Knowledge of the heterosexual spread of HIV is needed to plan future health-care needs. In December 1989 we gained approval and finance for unlinked anonymous testing of neonatal Guthrie card samples in Scotland. Local ethics committee approval was required before testing could start. Twenty ethics committees were approached in the 15 Scottish health board areas. Nineteen of the committees have agreed, representing 99.6 per cent of births in Scotland. Berkeley's Theory of Vision, or Visual Language Showing The Immediate Presence and Providence of A Deity, Vindicated And Explained was published in 1733, occasioned by an anonymous letter of the previous year to the London Daily Post Boy . The letter criticized Berkeley's New Theory of Vision , which had been published in 1709, but which had been appended to Berekely's Alciphron , published in 1732. No one has ever identified the author whose criticisms led Berkeley to his Theory of (...) Vision Vindicated . Circumstantial evidence presented here suggests that the author was Catherine Trotter Cockburn. Part of the evidence is the brilliance of her interpretation of Locke, whose position is defended in the letter against Berkeley. (shrink)

Cloth, $75.00.Professor Sell’s goal is to discern the impact of Locke’s thought upon the later divines; Sell’s scope is the seventeenth century through the nineteenth century. Most of the text is a detailed descriptive account of various scholars’ reactions (...) to Locke’s epistemology, metaphysics, and views concerning religion. Sell focuses on the question of the relative authority of scripture, reason and revelation. He contends that Locke’s epistemological and political positions are intimately bound up with his Christian faith, that as a conservative empiricist, Locke is “much more the rationalist than he has sometimes been painted” (48). The important question bequeathed by Locke to Christian apologetics is: “can the epistemological starting point be redeemed for Christian apologetic use or is it not viable at all?” (12). Sell addresses this question throughout the following chapters: “Ideas, Knowledge and Truth”; “Reason, Revelation, Faith and Scripture”; “Morality and Liberty”; “Toleration and Government”; and “Christian Doctrine”.Sell notes Locke’s roots in Calvinism, his appreciation of Arminian doctrine and his friendship with a number of prominent Latitudinarians. He argues that most criticisms of Locke’s Reasonableness of Christianity are misguided. During the seventeenth and eighteenth centuries Locke was charged with scepticism, deism, Socinianism and materialism. Sell presents the objections of numerous scholars, notably Bishop Stillingfleet, William Carroll, John Norris, Richard Bentley, Henry Lee, Richard Price, Bishop Berkeley, and Samuel Johnson. He also covers the views of Locke’s defenders, including Anthony Collins, Catharine Cockburn and Samuel Bold.The reader might be disappointed with Sell’s short presentation of an inordinate number of Lockean critics; there is little analysis or discussion of the merits of the particular objections cited. He does offer an analysis of the general charges against Locke, but rarely quotes Locke sufficiently to justify his conclusion that Locke was not a deist, sceptic, or materialist. Sell simply takes Locke’s word for it. This book is best taken as an excellent reference guide.Sell contends that in spite of Locke’s friendship with deists such as Collins, Locke’s Reasonableness of the Christian Religion was written to dissolve the deist prejudice against Christianity. He dismisses the charge of deism because: (1) Locke argues for revelation and against natural religion, (2) Locke’s God possesses the traditional attributes assigned to him (power, omniscience, providence), (3) Locke grounds morality not exclusively in natural law, as did deists, but in the gospel, (4) the anti-materialist thrust of Book IV, Chapter X of the Essay, and (5) Locke’s argument that there can be truths of revelation which are above reason. Sell concludes that the “main problem posed to Locke by the deists was that of guilt by association” (209), in other words Locke’s work was misused for political reasons.Sell considers the charge of Socinianism more serious than that of deism. Socinianism is defined by its denial of the Trinity, and by the claims that there cannot be an innate idea of God, that there is no original corruption deriving from Adam, that the wicked will not suffer eternal torments, and that some bodies are not raised at general resurrection. Despite Locke’s agreement with most Socinian claims, Sell claims that [End Page 631] Locke cannot be pinned down on the issue of the Trinity. Her work covers the early modern philosophy of Elisabeth of Bohemia, Margaret Cavendish, (...) Ann Conway, Mary Astell, Damaris Cudworth Masham and Catherine Trotter Cockburn. She points out the paradoxical relationship between current feminist philosophy and the writings of early Modern women. Broad concentrates on the metaphysical issues of mind-body dualism, thinking matter, and the role of reason in knowledge.Recent feminists have argued that even though Cartesianism appears to emphasize an egalitarian concept of reason, it entails a male bias which excludes women from philosophy. Broad covers the work of Genevieve Lloyd, Hilda Smith, Margaret Atherton and other feminists. Her goal is to show that the common Cartesian interpretation of early women's writings obscures the anti-Cartesian and anti-dualist aspects of their thought. Like Lloyd, she argues that historically women were associated with a lesser form of reason following the rise of Cartesianism.The conflict between reason and femininity is noted in the complexity of early Modern thought. Broad argues that even though Elisabeth is remembered as a critic of Descartes, many of her suggestions are not as anti-dualist as some scholars believe. On the basis of her letters she contends that Elisabeth can be regarded as a precursor to feminist philosophers who give an equal role to the body and emotions in their metaphysical and ethical writings.Like Elisabeth, Margaret Cavendish rejects Cartesian dualism. The common thread that runs through early Modern feminist philosophy is the argument that interaction between two unlike substances is inconceivable. Broad argues that like Cavendish, Anne Conway ascribes spiritual characteristics to the body and material properties to the soul. According to Broad, their ontological views amount to a rejection of the stereotypes of femininity.Broad argues that Mary Astell's metaphysical views diverge from the modern Cartesians of her time. Although she is indebted to Descartes, Broad contends that she supports a metaphysical system which avoids some of the gender biases identifiable in Cartesianism. Astell, for example, does not find a life based on reason as a rival to a life concerned with the body; her emphasis on rationality is simply a reaction to the stereotype of women as irrational material beings.Damaris Masham is generally considered a philosophical rival of Astell, but Broad argues that Masham's arguments are focused on the same presuppositions as Astell's. She argues that both philosophers champion women's education, criticize the occasionalism of Norris and believe in interaction between the corporeal and incorporeal worlds. Broad emphasizes the common theological outlook inspired by Cambridge Platonism. Contrary to the interpretation of Ruth Perry, she finds that there is sufficient evidence that Masham was positively inspired by the second part of Astell's Serious Proposal.Broad concludes with an analysis of Catherine Cockburns' metaphysics and moral philosophy. According to Cockburn, women's ignorance is simply the result of being discouraged from rational pursuits. The McNaughton rules for determining whether a person can be successfully defended on the grounds of mental incompetence were determined by a committee of the House of Lords in 1843. They arose as a consequence of the trial of Daniel McNaughton for the killing of Prime Minister Sir Robert Peel’s secretary. In retrospect it is clear that McNaughton suffered from schizophrenia. The successful defence of McNaughton on the grounds of mental incompetence by his advocate Sir Alexander Cockburn involved a (...) profound shift in the criteria for such a defence, and was largely based on the then recently published scientific thesis of the great US psychiatrist Isaac Ray, entitled A Treatise on the Medical Jurisprudence of Insanity. Subsequent discussion of this defence in the House of Lords led to the McNaughton rules, still the basis of the defence of mental incompetence in the courts of much of the English-speaking world. This essay considers one of these rules in the light of the discoveries of cognitive neuroscience made during the 160 years since Ray’s treatise. A major consideration is the relationship between the power of self-control and irresistible impulse as conceived by Cockburn on the one hand, and by cognitive neuroscience on the other. The essay concludes with an analysis of the notion of free will and of the extent to which a subject can exert restraint in the absence of particular synaptic connections in the brain. (shrink)

It is widely assumed that there is some form of logical tension between the idea that everything that happens happens of necessity and the idea that people are sometimes responsible for what they do. If there is such a tension it ought to be possible to characterize the notions of necessity and responsibility in a way such that the incompatibility is transparent.

An important thinker who contributed to eighteenth-century debates in epistemology, metaphysics, and ethics, Catharine Trotter Cockburn pursued the life of a dramatist and essayist, despite the prevailing social, cultural, and moral prescriptions of her day. Cockburn’s philosophical writings were polemical pieces in defence of such philosophers as John Locke and Samuel Clarke, in which she grappled with the moral and theological questions that concerned them and produced her own unique answers to those questions. Her works are interesting both (...) for their approach to philosophical issues that continue to be debated today and for the way that they inform our understanding of the early-modern period. ‘Only of a living human being and what resembles a living human being can one say: it has sensations; it sees; is blind; hears, is deaf; is conscious or unconscious’. 1 ‘The human body is the best picture of the human soul’. Anyone who believes that Wittgenstein's remarks here embody important truths has quite a bit of explaining to do. What needs to be explained is why it is that enormous numbers of people, people who have never had the chance (...) to be corrupted by reading Descartes or Dennett, are willing, with only the slightest prompting, to speak in ways which appear to conflict dramatically with Wittgenstein's thought. Many people appear to find no difficulty at all in the idea that we could ascribe thoughts, sensations, emotions and so on to things which in no way resemble or behave like a living human being—for example to disembodied ‘minds’ or ‘souls’ or disembodied brains floating in tanks. And with a little more pressing many will agree that it is never to the living human being that these states are, strictly speaking, correctly ascribed; but, rather, to one part of the living human being—the brain, for example. Now if this incredibly widespread tendency is the expression of confusion then we need an explanation of its existence. We need this partly because without it it will be difficult to undermine the tendency; and partly because we might expect that such a widespread tendency is a distortion of some truth. (shrink)

Untangling the Surrogacy WebSurrogacy agreements represent unique legal questions that must be answered with great care. In Australia we had the recent “Baby Gammy” scandal that involved an international surrogacy agreement and claims of abandonment of a child with Down’s syndrome. This story served to reinforce concerns that surrogacy turns children into a commodity that can be put to one side if expectations are not met. Of course, surrogacy agreements do not always end in this manner and often the outcome (...) is positive. There are, however, underlying legal questions regarding the status of the child, with some children, born as the result of international surrogacy agreements, being practically stateless when the nation of the commissioning parents refuses to issue passports to allow the children to return “home” with their “parents.” Where the relationship is local, however, and there is clear legislation, the issues can be less problematic but can become complex where a party wishes .. In its treatment of capital punishment Amnesty International gives a central place to the suffering of the prisoner. Two quite distinct forms of suffering are relevant here. There is the psychological anguish of the person awaiting execution; and there is the physical suffering which may be involved in the execution itself. It is suggested that if we reflect clearly on this suffering we will conclude that the death penalty involves cruelty of a kind which makes it quite unacceptable. It is (...) to be condemned on the same ground as torture is to be condemned: on the ground, that is, that it involves the infliction of an unacceptable degree of suffering. (shrink)

We view things from a certain position in time: in our language, thought, feelings and actions, we draw distinctions between what has happened, is happening, and will happen. Frequently, approaches to this feature of our lives - those seen in disputes between tensed and tenseless theories, between realist and anti-realist treatments of past and future, and in accounts of historical knowledge - embody serious misunderstandings of the character of the issues; they misconstrue the relation between metaphysics and ethics, and the (...) way to characterize the kind of sense which tensed language has. David Cockburn argues that the notion of 'reasons for emotion' must have a central place in any account of meaning, and that the present should have no priority in our understanding of tense. This allows for a more satisfactory articulation of the place of past, present and future in our thought, and of the form which criticism of our thought might take. (shrink)

For the theorists of crisis, the revolutionary state comes into existence through violence, and due to its inability to provide an authoritative katechon (restrainer) against internal and external violence, it perpetuates violence until it self-destructs. Writing during extreme economic depression and growing social and political violence, the crisis theorists––Joseph de Maistre, Juan Donoso Cortés, and Carl Schmitt––each sought to blame the chaos of their time upon the Janus-faced postrevolutionary ideals of liberalism and socialism by urging a return to pre-revolutionary moral (...) and religious values. They are united by three counterrevolutionary principles, all of which are purported to remedy revolutionary violence: traditional constitutional fidelity, the philosophy of the decision, and opposition to bourgeois liberalism. This essay is followed by the first complete English translation and publication of Donoso’s letter of October 24, 1851, which contains Donoso’s only reference to the “discussing class,” a political entity later popularized by Schmitt in his 1922 work Political Theology. In much of the current academic and public discussion, conspiracy theories are portrayed as a negative phenomenon, linked to misinformation, mistrust in experts and institutions, and political propaganda. Rather surprisingly, however, philosophers working on this topic have been reluctant to incorporate a negatively evaluative aspect when either analyzing or engineering the concept conspiracy theory. In this paper, we present empirical data on the nature of the concept conspiracy theory from five studies designed to test the existence, prevalence and exact form (...) of an evaluative dimension to the ordinary concept conspiracy theory. These results reveal that, while there is a descriptive concept of conspiracy theory, the predominant use of conspiracy theory is deeply evaluative, encoding information about epistemic deficiency and often also derogatory and disparaging information. On the basis of these results, we present a new strategy for engineering conspiracy theory to promote theoretical investigations and institutional discussions of this phenomenon. We argue for engineering conspiracy theory to encode an epistemic evaluation, and to introduce a descriptive expression—such as ‘conspiratorial explanation’—to refer to the purely descriptive concept conspiracy theory. The author argues that a view of what a person is cannot be separated from our view of how another person is to be treated. What is needed is an acknowledgement of the tangible, persisting human being--a being with a distinctive bodily form and having its own distinctive kind of value--as a fundamental feature of our thought.

We may think of the notion of “trust” primarily in epistemological terms or, alternatively, primarily in ethical terms. These different ways of thinking of trust are linked with different ways of picturing language, and my relation to the words of another. While an analogy with an individual continuing an arithmetical series has had a central place in discussions of language originating from Wittgenstein, Rush Rhees suggests that conversation provides a better model for thinking about language. Linking this with Knud Løgstrup’s (...) suggestion that “In its basic sense trust is essential to every conversation”, the paper develops the idea of speech as fundamentally a form of contact between human beings. With that, the constraints on which we need to focus if we are to grasp the nature of conversation are not, as in Grice’s influential treatment, maxims whose observance will aid the pursuit of certain general human ends. The relevant constraints are, rather, limits on our goal-directed activity: limits that are fundamental to our relations with others. It is within this framework that we must understand the form of “trust” that is central to conversation. (shrink)

This book differs from others by rejecting the dualist approach associated in particular with Descartes. It also casts serious doubt on the forms of materialism that now dominate English language philosophy. Drawing in particular on the work of Wittgenstein, a central place is given to the importance of the notion of a human being in our thought about ourselves and others.

The central claim of this book is that the dichotomy between economic dependence and economic independence is completely inadequate for describing the political challenges faced by contemporary capitalist welfare states. The simplistic contrast between markets and states as sources of income renders invisible the relations of dependence established in our basic economic institutions such as the family, property, and money. This book is a work of political theory that attacks narrow conceptions of dependence and identifies distinct senses of dependence that (...) might allow political communities to make clearer decisions about the justice of our economic institutions and practices. Inheritance, for example, is as much a form of dependence as support by a welfare state, but these are never compared in debates about economic justice. This book begins the work of comparing forms of economic dependence, and argues that economic dependence is always an issue of both vulnerability and parasitism. It builds bridges between political theory and social science, and is of relevance to those concerned with social and economic justice in and beyond contemporary capitalist welfare states. (shrink)

For several decades, public political discourses on ‘welfare dependency’ have failed to recognise that welfare states are not the source of economic dependence, but rather reconfigure economic dependencies in a specific way. This article distinguishes four senses of ‘economic dependence’ that can help to clarify what is missing from these discourses, and what is at stake in political and legal decisions about how we may economically depend upon one another. While feminist, republican and egalitarian philosophical work has examined the problems (...) of dependence on states, in families and in markets, the present approach adds a further dimension to our cultural and political concerns with economic dependence: it argues that it is reasonable and useful to consider the economic dependence of the economically powerful. Doing so requires a clarification of the ‘varieties of dependence’ that exist in contemporary societies and economies, and the recognition that legal and political choices regarding social and economic justice are often about choosing between varieties of dependence, not about escaping dependence entirely.
