Este artículo busca establecer un diálogo con la literatura internacional sobre justicia transicional y ofrecer un marco teórico crítico que permita analizar la experiencia reciente en Colombia. Para tal efecto, en la primera parte del artículo sostengo que la idea de justicia transicional es una construcción discursiva relativamente reciente en el escenario político y académico internacional, pero que, a su vez, ha experimentado diferentes momentos y transformaciones. En la segunda parte, el artículo ofrece un marco teórico que permita reflexionar sobre (...) la construcción de sentidos democráticos sobre la justicia transicional y los derechos de las víctimas en un escenario complejo como el colombiano. En tal sentido, con base en la perspectiva de campos sociales expuesta por Pierre Bourdieu, sostengo que la justicia transicional es un espacio de confrontación y lucha entre sujetos sociales que cuentan con distintos acumulados de poder. Así mismo, me baso en perspectivas críticas en materia de derechos humanos y justicia transicional para resaltar la relevancia de sujetos sociales, como los movimientos sociales y las redes de derechos humanos, en la construcción de una justicia transicional “desde abajo”. The closure of schools as a result of COVID-19 has been a critical global incident from which to rethink how education works in all our countries. Among the many changes generated by this crisis, all teaching became mediated by digital technologies. This paper intends to analyze the activities carried out during this time through digital technologies and the conceptions of teaching and learning that they reflect. We designed a Likert-type online questionnaire to measure the frequency of teaching activities. It was (...) answered by 1,403 teachers from Spain. The proposed activities varied depending on the learning promoted, the learning outcomes, the type of assessment to which the activities were directed, and the presence of cooperative activities. The major result of this study was that teachers used reproductive activities more frequently than constructive ones. We also found that most activities were those favoring verbal and attitudinal learning. The cooperative activities were the least frequent. Finally, through a cluster analysis, we identified four teaching profiles depending on the frequency and type of digital technologies use: Passive, Active, Reproductive, and Interpretative. The variable that produced the most consistent differences was previous digital technologies use These results show that Information and Communication Technologies uses are reproductive rather than constructive, which impedes effective digital technologies integration into the curriculum so that students gain 21st-century competencies. There is no consensus in the literature about the nature of terrorism. The authors’ main claim is that this is ultimately the result of the coexistence of two senses of the term, the action and the actor sense, which are not fully congruent. Rather than trying to advocate a specific conceptualization, the authors provide in this article a map of the different ways in which scholars talk about terrorism. They identify first the set of terrorist actions and the set of (...) terrorist actors. Terrorist tactics are a variety of the power to hurt, based on the lack of military power. Terrorist groups are underground ones with no territorial control. When the two criteria meet, the core of terrorism exists: coercive violence perpetrated by underground groups. The ambiguity that surrounds terrorism is caused by two other possibilities: actors with some measure of territorial control adopting coercive tactics and underground actors adopting military tactics. Although it is not possible to remove this ambiguity in empirical research, scholars can at least identify it and analyze it. The authors illustrate the two senses of terrorism and their interaction by using the most comprehensive dataset on terrorist incidents, the Global Terrorism Database. (shrink)

This article analyzes the problem of preference imputation in rational choice political science. I argue against the well-established practice in political science of assuming selfish preferences for purely methodological reasons, regardless of its empirical plausibility (this I call a preference for selfish preferences). Real motivations are overlooked due to difficulties of imputing preferences to agents in a non-arbitrary way in the political realm. I compare the problem of preference imputation in economic and political markets, and I show the harmful consequences (...) of the preference for selfish preferences in the field of collective action. La solución de los problemas biojurídicos depende fundamentalmente de la concepción del derecho y de la valoración de la vida humana de la que se disponga. La supresión de la perspectiva de la justicia, unida a la consideración de la vida humana como mera propiedad inmanente de un ser vivo que, en el caso del hombre, permitirá la libre disposición de ella, conducirá necesariamente a una degradación de la protección jurídica de la vida. Por el contrario, la vinculación del derecho (...) con la moral, a través de la justicia, propia de la concepción óntico-valorativa o, al menos, de una concepción del derecho que aúne las tres dimensiones, conducirá a una más firme defensa jurídica de la vida. Desde esta perspectiva se analiza la desprotección jurídica, y por tanto moral, de la vida en la regulación del aborto en la legislación española. (shrink)

No obstante, sin abandonar esa predilección por un “cine de directores”, a lo largo de su trayectoria la revista británica intentará desarrollar un riguroso método de análisis formal a través de detallados close readings de los films. Algunos de sus integrantes buscan aplicar al cine los planteos de F. R. Leavis y la revista Scrutiny (...) a propósito de la crítica literaria. Es esta modulación analítica la que será puesta en cuestión con el auge del estructuralismo y el posestructurailsmo a los que se asocia la revista Screen en los años 70.: During the sixties, the journal Movie inherits from Cahiers du cinéma the preferencies for a politique des auteurs and for certain american films. However, never abandoning this tendency towards a “cinema of directors”, the british journal develops a rigorous method of formal analysis and detailed close readings. Some of its members try to apply to cinema the concepts elaborated by F. R. Leavis and the journal Scrutiny in reference to literary criticism. The hypothesis that terrorism often emerges when mass collective action declines and radicals take up arms to compensate for the weakness of a mass movement has been around for some time; however, it has never been tested systematically. In this article the authors investigate the relationship between terrorist violence and mass protest in the context of the Spanish transition to democracy. This period is known for its pacts and negotiations between political elites, but in fact, it was accompanied by high (...) levels of terrorist violence and popular mobilization. To test the hypothesis, the authors have created two data sets, one on victims of terrorism and another on participation in demonstrations. The data clearly confirm that terrorism erupted in Spain when participation in demonstrations started to decline. This result sheds new light on the nonstructural conditions associated with the onset of terrorist violence. (shrink)

Sport is an emotional experience. Studies have shown that high emotional intelligence (EI) is associated with better sports performance, though different aspects of sports experience and their relationship with EI are still unclear. This study examined the possible relationships between sports experience and EI dimensions of undergraduate athletes. Likewise, according to the differences described in the literature between men and women, the secondary aim was to identify the possible relationship between EI and sports experience in both subgroups. A total of (...) 1784 [712 men (39.9%), 1072 women (60.1%); mean age = 21.3 years, SD = 4.2)] undergraduate athletes completed the Trait Meta Mood Scale and a sports experience questionnaire. Comparisons between groups were performed using Mann–Whitney-Uand H-Kruskal–Wallis tests and correlations between variables were analyzed using Spearman correlation. We found that the number of different sports practiced and the number of years practicing sports were positively associated with emotional repair (ER). However, the number of years practicing sports was negatively associated with emotional attention (EA). Male athletes who trained more and had a higher competitive level were more likely to show higher ER. In any case, it is necessary to take into account that all the associations were weak. Our study suggested that athletes tend to attend to and value their feelings and use positive thinking to repair their negative moods. (shrink)

The acquisition and evolution of speech production, discourse and communication can be negatively impacted by brain malformations. We describe, for the first time, a case of developmental dynamic dysphasia (DDD) in a right-handed adolescent boy (subject D) with cortical malformations involving language-eloquent regions (inferior frontal gyrus) in both the left and the right hemispheres. Language evaluation revealed a markedly reduced verbal output affecting phonemic and semantic fluency, phrase and sentence generation and verbal communication in everyday life. Auditory comprehension, repetition, naming, (...) reading and spelling were relatively preserved, but executive function was impaired. Multimodal neuroimaging showed a malformed cerebral cortex with atypical configuration and placement of white matter tracts bilaterally and abnormal callosal fibers. Dichotic listening showed right hemisphere dominance for language and functional magnetic resonance imaging (fMRI) additionally revealed dissociated hemispheric language representation with right frontal activation for phonology and bilateral dominance for semantic processing. Moreover, subject D also had congenital mirror movements (CMM), defined as involuntary movements of one side of the body that mirror intentional movements of the other side. Transcranial magnetic stimulation and fMRI during voluntary unimanual (left and right) hand movements showed bilateral motor cortex recruitment and tractography revealed a lack of decussation of bilateral corticospinal tracts. Genetic testing aimed to detect mutations that disrupt the development of commissural tracts correlating with CMM (e.g., Germline DCC mutations) was negative. Overall, our findings suggest that DDD in subject D resulted from the underdevelopment of the left inferior frontal gyrus with limited capacity for plastic reorganization by its homologous counterpart in the right hemisphere. Corpus callosum anomalies probably contributed to hinder interhemispheric connectivity necessary to compensate language and communication deficits after left frontal involvement. (shrink)

This study analyzes the interests of Spanish audiences in travel magazines within the current context of press consumption. The objectives are to identify the readers' reading frequency and reasons for reading, what contents interest them, and what aspects of the photographs attract them. The methodology involves a structured questionnaire completed by a representative sample of the Spanish population (n=1000). The main results reveal a low reading frequency, great interest in practical information, preference for landscape photography (over the age of 54) (...) and nightlife photography (young people), and indifference regarding the journalistic source of the images. These data provide relevant information on which to adapt travel magazines' content strategy. (shrink)

The deep influence of affectivity on learning is now widely acknowledged (Keefer et al., 2018; Sánchez-Álvarez et al., 2021). For instance, it has been shown that affect influences key learning-relevant processes, such as motivation, perception, behavior, and critical thinking (Izard, 2002; Mayer & Salovey, 1997). Evidence also shows that emotion and mood strongly influence attention, which in turn drives learning and memory (Elbertson et al., 2010; Elias et al., 1997). Intersubjective phenomena, such as the degree of affection and respect (...) between child and teacher, also affect the child’s learning processes, academic outcomes, and brain development (Kusché & Greenberg, 2006; Ryan & Patrick, 2001). However, the relevant literature is not paying attention to increasing evidence showing that affective phenomena are rooted in interoceptive and homeostatic self- and co-regulatory processes within and between people’s living bodies (Barrett, 2017; Carvalho & Damasio, 2021; Craig, 2015, 2018; Fotopoulou et al., 2022; Fotopoulou & Tsakiris, 2017; Seth & Friston, 2016). In this theoretical chapter, we explore this connection and its importance for learning. We argue that affective experience plays a fundamental role in learning, and that affective experience is rooted in the homeostatic self-/co-regulation of living bodies. Therefore, the homeostatic self-/co-regulation of living bodies plays a fundamental role in learning. In other words, there is an intra- and interpersonal somatic dimension of learning that demands explicit consideration in educational contexts. In this way, we aim to contribute to an understanding of learning and education that moves away from an individualistic, brain-centered information-processing conception toward one centered on sentient, interdependent living bodies. En el artículo se pasa revista a su intervención como traductor y a los argumentos que utilizó para criticar la doctrina de los libros plúmbeos. (...) El P. The present paper tries to answer the question _Is religious education compatible with the purposes of liberal education?_ This work argues that it is possible, and desirable, that democratic states built on liberal ideals include religious education in all schools since increasing the number of options among which the future citizen may choose the conception of the good with which he or she wishes to live is a condition for autonomy as one of its educational purposes. However, the proposal is (...) not based on religious confessional education, which by itself does not satisfy the liberal educational goals, but is redefined from the common noahide principles compatible both religious confessions and non-religious views of morality and citizenship. Background Ethical conflicts generate difficulties in daily clinical activity. Which methods of ethical advice are most frequently used to resolve them among Spanish doctors has not been studied. The objective of this study is to describe what methods hospital internal medicine physicians in Spain use to resolve their ethical doubts and which they consider most useful. Design A cross-sectional observational study was conducted through a voluntary and anonymous survey and distributed through an ad hoc platform of the Spanish Society of (...) Internal Medicine. Measures We measured methods by which to resolve doubts, types of tools sought, frequency of consulting the Clinical Ethics Committees, and satisfaction with resolution of ethical issues. Results Of 261 internists surveyed, 86 per cent resolve their ethical doubts with assistance, the most frequently used method being consultation with colleagues (58.6 per cent), followed by using specific protocols or guides (11.8 per cent) and consultation with experts in bioethics (9.6 per cent). The most preferred tools are the creation of protocols (30.3 per cent) and the establishment of a consultant/expert in bioethics (27.8 per cent). Conclusions Internists in Spain usually seek assistance to resolve their ethical doubts. Consulting colleagues is the most frequently adopted method. The majority regard tools to resolve ethical conflicts as necessary, seeking above all protocols and consultants/experts in bioethics. (shrink)

El concepto de sociedad postsecular desarrollado por este autor en la etapa más reciente de su pensamiento ha exigido una revalorización de la religión como generadora de motivación y solidaridad sin la cual la sociedad occidental ve amenazada su existencia. Pero, ¿revalúa Habermas adecuadamente la religión hasta el punto de que podamos hablar de tal "giro"? -/- Esta tesis aborda los aspectos desarrollados en ese sentido por las obras más (...) recientes de Habermas: El pensamiento postmetafísico y También una historia de la filosofía, principalmente. Pero esta evaluación no se hace desde el lugar común de Habermas y los estudios comparativos de la religión: el cristianismo y el islam, sino desde la tradición noájida que precede y sustenta a estas tradiciones religiosas, lo cual permite a los ciudadanos religiosos y laicos comprender mejor la argumentación religiosa en la esfera pública, al tiempo que puede revelar las limitaciones de la comprensión laica (como la de Habermas) de los argumentos religiosos. Los summaria alexandrinorum (conocidos como ǧawāmiʿ al-iskandarāniyyīn en árabe) son resúmenes de obras galénicas que solo sobreviven en versiones hebreas o árabes. Tradicionalmente, estas traducciones se han atribuido a Ḥunayn ibn Isḥāq (s. IX) y se han vinculado a la enseñanza de la medicina en la Alejandría de los siglos VI y VII. En este artículo presentamos la edición de uno de estos ǧawāmiʿ al-iskandarāniyyīn, en concreto el compendio árabe del De simplicium medicamentorum facultatibus de Galeno que se conserva en (...) el manuscrito Huntington 600/2 de la Bodleian Library de Oxford. Con la publicación de este texto inédito pretendemos contribuir a comprender mejor la naturaleza y el origen de este tipo de textos, así como a facilitar su consulta y estudio por parte de otros especialistas. Añadimos una breve introducción sobre los summaria alexandrinorum y su importancia en la enseñanza y la transmisión de la medicina en la Edad Media, seguida de una serie de apuntes acerca del De simpl. med. fac. A continuación, se describe el manuscrito fuente tanto en forma como en contenido y se fijan los criterios de edición. Asimismo, se han extraído del texto los usos y las características más comunes de la farmacopea galénica. Con el fin de ofrecer una edición rigurosa, se ha cotejado el texto con la traducción completa del De simpl. med. fac. al árabe, así como con otros tratados de simples andalusíes. (shrink)

En la primera parte de este estudio desarrollamos una idea de la ciencia islámica que hace posible comprender su integración en la esfera de la metafísica. En la segunda parte, desarrollamos algunas nociones centrales de la fi losofía natural de ibn Sina que muestran de qué modo la realidad humana está unida a la concepción científi ca de la naturaleza e inserta plenamente en ella, a diferencia de lo que acontece en el paradigma científi co moderno.

We solve two problems from a work of Haskel and Pillay concerning maximal stable quotients of groups ∧-definable in NIP theories. The first result says that if G is a ∧-definable group in a distal theory, then Gst=G00 (where Gst is the smallest ∧-definable subgroup with G∕Gst stable, and G00 is the smallest ∧-definable subgroup of bounded index). In order to get it, we prove that distality is preserved under passing from T to the hyperimaginary expansion Theq. The second result (...) is an example of a group G definable in a nondistal NIP theory for which G=G00, but Gst is not an intersection of definable groups. Our example is a saturated extension of (R,+,[0,1]). Moreover, we make some observations on the question whether there is such an example which is a group of finite exponent. We also take the opportunity and give several characterizations of stability of hyperdefinable sets involving continuous logic. (shrink)

The origin of the Third Sector (TS) in Spain is rooted in the defence of social rights and demands made of the State regarding social transformation. With the development of the Welfare State, the role of the TS has progressively changed, becoming primarily a provider of services to Public Administrations (PAs), and moving away from its roots advocating and demanding social justice. This article examines the distance between the original intentions (‘ought’) and the current day-to-day actions (‘is’) of the TS (...) in the case of the region of Andalusia (Spain), focusing on a three-dimensional analysis: the objectives that mark its action, its funding model, and relations within the organisation. Using a qualitative methodology based on Thematic Content Analysis, the discourses of actors involved in the TS (managers, professionals, volunteers, users, public administration professionals, and other actors) have been analysed and linked, concluding that the gap generated between intention and deed, or ‘ought’ and ‘is’, are the result of external contextual elements, but also of decisions made within the TS. The general aim of this article is to give a critical interpretation of post-trial obligations towards individual research participants in the Declaration of Helsinki 2013. Transitioning research participants to the appropriate health care when a research study ends is a global problem. The publication of a new version of the Declaration of Helsinki is a great opportunity to discuss it. In my view, the Declaration of Helsinki 2013 identifies at least two clearly different types of post-trial obligations, specifically, access to (...) care after research and access to information after research. The agents entitled to receive post-trial access are the individual participants in research studies. The Declaration identifies the sponsors, researchers and host country governments as the main agents responsible for complying with the post-trial obligations mentioned above. To justify this interpretation of post-trial obligations, I first introduce a classification of post-trial obligations and illustrate its application with examples from post-trial ethics literature. I then make a brief reconstruction of the formulations of post-trial obligations of the Declaration of Helsinki from 2000 to 2008 to correlate the changes with some of the most salient ethical arguments. Finally I advance a critical interpretation of the latest formulation of post-trial obligations. I defend the view that paragraph 34 of ‘Post-trial provisions’ is an improved formulation by comparison with earlier versions, especially for identifying responsible agents and abandoning ambiguous ‘fair benefit’ language. However, I criticize the disappearance of ‘access to other appropriate care’ present in the Declaration since 2004 and the narrow scope given to obligations of access to information after research. The term “innovation” or “innovative care” has recently gained attention in the context of the use of novel and not yet fully validated medical interventions and technologies. Most notably, there have been various incidences of medical activities insufficiently validated for its regular use in healthcare that fall into this category, such as stem cell treatments, genome sequencing for diagnostic purposes, or novel reproductive technologies. Latin American countries are among the places where new and non-validated medical activities take place, notably due (...) to a lack of clear regulations and the poor support of authorities of existent legal and ethical guidelines, which is driven by “hidden battles” on the moral status of certain interventions. The increasing importance of innovative care underlines the importance of developing a general framework for these practices. Therefore, the present chapter scrutinizes this nascent field of inquiry in Latin America and offers a conceptual framework for innovation as well as its ethical justification. As we will argue, an important use of the term “innovation” or “innovative care” is best interpreted as “new non-validated practice” and not as a research activity. Then, we will defend that responsible innovation understood as responsible new non-validated practice is ethically permissible and poses an acceptable medical option if done in exceptional circumstances—where no reasonable alternatives can be provided to an individual patient—and following special ethical principles. Finally, we focus on the peculiarities and specific difficulties the concept of new non-validated practice poses to the Latin American context. We will conclude the chapter by some remarks and recommendations we draw from our analysis for individual patients, doctors, and societies in Latin America. (shrink)

The extent to which people anticipate and are influenced by the potential future consequences of their current behavior is called Consideration of Future Consequences. A well-established tool to measure this construct is the 14-item Consideration of Future Consequences Scale. The CFC-14 has shown appropriate psychometric properties in several languages. This scale comprises two factors: the CFC-Immediate and the CFC-Future. The main goal of this study was to assess the psychometric properties and internal consistency of the CFC-14 Scale in Spanish, using (...) an Argentine sample. A secondary goal was to determine its convergent validity with impulsivity, and determine differences across gender and age groups. Using a web-based survey, we collected data from 512 participants aged 13-74 years. Confirmatory Factor Analysis showed a 2-factor model as the best solution for 13-items version. Standardized regression weights ranged from.50 to.66 for CFC-F and between.43 and.83 for CFC-I. Composite reliability was also adequate: CFC-F achieve? =.80 and CFC-I? =.82. There were no differences across gender and age. The CFC-F subscale and UPPS-P subscales correlations, were negative and significant, highlighting the negative and moderate correlation between CFC-F and the lack of premeditation, a dimension strictly related to intertemporal decisions making. Thus, CFC-14 has adequate psychometric properties in an Argentinian population, although more studies are necessary to determine the robustness of these findings. (shrink)

In a journal entry from 1906, Husserl complains of lacking "internal stability" and of his desire to "achieve" it. My claim in this paper is that the "phenomenological method," which he made public in his 1907 lectures "Die Idee der Phänomenologie" was, and is, a means to achieve the inner harmony that Husserl longed for. I do not provide an analysis of why Husserl might have felt the way he did; my aim is to show what internal stability might be (...) and how one might achieve it. I conclude that the phenomenological method is the means, the "how," to internal stability, which I characterize as "clarity" and "harmony" regarding our beliefs and, and ultimately, our authentic comportment. The goal of this study was to introduce a model explaining how managers' attitudes, subjective norms, attributions, and the individualism-collectivism cultural dimension affect the way managers' deal with employee bribery in organizations. Twenty-six internal and external attributions related to bribery were identified through a series of structured interviews with 65 subject matter experts. These attributions, together with the other variables in the model, were evaluated by 354 Ecuadorian managers. Hierarchical regression analyses indicated that attitudes and external attributions significantly predicted managers' (...) intentions to discipline employees who accepted a bribe. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. Este trabajo analiza los conceptos de justicia social y felicidad en la filosofía de Julián Marías con el fin de alcanzar tres metas: comprender su sentido; mostrar cómo pudo llegar a visiones originales de ellos gracias a que su teoría está fundamentada en una metafísica, y alumbrar cómo esta es un método para que podamos seguir pensando. Para ello, se revisan las tres grandes perspectivas filosóficas de Marías –la estructura analítica, la empírica y la de la persona– para indagar qué (...) se entiende por justicia social y felicidad. Asimismo, desde cada uno de estos puntos de vista se buscan las conexiones entre ambos temas. Finalmente se analiza si es verosímil esperar que haya una vida tras la muerte biológica, puesto que, según el filósofo, la perduración es una condición necesaria para que sea posible tanto la verdadera felicidad como la justicia social derivada de ella. Este artículo pretende ser una nueva aportación a la discusión que tuvo lugar durante el siglo XX sobre si santo Tomás afirma la existencia de un sentido literal múltiple. Para ello, el autor vuelve a revisar los textos teóricos en los que santo Tomás trató el tema para reconocer en ellos la afirmación de la pluralidad del sentido literal y aclarar los lugares donde el Aquinate parece negarla. Seguidamente considera el uso que santo Tomás hace de este principio en su (...) exégesis. Finalmente, lo enmarca en su hermenéutica bíblica para ver su sentido y mostrar que no es elemento yuxtapuesto, sino coherente con ella. Justamente son estos dos últimos puntos los que arrojan nueva luz para entender mejor el sentido y el fundamento de la pluralidad del sentido literal en el Aquinate. Pues, la Sagrada Escritura es una palabra que Dios quiere dirigir a cada hombre para su salvación, la cual se hace plural para poder comunicar su riqueza y alcanzar a cada hombre en su situación.
