This article considers the extent to which insights from the philosophy of art can assist copyright law in identifying the author or authors of works to which many have contributed. In doing so, it looks to institutional theories of art, which go beyond a simple bifurcation of ‘author’ and ‘work’, and focus instead on broader determinants of an art work’s production, such as the ‘artworld’. It puts forward a framework focusing on three components of authorship supported by these theories: role, (...) authority and intention. The paper then draws attention to some important challenges that this framework raises for copyright law’s joint authorship doctrine in the UK and USA, and suggests some ways in which copyright law might be reformed, so as to allow copyright to retain its own benchmarks while also bringing conceptions of authorship in law and art closer together. Recruiting research participants based on genetic information generated about them in a prior study is a potentially powerful way to study the functional significance of human genetic variation, but it also presents ethical challenges. To inform policy development on this issue, we conducted a survey of U.S. institutional review board chairs concerning the acceptability of recontacting genetic research participants about additional research and their views on the disclosure of individual genetic results as part of recruitment. Our findings suggest there is (...) unlikely to be a “one-size-fits-all” solution, but rather several ethically acceptable approaches to genotype-driven recruitment, depending on context. Disclosures made during the consent process for the original study and the clinical validity of the results are key considerations. Researchers must be prepared to communicate and answer questions in clear lay language about what is known and not known regarding the role of genetics in their proposed area of research. (shrink)

Many countries, including Australia, have established a national scheme that supports the recognition of a single ethical review for multi-centre research conducted in publicly funded health services. However, local site-specific governance review processes remain decentralised and highly variable. This short report describes the ethics and governance processes required for a negligible risk national survey of physiotherapy-led airway clearance services in Australia. We detail inconsistencies in research governance document preparation and submission (platforms, processes, forms and signatories) and report the time cost (...) and likely impact of these inconsistencies on health services research outcomes. Processes and strategies that facilitated success in this project are identified and summarised as helpful hints to other researchers looking to embark on negligible risk research in public health facilities. A prominent view in contemporary political theory, the ‘associative view’, says that duties of justice are triggered by particular cooperative relations between morally significant agents, and that ‘therefore’ principles of justice apply only among fellow citizens. This view has been challenged by advocates of global justice, who point to the existence of a world-wide cooperative network to which principles of justice apply. Call this the challenge from geographical extension. In this paper, I pose a structurally similar challenge to the associative (...) view: the challenge from species extension. This says that the existing network of cooperation extends beyond the human species, to encompass some non-human animals, particularly domesticated dogs. In light of this, if one believes that (i) certain non-human animals are morally significant (i.e. objects of moral concern), and that (ii) justice applies to fellow cooperators, one should also hold that domesticated dogs are owed justice in much the same way our human fellow citizens are. I conclude by considering the implications of this argument for the associative view, and animal-rights theory. (shrink)

We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. A growing number of multi-stakeholder initiatives seek to improve labor and environmental standards through third-party certification. Fairtrade, one of the most popular third-party certifications in the agro-food sector, is currently expanding its operations from its traditional base in commodities like coffee produced by peasant cooperatives to products like flowers produced by hired labor enterprises. My analysis reveals how Fairtrade’s engagement in the hired labor sector is shaped by the tensions between traditional market and industrial conventions, rooted in price competition, bureaucratic (...) efficiency, product standardization and certification and alternative domestic and civic conventions, rooted in trust, personal ties, and concerns for societal wide benefits. At the global level, these tensions shape Fairtrade’s global standard setting as reflected in Fairtrade’s recently revised labor standards. At the local level, these tensions shape the varied impacts of certification on the ground as revealed through a case study of certified flower production in Ecuador. (shrink)

In this paper we report on empirical research which investigates social capital of Small and Medium Sized Enterprises (SMEs). Bringing an international perspective to the work, we make a comparison between 30 firms located in West London and Munich in the sectors of food manufacturing/production, marketing services and garages. Here we present 6 case studies, which we use to illustrate the early findings from this pilot project. We identify differences in approach to associational membership in Germany and the U.K., with (...) a greater propensity to "belong" to an official group in Germany. We distinguish clear sectoral similarities across the countries, and indications that certain personality types will seek out engagement and find time beyond busy work life schedules, often merging work/home/leisure life and friends. Some of our cases illustrate that formal institutions, networks and mutual relationships can develop social capital for the SME, although we should take care not to assume a universal win-win situation for those who are engaged and contribute to the common good. Some of the obstacles to cooperation and civic engagement are outlined. (shrink)

Messaging from U.S. authorities about COVID-19 has been widely divergent. This research aims to clarify popular perceptions of the COVID-19 threat and its effects on victims. In four studies with over 4,100 U.S. participants, we consistently found that people perceive the threat of COVID-19 to be substantially greater than that of several other causes of death to which it has recently been compared, including the seasonal flu and automobile accidents. Participants were less willing to help COVID-19 victims, who they considered (...) riskier to help, more contaminated, and more responsible for their condition. Additionally, politics and demographic factors predicted attitudes about victims of COVID-19 above and beyond moral values; whereas attitudes about the other kinds of victims were primarily predicted by moral values. The results indicate that people perceive COVID-19 as an exceptionally severe disease threat, and despite prosocial inclinations, do not feel safe offering assistance to COVID-19 sufferers. This research has urgent applied significance: the findings are relevant to public health efforts and related marketing campaigns working to address extended damage to society and the economy from the pandemic. In particular, efforts to educate the public about the health impacts of COVID-19, encourage compliance with testing protocols and contact tracing, and support safe, prosocial decision-making and risk assessment, will all benefit from awareness of these findings. The results also suggest approaches, such as engaging people's stable values rather than their politicized perspectives on COVID-19, that may reduce stigma and promote cooperation in response to pandemic threats. The family presents an interesting challenge to many conceptions of collective activity and the makeup of social groups. Social philosophers define social groups as being comprised of individuals who knowingly consent to their group membership or voluntarily act to continue their group membership. This notion of voluntarism that is built into the concept of a social group rests upon a narrow conception of agency that is difficult to extend beyond able-minded autonomous adults. Families, however, are often comprised of members who (...) supposedly lack this developed sense of agency and are therefore considered incapable of consenting to join or remain in a group: infants and small children. So, the family seems to be an odd fit for the designation of social group, even though it is often heralded as a paradigm example of one. In this paper I argue that children and infants are in fact agents who are capable of collective intentionality, especially in the context of the family where they act cooperatively and reciprocally with their caretakers. In doing so, I present an understanding of the family as a social group that has degrees of voluntarism for all members in the forms of joint readiness and joint commitment. I argue for this in three steps. First, I employ Margaret Gilbert’s concepts of joint commitment and joint readiness as a framework for collective intentionality. Second, echoing Carol Gould, I argue that we ought to expand our understanding of agency beyond the ideal case. Third, I draw upon recent research from Michael Tomasello that demonstrate a child’s ability to act cooperatively and reciprocally. Together these steps provide a strong foundation for the claim that children and infants are agents capable of collective intentionality within families. (shrink)

The aim of the chapter is to discuss and evaluate the epistemic role of emotions in participatory sense-making, assuming 4Ecognition as background. I first ask why could emotions be beneficial for the collective processes of knowledge, especially discussing Battaly and arguing for a conceptualisation of emotions as socially extended motivations in virtue epistemology; then, I discuss participatory sense-making, both conceptually and phenomenologically, arguing for a fundamental role played by emotions in boosting epistemic cooperation and determining the quality of social bonds. (...) I advocate their specific function in epistemic cooperation. Epistemic cooperation is what brings about the generation of a shared meaning in participatory sense-making and thus, since emotions function as socially extended motivations, they boost the relationships among the agents, bonding them to the aims of their epistemic community. Feminist criticism of health care and ofbioethics has become increasingly rich andsophisticated in the last years of thetwentieth century. Nonetheless, this body ofwork remains quite marginalized. I believe thatthere are (at least) two reasons for this.First, many people are still confused aboutfeminism. Second, many people are unconvincedthat significant sexism still exists and aretherefore unreceptive to arguments that itshould be remedied if there is no largerbenefit. In this essay I argue for a thin,``core'' conception of feminism that is easy tounderstand and (...) difficult to reject. Corefeminism would render debate within feminismmore fruitful, clear the way for appropriaterecognition of differences among women andtheir circumstances, provide intellectuallycompelling reasons for current non-feminists toadopt a feminist outlook, and facilitatemutually beneficial cooperation betweenfeminism and other progressive socialmovements. This conception of feminism alsomakes it clear that feminism is part of alarger egalitarian moral and political agenda,and adopting it would help bioethics focus onthe most urgent moral priorities. In addition,integrating core feminism into bioethics wouldopen a gateway to the more speculative parts offeminist work where a wealth of creativethinking is occurring. Engaging with thisfeminist work would challenge and strengthenmainstream approaches; it should also motivatemainstream bioethicists to explore othercurrently marginalized parts of bioethics. Transplantation experiments have shown that developing metazoan organs carry intrinsic information about their size and shape. Organ and body size are also sensitive to extrinsic cues provided by the environment, such as the availability of nutrients. The genetic and molecular pathways that contribute to animal size and shape are numerous, yet how they cooperate to control growth is mysterious. The recent identification and characterization of several mutations affecting growth in Drosophila melanogaster promises to provide insights. Many of these mutations affect (...) the extrinsic control of animal size; others affect the organ‐intrinsic control of pattern and size. In this review, we summarize the characteristics of some of these mutations and their roles in growth and size control. The aim of the paper is to discuss and evaluate the role of positive emotions for cooperation in dialogical inquiry. I analyse dialogical interactions as vehicles for inquiry, and the role of positive emotions in knowledge gain is illustrated in terms of a case study taken from Socratic Dialogue, a contemporary method used in education for fostering group knowledge. I proceed as follows. After having illustrated the case study, I analyse it through the conceptual tools of distributed cognition and character-based (...) virtue epistemology, focusing on the two functions that emotions seem to play in the process of knowledge-building. These functions are motives for joint inquiry, and building blocks of the affective environment where the inquiry takes place. Positive emotions such as love and gratitude foster knowledge generation by providing an environment for posing questions and exploring aspects of a specific topic that a subject would not investigate outside of a group. This analysis helps me defend the thesis for which positive emotions are beneficial for cooperation. Because cooperation is the process that leads a group to cognitive transformation, emotions that support cooperation are beneficial for group knowledge creation as well. I assume that the beneficial function that positive emotions play within dialogical inquiry is the one of enhancement of cooperation. A beneficial factor not only comprises positive emotions that facilitate and strengthen cooperation among the agents in their epistemic practices, but also consists of such emotions that nurture the epistemic agents, enhancing their responsibility to generate epistemic goods, as propositional knowledge or explanatory understanding, for example. Thus, the responsibility toward the epistemic practice disclose the ethical dimension of group inquiry. (shrink)

Climate change is an anthropogenic existential threat that provokes extreme concern among climate scientists, but not, it seems, among all member of the public. Here, there is considerably more variability in level of concern and, it appears, in everyday sustainable behavior. But how does personality affect this variability in behavior? And how are underlying personality states like dispositional optimism linked to more sustainable everyday practices? Research in clinical psychology has suggested that dispositional optimism is a very positive personality characteristic associated (...) with higher levels of hope and resilience, but applied research from other domains has reported that optimists can, on occasion, bury their heads in the sand and avoid attending to external threats, like climate change, in order to maintain mood state. So are optimists more immune to climate change messaging than non-optimists? And do they make fewer sustainable choices? A series of experimental studies, manipulating signifiers of carbon footprint (Study 1) and eco labels on products (Study 2) found that optimists made more sustainable choices than non-optimists and that both groups were influenced equally by climate change film clips in terms of sustainable choices (Study 1). Optimists also displayed a false consensus effect, overestimating the proportion of people who would behave more sustainably like themselves (Study 3). Given that global problems like climate change need concerted, cooperative effort, these optimistic beliefs about how others behave could be adaptive in the long-run. Designing climate change messages to appeal to optimists might be a critical consideration for the future. (shrink)

A study on recruitment interviewing in Germany, U.K. and the Netherlands is used to demonstrate the value of interdisciplinary business ethics research, particularly across cultures.

If Christian theological and ethical thought can be shown to explain and shore up the notion that [End Page 190] "people matter" better than other ethical outlooks—and the authors believe it can—then the work will have (1) established a proper moral foundation for holding and acting on the conviction that people matter and (2) provided a reasoned argument for why Christianity as a fundamental belief system is better and truer than the other ethical systems examined.The text of Why People Matter is accessible and well written. The essays weave together coherently around two central ideas: each human person has inherent, inalienable dignity, and Christianity is the truest way of understanding and acting on that conviction. To demonstrate what Christianity has to offer, the book begins (after a summative introduction by Kilner) with a set of essays describing five ethical outlooks: utilitarianism, collectivism, individualism, naturalism, and transhumanism. In each, a different author lays out an ethical foundation and concept of the outlook, shows how the concept illuminates why "people matter," explains why it may seem compelling, and argues that it fails to grasp something crucial about why people matter and how to live as if they matter. As Kilner puts it, "each [outlook] recognizes and champions something important that is missing in other ways of thinking. However, each is dangerously reductionistic by making that missing element the all-encompassing focus of its approach" (190).Next, Kilner examines the Christian conviction that every human being is made in the image of God. He argues that this conviction, rightly understood, provides the only adequate foundation for the idea that "people matter." Respect for the image of God leads to proper respect for the human rights of others. Following this, David Gushee analyzes biblical passages and themes to argue that encounters with human beings are always also encounters with God; thus, we must treat people accordingly.Why People Matter accomplishes its purpose as an apologetic, and it seems especially likely to help committed Christians understand how their moral convictions can hold up in debates with common Western philosophical ethical outlooks. A wise friend once described C. S. Lewis (referenced several times in the work) as "a master of convincing Christians that what they already believe is true." That sort of persuasion is one of the appropriate goals of apologetic, and Why People Matter seems likely to achieve it.I have two comments on areas where readers may come away unsatisfied. First, the contributors' descriptions of the ethical outlooks they discuss are necessarily brief; those who hold these outlooks would likely wish to quibble with or nuance their arguments. Second, the work addresses only Western philosophical outlooks; the authors do not engage non-Christian religious traditions. In the spirit of interreligious cooperation, this is an excellent decision: frankly, I would not want to read a work that spent several chapters explaining why Christian ethical thought is superior to the ethical thought of, say, Hinduism or Judaism. But the work does leave unanswered, and unasked, the question [End Page 191] of whether a reader who does come to reject individualism, transhumanism, and so on might not just as well embrace Islam or Buddhism as Christianity.That said, this is an engaging work on the title question. Consider the problem of the Other, managing acculturation and cultural cohabitation becomes a political issue, and the management of the relationship between culture and communication, society and politics requires the construction of specific theories and adapted. An important edited collection on US and European migration policies as vehicles or factors of institutional racism are dealt with in this review-essay. In the context of recent literature on migration, Pietro Basso’s State Racism proposes a specifically Marxist approach and represents a sharp critical analysis of the ongoing surge in racism sweeping across Western Europe and North America by offering an investigation into the authoritarian, racialising, and elitist drift of Western democracies and societies. Particular importance is given to the (...) spread of hostility towards migrants among native workers, often due to a condition of isolation, weakness, and vulnerabilities produced by the failures of trade unions and political organisations of the working class. The essays in the collection point towards ways in which these can be effectively thwarted and blocked by renewing collective struggles and solidarity, arguing that solidarity can stimulate the development of anti-racism based on the unity of the working class, capable of combating all types of discrimination through self-organisation, equality, and cooperation between migrant and native workers in the common struggle to assert needs and rights. At the present conjuncture, workers across borders can be the carriers of a new form of civilisation, liberated from the supremacy of the commodity and of money, from the exploitation of labour, and from racism and sexism. As past research has identified frontline employees as the primary communicators of a company’s CSR, this paper reports on a large-scale quasi-field experiment aimed at gaining a deeper understanding of the levers of successful in-store, point-of-sale, CSR communication. In cooperation with a large international retailer, the authors analyzed the effects of varying in-store CSR communication strategies in 48 unique stores, combining data from a customer survey, company records of customers’ real visits and purchases, and interviews with store managers. Taking into (...) account the nested structure of the data, the authors reveal that CSR-related training of frontline employees bestows its favorable effect on customers and customer behavior only if it is accompanied by the store managers’ personal support for CSR. Just Ecological Integrity presents a collection of revised and expanded essays originating from the international conference 'Connecting Environmental Ethics, Ecological Integrity, and Health in the New Millennium' held in San Jose, Costa Rica in June 2000. It is a cooperative venture of the Global Ecological Integrity Project and the Earth Charter Initiative.

In the study of innovation institutions, it is important to consider how different institutional models can affect a research organization in conducting or funding successful work. As an industry collaborative, Semiconductor Research Corporation provides an example of a privately funded institution that leverages the inputs of several member companies, along with federal funding, to accomplish innovation in its mission area. SRC has several component programs, all attempting to find innovative solutions to semiconductor problems, but on different time scales, and in (...) different technology areas. But how does SRC use its resources to ensure these goals? Through data gathered from semi-structured qualitative interviews and SRC documentation, this paper addresses that question. SRC has found a way to leverage industry money to motivate and develop a robust field of university research for over 30 years. SRC uses several mechanisms for maintaining an application focused, member-centered decision process, institutional flexibility, and strong ties between industry contributors and university researchers. SRC has continued to keep its members satisfied by training thousands of graduate students for employment in their member companies, by focusing on precompetitive research that addresses industry requirements, and doing so in a manner that operates leanly, with low overhead to its funders. Given these successes, we identify aspects of SRC operations, such as a focus on its member company needs, frequent interactions between funders and researchers, flexible funding mechanisms, and focus on workforce development, that may be diffusible to innovation institutions, including federal research efforts. In this paper we argue that the formalisms for decoherence originally devised to deal just with closed or open systems can be subsumed under a general conceptual framework, in such a way that they cooperate in the understanding of the same physical phenomenon. The deepening U.S. farm crisis has been accompanied by numerous benefit fund raisers, individual donations and volunteer programs—all an expression of cooperation and concern on the part of U.S. citizens, farmer and non-farmer alike. These responses have received wide media attention and much public praise. A sense of patriotism and self-reliance underlies their popularity. Nevertheless, such efforts work to undermine their own ultimate objective—that of improving the economic circumstances of the family farm and farm family.This irony, it is argued, arises (...) from the fact that these charitable responses typically depoliticize the nature of the U.S. farm crisis. First, they deflect public attention away from the larger economic context and the structural inequities within it. Second they revitalize agrarian-based myths which serve to rationalize and to reproduce the ‘independent’ behavior of small, commercial farmers. Finally, it is argued that the depoliticization of the farm crisis is itself a political strategy, one which supports and legitimizes ‘business as usual’ and is compatible with the interests of corporate agriculture. These two subjects both share three fundamental characteristics: a captivating appearance, usefulness, and also are ubiquitous in everyday life. This is particularly evident nowadays in mobile devices such as smartphones and tablets that are featured with a touchscreen technology. The paradigmaticity of such a comparison stands in the planning, and organizational quality, common to the two above mentioned subject (...) areas. Commons. In this article we review the emerging literature on the self-transcendent emotions. We discuss how the self-transcendent emotions differ from other positive emotions and outline the defining features of this category. We then provide an analysis of three specific self-transcendent emotions—compassion, gratitude, and awe—detailing what has been learned about their expressive behavior, physiology, and likely evolutionary origins. We propose that these emotions emerged to help humans solve unique problems related to caretaking, cooperation, and group coordination in social interactions. The expansion of research on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises important neuroethics and policy questions related to data sharing. However, there has been little empirical research on the perspectives of experts developing these technologies. We conducted semi-structured, open-ended interviews with aDBS researchers regarding their data sharing practices and their perspectives on ethical and policy issues related to sharing. Researchers expressed support for and a commitment to sharing, with most saying that they were either sharing their data (...) or would share in the future and that doing so was important for advancing the field. However, those who are sharing reported a variety of sharing partners, suggesting heterogeneity in sharing practices and lack of the broad sharing that would reflect principles of open science. Researchers described several concerns and barriers related to sharing, including privacy and confidentiality, the usability of shared data by others, ownership and control of data (including potential commercialization), and limited resources for sharing. They also suggested potential solutions to these challenges, including additional safeguards to address privacy issues, standardization and transparency in analysis to address issues of data usability, professional norms and heightened cooperation to address issues of ownership and control, and streamlining of data transmission to address resource limitations. Researchers also offered a range of views on the sensitivity of neural activity data (NAD) and data related to mental health in the context of sharing. These findings are an important input to deliberations by researchers, policymakers, neuroethicists, and other stakeholders as they navigate ethics and policy questions related to aDBS research. BackgroundMoral distress is a phenomenon that can lead to an imbalance of the mind and body. There are many coping strategies to overcome the obstacles that lead the subject to this condition. Some coping strategies are capable of being achieved through the cultivation of moral resilience.AimThe aim is to identify the strategies of moral resilience in the nursing management of University Hospitals in Brazil.Research designThe research design is the qualitative study with discursive textual analysis.Participants and research context: 44 nurse managers (...) and nurses in leadership positions participated in a total of 30 University Hospitals in Brazil. Data were collected online, using a questionnaire with open questions.Ethical considerationsThe Ethics Committee approved the study. Participants received information about the research, agreed to respond to the questionnaire, and were guaranteed anonymity.FindingsPersonal adaptive strategies (intrapersonal and interpersonal) and organizational collaborative strategies (intrinsic and transformational management) emerged from this process. The intrapersonal strategies involved elements of rationality, flexibility, rebalancing practices, moral courage, and detachment. The interpersonal strategies addressed support networks, team involvement, and dialog. Organizational strategies dealt with actions which reorient ethical infrastructure, ethical education, and psychological protection, as well as fostering dialogical relationships, empowerment, and cooperation.ConclusionFrom the perspective of social historical construction, it is understood that developing personal and organizational strategies is essential to cultivating moral resilience. The paper presents the territorial and axiological context and the peculiarities of the participatory project developed by the Polis Research Centre and the Bon Pastor Neighbourhood Association, as well as the first steps in the design of two interventions. The first intervention, the Wall and Party Walls in Rodriguez de la Fuente Square, is proposed within the framework of the sustainable development strategies of Barcelona City Council. Its main objective is to achieve thermal insula­tion of the affected dwellings, thus contributing (...) to the well being of the residents and to the reduc­tion of CO 2 emissions into the atmosphere. Besides, it is aimed to solve landscape discontinuity. In the lower part of the party walls, there is a wall, a kind of plinth that the residents have chosen as a site for the expansion of the work on the civic remembrance of the neighbourhood. There, the “Living Memory” space will be set up, reserved for interventions by children from the quarter’s schools through a work programme run in cooperation with them. The second intervention is the case of the centennial Mulberry Tree classified as a tree of local interest. In 2018, the mulberry tree suffered some damage from thugs who threw firecrackers inside. Therefore, the need was pointed out to reorganise the space around the tree in order to create dissuasive effects and preserve its integrity. These are preliminary studies to be discussed by the agents involved in the project: the Sant Andreu District, the IMPUQV (Institut Municipal del Paisatge Urbài la Qualitat de Vida), and the Bon Pastor Neighbourhood Association. Laura Valentini’s Justice in a Globalized World presents, with admirable clarity, a new, hybrid conception of global justice that builds on insights from both cosmopolitans and statists, especially their relational variants. Relational cosmopolitans generally argue that substantial economic cooperation and interdependence (i.e., the relevant economic relations) trigger robust obligations of distributive justice. They then argue that, as a matter of fact, these relations obtain globally in virtue of intensifying global trade, capital flows, and labor migration. Thus, relational cosmopolitans conclude (...) that obligations of distributive justice directly apply to the global economic order. Relational statists, by contrast, argue that obligations of distributive justice are trigged by coercive, political relations. Furthermore, these coercive relations only obtain—and can only be justified—within a state. As a consequence, the global order is a ‘secondary site’ of justice that ought to be con. (shrink)

In this article, Laura Quintana elaborates on a conceptual distinction between violence and rage. Along with this distinction, she recognises that while rage may possess a destructive potential, it can also be politicised in emancipatory practices that confront conditions of injustice and structural violence. Her analysis centers on contemporary political movements in Latin America, which she views as collective manifestations of rage. Within these movements, the manifestation of rage is intertwined with forms of care and communal labor. Quintana characterises (...) such movements as embodying a “dignified rage” (digna rabia) that calls for an emancipatory transformation of the status quo. She contends that these practices can be understood in terms of the notion of “anti-violence,” as it has been coined by Étienne Balibar. In this she diverges from Judith Butler, since, according to Quintana’s analysis, such practices challenge the demand for non-violence that has often served to neutralise the disruptive force of such manifestations and movements. In this article I argue that characterizations of anger as a hostile emotion may be mistaken. My project is empirically informed and is partly descriptive, partly diagnostic. It is descriptive in that I am concerned with what anger is, and how it tends to manifest, rather than with what anger should be or how moral anger is manifested. The orthodox view on anger takes it to be, descriptively, an emotion that aims for retribution. This view fits well with anger being (...) a hostile emotion, as retribution is punitive. I will argue that a different view of anger deserves our attention. On this alternative view, anger aims for recognition of harms done, rather than for the punishment of those who have committed them. I argue that we have reason to favour a strong view that excludes retribution from anger’s main aims. In addition, I offer a diagnosis of the reasons that led the retributive view of anger to become, and remain, orthodoxy. This diagnosis provides indirect reason to give my descriptive proposal serious consideration, for it highlights that the orthodox view has dominated folk and philosophical conceptions of anger for reasons that do not speak in favour of the view’s veracity. The view that anger is a hostile emotion will therefore emerge as in need of serious scrutiny. (shrink)

Et il n'y a sans doute pas d'image plus typique du blockbuster que celle d'une gigantesque explosion. Les déflagrations dont il s'agit dans ce livre ne sont pas uniquement celles que racontent les films. Produit grand public, confectionné grâce à d'immenses investissements financiers, le blockbuster s'apparente à une bombe à fragmentation, pulvérisant l'objet filmique dans des (...) contextes de consommation qui n'ont plus rien à voir avec le cinéma, se diffractant sur le marché mondial sous forme de produits dérivés, T-shirts, figurines et autres gadgets. Sept auteurs, philosophes et critiques, se sont penchés sur quelques blockbusters de leur choix. A chaque fois, les films dynamitent la pensée et l'entraînent dans des directions inattendues : les gremlins sabotent les écrans et contaminent les images, Godzilla et King Kong se font machines à échanger les regards, Batman devient le théâtre d'une déconstruction du politique, Alien met en scène les métamorphoses d'un récit qui ne change jamais, et Titanic coule comme cette industrie lourde qu'est le cinéma lui-même... Frank Jackson often writes as if his descriptivist account of public language meanings were just plain common sense. How else are we to explain how different speakers manage to communicate using a public language? And how else can we explain how individuals arrive at confident judgments about the reference of their words in hypothetical scenarios? Our aim in this paper is to show just how controversial the psychological assumptions behind in Jackson’s semantic theory really are. First, we explain how Jackson’s (...) theory goes well beyond the commonsense platitudes he cites in its defence. Second, we sketch an alternative explanation of those platitudes, the jazz model of meaning, which we argue is more psychologically realistic. We conclude that the psychological picture presupposed by Jackson’s semantic theory stands in need of a much more substantial defence than he has so far offered. (shrink)

In his recent bookThe Idea of Justice, Amartya Sen suggests that political philosophy should move beyond the dominant, Rawls-inspired, methodological paradigm – what Sen calls ‘transcendental institutionalism’ – towards a more practically oriented approach to justice: ‘realization-focused comparison’. In this article, I argue that Sen's call for a paradigm shift in thinking about justice is unwarranted. I show that his criticisms of the Rawlsian approach are either based on misunderstandings, or correct but of little consequence, and conclude that the Rawlsian (...) approach already delivers much of what Sen himself wants from a theory of justice. A globalized world, some argue, needs a global democracy. But there is considerable disagreement about whether global democracy is an ideal worth pursuing. One of the main grounds for scepticism is captured by the slogan: “No global demos, no global democracy.” The fact that a key precondition of democracy—a demos—is absent at the global level, some argue, speaks against the pursuit of global democracy. The paper discusses four interpretations of the skeptical slogan—each based on a specific account of the notion (...) of “the demos”—and concludes that none of them establishes that the global democratic ideal must be abandoned. In so doing, the paper (i) systematizes different types of objections against global democracy, thus bringing some clarity to an otherwise intricate debate and (ii) offers a robust but qualified defense of the global democratic ideal. Doxastic involuntarism—the thesis that we lack direct voluntary control (in response to non-evidential reasons) over our belief states—is often touted as philosophical orthodoxy. I here offer a novel defense of doxastic voluntarism, centered around three key moves. First, I point out that belief has two central functional roles, but that discussions of voluntarism have largely ignored questions of control over belief's guidance function. Second, I propose that we can learn much about doxastic control by looking to cognitive scientific research on (...) control over other relevantly similar mental states. I draw on a mechanistic account of control of the guidance function for “emotion-type states,” and argue that these same cognitive control mechanisms can used to block doxastic guidance. This gives us an account of “back-end” doxastic control which can be deployed for reasons which are not the right kinds of reasons to support “front-end” belief formation—i.e., non-evidential reasons. Third, I argue that comprehensive, self-directed exercises of this kind of control can amount to an underappreciated kind of voluntarism. This form of voluntarism is available to any account of belief that takes guidance-instantiation to be at least partly constitutive of believing.
