In this article, I argue that Dworkin’s one-system view of law and morality is not as easy to refute or dismiss as some would suggest. In a recent article, Dindjer criticizes a new kind of opposition to legal positivism characterized by both its opposition to a two-system view of law and morality and its promotion of a one-system alternative picture. By re-examining Dworkin’s criticisms of the two-system view and by providing additional reasoning of my own, I show that Dworkin’s one-system (...) interpretative approach is not just sensible but also promising in refocusing contemporary debates in general jurisprudence on a moral and political reading of the structural features of law. There is no known syntactic characterization of the class of finite definitions in terms of a set of basic definitions and a set of basic operators under which the class is closed. Furthermore, it is known that the basic propositional operators do not preserve finiteness. In this paper I survey these problems and explore operators that do preserve finiteness. I also show that every definition that uses only unary predicate symbols and equality is bound to be finite.

Background: Screen time among adults represents a continuing and growing problem in relation to health behaviors and health outcomes. However, no instrument currently exists in the literature that quantifies the use of modern screen-based devices. The primary purpose of this study was to develop and assess the reliability of a new screen time questionnaire, an instrument designed to quantify use of multiple popular screen-based devices among the US population. -/- Methods: An 18-item screen-time questionnaire was created to quantify use of (...) commonly used screen devices (e.g. television, smartphone, tablet) across different time points during the week (e.g. weekday, weeknight, weekend). Test-retest reliability was assessed through intra-class correlation coefficients (ICCs) and standard error of measurement (SEM). The questionnaire was delivered online using Qualtrics and administered through Amazon Mechanical Turk (MTurk). -/- Results: Eighty MTurk workers completed full study participation and were included in the final analyses. All items in the screen time questionnaire showed fair to excellent relative reliability (ICCs = 0.50–0.90; all < 0.000), except for the item inquiring about the use of smartphone during an average weekend day (ICC = 0.16, p = 0.069). The SEM values were large for all screen types across the different periods under study. -/- Conclusions: Results from this study suggest this self-administered questionnaire may be used to successfully classify individuals into different categories of screen time use (e.g. high vs. low); however, it is likely that objective measures are needed to increase precision of screen time assessment. Background The purpose of this study was to examine whether extended use of a variety of screen-based devices, in addition to television, was associated with poor dietary habits and other health-related characteristics and behaviors among US adults. The recent phenomenon of binge-watching was also explored. -/- Methods A survey to assess screen time across multiple devices, dietary habits, sleep duration and quality, perceived stress, self-rated health, physical activity, and body mass index, was administered to a sample of US adults using (...) the Qualtrics platform and distributed via Amazon Mechanical Turk (MTurk). Participants were adults 18 years of age and older, English speakers, current US residents, and owners of a television and at least one other device with a screen. Three different screen time categories (heavy, moderate, and light) were created for total screen time, and separately for screen time by type of screen, based on distribution tertiles. Kruskal-Wallis tests were conducted to examine differences in dietary habits and health-related characteristics between screen time categories. -/- Results Aggregate screen time across all devices totaled 17.5 h per day for heavy users. Heavy users reported the least healthful dietary patterns and the poorest health-related characteristics – including self-rated health – compared to moderate and light users. Moreover, unique dietary habits emerged when examining dietary patterns by type of screen separately, such that heavy users of TV and smartphone displayed the least healthful dietary patterns compared to heavy users of TV-connected devices, laptop, and tablet. Binge-watching was also significantly associated with less healthy dietary patterns, including frequency of fast-food consumption as well as eating family meals in front of a television, and perceived stress. -/- Conclusions The present study found that poorer dietary choices, as well as other negative health-related impacts, occurred more often as the viewing time of a variety of different screen-based devices increased in a sample of US adults. Future research is needed to better understand what factors among different screen-based devices might affect health behaviors and in turn health-related outcomes. Research is also required to better understand how binge-watching behavior contributes impacts health-related behaviors and characteristics. (shrink)

One of the principal challenges to human survival will be for human beings, embedded in a plurality of cultural contexts, to engage with and learn from one another respectfully in the continuing task of creating a more liveable world. I argue here that theoretical psychology can contribute to setting some of the terms for this effort through the kind of conception it advances of the person as agent. I discuss broadly two philosophical perspectives toward human agency which have become prominent (...) in psychology in the last few decades, the humanistic and the hermeneutic. Information is a notion of wide use and great intuitive appeal, and hence, not surprisingly, different formal paradigms claim part of it, from Shannon channel theory to Kolmogorov complexity. Information is also a widely used term in logic, but a similar diversity repeats itself: there are several competing logical accounts of this notion, ranging from semantic to syntactic. In this chapter, we will discuss three major logical accounts of information.

Context: The need to reinvigorate medical confidentiality protections is recognised as an important objective in building patient trust necessary for successful health outcomes. Little is known about patient understanding and expectations from medical confidentiality.Objective: To identify and describe patient views of medical confidentiality and to assess provisionally the range of these views.Design: Qualitative study using indepth, open ended face-to-face interviews.Setting: Southeastern Pennsylvania and southern New Jersey, USA.Participants: A total of 85 women interviewed at two clinical sites and three community/research centres.Main (...) outcome measures: Subjects’ understanding of medical confidentiality, beliefs about the handling of confidential information and concerns influencing disclosure of information to doctors.Results: The subjects defined medical confidentiality as the expectation that something done or said would be kept “private” but differed on what information was confidential and the basis and methods for protecting information. Some considered all medical information as confidential and thought confidentiality protections functioned to limit its circulation to medical uses and reimbursement needs. Others defined only sensitive or potentially stigmatising information as confidential. Many of these also defined medical confidentiality as a strict limit prohibiting information release, although some noted that specific permission or urgent need could override this limit.Conclusions: Patients share a basic understanding of confidentiality as protection of information, but some might have expectations that are likely not met by current practice nor anticipated by doctors. Doctors should recognise that patients might have their own medical confidentiality models. They should address divergences from current practice and provide support to those who face emotional or practical obstacles to self-revelation. (shrink)

We consider the complex interactions between rape culture and epistemology. A central case study is the consideration of a deferential attitude about the epistemology of sexual assault testimony. According to the deferential attitude, individuals and institutions should decline to act on allegations of sexual assault unless and until they are proven in a formal setting, i.e., a criminal court. We attack this deference from several angles, including the pervasiveness of rape culture in the criminal justice system, the epistemology of testimony (...) and norms connecting knowledge and action, the harms of tacit idealizations away from important contextual factors, and a contextualist semantics for 'knows' ascriptions. We propose that the prevalent moral aversion to AWS is supported by a pair of compelling objections. First, we argue that even a sophisticated robot is not the kind of thing that is capable of replicating human moral judgment. This conclusion follows if human moral judgment is not codifiable, i.e., it cannot be captured by a list of rules. Moral judgment requires either the ability to engage in wide reflective equilibrium, the ability to perceive certain facts as moral considerations, moral (...) imagination, or the ability to have moral experiences with a particular phenomenological character. Robots cannot in principle possess these abilities, so robots cannot in principle replicate human moral judgment. If robots cannot in principle replicate human moral judgment then it is morally problematic to deploy AWS with that aim in mind. Second, we then argue that even if it is possible for a sufficiently sophisticated robot to make ‘moral decisions’ that are extensionally indistinguishable from (or better than) human moral decisions, these ‘decisions’ could not be made for the right reasons. This means that the ‘moral decisions’ made by AWS are bound to be morally deficient in at least one respect even if they are extensionally indistinguishable from human ones. Our objections to AWS support the prevalent aversion to the employment of AWS in war. They also enjoy several significant advantages over the most common objections to AWS in the literature. In July 2020, more than 1000 companies that advertise on social media platforms withdrew their business, citing failures of the platforms (especially Facebook) to address the proliferation of harmful content. The #StopHateForProfit movement invites reflection on an understudied topic: the ethics of boycotting by corporations. Under what conditions is corporate boycotting permissible, required, supererogatory, or forbidden? Although value-driven consumerism has generated significant recent discussion in applied ethics, that discussion has focused almost exclusively on the consumption choices of individuals. As this (...) article underscores, value-driven consumerism by business corporations complicates these issues and invites further examination. We propose principles for the ethics of boycotting by corporations, indicate how these principles relate to different CSR paradigms, and show how these insights can help assess recent instances of corporate boycotting. The partial aim of this paper is to suggest that Merleau-Ponty’s ontology is prefigured in Schelling’s conception of God as presented in Ages of the World. This will specifically be demonstrated by explicating the parallels between Merleau-Ponty’s paradoxical notion of the flesh and Schelling’s equally complex idea of Ungrund. Understanding the significance of Schelling’s influence on Merleau-Ponty becomes pivotal upon the recognition that the contemporary French political philosopher Claude Lefort’s idea of the political instituting politics is directly linked to Merleau-Ponty’s (...) ontology of the invisible and visible. The implication here involves the suggestion that Lefort’s conception of the political parallels Schelling’s conception of God as mediated by Merleau-Ponty. It is then suggested that the political form of modernity should be understood less as the emergence of a novel form and conceived of more as an originary dimension where the theological and the political become indistinguishable. This essay attempts to provide a historical account of Michael Oakeshott’s famous distinction between civil and enterprise association. As such, it demonstrates that Oakeshott’s political skepticism and his concomitant view of civil association can in part be explained by his reliance on Augustinian theology. In a similar vein, Oakeshott’s linkage of enterprise association with the rationalism of Bacon must be considered in terms of Oakeshott’s understanding of Pelagianism and Gnosticism. Unsurprisingly, it will be demonstrated that despite Oakeshott’s disagreements with the (...) political philosopher Eric Voegelin, he was very impressed by Voegelin’s work on the Gnostic origins of modernity. Consequently, a major claim of this essay is that Oakeshott’s speculative understanding of modern political thought constitutes a theological genealogy of political modernity in all but name. Elizabeth Barnes and Robert Williams have developed a theory of metaphysical indeterminacy, via which they defend the theoretical legitimacy of vague objects. In this paper, we argue that while the Barnes–Williams theory supplies a viable account of genuine metaphysical vagueness, it cannot underwrite an account of genuinely vague objects. First we clarify the distinction between these two key theses. Then we argue that the Barnes–Williams theory of metaphysical vagueness not only fails to deliver genuinely vague objects, it in fact provides (...) grounds for rejecting them. (shrink)

Reviews the book Time and psychological explanation by Brent D. Slife . In this book Prof. Slife has taken on the task of showing how the Western conception of time is a construct whose use in psychology is in need of just such a review. The object of Slife's critique is the modern Western tradition which takes time to be an objective and linear entity. This perspective, of course, derives from the work and thinking of Sir Isaac Newton, and it (...) is an orientation which has been fundamental to the development of Western science and culture since the period of the Enlightenment. Prof. Slife argues that the Newtonian time paradigm rests on five somewhat overlapping conceptual elements which are basic to traditional scientific explanation. These are the notions of "objectivity," "continuity," "linearity," "universality," and "reductionism." Some of these characteristics can be seen to be features of the way Newton envisioned time itself and some are aspects of events to be accounted for, because they exist in absolute time. In sum Prof. Slife has made a philosophically literate case for the need to analyze the limiting effects of Newtonian notions of time on psychology's theory and practice. 2012 APA, all rights reserved). Ichikawa and Jarvis offer a new rationalist theory of mental content and defend a traditional epistemology of philosophy. They argue that philosophical inquiry is continuous with non-philosophical inquiry, and can be genuinely a priori, and that intuitions do not play an important role in mental content or the a priori.

ABSTRACTThe jus ad bellum criterion of right intention is a central guiding principle of just war theory. It asserts that a country’s resort to war is just only if that country resorts to war for the right reasons. However, there is significant confusion, and little consensus, about how to specify the CRI. We seek to clear up this confusion by evaluating several distinct ways of understanding the criterion. On one understanding, a state’s resort to war is just only if it (...) plans to adhere to the principles of just war while achieving its just cause. We argue that the first understanding makes the CRI superfluous, because it can be subsumed under the probability of success criterion. On a second understanding, a resort to war is just only if a state’s motives, which explain its resort to war, are of the right kind. I argue that evaluating the knowledge norm of practical reasoning is less straightforward than is often assumed in the literature. In particular, cases in which knowledge is intuitively present, but action is intuitively epistemically unwarranted, provide no traction against the knowledge norm. The knowledge norm indicates what it is appropriately to hold a particular content as a reason for action; it does not provide a theory of what reasons are sufficient for what actions. Absent a general theory about what sorts (...) of reasons, if genuinely held, would be sufficient to justify actions—a question about which the knowledge norm is silent—many of the kinds of cases prevalent in the literature do not bear on the knowledge norm. Friends of Wright-entitlement cannot appeal to direct epistemic consequentialism (believe or accept what maximizes expected epistemic value) in order to account for the epistemic rationality of accepting Wright-entitled propositions. The tenability of direct consequentialism is undermined by the “Truth Fairy”: a powerful being who offers you great epistemic reward (in terms of true beliefs) if you accept a proposition p for which you have evidence neither for nor against. However, this chapter argues that a form of indirect epistemic consequentialism seems (...) promising as a way to deal with the Truth Fairy problem. The relevant form of indirect consequentialism accommodates evidentialism but allows for exceptions in the case of anti-sceptical hypotheses. Since these are the kind of propositions to which Wright-entitlement is supposed to apply—i.e. cornerstone propositions—indirect consequentialism is entitlement-friendly. (shrink)

The book develops and synthesises two main ideas: contextualism about knowledge ascriptions and a knowledge-first approach to epistemology. The theme of the book is that these two ideas fit together much better than it's widely thought they do. Not only are they not competitors: they each have something important to offer the other.

This paper will articulate and defend a novel theory of epistemic justification; I characterize my view as the thesis that justification is potential knowledge . My project is an instance of the ‘knowledge-first’ programme, championed especially by Timothy Williamson. So I begin with a brief recapitulation of that programme.

Across languages, lexical items specific to infant‐directed speech (i.e., ‘baby‐talk words’) are characterized by a preponderance of onomatopoeia (or highly iconic words), diminutives, and reduplication. These lexical characteristics may help infants discover the referential nature of words, identify word referents, and segment fluent speech into words. If so, the amount of lexical input containing these properties should predict infants’ rate of vocabulary growth. To test this prediction, we tracked the vocabulary size in 47 English‐learning infants from 9 to 21 months (...) and examined whether the patterns of growth can be related to measures of iconicity, diminutives, and reduplication in the lexical input at 9 months. Our analyses showed that both diminutives and reduplication in the input were associated with vocabulary growth, although measures of iconicity were not. These results are consistent with the hypothesis that phonological properties typical of lexical input in infant‐directed speech play a role in early vocabulary growth. (shrink)
