This article addresses counter-Islamist discourses by NU Garis Lucu (NU’s Funny Brigade) through its social media accounts. Instead of a clear-cut theological debates, NU Garis Lucu offers humour as method to counter attack Islamit’s arguments through its social-media activism. Using a discourse analysis approach, this article examines tweets of the NU Garis Lucu’s during the course of 2015-2020. It further reveals the account strategies to counter attack Islamist’s discourse which include questioning the legitimacy of the religious authority of Islamist groups, (...) promoting religious moderation, supporting democracy as an ideal political system, promoting ‘smiling’ Islam, and putting to an end religious polarization. _ _. During the initial phases of the COVID-19 pandemic, stress and anxiety were pervasive among the masses due to high morbidity and mortality. Besides the fear of coronavirus was also particularly driven by social media. Many people started to look for faith and spiritual connections to gain comfort. The role of spiritual ties and religious beliefs in relation to coping with pandemic stress gained the attention of researchers in some parts of the world. This cross-sectional survey aimed at assessing the intensity (...) of stress and anxiety symptoms experienced by people and how much they were alleviated by employing spiritual connections. The study sample comprises 795 respondents with 52% males and 48% females living in Saudi Arabia. The brief online study questionnaire collected data about background variables, anxiety and stress scale from DASS-21, and items from the WHOQOL instrument assessed the use of spiritual beliefs to cope. Multiple regression models were tested to determine the role of spiritual connections after adjusting demographic variables. Results illustrated that after adjusting for gender and age, participants' anxiety symptoms decreased by units with each unit increase in the use of spiritual connections, and participants’ stress symptoms reduce by units with each unit increase in coping with spirituality. Additionally, females’ risk to experience anxiety and stress symptoms was more than males and, respectively. An increase in age decreases the likelihood of experiencing anxiety symptoms and stress symptoms by and units respectively. Findings support the protective role of spiritual connections despite small beta coefficients. The social and cultural context in Saudi Arabia favors deep-rooted connections with spirituality and faith. Our findings support that the reliance on spiritual connections helped older people to deal with exaggerated fear during the initial phase of the COVID-19 pandemic and reduces the risk of experiencing anxiety and stress symptoms. Females and younger participants were relatively vulnerable to developing these symptoms. We discussed these findings considering some recent studies that reported similar relationships and made recommendations for future research. (shrink)

El presente artículo busca dar razón de la categoría paideia como estructura fundamental del quehacer teológico de Gregorio de Nisa. En función de este propósito se hace un acercamiento a la noción de paideia propia de los griegos y, posteriormente se señala la manera como el Niseno apropió dicha categoría configurando la paideia cristiana, apelando a ejemplos de su obra De Vita Moysis. This article seeks to give reason for the category paideia as a fundamental structure of the theological (...) enterprise of Gregory of Nyssa. According to this purpose is made an approach to the concept of paideia own of the Greeks and subsequently notes how the bishop of Nyssa appropriated that category by configuring the Christian paideia, appealing to examples of his work De Vita Moysis. One of the issues of discussion between Ahl al-Sunnah and the Mu‛tazila, who differ in many issues, is the relationship between divine command and divine will. Among those who express their opinion on is the Ash‛arī theologian Salmān al-Nīsābūrī. The author, who first cites his sect’s approach on this issue and then explains that Mu‛tazila’s contrary view, adopted the view that the belief, which follows as worship and good deeds commanded by Allah will be the same from his servants. In (...) this matter he basically elaborates three arguments the Mu‛tazila. He states that they build the first of these proofs on the impossibility of the commandment and the will being in a separate direction, and secondly on the fact that the desire for evil is bad. Finally, he adds that they bring evidence from the verses which translates as Allah desires the good of his servants and doesn’t intend his evil deeds. Nīsābūrī, doesn’t pass on these Mu‛tazilite proofs with an immediate answer, but also puts on his agenda possible other objections to those answers that he is giving. He makes the debate very comprehensive, especially on the first evidence he attributes to them. In this sense, he tries to refute the Mu‛tazila argument that the ruler cannot have a will contrary to what he ordered, based on some other rulers who would not want their orders to be fulfilled. Nīsābūrī, who cites some other objections on this issue, states that while there are claims regarding the necessity of order-will harmony, it isn’t consistent that these claimants develop their objections to the examples that show the opposite of their views. In other words, he says that these regarding cases invalidate Mu‛tazila’s claim of necessity. Nīsābūrī includes abrogation in the later stages of the debate and argues that abrogation, which means the abolition of a decree, hits a blow to their understanding of the necessity of order-will. The author also takes objections to his agenda and responds to them. He also examines Mu‛tazila’s approach on the content that if the will is contrary to the order, the rebel and the submissive will be confused, so they must be compatible. Since this claim confirms the meaning that the unbelievers obey Allah’s will with their blasphemy, he makes explanations that obedience will be achieved by order, not by will. On the other hand, the author tries to bind his interlocutors by emphasizing that there’s no room for discussion when it is seen at the relevant verses and seen that Allah doesn’t wish (some) unbelievers to believe. Nīsābūrī, also examines the argument made by Mu‛tazila as to the necessity of conformity between divine command and divine will, that wishing for evil is also evil. Nīsābūrī, who makes relatively more concise explanations on this subject, pointing to the source of this evidence and stating that it is reached from the realm of the perceptible (qiyas bi’l-shāhid). Then, he makes some explanations that the visible realm and the invisible realm cannot be evaluated in the same way and draws attention to the fact that Allah’s being unwise isn’t inferred from the worldly affairs that are happening against Muslims. Nīsābūrī also deals with Mu‛tazila’s evidence for the harmony of divine will and divine order through verses stating that Allah wouldn’t wish his servants to harm. At this stage, he makes comments that the relevant verses are suitable to be evaluated in another way. For this, sometimes makes linguistic explanations, sometimes refers to the content of other verses, and sometimes points to the meaning of the verse used as the evidence. In all of them, he ultimately tries to show that the verses raised by Mu‛tazila do not support their claim. While the author refutes those evidences, he also points out the problems that may arise if the view defended by Mu‛tazila would accepted. In this sense, Nīsābūrī points out that this view will also mean the occurrence of deeds that Allah does not want, and this would bring harm to the divine judgement. As a result, Nīsābūrī underlines that at least Allah’s order towards His servants, whom He knows won’t believe, isn’t in the same direction. (shrink)

Este trabajo estudia el concepto de virtud moral a partir de dos obras de san Gregorio de Nisa, a saber, De professione Christiana yDe perfectione, pertenecientes a la etapa inmediatamente anterior a la madurez de su autor, signada sobre todo por el De vita Moysis,que mucha atención ha merecido. Sin embargo, algunas de las tesis características de esta última obra se encuentran ya trazadas en las primeras dos, especialmente la propuesta de que la virtud es una tarea inabarcable e (...) infinita, como infinita es la naturaleza de Dios. Por ello, el artículo estudia, primero, en qué consiste la infinitud divina de acuerdo con el Niseno, siguiendo para ello, específicamente, el Contra Eunomium; luego, hace lo propio en relación a la antropología filosófica que, desde la visión de este trabajo, resulta ser el puente entre el ámbito metafísico y el moral, pues infinita es también la labor moral del hombre, y, finalmente, expone en qué consiste la virtud moral en las dos obras mencionadas. In the mid-twentieth century, Jérome Gaïth drew attention to the possible influence of Plotinus’ Enneads VI 8 (39) on Gregory of Nyssa’s theory of Divine will. In this treatise, despite being aware of the inappropriateness of all language to describe the One, Plotinus ascribes to it the classical traits of human action: will, freedom, self-determination, though raised to an absolute degree. In the present study we will analyse the reception and transformation of this theory in Nyssen and its anthropological corollaries, (...) in which he extends the virtuality of human freedom to an ontological level. Resumen: A mediados del siglo XX, Jérome Gaïth señalaba la posible influencia de Enéadas VI 8 (39) de Plotino sobre la teoría de la voluntad divina de Gregorio de Nisa. En ese tratado, a pesar de ser consciente de la impropiedad de todo lenguaje para describir lo Uno, Plotino le atribuye los clásicos distintivos del obrar humano: voluntad, libertad, autodeterminación, aunque elevados al grado absoluto. En el presente estudio analizaremos la recepción y transformación de esta teoría en el Niseno y sus corolarios antropológicos, en los que extiende la virtualidad de la libertad humana al plano ontológico. Marjorie Shostak's ethnography, Nisa: The Life and Words of a !Kung Woman, is analyzed as a case study of feminist social science. Three principles of feminist research are suggested as standards for evaluation. After discussion of the principles and analysis of the text, I raise a criticism of the principles as currently sketched. The entire project is framed by the question of how best to resolve conflict between researcher and participant accounts.

In now classic article, James Clifford offers a novel perspective on ethnographic texts. Inspired by literary studies he uses contemporary ethnographic works to question ethnography’s claims of scientific objectivity and a clear distinction between allegorical and factual. If ethnography aims to keep its contemporary relevance, it should specifically focus on allegory as an intrinsic quality of ethnographic texts This kind of analysis may assume that any ethnographic text accounts for facts and events but at the same time it tackles the (...) moral, ideological or even cosmological issues. According to Clifford, ethnography has been dominated by a “pastoral” allegorical register which allowed an ethnographer to occupy a privileged position to interpret other, non-writing cultures. Clifford notices that this register is loosing support in the modern world since the difference between illiterate and literate cultures is not relevant anymore. Ethnographic pastoral is now replaced with self-reflexive and dialogical forms of ethnographic writing, analyzed by Clifford by the example of Marjorie Shostak’s book Nisa: The Life and Words of a!Kung Woman. This paper examines the debate on gender equality which is considered by some groups to be in conflict with Q.S. An-Nisa [4]: ​​11. With a philosophical approach and referring to the concept of inheritance of Sa'id Ramadan al-Buthi in the _Kitab_ _al-Mar'ah Bayna Thughyan al-Nizam al-Gharbi wa Lata'if al-Tashri' al-Rabbani_, this paper tries to refute these allegations and offers a more gender-friendly interpretation. For al-Buthi, the verse has actually liberated women because the provisions are caused by the responsibilities imposed (...) by Islam on men as prospective husbands and not experienced by women. On the contrary, if women are empowered than men, that is a moral responsibility, not a _sharia_ responsibility. Thus, women have been given freedom by the _sharia_ in order to determine the choice to participate in bringing about stability in life, regardless of the existence of a condition of women more empowered than men that will not be the cause of changes in the provisions of _sharia_ concerning inheritance. Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Muḳātil b. Sulaymān’s (d. 150/767) tafsīr named al-Tafsīr al-kabīr, is accepted as the first completed tafsīr that has reached us from the early sources of tafsīr literature. One of the issues that the mufassir, deals with emphatically by emphasizing the concealment of the Prophet’s tabs̲h̲īr in the Bible. The Mufassir make a connection between the concealment of the Prophet’s tabs̲h̲īr and the falsification of the Bible. When we examine the verses that Muḳātil commented to prove his claim related with falsification (...) of these books, we encounter the phenomenon of takhṣīs in tafsīr. Takhṣīs is a term used in the literature of fiḳh method, in the sense of explaining with a word, with a proof, that some of the individuals it covers are meant. Considering the content of this term, it is understood that Muḳātil’s takhṣīs in tafsīr means limiting the meaning of words with many meanings to only one content. The main issue that prompted Muḳātil to make a takhṣīs in tafsīr is falsification. The issue of falsification of the Bible has been a subject that attracted the attention of Muslim scholars. Because in the Ḳurʾān, the distortion of the Torah is described in the following terms: يحرفون “they distort”, فبدل “altered”, يلون السنتهم “who twist their tongues”, يكتمون “they conceal”, ولا تلبسوا الحق بالباطل “confound not truth with falsehood”, وتكتموا الحق “conceal the truth”, يكتبون الكتاب بِاَيْد۪يهِمْ “They write the book with their hands”. The Ḳurʾān’s statement on this matter encouraged the criticism of the scholars about the Torah. Among the issues criticized there are; tabs̲h̲īr of Muḥammad in previous books, the origin of the Torah, inaccuracy in chronological order, stylistic differences, information errors and contradictions. Among these criticisms directed at the People of the Book, Muḳātil focuses on tabs̲h̲īr. The main source that leads him to argue that Muḥammad was heralded in previous books is the verses of the Ḳurʾān. In addition to this, it is highly probable that the geography where the mufassir lived was also influential in shaping his criticisms. Considering the Jewish population in the neighborhoods where he lived, such as Balk̲h̲ and Marw, it is possible for the commentator to develop a dialogue with the Jews, and it is also possible that his criticisms will be shaped within the framework of these dialogues. Muḳātil’s falsification criticism is expressed in the context of the Prophet’s tabs̲h̲īr. However, the mufassir’s emphasis on tabs̲h̲īr goes beyond the criticism of falsification. The mufessir always keeps the issue alive on the reader’s agenda with short phrases such as “كتم أمر محمد / بكتمان أمر محمد Muḥammad’s subject is hidden in the Torah”, “نعت محمد / صفة محمد / Muḥammad’s qualification”. As far as we can determine, there are fifty-two verses in al-Tafsīr al-kabīr that Muḳātil consider directly related to tabs̲h̲īr. He deals with the issue of distortion in thirty-eight verses. The number of verses that the mufassir associates with both distortion and tabs̲h̲īr is thirty-six. The number of verses that he does not associate with falsification but only about tabs̲h̲īr is twelve. Among them, it has been determined that Muḳātil made takhṣīs in the interpretation of forty-eight verses in total. When we classify his takhṣīs’s, we can form a tidy framework under four main headings: in the interpretation of sila sentences, idioms and idiomatic expressions, determining the content of words, and indicates of pronoun. Since the thought of tabs̲h̲īr is one of the main motifs in the mind of the commentator, his tafsīr’s follow a parallel course to this motif. In the interpretation of many verses, there are examples of interpretations that will legitimize this thought and confirm this claim. As a matter of fact, in the interpretation of the expression يلوون ألسنتهم بالكتاب “While reading the Book, they bend their tongues” in the 78th verse of sūrat āl ʿImrān, it is said that Muḥammad’s qualification in the Torah were deleted and other adjectives were written instead of it. In the tafsīr of the 37th verse of sūrat al-Nisāʾ, there are the expressions like this: “The concealment of Muḥammad’s tabs̲h̲īr and its removal from the Torah (بكتمان أمر محمد و محوه من التوراة)”. Muḳātil narrowed the content of the expression, which has a wide meaning area. This narrowing of the meaning is technically considered an example of takhṣīs. Other examples where takhṣīs made in tafsir are present in the interpretations of the phrases of guidance/aberration, right/false, belief/disbelief, verse, word, stinginess, knowledge, promise, declaration, turning away and the book of Allah. The tafsīr’s extreme loyalty to the context is accompanied by his limiting the meaning of words with broad content to a narrow content. (shrink)

Unë do t’ju shpie nëpër një numër të madh personazhesh (karaktere fiktive dhe historike) dhe nëpër ide, secila prej të cilave na del para sysh, por kur bashkohet me tjera, shfamljarizon përvojat tona. Resumen En el presente artículo se abordará la medicina espiritual de San Gregorio de Nisa como un aporte para los retos de una Iglesia en salida. Para ello se partirá de una aproximación a la Iglesia en salida misionera, para luego abordar al Niseno y examinar en sus textos la importancia de la medicina en su reflexión especulativa, mística y pastoral, así como para la comprensión de su quehacer teológico como medicina espiritual. Finalmente, se recogerán algunos aportes para los (...) desafíos de una Iglesia en salida.This article will analyze the approach to the spiritual medicine of Saint Gregory of Nyssa, like a contribution for the challenges of an outgoing Church. For this purpose, it will start with an approach to the Church in a missionary outing, to then approach Gregory’s life and examined in his texts the importance of medicine and his speculative, mystical and pastoral reflection, as well as for the understanding of its theological work as spiritual medicine. The history of the Qurʾānic text begins with the time of its revelation. The research on Qurʾānic manuscripts is one of the main fields of textual studies of the Qurʾān. There have been many works done by both Muslim and Western scholars. Many museums and libraries around the world hold Qurʾān manuscripts. Each manuscript has its own characteristics such as orthography, calligraphy, decoration, and binding, number of the pages and the lines, and dating. This article deals with 110 Qurʾān manuscripts (...) found in the Vatican Library (Biblioteca Apostalica Vaticana) at the Vaticani arabi, Borgiani arabi,Barberiniani orientaliand RossianiCollections. The dates of these Qurʾān manuscripts vary from I/VII(?) and XIII/XIX centuries. The article aims to identify the features of Qurʾānic writing by studying chronologically some basic physical-content descriptions and characteristics of these manuscripts. It also examines the different names of the sūrahs and the knowledge on Meccan or Medinan sūrahs presented on the sūrah headings of manuscripts. Summary: Each Qurʾān manuscript has its own characteristics. These features present significant insights into the field of history of Qurʾānic text. A manuscript becomes a source for the history of writing muṣḥafin terms of physical and content features such as calligraphy, ink colors, binding, and explanations found in katabapage, the sūrah headings which contain the names of sūrahs, Meccan-Medinan knowledge, the numbers of āyahs, and the signs for juzʾ, ʿashr, and ḥizb. The research on the names of sūrahs, Meccan-Medinan knowledge, and the number of āyahs contributes to the ʿulūm al-Qurʾānstudies as well. This article examines 110 Qurʾān manuscripts located in the Vatican Library in the Vaticani arabi(73 MSS), Borgiani arabi (25 MSS),Barberiniani orientali(11 MSS), and Rossiani(2 MSS) Collections. Each manuscript is individually studied. However, due to the limitation of the article, I include only some basic and significant physical and content features of these manuscripts. The catalogues prepared by Giorgio Levi della Vida (1886-1967) and Carlo Alberto Anzuini are consulted for this study. I also study the sūrah headings in Qurʾān manuscripts which contain the names of sūrahs and Meccan-Medinan knowledge. The most used calligraphy types of these manuscripts coming from different geographies are maghribī(19 MSS) and nasikh-Ottoman (66 MSS). The basic features of maghribīMSS as follows: The text is written dark brown, vowel signs in dark red, shaddaand jazmin blue, and hamzain orange ink (VI-VII/XII-XIII centuries). The āyah endings are in circle form and decorated (VI-VII/XII-XIII centuries). The same characteristics can be seen in the next centuries (VIII/XIV and IX/XV centuries). The word sajdais written in the same line with the sajdaayah in Borg. Ar. 51 (VI-VII/XII-XIII centuries). The main characteristics of nasikh-Ottoman MSS as follows: Vat. Ar. 195 (IX/XV century) includes the āyah endings in two different figures: Three dots in triangle-shaped in red ink or in inverse comma-formed. The numbers of the āyahs are not written in this manuscript. On the other hand, the earlier features of the present muṣḥafs found in this manuscript as follows: Waqfsigns are in red ink; the word sajdais written in the same line with the sajdaāyah in black ink. The word ḥizbis in the margin of the pages. The sūrah headings hold the name of the sūrah, Meccan-Medinan knowledge, and the numbers of āyahs. The taʿqībaword is at the end of the pages. Among these manuscripts, Barb. Or. 72 (X/XVI century) contains, for the first time, the prayer text after the reading the whole Qurʾān (khatm) at the end of the muṣḥaf. This manuscript has different explanations for the Meccan and Medinan knowledge. It uses “ نزلت بمكة ” for “ مكية ”, and “ نزلت بالمدينة ” for “ مدنية ”. The figures of juzʾare written in numerical form in Borg. Ar. 184 (XI/XVII century). The divisions such as “ ربع حزب, نصف حزب ” can be seen in the manuscripts in XII/XVIIIcenturies. The names of the sūrah in the sūrah headings can be different from their widely-known names. The 39 sūrahs have different names among the manuscripts examined in this article. The names of sūrahs which cannot be found in the relevant classical source as follows: al-Khalīlfor Sūrah Ibrāhīm; al-kharīrfor Sūrah al-Sajda; al-sayyāḥūnfor Sūrah Sabaʾ;jādalafor Sūrah Mucādala; al-ʿishārfor Sūrah al-Takwīr;wa’l-layli idhāyaghshāfor Sūrah al-Shams;lumazafor Sūrah al-Humaza; miskīnfor Sūrah al-Māʿūn;asrāfor Sūrah al-Isrāʾ;al-maqābirand al-qabrfor Sūrah al-Takāthur; salāsilāfor Sūrah al-Insān; al-abrārfor Sūrah al-Muṭaffifīn. The sūrah headings indicate the knowledge of Meccan-Medinan classification of the sūrahs. Each manuscript does not have this feature. However, the manuscripts have this feature may not include this knowledge for each sūrah headings. The disagreements about the Meccan or Medinan sūrahs in theʿulūm al-Qurʾānliterature can be seen in the manuscripts studied in this article. The manuscripts which have this knowledge present that the 47 sūrahs recorded only as Meccan, but the remaining ones both Meccan and Medinan. These manuscripts do not record a sūrah only as Medinan. There are manuscripts which present more detailed knowledge on Meccan-Medinan. Vat. Ar. 1484 (IX/XV century) mentions not only whether a sūrah is Meccan or Medinan but also the exceptional verses if the sūrah has. For instance, the heading of Sūrah al-Anʿām reads that: “ سورة الانعام نزلت جملة واحدة بمكة الا ثلث ايات انزلت بالمدينة قوله قل تعالوا أتل ما حرم ربكم عليكم لعلكم تتقون ”. Among the sūrah headings which have this feature are al-Naḥl, al-Ḥajj, al-Shuʿarāʾ, Luqmān, al-Sajda, and al-Zumar. Vat. Ar. 1588 mentions only the numbers of exceptional verses. For example, the heading of Sūrah al-Isrāʾsays that “ مكية و قيل مدنية غير ثلث ايات ”. Vat. Ar. 1597 contains details about the numbers of ayahs, words, and letters in the sūrah headings. For instance, for Sūrah al-Nisāʾ, it reads that “ اياتها ق ع اختلافها ب كلماتهاغج ذ م ه حروفها غيول ”. The Arabic letters in this explanation has a numerical value (abjad). According to this the number of āyahs is 170, the number of debated ones in merging with the previous and next verses is 2, the number of words 3.745, and the number of letters is 16.030. There are corrections on the pages of the manuscripts. These corrections may be done through the writing process or during the check reading (muqabala) at the end of the writing. The writing of the text by heart and by looking to the other copy, and the similarities may cause these kinds of errors for the scribe. Studying on Qurʾān manuscripts reveals the different features of the writing of a muṣḥaf. Even though the numbers of the graduate studies gradually increase in Turkey, there is no a PhD dissertation which analyzes a Qurʾān manuscript, and only one M.A. thesis has been recently completed. Therefore, establishing graduate courses on Qurʾān manuscripts in the field of Islamic studies will strengthen the Qurʾānic and tafsīrstudies. (shrink)

The history of the idea of biological progress shows that it is not a selfexplanatory category, so a clear definition is required. Biological progress exists if: “more progressive” is defined as “more complex” – in that case evolution is synonymous with progress, i.e. development from simple to complex, from homogeneous to heterogeneous; we perceive the expression “more progressive” as more successful in relation to the environment, in these terms some groups in the history of life were more progressive because/so that (...) they survived, while others were retrogressive or less progressive because/so that they died out; on the other hand, within their ecological niches, certain forms of life are perfectly adapted to their environment as long as it is stable ; we take the span or reach of a potential adaptation of populations as a measure . However, there is no active, innovative problem solving in relation to the environment either with plants or animals – only the variability mechanism / selection is in place, automatism, instinct. In the light of the above-mentioned biological criteria, man is the most complex living creature by his constitution , he is the least dependent on the environment and can be innovative in relation to the environment. Man is the only living creature capable of establishing an active relationship with the environment through his special tool – culture. Considering the level of organization and quantity of information, the mammal genome is more progressive than the bacterium genome, while the human genome comprises most information which makes man the most progressive living thing. We can talk about biological progress if we define progressiveness as advancement toward complexity of organisation, but sometimes thesimplification of structure enables survival. It seems that we can talk about progressivenessin biology only if we accept the anthropic principle – that is why only cultural progress is possible. Information is the link between biological and cultural-anthropological successfulness . Biological information is a “complete” piece of information to an animal . To a human being, it is only a condicio sine qua non for the reality of human spirit which receives, keeps and generates information. Progress can be measured according to the capability ofestablishing an active and innovative relationship with the environment, but only within some sort of anthropocentric outlook which is a criterion of value. It is not possible to talk about progressiveness of life if man is not the measure of all things.Povijest ideje biološkog napretka pokazuje kako to nije samorazumljiva kategorija, pa se traži jasna definicija. Biološki progres postoji ukoliko: “naprednije” definiramo kao “složenije” – evolucija je tada sinonim napretka, tj. prelaženja iz jednostavnijeg u složenije, iz homogenog u heterogeno; “naprednije” shvatimo kao “uspješnije” s obzirom na okoliš; u tom smislu neke skupine u povijesti života bile su naprednije jer/pa su opstale, dok su druge bile nazadnije ili manje napredne pa/jer su izumrle; s druge strane unutar svojih ekoloških niša pojedini oblici života savršeno su prilagođeni svojem okolišu dokle god je on stabilan ; kao mjerilo uzmemo raspon ili širinu moguće prilagodbe populacija jer tada postoje razlike; ipak ni u biljaka ni u životinja tu nema aktivnog inovatorskog rješavanja problema okoliša, nego djeluje samo mehanizam varijabilnost/selekcija, automatizam, nagon. U svjetlu gore navedenih bioloških mjerila čovjek je svojim ustrojstvom najsloženije biće , najmanje je ovisan u odnosu na okolinu, može se novativno nositi spram okoline. Čovjek je jedini kadar za pravi aktivni odnos prema svom okolišu putem specifičnog oruđa kulture. S obzirom na stupanj organizacije i količinu informacija, genom sisavca je napredniji od genoma bakterije, a genom čovjeka raspolažes najviše informacija, pa je on po tome najprogresivnije biće u prirodi. O biološkom progresu možemo govoriti ako progresivnost definiramo kao porast složenosti organizacije, no ponekad pojednostavljenje građe omogućava preživljavanje. Čini se da o progresivnosti u biologiji možemo govoriti samo usvajajući princip antropičnosti, zato je u svijetu moguć samo kulturni progres. Posjedovanje informacije je veza između biološke i kulturno-antropološke uspješnosti . Posjedovanje biologijske informacije za životinju je “potpuna informacija” , dok je za Čovjeka samo condicio sine qua non za zbiljnost ljudskog duha koji dobiva, posjeduje i stvara informaciju. Progres je moguće mjeriti prema sposobnosti aktivnog i inovativnog odnosa spram okoliša jedino u nekoj vrsti antropocentričnog obzora koji u središtu ima mjerilo vrijednosti. Nemoguće je govoriti o progresivnosti života ako svemu nije mjera sam čovjek. (shrink)

In this study, the term of ‘blessing’, which is a basic Qurʾānic concept, is analyzed. In this regard, the study focuses on the definition of ‘blessing’, its different meanings in the various contexts, synonyms and antonyms and its leading individuals to the dimensions of faith, worship and morality. These subject matters are studied by taking into consideration of the meanings of ‘blessing’ in the Qurʾān and commentators’ explanations about the word. The expression of the ‘blessing’ in the Qurʾān indicates that (...) the word has an extensive and constructive meaning. The fact that having an extensive meaning demonstrates that the points the word encompasses can be determined to some extent. It is exemplified in the Qurʾān what can be regarded as ‘blessing’. Furthermore, the commentators determine various meanings to the word by considering the contexts in which the word is used. It is understood that the aim of using the word in the Qurʾān is to lead the individuals to the dimensions of the faith, worship and morality. It is possible for people to be grateful to God by making this aim more visible in their lives. -/- SUMMARY The word blessing mentioned in the Qurʾān has a general meaning. This type of words contains more than one subject inside them. The fact that the blessing contains more than one subject may be seen in the Qurʾānic attributions of it as well as seen in its dictionary and term meaning. Also, the way of explaining a part of subjects, which are in its content, points out this aspect. Thus, in the Qurʾān, the new ones are being added in another place to things referred as blessing in one place. Also, sometimes the blessings with entirely different contents are included. For example, the blessing of God upon Muslims is His support on a battle. In another place rendering them as brothers is a blessing. This is also an example that blessing was partially explained in the Qurʾān. The explanation of the word is sometimes in the same context and sometimes in different contexts. For example, in the verse 47 of the Surah al-Baqara, the blessing given to Jews in the time of Moses is mentioned. Starting from the next verse, between the verses 49-61, these blessings are aligned. Moreover, the blessing that was given to prophets, martyrs and righteous (siddiq) can be an example for the explanation of blessing in the different verses of the Qurʾān. These people who have been given blessing are mentioned side by side in the verse 69 of al-Nisā’. However, it is not explained that what the blessing given to them is. Each blessing mentioned is explained in different places in the Qurʾān. While some part of blessing is determined by the Qurʾān itself, the other part is attempted to be determined by commentators. Given that the explanations in the Qurʾān and commentaries, the subjects that affected by blessing can be divided into two as tangible and intangible blessings. The resources offered for humans to maintain their lives, emancipation a slave, the wind that helps the ship to move forward and Muhammad himself as a prophet are the tangible ones. Faith, miracle, mercy, reward, retrieving safety, the place where all kind of resources and ease, peace and happiness exist (Heaven) can be commentated as intangible blessings. The subjects included in the concept of blessing in the Qurʾān are changing according to the context. The blessing from God upon believers is “the faith granted by God on the earth” in one place, and “the Heaven bestowed in the afterlife” in another place. When determining the close and opposite meanings of the word, it should not be ignored this aspect of the blessing. In other words, it changes according to the context. For example, if the content of blessing is “the resource presented to human beings”, the close meaning of it in the Qurʾān is “compassion”, the opposite meaning of it is “harm”. However, if the thing that fell within blessing is “reward”, the close meaning will be “good deed”, opposite meaning will be “torment”. The blessing changes according to the addressed person as well. It is the all kind of resource that God presents to humans if the human kind is in question. If it is for a believer, it means moral support and every kind of reward as well as the resources offered. However, if it is relevant to a prophet, the prior meaning is prophethood as well as the meanings above. The expression of blessing in the Qurʾān helps us to have more opinion about it. For example, blessing has a positive meaning according to the Qurʾān. The word’s positive aspect is emphasized by comparing things that cannot be blessing to negative person types. The perception of blessing of Pharaoh and a hypocrite that is expressed in the Qurʾān can be evaluated in this content. According to the Qurʾān, the blessing they qualify is not in the context of blessing. Another aspect that draws attention in the expression of blessing in the Qurʾān is the relationship between the blessing giver and receiver. This relationship between God and servants takes place both in the earth and the afterlife. First, God has presented blessing to humans by considering that he/she is worth creating. Human beings show ingratitude or gratitude for being created and all other blessings. Here, the blessing is a test tool for humans. God responds according to the behaviors of human beings in test. He gives this response either only in the afterlife or both in the afterlife and the earth. If the humans respond the blessing with gratitude, God puts him/her to the heaven full of blessings in the afterlife. The blessing here is the result of the test on the earth. So the purpose of expression of blessing in the Qurʾān is to direct the humans to exhibit the behavior with that God is pleased, gain His contentment, deserve His heaven full of blessings. This is the reason that prophets remind the blessings of God to humans while they invite them to religion. Prophets invite people to believe, worship and be moral toward God as a response to these blessings. -/- Even though the content of blessing changes according to addressed person and time, the principle of the relationship between God and His servants does not change. Blessing and gratitude or blasphemy shall continue to exist as long as mankind exists. Here, the principle of “Every blessing’s gratitude is its own type” can be remembered. This principle recommends that giving thanks to God by tongue only for blessings will not be enough. Because of that, how should be grateful for different blessings should be exemplified. These definitions containing examples help us to understand better the purpose of expression of blessing in the Qurʾān. For example, the gratitude for humans’ own equipment can be through remembering always Him who gave that equipment, obey and worship Him constantly. Gratitude for children and good fortune happens by directing them towards God’s sake. As for the gratitude for the blessing of the universe, that contains signs of the existence of God, can be through recognizing his/her Creator and maintaining its existing order. If human beings break this order, he/she would be ungrateful because this would be an attitude against the one who created this order. Just as a servant might be ungrateful to God when he/she does not appreciate the blessing of prophet that reminds us God, exhibiting negative attitude against the universe that points out the existence of God is a kind of ungratefulness against God as well. So that, the blessing carries humans to faith and worship dimensions and also to moral dimension in terms of relationship between himself/herself and other things. The modern-day people need this Qurʾānic perspective. A human being should review his/her relationship between himself/herself, God, other people and the nature, then he/she should try to reach the Qurʾānic dimension by being grateful properly for blessings that he/she has. Ṣūfī people, as well as the ulema (ʿulemā), discussed the issue of how God (Ḥaḳḳ) surrounds the universe (ʿālem) and where the ʿarş (arsh / the ninth heaven) in which God ensconces himself exists. The Ṣūfī people supporting the unity of existence (Wahdat al-wujud) concept claim that God surrounds the universe by his own being and so that the ʿarş (arsh) is all the creation / created beings by God moreover they argued that people who rejected this idea could attribute (...) weakness or impotence to the power of God. On the other hand, commentators and scholastic theologians acknowledge the idea that God surrounds the universe not by his own being as Ṣūfīs claimed but God surrounds the universe by his knowledge (ʿilm) and power (ḳudret). They claimed that there was no physical connection of God with the universe. There-fore, this article discusses a couplet (beyit) written by Ḥuseyn-i Lāmekānī from Bayramī-Melāmī group in light of four different tracts (risāle). One of the four tracts was written by the author of the couplet Ḥuseyn-i Lāmekānī himself. The title of his tract is Wahdat-nameh (Vaḥdet-nāme). The other tract was written by Munīrī-yi Belgradī and the title of it is Şarḥ-i Qaṣīda-i Suleymān. The other two tracts analyzed in this article were written by Ṣalāḥ al-dīn-i ʿUşşāḳī. These two tracts try to explain how God surrounds the universe from the unity of existence (Wahdat al-wujud) perspective. Therefore, they may help in understanding the men-tioned couplet written by Lāmekānī. The outline of the article is as follows: the introduction has the text of the ghazal including the mentioned couplet and discusses how the characteris-tics of Bayramī-Melāmī people were reflected in their poems. This part also tries to determine who wrote the mentioned ghazal as there were two different pen manes / pseudonyms (mah-las) for the same ghazal in various resources. To determine the original writer of the ghazal is crucial for proper interpretation of the texts. The next part of the article discusses the accusa-tion that Lāmekānī was an heretic in the Şarḥ-i Qaṣīda-i Suleymān tract by Munīrī-yi Belgradī. This part also tries to outline Munīrī-yi Belgradī’s mode of thought to discuss the background of his criticism about the couplets. According to his way of thinking, though Munīrī had some tolerance to Ṣūfī people believing fenā fillāh, he ironically harshly criticized the Ṣūfī group supporting Wahdat al-wujud entitled as Fuṣūṣī. In the second section, based on his work named Wahdat-nameh (Vaḥdet-nāme), it is aimed to create a general portrait of Ḥuseyn-i Lāmekānī. In this context, it discusses how Wahdat al-wujud and Hurufism, which are generally big issues for Bayramī-Melāmī, influenced Lāmekānī. Therefore, the comparison between Oglan Sheikh İsmāʿil-i Maʿşūḳī who was clearly influenced by Wahdat al-mavjud (vaḥdet-i mevcūd) and Hurufism, and Ḥuseyn-i Lāmekānī is realized in this part. It was figured out that adoration of Fuṣūṣ al-Ḥikem (Fuṣūṣīlik) was more influential in Bayramī-Melāmī Sheikh’s mode of thinking through the analysis of the effect of Fuṣūṣ al-Ḥikem in Wahdat-nameh (Vaḥdet-nāme). It was suggested that the reason behind the allocation of Munīrī-yi Belgradī for Ḥuseyn-i Lāmekānī was the effect of Fuṣūṣ al-Ḥikem which was salient for Melāmī Sheikh Lāmekānī. The final part of the article is about two tracts Miftāḥ al-vucūd and Zayl al-kitāb written by Ṣalāḥ al-dīn-i ʿUşşāḳī. The criticized couplet was read under the light of these tracts. These two tracts are significant as they explain how God surrounds the universe and where the ʿarş (arsh) is located by referring to the verses of Quran al-Fussilet 41/54, al-Nisā 4/126 and el-Tāhā 20/5 mentio-ned in the couplet by Ḥuseyn-i Lāmekānī. Ṣalāḥ al-dīn-i ʿUşşāḳī proposed a new argument about how God surrounds the universe in Zayl al-kitāb. According to this argument, in Miftāḥ al-vucūd Ṣalāḥ al-dīn-i ʿUşşāḳī tries to explain God’s surrounding potent through the or-ders/grades of the existence. In Zayl al-kitāb, he claims that there must be a center for God’s surroundings of the universe and this center must be Ḥaḳīḳat al-Muḥammediyye. Ṣalāḥ al-dīn-i ʿUşşāḳī stated that he did not acknowledge this information by himself but he acquired it from Ibn Arabī when he had a dream. Lastly, this part of the article discusses what Rahman settles in ʿarş (arsh) means in terms of circle (devir) theory. It was suggested that according to Ṣūfī people believing Wahdat (vaḥdetçi) God’s ʿarş (arsh) is the human being himself by drawing on the Kasf al-Gıtā (Keşfu’l-Gıtā) qasida written by Sunʿullāh-ı Gaybī who was a successor of Ḥuseyn-i Lāmekānī from the second generation. En la intimidad del diálogo de corazón a corazón entre Macrina y Gregorio en el De Anima et Resurrectione, se puede percibir no sólo una dialéctica: pathos–logos, maestro-discípulo, fe-ciencia; sino también, una estructuración del diálogo inspirada en el Fedro, en la que tras la tesis y la antítesis, se busca como fruto pedagógico del diálogo una síntesis de los elementos en cuestión. Estos dos dispositivos retóricos que también están presentes en De Vita Moysis e In Canticum Canticorum, le permiten al Niseno dialogar con la filosofía y la Sagrada Escritura en medio de su quehacer teológico. En este sentido, se analizará la introducción al diálogo, explorando también la estructura del discurso y su relación con el Fedro (1), para luego analizar los símbolos del caballo y los ojos (2), estableciendo algunas relaciones con De Vita Moysis e In Canticum Canticorum que permiten profundizar en la pedagogía cor ad cor de Macrina hacia Gregorio (3), para finalizar con una breve conclusión. The correct understanding of the Qurʾān verses is possible by examining the concepts in them linguistically and revealing the meaning they express in the integrity of the Qurʾān. The verb “h-m-m” is one of these concepts. This verb has been used as sulasi mucerred in a total of seven verses in Āl-i 'Imrān 3/122, al-Nisāʾ 4/113, al-Māʾidah 5/11, at-Tawba 9/13, 74, Yūsuf 12/24, al-Mu'min 40/5. In our study, the aforementioned verses in which the verb “h-m-m” is used, have been examined (...) through the sources of tafsir and based on the meaning of the mentioned word in the unity of the Qurʾān, the verse of "Woman had tend to him. He also tended to the woman. If he had not seen the proof of his Lord. This is what We did to drive away evil and immorality from him. Surely, he is one of Our sincere servants." (Yūsuf 12/24) has been analyzed. First of all, information about the verb “h-m-m” was given within the scope of the conceptual framework, then it was emphasized that in which verses the related verb is used and how it can be considered within the context of the verse in Yūsuf Surah and narrations about revelation reasons of this verse. In the context of the relevant verse, the views in the "Manar Tafsir" have been handled separately since it differs from almost all commentaries in terms of approach. Although it is examined how the relevant verse in Yūsuf Surah is handled in the Bible, this aspect of the subject has not been mentioned because it will not contribute to our study and because of the limited structure of the article. In the handling of our subject, as a method, the integrity of the Qurʾān within the scope of the verb “h-m-m”, the narrations about the revelation reasons and the context of the verse were taken as basis. The aim of our study is to reveal what is meant by the verb “h-m-m” in the mentioned verse, based on the uses of the verb in the Qurʾān and considering the context of the relevant verse and narrations about its revelation reasons. In this context, it can be said that the verb “h-m-m” in the relevant verse of Yūsuf Surah means to decide and attempt an attack in connection with sexual impulses. (shrink)

Basic characteristic of Islamic heritage law, principally it has accepted the two-to-one ratio between the male and the female children/siblings in division of heritage. In Islamic inheritance law, the main/basic reason why the share of the male is twice the share of the female is no “value” judgments given to female/women in creation and gender in Islam, on the contrary, are real realities related with the roles and financial obligations that man and woman have undertaken, in other words, related with (...) “socio-economic structure/fact” in the family and society structure foreseen by Islam. As a matter of fact, “need principle” is based on in division and succession of heritageand a fair arrangement has been made in accordance with the rights and responsibilities of the husband and wife in Islamic Law. In some classical tafsīr books, the concept of “degree” in the verse “... Men have a degree (right) over women” (Al-Baqara 2/228) mentioning the mutual rights and responsibilities of women and men; and the expression of “lil al-dhakari mithlu haẓẓ al-unthayain” in the verse –the inheritance of man is the share of two women– (Al-Nisā 4/11) mentioning the inheritance shares of boys and girls is interpreted against the woman by disregarding the intended purpose and socio-economic contexts of these verses. As a result of this interpretation, the share of men in inheritance is twice the share of women in Islamic law is ontologically (existential/creation) based on a justification that “man is superior to woman”. In this article/study, an analyticallook atthe interpretations in some classical tafsīr books on the axis of “daraja/degree” and “lil al-dhakari mithlu haẓẓ al-unthayain” that today sheds light on the sociological-historical background of depriving the daughter from the heritage will be made. Summary: Just as there is no way to determine a person’s sex, it is not either possible by reason to have such an opportunity. - With the possibility of medical intervention nowadays - sex is determined by the discretion of the Supreme Creator rather than will. Indeed, it is mentioned in the Qur’ān: To Allah belongs the dominion of the heavens and the earth; He creates what he wills. He gives to whom He wills female [children], and He gives to whom He wills males (Al-Shūrā 42/49.)In addition to human biological sex, there is also social gender. Indeed, the term “sex” refers to being biologically female or male, while the term "gender" refers to the social and cultural identity of a woman or man, or the social roles that occur in the historical process.Accordingly, while it is not possible to determine biological sex (in normal circumstances in advance), determining gender is shaped by the cultural will of individuals and societies. As a matter of fact, gender is shaped according to the religions, customs and cultures of the societies and it shows differences according to time, culture and family structure. In this context, in the pre-Islamic Arab society, the gender of the girl or the woman was shaped by the custom of the ritual and customs. Indeed, it is a known fact that during the period of Jahiliyyah, in terms of social gender, the girl/woman has been deprived of many social and economic rights, especially heritage. The Qur’ān has brought the girls who, in the period of Jahiliyyah, were oppressed in terms of gender, deprived of many social and economical rights, treated as second class human, embarrassed of themselves and buried alive, to the same position as man. In this context, as it is in every field in the direction of social structure and social conditions of that day, also in the field of inheritance law, a number of regulations were made in the Qur’ān and the Sunnah being the main sources of Islam. The divisions of the inheritance were connected with religious and legal rules and the shares of the inheritance of the sons and daughters were determined by naṣṣ (verses and hadiths).However, in Islamic inheritance law, as a requirement of the structure of family and society accepted by Islam, in principle, “two-to-one” measures have been adopted between male and female children. As a matter of fact, in this aspect, it is mentioned in the Qur’ān: Allah instructs you concerning your children: for the male, what is equal to the share of two females (Al-Nisā 4/11.)On one hand, the principle that Islamic law brings between boys and girls; Seems to be an inequality in terms of the arrangement in which "the inheritance share of the male child is twice the share of the female child", while on the other hand, within the border of in the family foreseen by Islam, this regulation has not been seen as an injustice and inequity by Muslim societies, because in Islamic family law, a man is obliged to ensure the livelihood of the family after marriage. He is also obliged to give his wife her mahr when marrying.In Islamic inheritance law, “necessity principle” is taken as the basis of responsibility that women and man have undertaken in family and society. Therefore, even though giving nothing at all to those who are not in need and giving less to those who are in less need, giving too much to those who are in much need might seem contrary to the principle of equality, it is a necessity of the principle of justice and fairness. As a matter of fact, while "law equality, necessity in sharing" principle, law is arranged according to people's qualifications, goods and wealth sharing is divided according to the needs of people. In this context, there has been a fair division in Islamic heritage law based on the necessity, (distributive) justice and fairness principle. Indeed, the French philosopher Roger Garaudy (1913-2012), who chose /converted to Islam, evaluates the following about the proportion of male child in the Qur'an to that of female child: “When we consider that in the Arab society all the obligations of the family and of the care of the parents and of all the things that we call ‘social security’ today are put on the shoulders of the husband, the hereditary male child's share must be twice as high as the female child’s is”.As Garaudy argues, the difference in the inheritance of women and men in Islamic inheritance law is not a legal discrimination/inequality, but a form of divisiveness stemming from a need based on the role and responsibility that women and men have undertaken in the family and society. Therefore, giving nothing to those who need nothing, giving little to those who need little, and giving a lot to those who need a lot,even though may seem contradictious to the principle of equality, it becomes a necessity of equity and (distributive) justice principle. In this case, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child, is social and economic reasons and it is possible to rank them as follows:1) According to Islamic law, women are not obliged to make their own economic livelihoods. The woman’s economic responsibility belongs to her father or brothers before marriage, and then to her husband after marriage. 2) When a woman is married she is not responsible for herself or other family members’ livelihood. The male is obliged to make a living for himself, his wife and his children.3) While married, the male is obliged to give the wife mahr. The woman has no such responsibility.As it is understood from the above explanations, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child is not about the ontologically “value” based on creation and sex given to the woman (girl child) in Islam. On the contrary, it is the real facts concerning the family and society structure that Islam predicts, the roles and financial obligations that man and woman have undertaken, namely “socio-economic structure/fact”.In some commentaries in classical commentary books, the rights and responsibilities of women and men are referred to, like: the word “degree” mentioned in: …but the men have a degree over them [in responsibility and authority (Al-Baqara 2/228), and the talk about the inheritance shares of boys and girls in: for the male, what is equal to the share of two females (Al-Nisā 4/11). Eventually, the concepts “lil al-dhakari mithlu haẓẓ al-unthayain” have been associated with the gender of the woman/girl child ontologically (based on social fact) by ignoring the referent purpose and socio-economic contexts of these verses. As a result of these interpretations, it was desired that the Islamic law principle of inheritance share of male child being twice the share of female child, ontologically, should be based on a justification that “man is superior to woman”.In this study, some of the era’s dominant culture classical interpretations grounding women's inheritances share on her gender and based on the axis of the concepts of "degree" and “lil al-dhakari mithlu haẓẓ al-unthayain” in the related verses of the Qur'ān will be elaborated. Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Islamic law accepts the institution of polygyny as a substitute provision if it fulfills the certain conditions and reasons, -and limited the maximum number of wives to four. Although polygyny is mubah (permissible) in Islamic law, it is not an absolute right that every man can use arbitrarily. Thus in Islamic law, the legitimacy of polygyny has been attributed (...) to the presence of two basic conditions: the observance of justice among co-wives and providing maintnance. However, the observance of these conditions that is left to the mercy of men leads to the exploitation of the right for practicing to polygyny and victimization of the first spouse. Therefore, inserting some restrictions for using this right has come to the agenda from time to time in Islamic legal history. The first legal arrangements concerning the restriction of the polygyny (taaddud al-zawjāt) in the history of Islamic law were indirectly made with the Family Law Decree of 1917 which was prepared in the last periods of the Ottoman Empire. Among the late Islamic jurists, the issue of the limitation of polygyny by public authority in Islamic law continues to be discussed. The civil laws of contemporary Muslim countries contain different regulations on the issue. In this article, the restriction of polygyny by the public authority in Islamic family law will be focused on.Summary: Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Islamic law accepts the institution of polygyny as a substitute provision if it fulfills the certain conditions and reasons, and limited the maximum number of wives to four. Thus, relevant verses in the Qur’an (al-Nisa 4/3, 129) and the Prophet’s own practice (al-Ahzab 33/50, 51, 59 al-Tahrim 66 / 3-5) show that it is legitimate for a man to marry more than one woman (up to four) at the same time in Islamic law. Although polygyny is legally permissible (mubah) in Islamic law it is not an absolute right that every man can arbitrarily use. Thus in Islamic law, the legitimacy of polygyny has been attributed to the presence of two basic conditions: the observance of justice among co-wives and providing maintenance. On the other hand, there may be some exceptional circumstances permitting polygyny in Islamic law. For example, when female population is much more than male in the society and when a, woman is can not fulfill her family duties due to her cureless illness, polygyny is permitted in Islamic law.As it can be understood from the explanations above, polygyny in Islamic law is not a general and mandatory provision that should be applied by every man who has legal capacity to marry. On the contrary, it is an exceptional provision that is justified if there are certain conditions and justifications. According to this; polygyny is a moral and legal institution that is made up of mutual consent based on individual and social conditions and needs in Islamic law. Therefore, men do not have to marry a second woman on their current wives, as well as women have the right to say “no” to marry a married man as a second wife.When the conditions and rationales indicated in the relevant verses and doctrine are evaluated together, it can be said that in order to be able to legitimize the polygyny in Islamic law, there must be three basic conditions:(1) Observing justice among spouses, (2) Having sufficient financial power to provide maintenance for spouses, (3) Existence of individual or social need or necessity.Therefore, in order to prevent the exploitation of polygyny, which is justified under certain conditions and justifications in Islamic law, the above-mentioned conditions must be fulfilled. Otherwise, polygyny can cause some problems, unrest and injustice for individual, family and society. Hence, in the presence of certain conditions and justifications, polygyny accepted in Islamic law as a moral and legal institution aiming the elimination of individual and social arbitration.Although the legitimacy of polygyny in Islamic law depends on the existence of certain conditions and special circumstances, it is a known fact that they are not always observed in practice. It can be said that the right of polygyny is a subject of abuse in practice. Therefore, the limitation of polygyny by the public authority has come to the fore in Islamic legal history. Today, control of the public authority and inserting some restrictions of polygyny continue to be discussed among the Islamic jurists. In the past, it is possible to say that the control of the exercising of this right has been done relatively by society (social environment). However, nowadays, since the society cannot perform the control mechanism, it is brought up by the state (public authority) on behalf of the society.Among the contemporary Islamic jurists regarding the supervision or limitation of polygyny by the public authority; there are two approaches: “those who accept” and “those who do not accept” such restrictions.Islamic jurists, who accept that public authority is allowed to intervene in polygyny, grounded their views on two perspectives: The first is that the polygyny is legally permissible and the public authority has the authority to limit the permissible (mubah) in Islamic law. The second is that polygyny is restricted with the conditions in the Qur’anic verses such as “husband’s observation supervision of justice among his wives” and “having the power for ensuring the livelihood (nafaqa) of his wives” and it is more appropriate for the benefit of society and the purpose of the legislator (Shari’) to be subject to the control of the public authority whether these conditions are present or not. Islamic jurists, who do not agree that the public authority has the right to intervene in polygyny grounded their views on two perspectives as well: First, polygyny is a legitimate right mentioned in the verses in Islamic law and there is no definite proof that this can be prohibited or restricted by the public authority. Secondly, it is contrary to the verses to prohibit or limit the right that the Qur’an makes legitimate (free).Thus, it is possible to say that the opinion which accepts that the public authority has to limit polygyny is more accurate in terms today’s social conditions. Namely, polygyny is linked to two basic conditions: ”husband’s observance of justice among his wives and having the power to provide maintenance for his wives. Therefore, supervision of the public authority on checking the existence of these conditions is more appropriate for the purpose of the legislator (Shari legitimizing polygyny and social benefit.In fact, the Ottoman Family Law Decree of 1917 indirectly limited the right of the husband to marry more than one woman, giving the woman right to stipulate a condition in her marriage contract that her husband not to marry a second woman. In the 1924 Draft of Family Law Decree, which was prepared after the repeal of the Family Law Decree of 1917, but not enacted, it was proposed that the application of polygyny should be presented to the approval judge.In today’-s Muslim countries, there are three different practices: namely “completely prohibiting polygyny”, ”releasing polygyny” and “giving the court the right to monitor the existence of necessary conditions “. In countries such as Morocco, Algeria, Iraq, Syria, Indonesia, Malaysia (and Pakistan), the validity of polygyny depends on the permission and supervision of the judiciary. Some of these countries which have accepted judicial review have given the judicial control for the requirement of justice, some of them the conditions of justice and maintenance some of them for the conditions of justice, maintenance and a legitimate justification.In sum, in accordance with the provisions of the relevant verses, polygyny in Islamic law is legitimately permissible (mubah). However, the public authority has the right and authority to limit the mubah in Islamic law in the case of the elimination of damage and the necessity of the public interest. On the other hand, the public authority has the right and authority to enact the law in Islamic law by preferring one of the existing ijtihads that meet the needs of the society and conforms to the conditions of the age.According to this, when the public authority made a statutory regulation that links the use of right of polygyny to the permission of the judge, this regulation is binding on society.Therefore, in the event of such a legal arrangement, it is possible for the public authority to allow the men who comply with the conditions and not to allow the ones who are not to comply with the conditions after conducting the necessary investigation. As a matter of fact, now Family Laws of many Muslim countries now include such legal arrangements. It is also worth mentioning here that there may be a necessity for a man to marry more than one woman (up to four) at the same time in terms of social benefits, when the population of male and female in a society is excessively disproportionate. In such circumstances, it is also possible that the public authority encourages, or even mandates, the marriage of men who have fulfilled the conditions to more than one woman. (shrink)

al-Qurṭubī (d. 671/1273) was a scholar of tafsīr, ḥadīth and fiqh. He experienced both Western and Eastern civilizations in the geography of Andalusia and Egypt, respectively. In his famous Tafsīr called al-Jâmi li-Aḥkâm al-Qur’ān, al-Qurṭubī comparatively explained and interpreted all legal verses. Also, in addition to exploring the spesific legal rulings denoted in the Qur’ān and the Sunnah, al-Qurṭubī has largely interpreted the legal norms regarding the issues of jurisprudence. By doing this, al-Qurṭubī contributed to the formation and development of (...) a civil codification activity under a kazuistic format. The casuistic structure of the legal exegesis of the Qur’ān is anlaysed in terms of the form and content in the sample of al-Jâmi. Therefore, neither the similarity or similarity of the schools of the legal exegesis of Qur’ān and of the legal schools nor the disciplines of positive law, but their kazuistic structures, which systems they built and which interpretation methods and techniques they operated on this basis, were evaluated in terms of their original structure. In this direction, the article emphasizes that the casuistic structure of the legal exegesis of Qur’ān is established on and by the Prophet’s sayings and practices. Although, it has been observed that it is a unique tradition, both as form and content, and that the interpretation means are identified with its own unique structure, it has been concluded that the casuistic method is not one of the fundamental elements of both this tradition and Islamic legal thought. This means that the casuistic method is always a tool that can be changed and transformed according to the conditions of time and space.Summary: As it is stated in al-Isrāʾ 17/106: “And (it is) a Qur’ān which we have separated (by intervals) that you might recite it to the people over a prolonged period. And we have sent it down progressive.”, the Qur’ān is revelaed in about twenty-three years by taking into consideration the sociocultural positions of its interlocutors. The Prophet Muḥammad explained the Qur’ān by the virtue of the ayah: “(We sent them) with clear proofs and written ordinances. And We revealed to you the message (i.e. that you may make clear to the people what was sent down to them and that they might give thought.” (an-Naḥl 16/44). Of course, there is no subject integrity in this Qurānic chronology-which also reflects life. As a matter of fact, the issues related to individual and society have been independently analyzed by a casuistic/case-based method and ruled in accordance with the intention of Allāh. It can be seen that the ayahs “They ask you about wine and gambling. Say, ‘In them is great sin and (yet, some) benefit for people. But their sin is greater than their benefit.’ And they ask you what they should spend. Say, ‘The excess (beyond needs).’ Thus Allāh makes clear to you the verses (of revelation) that you might give thought.” (al-Baqara 2/219) and other ayahs such as (al-Baqara 2/186; al-Nisāʾ 4/176; al-Anfāl 8/1) reflect the casuistic method in terms of form and content. This can also be exemplified by the Sunna. For example, when the question “Is it permissible to perform ablutions with sea water?” was posed to Messenger of Allāh. He said that “It’s water is clean and his dead (fish) are lawful “(Abū Dāwūd, “Ṭaḥāra”, 41). By this answer, the Prophet Muḥammad indeed ruled and established a general rule.It can be said that this early example table formed the basis of the legal exegesis of the Qur’ān in terms of origin, source and application, and that its shape and content are often immanent in the examples it contains. In this article, based on the prophetic period, the legal exegesis of the Qur’ān and casuistic structure has been studied with an analytical and critical approach. Again, because the casuistic method is one of the universal concepts of east-west science and cultural life, an interdisciplinary approach was exhibited in this study. The roots of the casuistic method date back to 5000 BC and the legal systems of the society and states of antiquity are examined from this method. This method is chosen and used in the legal exegesis of the Qur’ān. However, this study does not analyse the sameness or the similarity of the legal exegesis of the Qur’ān and the legal schools nor the positive law disciplines, but the casuistic structures used by these, the systems they have built on this basis and the interpretation methods and techniques they have been used and analyzed in terms of their originality.In effect, the article embodies the Qur’ānic exegesis called al-Jâmi li-Aḥkâm al-Qur’ān by al-Qurṭubī (d. 671/1273), a scholar of tafsīr, ḥadīth and fiqh. In addition to the works of the aḥkām al-Qur’āns, which deal with the interpretation of the ayahs related to the subjects of ʿibādāt, muʿāmalāt ve ʿuḳūbāt, many other works have been used in parallel with the development of the legal exegesis of the Qur’ān. al-Qurṭubī, who comparingly explained the legal verses in his tafsīr, investigated the aspects of the Qur’ān and Sunna that indicate the aḥkām, generally interpreted the existing legal norms within the framework of evidence and introduced his own opinions and etasblished his ijtihād. Thus, he benefited from the tafsīr accumulation and contributed to the formation and development of a civil legalization activity with casuistic format. As a matter of fact, the casuistic/case-based method has been used as a codification/tadwīn technique by Western and Eastern legal disciplines and systems. The casuistic method covers both concrete event and abstract ruling methods. In the casuistic method, which is fact-based event, the laws are organized according to all possible events that can be experienced. On the other hand, the abstract method, which is defined as the abstract ruling method, aims to organize the laws in a general and abstract framework. In the article, it is stated that the legal exegesis of the Qur’ān contains both concrete and abstract dimensions in its own way. It has been emphasized that the legal exegesis of the Qur’ān is based on divine revelation (waḥy) and that it is separated from human law as its origin and source, and that this feature is its most faithful characteristic. On this basis, the legal exegesis of the Qur’ān is a separate scholarly tradition and has its own definition, subject and purpose. Its original structure and function have been noted. As a matter of fact, the subject and purpose of the legal exegesis of the Qur’ān always require the tafsīr and taʾwīl of the legal verses having regard to the Qur’ān and Sunna. It is also necessary for the purpose of investigating the ways in which nuṣūṣ (an explicit statement upon which a ruling is based) can refer to the provisions and to resolve the issues related to individuals and society. As a matter of fact, the legal verses function as a guide for humanity until the day of judgment as the inspiration for religious-legal matters; they contain the content and provisions that offer happiness in the two worlds. Kur’an tasavvuru belli kavramlardan meydana gelmektedir. İnsanın fiziki ve manevî yönünü ifade eden fıtrat kavramı, Kur’an tasavvurunu ifade eden önemli kavramlarından biridir. Fıtrat kavramının ilk günden itibaren tefsircilerin ilgi odağı olması da bundandır. Genellikle fıtrat, İslam dini, ilk yaratılış ve insanın dini kabul etme potansiyeli olarak yorumlanmış ve bunların değişip değişmeyeceği üzerinde durulmuştur. Rum sûresinde geçen “khalqullah” ile Nisâ sûresinde geçen “khalqullah” terkiplerinin bulunduğu âyetler arasında bu çerçevede bağlantı kurulmuştur. Bu çalışmamızda fıtratın mahiyeti ile fıtratla ilgili âyetlerin birbiriyle ilişkilendirilmesi irdelenecek (...) ve fıtratın temel unsurları üzerinde durulacaktır. Akıl, sevgi, aşk, güzel şeylere ilgi duyma ve çirkinliklerden kaçınmanın, insan fıtratının temel bileşenleri arasında yer alıp almadığı tartışılacaktır. Ayrıca fıtrat âyetinde geçen tebdîl kavramı ile Nisâ sûresinde geçen tağyir kavramının, aynı manayı ifade edip etmediği üzerinde durulacaktır. (shrink)

El presente artículo trata de mostrar la presencia del pensamiento de Ireneo de Lyon en el sustrato del pensamiento de Gregorio de Nisa en una de sus obras cumbres: el Comentario al Cantar de los Cantares. Esta obra refleja la confluencia de una profunda reflexión a partir del texto bíblico y la filosofía de la época. El niseno se ubica en la tradición de los autores eclesiásticos que han comentado este bello poema de amor veterotestamentario. Si bien es cierto (...) que en la edición crítica de la obra no aparece nunca citado el lugdunense se pueden encontrar ciertos núcleos conceptuales y temáticos que ayudan a descubrir una recepción de Ireneo en el Comentario al Cantar de Gregorio. Esos elementos permiten poner de relevancia la relación existente entre estos dos autores patrísticos que se conectan para mostrar la realidad esponsal de la iglesia que posee un dinamismo pneumático-salvífico abierto a toda la humanidad. The purpose of this article is to show how Ireneus of Lyon´s thought was present in one of Gregory of Nyssa´s fundamental works: Commentary on The Song of Songs. This work reflects a convergence of deep biblical reflection and the philoshophy of the time. Gregory is among the ecclesiastical writers who have commented on this beautiful love poem in the Old Testament. Even though there is no mention of the Lugdunian in the critical edition of the work, some concepts and themes may be found which help identify an influence form Ireneus on Gregory´s Commentary on the Song of Songs. These elements allow us to give relevance to the relationship between these two patristic authors, who come into contact in order to show the church´s spousal reality, which has a pneumatological-salvific dynamics, open to all mankind. Resumen El presente artículo pretende poner de relieve a partir de la obra In Canticum canticorum de Gregorio de Nisa, el recorrido que el autor realiza en torno al tema de la visión mística. De esta manera se podrá analizar algunos conceptos que lo comprenden: luz y su antítesis noche; así como también detenerse en la formulación de los términos ojos-visión; lo cual nos remitirá a la pregunta, ¿qué es lo que se ve? y/o ¿quiénes contemplan a Dios como (...) El es? De este modo, la contemplación en la obra del Niseno obtendrá alcances significativos desde una lectura antropológica cristiana.This paper intends to highlight, from Gregory of Nyssa’s In Canticum canticorum, the author’s journey around the issue of mystic vision. In this way, some of his concepts can be analyzed: light and its antithesis night, along with making a stop in the formulation of the terms eyes-vision, which will lead us to the question, what is that which is seen? and/or, who contemplates God as He is? So, contemplation in the work of the Nicene will have meaningful approaches from a Christian anthropological reading. (shrink)
