Legal theorists have characterized physical evidence of brain dysfunction as a double-edged sword, wherein the very quality that reduces the defendant’s responsibility for his transgression could simultaneously increase motivations to punish him by virtue of his apparently increased dangerousness. However, empirical evidence of this pattern has been elusive, perhaps owing to a heavy reliance on singular measures that fail to distinguish between plural, often competing internal motivations for punishment. The present study employed a test of the theorized double-edge pattern using (...) a novel approach designed to separate such motivations. We asked a large sample of participants (N = 330) to render criminal sentencing judgments under varying conditions of the defendant’s mental health status (Healthy, Neurobiological Disorder, Psychological Disorder) and the disorder’s treatability (Treatable, Untreatable). As predicted, neurobiological evidence simultaneously elicited shorter prison sentences (i.e., mitigating) and longer terms of involuntary hospitalization (i.e., aggravating) than equivalent psychological evidence. However, these effects were not well explained by motivations to restore treatable defendants to health or to protect society from dangerous persons but instead by deontological motivations pertaining to the defendant’s level of deservingness and possible obligation to provide medical care. This is the first study of its kind to quantitatively demonstrate the paradoxical effect of neuroscientific trial evidence and raises implications for how such evidence is presented and evaluated. While philosophers and scientists sometimes suggest (or take for granted) that consciousness is an essential condition for free will and moral responsibility, there is surprisingly little discussion of why consciousness (and what sorts of conscious experience) is important. We discuss some of the proposals that have been offered. We then discuss our studies using descriptions of humanoid robots to explore people’s attributions of free will and responsibility, of various kinds of conscious sensations and emotions, and of reasoning capacities, and examine (...) the relationships between these attributions. Our initial results suggest that people’s attributions of free will are strongly influenced by their attributions of conscious emotions, such as happiness and disappointment, including Strawsonian emotions, such as pride and regret. These results provide some support for an intriguing proposal: Free will requires the capacity to make decisions that really matter to the agent, and for anything to really matter to the agent, she must be able to consciously experience the good and bad effects of the decisions she makes—to suffer and regret, or to enjoy and feel proud of, their outcomes. Citizens United v. Federal Election Commission is a 2010 US Supreme Court decision that fundamentally transformed federal election financing. As a result, we have seen a drastic increase in the amount of so-called soft money that wealthy individuals and corporations contribute to political campaigns. Following a brief overview of the case and the precedent that formed the basis for the ruling, this chapter concerns philosophical stakes of the decision and what precisely it says about the public today and the role (...) of philosophy within it. When faced with a dilemma between believing what is supported by an impartial assessment of the evidence (e.g., that one's friend is guilty of a crime) and believing what would better fulfill a moral obligation (e.g., that the friend is innocent), people often believe in line with the latter. But is this how people think beliefs ought to be formed? We addressed this question across three studies and found that, across a diverse set of everyday situations, people treat moral considerations (...) as legitimate grounds for believing propositions that are unsupported by objective, evidence-based reasoning. We further document two ways in which moral considerations affect how people evaluate others' beliefs. First, the moral value of a belief affects the evidential threshold required to believe, such that morally beneficial beliefs demand less evidence than morally risky beliefs. Second, people sometimes treat the moral value of a belief as an independent justification for belief, and on that basis, sometimes prescribe evidentially poor beliefs to others. Together these results show that, in the folk ethics of belief, morality can justify and demand motivated reasoning. (shrink)

We presented evidence supportive of our hypothesis in the form of analyses that controlled for variation in freedom, wealth resources, and wealth inequality across nations and the states of the USA. Obtaining informed consent from patients prior to a medical or surgical procedure is a fundamental part of safe and ethical clinical practice. Currently, it is routine for a significant part of the consent process to be delegated to members of the clinical team not performing the procedure (eg, junior doctors). However, it is common for consent-taking delegates to lack sufficient time and clinical knowledge to adequately promote patient autonomy and informed decision-making. Such problems might be addressed in a number of (...) ways. One possible solution to this clinical dilemma is through the use of conversational artificial intelligence using large language models (LLMs). There is considerable interest in the potential benefits of such models in medicine. For delegated procedural consent, LLM could improve patients’ access to the relevant procedural information and therefore enhance informed decision-making.In this paper, we first outline a hypothetical example of delegation of consent to LLMs prior to surgery. We then discuss existing clinical guidelines for consent delegation and some of the ways in which current practice may fail to meet the ethical purposes of informed consent. We outline and discuss the ethical implications of delegating consent to LLMs in medicine concluding that at least in certain clinical situations, the benefits of LLMs potentially far outweigh those of current practices. Evidence-based practice (EBP) is a relatively recent incarnation in social work's long history of valuing evidence as a basis for practice. Few argue with the ethics and usefulness of grounding practice in empirically tested interventions. Critics of EBP instead focus on how it is defined and implemented. Critiques include what counts as evidence, who makes decisions regarding research agendas and processes, and the lack of attention to context. This essay reflects on such critiques and suggests that social work, as a (...) profession that values human diversity, equality, and self-determination, is well situated to shed light on such debates about EBP. As a profession that supports a person-in-environment perspective, we must examine not only the theory but the practice of EPB in academic, institutional, and societal settings. It is also argued that, owing to our professional mission, it is not enough to acknowledge the risk of oppression and harm; we are obligated to take them seriously and include such potential for harm in our assessment of so-called best practices. Alain Locke is most known for his involvement in the Harlem Renaissance. However, he received his PhD in philosophy from Harvard University in 1918, and produced a very large corpus of philosophical work. His work shows him to have been a sophisticated philosopher who thought through practical and theoretical problems regarding the nature of cosmopolitanism, democracy, race, value, religion, art, and education. Although Locke’s philosophical work has been discussed in parts, there has been no theorizing about how his different philosophical (...) commitments fit together. In this book Corey L. Representation is central to contemporary theorizing about the mind/brain. But the nature of representation--both in the mind/brain and more generally--is a source of ongoing controversy. One way of categorizing representational types is to distinguish between the analog and the digital: the received view is that analog representations vary smoothly, while digital representations vary in a step-wise manner. I argue that this characterization is inadequate to account for the ways in which representation is used in cognitive science; in its place, I (...) suggest an alternative taxonomy. I will defend and extend David Lewis's account of analog and digital representation, distinguishing analog from continuous representation, as well as digital from discrete representation. I will argue that the distinctions available in this four-fold account accord with representational features of theoretical interest in cognitive science more usefully than the received analog/digital dichotomy. Relative to digital computation, analogue computation has been neglected in the philosophical literature. To the extent that attention has been paid to analogue computation, it has been misunderstood. The received view—that analogue computation has to do essentially with continuity—is simply wrong, as shown by careful attention to historical examples of discontinuous, discrete analogue computers. Instead of the received view, I develop an account of analogue computation in terms of a particular type of analogue representation that allows for discontinuity. This account (...) thus characterizes all types of analogue computation, whether continuous or discrete. Furthermore, the structure of this account can be generalized to other types of computation: analogue computation essentially involves analogue representation, whereas digital computation essentially involves digital representation. Besides being a necessary component of a complete philosophical understanding of computation in general, understanding analogue computation is important for computational explanation in contemporary neuroscience and cognitive science. Corey W. Dyck presents a new account of Kant's criticism of the rational investigation of the soul in his monumental Critique of Pure Reason, in light of its eighteenth-century German context. When characterizing the rational psychology that is Kant's target in the Paralogisms of Pure Reason chapter of the Critique commentators typically only refer to an approach to, and an account of, the soul found principally in the thought of Descartes and Leibniz. But Dyck argues that to do so (...) is to overlook the distinctive rational psychology developed by Christian Wolff, which emphasized the empirical foundation of any rational cognition of the soul, and which was widely influential among eighteenth-century German philosophers, including Kant. In this book, Dyck reveals how the received conception of the aim and results of Kant's Paralogisms must be revised in light of a proper understanding of the rational psychology that is the most proximate target of Kant's attack. In particular, he contends that Kant's criticism hinges upon exposing the illusory basis of the rational psychologist's claims inasmuch as he falls prey to the appearance of the soul as being given in inner experience. This paper brings empirical and theoretical studies of ethical leadership into conversation with one another in an effort to determine the antecedent to perceived ethical leadership. Employing a Levinasian perspective, I argue that ethical leadership entails being faced with the impossible task of realizing the needs of many individual others. For this reason, I argue, perceived ethical leadership is grounded in an employee’s perception that a leader struggles to make decisions based on the conflicting demands placed upon her. More important (...) than the result of a leader’s decision is the degree to which the leader demonstrates concern for the well-being of others in her decision-making process. I ground my discussion through reference to results of empirical studies on behaviors associated with ethical leadership, including Brown, Treviño, and Harrison, Kalshoven, Den Hartog, and De Hoogh, and Treviño, Hartman, and Brown. I identify several mediating factors which may influence employee perception of ethical leadership, proposing avenues for further research which can help to clarify the relationship between concrete leadership behaviors and perceived ethical leadership. I argue that the appropriateness of an assertion is sensitive to context—or, really, the “common ground”—in a way that hasn’t previously been emphasized by philosophers. This kind of context-sensitivity explains why some scientific conclusions seem to be appropriately asserted even though they are not known, believed, or justified on the available evidence. Background: Transgender health care is a subject of much debate among clinicians, political commentators, and policy-makers. While the World Professional Association of Transgender Health (WPATH) Standards of Care (SOC) establish clinical standards, these standards contain implied ethics but lack explicit focused discussion of ethical considerations in providing care. An ethics chapter in the SOC would enhance clinical guidelines. Aims: We aim to provide a valuable guide for healthcare professionals, and anyone interested in the ethical aspects of clinical support for gender (...) diverse and transgender people of all ages. Recognizing that the WPATH is a global association, we address broad challenges. We offer a reflection on general ethical principles, providing conceptual tools for healthcare providers, patients, and families to navigate the specific challenges they might encounter in transgender health care, in line with WPATH’s worldwide mission and scope. Method: This article employs a descriptive analysis, and our framework of reference is the four principles of biomedical ethics: respect for autonomy, beneficence, nonmaleficence, and justice. Results: The article presents a discussion on the four ethical principles as applied to transgender health care. We address issues such as respect for patient autonomy in decision-making, the role of beneficence and nonmaleficence in clinical interventions, and the importance of justice in equitable treatment and access to care. Some of the ethical concerns we address in this article pertain to the current sociopolitical climate, where there has been increasing legal interference, internationally, for transgender and nonbinary people, particularly youth, seeking medical care. Discussion: We highlight the interplay between ethical principles and clinical practice, underscoring the need for ethical guidance in addressing the diverse challenges faced by healthcare providers and patients in transgender health care. In this essay I develop and defend a theory of state punishment within a wider conception of political legitimacy. While many moral theories of punishment focus on what is deserved by criminals, I theorize punishment within the specific context of the state's relationship to its citizens. Central to my account is Rawls's “liberal principle of legitimacy,” which requires that all state coercion be justifiable to all citizens. I extend this idea to the justification of political coercion to criminals qua citizens. (...) I argue that the liberal principle of legitimacy implicitly requires states to respect the basic political rights of those who are guilty of committing crimes, thus prohibiting capital punishment. Abstract:“Black art” is often understood as being inherently political. In examining two major Black arts movements, the Harlem Renaissance and the Black Arts movement, many of the works attributed to those periods fit the description of “political art” but not all of them. Black art movements are not defined exclusively by similar styles or methodologies, like Expressionism or Surrealism, either. Instead, Black art movements are complex movements that blend social, political, and aesthetic criteria. In this article, I list seven conditions (...) that I take to be jointly sufficient for a Black art movement to be signified as such. In this assertion, I also argue that this current era, paralleling the Black Lives Matter movement, is worthy of Black art movement signification, if we update the mediums by which the conditions are met in the Harlem Renaissance and the Black Arts movement. For those who subscribe to a pro-Black political ideology, like that of Pan-Africanism or Black Nationalism, is there a specific moral obligation between Black agents to protect one another against intersectional/multidimensional oppressions? Africana people are often subjugated to other forms of domination outside of anti-Black racism exclusively. When examining offenses against Black women, queer Black people, poor Black people, etc., both Black Nationalist and Pan-Africanist ethics suggest a moral obligation of protection to all Africana people, but there are varying ways (...) that obligation is explicated. In this argument, I assert that Amílcar Cabral’s text Resistance and Decolonization provides a critical framework for the ways in which disenfranchised, Africana people should be advocated for by their Africana counterparts that take Black collectivity seriously. This argument, as a starting point, conceptualizes Africana people defending one another as a form of decolonization, and it describes four dimensions of moral obligation for defense both within and outside of Black communities: political, economic, cultural, and armed defense. Current orthodoxy takes representation to be essential to computation. However, a philosophical account of computation that does not appeal to representation would be useful, given the difficulties involved in successfully theorizing representation. Piccinini's recent mechanistic account of computation proposes to do just that: it couches computation in terms of what certain mechanisms do without requiring the manipulation or processing of representations whatsoever (Piccinini 2015). Most crucially, mechanisms must process medium-independent vehicles. There are two ways to understand what "medium-independence" means on (...) this account; however, on either understanding, the account fails. Either too many things end up being counted as computational, or purportedly natural computations (e.g., neural computations) cannot be counted at all. Favoring individual entrepreneurial freedom and free-market competition, neoliberalism has reshaped the social and discursive practices of higher education institutions (HEIs) around the world. In this paper, I draw on methods from critical multimodal discourse studies and an analytic concept from linguistic anthropology to examine several sets of student service materials circulating on the campus of a Hong Kong university between 2016 and 2017. While these materials are purportedly designed with student welfare in mind, I demonstrate how they effectively position students (...) as (1) consumers of tailored services or experiences provided by the university; and (2) entrepreneurial selves, that is, socio-economically competitive and self-managed young individuals. I conclude by arguing that these service materials are shaped by and espouse a neoliberal governmentality that (re)orients HEIs and their students towards an all-pervasive marketization, competitiveness, and assertion of class privilege in a globalizing, particularly Westernized late capitalist society in Asia. Computationalism about the brain is the view that the brain literally performs computations. For the view to be interesting, we need an account of computation. The most well-developed account of computation is Turing Machine computation, the account provided by theoretical computer science which provides the basis for contemporary digital computers. Some have thought that, given the seemingly-close analogy between the all-or-nothing nature of neural spikes in brains and the binary nature of digital logic, neural computation could be a species of (...) digital computation. A few recent authors have offered arguments against this idea; here, I review recent findings in neuroscience that further cement the implausibility of this view. However, I argue that we can retain the view that the brain is a computer if we expand what we mean by “computation” to include analog computation. I articulate an account of analog computation as the manipulation of analog representations based on previous work on the difference between analog and non-analog representations, extending a view originally articulated in Shagrir :271–279, 2010). Given that analog computation constitutes a significant chapter in the history of computation, this revision of computationalism to include analog computation is not an ad hoc addition. Brains may well be computers, but of the analog kind, rather than the digital kind. (shrink)

Representation is typically taken to be importantly separate from its physical implementation. This is exemplified in Marr’s three-level framework, widely cited and often adopted in neuroscience. However, the separation between representation and physical implementation is not a necessary feature of information-processing systems. In particular, when it comes to analog computational systems, Marr’s representational/algorithmic level and implementational level collapse into a single level. Insofar as analog computation is a better way of understanding neural computation than other notions, Marr’s three-level framework must (...) then be amended into a two-level framework. However, far from being a problem or limitation, this sheds lights on how to understand physical media as being representational, but without a separate, medium-independent representational level. When the Supreme Court in 2003 struck down a Texas law prohibiting homosexual sodomy, it cited the right to privacy based on the guarantee of "substantive due process" embodied by the Constitution. But did the court act undemocratically by overriding the rights of the majority of voters in Texas? Scholars often point to such cases as exposing a fundamental tension between the democratic principle of majority rule and the liberal concern to protect individual rights. Democratic Rights challenges this view by (...) showing that, in fact, democracy demands many of these rights. Corey Brettschneider argues that ideal democracy is comprised of three core values--political autonomy, equality of interests, and reciprocity--with both procedural and substantive implications. These values entitle citizens not only to procedural rights of participation but also to substantive rights that a "pure procedural" democracy might not protect. What are often seen as distinctly liberal substantive rights to privacy, property, and welfare can, then, be understood within what Brettschneider terms a "value theory of democracy." Drawing on the work of John Rawls and deliberative democrats such as Jürgen Habermas, he demonstrates that such rights are essential components of--rather than constraints on--an ideal democracy. Thus, while defenders of the democratic ideal rightly seek the power of all to participate, they should also demand the rights that are the substance of self-government. (shrink)

One distinction is between those representations that have parts that are themselves representations and those that do not (i.e., those for which the Parts Principle is true and those for which it is not). I offer a unified account of analog representation, showing what all types have in common. This account clarifies when the Parts Principle applies and when it does not, thereby illuminating why the Parts Principle is less interesting than one might have (...) thought. Understanding analog representation instead requires understanding the kinds of magnitudes used in a particular representation, and the kinds of variation possible within a representational scheme. This paper explores the idea that many “simple minded” invertebrates are “natural zombies” in that they utilize their senses in intelligent ways, but without phenomenal awareness. The discussion considers how “first-order” representationalist theories of consciousness meet the explanatory challenge posed by blindsight. It would be an advantage of first-order representationalism, over higher-order versions, if it does not rule out consciousness in most non-human animals. However, it is argued that a first-order representationalism which adequately accounts for blindsight also implies that most (...) non-mammals are not conscious. The example of the honey bee is used to illuminate these claims. Although there is some reason to think that bees have simple beliefs and desires, nevertheless, their visually-mediated cognizing is comparable to that of an animal with blindsight. There is also reason to think that the study of blindsight can also help determine how consciousness is distributed in the animal world. (shrink)

Democratic theorists often distinguish between two views of democratic procedures. ‘Outcomes theorists’ emphasize the instrumental nature of these procedures and argue that they are only valuable because they tend to produce good outcomes. In contrast, ‘proceduralists’ emphasize the intrinsic value of democratic procedures, for instance, on the grounds that they are fair. In this paper. I argue that we should reject pure versions of these two theories in favor of an understanding of the democratic ideal that recognizes a commitment to (...) both intrinsically valuable democratic procedures and democratic outcomes. In instances in which there is a conflict between these two commitments, I suggest they must be balanced. This balancing approach offers a justification of judicial review on the grounds that it potentially limits outcomes that undermine democracy. But judicial review is not justifiable in any instance in which a bad democratic outcome results from democratic procedures. When the loss that would result from overturning a democratic procedure is greater than the gain to democracy that would result from ensuring against an undemocratic outcome; judicial review is not justifiable. Loss or gain to democracy is defined by the negative or positive impact of each action on the core democratic values of equality and autonomy, aspects of the democratic ideal. Even when judicial review is justified, the fact that it overturns intrinsically valuable procedures suggests that such review is never ideal from the standpoint of democracy. (shrink)

Climate scientists often apply statistical tools to a set of different estimates generated by an “ensemble” of models. In this paper, I argue that the resulting inferences are justified in the same way as any other statistical inference: what must be demonstrated is that the statistical model that licenses the inferences accurately represents the probabilistic relationship between data and target. This view of statistical practice is appropriately termed “model-based,” and I examine the use of statistics in climate fingerprinting to show (...) how the difficulties that climate scientists encounter in applying statistics to ensemble-generated data are the practical difficulties of normal statistical practice. The upshot is that whether the application of statistics to ensemble-generated data yields trustworthy results should be expected to vary from case to case. (shrink)

Contrary to the narrative of collapse that attends much of the discussion of the humanities today, recent data suggest that for many programs in the United States, at least, stagnation is the real challenge. Committed to teaching models that support faculty rather than student needs, graduate programs, in particular, are struggling to extend their reach beyond an established constituency of students interested in traditional disciplinary specialization and academic research. By emphasizing the teaching of empathy and communication, which underlie the various (...) humanities disciplines, pursuing inter- and transdisciplinary teaching within and beyond the humanities, and securing administrative support for academic innovation, programs can find and serve a larger graduate student audience. Facing unique financial pressures, smaller colleges may prove more open to such innovation and merit greater attention in the discussion of the future of humanities graduate education. (shrink)

Religious freedom is often thought to protect, not only religious practices, but also the underlying religious beliefs of citizens. But what should be said about religious beliefs that oppose religious freedom itself or that deny the concept of equal citizenship? The author argues here that such beliefs, while protected against coercive sanction, are rightly subject to attempts at transformation by the state in its expressive capacities. This volume provides a guide to the discussion among biologists and philosophersabout the role of concepts such as function and design in an evolutionary understanding oflife.

According to the widely accepted principles of beneficence and distributive justice, I argue that healthcare providers and facilities have an ethical duty to reduce the ecological footprint of the services they provide. I also address the question of whether the reductions in footprint need or should be patient-facing. I review Andrew Jameton and Jessica Pierce’s claim that achieving ecological sustainability in the healthcare sector requires rationing the treatment options offered to patients. I present a number of reasons to think that (...) we should not ration health care to achieve sufficient reductions in a society’s overall consumption of ecological goods. Moreover, given the complexities of ecological rationing, I argue that there are good reasons to think that the ethical duty to reduce the ecological footprint of health care should focus on only nonpatient-facing changes. I review a number of case studies of hospitals who have successfully retrofitted facilities to make them more efficient and reduced their resource and waste streams. (shrink)
