According to the epistemic account of request normativity, a request gives us reasons by revealing normatively relevant information. The information is normative, not the request itself. I raise a new objection to the epistemic account based on situations where we might try to avoid someone requesting something of us. The best explanation of these situations seems to be that we do not want to acquire a new reason to do something. For example, if you know I am going to ask (...) you to read a draft of my paper, you might avoid running into me so as to avoid acquiring a reason to read a draft of my paper. I then argue that the epistemic account can successfully reply to this objection and that in fact the epistemic account does a better job of accounting for cases like this than competing views of the normativity of requests. Scanlon (2008) has argued that his theory of permissibility (STP) has more explanatory power than the Doctrine of Double Effect (DDE). I believe this claim is wrong. Borrowing Michael Walzer’s method of inquiry, I will evaluate the explanatory virtue of these accounts by their understanding of actual moral intuitions originated in historical cases. Practically, I will evaluate these accounts as they explain cases of hostage crises. The main question in this context is: is it permissible that nation-states act with military (...) force in order to liberate hostages, even if those actions put the lives of the hostages at risk? The first part of this paper has an operative reconstruction of the relevant theories. In the second section, two cases of hostage crises will be considered: the Moscow theater hostage crisis of 2002, and the Jaque Operation, which occurred in Colombia in 2008. Additionally, it will be shown that DDE explains these cases better than STP. Finally, this paper offers a critical analysis of Scanlon’s account of the explanatory power of both STP and DDE. The article examines the compatibility of agonistic democracy and populism as well as their relationship to the idea of constitutionalism. The first part shows that Chantal Mouffe’s recent attempts to reconcile her normative approach of an agonistic pluralism with a populist style of politics are not fully convincing. Although there are undeniable commonalities between an agonistic and a populist understanding of politics – the appreciation of conflict, the rejection of moralistic and juridical modes of conflict resolution etc. – the populist (...) mode of the construction of the people (and the denunciation of political opponents as enemies of the people) risks impeding the transformation of antagonistic into agonistic modes of political contest. The tensions between agonism and populism are especially evident in matters of constitutionalism. This topic is examined in the second part of the article, which provides some ideas for reducing the normative and institutional blind spots of contemporary theories of agonistic democracy. It focuses on elementary principles for an agonistic concept of democratic constitutionalism that differs from the populist view of the relationship between politics and law, especially in respect of its interpretation of the concept of ‘resistibility’ of legal norms. The computation of both Scalar Implicatures (SI) and Association with Focus (AF) is characterized with reference to sets of alternatives. However, it has generally been assumed that the relevant alternatives are determined in different ways for the two processes. Specifically, it has been assumed that the alternatives for SI – scalar alternatives – are computed by a special procedure specifically designed for implicatures, whereas the alternatives for AF – focus alternatives – are determined by the general theory of association with (...) focus – focus semantics. As far as we know, the only attempt to connect the two is Krifka (1995), under which scalar alternatives and focus alternatives are identical and determined by focus semantics. However, Krifka’s result is based on a specific stipulation about scalar items, which he borrows from Horn and incorporates into focus semantics, namely that scalar items are inherently focused and have their Horn Scale as their lexically specified focus values. In recent years, artificial intelligence has been deployed by online platforms to prevent the upload of allegedly illegal content or to remove unwarranted expressions. These systems are trained to spot objectionable content and to remove it, block it, or filter it out before it is even uploaded. Artificial intelligence filters offer a robust approach to content moderation which is shaping the public sphere. This dramatic shift in norm setting and law enforcement is potentially game-changing for democracy. Artificial intelligence filters carry (...) censorial power, which could bypass traditional checks and balances secured by law. Their opaque and dynamic nature creates barriers to oversight, and conceals critical value choices and tradeoffs. Currently, we lack adequate tools to hold them accountable. This paper seeks to address this gap by introducing an adversarial procedure— – Contesting Algorithms. It proposes to deliberately introduce friction into the dominant removal systems governed by artificial intelligence. Algorithmic content moderation often seeks to optimize a single goal, such as removing copyright-infringing materials or blocking hate speech, while other values in the public interest, such as fair use or free speech, are often neglected. Contesting algorithms introduce an adversarial design which reflects conflicting values, and thereby may offer a check on dominant removal systems. Facilitating an adversarial intervention may promote democratic principles by keeping society in the loop. An adversarial public artificial intelligence system could enhance dynamic transparency, facilitate an alternative public articulation of social values using machine learning systems, and restore societal power to deliberate and determine social tradeoffs. There is ample discussion of MBA self-serving values in the corporate social responsibility literature, and yet empirical studies regarding the corporate manifestations and consequences of those values are scant. In a comprehensive study of major US public corporations, we find that MBA CEOs are more apt than their non-MBA counterparts to engage in short-term strategic expedients such as positive earnings management and suppression of R&D, which in turn are followed by compromised firm market valuations.

In these challenging times, connectedness has become more necessary than ever before. Meanwhile, research in organizations highlighted the importance of entrainment, a process of synchronizing rhythms over time that drives connectedness within, between, and across rhythmic activities. It is also suggested that an inner life and spiritual leadership coherence can play a key role in this process, out of which spiritual well-being emerges. The purpose of this study is to evaluate the conditions for entrainment through the revised model of spiritual (...) leadership at a professional services company that employs multiple teams simultaneously, as presented by Sandra & Nandram (Journal of Management, Spirituality & Religion 17(4):316–332, 2020 ). It verifies if inner life and spiritual leadership coherence are jointly sufficient to foster the emergence of spiritual well-being, both at the individual and at the group level. Next, it seeks to understand how teams differ on these variables. To generate a more holistic insight, it uses an explanatory sequential research design as mixed methods approach, integrating and comparing quantitative data from eighty-six participants across fourteen teams with qualitative data from five team leaders. The findings support that inner life and spiritual leadership coherence can be usefully deployed in a consistent way to understand the emergence of spiritual well-being through entrainment. It further supports that developing personal spiritual leadership directly influences the level of spiritual leadership of the group to which the individual belongs. Finally, better performing teams pay more attention to inner life practices, while taking care of their team members. (shrink)

The literature on the interplay between geographic communities and organizations has largely ignored the role of individual residents. In adopting a meso-perspective, we examine a potentially vital relationship between corporate conduct and pro-social behavior demanding sacrifice from individuals. Drawing on Weber ), we theorize that organizations in a community legitimize personal social conduct in three ways—by serving as role models, imparting norms and values, and routinizing forms of interaction. We study the relationship between corporate social responsibility behavior by local firms (...) and the social distancing of citizens in US counties during the Covid-19 pandemic, a core ethical outcome. We argue and find that the residents of communities in which firms exhibit higher levels of CSR engaged in more SD during the Covid-19 pandemic. This was true when firms were long-established, isomorphic in their CSR, and major employers and vendors. Moreover, CSR relating to the treatment of employees as well as positive and negative extremes in CSR bore especially strong relationships with SD. Implications are drawn for the study of business ethics, as modeled by CSR, as a force for ethical personal behavior and public health in communities. (shrink)

In this paper, the process for firms to decide whether or not to invest in corporate social responsibility is treated from a real option perspective. We extend the Husted framework with an important extra parameter that allows us to understand the timing of CSR investment and explain why some companies drag their feet over CSR investments. Our model explicitly allows for the impact of the opportunity cost of delaying the CSR investment decision, providing firms with tools to determine the optimal (...) moment of exercising the CSR investment option. We illustrate our timing model through a case study and analyze governmental support strategies for CSR from a real options perspective. (shrink)

The prevalence of social production and the increase in User Generated Content destabilize some of the fundamental premises of our current copyright law. Copyright law is primarily designed to regulate the relationships of a single owner with other non-owners and is focused on the sovereignty of the author/owner. Social production, by contrast, requires us to articulate a matrix of relationships between the individual, the facilitating platform and the communities and crowds involved in social production. The transition from industrial production to (...) social production transforms the social relations associated with the production of content and therefore requires adjustment of the institutions that design such relations. This Article closely examines the social dimension of content production and analyzes the consequences for the governance of content in the social web. The Article proceeds as follows: Part I describes social production and analyzes the implications for the stakeholders involved. I focus on three key features of social production which affect why we create, how we create, and what assets are generated by the process of creation. Part II explains why social production might be incompatible with the current copyright regime. In particular, I argue that copyright law mainly defines rights against strangers and fails to provide a framework for managing the rights and interests within a gigantic group of collaborators. Furthermore, the exclusivity offered by copyright law may undermine social motivation and collaborative production. Finally, in Part III, I outline some of the challenges for legal policy. (shrink)

Copyright law in recent years has undergone a process of privatization. While weakening the enforceability of conventional legislation (copyright rules), cyberspace facilitates alternative types of regulation such as contracts and technical self-help measures. Regulation by the code is significantly different from traditional types of public ordering (copyright law) and private ordering (contracts). Norms that technically regulate the use of information are not merely self-made they are also self-enforced. Furthermore, the law was recruited to uphold the superiority of such technical self-help (...) measures. The recently adopted U.S. Digital Millenium Copyright Act (DMCA) 1998 prohibits the development and use of technologies designed to circumvent copyright management systems. The underlying assumption of this legislation is that in Cyberspace, the target of regulation should become the technologies that affect users'' behavior rather than the behaviors themselves. This paper critically examines this regulatory approach and highlights its shortcomings. (shrink)

Recently there has been a lively revival of interest in implicatures, particularly scalar implicatures. Building on the resulting literature, our main goal in the present paper is to establish an empirical generalization, namely that SIs can occur systematically and freely in arbitrarily embedded positions. We are not so much concerned with the question whether drawing implicatures is a costly option (in terms of semantic processing, or of some other markedness measure). Nor are we specifically concerned with how implicatures come about (...) (even though, to get going, we will have to make some specific assumptions on this matter). The focus of our discussion is testing the claim of the pervasive embeddability of SIs in just about any context, a claim that remains so far controversial. While our main goal is the establishment of an empirical generalization, if we succeed, a predominant view on the division of labor between semantics and pragmatics will have to be revised. A secondary goal of this paper is to hint at evidence that a revision is needed on independent grounds. But let us first present, in a rather impressionistic way, the reasons why a revision would be required if our main generalization on embedded SIs turns out to be correct. In the tradition stemming from Grice (1989), implicatures are considered a wholly pragmatic phenomenon and SIs are often used as paramount examples. Within such a tradition, 㳊 semantics is taken to deal with the compositional construction of sentence meaning (a term which we are using for now in a loose, non technical way), while pragmatics deals with how sentence meaning is actually put to use (i.e. enriched and possibly modified through reasoning about speakers’ intentions, contextually relevant information, etc.). Simply put, on this view pragmatics takes place at the level of complete utterances and pragmatic enrichments are a root phenomenon (something that happens globally to sentences) rather than a compositional one.. Focusing on Correspondence from the Double-Cassia Studio (Shuanggui xuan chidu 雙桂軒尺牘), a collection of letters by a gentlewoman named Ding Shanyi 丁善儀 (1799–after 1861), this paper examines how elite women in mid-nine- teenth-century China applied epistolary conventions in their social life. Com- pared to other literary collections of individual women in late imperial China, Ding’s letter collection is exceptional in recording the life of its author through the epistolary genre and in revealing the sociopolitical dynamics that underlay elite women’s epistolary (...) gentility. Ding’s letters are indicative of the noticeable concerns shared by gentlewomen in mid-nineteenth-century China and provide specific contexts for understanding some of the epistolary techniques used by lit- erary women to facilitate social networking. This paper uncovers Ding’s life and explores three major themes in her epistolary collection: her responses to crises, concerns about health, and cultivation of friendship. Ding’s letters show how elite women evinced sophistication and erudition in their epistolary composition, which was an important way for them to express themselves and demonstrate their mas- tery of language and rhetorical tradition. The article inquires about the role of language in Cristina Peri Rossi’s Panic Signs [Indicios pánicos]. The hypothesis of the work is that language, as a mimetic instrument of representation and creation, established itself as a way to upgrade the relations of power during the Uruguayan pre-dictatorship. Being a qualitative research based on a hermeneutical approach, the article has the following aims: i) reconstruct the background to the dictatorship leaded by Juan Maria Bordaberry, ii) frame the work within the tradition (...) of dictator novel following Lukács’ socio-critical approach and Pierre Bourdieu’s field theory, iii) explain how language works as an instrument of representation and power, iv) analyze Peri Rossi’s work in the light of the aforementioned framework. It concludes, first, that the work responds to a mimetic language of representation, which involves taking a stance that is based on the notions of hegemony or counter-hegemony; and, second, that provided the scarce studies concerning the circumstantial situations of the work, the article might be regarded as a significant contribution to literary criticism. We ordered morphine and got her settled and she finally relaxed. She was gone by morning.May reminded me of Mary, another woman with a similar disease. Mary's husband Harold came to visit drunk. She could just point to a letter board similar to an Ouija board and spell out words and phrases with her right hand and then use her eyes to indicate if we were correct. Mary was a refined woman but very patient with me because I was an 18-year-old boy trying to be a man, sensitive but having a lot to learn. Mary taught me how to communicate without words—just using the eyes.These women are the core of understanding the meaning of what I have done for 30 years. Whether imprisoned by hearing loss, loss of sight or mobility, failing bodies and minds or simply being alone—the challenge was the same, to know when to reach into another's soul and touch them, to stay out of the way, and have the good sense to know the difference. Can I honestly say I fell in love with the woman that quietly said, "I'm tired of being old?" These were largely rhetorical questions without an answer.The men and women of this generation were far superior to me. I could only stand by and watch them die. Stress is an organism’s phyciological and psychological responses that can cause unpleasant situation and make mental and emotional dysfunction. Resilient people are more to see changes as opportunity to grow rather than as stressors. Resiliency is the ability to bounce back quickly from misfortune and successfully adapt in a smart way to adverse with more power. This quantitative (...) research represents a non-experimental method using questionnaires with Likert scale as the instrument to find correlation between resiliency and stress in the preparatory phase of retirement. The foundations of analysis offered by Cauchy and Riemann were not immediately welcomed by the mathematical community. Before 1870 the foundations of mathematics were considered more or less a national affair. In this paper, Dutch ideas of rigour in analysis between 1840 and 1870 will be discussed. These ideas show that Dutch mathematicians were aware of developments abroad but preferred the concept of infinitesimals as a foundation of mathematics.

This paper examines footraces that are paced and unpaced, and runners who are pre-arranged, designated pacers and those who are not. Although pacesetting is commonplace in footraces today, the practice challenges our conception of sport competition, the nature of competitors and the meaning of records. For example, Bale calls paced races as ‘staged experiments’ to set world records and argues that pacers were crucial in the running career of Roger Bannister. In 2011, the International Association of Athletics Federation banned women’s (...) world records in mixed gender running events, like major marathons, because women were paced by male runners. By examining these cases and others, the authors here will claim paced footraces are qualitatively different than unpaced competitions, pacers introduce peculiar motives and intentions as competitors, women should not be denied opportunities to excel and perform at their very best, and the 2011 IAAF policy is unjustified. This book offers new insights into the nature of human rational capacities by engaging inferentialism with empirical research in the cognitive sciences. Inferentialism advocates that humans' unique kind of intelligence is discursive and rooted in competencies to make, assess and justify claims. This approach provides a rich source of valuable insights into the nature of our rational capacities, but it is underdeveloped in important respects. For example, little attempt has been made to assess inferentialism considering relevant scientific research on human (...) communication, cognition or reasoning. By engaging philosophical and scientific approaches in a productive dialogue, this book shows how we can better understand human rational capacities by comparing their respective strengths and weaknesses. In this vein, the author critically revisits and constructively develops central themes from the work of Robert Brandom and other language rationalists: the nature of the assertoric practice and its connection to reasoned discourse, the linguistic constitution of the shared space of reasons, the social nature and function of reasoning, the intersubjective roots of social-normative practices and the nature of objective thought. This change in approach, which primarily occurred in 1860’s, affected the standing and perception of an academy once highly respected in the field of mathematics. In the present work, I examine both the curricula at the Academy and the crucial role of the Academy’s mathematics instructors in the Dutch Mathematical Society and the Royal Academy of Sciences. Importantly, these two institutions managed to successfully adapt to the changing character of mathematical sciences that occurred around 185 Mathematicians at the Royal Military Academy, however, appeared to cling to an outdated view of mathematics. Failing to update their approach ultimately caused the Academy to lose its once prominent place in the Dutch mathematical community. (shrink)

This shift became visible with the founding of the Dutch Royal Military Academy in 1828, which shows the role of mathematics in military education shifting toward a purely pedagogical function. This change in approach, which primarily occurred in 1860’s, affected the standing and perception of an academy once highly respected in the field of mathematics. In the present work, I examine both the curricula at the Academy and the crucial role of the Academy’s mathematics instructors in the Dutch Mathematical Society and the Royal Academy of Sciences. Importantly, these two institutions managed to successfully adapt to the changing character of mathematical sciences that occurred around 185 Mathematicians at the Royal Military Academy, however, appeared to cling to an outdated view of mathematics. Failing to update their approach ultimately caused the Academy to lose its once prominent place in the Dutch mathematical community. (shrink)

At the provincial council elections of the 13th of October 1985 in Belgium two of the three traditional politie al families made a general progress, namely the socialists and the christian democrats. The liberals had a serious decline in Flanders, but for the greater part this was counterbalanced by the liberal progress in Wallonia. The ecologists also made progress, mostly in the Flemish part of the country. Beside the Flemish liberals, the big losers of these elections were the regional parties, (...) namely the Flemish nationalists and for sure the Walloon Rally who disappeared from the electoral scene. At the provincial council elections of the 13th of december 1987 only one of the three traditional political families made a general progress, namely the socialists. Mainly in Wallonia the socialists improved their position seriously. In this part of the country they are the only and absolute winners of these provincial elections. The christian-democrats and the liberals were subject of a severe decline. Por the christian-democrats this decline was mainly situated in Flanders. The liberals had a serious decline in W (...) allonia, that couldn't be counterbalanced by the small progress they made in Flanders. The ecologists made progress, mostly in the Flemish part of the country and in Brussels. By the federalist parties the Volksunie had a loss of three provincial council seats in Flanders, but the seperatistic and extreme right party Vlaams Blok won two seats. The communists disappeared totally from the provincial councils in Belgium. The results of the provincial council elections had a similar profile as these of the House of Representatives and the Senate which where held at the same day. (shrink)
