Objective To develop an ethically, legally, and clinically appropriate ventilator allocation policy for AdventHealth Tampa and AdventHealth Carrollwood in Tampa, Florida, which could be enacted swiftly during the Covid-19 pandemic. Methods During Spring 2020, a subcommittee of the Medical Ethics Committee established consensus on the fundamental principles of the policy, then built on existing ethical, legal, and clinical guidance. Results The plan was finalized in May 2020. The plan triages patients based on exclusion criteria, prognosis and expected benefit of ventilation, (...) and change in prognosis over time. Decisions are made by committee in order to minimize moral distress among individual patient care providers. Conclusions Due to international concerns about healthcare resource shortages during the Covid-19 pandemic, hospitals need allocation policies informed by the crisis standard of care, the hospital’s ethical duty to plan for an emergency, and federal civil rights laws Policy Implications: This type of policy can serve as a model for other institutions to develop crisis standards of care resource allocation policies, which are a necessary component of disaster planning. Recently there have emerged an assortment of theorems relating to the ‘absoluteness of emerged events,’ and these results have sometimes been used to argue that quantum mechanics may involve some kind of metaphysically radical non-absoluteness, such as relationalism or perspectivalism. However, in our view a close examination of these theorems fails to convincingly support such possibilities. In this paper we argue that the Wigner’s friend paradox, the theorem of Bong et al and the theorem of Lawrence et al are all (...) best understood as demonstrating that if quantum mechanics is universal, and if certain auxiliary assumptions hold, then the world inevitably includes various forms of ‘disaccord,’ but this need not be interpreted in a metaphysically radical way; meanwhile, the theorem of Ormrod and Barrett is best understood either as an argument for an interpretation allowing multiple outcomes per observer, such as the Everett approach, or as a proof that quantum mechanics cannot be universal in the sense relevant for this theorem. We also argue that these theorems taken together suggest interesting possibilities for a different kind of relational approach in which _interaction_ states are relativized whilst observed events are absolute, and we show that although something like ‘retrocausality’ might be needed to make such an approach work, this would be a very special kind of retrocausality which would evade a number of common objections against retrocausality. We conclude that the non-absoluteness theorems may have a significant role to play in helping converge towards an acceptable solution to the measurement problem. (shrink)

Dementia patients in the moderate-late stage of the disease can, and often do, express different preferences than they did at the onset of their condition. The received view in the philosophical literature argues that advance directives which prioritize the patient’s preferences at onset ought to be given decisive moral weight in medical decision-making. Clinical practice, on the other hand, favors giving moral weight to the preferences expressed by dementia patients after onset. The purpose of this article is to show that (...) the received view in the philosophical literature is inadequate and is out of touch with real clinical practice. I argue that having dementia is a cognitive transformative experience and that preference changes which result from this are legitimate and ought to be given moral weight in medical decision-making. This argument ought to encourage us to reduce our confidence in the moral weight of advance directives for dementia patients. (shrink)

A recurring criticism of Isaiah Berlin is that he is a relativist. This essay argues that such criticisms are misplaced, as they fail to account for Berlin’s views about a common human horizon and the sense of reality. Berlin distinguishes his position from two forms of relativism – epistemological and cultural – and argues that the first entails self‐contradiction, while the other precludes mutual understanding. In response, he highlights the importance of a human horizon which involves shared moral values, and (...) provides for the possibility of mutual comprehension. Such comprehension is attained by the use of the sense of reality, which is taken to illuminate the differences and similarities between those of different beliefs. (shrink)

We describe how the set of tools, practices, and social relations known as “precision agriculture” is defined, promoted, and debated. To do so, we perform a critical discourse analysis of popular and trade press websites. Promoters of precision agriculture champion how big data analytics, automated equipment, and decision-support software will optimize yields in the face of narrow margins and public concern about farming’s environmental impacts. At its core, however, the idea of farmers leveraging digital infrastructure in their operations is not (...) new, as agronomic research in this vein has existed for over 30 years. Contemporary discourse in precision ag tends to favour emerging digital technologies themselves over their embeddedness in longstanding precision management approaches. Following several strands of science and technology studies research, we explore what rhetorical emphasis on technical innovation achieves, and argue that this discourse of novelty is a reinvention of precision agriculture in the context of the growing “smart” agricultural economy. We overview six tensions that remain unresolved in this promotional rhetoric, concerning the definitions, history, goals, adoption, uses, and impacts of precision agriculture. We then synthesize these in a discussion of the extent to which digital tools are believed to displace farmer decision-making and whether digital agriculture addresses the biophysical heterogeneity of farm landscapes or land itself has become an “experimental technology”—a way to advance the general development of artificial intelligence. This discussion ultimately helps us name a larger dilemma: that the smart agricultural economy is perhaps less about supporting land and its stewards than promising future tech and profits. (shrink)

Cartographies contributes to the growing debates on the value of poststructuralist theory. Grounded in a theoretical framework, it combines poststructural semiotics and a philosophy of the body. While interest in poststructuralism is well established, the currently felt need to anchor that interest in a political, material reality is where these readings gain their critical edge. They address the material - social, political and economic - effects of representation, marking anew direction in the debate.

The laws of nature have come a long way since the time of Newton: quantum mechanics and relativity have given us good reasons to take seriously the possibility of laws which may be non-local, atemporal, ‘all-at-once,’ retrocausal, or in some other way not well-suited to the standard dynamical time evolution paradigm. Laws of this kind can be accommodated within a Humean approach to lawhood, but many extant non-Humean approaches face significant challenges when we try to apply them to laws outside (...) the time evolution picture. Thus for proponents of non-Humean approaches to lawhood there is a clear need for a novel non-Humean account which is capable of accommodating these sorts of laws. In this paper we propose such an account, characterizing lawhood in terms of constraints, which are understood as a form of modal structure. We demonstrate that our proposed realist account can indeed accommodate a large variety of laws outside the time evolution paradigm, and describe some possible applications to important philosophical problems. Ethics training has undergone dramatic changes in the past decade. Global business growth and increased technological change have played a role in the increasing sophistication and development of ethics programs and communication devices. These training initiatives are based on organizational ethical decision making theories and empirical research indicating the benefits of training in developing an ethical organizational culture. In this article, we discuss the issues important in developing effective ethics training, examine the goals and methods currently used in training, introduce (...) an ethics training behavioral simulation, and discuss its implementation and evaluation. Based on an extensive review of the literature and field surveys, the paper proposes a conceptualization and operationalization of corporate citizenship meaningful in two countries: the United States and France. A survey of 210 American and 120 French managers provides support for the proposed definition of corporate citizenship as a construct including the four correlated factors of economic, legal, ethical, and discretionary citizenship. The managerial implications of the research and directions for future research are discussed.

Simple idealized models seem to provide more understanding than opaque, complex, and hyper-realistic models. However, an increasing number of scientists are going in the opposite direction by utilizing opaque machine learning models to make predictions and draw inferences, suggesting that scientists are opting for models that have less potential for understanding. Are scientists trading understanding for some other epistemic or pragmatic good when they choose a machine learning model? Or are the assumptions behind why minimal models provide understanding misguided? In (...) this paper, using the case of deep neural networks, I argue that it is not the complexity or black box nature of a model that limits how much understanding the model provides. Instead, it is a lack of scientific and empirical evidence supporting the link that connects a model to the target phenomenon that primarily prohibits understanding. (shrink)

Do we see more than we can report? Psychologists and philosophers have been hotly debating this question, in part because both possibilities are supported by suggestive evidence. On one hand, phenomena such as inattentional blindness and change blindness suggest that visual awareness is especially sparse. On the other hand, experiments relating to iconic memory suggest that our in-the-moment awareness of the world is much richer than can be reported. Recent research has attempted to resolve this debate by showing that observers (...) can accurately report the color diversity of a quickly flashed group of letters, even for letters that are unattended. If this ability requires awareness of the individual letters’ colors, then this may count as a clear case of conscious awareness overflowing cognitive access. Here we explored this requirement directly: can we perceive ensemble properties of scenes even without being aware of the relevant individual features? Across several experiments that combined aspects of iconic memory with measures of change blindness, we show that observers can accurately report the color diversity of unattended stimuli, even while their self-reported awareness of the individual elements is coarse or nonexistent — and even while they are completely blind to situations in which each individual element changes color mid-trial throughout the entire experiment. We conclude that awareness of statistical properties may occur in the absence of awareness of individual features, and that such results are fully consistent with sparse visual awareness. (shrink)

Relational quantum mechanics (RQM) is an interpretation of quantum mechanics based on the idea that quantum states do not describe an absolute property of a system but rather a relationship between systems. There have recently been some criticisms of RQM pertaining to issues around intersubjectivity. In this article, we show how RQM can address these criticisms by adding a new postulate which requires that all of the information possessed by a certain observer is stored in physical variables of that observer (...) and thus is accessible by measurement to other observers. This makes it possible for observers to reach intersubjective agreement about quantum events that have occurred in the past. We suggest a possible ontology for a version of RQM employing this postulate; this ontology upholds the principle that quantum states are always relational, but it also postulates a set of quantum events that are not strictly relational. We show that the new postulate helps address the preferred basis problem in RQM. (shrink)

Many modern commentators on inertial phenomena hold (or just assume) that there is no "problem of inertia", on the grounds that either (a) no explanation is needed for such phenomena or (b) the explanation is already at hand. My purpose here is to comment on both views, defending the thesis that the problem is real and still unsolved.

Any successful interpretation of quantum mechanics must explain how our empirical evidence allows us to come to know about quantum mechanics. In this article, we argue that this vital criterion is not met by the class of ‘orthodox interpretations,’ which includes QBism, neo-Copenhagen interpretations, and some versions of relational quantum mechanics. We demonstrate that intersubjectivity fails in radical ways in these approaches, and we explain why intersubjectivity matters for empirical confirmation. We take a detailed look at the way in which (...) belief-updating might work in the kind of universe postulated by an orthodox interpretation, and argue that observers in such a universe are unable to escape their own perspective in order to learn about the structure of the set of perspectives that is supposed to make up reality according to these interpretations. We also argue that in some versions of these interpretations it is not even possible to use one’s own relative frequencies for empirical confirmation. Ultimately we conclude that it cannot be rational to believe these sorts of interpretations unless they are supplemented with some observer-independent structure which underwrites intersubjective agreement in at least certain sorts of cases. Mary Gentile’s Giving Voice to Values presents an approach to ethics training based on the idea that most people would like to provide input in times of ethical conflict using their own values. She maintains that people recognize the lapses in organizational ethical judgment and behavior, but they do not have the courage to step up and voice their values to prevent the misconduct. Gentile has developed a successful initiative and following based on encouraging students and employees to learn how (...) to engage in communication or action to express their values within an organization’s formal and informal value system. The purpose of this analysis is to examine the Giving Voice to Values approach to empowering the individual to take action to deal with lapses in organizational ethics. We examine the role of Giving Voice to Values in business ethics education, considerations for implementing GVV, and recommendations for business educators and corporate ethics officers. We conclude that while GVV is an effective tool, it is not a comprehensive or holistic approach to ethics education and organizational ethics programs. (shrink)

The development of a professional code of ethics should provide an explanation of the professional values and principals that guide a body of persons engaged in an important role in society. Most professions find ethical standards of conduct are necessary to codify acceptable behavior to develop public trust, reliability, and consistency in their performance. The proposed AMS Code of Ethics for Marketing Educators is the first step in developing communication, debate, and hopefully, agreement about the social responsibility of the marekting (...) discipline. It is important to note that the AMS code was not developed to punish wrongdoers but to provide a positive guide to help marketing educators understand how their actions may be viewed by society. Physicists are increasingly beginning to take seriously the possibility of laws outside the traditional time-evolution paradigm; yet many popular definitions of determinism are still predicated on a time-evolution picture, making them manifestly unsuited to the diverse range of research programmes in modern physics. In this article, we use a constraint-based framework to set out a generalization of determinism which does not presuppose temporal evolution, distinguishing between strong, weak and delocalised holistic determinism. We discuss some interesting consequences of these generalized notions (...) of determinism, and we show that this approach sheds new light on the long-standing debate surrounding the nature of objective chance. There is a long tradition, in the history and philosophy of science, of studying Kant’s philosophy of mathematics, but recently philosophers have begun to examine the way in which Kant’s reflections on mathematics play a role in his philosophy more generally, and in its development. For example, in the Critique of Pure Reason , Kant outlines the method of philosophy in general by contrasting it with the method of mathematics; in the Critique of Practical Reason , Kant compares the Formula (...) of Universal Law, central to his theory of moral judgement, to a mathematical postulate; in the Critique of Judgement , where he considers aesthetic judgment, Kant distinguishes the mathematical sublime from the dynamical sublime. This last point rests on the distinction that shapes the Transcendental Analytic of Concepts at the heart of Kant’s Critical philosophy, that between the mathematical and the dynamical categories. These examples make it clear that Kant's transcendental philosophy is strongly influenced by the importance and special status of mathematics. The contributions to this book explore this theme of the centrality of mathematics to Kant’s philosophy as a whole. This article explores the idea that there is a spectrum of individuals who feel compelled to dwell in the past, either due to psychological or social conditions. I analyze both conditions respectively by critically examining two cases: post-traumatic stress disorder and racialized oppression. I propose that individuals with PTSD can feel psychologically compelled to dwell in the past in a dually negative sense: the individual lives in the past but also broods on it, causing them to feel “stuck” in the (...) past. This kind of “dwelling” can cause individuals to suffer disruptions to their sense of self and intersubjectivity. After exploring the psychological case of dwelling in the past, I explore the social sense in which individuals can dwell in the past due to oppressive social structures by examining the case of racialized oppression. The case of racialization is philosophically stimulating because of its intersubjective dimensions—it subverts the idea that dwelling in the past is simply a psychological phenomenon by capturing that others can help or hinder us with maintaining a sense of self and future-directed intentionality. By putting the phenomenological work of Al-Saji into conversation with recent phenomenological research on incarceration, I propose that racialization can be similarly disruptive to one’s sense of self and intersubjectivity. The proposed account is suggestive that traumatic and oppressive experiences may amplify and compound each other in ways not yet well elucidated in the literature. If this account is taken to be persuasive, it is indicative that both psychological and social conditions mediate one’s temporality and well-being. (shrink)

Our in-the-moment experience of the world can feel vivid and rich, even when we cannot describe our experience due to limitations of attention, memory or other cognitive processes. But the nature of visual awareness is quite sparse, as suggested by the phenomena of failures of awareness, such as change blindness and inattentional blindness. I will argue that once failures of memory or failures of comparison are ruled out as explanations for these phenomena, they present strong evidence against rich awareness. To (...) accommodate and explain these massive failures of awareness, any theory of phenomenal consciousness must downgrade phenomenology to a degree where it is functionless or, ironically, does not reflect what we experience. Perhaps the most striking phenomenon of visual awareness is inattentional blindness (IB), in which a surprisingly salient event right in front of you may go completely unseen when unattended. Does IB reflect a failure of perception, or only of subsequent memory? Previous work has been unable to answer this question, due to a seemingly intractable dilemma: ruling out memory requires immediate perceptual reports, but soliciting such reports fuels an expectation that eliminates IB. Here we introduce a way of evoking repeated (...) IB in the same subjects and the same session: we show that observers fail to report seeing salient events’ not only when they have no expectation, but also when they have the wrong expectations about the events nature. This occurs when observers must immediately report seeing anything unexpected, even mid-event. Repeated IB thus demonstrates that IB is aptly named: it reflects a genuine deficit in moment-by-moment conscious perception, rather than a form of inattentional amnesia. (shrink)

This paper offers a case study based on qualitative research in the burley tobacco region of central Kentucky, where farmers are urged to diversify away from tobacco production. “Replacing” tobacco is difficult for economic and material reasons, but also because raising tobacco is commensurate with a locally valued way of doing masculinity. The focus is on these two questions: How can the doing of work associated with tobacco production and marketing be understood as also doing a particular masculinity? What does (...) an understanding of farm work as a simultaneous doing of gender illuminate about the challenges of diversification away from tobacco? Asking tobacco farmers to “grow something else” is also asking them to do gender differently, suggesting that the transition away from tobacco must be understood as a gendered transition. This research, focused primarily on male farmers who continue to raise tobacco, suggests the need for gendered research with women and men who have moved away from tobacco to other crops. (shrink)

This study considers the relationship between perceptions of ethical behavior and the demographic characteristics of sex, age, education level, job title, and job tenure among a sample of marketing researchers. The findings of this study indicate that female marketing researchers, older marketing researchers, and marketing researchers holding their present job for ten years or more generally rate their behavior as more ethical.

This case raises ethical issues involving conflicts of interest arising from industrial funding of academic research; ethical responsibilities of laboratories to funding agencies; ethical responsibilities in the management of a research lab; ethical considerations in appropriate research design; communication in a research group; communication between advisor and graduate student; responsibilities of researchers for the environment; misrepresentation or withholding of scientific results.

In this article we set out to understand the significance of the process matrix formalism and the quantum causal modelling programme for ongoing disputes about the role of causation in fundamental physics. We argue that the process matrix programme has correctly identified a notion of ‘causal order’ which plays an important role in fundamental physics, but this notion is weaker than the common-sense conception of causation because it does not involve asymmetry. We argue that causal order plays an important role (...) in grounding more familiar causal phenomena. Then we apply these conclusions to the causal modelling programme within quantum foundations, arguing that since no-signalling quantum correlations cannot exhibit causal order, they should not be analysed using classical causal models. This resolves an open question about how to interpret fine-tuning in classical causal models of no-signalling correlations. Finally we observe that a quantum generalization of causal modelling can play a similar functional role to standard causal reasoning, but we emphasize that this functional characterisation does not entail that quantum causal models offer novel explanations of quantum processes. In recent years the quantum foundations community has seen increasing interest in the possibility of using retrocausality as a route to rejecting the conclusions of Bell’s theorem and restoring locality to quantum physics. On the other hand, it has also been argued that accepting nonlocality leads to a form of retrocausality. In this article we seek to elucidate the relationship between retrocausality and locality. We begin by providing a brief schema of the various ways in which violations of Bell’s inequalities (...) might lead us to consider some form of retrocausality. We then consider some possible motivations for using retrocausality to rescue locality, arguing that none of these motivations is sufficient to show that local retrocausal theories should always be preferred to nonlocal retrocausal theories, and therefore there is no clear reason to focus research efforts entirely on seeking local retrocausal models. Next, we examine several different conceptions of retrocausality, concluding that ‘all-at-once’ retrocausality is more coherent than the alternative dynamical picture. We then argue that since the ‘all-at-once’ approach requires probabilities to be assigned to entire histories, locality is not playing any crucial role within this picture. Thus we conclude that using retrocausality as a way to rescue locality may not be the right route to retrocausality. Finally, we demonstrate that accepting the existence of nonlocality and insisting on the nonexistence of preferred reference frames leads naturally to the acceptance of a form of retrocausality, albeit one which is not mediated by physical systems travelling backwards in time. We argue that this is the more natural way to motivate retrocausal models of quantum mechanics. (shrink)

One of the most pressing dilemmas of the moment concerns pluralism and the issue of justification: how does one defend a commitment to any particular position? The fear is that pluralism undercuts our ability to justify our moral and political views, and thereby leads to relativism. As I argue here, Isaiah Berlin provides an exemplary argument concerning the ties between pluralism and liberalism. Although Berlin admits there is no logical link between pluralism and liberalism, he nevertheless highlights plausible ties between (...) pluralism and the fields of philosophy, history and politics, all of which provide good reasons for him to endorse liberalism. Moreover, these arguments indicate how pluralism differs from relativism, so that pluralists such as Berlin are not guilty of the charge of moral subjectivism. A reconsideration of Berlin's position thus provides insight into the problem of justification in a pluralist condition, one that illuminates certain features of pluralism, as well as exemplifies its compatibility with liberalism. In The Sublime in Modern Philosophy: Aesthetics, Ethics, and Nature, Emily Brady takes a fresh look at the sublime and shows why it endures as a meaningful concept in contemporary philosophy. In a reassessment of historical approaches, the first part of the book identifies the scope and value of the sublime in eighteenth-century philosophy, nineteenth-century philosophy and Romanticism, and early wilderness aesthetics. The second part examines the sublime's contemporary significance through its relationship to the arts; its position with respect (...) to other aesthetic categories involving mixed or negative emotions, such as tragedy; and its place in environmental aesthetics and ethics. Far from being an outmoded concept, Brady argues that the sublime is a distinctive aesthetic category which reveals an important, if sometimes challenging, aesthetic-moral relationship with the natural world. BackgroundWhen conducting research with Indigenous populations consent should be sought from both individual participants and the local community. We aimed to search and summarise the literature about methods for seeking consent for research with Indigenous populations.MethodsA systematic literature search was conducted for articles that describe or evaluate the process of seeking informed consent for research with Indigenous participants. Guidelines for ethical research and for seeking consent with Indigenous people are also included in our review.ResultsOf 1447 articles found 1391 were excluded (...) ; 56 were relevant and included. Articles were categorised into original research that evaluated the consent process or publications detailing the process of seeking consent and guidelines for ethical research. Guidelines were categorised into international ; national and state/regional/local guidelines. In five studies based in Australia, Canada and The United States of America the consent process with Indigenous people was objectively evaluated. In 13 other studies interpreters, voice recording, videos, pictures, flipcharts and “plain language” forms were used to assist in seeking consent but these processes were not evaluated. Some Indigenous organisations provide examples of community-designed resources for seeking consent and describe methods of community engagement, but none are evaluated. International, national and local ethical guidelines stress the importance of upholding Indigenous values but fail to specify methods for engaging communities or obtaining individual consent. In the ‘Grey literature’ concerns about the consent process are identified but no solutions are offered.ConclusionConsultation with Indigenous communities is needed to determine how consent should be sought from the community and the individual, and how to evaluate this process.
