Mindfulness, as the word is commonly used in contemporary meditation teaching, refers to both being aware of our present moment's experience, and relating to that experience without grasping, aversion or delusion. All three habitual tendencies distort our perception of what is happening, and lead us to futile and misguided efforts to deny or control our experience. Loving-kindness is a quality of the heart that recognizes how connected we all are. Loving-kindness is essentially a form of inclusiveness of caring, rather than (...) categorizing others in terms of those whom we care for and those who can be easily excluded, ignored or disdained. Any reduction in our tendency to fall into attachment, aversion or delusion helps refine and expand the force of loving-kindness. A deepening of insight will inevitably include seeing how all of our lives are inextricably interconnected. The diminishing of grasping, aversion and delusion and the increase in insight are both reasons mindfulness naturally leads us to greater loving-kindness. (shrink)

This article aims to clarify and expand our conceptual repertoire for understanding domestic violence and abuse by making legible different characteristic harms, particularly those that cannot be made sense of in terms of physical harm. Sections 2 and 3 of this article review popular understandings of the harms of domestic violence and abuse. These often emphasize either (a) pain and suffering or (b) the loss of capacities for self-governance as characteristic harms of domestic violence and abuse. In its second half, (...) this article argues that domestic violence and abuse characteristically involve yet another harm to the victim, one that cannot neatly be explained in terms of hedonistic welfare or concerns for a victim's capacities for self-governance. More specifically, this article argues that through the characteristic social isolation of domestic violence and abuse, perpetrators alienate victims from what motivationally roots them to the world. Although relationships that motivationally root us to the world might make us fundamentally dependent on others and can cause us great pain, they nevertheless play a profoundly valuable role in our lives by giving us reasons to go on living. In this article, I argue that victims of domestic violence characteristically suffer from two distinct kinds of moral harm: moral damage and moral injury. Moral damage occurs when the ability to develop or sustain good moral character has been compromised by an agent’s circumstances. Moral injury refers to a kind of psychological anguish that follows from when an agent causes or becomes causally implicated in actions that we ordinarily would understand to be morally grievous offenses because of their circumstances. A (...) person can experience moral damage or moral injury separately, but the experiences of moral damage and moral injury can also overlap. Because abusers often expect victims to adopt morally deficient dispositions and often implicate victims in wrongdoing, I argue that victims of domestic violence characteristically suffer from both moral damage and moral injury. By appreciating the different yet overlapping moral experiences of the victim, we become better positioned to identify strategies for responding to and repairing the different harms they suffer. The traditional perspective on emotions assumes an unassailable dualism between emotions and reason. For common sense, including legal common sense, emotions are always dangerous and have nothing to do with rational decision-making. Nonetheless, the Aristotelian perspective regarding the relationship between emotions and reason is extremely enlightening. The relationship between emotions and law has been studied by a large range of scholars from different legal movements and with diverse objectives. This chapter is based on three theoretical pillars: Aristotle’s theory of emotions (...) as elaborated in Rhetoric and Nicomachean Ethics, Aristotle’s view on the close relationship between reason, emotions and phronesis as elaborated in the Nicomachean Ethics, and a specific contemporary view: Jurisprudentialism. We assert that through a Jurisprudentialist analysis of Law as an open task and through Aristotle’s account of emotions, the challenges of legal education could be more realistically reassessed. An anonymous biography of Lucan known as the Life of Vacca attributes to the poet the composition of a work called Siluae. This information has been accepted by scholars with regard to both Lucan and Statius, thus transforming Lucan into a predecessor of Statius’ Siluae. This article seeks to demonstrate that neither the manuscript tradition of Lucan's biography nor alleged references to Lucan's Siluae in Statius’ collection substantiate the affirmation that Lucan composed a work called Siluae. It is argued that (...) the Life of Vacca is most probably late and its very long catalogue of works (mostly problematic or otherwise unknown) aggrandizes Lucan in response to the need for a commendatory biography of the poet when he became a school author. Pomponio Leto is responsible for perpetuating the mention of Lucan's Siluae by including it in his influential biography of Lucan (the first to reach the printed press). It is further argued that the circumstances of the tradition of Statius’ Siluae explain Leto's acceptance of Lucan's work of the same title. Leto was working on a commentary on the recently rediscovered Siluae, which explains his inclusion of a work called Siluae in his biography of Lucan, a great poet who had preceded Statius. Finally, this article deconstructs the theories that find references to Lucan's Siluae in Statius’ Siluae or that justify Statius’ silence about Lucan's Siluae with its political motifs. (shrink)

En noviembre de 1976, Amnesty Internacional llegó al país a constatar denuncias sobre violaciones a los derechos humanos. Dos de sus integrantes llegaron a la ciudad de Córdoba. El Hotel Crillón, ubicado en plena city cordobesa y locación donde se alojaron los visitantes, fue el escenario de las acciones de espionaje, persecución y amedrentamiento que sufrieron los dos delegados, un varón y una mujer, que habían llegado para contactarse con posibles denunciantes. Al no poder constituirse como un refugio seguro para (...) expresar aquello que las autoridades negaban, el artículo analiza cómo se frustró esta visita en base a los informes elevados por la Policía Federal a través de un memorando reservado. En la misma se contextualiza el momento, apoyándonos en la historia de la represión local, y se procura una lectura analítica del documento resguardado en el Archivo Provincial de la Memoria de Córdoba. It considers the nature of the anxieties aroused by a new situation, changes in our circumstances, beginnings, and endings of relationships, gains and losses and the ending of a previous state throughout the lifespan. At a university where demand for an introductory ethics course is huge and spans many disciplines, it is challenging to achieve the appropriate degree of generality such that many students could take the course as their single exposure to ethics while others would find it sufficiently challenging and interesting to continue in philosophy. This paper discusses the considerations that led to a course focused on “expert ethical discourse.” Directed to a primarily non-traditional student body, this course aims for analytical skills (...) that are highly relevant to students’ lives. Its goal is thus closer to “ethical literacy” than familiarity with the Western ethical canon (e.g. Aristotle, Kant, Mill). Taking seriously a number of feminist and post-modernist criticisms applicable to traditional ethics courses, “Ethical Inquiry” seeks to introduce students to dominant discourses on ethics (those which are highly influential on how people think and talk about ethics). Most of these discourses belong to disciplines other than philosophy, but the course uses philosophical tools for understanding and critiquing them, resembling a “moral critical theory” approach. After recounting faculty objections to this approach, the author reviews the course’s texts, how each discourse’s limits were approached, and the benefits and drawbacks of each text in the classroom. Elected politicians—legislators and, in some systems, members of the executive—can choose to exercise authority themselves or to delegate that authority to any number of agencies. Such delegation of power can occur at the constitutional stage, but is most common at the post-constitutional stage. Two categories of delegation can be distinguished: domestic delegation to agencies within the legislators’ jurisdiction, and international delegation to supranational or international bodies. While some research has been done on domestic delegation, especially in the context of delegation (...) to administrative agencies in the U.S., as well as on delegation to supranational bodies, especially with regard to the E.U., these activities have not been analyzed within a unified framework. This paper attempts to inquire into these issues and provide a general picture of the decision-making process regarding whether to delegate authority and to which body to transfer the authority. The past decade has been a period of rapid change in Central and Eastern Europe. Almost all of these countries have either passed entirely new constitutions or substantially modified the old ones. This is a unique situation in which constitutional delegation of powers can be performed almost simultaneously with post-constitutional delegation. The constitutional process in Israel is very different. It has been underway for fifty years. However, it can also be characterized by simultaneous constitutional and post-constitutional choices. In this paper, we examine such delegation choices in nine countries. We describe the main differences among these countries with regard to delegation of power, try to trace their origins and analyze their effects on delegation of powers. One question raised is what are the ramifications of a quasi-simultaneous constitutional and post-constitutional choice? Have constitutional rules been chosen in anticipation of the necessary compatibility with the rules of international organizations that one wants to join? Has membership in international organizations led to a boost in credibility of those governments concerned? (shrink)

In 2020, the European Union announced the award of the contract for the biometric part of the new database for border control, the Entry Exit System, to two companies: IDEMIA and Sopra Steria. Both companies had been previously involved in the development of databases for border and migration management. While there has been a growing amount of publicly available documents that show what kind of technologies are being implemented, for how much money, and by whom, there has been limited engagement (...) with digital methods in this field. Moreover, critical border and security scholarship has largely focused on qualitative and ethnographic methods. Building on a data feminist approach, we propose a transdisciplinary methodology that goes beyond binaries of qualitative/quantitative and opacity/transparency, examines power asymmetries and makes the labour of coding visible. Empirically, we build and analyse a dataset of the contracts awarded by two European Union agencies key to its border management policies – the European Agency for Large-Scale Information Systems (eu-LISA) and the European Border and Coast Guard Agency (Frontex). We supplement the digital analysis and visualisation of networks of companies with close reading of tender documents. In so doing, we show how a transdisciplinary methodology can be a device for making datafication ‘intelligible’ at the European Union borders. (shrink)

Fencing for the blind and visually impaired is an emerging sub-discipline of fencing that creates unusual conditions for meaning-making through interaction between embodied endowments and worldly affordances. With the rules of fencing slightly adjusted to the needs of the blindfolded participants – regardless of their sightedness – the discipline requires the fencers to engage in a duel by relying on other than visual cues. This article explores what an autoethnographic account of experiences of participation in fencing for the blind and (...) visually impaired brings to debates on the embodied, and specifically sensory difference. The discussion of these experiences intersects with debates on affect, affordance, and habit, with all three having important roles in related semiotic processes. Presented vignettes draw upon the author’s lived experiences of participation in fencing for the blind and visually impaired and are analyzed as part of a mixed-method autoethnographic study, accompanied by sensory methodologies, with a focus on an inquiry beyond the visual. The vignettes elucidate how we make sense of our surroundings through a complex engagement with the ecology of sensory and affective processes. In addition to exploring the role of affective and pre-conceptual aspects of our experiences, the article seeks to understand how semiosis occurs through both exposure to as well as the active pursuit of specific environmental signs available to us. The article also derives from biosemiotics to examine the complex relationship between meaning-making processes and habits. Finally, the autoethnographic account provides an insight into how we habituate the world and our embodied differences and thus enable meaning-making processes. (shrink)

Este livro procura orientar o leitor em geral e os interessados em educação em particular, no estudo e na recuperação do Tratado de Pirkei Avot - Ética dos Pais, que integra o Talmud, à luz das modernas teorias da educação, permite o resgate de noções fundamentais relacionadas, principalmente, a atitudes e comportamentos do mestre e do aprendiz. Tais atitudes implicam uma relação horizontal e dialógica entre ambos e o constante intercâmbio de seus repertórios, condições imprescindíveis para a aquisição do conhecimento.

Authentic leadership has become increasingly important in the literature, attracting the attention of many scholars in the last decade. This study adopted an employee-centered perspective to guide its examination of the relationship between authentic leadership and individual performance and investigation of the sequential mediation of employees’ affective commitment and individual creativity. An analysis was conducted of data collected from 214 employees working in different business sectors. The results reveal a statistically significant positive relationship between authentic leadership and employees’ workplace performance, (...) which are both directly connected and indirectly linked through the two proposed psychosocial mechanisms. The findings thus indicate that authentic leadership reinforces workers’ emotional connection with their organizations, thereby increasing their individual creativity and, subsequently, promoting better on-the-job performance. This study presents new and significant results since, on the one hand, it relied on a sequential mediation analysis of variables and, on the other hand, integrated the four main constructs into a single model. The proposed model displays the chain of effects between authentic leadership, affective commitment, individual creativity, and employee workplace performance. Prominent tuberculosis (TB) actors are invoking solidarity to motivate and justify collective action to address TB, including through intensified development and implementation (D&I) of technologies such as drugs and diagnostics. We characterize the ethical challenges associated with D&I of new TB technologies by drawing on stakeholder perspectives from 23 key informant interviews and we articulate the ethical implications of solidarity for TB technology D&I. The fundamental ethical issue facing TB technological D&I is a failure within and beyond the TB community (...) to stand in solidarity with persons with TB in addressing the complex sociopolitical contexts of technological D&I. The failure in solidarity relates to two further ethical challenges raised by respondents: skewed power dynamics that hinder D&I and uncertainties around weighing risks and benefits associated with new technologies. Respondents identified advocacy and participatory research practices as necessary to address such challenges and to motivate sustained collective action to accelerate toward TB elimination. We present the first empirical examination of bioethical accounts of solidarity in public and global health. Our study suggests that solidarity allows us better to understand and address the ethical challenges that arrest the D&I of new TB technologies. Solidarity lends credence to policies and practices that address the relational nature of illness and health through collective action. (shrink)

The somatic mutation theory (SMT) of cancer has been and remains the prevalent theory attempting to explain how neoplasms arise and progress. This theory proposes that cancer is a clonal, cell‐based disease, and implicitly assumes that quiescence is the default state of cells in multicellular organisms. The SMT has not been rigorously tested, and several lines of evidence raise questions that are not addressed by this theory. Herein, we propose experimental strategies that may validate the SMT. We also call attention (...) to an alternative theory of carcinogenesis, the tissue organization field theory (TOFT), which posits that cancer is a tissue‐based disease and that proliferation is the default state of all cells. Online education has become an essential component of education. Thus, several factors, such as the student’s learning strategy and motivation, generally contribute to their academic success. This study investigates the relationship between learning strategies, motivation, and online learning environment among 150 first-year college students. Employing correlational design, the statistical findings of the study reveal that the r coefficient of 0.59 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision (...) to reject the null hypothesis. Hence, a significant relationship exists between learning strategies, motivation, and the online learning environment. (shrink)

Codes of medical ethics (codes) are part of a longstanding tradition in which physicians publicly state their core values and commitments to patients, peers, and the public. However, codes are not static. Using the historical evolution of the Canadian Medical Association's Code of Ethics as an illustrative case, we argue that codes are living, socio-historically situated documents that comprise a mix of prescriptive and aspirational content. Reflecting their socio-historical situation, we can expect the upheaval of the COVID-19 pandemic to prompt (...) calls to revise codes. Indeed, Alex John London has argued in favour of specific modifications to the World Medical Association's International Code of Medical Ethics (which has since been revised) in light of moral and scientific failures that occurred during the COVID-19 pandemic. Responding to London, we address the more general question: should codes be modified to reflect lessons drawn from the COVID-19 pandemic or future such upheavals? We caution that codes face limitations as instruments of policy change because they are inherently interpretive and ‘multivocal’, that is, they usually underdetermine or provide more than one answer to the question, ‘What should I do now?’ Nonetheless, as both prescriptive and aspirational documents, codes also serve as tools for reflection and deliberation—collective practices that are necessary to engaging with and addressing the moral and scientific uncertainties inherent to medicine. The theory of mental models postulates that meaning and knowledge can modulate the interpretation of conditionals. The theory's computer implementation implied that certain conditionals should be true or false without the need for evidence. Three experiments corroborated this prediction. In Experiment 1, nearly 500 participants evaluated 24 conditionals as true or false, and they justified their judgments by completing sentences of the form, It is impossible that A and ___ appropriately. In Experiment 2, participants evaluated 16 conditionals and provided their (...) own justifications, which tended to be explanations rather than logical justifications. In Experiment 3, the participants also evaluated as possible or impossible each of the four cases in the partitions of 16 conditionals: A and C, A and not-C, not-A and C, not-A and not-C. These evaluations corroborated the model theory. We consider the implications of these results for theories of reasoning based on logic, probabilistic logic, and suppositions. (shrink)

Humanism is charged with fostering a harmful anthropocentrism that has led to the exploitation of non-human beings and the environment. Posthumanist and transhumanist ideas prominently aim at rethinking our self-understanding and human-nature relations. Yet these approaches turn out to be flawed when it comes to addressing the challenges of the “age of the humanity”, the Anthropocene. Whereas posthumanism fails in acknowledging the exceptional role of human beings with regard to political agency and responsibility, transhumanism overemphasizes human capabilities of controlling nature (...) and only deepens the human-nature dualism. Therefore, a critical and humble version of humanism is suggested as a viable alternative. Drawing on pragmatist thinkers William James and F.C.S. Schiller, a resource for de-centering the human being is provided that critically reflects our role in the larger ecosystem and underlines human potentials as well as human responsibilities. Lack of vaccine confidence can contribute to drops in vaccination coverage and subsequent outbreaks of diseases like measles and polio. Low trust in vaccines is attributed to a combination of factors, including lack of understanding, vaccine scares, flawed policies, social media and mistrust of vaccine manufacturers, scientists and decision-makers. The COVID-19 crisis has laid bare societies’ vulnerability to new pathogens and the critical role of vaccines in containing this and future pandemics. It has also put science at the forefront of (...) the response, with several governments relying on academics to help shape policy and communicate with the public. Against this backdrop, protecting public trust in scientists and scientific output is arguably more important than ever. Yet, conflicts of interest in biomedical research remain ubiquitous and harmful, and measures to curb them have had limited success. There is also evidence of bias in industry-sponsored vaccine studies and academics are voicing concerns about the risks of working in a CoI prevalent research area. Here, we set out to challenge established thinking with regard to vaccine confidence, by shifting the gaze from a deficit in public understanding towards probity in research relationships and suggesting an alternative and perhaps complementary strategy for addressing vaccine mistrust. We argue that a concerted effort needs to be made to revisit the norms that undergird contemporary vaccine research, coupled with a willingness of all stakeholders to reimagine those relationships with an emphasis on demonstrating trustworthiness and probity. The purpose of this article is to investigate human spatiality and perception in general, with the experience of adventure sports as its background. These activities highlight especially our strong relationship with the world when we consider the specific way in which the environment participates in the development of human potential. We first analyse the notions of risk and instability as important elements in adventure sports. Then we explore the notion of experience and spatiality, considering the way in which we establish (...) our relationship with the world. The theoretical background is found in the phenomenology of Merleau-Ponty and Bachelard’s phenomenology of imagination to investigate perspectives of space among adventurers. We hold that more than a different range of corporeal techniques, adventure sports can teach us a way of interrogating and looking at the world. They require a peculiar sensibility that allows our body to experience the environment in favour of a corporeal wisdom. Alternative sports indicate the possibility that we have to build up different ways of inhabiting the world and comprehending it. (shrink)
