As a follow-up to Stephen Deakin's analysis on the ethics of mercy killing on the battlefield in this journal, this article proposes a moral justification for this type of action, as well as a judicial framework that could clarify what qualifies as such morally permissible action. Based upon contemporary cases, it argues that the current military codes of conduct are incoherent when it comes to the punishment of soldiers who commit mercy killings, and that the military codes of justice should (...) be amended accordingly. When we take a look back at the way Western states have fought terrorist organizations in the last 20 years, it is difficult not to think that these alternatives to war might have been more ethical than the decisions to invade Afghanistan and Iraq in 2001 and in 2003. These cases speak for themselves as they have both led to the death of hundreds of thousands of innocent civilians, which is highly paradoxical in light of the logic that supported these (...) interventions. There is a need to think of alternatives to war that will imply the legitimization of proactive sets of measures that would allow states to effectively prevent terrorist attacks through the use of kinetic force in a limited extent as a way to avoid the terrible and unpredictable effects of wars. Violent Alternatives to War: Justifying Actions Against Contemporary Terrorism engages in a moral discussion of the challenges associated with violent alternatives to war when confronting terrorism and suggests a comprehensive approach to how this form of violence can be legitimized and how it ought to be used against this contemporary threat. In what is quite possibly the most famous passage of the De revolutionibus, Copernicus implies that nobody could ever place this supreme flaming torch that is the Sun in another or better place than that from which it can illuminate everything simultaneously, namely the centre of this extremely beautiful temple that is our world. Considering the fact that he leaves an interrogatory twist to this argument of convenience, and since he makes this statement without any justification as it seems entirely (...) evident to him, certain Copernicans choose to illustrate this by means of an analogy: if indeed the Sun must be positioned thus, it is because the most appropriate place for the torch intended to illuminate the room is at its centre, and not in one of its corners. Despite the heliosophy of the Renaissance having been shared by both geocentrists and Copernicans alike, this "torch" argument does not appear to have achieved much success: rarely adopted by the Copernican camp, it was even contested by some of them; as for the geocentrists, it held no appeal for them whatsoever. Did this argument of convenience therefore not benefit from the self-evidence attributed to it by Copernicus, and from, in his wake, it's continued support by a good many commentators? As is often the case when it comes to the history of thought, the pseudo-obviousness of this argument is merely the fruit of a blatant anachronism: presenting heliocentrism as the cosmological system that finally grants the Sun its worthy centrality by placing it in the centre of the room and not in a corner, is to ignore the fact that this star of the day already enjoyed, in geocentrism, a centrality esteemed to be perfectly in keeping with both its dignity and its inherent illuminative function. Having lost their grasp on this worldview that no longer belonged to them, the Copernicans thus put forward an argument which, for the geocentrists, is worthless. Yet they could have argued the objective superiority of their centrality over that accorded to the Sun by geocentrism: while the latter is only numerical, on a purely planetary scale, and frankly fictitious, the former is thoroughly spatial, of cosmic proportions and, at least on first approximation, very real. In order to produce arguments of convenience that could carry their own weight, the protagonists of the new cosmology would have benefited from getting to know the world vision of their adversaries a little better instead of addressing them from their own point of view; similarly, instead of treating as an obvious fact that which is only evident to one of the two parties present, historians of scientific thought would also be well advised to have a better understanding of the world vision of those who history now considers as the losers! First recorded in the 14th century, the analogy of spit-roast meat argues that expecting the Sun to rotate around a strictly immobile Earth would be just as ludicrous as trying to move the fire around the roasting meat. On the contrary, it should be the Earth that spins upon itself in order to glean, from all possible angles, all the benefits of the Sun, just as it is the meat’s responsibility to turn on the spit before the motionless fire for (...) it to be perfectly cooked on all sides. Aimed at demonstrating, in geocentricism, the plausibility of the rotation of the Earth and, in heliocentrism, at supporting the physical reality of this terrestrial rotation, nowadays this analogy barely elicits more than an amused, or even condescending, smile. However, its continued long-term existence and its frequency of use — from the 14th to the 19th century, we found it mentioned by no less than 45 different authors — incited us to finally pay attention to it. We then noticed that beyond its explicitly cosmological scope, it raises, in its own way, the question of the purpose of the natural world: had the latter been conceived based upon humankind, then it is normal, despite what this analogy advocates, that the Sun is at the service of something more important than itself by rotating, to the profit of humankind, around the Earth; conversely, since such an infringement of the rule of common sense, as illustrated by this analogy, can neither be justified nor tolerated, it is up to the Earth to move around the Sun. Tracing the vicissitudes of this analogy, over 6 centuries, is thus not only about reconstructing the largely forgotten history of a presently obsolete analogy, but also about discovering the deeper meaning, henceforth incomprehensible, behind it. In describing how this meaning became progressively lost, one can finally pro­vide an understanding of why, in the present day, we are no longer capable of more than an amused smile when happening upon it! Jean-François Lyotard (1924-1998) was one of the most important French philosophers of the Twentieth Century. His impact has been felt across many disciplines: sociology; cultural studies; art theory and politics. This volume presents a diverse selection of interviews, conversations and debates which relate to the five decades of his working life, both as a political militant, experimental philosopher and teacher. Including hard-to-find interviews and previously untranslated material, this is the first time that interviews with Lyotard have been presented (...) as a collection. Key concepts from Lyotard's thought – the differend, the postmodern, the immaterial – are debated and discussed across different time periods, prompted by specific contexts and provocations. In addition there are debates with other thinkers, including Emmanuel Levinas and Jacques Derrida, which may be less familiar to an Anglophone audience. The objective of this study is to analyze the measurability and interfirm comparability of sustainability performance through the qualitative content analysis of 12 sustainability reports of mining firms using the Global Reporting Initiative guidelines. The systematic comparison of information disclosed in 92 GRI indicators sheds light on the reasons underlying the impossibility of rigorously measuring and comparing the sustainability performance of firms from the same sector, which are supposed to be strictly following the same reporting guideline. These reasons include qualitative (...) aspects of sustainability, lack of compliance with GRI protocols, indicator contingency, ambiguous or incomplete information, data heterogeneity, and report opacity. The study makes it possible to return to the very notion of sustainability, its meaning, and flexible application by organizations. The results are discussed from three different theoretical perspectives, each of which proposes possible and complementary explanations of the main findings. (shrink)

Lyotard’s earliest major work, available in English for the first time. Jean-François Lyotard is recognized as one of the most significant French philosophers of the twentieth century. Although nearly all of his major writing has been translated into English, one important work has until now been unavailable. Discourse, Figure is Lyotard’s thesis. In this paper, we consider how the four key team emergent states for team learning identified by Bell, Kozlowski and Blawath (2012), namely psychological safety, goal orientation, cohesion, and efficacy, operate as a system that produces the team’s learning climate (TLC). Using the language of systems dynamics, we conceptualize TLC as a stock that rises and falls as a joint function of the psychological safety, goal orientation, cohesion, and efficacy that exists in the team. The systems approach highlights aspects of (...) TLC management that are traditionally overlooked, such as the simultaneous influence of and feedback between the four team emergent states and the inertia that TLC can have as a result. The management of TLC becomes an issue of controlling the system rather than each state as an independent force, especially because changing one part of the system will also affect other parts in sometimes unintended and undesirable ways. Thus the value is to offer a systems view on the leadership function of team monitoring with regards to team emergent states, which we term team state monitoring. This view offers promising avenues for future research as well as practical wisdom. It can help leaders remember that TLC represents an equilibrium that needs balance, in addition to pointing to the various ways in which they can influence such equilibrium. (shrink)

BackgroundThe advent of learning healthcare systems (LHSs) raises an important implementation challenge concerning how to request and manage consent to support secondary use of data in learning cycles, particularly research activities. Current consent models in Quebec were not established with the context of LHSs in mind and do not support the agility and transparency required to obtain consent from all involved, especially the citizens. Therefore, a new approach to consent is needed. Previous work identified the meta-consent model as a promising (...) alternative to fulfill the requirements of LHSs, particularly large-scale deployments. We elicited the public’s attitude toward the meta-consent model to evaluate if the model could be understood by the citizens and would be deemed acceptable to prepare for its possible implementation in Quebec.MethodsEight focus groups, with a total of 63 members of the general public from various backgrounds were conducted in Quebec, Canada, in 2019. Explicit attention was given to literacy levels, language spoken at home and rural vs urban settings. We assessed attitudes, concerns and facilitators regarding key components of the meta-consent model: predefined categories to personalized consent requests, a dynamic web-based infrastructure to record meta-consent, and default settings. To analyse the discussions, a thematic content analysis was performed using a qualitative software.ResultsOur findings showed that participants were supportive of this new approach of consent as it promotes transparency and offers autonomy for the management of their health data. Key facilitators were identified to be considered in the implementation of a meta-consent model in the Quebec LHSs: information and transparency, awareness campaigns, development of educational tools, collaboration of front-line healthcare professionals, default settings deemed acceptable by the society as well as close partnerships with recognized and trusted institutions.ConclusionsThis qualitative study reveals the openness of a sample of the Quebec population regarding the meta-consent model for secondary use of health data for research. This first exploratory study conducted with the public is an important step in guiding decision-makers in the next phases of implementing the various strategies to support access and use of health data in Quebec. The theme appears in the writings of the decisionist period , as an illustration of a fantasm : that of definitive go-beyond any political conflictuality. During the national-socialist period, Schmitt opposes his theory of the « Great Space » and of the Empires to the dreams of globalisation, considered as a very dangerous as they would, in fact, express the interests of a great power seeking for hegemony, the United States. But, it’s in the writings posterior to 1945 that the theme is becoming central, when Schmitt produces his disillusioned reflexion on the « new nomos of earth » that could take the place of the jus publicum europaeum of the modern period. In the end, his constant refusal of a possible political unification of the world illustrates the statist convictions of Carl Schmitt, and is denial of a rationalist philosophy of history. (shrink)

Physicien théoricien, philosophe de la physique et historien des théo­ries physiques, le savant catholique français Pierre Duhem (1861-1916) a profondément marqué la pensée du vingtième siècle. Chacun connaît le Système du monde, dont les dix volu­mes ont contribué à la redécouverte de la science médiévale, et La théorie physique, qui a notamment donné lieu à la célèbre «thèse Duhem-Quine». Si Clio a donc gardé de Duhem le sou­venir d’un grand historien des sciences et d’un philosophe perspicace de la physique, lui-même (...) cependant n’aspirait qu’à être reconnu comme physicien. Son œuvre est en effet traver­sée par un projet scientifique qui consiste à ordonner et à réunir les diverses branches de la physique sous l’égide de la thermo­dynamique dans le cadre d’une théorie représentative et non explicative du réel. C’est ce projet que Duhem a voulu réaliser dans ses publications scientifiques, exposer dans ses écrits philoso­phiques, et finalement cautionner par ses recherches historiques. Cependant l’investissement toujours plus important de Duhem en histoire des sciences et la présence dans son œuvre de con­sidéra­tions apologétiques et d’écrits patriotiques peuvent don­ner à penser qu’il s’est progressivement détourné de ce projet primordial au profit d’autres préoccupations. De même, les tensions qui, à l’inté­rieur de ce projet scientifique, subsistent entre sa volonté unificatrice et sa revendication phénoménaliste peuvent conduire à une relativi­sation de cette dernière, conçue comme une demande contextuelle, passa­gère et finalement peu significative. Sans ignorer ces préoccu­pations historiques, religieuses ou patriotiques, sans négliger ce con­flit d’intérêt entre les deux parties constitutives du projet duhémien, cette étude entend tout d’abord réaffirmer que ce projet scientifique ne sera jamais ni abandonné, ni amputé. Toutefois, dès lors que sont maintenues la permanence, la prio­rité et l’intégralité de ce projet, trois paradoxes surgissent im­médiatement. Si Duhem se voulait avant tout physicien et souhaitait être reconnu comme tel, par quelle extravagance de l’histoire est-il finalement connu pour ses recherches histori­ques et ses travaux philosophiques et non pour ce qui lui tenait le plus à cœur? S’il ne voulait être qu’un illustre physicien, pourquoi s’est-il acharné, au retour du laboratoire, à exhumer de l’oubli les manuscrits et les théories scientifiques des au­teurs médiévaux? Enfin, s’il voulait vraiment établir une physi­que qui soit unifiée, cohérente et parfaite, pourquoi se prive-t-il du réa­lisme et s’embarrasse-t-il du phénoménalisme? Basée sur la corres­pondance inédite de Duhem, cette étude, centrée plus particu­liè­rement sur ce troisième paradoxe, contribue fina­lement à élucider chacun d’eux. (shrink)

This translation of Lyotard's first book, La phenomenologie (first publication in 1954; the translation is from the 10th edition of 1986, Presses Universitaires de France) supplies an important link to Lyotard's more recent work.

The first question we will try to answer is how did a Communist Party that rejected all forms of a market economy during its first 30 years in power succeed in establishing capitalism in China when so many attempts had failed after the mid-nineteenth century. Instead of relying on the traditional economic explanation based on labor, capital, and productivity that is favored by economists and that has been well discussed in the economic literature, we will focus more on the political (...) and social factors that explain this acceleration of history.The second question is related to the different problems that the Chinese economy faces today. China has registered one of the fastest economic growth rates in the history of capitalism, but this take-off still appears fragile in many analyses, potentially reversible. Again, if we consider what has been achieved during 25 years of reform, the question we can ask is whether the problems that create the concern with fragility represent a real threat to the economic modernization launched in 1978, and to the definitive establishment of a capitalism system in China.Finally, a third question that has been repeated like a mantra in foreign government circles and by reformers in China: Will the economic transformations that have taken place in the People’s Republic soon lead to the emergence of a democratic regime that will enable China to complete its cycle of modernization?
