This paper presents a survey of LGBT attitudes towards the security sector in Serbia. During the five focus groups with LGBT persons, we determined the basic characteristics of police attitudes towards sexual minorities. By examining the relationship between the police and the sexual minorities, the author attempts to determine the institutional practice towards homosexuality. The study also notes the differences between respondents based on their status and the size of their place of residence. The usage of metaphor in languages for specific purposes has been in the focus of interest of cognitive linguistics for years, especially after Lakoff and Johnson published their famous book “Metaphors We Live by” in 1980. Inspired by that book, the author strives to prove that metaphor was not only intensely present in the history of law but also that it pervades the language of contemporary legal theory and practice. Terms like _injury of law, the burden of evidence, soft laws, (...) hard laws,_ etc. are so often used by lawyers in their professional communication that they are hardly recognizable as metaphors. In the theoretical part, the terms _conceptual metaphor_ and _lexical metaphor_, as well as _the source domain_ and _the target domain of the metaphor_ are defined. Accordingly, conceptual metaphor and lexical metaphor are interpreted from the perspective of the language of law. As an introduction to the discussion on metaphoric terms in the field of law, a number of metaphors is presented and discussed from the point of view of legal history, as the metaphoric and other poetic expressions were recognized as the features of legalese back in the early seventeenth century. In the main part, the author presents and discusses the most common conceptual metaphors in connection with the terms _law, justice, court,_ and the types of metaphors typically used in specific branches of law as criminal law, company law, and contract law. The empirical part of the paper is focused on two research tasks. Firstly, metaphors occurring in selected Legal English textbooks are explored and discussed by using a qualitative and a quantitative approach, and secondly, metaphoric terms and phrases of the EU Law are excerpted from the Treaty Establishing the European Community (Consolidated version 2002), the main task being to establish the frequency of metaphors in this relatively young branch of law and the types of conceptual metaphors they belong to. In the closing part, conclusions on similarities and differences in the use of metaphor between two different types of legal texts are drawn with specific reference to the frequency, lexical structures, and typology of conceptual metaphors in the field of law. In a special way, he dedicated himself to one of its most important issues – the understanding of the Scriptures, and can, therefore, be considered a significant instigator of the founding of modern hermeneutics. As an excellent connoisseur of classical languages (Hebrew, Greek and Latin) he recognized the importance and dealt with many issues of language, grammar, logic, and dialectic, as essential prerequisites for understanding everything which exists, and hence (...) of the written text also. In this connection, his skepticism towards philosophy is apparent, since the main source of theological cognition, for him, is revelation, and not the human reason, which was principally destroyed by Original Sin. He found the confirmation of his ideas in the current debates with both proponents and opponents of the Reformation, as well as in his research into church history, wherein he incessantly tried to find the witnesses of the truth, as he perceived it. Heidegger, first of all, perceives modern thinking to be a source of technology in its partly threatening dimension, though this source was inherited fromGreek thinkers. However, technology and threat, which arises from it, are not some kind of inevitable fate, but are the destiny of Being, which should be calmly awaited in its mysteriousness. For where there are threat and danger, there also is a prospect of salvation – in this way Heidegger adopts Hölderlin’s restrained optimism. Furthermore, salvation presupposes constant (...) inquiry as an expression of the piety of thought. If it does not fall to its proper place, then the forgotness of Being, the abandonment of Being, war and triumph of different modern technologies, which have created a lot of trouble in the technological age, can take root. Therefore, it seems that only enlightened thinking, which is revealed in its inquisitive piety, can offer some way out. (shrink)

In many papers dealing with the stylistic features of legal texts, metaphor is highlighted as a stylistic figure often used in the language of law. On a daily basis we can witness the frequent use of metaphoric collocations like soft laws, hard laws, silent partner, hedge funds, etc. In this paper, the author analyses the use of denotations for colours as constituent parts of metaphoric collocations in the language of law. The analysis is conducted by using a comparative approach to (...) examples extracted by means of computer technology from international bills and conventions available online. In the main part of the paper, examples are classified by using a colour denotation as the main criterion for the classification. After that, the examples are compared with corresponding expressions used in German and Croatian. Taking into account the main principle of the Skopos translation theory that differences between cultures strongly influence the translation process, the hypothesis of this research is that in many cases there will be no lexical equivalence between collocations with colour denotation in three languages. Due to the fact that international bills and conventions build the corpus of the research, and that the English language has become the lingua franca of international communication, it can be expected that some metaphoric terms and collocations would be literally translated from English. Conclusions drawn from the comparative analysis of legal collocations containing denotations for colours can be interesting to lawyers and LSP teachers in the field of law. In this sense, results of the research can contribute to motivational aspects of teaching Legal English and Legal German. (shrink)

The relation between philosophy and theology in Martin Heidegger’s thought is multilayered and tense. On the one hand, he admits that his theological origin, i.e. his Christian-Catholic rootedness, determines the direction of his thought, while on the other hand, he has been fighting against theology that is too much tinted with philosophy. At the same time, he opposes that his thought be called theistic or atheistic. In the analytic of Dasein he wants to create assumptions that would enable him to (...) talk about God, gods or divine in general. This brings him close to mysticism, and even more so to mythology, which is revealed in his interpretation of Hölderlin. Nietzsche’s talk about God’s death helps him in this context. However, neither with Nietzsche nor with Heidegger does this death look like real death. Both thinkers hold that death strikes that God who has in philosophy and theology been made a being. After the thinking of the Being had thrown light upon their thought, God of Biblical theology and above all God whose coming is expected according to Heidegger cannot be left to death, because he evades human comprehension, especially oneDas Verhältnis zwischen Philosophie und Theologie im Denken von Martin Heidegger ist vielschichtig und gespannt. Einerseits gibt Heidegger zu, daß seine theologische Herkunft, d.h. seine christlich-katholische Verwurzelung, für sein Denken auch richtungsweisend ist, andererseits kämpft er sein ganzes Leben lang gegen eine Theologie, die allzu sehr philosophisch geprägt ist. Zur gleichen Zeit wehrt er sich dagegen, daß sein Denken theistisch oder atheistisch genannt wird. In einer Daseinsanalytik will er Voraussetzungen schaffen, um von Gott, von Göttern, oder vom Göttlichem überhaupt sprechen zu können. Dies bringt ihn in die Nähe von Mystik, ja sogar in die Nähe von Mythologie, was vor allem in seiner Hölderlininterpretation seinen Niederschlag findet. In diesem Zusammenhang hilft ihm auch Nietzsches Rede vom Tode Gottes. Dieser Tod aber scheint weder bei Nietzsche noch bei Heidegger ein echter zu sein. Der Tod trifft bei beiden Denkern den Gott, der in Philosophie und in Theologie zum Seienden gemacht wurde. Der Gott der biblischen Theologie, und vor allem der Gott, dessen Ankunft, nach Heidegger, zu erwarten ist, nachdem das Seins-Denken ihr Gedachtes gelichtet hat, kann nicht dem Tode überliefert werden, weil er sich dem Zugriff des Menschen, vor allem in Form von Philosophie und Theologie, entzieht. In accordance with the Bologna Declaration, modern languages and communication skills have a growing importance in all professions. With the prospect of Croatian membership of the EU and taking into consideration the conditions of the growing internationalization of law in general, knowledge of foreign languages represents an indispensable prerequisite for international com- munication within the legal profession. Thus, teaching foreign languages in the field of law, especially English and German, is necessary not only for the pro- fessional education of Croatian (...) law students, but also for their mobility within the network of European universities. This paper presents a case-study of the current situation in teaching Legal English and Legal German in Croatian Law Schools. First, the status of foreign languages for specific purposes in the Higher Education System of the Republic of Croatia in general is analyzed. The main part of the paper is dedicated to teaching Legal English and / or Legal German as compulsory courses within the curricula of Croatian law faculties. Then some projects on teaching foreign languages to practicing lawyers will be presented. With the prospect of Croatian membership of the EU, specific education programmes for lawyer- linguists have been introduced by the Law Faculties of Zagreb and Osijek. These programmes, developed within the lifelong education project for lawyers, offer an opportunity for Croatian law students and young lawyers not only to im- prove their knowledge of Legal English and Legal German, but also to learn other languages of the EU, like French or Italian. These new programmes are the response of Croatian foreign language teachers to the current requirements of the European labour market and the challenges of the internationalization of the modern world. This essay opens the Special Issue of the International Journal for the Semiotics of Law entitled “Legal Languages and Legal Communication” devoted to issues in translating, interpreting and teaching legal languages and legal communication. This volume of the International Journal of the Semiotics of Law comprises twelve articles which might be grouped into three categories of problems i.e. culture in legal translation and interpretation, legal discourse and/in legal communication and teaching legal languages and legal communication. The first section refers to (...) issues connected with legal terminology and the impact legal culture has on the quality of translation and interpretation (Kordić in Int J Semiot of Law 36 (4); Janigova in Int J Semiot of Law 36 (4); Matulewska and Oh in Int J Semiot of Law 36 (4)). The second part focuses on the question of legal discourse with a special emphasis on its role in legal communication (Więcławska in Int J Semiot of Law 36 (4); Alwazna in Int J Semiot of Law 36 (4); Hadryan and Rutecka-Góra in Int J Semiot of Law 36 (4); Orts in Int J Semiot of Law 36 (4); Cudowska in Int J Semiot of Law 36 (4); Górska and Juzaszek in Int J Semiot of Law 36 (4) and Grieshofer in Int J Semiot of Law 36 (4)).
