I discuss one version of a puzzle about the identity of a statue with the lump of clay of which it is made. The case is one in which the statue and lump agree in all their non-modal features. While this is a favorable case for the claim that they are identical, we nonetheless have discrepant intuitions about their potentialities, which appear irreconcilable. Critical analyses are given of recent treatments by Allan Gibbard, Kit Fine, and Stephen Yablo. An ontologically conservative (...) solution to the puzzle is offered which has the following features: the statue and lump of clay are said to be identical, our discrepant modal intuitions about the statue and lump are validated, identity is necessary, and is a relation between objects, not concepts, Leibniz' Law is not constrained, only a standard modal logic and semantics is needed, and our modal logical intuitions are preserved. In part, this last consists in proving that standard modal logics have certain structural features. In addition, the proposed account allows that names have the same function in and out of modal contexts, namely just to refer. As well, it allows genuine de re modality, i.e. that things have genuine modal properties. How the account meets general concerns about de re modality and essentialism is discussed. The proposed method of solution is also shown to apply to a number of other modal puzzles. (shrink)

There is increasing interest in determining what impact having women in management positions may have on corporate social responsibility initiatives. Various authors suggest that gender equality practices should be factored into the broader framework of CSR. This paper examines how the presence of women on corporate boards, in top and middle management and as heads of CSR departments, influences gender equality practices in the field of CSR. Using information collected from companies that have signed up to Women's Empowerment Principles in (...) Spain, we show that the presence of women in the aforesaid posts has a positive impact on CSR activities with gender equality objectives. We thus supplement the justice, business and moral arguments with further arguments in support of the incorporation of women into not only corporate boards but all management positions. Finally, we provide a view of how gender equality can be included in the broader framework of CSR. (shrink)

One would therefore think that Aquinas’s Exposition of the Divine Names (his only commentary on the works of Pseudo-Dionysius) would have been translated a lot sooner. This delay is assuredly due not just to the difficulty of translating this work but also to a certain embarrassment felt by Thomists over Aquinas’s sincere belief that the “Dionysius” who wrote the Divine Names was the Areopagite whose conversion at the teaching of St. Paul is mentioned in the Acts of the Apostles. That the author calling himself “Dionysius” was in fact a theologian writing in the fifth or sixth centuries has been well established by modern scholarship. Hence, Thomists may have felt tempted to discount or at least pass over the influence of this author on Aquinas since it is discomfiting to think that the Church’s greatest theologian accorded such authority to an imposter.Michael Augros tackles these concerns head-on in the excellent introduction to his new translation of the Divine Names commentary. First, Augros points out that in past centuries a pseudonym was usually not an act of forgery but, rather, a way of concealing the author’s identity, which an early Christian theologian might well decide to do either out of humility or out of a desire “to avoid provoking certain prejudices” in those who disagreed with him in contemporary theological disputes. Moreover, it is likely that the work was never intended for the general public (who could easily mistake the pseudonym as genuine) but, rather, was written for those “already initiated in a particular Neoplatonic school of Christian theology,” who would recognize the author as being “one of their own” but without knowing his precise identity. Finally, in taking the particular name of “Dionysius,” the author of the Divine Names was indicating his intention for the work: Just as the biblical Dionysius was a Greek philosopher who converted to Christianity, so the works of Pseudo-Dionysius [End Page 345] are an attempt to reconcile Greek philosophy with the Christian faith.It therefore seems likely, as Augros observes, that Aquinas would still have accorded a great deal of respect to the Divine Names even if he had learned the truth of the author’s identity. The work would not have had the same deuterocanonical authority for him that comes with being written by a direct disciple of St. Paul himself, but “the inherent cogency, coherence, and beauty” of Pseudo-Dionysius’s theology would have been the same. Hence, Pseudo-Dionysius would surely have earned from Aquinas the “docile attitude” appropriate “for a philosopher and theologian of the first order, such as Boethius.”That Aquinas was right to see the author of the Divine Names as a master philosopher and theologian becomes evident when one dives into the text itself, in which Aquinas sees a truly dazzling order, both externally and internally. Strengthening the abilities of smallholder farmers in developing countries, particularly women farmers, to produce for both home and the market is currently a development priority. In many contexts, ownership of assets is strongly gendered, reflecting existing gender norms and limiting women’s ability to invest in more profitable livelihood strategies such as market-oriented agriculture. Yet the intersection between women’s asset endowments and their ability to participate in and benefit from agricultural interventions receives minimal attention. This paper explores changes in gender relations (...) and women’s assets in four agricultural interventions that promoted high value agriculture with different degrees of market-orientation. Findings suggest that these dairy and horticulture projects can successfully involve women and increase production, income and the stock of household assets. In some cases, women were able to increase their control over production, income and assets; however in most cases men’s incomes increased more than women’s and the gender-asset gap did not decrease. Gender- and asset-based barriers to participation in projects as well as gender norms that limit women’s ability to accumulate and retain control over assets both contributed to the results. Comparing experiences across the four projects, especially where projects implemented adaptive measures to encourage gender-equitable outcomes, provides lessons for gender-responsive projects targeting existing and emerging value chains for high value products. Other targeted support to women farmers may also be needed to promote their acquisition of the physical assets required to expand production or enter other nodes of the value chain. (shrink)

The biological world is full of phenomena that seem to run counter to Darwin's insight that natural selection can lead to the appearance of design. For instance, why do organisms in some species divide reproductive labor? The existence of non-reproducing organisms in such 'eusocial' species looks to be at odds with an evolutionary theory which posits traits exist because they help organisms survive and reproduce. What is the evolutionary advantage of an insect being distasteful to its predators? The distastefulness appears (...) designed to deter predators, but can only affect the predator's actions when the insect is eaten; it is hard to see how such a trait could be passed on. This Element will cover the shared foundations of evolutionary explanations for these and other seemingly puzzling phenomena, focusing on the concepts of inclusive fitness and kin selection. This article examines the attempted reform of education within an emerging audit culture in Australia that has led to the implementation of a high-stakes testing regime known as NAPLAN. NAPLAN represents a machine of auditing, which creates and accounts for data that are used to measure, amongst other things, good teaching. In particular, we address the logics of a policy intervention that aims to improve the quality of education through returning ‘good teaching’. Using Deleuze’s concepts of series, events, copies and (...) simulacra, we suggest that an attempt to return past commonsense logics of ‘good teaching’ as a result of NAPLAN is not possible. In an audit culture as exemplified by NAPLAN, ‘good teaching’ is being reconceptualized through those practices and becomes unrecognizable. Whilst policy claims to improved equity and quality are admirable, this article suggests that the simulacral change to logics of good teaching may actualize something very different. (shrink)

This paper attempts to show how certain approaches in Values Based Practice duplicate key moves in liberal political theory.

In the near future developments in non-invasive prenatal testing may soon provide couples with the opportunity to test for and diagnose a much broader range of heritable and congenital conditions than has previously been possible. Inevitably, this has prompted much ethical debate on the possible implications of NIPT for providing couples with opportunities for reproductive choice by way of routine prenatal screening. In view of the possibility to test for a significantly broader range of genetic conditions with NIPT, the European (...) Society of Human Genetics and American Society of Human Genetics recommend that, pending further debate, prenatal screening for reproductive choice should only be offered where concerning serious congenital conditions and childhood disorders. In support of this recommendation, the ESHG and ASHG discuss a number of ethical issues on which they prompt further debate: the informational privacy of the future child, the trivialization of abortion, the risk of information overload, and issues of distributive justice. This paper responds to this call with further reflection on each ethical issue and how it relates to the moral justification of providing couples with opportunities for meaningful reproductive choice. The paper concludes that whilst there may be good reasons for qualifying the scope of any unsolicited prenatal screening offer to serious congenital conditions and childhood disorders, if prenatal screening is justified for providing couples with opportunities for meaningful reproductive choice, then health services may have obligations to empower couples with the same opportunity where concerning other conditions. Developments in Non-Invasive Prenatal Testing (NIPT) and cell-free fetal DNA analysis raise the possibility that antenatal services may soon be able to support couples in non-invasively testing for, and diagnosing, an unprecedented range of genetic disorders and traits coded within their unborn child’s genome. Inevitably, this has prompted debate within the bioethics literature about what screening options should be offered to couples for the purpose of reproductive choice. In relation to this problem, the European Society of Human Genetics (ESHG) and (...) American Society of Human Genetics (ASHG) tentatively recommend that any expansion of this type of screening, as facilitated by NIPT, should be limited to serious congenital and childhood disorders. In support of this recommendation, the ESHG and ASHG cite considerations of distribution justice. Notably, however, an account of justice in the organization and provision of this type of screening which might substantiate this recommendation has yet to be developed. This paper attempts to redress this oversight through an investigation of Norman Daniels’ theory of Just health: meeting health needs fairly. In line with this aim, the paper examines what special moral importance (for Just health) screening for the purpose of reproductive choice might have where concerning serious congenital and childhood disorders in particular. The paper concludes that screening for reproductive choice where concerning serious congenital and childhood disorders may be important for providing women with fair opportunity to protect their health (by either having or not having an affected child). In early 2017, Nevada amended its Uniform Determination of Death Act, in order to clarify the neurologic criteria for the determination of death. The amendments stipulate that a determination of death is a clinical decision that does not require familial consent and that the appropriate standard for determining neurologic death is the American Academy of Neurology’s guidelines. Once a physician makes such a determination of death, the Nevada amendments require the withdrawal of life-sustaining treatment within twenty-four hours with limited exceptions. (...) Neurologists have generally supported Nevada’s amendments for clarifying the diagnostic standard and limiting the ability of family members to challenge it. However, it is more appropriate to view the Nevada amendments with concern. Even though the primary purpose of the UDDA is to ensure that all functions of a person’s entire brain have ceased, the AAN guidelines do not accurately assess this. In addition, by characterizing the determination of death as solely a clinical decision, the Nevada legislature has improperly ignored the doctrine of informed consent, as well as the beliefs of particular faiths and cultures that reject brain death. Rather than resolving controversies regarding brain death determinations, the Nevada amendments may instead instigate numerous constitutional challenges. (shrink)

Technological progress may eventually produce sophisticated robots with human-like traits that result in humans forming meaningful relationships with them. Such relationships would likely lead to a demand for human–artificial intelligence matrimony. U.S. Supreme Court decisions that expanded the definition of marriage to include interracial and same-sex couples, as well as those that have not extended marriage to polygamous relationships, provide guidance regarding the criteria that human–AI would have to meet to successfully assert a right to marry. Ultimately, robots will have (...) to possess certain characteristics of personhood to marry, including the capacity to contract and to engage in an intimate relationship. Alternatively, if AIs can simulate these abilities sufficiently, we may believe that they have these capacities. Even if AIs genuinely possess the capabilities necessary to enter into a marriage, it is social acceptance of intelligent non-humans as life partners that will likely influence legal development is this realm rather than personhood criteria. However, AIs are likely to face bias due to their “artificial” rather than biological nature. Yet, Peter Singer’s influential argument regarding speciesism in the context of animal rights implies that AIs with specific human-like qualities cannot be justifiably denied certain rights. In barely the space of one generation, Athens was transformed from a conventional city-state into something completely new--a region-state on a scale previously unthinkable. This book sets out to answer a seemingly simple question: How and when did the Athenian state attain the anomalous size that gave it such influence in Greek politics and culture in the classical period? Many scholars argue that Athens's incorporation of Attica was a gradual development, largely completed some two hundred years before the classical era. (...) Anderson, however, suggests that it is not until the late sixth century that we see the first systematic attempts by the Athenian polis to integrate all of Attica. Anderson first takes issue with the prevailing view of Cleisthenes' landmark political reforms of 508-7 b.c., arguing that they were animated by a more comprehensive vision of regional political community in Attica. The Athenians' strengthened the state by establishing institutional mechanisms that would allow inhabitants of the Attic periphery to participate as never before in the life of the center. The creation of a suitable physical setting for the new order was accompanied by religious, military, and symbolic innovations. Regional participation in Athenian affairs was stimulated by encouraging the Attic populace to imagine themselves, for the first time ever, as members of a single, like-minded, self-governing political community. Something has been going wrong on many college campuses in the last few years. Speakers are shouted down. Students and professors say they are walking on eggshells and are afraid to speak honestly. Rates of anxiety, depression, and suicide are rising--on campus as well as nationally. How did this happen? First Amendment expert Greg Lukianoff and social psychologist Jonathan Haidt show how the new problems on campus have their origins in three terrible ideas that have become increasingly woven into (...) American childhood and education: What doesn't kill you makes you weaker; always trust your feelings; and life is a battle between good people and evil people. These three Great Untruths contradict basic psychological principles about well-being and ancient wisdom from many cultures. Embracing these untruths--and the resulting culture of safetyism--interferes with young people's social, emotional, and intellectual development. It makes it harder for them to become autonomous adults who are able to navigate the bumpy road of life. Lukianoff and Haidt investigate the many social trends that have intersected to promote the spread of these untruths. They explore changes in childhood such as the rise of fearful parenting, the decline of unsupervised, child-directed play, and the new world of social media that has engulfed teenagers in the last decade. They examine changes on campus, including the corporatization of universities and the emergence of new ideas about identity and justice. They situate the conflicts on campus within the context of America's rapidly rising political polarization and dysfunction. This is a book for anyone who is confused by what is happening on college campuses today, or has children, or is concerned about the growing inability of Americans to live, work, and cooperate across party lines. When we read On the Origin of Species, we cannot help but hear echoes of the Wealth of Nations. Darwin’s “economy of nature” features a “division of labour” that leads to complexity and productivity. We should not, however, analyze Darwin’s ethics through this lens. Darwin did not draw his economic ideas from Smith, nor did he base his ethics on an economic foundation. Darwin’s ethics rest on Smith’s notion—from the Theory of Moral Sentiments—of an innate human faculty of sympathy. Darwin (...) gave this notion an evolutionary interpretation, concluding that any species of social animals that develops a high enough level of intelligence will evolve moral principles. But the specific moral principles evolved by any particular species will vary, depending on that species’ particular evolutionary history. Darwin’s theory of moral sentiments thus diverged profoundly from Smith’s, while remaining in the same intellectual lineage. Although my reading of Darwin’s ethics departs from the dominant trend, it is not without precedent. A century ago, William James propounded a similar interpretation of Darwin. James’s interpretation has been largely forgotten, but he had Darwin right. It seems that James then developed his own moral philosophy on what he saw as a Darwinian foundation. It may be that James read Darwin’s evolutionary ethics through a pragmatic lens and so refashioned it, in his turn, into something again profoundly different from what Darwin had conceived, but again remaining in the same intellectual lineage. Loïc Wacquant argues for a radicalization of the habitus concept provided by Pierre Bourdieu, suggesting that habitus is a site and mode for conducting research, not simply an explanatory or theoretical mechanism. Taking seriously this call to examine skills and communities of practice through apprenticeship, however, requires that the theoretical account of habitus be subject to empirical testing. Moreover, enquiry into communities of practice, especially the subtle psychological, behavioural and even neurological consequences of skill acquisition, means that claims about the (...) habitus can be scrutinized by fields such as psychology, neurology and even human biology. Habitus as a truly open path of inquiry will demand, not wholly novel concepts, but a recognition of when claims about practice are simultaneously testable, and falsifiable, by other forms of empirical enquiry, including the human sciences. Although we are still in the dark when it comes to giving necessary and jointly sufficient criteria for what it takes to be thinking a singular thought, the paradigm cases are just ones where an agent is thinking about some particular object. When we erroneously think that Vulcan is a planet, our thought appears to be singular since it is, after all, about Vulcan. A promising way to explain this is to claim that there is something, a merely hypothetical entity, (...) that is Vulcan. There have been notable supporters for positing hypothetical entities for some time now, but the account of how we create hypothetical entities is still underdeveloped. In fact, we face a puzzle if we assume: hypothetical entities are created by us; we create a given hypothetical entity only when we falsely hypothesize something to be the unique F; we create the hypothetical entity long before we learn that there is no unique F. How can we possibly manage to conditionally and unknowingly create some entity when there is no unique F? In showing how this is possible, it will become clear that we have good reason for preferring a view that posits hypothetical entities over the alternative ways of accounting for our apparently singular thoughts about Vulcan, Pegasus, the Fountain of Youth, and so on. The woman was appreciative and gracious, the pilot scarcely offered thanks, and I began my vacation exhausted.Having been trained as a paediatrician, I have responded to nearly two dozen “Good Samaritan” scenarios, where a person was injured or became critically sick in a public setting. Perhaps I have had more than my fair share, but I wonder if this is an important and mounting phenomenon.
