Resumen: En el siguiente análisis intentamos, por una parte, contextualizar la loa El divino Narciso de sor Juana Inés de Cruz dentro de los paradigmas estéticos y culturales de su época. Y por otra, reactualizar la lectura crítica de ella desde la perspectiva de una retórica o poética subalterna, entendiendo esto último como la deconstrucción literaria y su posterior reorganización de las significaciones que justificaron el colonialismo. Lo anterior tiene por finalidad dar cuenta cómo, mediante la manipulación precisa de los (...) códigos hegemónicos, se logra invertir los contenidos simbólicos de una de las representaciones más tempranas y persistentes del continente americano: la figura América-mujer, imagen que naturalizó y justificó su alteridad.: In the following analysis, we tried first to contextualize La loa El Divino Narciso from Sor Juana Inés de la Cruz within esthetical and cultural paradigms of her time. Then, we tried to update her critical reading from the perspective of a subordinate rhetoric or poetics. We understand it as the literary deconstruction and subsequent reorganization of the meanings that justified colonialism. This approach has the purpose of accounting for the way in which accurate manipulation of hegemonic codes makes it possible to reverse the symbolic contents of one of the earliest and most persistent representations of the American continent: the America-woman figure. Quiero que hablen los personajes y que defiendan su posición. Es un diálogo a tres bandas. El filósofo busca la bienaventuranza a través de la virtud y la dialéctica. Dice el filósofo que la salvación llega por la dialéctica y no por los ritos. El cristiano recuerda a los maestros (...) Guillermo y Anselmo que tenían una palabra fácil y que utilizaban muy bien la retórica. El judío, en cambio, coloca las palabras una junto a otra sin comprenderlas; es el gramático el que asegura la construcción perfecta de las frases, de la gramática.In this work I would like to see the relation in the Abelard’s Dialogue betwenn a Philosopher and the dialectic; a Christian and the rethoric and a Jew and the granmmar. I want that the charecters talk and discuss their position. It is a Dialogue of three people. The Philosopher look for the blessdness with the virtue and the dialectic. The Philosopher sais that the salvation come for the dialectic and no by the rites. The Christian remembers the teachers William of the Champeau and Anselm of the Laon who had the easy word and used the Rethoric vary good. O presente trabalho pretende, sobretudo, relevar o poder argumentative do orador, seguindo de perto as considerações de Chaïm Perelman sobre a Retórica como "discurso que visa convencer ou persuadir". Simultaneamente, desta-cam-se os голоl ou valores universais patenteados no texto de Vieira e que constituem a base da (...) teoria da argumentação de Oswald Ducrot. \\\ In the "Sermon for the good success of the Portuguese army against Holland's", Vieira displays all his gifts as an uncommon writer, an excellent theologian, a non negligeable jurist, a convinced humanist, and, above all, a wholehearted patriot. This essay is an attempt to put in evidence the preacher's argumentative power, on the basis of Chaïm Perelman's considerations on Rethoric as "a speech that aims to convince or persuade". At the same time, we emphasize, as displayed in Vieira's text, the "topoi", or universal values, that are the basis of Oswald Ducrot's argumentation theory. (shrink)

The parrhesy shows the being of the subject as only activity and, thus, it points out the essential limit between the subject's being as éthos and the subject's being as téchne. That is, it points out the border, which we can find first in Plato, between philosophy and rethoric . The purpose of this paper is to show that philosophy is un-thematized as opposed to the dependence of the theme of rhetoric. Philosohy is duty, the acknowledgment of the factical finitude of man , and criticism, the discovery of the need of truth-telling in the... game of the soul and the pólis. Theme of this article is the ancient Roman tradition of criticism based of the standard ">institutio oratoria« of the late Roman teacher of rhetoric Quintilianus and the reception of rhetorical and critical theory among German 18th century philologists. Just like Immanuel Kant's terminology of 'Kritik' the Latin terms critica and ars critica became in the 18th century basic terms for the research in the history of philology and the social importance of this scientific work. The researchers' documentations in the 18th (...) century demonstrate the ancient tradition between criticism and the liberal arts of the trivium which are studies in rethoric, dialectic and grammar. This paper studies the role of literature and rethorics as a tool of philosophical practice within the classical tradition of «spiritual exercises». The aim of this study is to propose new ways of thinking the relations among philosophy and literature as formative or psicagogic disciplines, as well as for stand up for the role of philosophy and literature in our society.

The traditional perspective on emotions, anchored in the Western philosophical tradition, assumes an irretrievable dualism between emotions and reason. Emotions are assumed as forces, which can blind a person’s view and lead them to do terrible things. For this reason, emotions must be put aside during rational deliberation. For common sense, including legal common sense, emotions are dangerous and are unrelated to rational decision-making. Nevertheless, Aristotelian’s perspective on the relationship between emotions, reason and practical deliberation is enlightening. Emotions are not (...) blind forces completely divorced from reason. Aristotle did not develop a complete theory of emotions but recognized a strong covariance between emotions/passions/sentiments and thoughts. This research is based on three theoretical pillars: Aristotle’s perspective on the relationship between reason and emotions drawn on Nicomachean Ethics and Rethoric, the jurisprudencialism, a jurisphilosophical approach elaborated by António Castanheira Neves, and Terry Maroney’s model for judicial emotion regulation. The power of judgement is assumed mainly as a practical task, which involves the excellence of phronesis, virtues and emotions/sentiments/passions. (shrink)

O presente estudo constitui um ensaio crítico de reflexão sobre a questão dos limites da linguagem em Wittgenstein. A perspectiva deste estudo observa, numa primeira parte, o próprio procedimento do método wittgen-steiniano e segue um modelo de discurso plural, a partir de várias perspectivas que, não só permitem desconstruir a aparente unidade da razão, como indagar interiormente do próprio limite da análise wittgensteiniana. Retomando a caracterização da linguagem e do pensamento nos seus traços fundamentais, desde o "Tractatus" até às "Investigações (...) Filosóficas", chama-se a atenção para os pontos de dificuldade, da indefinição e da cons-trutividade do modelo de Wittgenstein. A plena lição do "autómaton" da linguagem face a uma possível diferenciação dos signos e aprofundamento lógico, constitui uma parte desta reflexão que se complementa pela referência aos horizontes de resíduo do não-linguístico, ou até do indizível, numa dupla maneira de estabelecer os limites da linguagem. Enfim, e a título conclusivo, apontam-se, não apenas os contornos do que se entende como uma moral retórica da linguagem em Wittgenstein, mas para perspectivas originais de um reaprofundamento em termos etioló-gicos de diferenciação de escala da lógica e da linguagem, e de recuperação de uma intencionalidade psico-lógico-linguística superando aquela indiferen-ciação do dizer no automático da fala estatuída na "ordinary language". /// La présente étude constitue un essai critique qui réfléchie sur la question des limites du langage dans la philosophie de Wittgenstein. Dans une première partie la perspective de cette réflexion analise les procédés que Wittgenstein lui-même utilise dans sa méthode, et pour cela se sert d'un modèle de discours pluriel, lequel permet non seulement la déconstruction de l'apparente unité de la raison, mais aussi faire une enquête au dedans des limites de l'analyse wittgensteinienne. Reprenant la caractérisation du langage et de la pensée dans ses traits principaux, dès le "Tractatus" jusqu'aux "Investigations Philosophiques", on remarque les points de difficulté, d'indéfînition et de constructivité du modèle de Wittgenstein. La leçon de l'"autômaton" du langage face à une possible diférenciation des signes et l'approfondissement logique, constitue une partie de cette réflexion, qui se complémente par la référence aux horizons résiduels du non-linguistique, ou de l'indicible même, dans une double manière d'établir les limites du langage. Finalement, et comme une conclusion, on remarque, non seulement les contours de ce qu'on considère une morale réthorique du langage chez Witt- genstein, mais aussi pour les perspectives originelles qui permettent reprendre profondément, en termes étiologiques les différences d'échelles logique et linguistique, et récuperer une intentionalité psycho-logico-linguistique. Ainsi on réussit à supérer cette indifférenciation du dire dans l'authomatique de la parole qui s'etablie dans l'"ordinary language". /// The present study is a critical essay on the question of language's limits in Wittgenstein's thought. First of all, the view of this study observes how Wittgensteinian method proceeds. This investigation adopts a pluralistic model of speach, from several points of view, which not only allow to desconstruct the pseudo-unity of reason, but also, make possible to investigate about the inner limits of Wittgenstein's analysis. The Author remarks the difficulties of the non-definition and the construed vity of the Wittgensteinian model of thought, remembering the characteristic relationship language and thought, from Tractatus, to Philosophical Investigations. In order to a possible differenciation of signs and deeper logical analysis, the "automaton" of languages gives us a lesson which is another important part of this reflexion. This point is completed by the reference on the residual boundaries of non-linguistic, or even, non sayable, in a double way of establishing the limits of language. At last, and as a conclusion, the author points out, not only the outlines of the so called "rethoric moral" of language in Wittgenstein philosophy, but also to original views. These views allow a new deeper understanding, in ethiological terms. Different logical and linguistical scales are pointed as a mean, to recover a psycho-logico-linguistic intentionality, overcoming the indifferenciation of authomatic speech as established in "ordinary language". The purpose of this study is to focus on the coexistence, during the transmission of the doctrine on the Topics in the early Middle Ages, of two different interpretations: although both emerge from two commentaries on Cicero’s Topics, however, they gave rise to two different readings: the one transmitted by Marius Victorinus who thought the topics almost exclusively in the service of Rhetoric, the other conceived by Boethius who intended to restore the centrality that the Topics had in the Aristotelian (...) Logic, by subordinating the rethorical Topics to dialectical Topics. My conclusion is that the Early Middle Ages can be considered, from an epistemological point of view, as a long boetiana aetas. Although the corpus of Boethius’s logical writings was not yet available until the second half of the 11th century, Boethius’s methodological approach on the Topics somehow continued to support the slow but constant absorption of the topical doctrine into the new Christian sensibility. Enrico Opocher, one of the most important Italian legal philosophers in the last century, died on March 3, 2004. For almost four decades, he was Director of the prestigious Insitute of Philosophy of Law and Comparative Law in the University of Padua. Together with Norberto Bobbio, Sergio Cotta, Uberto Scarpelli and few others, he represented a generation as well as a season of deep renewal in Italian philosophy of law and politics. In the legal thought of the postwar period, Opocher (...) became the point of reference for all those who neither wanted to join the old tradition (substantially neo-scholastic) of natural law thinking, nor believed in Kelsen’s triumphant legalistic normativism. My contribution is devoted to focusing on that part of Opocher’s thought in which the Paduan philosopher defines “justice” as “a value which makes the law count” (in the sense of its “duration”) and puts in contact this peculiar concept of justice with the problem of the verification of truth in trials and lawsuits. My thesis comes from the analysis of the Opocher’s conception of “judicial truth” as a truth obtained by reflecting facts which are relevant to norms. In the course of my analysis, I criticize all interpretations which reduce judicial truth-seeking to the empirical method. My aim is to move it from the level of mere factual description to the one of “logical demonstration according to the circumstances”. This movement from the descriptive niveau to the argumentative one, will be justified through the adoption of the perspective of classical rethorics, based on Aristotle and Cicero, which shows how judicial truth (intended in the sense of entymematic demonstration) was much more coherent with the very idea of Opocher’s conception of justice. Diversos tratadistas del siglo XX han reconocido el importante papel cognoscitivo que Aristóteles le concedió a la opinión en la construcción del saber. Se mostrará que las diversas interpretaciones propuestas giran en torno a la discusión sobre cómo se entiende la relación o la posible identificación entre opinión (doxa) y apariencia (phainomena). A partir de dichas nociones se propone ver de qué manera Aristóteles las integra a su teoría sobre la retórica. Mediante el ejercicio retórico los miembros de una determinada (...) comunidad deliberan, juzgan o reconocen lo que se considera justo, conveniente o digno, cuando examinan determinados casos que se les presentan a su consideración. La retórica se presenta como un arte en el que se conjugan opinión y apariencia.
