Ce chapitre aborde l’histoire des avocats au Mexique depuis la microanalyse, c’est-à-dire pour en proposer une histoire globale à partir d’une échelle réduite et pendant la période de consolidation de ce qui était considéré comme une administration judiciaire moderne et professionnalisée, à la veille de la Révolution. Sont abordées les questions de leurs origines sociales, leur formation, la concurrence des conseillers juridiques informels, le coût de leurs services, la qualité de leurs relations, parfois houleuses, avec leurs clients. En dernière partie (...) est traité un aspect très particulier de leur histoire : le fait qu’ils constituaient le vivier d’où étaient nommés juges et notaires, violentant ainsi la constitution libérale. Pour cela, ont été mobilisées des sources judiciaires, des lettres adressées ou rédigées par l’Exécutif de l’État de Tlaxcala ainsi que quelques sources notariales. (shrink)

El objetivo de este estudio es analizar las investigaciones de pregrado en Literatura de una universidad peruana. Se realizó el mapeo sistemático de diez trabajos publicados entre el 2017 y 2022. Los resultados evidencian preferencia por la investigación en literatura peruana y que el género literario más estudiado es el narrativo. Se concluye que en los trabajos no se describen claramente los métodos científicos ni las metodologías de análisis literario; debido a su diversidad, a que los estudios literarios poseen una (...) complejidad interdisciplinaria, y porque los esfuerzos educativos universitarios en investigación se centran en los últimos semestres. The aim of the article is to intervene in debates about the digital and, in particular, framings that imagine the digital in terms of epochal shifts or as redefining life. Instead, drawing on recent developments in digital methods, we explore the lively, productive and performative qualities of the digital by attending to the specificities of digital devices and how they interact, and sometimes compete, with older devices and their capacity to mobilize and materialize social and other relations. In doing so, (...) our aim is to explore the implications of digital devices and data for reassembling social science methods or what we call the social science apparatuses that assemble digital devices and data to ‘know’ the social and other relations. Building on recent work at CRESC on the social life of methods, we recommend a genealogical approach that is alive to the ways in which digital devices are simultaneously shaped by social worlds, and can in turn become agents that shape those worlds. This calls for attending to the specificities of digital devices themselves, how they are varied and composed of diverse socio-technical arrangements, and are enrolled in the creation of new knowledge spaces, institutions and actors. Rather than exploring what large-scale changes can be revealed and understood through the digital, we argue for explorations of how digital devices themselves are materially implicated in the production and performance of contemporary sociality. To that end we offer the following nine propositions about the implications of digital data and devices and argue that these demand rethinking the theoretical assumptions of social science methods: transactional actors; heterogeneity; visualization; continuous time; whole populations; granularity; expertise; mobile and mobilizing; and non-coherence. The most recent work by Jürgen Habermas tries to revalue religion in today's society. For this he tries to find genealogical connections between secular content and the worldviews that emerged in the Axial Age, including Jewish monotheism. In this article we try to propose that a genealogical approach to monotheism from the perspective of those involved would have to start from the context of undetected origin that constitutes the ethical universalism of Judaism: the Noahide code. To do this, we analyze (...) narrative and conceptual elements of axial and non-axial cultures and show their parallels with the seven laws of the children of Noah as the moral core of humanity. Let ‘semantic relevance’ be the thesis that the wide semantic properties of representational mental states (like beliefs and desires) are causally relevant to behavior. A popular way of arguing for semantic relevance runs as follows: start with a sufficient counterfactual condition for causal or explanatory relevance, and show that wide semantic properties meet it with respect to behavior (e.g., Loewer & Lepore (1987,1989), Rescorla (2014), Yablo (2003)).This paper discusses an in‐principle limitation of this strategy: even the most sophisticated counterfactual criteria (...) systematically misclassify irrelevant properties as relevant when they stand in certain kinds of modal co‐variation or ‘entanglement’ relations to genuinely relevant properties. This entanglement problem, I argue, is more general and more serious than proponents of the counterfactual strategy have recognized: it threatens recent interventionist arguments for semantic relevance, and is not easily solved by appeal to proportionality or naturalness. I end by suggesting that proponents of semantic relevance may need to shift their attention from patterns of counterfactuals to the lawful psychological generalizations that explain them. (shrink)

Many pragmatist and non-representational approaches to cognition, such as the enactivist, have focused on the relations between actions, affectivity, and habits from an intersubjective perspective. For those adopting such approaches, all these aspects are inextricably connected; however, many questions remain open regarding the dynamics by which they unfold and shape each other over time. This paper addresses a specific topic that has not received much attention: the impact on future behavior of not fulfilling possibilities for social interaction even though their (...) fulfillment is desirable within a given context. Inspired by Gibson’s theory of affordances and Dewey’s account of habits, these situations will be characterized as events where an agent does not act upon an inviting affordance for social interaction due to a conflict which he or she experiences between given concerns, needs, and social norms. This conflict leads to a sense of unfulfillment that may eventually bring about a crisis and revision of habits. Through specific examples, this work presents the potential impact of the connection between affordances, habits, and affectivity on everyday situations. It therefore represents an exploration of the common ground between pragmatism and enactivism and an attempt to contribute to a process-based approach to social interaction. (shrink)

Habermas’s translation proviso aims to legitimize religious argumentation in the informal part of the public sphere while requiring religious citizens to express their arguments in the formal part of the public sphere using a universal (secular) language. By considering secular scholars Gonzalo Scivoletto’s and Javier Aguirre’s critiques of the meaning of “translation,” this article highlights the inconsistency of the proviso as manifested in its application to the religious concept of tzimtzum (“divine contraction”), from which Habermas attempts to extract a secular (...) worldview and moral intuitions that contradict the beliefs of religious citizens, thus undermining the reassessment of religion in the public sphere. The aim of this study is to try to make use of real numbers for representing an infinite analysis of individual notions in an infinity of possible worlds.As an introduction to the subject, the author shows, firstly, the possibility of representing Boole's lattice of universal notions by an associate Boole's lattice of rational numbers.But, in opposition to the universal notions, definable by a finite number of predicates, an individual notion, cannot admits this sort of definition, because each state of an (...) individual subject is characterized by the values taken by an infinite number of predicates, each of whom may appear or disappear in the next state.The notion of “degree of identification of an individual notion” is then introduced and arithmetized by a rational number.As an individual notion can be defined by a convergent succession of degrees of identification, the real characteristic number of such an individual notion can be defined by the corresponding convergent succession of rational numbers, satisfying Cauchy's conditions for the convergence of successions. Ihr Verständnis von Politik definiert sich durch Phänomenalität und entsteht als Handeln zwischen den Menschen. Die Verfasserin zeigt, dass Arendts Denken auch für aktuelle politikdidaktische Fragestellungen wegweisend ist.

Resumo: A inclusão no Ensino Superior é uma premissa de âmbito social, educacional e político. Muitos passos têm sido trilhados para que os discursos sobre equidade e igualdade possam ser proferidos e perspectivados, reconhecendo que o ajustamento dos estudantes com Necessidades Educativas Especiais (NEE) precede-se de inúmeros fatores, entre eles, das políticas educativas. Para possibilitar algumas reflexões, o presente estudo, de natureza qualitativa, objetivou conhecer as percepções de colaboradores (n=85) de Instituições de Ensino Superior portuguesas sobre o papel das políticas (...) educativas em prol da inclusão. Os dados, provenientes de um questionário online, foram tratados sob a técnica de análise de conteúdo, com apoio do software webQDA. Os resultados evidenciaram 60 referências na categoria de potencialidades, refletidas na garantia da efetivação do percurso acadêmico de estudantes com NEE no Ensino Superior e concretização dos seus direitos. Verificou-se que 91,7% dos participantes compreendem que as políticas educativas são importantes para o seu país, pelo que 88,2% dos colaboradores acreditam que estas políticas potenciam a inclusão e a permanência de estudantes com NEE no Ensino Superior, na qual 40,7% verificaram ações de apoio e incentivo, ao nível político, em prol da inclusão em Portugal. Many steps have been taken so that the discourses on equity and equality can be delivered and envisaged, recognizing that the adjustment of students with Special Educational Needs (SEN) is preceded by numerous factors, among them, educational policies. To enable some reflections, the present study, of a qualitative nature, aimed to know the perceptions of employees (n = 85) of Portuguese Higher Education Institutions about the role of educational policies on behalf of inclusion. The data, from an online survey, were treated using the content analysis technique, with the support of the webQDA software. The results revealed 60 references in the potentialities category, reflected in the guarantee of the effectiveness of the academic path of students with SEN in Higher Education and the realization of their rights. It was found that 91.7% of participants understand that educational policies are important for their country, so 88.2% of employees believe that these policies enhance the inclusion and permanence of students with SEN in Higher Education, in which 40.7% verified support and incentive actions, at the political level, in favor of inclusion in Portugal. Dentro de la historiografía centroamericana, el erotismo ha sido un tema que, en contraposición con otros como la reinterpretación del discurso histórico, no cuenta con una cantidad considerable de estudios comparativos que permitan comprender su desarrollo y sus diferentes acercamientos. Assistive technology has great potential to contribute to health, functioning, and quality of life. To date, as exemplified in the Canadian context, variations and inequities in access to assistive technology are evident; the development of legislation, policies, and programs has not kept up with the increasing use of assistive technology. In this article, we apply ;Daniels’s (2008) theory of just health to argue that equitable access to assistive technology funding and services is necessary for justice. En este artículo se analiza un conjunto de obras sobre ríos y represas que pertenece a la serie titulada Represa /Represión (2012-) de la artista colombiana Carolina Caycedo. La pregunta de la que se ocupa esta investigación es ¿cómo las estrategias estéticas de estas obras identifican los problemas socio-ecológicos generados por las represas y contribuyen a articular imaginarios políticos de sostenibilidad? El argumento principal es que las obras de Caycedo sobre el río Yuma o Magdalena contribuyen con la construcción de (...) una memoria histórica ambiental, a partir de saberes populares, campesinos y cosmovisiones indígenas. Con este fin, este texto caracteriza el problema de las represas a partir de los conceptos de ‘extractivismo’, de Macarena Gómez-Barris, y ‘desterritorialización’, de Rob Nixon, para luego realizar un recorrido por las obras de la artista, de cuyo análisis se va construyendo una caracterización de la memoria histórica ambiental de un segmento del río Yuma. El marco conceptual del trabajo incluye las nociones de ‘seres-tierra’, de Marisol de la Cadena y ‘territorio’, de Arturo Escobar, así como ‘memoria de los ríos’, de Kristina Lyons. La metodología se basa en el análisis conceptual y técnico de las piezas de Caycedo en el marco interdisciplinar de las humanidades ambientales. El análisis concluye que las obras de Caycedo generan espacios de memoria histórica ambiental desde perspectivas trasnacionales y, en estos espacios de encuentro que constituyen las obras, se relacionan y rearticulan los extremos de falsos antagonismos como naturaleza/cultura, humano/no humano y ciencia/arte. That Cicero as a young didactic poet embraced the traditions of Hellenistic hexameter poetry is well recognized. Those traditions encompass various forms of wordplay, one of which is the acrostic. Cicero's engagement with this tradition, in the form of an unusual Greek-Latin acrostic at Aratea 317–20, prompts inquiry regarding both the use of the acrostic technique as textual commentary and Cicero's lifelong concerns regarding translation.

In business and government, databases contain large quantities of digital transactional data (purchases made, services used, finances transferred, benefits received, licences acquired, borders crossed, tickets purchased). The data can be understood as ongoing and dynamic measurements of the activities and doings of people. In government, numerous database devices have been developed to connect such data across services to discover patterns and identify and evaluate the performance of individuals and populations. Under the UK’s New Labour government, the development of such devices (...) was part of a broader policy known as ‘joined-up thinking and government’. Analyses of this policy have typically understood joining up as an operation of adding together distributed data about subjects, which can then be used in the service of government surveillance, the database state or informational capitalism. But rather than such technical or managerialist analytics, I argue that topological analytics capture what these database devices enact and do: they materialize the ‘individuality’ of subjects in intensified, distributed and fluctuating ways and materialize and intensify a logic of what Deleuze describes as modulating controls. Through examples of UK New Labour social policy initiatives over the past decade, I argue that topological analytics can account for these as immanent rather than exceptional properties of database devices and, as such, part and parcel of a governmental logic and ontology of subjects. Much has been written about data politics in the last decade, which has generated myriad concepts such as ‘surveillance capitalism’, ‘gig economy’, ‘quantified self’, ‘algorithmic governmentality’, ‘data colonialism’, ‘data subjects’ and ‘digital citizens’. Yet, it has been difficult to plot these concepts into an historical series to discern specific continuities and discontinuities since the origins of modern power in its three major forms: sovereign, disciplinary and regulatory. This article argues that the coronavirus pandemic in 2020 brought these three forms of (...) power into sharp relief but made particularly visible a fourth form of power that we name ‘sensory power’, which has been emerging since the 1980s. The article draws on early studies of power by Michel Foucault, subsequent studies on biopower and biopolitics that expanded on them, and studies in the past decade that focused on data produced from apps, devices and platforms. Yet, despite its ambition, the article is inevitably an outline of a much larger project. (shrink)

‘‘COGNITIVE ECOLOGY’’ is a fruitful model for Shakespearian studies, early modern literary and cultural history, and theatrical history more widely. Cognitive ecologies are the multidimensional contexts in which we remember, feel, think, sense, communicate, imagine, and act, often collaboratively, on the fly, and in rich ongoing interaction with our environments. Along with the anthropologist Edwin Hutchins,1 we use the term ‘‘cognitive ecology’’ to integrate a number of recent approaches to cultural cognition: we believe these approaches offer productive lines of engagement (...) with early modern literary and historical studies.2 The framework arises out of our work in extended mind and distributed cognition.3 The extended mind hypothesis arose from a post-connectionist philosophy of cognitive science. This approach was articulated in Andy Clark’s Being There: Putting Brain, Body, and World Together Again, and further developed by Susan Hurley and Mark Rowlands, among others.4 The distributed cognition approach arose independently, from work in cognitive anthropology, HCI (Human-Computer Interaction), the sociology of education and work, and science studies. The principles of distributed cognition were articulated in Hutchins’s ethnography of navigation, Cogni- tion in the Wild,5 and developed by theorists such as David Kirsh and Lucy Suchman.6 These models share an anti-individualist approach to cognition. In all these views, mental activities spread or smear across the boundaries of skull and skin to include parts of the social and material world. The Greek word mētis (μῆτις) traditionally refers to a particular form of wily intelligence associated with the arts of deception (dolos) and the knowledge of tricks (kerdē), subterfuges, and traps. Mētis evokes innovative and ground-breaking solutions, based on the capability to understand, anticipate, and possibly violate the others’ expectations. Most importantly, mētis presupposes practical wisdom, or prudence (phrόnesis), a dispositional quality that underpins all the virtues that deserve to be cultivated by sportspersons and that is pivotal to perfect sportspersons’ moral (...) character. Not only is prudence required to apply mētis profitably for winning a game, but it is also indispensable to perform consistently with the game’s norms—cognizant of sport values. This analysis of mētis is key to illuminate the embodied dimension of tactical and moral reasoning in contemporary sport practice. In this paper, we first argue that the strategic effectiveness of mētis proves that not only sensorimotor control but also higher forms of intelligence, like strategic reasoning, are embodied and inform skilful performance; second, we argue that relying on mētis is necessary not only to interpret the rules of the game in one’s own favor but also to respect the shared values that these rules uphold in the sport practice. The blooming desert or ‘El desierto florido’ in Spanish, is a millenarian climate pattern caused by El Niño that warms the surface waters in the eastern tropical Pacific Ocean and creates the conditions for rain in the Altiplano and the Atacama Desert, north of Chile. After some millimeters of abundant rain, a rich biotic community emerges, and in a matter of hours or days, the driest surface on Earth becomes an impressive colorful habitat for more than two hundred different species (...) of eye-catching flowers that host the desert biotic life. Unfortunately, this breathtaking display of colors coexists with less appealing but equally astonishing landscapes. The Atacama Desert harbors the largest accumulation of discarded clothing worldwide and the largest pools of lithium mining which require vast amounts of water for their production. Every year, approximately 56,000 tons of used clothing, predominantly consisting of fast fashion polyester products, water-intensive cotton fabrics, and equally polluting material scraps, are deposited, forming toxic mountains of waste. This article presents an interpretation of these distinct landscapes as interconnected realities of the dump that illustrate the impact of biocultural semiocides, whereby the loss of relationships and meanings with Earth materials is shaped by glocal forces. By making this argument, the article contends that the Atacama region replicates the conditions of the Earth as a global dumping and solastalgia, namely ‘the pain caused by the loss of solace and the sense of desolation connected to one´s home and territory.’. The Statements on Responsibilities in Tax Practice (SRTPs) provide guidance to the CPA when making decisions in tax practice. Many of these decisions are ethical in nature and have implications for tax compliance. In this study, a survey methodology is used to test whether the SRTPs affect decisions that CPAs make. The findings suggest that a clear majority of CPAs follow the SRTPs when making ethical decisions relating to tax return preparation and that CPAs follow the SRTPs more often than (...) unlicensed preparers on half the issues tested. However, a statistically significant number of CPAs do not follow the SRTPs and, CPAs do not follow the SRTPs any more often than unlicensed tax preparers on three issues. (shrink)

With the breakdown of traditional racial boundaries in many areas of the world, the widespread and growing consumption of skin-lightening products testifies to the increasing significance of colorism—social hierarchy based on gradations of skin tone within and between racial/ethnic groups. Light skin operates as a form of symbolic capital, one that is especially critical for women because of the connection between skin tone and attractiveness and desirability. Far from being an outmoded practice or legacy of past colonialism, the use of (...) skin lighteners is growing fastest among young, urban, educated women in the global South. Although global in scope, the skin-lightening market is highly segmented by nation, culture, race, and class. This article examines the “yearning for lightness” and skin-lightening practices in various societies and communities and the role of transnational pharmaceutical and cosmetic corporations in fueling the desire for lighter skin through print, Internet, and television ads that link light skin with modernity, social mobility, and youth. Distinguishing intentional behavior from accidental behavior is a crucial component of social cognition and a major developmental achievement. It has often been assumed that developmental changes in intentional reasoning result from a gradual sophistication in the ability to discern intentions in action. We take issue with this notion, demonstrating that data from cognitive, developmental, and social psychology are more consistent with the hypothesis that it is instead a gradual sophistication in the ability to understand accidents that drives developmental change.

What do biologists want? If, unlike their counterparts in physics, biologists are generally wary of a grand, overarching theory, at what kinds of explanation do biologists aim? A history of the diverse and changing nature of biological explanation in a particularly charged field, "Making Sense of Life" draws our attention to the temporal, disciplinary, and cultural components of what biologists mean, and what they understand, when they propose to explain life.

Complex environmental problems require well-researched policies that integrate knowledge from both the natural and social sciences. Epistemic differences can impede interdisciplinary collaboration, as shown by debates between conservation biologists and anthropologists who are working to preserve biological diversity and support economic development in central Africa. Disciplinary differences with regard to 1) facts, 2) rigor, 3) causal explanation, and 4) research goals reinforce each other, such that early decisions about how to define concepts or which methods to adopt may tilt research (...) design and data interpretation toward one discipline’s epistemological framework. If one of the contributing fields imposes a solution to an epistemic problem, this sets the stage for what I call disciplinary capture. Avoiding disciplinary capture requires clear communication between collaborators, but beyond this it also requires that collaborators craft research questions and innovate research designs which are different from the inherited epistemological frameworks of contributing disciplines. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. Pluhar defends the view that any sentient conative being—one capable of caring about what happens to him or herself—is morally significant, a view that supports the moral status and rights of many nonhuman animals. Confronting traditional and contemporary philosophical arguments, she offers in clear and accessible fashion a thorough examination of theories of moral significance while decisively demonstrating the flaws in the arguments of those who would avoid attributing moral rights to nonhumans. Exposing the traditional (...) view—which restricts the moral realm to autonomous, fully fledged "persons"—as having horrific implications for the treatment of many humans, Pluhar goes on to argue positively that sentient individuals of any species are no less morally significant than the most automomous human. We develop the concept of ‘aesthetic practices’ to capture the work needed for population data to be disseminated via government data portals. Specifically, we look at the Census Hub of the European Statistical System and the Danish Ministry of Education’s Data Warehouse. These portals form part of open government data initiatives, which we understand as governing technologies. We argue that to function as such, aesthetic practices are required so that data produced at dispersed sites can be brought into relation and (...) projected as populations in forms such as bar charts, heat maps and tables. Two examples of aesthetic practices are analysed based on ethnographic studies we have conducted on the production of data for the Hub and Warehouse: metadata and data cleaning. Metadata enables data to come into relation by containing and accounting for the differences between data. Data cleaning deals with the indeterminacies and absences of data and involves algorithms to determine what values data can obtain so they can be brought into relation. We attend to how both aesthetic practices involve normative decisions that make absent what exceeds them: embodied knowledge that cannot or has not been documented as well as data that cannot meet the forms required of data portals. While these aesthetic practices are necessary to sustain data portals as ‘sites of projection,’ we also bring critical attention to their performative effects for knowing, enacting and governing populations. Researchers have considered individual and organizational factors of ethical decision making. However, they have little interest in situational factors :101–125, 2013) which is surprising given the many situations sales persons face. We address this issue using two pilot qualitative studies successively and a 2 by 2 within-subject experiment with sales scenarios. Qualitative and quantitative data are obtained from front-line employees of the main French retail banks that serve low-income customers. We show that the recognition of an ethical issue differs depending (...) on the role behavior salespersons are engaged in and the nature of the conflict of interest they face. Moreover, the combined effect of these two situational characteristics is mediated by moral intensity. This study not only adds evidence on situational factors affecting ethical decision but also extends empirical research on sales ethics by revealing sales situations that are not considered in the empirical literature. The research implications of the findings are discussed along with the study’s limitations and suggestions for future research. (shrink)

This paper shows that philosophy and contemplation are integral parts of leisure and of a fully conscious educative experience. Through examination of the concepts of philosophy, the philosopher, and contemplation, it will be proposed that leisure is a necessary condition for philosophy and for education. To conceptually bring together philosophy and education with leisure, the act of teaching as “an overflow of contemplation,” following Yves Simon’s definition, will be considered. Supporting the philosophical view of education as constituting an inward transformation (...) of the individual, from which he or she can better regard the world and his or her place in it, a serious theory of education rooted on leisure is a timely and valuable idea to consider.
