Este texto construye una versión de la teoría de Hegel acerca de la sanción penal, principalmente a partir de su Fundamentos de la Filosofía del Derecho, como una teoría agnóstica da la pena. El texto demuestra como la contradicción interna presentada por Hegel en cuanto el filósofo intenta resolver los problemas acerca de la punición no son resueltas, pero, por el contrario, como esas contradicciones necesariamente se integran a todo posible concepto o imposición de la sanción criminal.

This article discusses the relation between colonialism and the sovereignty of peoples through a dialogue between Hegel and the thought of the French Revolution. These two sides are relevant to each other not only because of their historical proximity, but also because of the connections that can be established when we approach the topic of colonialism through these two manifestations. Hegel is explicit that his philosophy of history and his philosophy of right are supposed to be philosophies of freedom. Yet (...) despite the importance that he lends to freedom, Hegel also explicitly defends, in the very same text, colonial domination when he deals with the relation between peoples. A similar problem had arisen in the course of the French Revolution. Following the declarations of war, France is confronted on various occasions with the question of how to deal with other peoples and countries. With the foundation of the Republic in 1792, the relation with other peoples becomes central in the revolutionary debates. The topic of colonialism is part of the constituting debates, and not only because of the uprisings in then Saint Domingue leading to the Haitian Revolution. This article is a part of a larger research project that attempts to reassess the relations between Hegel and the French Revolution, and deals with the question of how we can re-read Hegel's interpretation of the French Revolution based on the evolving historiography of the Revolution. After an introduction of both sides of this dialogue, the paper discusses how Hegel's political philosophy can be applied to understand the debates about the emancipation of colonies that take place during the French Revolution. The next part further analyses some issues, such as the notion of sovereignty and, in the concluding remarks, I summarize my discussion and point to some avenues for further research. (shrink)

Patriotism is not commonly associated with freedom. Even less so when Hegel is evoked. By reading Hegel’s concept of patriotism through the lens of revolutionary France, I present a notion of patriotism that is tied to the realization of freedom. This paper demonstrates what happens when Hegel’s philosophy of law is re-read through the political philosophy of the French Revolution itself. Hegel’s Philosophy of Right and its lectures are marked by tensions. The legacy it leaves traces it leaves behind can (...) be re-appropriated to explore the inconclusive hints left by the philosopher. The idea of patriotism is one of them, simply defined as an intersubjective link between the concrete individual and the state or as particular and general interests coinciding. This paper expands this analysis by introducing two elements: Hegel’s discussion on the character of the law and how it comes to be law; and the revolutionary phenomenon itself. The revolutionaries’ views on patriotism and its functions within a revolutionary moment can help us transform the mere traces left by Hegel into a wider vision that incorporates and promotes freedom. The enhanced mathematical indispensability argument, proposed by Alan Baker (2005), argues that we must commit to mathematical entities, because mathematical entities play an indispensable explanatory role in our best scientific theories. This article clarifies the doctrines that support this argument, namely, the doctrines of naturalism and confirmational holism.

_The Power of Religion in the Public Sphere_, co-edited by Eduardo Mendieta and Jonathan VanAntwerpen, represents a rare opportunity to experience a diverse group of preeminent philosophers confronting one pervasive contemporary concern: what role does, or should, religion play in our public lives? Reflecting on her recent work concerning state violence in Israel-Palestine, Judith Butler explores the potential of religious perspectives for renewing cultural and political criticism, while Jürgen Habermas, best known for his seminal conception of the public sphere, (...) thinks through the ambiguous legacy of the concept of "the political" in contemporary theory. Charles Taylor argues for a radical redefinition of secularism, and Cornel West defends civil disobedience and emancipatory theology. Eduardo Mendieta and Jonathan VanAntwerpen detail the immense contribution of these philosophers to contemporary social and political theory, and an afterword by Craig Calhoun places these attempts to reconceive the significance of both religion and the secular in the context of contemporary national and international politics. In this note we shall argue that Milne’s new effort does not refute Truthmaker Maximalism. According to Truthmaker Maximalism, every truth has a truthmaker. Milne has attempted to refute it using the following self-referential sentence M: This sentence has no truthmaker. Essential to his refutation is that M is like the Gödel sentence and unlike the Liar, and one way in which Milne supports this assimilation is through the claim that his proof is essentially object-level and not semantic. In Section (...) 2, we shall argue that Milne is still begging the question against Truthmaker Maximalism. In Section 3, we shall argue that even assimilating M to the Liar does not force the truthmaker maximalist to maintain the ‘dull option’ that M does not express a proposition. There are other options open and, though they imply revising the logic in Milne’s reasoning, this is not one of the possible revisions he considers. In Section 4, we shall suggest that Milne’s proof requires an implicit appeal to semantic principles and notions. In Section 5, we shall point out that there are two important dissimilarities between M and the Gödel sentence. Section 6 is a brief summary and conclusion. (shrink)

In this essay an engineer and a philosopher, after many conversations, develop an argument for why the Aristotelian version of virtue ethics is the most promising way to develop what we call artificial moral, social agents, i.e. robots. This, evidently, applies to humans as well. There are several claims: first, that humans are not born moral, they are socialized into morality; second, that morality involves affect, emotion, feeling, before it engages reason; third, that how a moral being feels is related (...) to some narrative, whether moral or not; and finally, that narrativity is what builds a sense of a “moral” I, namely an authorial moral self. ABSTRACT Scholars have understood Aristotle’s theory of equity in two different ways. On the one hand, some claim that equity is an extra-normative criterion, that is, it goes beyond the law and reaches a supra-legal level identified with a metaphysical order of natural justice. On the other hand, some hold that equity is intra-normative, that is, the judge rectifes legal justice without going beyond its limits. Considering this second point of view and by using a methodology that combines legal philosophy (...) and some of the main theories about emotions in ancient Greece, this paper aims to demonstrate that equitable judges should not have broad discretion according to Aristotle’s thought. To hold that claim, I will mainly address the role of emotions in the formation of judgment and the power they have to endanger the possibility of giving just and rational judicial decisions. The desire to minimize the number of individual new entities postulated is often referred to as quantitative parsimony. Its influence on the default hypotheses formulated by scientists seems undeniable. I argue that there is a wide class of cases for which the preference for quantitatively parsimonious hypotheses is demonstrably rational. The justification, in a nutshell, is that such hypotheses have greater explanatory power than less parsimonious alternatives. My analysis is restricted to a class of cases I shall refer to as (...) additive. Such cases involve the postulation of a collection of qualitatively identical individual objects which collectively explain some particular observed phenomenon. Bioethics and human rights were conceived in the aftermath of the Holocaust, when moral outrage reenergized the outmoded concepts of and renaming them and to give them new purpose. Originally, the principles of bioethics were a means for protecting human rights, but through a historical accident, bioethical principles came to be considered as fundamental. In this paper I reflect on the parallel development and accidental divorce of bioethics and human rights to urge their reconciliation.

My aim is twofold: first, to root out the metaphysical assumptions that generate the problem of mental causation and to show that they preclude its solution; second, to dissolve the problem of mental causation by motivating rejection of one of the metaphysical assumptions that give rise to it. There are three features of this metaphysical background picture that are important for our purposes. The first concerns the nature of reality: all reality depends on physical reality, where physical reality consists of (...) a network of events.1 The second concerns the nature of causation, and the third concerns the conception of behavior. The evil God challenge is an argumentative strategy that has been pursued by a number of philosophers in recent years. It is apt to be understood as a parody argument: a wholly evil, omnipotent and omniscient God is absurd, as both theists and atheists will agree. But according to the challenge, belief in evil God is about as reasonable as belief in a wholly good, omnipotent and omniscient God; the two hypotheses are roughly epistemically symmetrical. Given this symmetry, thesis belief (...) in an evil God and belief in a good God are taken to be similarly preposterous. In this paper, we argue that the challenge can be met, suggesting why the three symmetries that need to hold between evil God and good God – intrinsic, natural theology and theodicy symmetries – can all be broken. Deliberation often begins with the question ‘What do I want to do?’ rather than the question of what one ought to do. This paper takes that question at face value, as a question about which of one’s desires is strongest, which sometimes guides action. The paper aims to explain which properties of a desire make that desire strong, in the sense of ‘strength’ relevant to this deliberative question. Both motivational force and phenomenological intensity seem relevant to a desire’s strength; however, (...) accounting for the strength of a desire in these terms opens up significant indeterminacy about what we want. The paper argues that this indeterminacy is often resolved simply by posing the question ‘What do I want to do?’ to oneself: there is reason to believe that one’s answer will play a verdictive role, partially determining what the agent most wants. Self-reflective beliefs can play a self-fulfilling role, and surprisingly this seems to follow from basic platitudes about the belief-desire model. (shrink)

Consensual homicide remains a crime in jurisdictions where active voluntary euthanasia has been legalized. At the same time, both jurisdictions, in which euthanasia is legal and those in which it is not, recognize that all patients (whether severely ill or not) have the right to refuse or withdraw medical treatment (including life-saving treatment). In this paper, I focus on the tensions between these three norms (the permission of active euthanasia, the permission to reject life-saving treatment, and the prohibition of consensual (...) homicide), assuming a justification of euthanasia based on the right to (personal) autonomy. I argue that the best way to provide a coherent account of these norms is to claim that patients have two distinct rights: the right to autonomy and the right to bodily integrity. This solution has some relevant implications for the discussion of the legalization of active euthanasia. (shrink)

Con importantes aspectos en común, sus propósitos, sus sesgos y la posición subjetiva de sus autores evidencian importantes diferencias. A partir de esta problemática, se analizará la correspondencia sostenida por Max Weber desde el servicio militar durante la Gran Guerra. En un período en el que no tiene intervención pública alguna, el análisis se centra en la evolución de su (...) perspectiva sobre el papel de Alemania y sobre su actividad específica en los lazaretos. Cada uno de estos aspectos se relaciona respectivamente con dos piedras angulares de la obra weberiana: el problema nacional y el proceso de burocratización. (shrink)

In this article, we will present a number of technical results concerning Classical Logic, ST and related systems. Our main contribution consists in offering a novel identity criterion for logics in general and, therefore, for Classical Logic. In particular, we will firstly generalize the ST phenomenon, thereby obtaining a recursively defined hierarchy of strict-tolerant systems. Secondly, we will prove that the logics in this hierarchy are progressively more classical, although not entirely classical. We will claim that a logic is to (...) be identified with an infinite sequence of consequence relations holding between increasingly complex relata: formulae, inferences, metainferences, and so on. As a result, the present proposal allows not only to differentiate Classical Logic from ST, but also from other systems sharing with it their valid metainferences. Finally, we show how these results have interesting consequences for some topics in the philosophical logic literature, among them for the debate around Logical Pluralism. The reason being that the discussion concerning this topic is usually carried out employing a rivalry criterion for logics that will need to be modified in light of the present investigation, according to which two logics can be non-identical even if they share the same valid inferences. Self-consciousness, many philosophers agree, is essential to being a person. There is not so much agreement, however, about how to understand what self-consciousness is. Philosophers in the field of cognitive science tend to write off self-consciousness as unproblematic. According to such philosophers, the real difficulty for the cognitive scientist is phenomenal consciousness--the fact that we have states that feel a certain way. relation between, say, a lump of clay and a statue that it makes up, or between a red and white piece of metal and a stop sign, or between a person and her body? Assuming that there is a single relation between members of each of these pairs, is the relation “strict” identity, “contingent” identity or something else?1 Although this question has generated substantial controversy recently,2 I believe that there is philo- sophical gain to be had from thinking through the (...) issues from scratch. Many of the charges and countercharges are based on the following dichotomy: For any x and y that are related as the lump of clay is to the statue that it makes up, either x is identical to y, or x and y are separate entities, independent of each other. By giving up this dichotomy, we will be able to begin to make sense, I hope, of an intermediate unity relation that holds promise for solving a raft of philosophical problems, including the problem of how persons are related to their bodies.3 And if I am correct, then this relation—constitution without identity—is ubiquitous and interesting in its own right, apart from the light that it sheds on human persons. The possible impact of general philosophical ideas on the choice of research subject in mathematics is the topic of this paper. I examine a specific case in which the philosophical background is provided by a discussion on the role of language in science, which is associated with the work of Condillac. The area of mathematics considered is functional equations, a difficult chapter of mathematical analysis that began to be developed between the end of the eighteenth and the beginning of the (...) nineteenth century. Drawing on writers as diverse as Saul Kripke, Stanley Cavell, G. E. M. Anscombe, Jonathan Lear, and Bernard Williams, I offer an interpretation of Wittgenstein's key notion of a form of life that explains why Wittgenstein was so enigmatic about it. Then, I show how Hilary Putnam's criticism of Wittgenstein's philosophy of mathematics and Richard Rorty's support of (what he takes to be) Wittgenstein's legacy in the philosophy of mind both require mistaken assumptions about Wittgenstein's idea of a form of (...) life. Finally, I consider the extent to which the idea of a form of life is subject to Donald Davidson's critique of the idea of a conceptual scheme. (shrink)

Throughout his illustrious career, Roderick Chisholm was concerned with the nature of persons. On his view, persons are what he called ‘entia per se.’ They exist per se, in their own right. I too have developed an account of persons—I call it the ‘Constitution View’—an account that is different in important ways from Chisholm’s. Here, however, I want to focus on a thesis that Chisholm and I agree on: that persons have ontological significance in virtue of being persons. Although I’ll (...) make the notion of ontological significance more precise later, the rough idea is that Fs (persons, or whatever) have ontological significance just in case a new F is a new thing and not just a change in some already-existing thing. I consider an argument, due to Geoffrey Lee, that we can know a priori from the left-right asymmetrical character of experience that our brains are left-right asymmetrical. Lee's argument assumes a premise he calls relationism, which I show is well-supported by the best philosophical picture of spacetime. I explain why Lee's relationism is compatible with left-right asymmetrical laws. I then show that the conclusion of Lee's argument is not as strong or surprising as he makes it out to be.

In 1997, I introduced the concept and the phrase “bio art”, originally in relation to my artwork “Time Capsule”. This work approached the problem of wet interfaces and human hosting of digital memory through the implantation of a microchip. The work consisted of a microchip implant, seven sepia-toned photographs, a live television broadcast, a webcast, interactive telerobotic webscanning of the implant, a remote database intervention, and additional display elements, including an X-ray of the implant. While “bio art” is applicable to (...) a large gamut of in vivo works that employ biological media, made by myself and others, in 1998, I started to employ the more focused term “transgenic art”. Republished in Ars Electronica ‘99—Life Science, ed. Gerfried Stocker and Christine Schopf, 289–296.) to describe a new art form based on the use of genetic engineering to create unique living beings. Art that manipulates or creates life must be pursued with great care, with acknowledgment of the complex issues it raises and, above all, with a commitment to respect, nurture, and love the life created. I have been creating and exhibiting a series of transgenic artworks since 1999. I have also been creating bio art that is not transgenic. The implications of this ongoing body of work have particular esthetic and social ramifications, crossing several disciplines and providing material for further reflection and dialog. What follows is an overview of theses works, the issues they evoke, and the debates they have elicited. (shrink)
