En el artículo se plantea que la libertad de expresión es vulnerada de manera distinta a los escenarios tradicionales en razón del uso del Big Data y otras tecnologías como el análisis predictivo de datos y la personalización de contenido. Esta vulneración resulta diferente de la habitual puesto que no existe imposibilidad o limitación a expresar lo que se quiere de manera espontánea, sino que, la libertad de expresión se ve coartada ex ante a través de la generación de circunstancias (...) en las que lo que se expresa viene dado previamente a través de información adecuada de manera personalizada según el perfil de quien opina. Para lograr presentar esta tesis, se efectúa un marco de referencia en el que este fenómeno se contextualiza. Al final se realiza una propuesta para disminuir o eliminar esta vulneración a la libertad de expresión. (shrink)

AI-based technologies are increasingly pervasive in a number of contexts. Our affective and emotional life makes no exception. In this article, we analyze one way in which AI-based technologies can affect them. In particular, our investigation will focus on affective artificial agents, namely AI-powered software or robotic agents designed to interact with us in affectively salient ways. We build upon the existing literature on affective artifacts with the aim of providing an original analysis of affective artificial agents and their distinctive (...) features. We argue that, unlike comparatively low-tech affective artifacts, affective artificial agents display a specific form of agency, which prevents them from being perceived by their users as extensions of their selves. In addition to this, we claim that their functioning crucially depends on the simulation of human-like emotion-driven behavior and requires a distinctive form of transparency—we call it emotional transparency—that might give rise to ethical and normative tensions. Why are mistaken beliefs about Covid-19 so prevalent? Political identity, education and other demographic variables explain only a part of individual differences in the susceptibility to Covid-19 misinformation. This paper focuses on another explanation: epistemic vice. Epistemic vices are character traits that interfere with acquiring, maintaining, and transmitting knowledge. If the basic assumption of vice epistemology is right, then people with epistemic vices such as indifference to the truth or rigidity in their belief structures will tend to be more susceptible (...) to believing Covid-19 misinformation. We carried out an observational study (US sample, n = 998) in which we measured the level of epistemic vice of participants using a novel Epistemic Vice Scale. We also asked participants questions eliciting the extent to which they subscribe to myths and misinformation about Covid-19. We find overwhelming evidence to the effect that epistemic vice is associated with susceptibility to Covid-19 misinformation. In fact, the association turns out to be stronger than with political identity, educational attainment, scores on the Cognitive Reflection Test, personality, dogmatism, and need for closure. We conclude that this offers evidence in favor of the empirical presuppositions of vice epistemology. (shrink)

According to some views, natural language suffers from underdeterminacy, but thought doesn’t. According to the underdeterminacy claim, sentence types underdetermine the truth-conditions of sentence tokens. In particular, the semantics of a predicate type seems to underdetermine the satisfaction conditions of its tokens. By contrast, mental representation-types are supposed to determine the truth-conditions of its tokens. In this paper I critically examine these mixed views. First, I argue that the arguments supporting the indispensability of including in one’s theory mental representations that (...) are free of the underdeterminacy exhibited by natural language are not sound. As a result, the possibility that mental representation-types are as underdetermined as natural language sentence-types has not been ruled out. Second, I argue that Carston’s ad hoc concept-types are as underdetermined as word-types. I finish by arguing that mental representations are also underdetermined in a second sense—mental representation-tokens only determine a partial function from possible worlds to truth-values. According to the extended cognition thesis, an agent’s cognitive system can sometimes include extracerebral components amongst its physical constituents. Here, we show that such a view of cognition has an unjustifiably anthropocentric focus, for it tends to depict cognitive extensions as a human-only affair. In contrast, we will argue that if human cognition extends, then the cognition of many non-human animals extends too, for many non-human animals rely on the same cognition-extending strategies humans rely on. To substantiate this claim, we (...) will proceed as follows. First (Sect. 1), we will introduce the extended cognition thesis, exposing its anthropocentric bias. Then, we will show that humans and many non-human animals rely on the same cognition-extending strategies. To do so, we will discuss a variety of case studies, including “intrabodily” cognitive extensions such as the spinal cord (Sect. 2), the widespread reliance on epistemic actions to solve cognitive tasks (Sect. 3) and cases of animal cognitive offloading (Sect. 4). We’ll then allay some worries our claim might raise (Sect. 5) to then conclude the paper (Sect. 6). (shrink)

The classification of medical interventions as either invasive or non-invasive is commonly regarded to be morally important. On the most commonly endorsed account of invasiveness, a medical intervention is invasive if and only if it involves either breaking the skin (‘incision’) or inserting an object into the body (‘insertion’). Building on recent discussions of the concept of invasiveness, we show that this standard account fails to capture three aspects of existing usage of the concept of invasiveness in relation to medical (...) interventions—namely, (1) usage implying that invasiveness comes in degrees, (2) that the invasiveness of an intervention can depend on the characteristics of the salient alternative interventions, and (3) that medical interventions can be invasive in non-physical ways. We then offer the beginnings of a revised account that, we argue, is able to capture a wider range of existing usage. Central to our account is a distinction between two properties: basic invasiveness and threshold invasiveness. We end by assessing what the standard account gets right, and what more needs to be done to complete our schematic account. (shrink)

A view that emancipates free will by means of quantum indeterminism is frequently rejected based on arguments pointing out its incompatibility with what we know about quantum physics. However, if one carefully examines what classical physical causal determinism and quantum indeterminism are according to physics, it becomes clear what they really imply–and, especially, what they do not imply–for agent-causation theories. Here, we will make necessary conceptual clarifications on some aspects of physical determinism and indeterminism, review some of the major objections (...) against libertarian conjectures, and show that there is no conceptual incompatibility preventing us from taking a ‘quantum-libertarian’ approach to the problem of free will. In particular, we will illustrate the possible role of self-causation (causa sui) as a potential solution to otherwise apparently incompatible or even paradoxical statements concerning free will and quantum indeterminism. The abrupt beginning of the Philebus refers to the abrupt interruption of the dialogue with Callicles in the Gorgias. The reuse of the phrase αὐτὸς γνώσῃ (Phlb. 12a9 = Gorg. 505c9), unique in Plato, is an evident sign of the will to connect the two texts and contexts. Both of them deal with the problem of the interruption of the philosophical dialogue. The absolute lack of contextualization and the ‘open’ conclusion in the Philebus are consistent with this framework. The continuity (...) with the Gorgias is also a fundamental reason why Socrates returns as protagonist in a late dialogue. It also allows us to put forward a hypothesis on the identity of Philebus, an emblematic character like Callicles. (shrink)

Gorgias, the teacher of Isocrates, is rarely mentioned in Isocrates’ works and never in a flattering way. He is also presented, among other masters and poets, on Isocrates’ grave in a way that appears to be consistent with his pupil’s thought. Thus, the author of the iconographic plan of the grave may have been either Isocrates himself or someone who suffi­ciently knew his works and properly understood his tempestuous rela­tionship with his master.

This pragmatic content is sometimes identified with speaker meaning or with the thought the speaker intends to express. I will argue that given the sociolinguistic role of utterance content—the fact it provides reasons for action, liabilities and entitlements—locutionary content should not be modelled as a variety of speaker meaning.

In this article, I address a controversial aspect of Rawls’s treatment of the question of justice between generations: how the parties in the original position could be motivated to select Rawls’s preferred principle of intergenerational savings, which he dubs the just savings principle. I focus on the explanation found in his later work, where he proposes that the correct savings principle is the principle that any generation would have wanted preceding generations to have followed. By expanding upon this explanation, I (...) respond to the objection that this explanation disregards the perspective of the first generation. I demonstrate that this objection ceases to be a concern when a proper account of the parties’ reasoning is developed. What is notable about the explanation I defend is that it relies on the parties adopting maximax – not maximin – as a rule for rational decision making. Having established this intermediary conclusion, I depart with Rawls and consider what savings principle the parties would choose if given more options. Ultimately, I argue that the parties would select a principle that Rawls would have undoubtedly rejected if presented to him at face value. This is because the principle of savings I argue would be selected requires continual economic growth over generations to increase upwards indefinitely – a conclusion Rawls is explicitly trying to avoid in his theory of justice. In his 1920 monograph Relativitätstheorie und Erkenntnis apriori the young Reichenbach distinguished between two meanings of the a priori: ‚apodictically valid, true for all time‘ and ‚constituting the concept of object‘. At the end of the 1990s Michael Friedman drew again the attention of philosophers of science to this forgotten distinction. In the spirit of Reichenbach’s early Kantianism Friedman attempted to construct a relativized or temporally variable a priori, which is nevertheless constitutive of the object of knowledge. Friedman rejects an (...) alternative historicized version of the a priori elaborated by the Marburg school and in particular by Cassirer. According to Friedman, Cassirer defended a regulative, but absolute version of the a priori, the existence of a yet-to-be-found set of final principles that are conditions of all scientific experience. This paper suggests that using the constitutive/regulative distinction as a basis for comparison is misleading. In order to understand the Marburg school’s conception of the a priori one should get back to Hermann Cohen’s interpretation of Kant and in particular to his own distinction between two meanings of the a priori. A more suitable comparison is that between Cohen’s opposition metaphysical-vs.-transcendental a priori and Reichenbach’s distinction apodictic-vs.-constitutive a priori. If the comparison is conducted along these lines—as already suggested in the mid-1920 s by the Dutch neo-Kantian Alfred C. Elsbach—it turns out that Cohen and the Marburg school and not Reichenbach provided a good example of a relativized a priori. (shrink)

The aim I am pursuing here is to describe some general aspects of mathematical proofs. In my view, a mathematical proof is a warrant to assert a non-tautological statement which claims that certain objects (possibly a certain object) enjoy a certain property. Because it is proved, such a statement is a mathematical theorem. In my view, in order to understand the nature of a mathematical proof it is necessary to understand the nature of mathematical objects. If we understand them as (...) external entities whose 'existence' is independent of us and if we think that their enjoying certain properties is a fact, then we should argue that a theorem is a statement that claims that this fact occurs. If we also maintain that a mathematical proof is internal to a mathematical theory, then it becomes very difficult indeed to explain how a proof can be a warrant for such a statement. This is the essential content of a dilemma set forth by P. Benacerraf (cf. Benacerraf 1973). Such a dilemma, however, is dissolved if we understand mathematical objects as internal constructions of mathematical theories and think that they enjoy certain properties just because a mathematical theorem claims that they enjoy them. As neuroscience progresses, we will not only gain a better understanding of how our brains work, but also a better understanding of how to modify them, and as a result, our mental states. An important question we are faced with is whether the state could be justified in implementing such methods on criminal offenders, without their consent, for the purposes of rehabilitation and reduction of recidivism; a practice that is already legal in some jurisdictions. By focusing on a prominent type (...) of view of free action, which I call bypassing views, this paper evaluates how such interventions may negatively impact the freedom of their subjects. The paper concludes that there will be a tension between the goals of rehabilitation and reduction of recidivism, on the one hand, and the negative impact such interventions may have on free action, on the other. Other things equal, the better that a particular intervention is at achieving the former, the more likely it is to result in the latter. (shrink)

In discussions of nudging, transparency is often taken to be important; it is often suggested that a significant moral consideration to take into account when nudging is whether the nudge is transparent. Another consideration taken to be relevant is whether the nudge is easy to resist. Sometimes, these two considerations are taken to be importantly related: if we have reason to make nudges easy to resist, then we have reason to make them transparent, insofar as a nudge’s transparency is relevant (...) to whether the nudge is easy to resist. In this paper, we critically scrutinize this view. First, we draw out the purported connections between transparency and resistibility, combining them into what we call the Resistibility-to-Transparency Argument (RTA). Then, we do some conceptual groundwork elaborating on different forms of transparency mentioned in the debate. With this in place, we argue that in order to be plausible, the RTA must appeal to certain forms of transparency; those on which the transparency of a nudge depends on the nudgee’s ability to become aware of the relevant facts about the nudge. We then argue against the common assumption that in order for a nudge to be easy to resist for an individual, that individual needs to have the capacity to easily become aware of the relevant nudge facts. We conclude that the connection between the easy resistibility of a nudge and its transparency is, at best, a weak one. (shrink)

Constitutional scholarship has put much emphasis on Montesquieu's principle of separation of powers as developed in the chapter of 'The Spirit of the Laws' devoted to the English constitution (XI, 6). It has also been quite common to mix up this model of separation of powers with elements taken from other sections of Montesquieu's masterpiece. The starting point of this paper is that there is an alternative, second model of separation powers based on the French monarchy of intermediate powers, which (...) is also an instantiation of limited government. From this premise, the paper's aim is to carve out a second version of the principle of separation of powers by focusing on the different role and nature of judicial power in the English and French models. It turns out that the French version of the separation of powers is not based on a strict separation, since it bestows on the higher judicial intermediate bodies both judicial and legislative functions. This also leads to a kind of constitutionalism that is 'in between' ancient and modern, as it is exemplified by Montesquieu's take on the functioning of parliaments. As is typical of his political thought, he sees this intermediate power as representative of traditional and conservative social forces but, at the same time, in virtue of its social status, as an institution which strengthens, by opposing it, the monarch's legislative rationality, and legally contains political action. The chapter advances a reformulation of the classical problem of the nature of mathematical objects (if any), here called “Plato’s problem,” in line with the program of a philosophy of mathematical practice. It then provides a sketch of a platonist solution, following the same perspective. This solution disregards as nonsensical the question of the existence of abstract, and specifically mathematical, objects, by rather focusing on the modalities of our access to them: objects (in general, both concrete and abstract) are regarded (...) as individual contents that we have (or can have) a de re epistemic access to. The question of the existence of mathematical objects is then replaced by that of the modalities of our de re epistemic access to individual mathematical contents. (shrink)

Language does not have to be held as a problem for radical enactivists. The scope objection usually presented to criticize enactivist explanations is a problem only if we have a referentialist and representationalist view of the nature of language. Here we present a normative hypothesis for the great question concerning the hard problem of content, namely, on how linguistic practices develop from minds without content. We carry representational content when we master inferential relations and we master inferential relations when we (...) master normative relations, especially when we are introduced into frameworks of authorizations and prohibitions. Inspired by the anti-intellectualism of the later Wittgenstein and Brandom’s inferentialism, we present the hypothesis that language emerges from inferentially articulated action from normative elements and not from manipulation in internal mental states of contents fixed by reference to external things.
