The development of clinical ethic support in the UK arguably brings with it a series of legal questions, which need to be addressed. Most particularly, these concern questions of due process and formal justice, which I argue are central to the provision of appropriate ethical advice. In this article, I will compare the UK position with the more developed system in the USA, which often provides a template for development in the UK. While it is not argued that the provision (...) of clinical ethics support in the UK will necessarily follow the path mapped in the USA, there are lessons that can be learned from the US experience – particularly in terms of attention to process – from which UK clinical ethics support service might well benefit. As support for clinical ethics committees in the UK grows, care must be taken to define their function, membership and method of working and the status of their decisions.The modern practice of medicine raises a plethora of complex issues—medical, ethical and legal. Doctors and other healthcare professionals increasingly must try to resolve these and may sometimes have to do so in the face of contrary opinion expressed by patients and/or their surrogates. While clearly qualified in the medical arena, and although (...) there is now more ethics teaching in the medical curriculum, healthcare professionals are seldom qualified to adjudicate on ethical or legal matters, or even, perhaps, to recognise them when they arise. Yet, as Doyal says, “clinical life must go on and moral and legal indeterminacy within medicine cries out for practical resolution.”1 Meanwhile, the expectations of patients and their families—and, indeed, of wider society—are that decisions about patient care, resources and therapeutic regimes should be soundly based on appropriate ethicolegal, as well as scientific, principle.Recognition of these additional burdens on healthcare professionals has generated some interest in the provision of ethics consultation. In the USA this has been undertaken by a variety of tribunals and individuals. Hospital ethics committees and ethics consultants feature in many US hospitals and perform a variety of roles. In Europe, a number of countries have also established clinical ethics committees and they are becoming more common in the UK—primarily in England and Wales for the moment. Whereas, however, “[i]n North America, CECs have … become an integral part of the organisational infrastructure of hospitals ...”,1 in the United Kingdom they remain essentially ad hoc bodies, generated for a variety of reasons and with different goals, structures, membership, methods of working and functions. Despite a long history in eastern and western culture of defining leadership in terms of virtues and character, their significance for guiding leader behavior has largely been confined to the ethics literature. As such, agreement concerning the defining elements of virtuous leadership and their measurement is lacking. Drawing on both Confucian and Aristotelian concepts, we define virtuous leadership and distinguish it conceptually from several related perspectives, including virtues-based leadership in the Positive organizational behavior literature, and from ethical and value-laden leadership. (...) Then, two empirical studies are presented that develop and validate the Virtuous Leadership Questionnaire, an 18-item behaviorally based assessment of the construct. Among other findings, we show that the VLQ accounts for variance in several outcome variables, even after self-assessed leader virtue and subordinate-rated social and personalized leader charisma are controlled. An essential and neglected distinction between contract and administrative law is in how each conceives of the Crown as a juristic person. This article explores the extent of this distinction, and its implications for the rule of law and the separation of powers. It offers explanations—historical, jurisprudential and pragmatic—for why contract law conceives of the Crown as a corporation aggregate with the powers and liberties of a natural person, and why administrative law disaggregates the State into named officials.

The emergence of a conception of the marketing firm (Foxall, 1999a) conceived within behavioral psychology and based on a corresponding model of consumer choice, (Foxall, 1990/2004) permits an assessment of the levels of behavioral and organizational analysis amenable to neuroscientific examination. This paper explores the ways in which the bilateral contingencies that link the marketing firm with its consumerate allow appropriate levels of organizational neuroscientific analysis to be specified. Having described the concept of the marketing firm and the model of (...) consumer behavior on which it is based, the paper analyzes bilateral contingencies at the levels of (i) market exchange, (ii) emotional reward, and (iii) neuroeconomics. Market exchange emerges as a level of analysis that lends itself predominantly to the explanation of firm—consumerate interactions in terms of the super-personal level of reinforcing and punishing contingencies: the marketing firm can be treated as a contextual or operant system in its own right. However, the emotional reward and neuroeconomic levels of analysis should be confined to the personal level of analysis represented by individual managers on the one hand and individual consumers on the other. This also entails a level of abstraction but it is one that can be satisfactorily handled in terms of the concept of bilateral contingency. (shrink)

We discuss the looming possibility of mass unemployment triggered by AI and the societal repercussions of this transition. Despite the challenges this shift presents, we argue that it also unveils opportunities to mitigate social inequalities, combat global poverty, and empower individuals to follow their passions. Amidst this discussion, we also touch upon the existential question of the purpose of (...) human life in a world where machines predominantly perform work. Additionally, we explore the contentious issue of the moral status and rights of AI entities, contemplating the scenario where machines evolve to become sapient and sentient. The paper concludes with a call to action, emphasizing the necessity to acknowledge these potential outcomes and proactively seek solutions, as part of an inevitable journey through the evolution of human society shared with intelligent machines. He examines the prospects for adapting to the geometric case the standard philosophical accounts of the related notion of physical possibility, with particular emphasis on Humean, primitivist, and necessitarian accounts of physical and geometric possibility. This contribution to the debate concerning the nature of space will be of interest not only to philosophers and metaphysicians concerned with space and time, but also to those interested in laws (...) of nature, modal notions, or more general issues in ontology. ABSTRACT This essay is a critical study of Jason Brennan's Against Democracy. We make three main points. First, we argue that Brennan's proposal of a right to competent government only works if one considers the absence of government a viable proposition, something most of his opponents are not prepared to do. Second, we suggest that Brennan's account of competent decision-making is blind to forms of oligarchic power that work against the very ideals of justice and epistemic virtue that competence is (...) meant to safeguard. Third, we muster empirical evidence to argue that, in the real world, democracy is not just about making decisions and selecting policies, in which case Brennan's argument misses its mark. (shrink)

In recent work, Peter Hanks and Scott Soames argue that propositions are types whose tokens are acts, states, or events. Let’s call this view the type view. Hanks and Soames think that one of the virtues of the type view is that it allows them to explain why propositions have semantic properties. But, in this paper, we argue that their explanations aren’t satisfactory. In Section 2, we present the type view. In Section 3, we present one explanation—due to Hanks (2007, (...) 2011) and Soames (2010)—of why propositions have semantic properties. We criticize this first explanation in Section 4. The rapid rise of varieties of historicism in Germany, during the mid- to late-nineteenth century, and subsequently in England and America, resulted in a radical transformation of the principles of coherence and methods of analysis within biblical studies.1This paper will argue that the foundational ‘subject/object’ metaphysics of historicism has been subverted over the past century. For this reason, historical positivism should no longer be accorded the status of ‘normative paradigm’ and ‘gatekeeper’ over and against other interpretive approaches. This paper next (...) lays out five principles for a renewed practice of historical inquiry. It argues, first, that historical inquiry continues to serve a vital function within biblical studies in its ability to call attention to historical difference, and, thereby, to contribute to a strategy of resistance to ideology and to totalizing theories; second, that the traditional appeal to historical ‘context’ and ‘author’ in the interpretation of texts continues to be a useful practice – despite the provisional and constructed nature of both – as a way of taking into account extra-lingual reference and of avoiding presentism; third, that the substitution of new ‘grand narratives’ of Christian origins in place of the (quasi-theological) ‘historical’ narrative of traditional Christianity – under the claim of historical objectivity – should be abandoned because the very concept of ‘origins’ is the result of a literalizing of a metaphor. Such totalizing narratives always reduce history's inherent polycentricism. Fourth, I will argue that the continued use of historicism in the antiquarian attempt to reconstruct the past, disconnected from both a quest for social justice and a desire for personal self-creation, represents a form of thought that alienates scholars from themselves and from their real material contexts. Finally, and following on the previous point, this paper submits that the practice of historical analysis has an ethical dimension by virtue of the fact that the personhood of the biblical historian is indissolubly linked to other dimensions of life including the social and ethical aspects of life. These added dimensions complicate the making of choices, which is implicit within all practices of interpretation. These five principles are here suggested as points of departure for the reconceptualization of the scope and function of historical inquiry within the discipline of New Testament studies. (shrink)

This paper is concerned with the relation between two notions: that of two solutions or models of a theory being related by a symmetry of the theory and that of solutions or models being physically equivalent. A number of authors have recently discussed this relation, some taking an optimistic view, on which there is a suitable concept of the symmetry of a theory relative to which these two notions coincide, others taking a pessimistic view, on which there is no such (...) concept. It is often said that the Aharonov-Bohm effect shows that the vector potential enjoys more ontological significance than we previously realized. But how can a quantum-mechanical effect teach us something about the interpretation of Maxwell's theory—let alone about the ontological structure of the world—when both theories are false? I present a rational reconstruction of the interpretative repercussions of the Aharonov-Bohm effect, and suggest some morals for our conception of the interpretative enterprise.

Individual differences in the mere willingness to think analytically has been shown to predict religious disbelief. Recently, however, it has been argued that analytic thinkers are not actually less religious; rather, the putative association may be a result of religiosity typically being measured after analytic thinking (an order effect). In light of this possibility, we report four studies in which a negative correlation between religious belief and performance on analytic thinking measures is found when religious belief is measured in a (...) separate session. We also performed a meta-analysis on all previously published studies on the topic along with our four new studies (N = 15,078, k = 31), focusing specifically on the association between performance on the Cognitive Reflection Test (the most widely used individual difference measure of analytic thinking) and religious belief. This meta-analysis revealed an overall negative correlation (r) of -.18, 95% CI [-.21, -.16]. Although this correlation is modest, self-identified atheists (N = 133) scored 18.7% higher than religiously affiliated individuals (N = 597) on a composite measure of analytic thinking administered across our four new studies (d = .72). Our results indicate that the association between analytic thinking and religious disbelief is not caused by a simple order effect. There is good evidence that atheists and agnostics are more reflective than religious believers. (shrink)

The new regulations on xenotransplantation pay insufficient attention to the broad ethical problems raised by this technique and that the abandonment of a national body with overall regulatory authority in this area is a mistake.Following reports from the Nuffield Council on Bioethics1 and, most importantly, the Advisory Group on the Ethics of Xenotransplantation2 , the UK Xenotransplantation Interim Regulatory Authority was established in 1997. The existence of a national body to govern xenotransplantation was deemed to be of critical importance by (...) the Kennedy report given the practical and ethical issues associated with xenotransplantation. Indeed, the Kennedy report recommended that ultimately UKXIRA should be placed on a statutory footing.2 The remit of UKXIRA was to advise the Secretary of State on particular applications, gather information on issues such as safety, and assess whether the preconditions identified by the Kennedy report had been met.3In December 2006, UKXIRA was quietly disbanded, and the Department of Health issued a statement of guidance, the terms of which now govern xenotransplantation in the UK. This document superseded procedures that had been in place since 1998, which had placed the overall regulation of applications to conduct xenotransplantation in the hands of UKXIRA and, ultimately, the Secretary of State.4 The revised guidance defines xenotransplantation as being: “… any procedure that involves the transplantation, implantation, or infusion into a human recipient of either live tissues or organs retrieved from animals, or, human body fluids, cells, tissue or organs that have undergone ex vivo contact with live non-human animal cells, tissues or organs.”5 . Intuitively, a classical field theory is background-in- dependent if the structure required to make sense of its equations is itself subject to dynamical evolution, rather than being imposed ab initio. The aim of this paper is to provide an explication of this intuitive notion. Background-independence is not a not formal property of theories: the question whether a theory is background-independent depends upon how the theory is interpreted. Under the approach proposed here, a theory is fully background-independent relative to an interpretation (...) if each physical possibility corresponds to a distinct spacetime geometry; and it falls short of full background-independence to the extent that this condition fails. It is widely thought that chance should be understood in reductionist terms: claims about chance should be understood as claims that certain patterns of events are instantiated. There are many possible reductionist theories of chance, differing as to which possible pattern of events they take to be chance-making. It is also widely taken to be a norm of rationality that credence should defer to chance: special cases aside, rationality requires that one’s credence function, when conditionalized on the chance-making facts, should (...) coincide with the objective chance function. It is a shortcoming of a theory of chance if it implies that this norm of rationality is unsatisfiable. The primary goal of this paper is to show, on the basis of considerations concerning computability and inductive learning, that this shortcoming is more common than one would have hoped. (shrink)

The patient-doctor relationship has recently come under intense scrutiny, resulting in a re-evaluation of the basis of that relationship. The papers by Glannon and Ross, and McKay seek to identify the sources of authority in the patient-doctor relationship by evaluating it in terms of the concept of altruism. In this paper I argue that the analysis of Glannon and Ross, and of McKay is unnecessary and that the analysis offered by the latter is also flawed. I do acknowledge, however, that (...) Glannon and Ross's description of doctors' responsibilities and patients' roles has much to commend it. (shrink)

The most discussed and most significant issue on the religious scene today is whether it is possible, or even desirable, to believe in God. Mr. Kaufman's valuable study does not offer a doctrine of God, but instead explores why God is a problem for many moderns, the dimensions of that problem, and the inner logic of the notion of God as it has developed in Western culture. His object is to determine the function or significance of talk about God: how (...) the concept of God is generated in human experience; the special problems in turn generated by this concept (for example, the intelligibility of the idea of transcendence, the problem of theodicy) and how they are met; and under what circumstances the idea of God is credible or important or even indispensable. He does not try to prove God's existence or nonexistence, but elucidates what the concept of God means and the important human needs it fulfills. Physicists who work on canonical quantum gravity will sometimes remark that the general covariance of general relativity is responsible for many of the thorniest technical and conceptual problems in their field.1 In particular, it is sometimes alleged that one can trace to this single source a variety of deep puzzles about the nature of time in quantum gravity, deep disagreements surrounding the notion of ‘observable’ in classical and quantum gravity, and deep questions about the nature of the existence of spacetime (...) in general relativity. Philosophers who think about these things are sometimes skeptical about such claims. We have all learned that Kretschmann was quite correct to urge against Einstein that the “General Theory of Relativity” was no such thing, since any theory could be cast in a generally covariant form, and hence the general covariance of general relativity could not have any physical content, let alone bear the kind of weight that Einstein expected it to.2 Friedman’s assessment is widely accepted: “As Kretschmann first pointed out in 1917, the principle of general covariance has no physical content whatever: it specifies no particular physical theory; rather, it merely expresses our commitment to a certain style of formulating physical theories” (1984, p. 44). Such considerations suggest that general covariance, as a technically crucial but physically contentless feature of general relativity, simply cannot be the source of any significant conceptual or physical problems.3 Physicists are, of course, conscious of the weight of Kretschmann’s points against Einstein. Yet they are considerably more ambivalent than their philosophical colleagues. Consider Kuchaˇr’s conclusion at the end of a discussion of this topic. (shrink)

This paper is concerned with learners who aim to learn patterns in infinite binary sequences: shown longer and longer initial segments of a binary sequence, they either attempt to predict whether the next bit will be a 0 or will be a 1 or they issue forecast probabilities for these events. Several variants of this problem are considered. In each case, a no-free-lunch result of the following form is established: the problem of learning is a formidably difficult one, in that (...) no matter what method is pursued, failure is incomparably more common that success; and difficult choices must be faced in choosing a method of learning, since no approach dominates all others in its range of success. In the simplest case, the comparison of the set of situations in which a method fails and the set of situations in which it succeeds is a matter of cardinality (countable vs. uncountable); in other cases, it is a topological matter (meagre vs. co-meagre) or a hybrid computational-topological matter (effectively meagre vs. effectively co-meagre).
