In Powers of Horror,1 the psychoanalyst Julia Kristeva presented the first explicit, elaborated theory of ‘abjection,’ which she defines as the casting off of that which is not of one’s “clean and proper”2 self. According to Kristeva, abjection is a demarcating impulse which establishes the basis of all object relations, and is operative in the Lacanian narrative of subject formation in early childhood via object differentiation. Abjection continues to operate post-Oedipally to prevent the dissolution of the subject by repressing identification (...) with that which is other, and particularly that which is only tenuously other: the abject. Though Kristeva’s theory is braided into problematic Freudian premises, this essay will argue that abjection remains operative independent of the Oedipal model. (shrink)

Hayek’s The Road to Serfdom has been interpreted as a general warning against state intervention in the economy.1 We review this argument in conjunction with Hayek’s later work and discern an institutional thesis about which forms of state intervention and economic institutions could threaten personal and political freedom. Economic institutions pose a threat if they allow for coercive interventions, as described by Hayek in The Constitution of Liberty: by giving someone the power to force others to serve one’s will by (...) threatening to inflict harm, in the absence of general rules of conduct. According to the logic of the argument, welfare-state provisions are not coercive insofar as they do not allow the identification and discriminatory treatment of individuals. By contrast, we claim that a structure of coercion is likely to emerge from the command-and-control nature of protectionist institutions and immigration restrictions currently advocated by the radical right. _Violence: Probing the Boundaries around the World_ includes implicit and explicit contributions to the conceptualisation of violent processes across the world, the circumstances that enable them to exist and opens ways to think valuable interventions.

Constructions of Intersubjectivity shows that the meaning of grammatical constructions often has more to do with the human cognitive capacity for taking other peoples' points of view than with describing the world. Treating pragmatics, semantics, and syntax in parallel and integrating insights from linguistics, psychology, and animal communication, Arie Verhagen develops a new understanding of linguistic communication. In doing so he shows the continuity between language and animal communication and reveals the nature of human linguistic specialization. Professor Verhagen uses Dutch (...) and English data from a wide variety of sources and considers the contributions of grammar to the coherence of discourse. He argues that important problems in semantics and syntax may be resolved if language is understood as an instrument for exerting influence and coordinating different perspectives. The grammatical phenomena he discusses include negative expressions, the let alone construction, complementation constructions, and discourse connectives.This powerfully argued and original explanation of the nature and operation of communication will interest a wide range of scholars and advanced students in linguistics, cognitive science, and human evolution. Longer-term developments shape the present and endogenous futures of institutions and practices of science and technology in society and their governance. Understanding the patterns allows diagnosis and soft intervention, often linked to scenario exercises. The book collects six articles offering key examples of this perspective, addressing ongoing issues in the governance of science and technology, including nanotechnology and responsible research and innovation. And adds two more articles that address background philosophical issues.

In recent years, the educational-system development specialization of the MA program in the University of Haifa’s Faculty of Education has held an annual seminar on Philosophy for/with Children (P4wC). Under my guidance, Jewish, Muslim, Christian, Druze, and Circassian students have formed a group embodying a living and breathing dialogical space. Despite the global spread of P4wC principles following the emergence of the P4C movement promoted by the International Council of Philosophical Inquiry and its practice in dozens of national and regional (...) centers, neither approach is formally taught in Israeli universities and colleges. Both thus remain outside the pedagogical mainstream, the University of Haifa—where I teach—being the only institution at which they can be studied at an MA level. I have also established the Israeli Academic Forum for Philosophy with Children, which conducts seminars and offers professional development, etc. (shrink)

Within the space of a few years, the idea of Responsible Research and Innovation, and its acronym RRI, catapulted from an obscure phrase to the topic of conferences and attempts to specify and realize it. How did this come about, and against which backdrop? What are the dynamics at present, and what do these imply for the future of RRI as a discourse, and as a patchwork of practices? It is a social innovation which creates opening in existing divisions of (...) moral labour, a notion that is explained with the help of the history of responsibility language. It is filled in for the present situation and ongoing developments. Some elements may stabilize and this creates a path into the future. There will be reductions of the originally open-ended innovation, some productive, others less so. This is a reason to regularly inquire into the value of the reductions and the directions the path is taking. (shrink)

This study offers a fresh reappraisal of the philosopher, political thinker, and historian of ideas Sir Isaiah Berlin (1909-1997) from childhood to the height of his intellectual career. It provides the first historically contextualized study of Berlin's formative years and identifies different stages in his intellectual development, allowing a reappraisal of his theory of liberalism. The article revisits the large n problem as it relates to the Jeffreys-Lindley paradox to compare the frequentist, Bayesian, and likelihoodist approaches to inference and evidence. It is argued that what is fallacious is to interpret a rejection of as providing the same evidence for a particular alternative, irrespective of n; this is an example of the fallacy of rejection. Moreover, the Bayesian and likelihoodist approaches are shown to be susceptible to the fallacy of acceptance. The key difference is that (...) in frequentist testing the severity evaluation circumvents both fallacies but no such principled remedy exists for the other approaches. (shrink)

Many believe that the ethical problems of donation after cardiocirculatory death (DCD) have been "worked out" and that it is unclear why DCD should be resisted. In this paper we will argue that DCD donors may not yet be dead, and therefore that organ donation during DCD may violate the dead donor rule. We first present a description of the process of DCD and the standard ethical rationale for the practice. We then present our concerns with DCD, including the following: (...) irreversibility of absent circulation has not occurred and the many attempts to claim it has have all failed; conflicts of interest at all steps in the DCD process, including the decision to withdraw life support before DCD, are simply unavoidable; potentially harmful premortem interventions to preserve organ utility are not justifiable, even with the help of the principle of double effect; claims that DCD conforms with the intent of the law and current accepted medical standards are misleading and inaccurate; and consensus statements by respected medical groups do not change these arguments due to their low quality including being plagued by conflict of interest. Moreover, some arguments in favor of DCD, while likely true, are "straw-man arguments," such as the great benefit of organ donation. The truth is that honesty and trustworthiness require that we face these problems instead of avoiding them. We believe that DCD is not ethically allowable because it abandons the dead donor rule, has unavoidable conflicts of interests, and implements premortem interventions which can hasten death. These important points have not been, but need to be fully disclosed to the public and incorporated into fully informed consent. These are tall orders, and require open public debate. Until this debate occurs, we call for a moratorium on the practice of DCD. (shrink)

This essay provides a general introduction to the special number on Jacob L. Talmon (1916–1980). The essay sketches the outlines of Talmon's intellectual biography, beginning with his study of the origins of totalitarian democracy, moving through his analysis of nationalism and political messianism, and ending with his study of the ideological clash of the 20th century. The essay raises the question of whether Talmon should be seen as a thinker wishing to defend existing traditions (i.e. a “priest”), or as a (...) radical anti-authoritarian skeptic (i.e. a “jester”). Moreover, being both an anti-nationalist liberal, and a zionist at the same time, Talmon, the essay shows, was aware of the fact his own stance was problematic and at times even paradoxical. The last section of the essay presents the seven essays, which are included in the special issue. (shrink)

Starting from common-sense notions of ‘furniture of the world’ a process ontology is developed in which prospective is an integral part. Technology as configurations that work (precariously) embodies expectations which structure further development. Examples (a cloned puppy, hotel keys, DC airplanes, stem cells, and overpasses on Long Island) are used to develop the notion of material narratives that are “written”, not just by engineers and designers/producers, but also by users: “reading” implies some further “writing”. In contrast to prevailing notions of (...) technological control (through manipulation of building blocks), the “writing” of nanotechnology is modulation of the invisible and impredictable - an extreme example of unruly technology and repair work after the fact, where in practice control is a gesture not so different from magic. Because ontology cannot be other than prospective, it is political throughout. Thus, prospective technology highlights ontological politics. (shrink)

Brain death has been accepted worldwide medically and legally as the biological state of death of the organism. Nevertheless, the literature has described persistent problems with this acceptance ever since brain death was described. Many of these problems are not widely known or properly understood by much of the medical community. Here we aim to clarify these issues, based on the two intractable problems in the brain death debates. First, the metaphysical problem: there is no reason that withstands critical scrutiny (...) to believe that BD is the state of biological death of the human organism. Second, the epistemic problem: there is no way currently to diagnose the state of BD, the irreversible loss of all brain functions, using clinical tests and ancillary tests, given potential confounders to testing. We discuss these problems and their main objections and conclude that these problems are intractable in that there has been no acceptable solution offered other than bare assertions of an ‘operational definition’ of death. We present possible ways to move forward that accept both the metaphysical problem - that BD is not biological death of the human organism - and the epistemic problem - that as currently diagnosed, BD is a devastating neurological state where recovery of sentience is very unlikely, but not a confirmed state of irreversible loss of all [critical] brain functions. We argue that the best solution is to abandon the dead donor rule, thus allowing vital organ donation from patients currently diagnosed as BD, assuming appropriate changes are made to the consent process and to laws about killing. In Part I of this series, we presented the microscopic approach to Souslin-tree constructions, and argued that all known ⋄-based constructions of Souslin trees with various additional properties may be rendered as applications of our approach. In this paper, we show that constructions following the same approach may be carried out even in the absence of ⋄. In particular, we obtain a new weak sufficient condition for the existence of Souslin trees at the level of a strongly inaccessible cardinal. We (...) also present a new construction of a Souslin tree with an ascent path, thereby increasing the consistency strength of such a tree's nonexistence from a Mahlo cardinal to a weakly compact cardinal. Section 2 of this paper is targeted at newcomers with minimal background. It offers a comprehensive exposition of the subject of constructing Souslin trees and the challenges involved. (shrink)

This article calls into question the charge that frequentist testing is susceptible to the base-rate fallacy. It is argued that the apparent similarity between examples like the Harvard Medical School test and frequentist testing is highly misleading. A closer scrutiny reveals that such examples have none of the basic features of a proper frequentist test, such as legitimate data, hypotheses, test statistics, and sampling distributions. Indeed, the relevant error probabilities are replaced with the false positive/negative rates that constitute deductive calculations (...) based on known probabilities among events. The Vatican recently published directives regarding “beginning of life” issues that explain the Catholic Church's position regarding new technologies in this area. We think that it is important to develop a response that presents the traditional Orthodox Jewish position on these same issues in order to present an alternative, parallel system. There are many points of commonality between the Vatican document and traditional Jewish thought as well as several important issues where there is a divergence of opinion. The latter include (...) the status of the zygote as produced during in vitro fertilization, the acceptable of procreation in a method other than through the conjugal act, and the permissibility of deriving benefit from the products of an illicit act. The transcriptional profile of the entire Caulobacter crescentus genome over a synchronous cell cycle was recently described.(1) The analysis reveals a stunning 553 cell-cycle-regulated genes or orfs, nearly 19% of the genome, including putative functions in virtually all biological activities. Over a quarter of these genes/orfs respond to the Caulobacter master regulator, CtrA, most of them apparently indirectly. The analysis confirms and extends earlier observations showing that many proteins involved in cell cycle functions are expressed at the cell age when (...) they are needed. This discussion note offers a preliminary analysis of what recent developments in human germline gene editing tell us about the effectiveness of speculative and anticipatory modes of techno-ethics. It argues that the benefits of speculative discussions are difficult to detect thus far, and that pushing the focal point of ethical discourse well ahead of the current state of technology may prematurely undermine existing norms long before a broad consensus would justify moving beyond them.

According to international scientific medical consensus, death is a biological, unidirectional, ontological state of an organism, the event that separates the process of dying from the process of disintegration. Death is not merely a social contrivance or a normative concept; it is a scientific reality. Using this paradigm, the international consensus is that, regardless of context, death is operationally defined as “the permanent loss of the capacity for consciousness and all brainstem function. This may result from permanent cessation of circulation (...) or catastrophic brain injury. In the context of death determination, ‘permanent’ refers to loss of function that cannot resume spontaneously and will not be restored through intervention.” The word “permanent” replaces “irreversible” (used in the United States’ 1980 Uniform Declaration of Death Act) in this new definition, arguably invented to allow donation after circulatory determination of death (DCDD) while still complying with the dead donor rule. I will show that this invention fails, for at least four reasons. (shrink)

This paper first develops a theoretically motivated view of narrative as a special form of inferential, cooperative human communication, of the role that the past tense plays in the intersubjective coordination of narrators and readers, viz. that of ‘curtailing’ the immediate argumentative applicability of the represented situation, and of its relation to viewpoint management. In three case studies, it is subsequently shown how this helps to elucidate certain effects of present and past tense alternations in stories. While these effects are (...) multi-faceted and highly text-specific, there is a common denominator of the use of the past tense in the dimension of narrator-reader communication in the narratives. The analysis supports an independently motivated conception of intersubjectivity that assigns a special status to ‘coordination with other minds’, apart from senders and addressees. (shrink)

This work focuses on the conception of God of the medieval Jewish philosopher and legal scholar, Hasdai Crescas (1340-1410/11). It demonstrates that Crescas’ God is infinitely creative and good and explores the parallel that Crescas implicitly draws between God as creator and legislator.

The public sphere, be it the Greek agora or the New York Times op-ed page, is the realm of appearances - not citizenship. Its central event is spectacle - not dialogue. Public dialogue, the mantra of many intellectuals and political commentators, is but a contradiction in terms. Marked by an asymmetry between the few who act and the many who watch, the public sphere can undermine liberal democracy, law, and morality. Inauthenticity, superficiality, and objectification are the very essence of the (...) public sphere. But the public sphere also liberates us from the bondages of private life and fosters an existentially vital aesthetic experience. Reign of Appearances uses a variety of cases to reveal the logic of the public sphere, including homosexuality in Victorian England, the 2008 crash, antisemitism in Europe, confidence in American presidents, communications in social media, special prosecutor investigations, the visibility of African-Americans, violence during the French Revolution, the Islamic veil, and contemporary sexual politics. This unconventional account of the public sphere is critical reading for anyone who wants to understand the effects of visibility in urban life, politics, and the media. (shrink)

In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. The main aim of this paper is to revisit the curve fitting problem using the reliability of inductive inference as a primary criterion for the ‘fittest' curve. Viewed from this perspective, it is argued that a crucial concern with the current framework for addressing the curve fitting problem is, on the one hand, the undue influence of the mathematical approximation perspective, and on the other, the insufficient attention paid to the statistical modeling aspects of the problem. Using goodness-of-fit as the (...) primary criterion for ‘best', the mathematical approximation perspective undermines the reliability of inference objective by giving rise to selection rules which pay insufficient attention to ‘accounting for the regularities in the data'. A more appropriate framework is offered by the error-statistical approach, where (i) statistical adequacy provides the criterion for assessing when a curve captures the regularities in the data adequately, and (ii) the relevant error probabilities can be used to assess the reliability of inductive inference. Broadly speaking, the fittest curve (statistically adequate) is not determined by the smallness if its residuals, tempered by simplicity or other pragmatic criteria, but by the nonsystematic (e.g. white noise) nature of its residuals. In empirical modeling, an important desiderata for deeming theoretical entities and processes as real is that they can be reproducible in a statistical sense. Current day crises regarding replicability in science intertwines with the question of how statistical methods link data to statistical and substantive theories and models. Different answers to this question have important methodological consequences for inference, which are intertwined with a contrast between the ontological commitments of the two types of models. The key to untangling them is (...) the realization that behind every substantive model there is a statistical model that pertains exclusively to the probabilistic assumptions imposed on the data. It is not that the methodology determines whether to be a realist about entities and processes in a substantive field. It is rather that the substantive and statistical models refer to different entities and processes, and therefore call for different criteria of adequacy. (shrink)

This essay seeks to examine the history of the intellectual comradeship between J.L. Talmon and the philosopher, political thinker, and historian of ideas, Isaiah Berlin (1909–1997). The scholarly dialog between the two began in 1947, continued until Talmon's death in 1980, and is well documented in their private correspondence. I argue that there were two levels to this dialog: First, both Berlin and Talmon took part in the Totalitarianism discourse, which was colored by Popperian terminology, and thus I claim that (...) their ideas should be examined as part of the Cold-War political discourse. The second level stemmed from their similar East-European origin, their mutual Jewish identity, and their attitude towards the Zionist movement. At times the two levels of discourse conjoined commensurably, but in other cases the juxtaposition of the two created conceptual tensions. Examining Berlin and Talmon's thought from this dual perspective, I argue, can shed new light on the inner conflicts and conceptual tensions that each of them had to face. In particular, I claim that both thinkers tried to integrate their Anglophile liberal heritage with their support of National movements in general, and the Jewish National movement in particular. Nevertheless, the different approaches of Talmon and Berlin present two concepts of liberal Nationalism: While Talmon assumed that Zionism solved the Jewish individual's dilemmas by making Jews members of a commune attached to soil; Berlin sought to preserve the individual in an inviolable sphere and thus was more ambivalent in his attitude towards the state of Israel. In conclusion, I offer to see Talmon as a classic Zionist liberal and Berlin as a supporter of what I call “Diaspora Zionism”, an approach, which would later provide the grounds for Berlin's celebrated pluralism. This essay examines Isaiah Berlin's ambivalent relationship with the ideas and practices of Jewish nationalism and the ways in which this ambivalence shaped some of the key premises of his political thought. Drawing upon extensive archival research in his unpublished letters from the mid-1930s to the late 1950s, this essay reconstructs Berlin's attempt to reconcile himself with the national idea. This attempt forced him to enrich his liberalism, and pushed him to develop and adopt the Jewish normalization discourse. In the (...) course of those intra-Jewish debates Berlin also began to conceptualize freedom as an opportunity concept, an idea that would later become central both in Berlin's famous negative concept of freedom and in his pluralism. Adopting a dual perspective, which considers Berlin as both a British liberal and a Russian-Jewish émigré intellectual, I therefore offer to see the Jewish Zionist writings as complementary rather than secondary to Berlin's enterprise.
