Schmitz kein Geheimtipp mehr. Die Zahl der Studien, die sich mit ihr auseinandersetzen, ist heute kaum uberschaubar. Der Band versucht nach knapp einem halben Jahrhundert Wirkungsgeschichte eine Art Zwischenbilanz zu ziehen. Er fragt, inwiefern und in welchen Kontexten sich die von Schmitz erarbeiteten Kategorien des eigenleiblichen Spurens bewahrt haben. Die Beitrage erortern die gespurte Leiblichkeit in ihrer Verflechtung mit Sachverhalten wie Geschichte, Kultur, Person, (...) Geschlecht sowie als Aktionsfeld leiblicher Kommunikation und zeugen davon, dass das von Schmitz begonnene Projekt uber die Philosophie hinaus auch von anderen Wissenschaften stetig erganzt und weiterentwickelt wird. Vor dem Hintergrund eines sich am Leitmodell des sicht- und tastbaren Korpers orientierenden Denkens konnten sprachliche Ausdrucke fur leibliches Erleben nur als Skandal der Metapher (Strub) begriffen werden. Die Leibphanomenologie bietet dagegen einen alternativen Zugang, dem aber der Korper, wie Schmitz sagt, zum Skandal wird. Diesem schwierigen Verhaltnis von Leib und Korper geht der Band nach, um das Skandalose theoretisch einzuholen. This book presents a contextual study of the life and work of the Cambridge Platonist Ralph Cudworth (1617-1688). Focusing on the theological basis of Cudworth's ethical philosophy, this book unlocks the hitherto ignored political aspect to Cudworth's ethical philosophy. Through a detailed examination of Cudworth's published works - particularly his voluminous "True intellectual system of the Universe" -, his posthumously published writings, and his 'freewill' manuscripts Benjamin Carter argues that the ethical and political arguments in Cudworth's philosophy develop out (...) of Cudworth's Trinitarian theology. Carter traces the link between Cudworth's trinitarianism and his ethical and political ideas by placing Cudworth's work in the turbulent religious and intellectual context of seventeenth-century England, and the University of Cambridge in particular. Hardly anyone disputes that discrimination can be a grave moral wrong. Yet this consensus masks fundamental disagreements about what makes something discrimination, as well as precisely why acts of discrimination are wrong. Benjamin Eidelson develops systematic answers to those two questions. He claims that discrimination is a form of differential treatment distinguished by its special connection to the differential ascription of some property to different people, and goes on to argue that what makes some cases of discrimination intrinsically wrongful (...) is that they manifest an attitude of disrespect for the personhood of those who are disfavored. He endeavors to specify what this attitude consists in, and to demonstrate how attending to its character can help us to better understand the moral dimensions of different forms of wrongful discrimination. While psychopathy research has been growing for decades, a relatively new area of research is corporate psychopathy. Corporate psychopaths are simply psychopaths working in organizational settings. They may be attracted to the financial, power, and status gains available in senior positions and can cause considerable damage within these roles from a manipulative interpersonal style to large-scale fraud. Based upon prior studies, we analyze psychopathy research pertaining to 23 moral emotions classified according to functional quality and target. Based upon our review, (...) we suggest that psychopaths are high in moral emotions associated with other-directed negative signals, low in self-directed negative signals, and low in other-directed positive signals. We found no empirical articles related to self-directed positive signals. This understanding of the specific moral emotion deficits of corporate psychopaths provides greater theoretical understanding and practical implications of knowing which individuals not to promote, though more research is needed on moral emotions that are faked for manipulative reasons. The problem of deviant causation has been a serious obstacle for causal theories of action. We suggest that attending to the problem of deviant causation reveals two related problems for causal theories. First, it threatens the reductive ambitions of causal theories of intentional action. Second, it suggests that such a theory fails to account for how the agent herself is guided by her reasons. Focusing on the second of these, we argue that the problem of guidance turns out to be (...) related to a number of other issues in the literature on action explanation, and that it is much more general: it threatens not only causal theories but any theory of action. Finally, we suggest that a certain version of the view that acting has a constitutive or formal aim can overcome this problem. (shrink)

In spite of its significance for everyday and philosophical discourse, the explanatory connective has not received much treatment in the philosophy of logic. The present paper develops a logic for based on systematic connections between and the truth-functional connectives.

Following Gilbert Ryle’s arguments, many philosophers took it for granted that someone knows how to do something just in case they have the ability to do it. Within the last couple decades, new intellectualists have challenged this longstanding anti-intellectualist assumption. Their central contention is that mere abilities aren’t on the same rational, epistemic level as know how. My goal is to intellectualize know how without over-intellectualizing it. Intelligent behavior is characteristically flexible or responsive to novelty, and the distinctive feature of (...) creatures who exhibit flexible behavior is their capacity to learn. As it turns out, Ryle already identified a core characteristic of learning shared widely across the animal kingdom from the lowly rat to the top athlete. Taking my cues from Ryle, I argue that know how is successful performance resulting from self-regulated abilities. To regulate an ability is to be disposed to adjust to error and respond to feedback. While regulating sophisticated human abilities often requires propositional knowledge, in many simpler cases it does not. I focus on the navigational know how of rats and honeybees. Although they possess know how, whether they possess propositional knowledge is at best an open question. (shrink)

Following Cass Sunstein's popular treatment of the concept, echo chambers are often defined as environments which exclude contrary opinions through omission. C. Thi Nguyen contests the popular usage and defines echo chambers in terms of in-group trust and out-group distrust. In this paper, I argue for a more comprehensive treatment. While both exclusion by omission and out-group distrust help sustain echo chambers, neither defines the phenomenon. I develop a social network model of echo chambers which focuses on the role of (...) belief-reinforcing echoes. First, I argue that the model allows us to incorporate Nguyen's main point about distrust without construing other commentators as deeply mistaken about the nature of echo chambers. Second, I use the model to develop an account of collaborative resistance and use it to clarify the role echo chambers play in spreading misinformation. (shrink)

Many theorists who argue that individuals have a personal responsibility to reduce greenhouse gases (GHGs) tie the amount of GHGs that an individual is obligated to reduce to the amount that an individual releases, or what is often called a carbon footprint. The first section of this article argues that this approach produces standards that are too burdensome in some contexts. Section two argues that this approach produces standards of responsibility that are too lenient in other contexts and sketches an (...) alternative account of personal responsibility that treats it as an obligation to take certain kinds of opportunities to reduce GHGs, regardless of how little or much gas an individual releases through her own actions. Section three argues that this alternative conception of personal responsibility is well positioned to rebut the Argument from Inconsequentialism, widely considered the most significant challenge to the assumption that individuals are capable of bearing a responsibility to reduce GHGs. According to the Motive of Duty Thesis, a necessary condition for an action to have moral worth is that it be motivated at least in part by a normative assessment of the action. However, this thesis has been subject to two powerful objections. It has been accused of over-intellectualizing moral agency, and of giving the wrong verdict when it comes to people who hold false moral theories that convince them that their actions are in fact morally wrong. I argue that (...) both of these objections can be convincingly answered using resources from the Guise of the Good view, which holds that for an agent to intend to requires that they take Φing to be good. Furthermore, I argue that combining the motive of duty thesis with the Guise of the Good view allows us to recognize an important further condition on moral worth—namely, that the agent recognize that their reason for action requires, rather than merely permits, their action. Thus, while no action lacks moral worth in virtue of being motivated by no normative evaluation at all, an action can still lack moral worth in virtue of failing to be motived by the correct normative evaluation, namely that the action is required. The paper deals with the notions of grounding and of existential dependence. It is shown that cases of existential dependence seem to be systematically correlated to cases of grounding and hence the question is raised what sort of tie might hold the two notions together so as to account for the observed correlation. The paper focusses on three possible ties between grounding and existential dependence: identity, definition, and grounding. A case for the definitional tie is made.

Many of the moral and political disputes that loom large today involve claims (1) in the register of respect and offense that are (2) linked to membership in a subordinated social group and (3) occasioned by symbolic or expressive items or acts. This essay seeks to clarify the nature, stakes, and characteristic challenges of these recurring, but often disorienting, conflicts. Drawing on a body of philosophical work elaborating the moral function of etiquette, I first argue that the claims at issue (...) implicate a communicative apparatus of the same basic kind—a system that I term the “etiquette of equality.” That regime, I suggest, can serve a kindred function of facilitating the expression of morally appropriate attitudes. I also argue, however, that the etiquette of equality exhibits three problematic features that counsel ambivalence about its mounting significance: (1) the costly overdetermination of relevant signals; (2) a recursive tendency toward inflation in respect’s demands; and (3) a related set of incentives for testing, and then affirming, a group’s status through the assertion and symbolic remediation of dignitary harm. The upshot is a better understanding of the trade-offs and predicaments we face in a vital area of public life. (shrink)

The article is primarily concerned with the notion of a truth-maker. An explication for this notion is offered, which relates it to other notions of making something such-and-such. In particular, it is shown that the notion of a truth-maker is a close relative of a concept employed by van Inwagen in the formulation of his Consequence Argument. This circumstance helps understanding the general mechanisms of the concepts involved. Thus, a schematic explication of a whole battery of related notions is offered. (...) It is based on an explanatory notion, introduced by the sentential connector “because”, whose function is examined in some detail. Finally, on the basis of the explication proposed, an argument is developed to the effect that the objects usually regarded as truth-makers are not apt to play this role. (shrink)

While the objects of olfaction are intuitively individuated by reference to the ordinary objects from which they arise, this intuition does not accurately capture the complex nature of smells. Smells are neither ordinary three-dimensional objects, nor Platonic vapors, nor odors. Rather, smells are the molecular structures of chemical compounds within odor plumes. Molecular Structure Theory is offered as an account of smells, which can explain the nature of the external object of olfactory perception, what we experience as olfactory objects, and (...) what determines the olfactory quality of smells by which we can demarcate the spatiotemporal boundaries of smells. Quality-space theory (QST) explains the nature of the mental qualities distinctive of perceptual states by appeal to their role in perceiving. QST is typically described in terms of the mental qualities that pertain to color. Here we apply QST to the olfactory modalities. Olfaction is in various respects more complex than vision, and so provides a useful test case for QST. To determine whether QST can deal with the challenges olfaction presents, we show how a quality space (QS) could be (...) constructed relying on olfactory perceptible properties and the olfactory mental qualities then defined by appeal to that QS of olfactory perceptible properties. We also consider how to delimit the olfactory QS from other modalities. We further apply QST to the role that experience plays in refining our olfactory discriminative abilities and the occurrence of olfactory mental qualities in non-conscious olfactory states. QST is shown to be fully applicable to and useful for understanding the complex domain of olfaction. (shrink)

There is consensus within the chemosciences that olfactory perception is of the molecular structure of chemical compounds, yet within philosophical theories of smell there is little agreement about the nature of smell. The paper critically assesses the current state of debate regarding smells within philosophy in the hopes of setting it upon firm scientific footing. The theories to be covered are: Naïve Realism, Hedonic Theories, Process Theory, Odor Theories, and non-Objectivist Theories. The aforementioned theories will be evaluated based on their (...) explanations of the (a) the olfactory quality of a smell, (b) smells as distal entities, and (c) our experience of smells as intentional objects.
