Research shows that people often do not intervene to stop immoral action from happening. However, limited information is available on why people fail to intervene. Two preregistered studies (Ns = 248, 131) explored this gap in the literature by staging a theft in front of participants and immediately interviewing them to inquire about their reasons for intervening or not intervening. Across both studies, most participants did not try to stop the theft or even report it to the experimenter afterward. Furthermore, (...) many participants reported confusion and inattention as precursors to nonintervention, yielding insight into what inhibits moral courage. (shrink)

This work presents a blueprint or set of guidelines for the planning and development of sustainable national centers dealing with the safety of nanomaterials and nanotechnologies toward public health and environment. The blueprint was developed following a methodological approach of EU-wide online survey and workshop with several stakeholders. The purpose was to identify the key elements and challenges in the development and sustainability of a national nanosafety center. The responses were received from representatives of 16 national nanosafety centers across Europe (...) and 44 people from 18 EU member states who represented the stakeholder groups of researchers, academics, industry, regulators, civil society, and consultants. By providing an overview of the organizational design of existing national nanosafety centers across EU and converging demands in the field of nanosafety, the blueprint principally benefits those EU member states who do not have a national nanosafety center, but intend to develop an entity to manage the human health, environmental, ethical, and social concerns/risks toward the growing nationwide activities on engineered nanomaterials, e.g., their production, use or disposal, at national level. Background Shared responsibility is an essential part of family-centred care and it characterizes the relationship between parents and healthcare professionals. Despite this, little is known about their shared responsibility for decision-making in neonatal intensive care units. Aim The aim of this scoping review was to identify previous studies on the subject and to summarize the knowledge that has been published so far. Method The review was conducted using electronic searches in the CINAHL, PubMed, Scopus and PsycINFO databases and manual searches (...) of the reference lists of the selected papers. The searches were limited to peer-reviewed papers that had been published in English from 2010 to September 2021. The data were selected based on inclusion and exclusion criteria and the findings were inductively summarized. We identified eight papers that met the inclusion criteria. Ethical considerations: The scoping review was conducted according to good scientific practice by respecting authorship and reporting the study processes accurately, honestly and transparently. Results The results showed that shared responsibility for decision-making was based on the parents’ intentions, but the degree to which they were willing to take responsibility varied. The facilitating and inhibiting factors for shared responsibility for decision-making were related to the communication between parents and professionals. The impact was related to the parents’ emotions. Conclusion It is essential that parents and professionals negotiate how both parties will contribute to their shared responsibility for decision-making. This will enable them to reach a mutual understanding of what is in the infants’ best interests and to mitigate the emotional burden of decisions in neonatal intensive care units. More research is needed to clarify the concept of shared responsibility for decision-making in this intensive care context. (shrink)

Pain is a global problem whose social, economic, and psychological costs are immeasurable. It is now seen as the most common reason why people seek medical (including psychiatric) care. But what is pain? This article shows that the discourse of pain tends to suffer from the same problems of ethnocentrism and obscurity as the discourse of emotions in general. Noting that in the case of pain, the costs of miscommunication are particularly high, this article offers a new paradigm for communicating (...) about pain. It shows how the use of natural semantic metalanguage (NSM) techniques developed in linguistic semantics can help in this area, as in other areas concerned with human subjectivity, and can lead to a greater understanding between psychologists, psychiatrists, medical practitioners, social workers, and ordinary suffering mortals. Trope theory is the view that the world consists (wholly or partly) of particular qualities, or tropes. This admittedly thin core assumption leaves plenty of room for variation. Still, most trope theorists agree that their theory is best developed as a one-category theory according to which there is nothing but tropes. Most hold that ‘sameness of property’ should be explained in terms of resembling tropes. And most hold that concrete particulars are made up from tropes in compresence (for an overview, (...) including an introduction to some alternative versions of the view, cf. Maurin, 2014). D. M. Armstrong disagrees. He thinks the world is a world of immanent universals, the thin particulars in which those universals are instantiated, and the states of affairs that—thereby—exist. He holds that ‘sameness of property’ should be explained in terms of numerically identical universals or—if the resembling things are the universals themselves—in terms of partially identical universals. And he believes that concrete particulars are made up from ‘thin particulars’ in which a (sufficient) number of universals are instantiated. In spite of their disagreements, proponents of tropes owe Armstrong a debt of gratitude. First, for being one of the theory’s earliest, most serious, and—not least—most prominent, critics (Armstrong for the first time considers, and rejects, what he then labels ‘particularism’, in his 1978a). But also for being one of the theory’s most ardent champions. Already in his 1989a, Armstrong regrets his 1978-rejection of the view. Equivalence classes of exactly resembling tropes, he now admits, for most purposes “serve as an excellent substitute for universals” (Armstrong 1989a, 122). But then why isn’t Armstrong a trope theorist? In this paper, Armstrong’s main reasons for rejecting the trope view are critically scrutinized. All of them, it is maintained, fail to convince. If this argument is accepted, Armstrong seems to have no—or, at least, no good—reason for not accepting the existence of tropes. But, then, ought Armstrong to have been a trope theorist? If the ‘best’ version of the trope view turns out to be ontologically more parsimonious than Armstrong’s own theory of universals, then, yes. That there is a version of the trope view, a version that is not (or, at least not seriously) considered by Armstrong, that is ontologically more parsimonious than the universals view, is argued in the next section. Why none of Armstrong’s reasons for preferring universals to tropes manage to convince, is explained in the section after that. First, however, and in order to avoid a common misunderstanding of the trope view and, as a consequence, of why one ought to reject it, a few more words about the core-difference between tropes and universals, and about how this difference matters (as well as does not matter) to what—and how well—these theories explain. Theories of deliberative democracy maintain that outcomes of democratic deliberation are fairer than outcomes of mere aggregation of preferences. Theorists of impartial justice, especially Rawls and Sen, emphasize the role of deliberative processes for making just decisions. Democratic deliberation seems therefore to provide a model of impartial decision-making applicable in the real world. However, various types of cognitive and affective biases limit individual capacity to see things from others’ perspectives. In this paper, two strategies of enhancing impartiality in real world (...) decision-making are discussed. The first involves decision-making processes which detach decision-makers from their particular interests, whereas the second aims to enhance the quality of democratic deliberation and empathetic reasoning. We conclude that new forms of democratic deliberation may be necessary if we hold on to the aspiration of making decisions which are both democratic and impartial. (shrink)

What does it mean to intentionally not perform an action? Is it possible to not perform an action out of resistant intention? Is there sufficient language for talking about this kind of behavior in the social sciences? In this article, a nonnormative vocabulary of not doings including resistant intentional omissions is developed. Unlike concepts that describe official, overt, and public resistance, James Scott’s everyday resistance and Albert Hirschman’s exit have made it possible to talk about the resistant inactions of agents (...) in the social sciences. But in order to grasp the ordinariness of this kind of oppositional behavior, philosophy of intentional omissions is used. (shrink)

In the popular and academic literature on the problems of the so-called attention economy, the cost of attention grabbing, sustaining, and immersing digital medias has been addressed as if it touched all people equally. In this paper I ask whether everyone has the same resources to respond to the recent changes in their stimulus environments caused by the attention economy. I argue that there are not only differences but disparities between people in their responses to the recent, significant increase in (...) the degree and persuasiveness of digital distraction. I point toward individual variance in an agent’s top-down and bottom-up attention regulation, and to further inequality-exacerbating variance in active participation on the internet and in regulating reward-seeking behaviors on the internet. Individual differences in these areas amount to disparities because they have been found to be connected to socioeconomic background factors. I argue that disparities in responding to digital distraction threaten fair equality of opportunity when it comes to digital distraction in the classroom and that they may lead to an unequal contribution of achievements that require complex cognition by people from lower socioeconomic backgrounds. The debate over the objects of episodic memory has for some time been stalled, with few alternatives to familiar forms of direct and indirect realism being advanced. This paper moves the debate forward by building on insights from the recent psychological literature on memory as a form of episodic hypothetical thought (or mental time travel) and the recent philosophical literature on relationalist and representationalist approaches to perception. The former suggests that an adequate account of the objects of episodic memory will (...) have to be a special case of an account of the objects of episodic hypothetical thought more generally. The latter suggests that an adequate account of the objects of episodic hypothetical thought will have to combine features of direct realism and representationalism. We develop a novel pragmatist-inspired account of the objects of episodic hypothetical thought that has the requisite features. (shrink)

It has been debated whether the so-called attention economy, in which the attention of agents is measured and sold, jeopardizes something of value. One strand of this discussion has focused on so-called attention rights, asking: should attention be legally protected, either by introducing novel rights or by extending the scope of pre-existing rights? In this paper, however, in order to further this discussion, we ask: How is attention already protected legally? In what situations does a person have the right to (...) attention under current law? -/- Unlike (Chomanski, Neuroethics 16:1–11, 2023), who discusses an overall right to attention, or (Puri, Rutgers Law Record 48:206–221, 2021), who discusses an overall right to attentional privacy, in this paper we focus on two types of situations in which a person’s attention is already protected by legal regulation. Sustained attention-requiring tasks can be jeopardized by distractions whereas attentiveness to certain kind of stimuli can be jeopardized by immersive stimuli. That is why distractions are regulated in situations where an agent has what we call a concentration right and immersive stimuli are regulated in situations where an agent has what we call a duty to be attentive. The further analysis of these situations provides an understanding of the legal means by which attention is already regulated, which can be helpful when thinking about how it should be regulated in the future. In bioethics vaccine refusal is often discussed as an instance of free riding on the herd immunity of an infectious disease. However, the social science of vaccine refusal suggests that the reasoning behind refusal to vaccinate more often stems from previous negative experiences in healthcare practice as well as deeply felt distrust of healthcare institutions. Moreover, vaccine refusal often acts like an exit mechanism. Whilst free riding is often met with sanctions, exit, according to Albert Hirschman’s theory of exit and (...) voice is most efficiently met by addressing concerns and increasing the quality and number of feedback channels. If the legitimate grievances responsible for vaccine refusal are not heard or addressed by healthcare policy, further polarization of attitudes to vaccines is likely to ensue. Thus, there is a need in the bioethics of vaccine refusal to understand the diverse ethical questions of this inflammable issue in addition to those of individual responsibility to vaccinate. The article is devoted to the analysis of the key directions of the study of the possible influence of the specifics of Chinese language culture on the content and nature of intellectual discourse, which is recognized as philosophical. Logic and ontology are the key areas of analysis of the possible influence of linguistic determinants on the intellectual discourse of China. Three main topics that attract the attention of researchers are the (...) structure of judgment, the semantics of lexical units, and the specificity of the pragmatics of the Chinese language. M e t h o d s. The author applied general scientific methods of analysis, synthesis, comparison and description of the works of researchers of Chinese philosophy, which justify and argue the fruitfulness of studying the peculiarities of Chinese language to explain the reasons of the fundamental difference between the problems actualized in the history of Chinese philosophy and those that formed the basis of the development of the history of philosophy in the Western world. R e s u l t s. It is generally accepted that for the worldview of representatives of Chinese culture, the world is a structural whole, consisting of elements that continuously interact in the dynamics of changes and transformations, we find a reflection of this feature in the semantics of the corresponding symbolic system. Polysemy in the Chinese language mostly reveals a complex and multi-layered "web" of associative and correlative connections between meanings, which in fact cannot be argued outside the context of the relevant cultural tradition indicating common features or similarities of the signified. The doubt about the typicality of understanding the denotations as fixed and atomized for the Chinese language culture is reasonable, even in those cases when it comes to the designation of empirically accessible objectivity. The main specific features of polysemy in the Chinese language are the complete heterogeneity of what is signified, and the lack of transparent grounds for identifying the genus-species subordination of the scope of general concepts. This can also serve as an explanation for the fact that we do not find a completely obvious and nondisputable analogue of the problem of universals of the Western model in the history of Chinese philosophy. C o n c l u s i o n s. Based on the peculiarities of the Chinese language culture, we can recognize as a reasonable a statement that the seemingly natural understanding of the essence – the subject, as something that remains the same (at least for a certain time), but it undergoes some changes through its manifestations – a predicate (properties and actions). It is not as necessary and axiomatic for Chinese thinkers as, for example, for ancient Greek philosophers. In addition, we can recognize the fact that the verb "to exist" does not fulfill the role of a necessary copula in judgments in the Chinese language, as a probable reason for the lack of fundamental problematization of the concept of "being" in the Chinese history of philosophy. In general, the context of the use of a certain word-sign in the Chinese language plays a determining role. The actualization of one or another meaning in an expression is formed not only by its integration into a certain text, but also by its purpose in accordance with the specific practice of application. Therefore, this can serve as an explanation for the absence of an original and axiomatic interpretation of truth as absolute, that is, unchanging and non-relative in the history of Chinese philosophy. Mit den Fortschritten in Generativer Künstlicher Intelligenz, Large Language Models, Brain-Computer Interfaces und genetischen Eingriffen gewinnt auch der Transhumanismus an Relevanz. Der Transhumanismus ist ein beliebtes Thema der Medien und wird in Tages- und Wochenzeitungen sowie im Fernsehen gerne aufgegriffen. Außerdem gibt es inzwischen viele Filme, die den Transhumanismus thematisieren, z. B. die Dokumentation „Endlich unendlich“ (2021, Regie: Stephan Bergmann). Der Transhumanismus wurde in Österreich auch Gegenstand einer Verschwörungserzählung, über die der Bayrische Rundfunk aufgeklärt hat. Auf den Wahlplakaten der „Partei (...) für Gesundheitsforschung“ ist der Transhumanist Aubrey de Grey abgebildet, der ein in Cambridge lebender Brite ist, aber auf Plakaten in Deutschland dargestellt wird. Diese und weitere Entwicklungen machen es notwendig, sich mit dem Transhumanismus aus wissenschaftlicher Perspektive auseinanderzusetzen. Was ist der Transhumanismus? Alle sprechen von Transhumanismus, aber was der Transhumanismus letztlich ist, bleibt häufig unklar. Der Transhumanismus (TH) ist eine philosophisch-technologische Bewegung des 20. und 21. Jahrhunderts, die es sich zum Ziel setzt, mittels neuer Technologien den Menschen grundlegend zu transformieren. Wichtig ist dabei, dass sich der TH nicht mit den Optimierungsbestrebungen in der Gesellschaft oder technologischem Fortschritt gleichsetzen lässt. Vielmehr verstehe ich unter TH die Gruppe, die sich um die Organisation Humanity+ in Kalifornien versammelt und die Personen, die sich explizit alsVertreter*innen des TH verstehen. Der TH hat eine ganz eigene Agenda, eigene Institutionen, Organisationen und Publikationsorgane.4 Zu den Themen und Visionen gehören die Lebensverlängerung von mehreren Hundert Jahren bis zur Unsterblichkeit, Kryonik (das Einfrieren des Körpers, der wieder aufgetaut werden soll, wenn nach transhumanistischer Vorstellung Unsterblichkeit ermöglicht werden kann), umfassendes Enhancement und die Verschmelzung von Körper und Technik sowie Beseitigung allen Leids, aller Krankheiten und Aufhebung des Alterns. Der TH strebt danach, mittels Technik neue Sinnesfähigkeiten zu erlangen und neue (virtuelle) Erfahrungswelten zu erschließen. Außerdem wird von vielen Transhumanist*innen auch die hochspekulative Vision des Mind Uploading vertreten, die streng genommen dem Posthumanismus zugeordnet werden muss Gemäß dieser Vision soll durch das maschinelle Lesen des Gehirns der ganze Mensch auf ein externes Medium hochgeladen werden können. Die Vision des Mind Uploadings ist aus naturwissenschaftlicher Perspektive hochumstritten, ist aber ein sehr beliebtes Motiv, das auch außerhalb des TH Wirkung zeigt und in viele Science-Fiction- Filme Eingang gefunden hat (z.B. die Amazon Serie „Upload“, 2020, Regie: Greg Daniels). Das Bestreben des TH, den Menschen grundlegend zu transformieren, wirft zunächst die Frage auf, wie der TH den Menschen überhaupt versteht. Dieser Frage nach dem Menschenverständnis des TH habe ich mich in meinem Buch „Über-Menschen. Philosophische Auseinandersetzung mit der Anthropologie des Transhumanismus“ gewidmet. Philosophische Anthropologie bezeichnet die wissenschaftlichen, philosophischen Reflexionen auf den Menschen. Welches Menschenverständnis vertritt der TH und lässt sich unsere Anthropologie auf dieser Grundlage weiterentwickeln? Das Buch gliedert sich in drei Teile: Teil 1 führt zuerst in die Bewegung des TH ein, worauf Teil II aufbaut, der sich mit dem Menschenverständnis des TH beschäftigt. Teil III betrachtet schließlich heutige Optimierungsbestrebungen in der Gesellschaft sowie neue Ansätze für die Technikanthropologie (z. B. Kritischer Posthumanismus und Neuer Materialismus). Die nachfolgenden Kapitel dieses Aufsatzes sind ein Ausschnitt aus Teil II, der Untersuchung des transhumanistischen Menschenverständnisses. Dieser Aufsatz widmet sich dem „genetisch codierten Menschen“ im TH, also der transhumanistischen Sicht auf den Menschen als jemanden, die*der vollständig von ihren*seinen Genen bestimmt ist. Der genetische Diskurs ist nur einer von fünf im TH dominanten Diskursen, die das transhumanistische Menschenverständnis ausmachen. Zu den anderen Diskursen bzw. transhumanistischen Bestimmungen des Menschen gehören: der Diskurs um die „Natur des Menschen“, der Maschinendiskurs – die Bestimmung des Menschen als Maschine –, der neurowissenschaftliche Diskurs – die Gleichsetzung des Menschen mit dem Gehirn bzw. Neuronalem und zuletzt die metaphysischen Verhältnisbestimmungen von Geist und Körper (PUZIO, Über-Menschen, Kap. 4). Diese transhumanistischen Bestimmungen des Menschen werden am Ende ausgewertet. Ohne die Ergebnisse dieses Kapitels im Detail vorwegnehmen zu wollen, kann für die Gesamtuntersuchung des TH gesagt werden, dass das transhumanistische Menschenverständnis sich als hochproblematisch erweist. Die transhumanistischen Argumentationsstrukturen sind nicht tragfähig und der TH behauptet sich auf die Naturwissenschaften zu berufen, widerspricht allerdings den aktuellen Ergebnissen der Naturwissenschaften. Dies wird in den nachfolgenden Kapiteln gut deutlich werden. Der TH hat ein reduktionistisches Menschenverständnis und reduziert den Menschen beispielsweise auf „Information“. Viele Ausführungen sind diskriminierend z. B. gegenüber Kranken, Alternden und Menschen mit Behinderungen und letztendlich wird sogar jeder Mensch, auch der gesunde junge Mensch, gegenüber der Maschine abgewertet, die aus transhumanistischer Sicht den Menschen weit übertrifft. Im weiteren Verlauf der Arbeit werden sogar „ideologische Elemente“ im TH identifiziert. Daher wird in der Arbeit abgelehnt, den TH als Grundlage für die Weiterentwicklung der Anthropologie zu verwenden und stattdessen werden im letzten Teil der Arbeit alternative Ansätze für die Technikanthropologie präsentiert. Wie bereits erwähnt, richtet sich die Kritik am TH jedoch nicht gegen die heutige Optimierung in der Gesellschaft, die ebenfalls im letzten Teil der Arbeit diskutiert wird. Optimierungsbestrebungen hat es schon immer gegeben und sie werden nun durch neue Technologien weiter verändert, sie sind aber nicht mit der Bewegung des TH gleichzusetzen. Das Kapitel ist eingebettet zwischen dem Maschinendiskurs (Mensch als Maschine) mit seinen Ausführungen zu Information und Kybernetik und dem neurowissenschaftlichen Diskurs („Der Mensch ist ihr*sein Gehirn“). Es wird im Folgenden der genetische Diskurs im TH untersucht, also wie der TH den Menschen vollständig auf Gene zurückführt, und dies schließlich kritisch geprüft. Sind „gute Gene“ alles? Kann der Mensch vollständig über ihre*seine Gene bestimmt werden? Und was hat es mit der trügerischen „genetischen Information“ auf sich? Zunächst wird der genetische Diskurs im TH dargestellt, also die genetischen Ausführungen des TH präsentiert (Kap. 2), danach wird der Blick auf den Gebrauch der genetischen Metaphern im TH gerichtet (Kap. 3) und zuletzt werden die genetischen Vorstellungen des TH kritisiert (Kap. 4). Der Aufsatz schließt in Kap. 5mit einer (vorläufigen) Zusammenführung der Ergebnisse und einem Ausblick. (shrink)

Vaalijärjestelmä on yksi keskeisimmistä demokraattisen järjestelmän instituutioista, joka vaikuttaa merkittävästi siihen, kuka vaalit voittaa ja kuka häviää. Eerik Lagerspetz analysoi kirjassaan Social Choice and Democratic Values laajasti äänestyssääntöjen vaikutusta demokraattisiin päätöksiin. Lagerspetzin teos on tärkeä monestakin syystä, mutta erityisesti siksi, että se yhdistää harvoin keskenään keskustelevia normatiivisen demokratiateorian ja sosiaalisen valinnan teorian perinteitä. Pohdin artikkelissani äänestysmenettelyjen valintaa. Keskityn siihen, millä säännöillä äänestysmenettely valitaan, en niinkään sitä, ketkä valinnan tekevät. Tarkastelen aluksi sitä, miten äänestyssäännön valinta poikkeaa muista poliittisista valinnoista. Surging from the ontopoietic vital timing of life, human self-consciousness prompts the innermost desire to rise above its brute facts. Imaginatio creatrix inspires us to fabulate these facts into events and plots with personal significance attempting to delineate a life-course in life-stories within the ever-flowing stream – existence. Seeking their deep motivations, causes and concatenations, we fabulate relatively stabilized networks of interconnecting meaning – history. But to understand the meaning and sense of these networks’ reconfigurations call for the purpose and (...) telos of our endless undertaking; they remain always incomplete, carried onwards with the current of life, while fluctuating with personal experience in the play of memory. Facts and life stories, subjective desires and propensities, the circumambient world in its historical moves, creative logos and mythos, personal freedom and inward stirrings thrown in an enigmatic interplay, prompt our imperative thirst for the meaning of this course, its purpose and its fulfillment – the sense of it all. To disentangle all this animates the passions of the literary genius. The focus of this collection is to isolate the main arteries running through the intermingled forces prompting our quest to endow life with meaning. Conceptual primitives and semantic universals are the cornerstones of a semantic theory which Anna Wierzbicka has been developing for many years. Semantics: Primes and Universals is a major synthesis of her work, presenting a full and systematic exposition of that theory in a non-technical and readable way. It delineates a full set of universal concepts, as they have emerged from large-scale investigations across a wide range of languages undertaken by the author and her colleagues. On the basis of empirical (...) cross-linguistic studies it vindicates the old notion of the "psychic unity of mankind", while at the same time offering a framework for the rigorous description of different languages and cultures. This paper analyzes the main features of rational choice theory and evaluates it with respect to the conceptions of Lakatos' research program and Laudan's research tradition. The analysis reveals that the thin rationality assumption, the axiomatic method and the reduction to the micro level are the only features shared by all rational choice models. On these grounds, it is argued that rational choice theory cannot be characterized as a research program. This is due to the fact that the thin rationality (...) assumption cannot be understood as a hard core in Lakatos' terms. It is argued that Laudan's conception of a research tradition better characterizes rational choice theory. On the basis of this conclusion, certain important criticisms of rational choice theory are answered. First, the criticisms concerning the core assumptions of rational choice theory are countered. It is argued that this critique is based on a misunderstanding of rational choice theory as a unified set of models, such as Lakatos' research program. Second, Green and Shapiro's rational choice 'pathologies' - inconsistent predictions, post hoc theory development and arbitrary domain restrictions - are evaluated. Contrary to Green and Shapiro, it is argued that post hoc theory development is a more preferable strategy for developing RCT than domain restrictions based on ex ante rules. (shrink)

The philosophical debate around the nature of moods has mostly focused on their apparent undirectedness: unlike mental states such as perceptual experiences, thoughts, and emotions, moods do not seem to be directed at any specific object, and indeed they do not seem to be directed at anything at all. In this paper, I want to draw attention to a different feature of moods, one that is as important and in need of explanation as their apparent undirectedness, but which has been (...) overlooked by most participants in the debate: the fact that moods involve a particularly marked salience of the subjective aspect of experience. I argue that any adequate theory of moods should account for this fact. I call this the “subjective salience desideratum.” In the bulk of the paper, I articulate and motivate the desideratum, show that extant theories of moods do not satisfy it, and offer a preliminary overview of possible (yet unexplored) theories that have the subjective salience desideratum at their core. On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either point to a relevant difference between factors like (...) moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

Accountability is present in many types of social relations; for example, the accountability of elected representatives to voters is the key characteristic of representative democracy. We distinguish between two institutional mechanisms of accountability, i.e., opportunity to punish and requirement of a justification, and examine the separate and combined effects of these mechanisms on individual behavior. For this purpose, we designed a decision-making experiment where subjects engage in a three-player trust game with two senders and one responder. We ask whether holding (...) the responder accountable increases senders’ and responders’ contributions in a trust game. When restricting the analysis to the first round, the requirement of justification seems to have a positive impact on senders’ contributions. When the game is played repeatedly, the experience of previous rounds dominates the results and significant treatment effects are no longer seen. We also find that responders tend to justify their choices in terms of reciprocity, which is in line with observed behavior. Moreover, the treatment combining punishment and justification hinders justifications that appeal to pure self-interest. (shrink)

‘Intersectionality’ has taken on a complex position in the field of feminist scholarship over the last decade. Debate on the concept has swung back and forth, from buzzword to harsh critique. Amid these discussions, many feminist scholars have thought about Audre Lorde and the role of her writings in the debates over intersectionality. Lorde’s radical literary feminism has often been seen both as reflecting a politics of identity, on the one hand, and as shifting and situational, on the other. Intersectionality (...) has also been claimed either to be recycling the ideas of identity politics or to be forging new ways to grasp decentered identity positions and power structures. This article aims to tell a story about the roots of intersectionality through – and alongside – the legacy of Lorde’s feminism, by revisiting certain identity-political ideas. The radical nature of Lorde’s thinking is in many ways connected to politicized writing styles and rebellious literary forms. The main focus in this article is therefore extended to cover the role and implications of radical writing styles for intersectionality. The article argues that the oeuvre of telling the story of intersectionality through Lorde’s feminism opens up a new perspective on the genealogy of intersectionality. (shrink)

Most recent philosophical theories of consciousness account for it in terms of representation, the bulk of the debate revolving around whether (suitably) representing something is sufficient for consciousness (as per first-order representationalism) or some further (meta-)representation is needed (as per higher-order representationalism and self-representationalism). In this paper, I explore an alternative theory of consciousness, one that aims to explain consciousness not in terms of representation but in terms of the epistemically and metaphysically direct relation of acquaintance. I call this the (...) Inner Acquaintance Theory of consciousness (IAT). Roughly, on IAT, what makes a mental state conscious is its subject being acquainted with it. Though not wholly unprecedented, IAT is still at the fringe of consciousness debates and remains largely underexplored. The main goal of this paper is to take some steps toward developing the details of IAT, illustrate its potential explanatory power, and put it forward as a plausible alternative to representational theories, with the hope that this will contribute to shifting IAT closer to the center of the debate. Here is how I proceed. In §2 I introduce a notion—inner awareness—that is crucial both to contextualize and to understand IAT. In §3 I provide some preliminary motivation for exploring IAT. In §4 I explain the notion of acquaintance and illustrate some of the features that are typically attributed to it in the literature. The details of IAT are then shaped through four main decision points. I address them in §§5-8, where I suggest a particular choice at each decision point, thereby progressively building up a view that I consider particularly promising. (shrink)

This paper explores the relationship between a prominent version of the relational view of memory and recent work on forms of unsuccessful remembering or memory errors. I argue that unsuccessful remembering poses an important challenge for the relational view. Unsuccessful remembering can be divided into two kinds: misremembering and confabulating. I discuss each of these cases in light of a recent relational account, according to which remembering is characterized by an experiential relation to past events, and I argue that experiential (...) relations do not adequately distinguish between remembering and unsuccessful remembering. This is because there are, on the one hand, cases of remembering that do not instantiate the relevant experiential relations, and, on the other hand, cases of confabulation and misremembering that do instantiate the relevant experiential relations. I conclude by suggesting that any successful relationalist attempt to explain remembering needs to come to grips with unsuccessful remembering. (shrink)

This article presents the development, validation and application of an instrument to measure everyday moral distress in different health care settings. The concept of moral distress has been discussed and developed over 20 years. A few instruments have been developed to measure it, predominantly in nursing. The instrument presented here consists of two factors: level of moral distress, and tolerance/openness towards moral dilemmas. It was tested in four medical departments and three pharmacies, where 259 staff members completed a questionnaire. The (...) two factors were found to be reliable. Differences in levels of moral distress were found between pharmacies and clinical departments, and between the youngest and oldest age groups; departmental staff and the youngest group experienced higher levels of moral distress. Departments reported less tolerance/openness towards moral dilemmas than pharmacies. The instrument needs to be tested further, but its strengths are the focus on everyday ethical dilemmas and its usefulness in different health care settings. (shrink)

For most people, animals are the most significant aspects of the nonhuman world. They symbolize nature in our imaginations, in popular media and culture, and in campaigns to preserve wilderness, yet scholars habitually treat animals and the environment as mutually exclusive objects of concern. Conducting the first examination of animals' place in popular and scholarly thinking about nature, Anna L. Peterson builds a nature ethic that conceives of nonhuman animals as active subjects who are simultaneously parts of both nature (...) and human society. Peterson explores the tensions between humans and animals, nature and culture, animals and nature, and domesticity and wildness. She uses our intimate connections with companion animals to examine nature more broadly. Companion animals are liminal creatures straddling the boundary between human society and wilderness, revealing much about the mutually constitutive relationships binding humans and nature together. Through her paradigm-shifting reflections, Peterson disrupts the artificial boundaries between two seemingly distinct categories, underscoring their fluid and continuous character. (shrink)

This article locates a theoretical reflection on the form of legal subjectivity against twenty-first century complexities and pressures, including the structural complexities visible in biotechnological developments, new hybridities and numerous contemporary theoretical and practical manifestations of heterogeneity, multiplicity and complexity emerging in a range of disciplines, including cybernetics, techno-theory, post-humanism and ecology. The author defends the theoretical and critical utility of understanding the legal subject as an explicit (and explicitly limited ) constructus . Criticising the constructed naturalism (and the historical (...) and contemporary exclusions) of the 'human being' of law, the author suggests that the language and concept of the 'legal entity' (rather than that of the 'legal person') draws attention to the patterned 'gap' between law and life (and to related injustices enacted by the form of the materialisation of legal subjectivity) while simultaneously providing the degree of theoretical plasticity now required by the mutable complexities of the twenty-first century and beyond.
