Wittgenstein započinje svoja Predavanja o religioznom vjerovanju tvrdeći kako ne bi proturječio religioznoj osobi koja vjeruje u Strašni sud, iako on osobno ne dijeli takva uvjerenja. Kasnije izjavljuje kako nije siguran mogu li religiozni vjernici i pojedinci koji ne vjeruju istinski razumjeti jedni druge. Neki filozofi tumače ove primjedbe kao dokaz da je Wittgenstein smatrao kako su religijski i nereligijski diskursi nesumjerljivi, u tom smislu da nereligiozna osoba ne može razumjeti religioznu kada ova govori o svojim vjerovanjima, kao i da (...) su religiozna vjerovanja imuna na kritiku izvana kao posljedica te navodne nesumjerljivosti. Hilary Putnam je tvrdio da je Wittgenstein vjerovao kako dijalog između religioznih i nereligioznih osoba podrazumijeva određeno nesporazumijevanje, koje međutim nije posljedica nesumjerljivosti. Predlažem drugačije sagledavanje „nesuprotstavljenosti“ i Wittgensteinovog shvaćanja religioznog vjerovanja, pri čemu se slažem s Putnamom da se teza o nesumjerljivosti ne može pripisati Wittgensteinu. Perdurantista ne može da razlikuje dve mogućnosti pozivajući se na različite trenutne brzine trenutnih temporalnih delova diska, zbog toga što bi time prekršio tezu hjumovske supervenijencije. U knjizi Pisanje knjige sveta (2011) Teodor Sajder tvrdi da na fundamentalnom nivou stvarnosti ne postoje objekti sastavljeni od delova, što njegovo gledište čini verzijom mereološkog nihilizma. Međutim, u prethodnoj knjizi pod naslovom Četvorodimenzionalizam (2001) Sajder zastupa mereološki univerzalizam, tezu da svaka klasa objekata ima mereološku fuziju, odnosno da postoji dodatni objekat koji sadrži date objekta kao svoje delove, koji igra suštinsku ulogu u njegovoj argumentu na osnovu nejasnosti u prilog perdurantizma, odnosno postojanja temporalnih delova materijalnih objekata. In Tulving’s initial characterization, episodic memory was one of multiple memory systems. It was postulated, in pursuit of explanatory depth, as displaying proprietary operations, representations, and substrates such as to explain a range of cognitive, behavioural, and experiential phenomena. Yet the subsequent development of this research program has, paradoxically, introduced surprising doubts about the nature, and indeed existence, of episodic memory. On dominant versions of the ‘common system’ view, on which a single simulation system underlies both remembering and imagining, there (...) are no processes unique to memory to support robust generalizations with inductive potential. Eliminativism about episodic memory seems to follow from the claim that it has no dedicated neurocognitive system of its own. After identifying this under-noticed threat, we push back against modern eliminativists by surveying recent evidence that still indicates specialized mechanisms, computations, and representations that are distinctly mnemic in character. We argue that contemporary realists about episodic memory can retain lessons of the common system approach while resisting the further move to eliminativism. (shrink)

There are various conceptions of objectivity, a characteristic of the scientific enterprise, the most fundamental being objectivity as faithfulness to facts. A brute fact, which happens independently from us, becomes a scientific fact once we take cognisance of it through the means made available to us by science. Because of the complex, reciprocal relationship between scientific facts and scientific theory, the concept of objectivity as faithfulness to facts does not hold in the strict sense of an aperspectival faithfulness to brute (...) facts. Nevertheless, it holds in the large sense of an underdetermined faithfulness to scientific facts, as long as we keep in mind the complexity of the notion of scientific fact (as theory-laden), and the role of non-factual elements in theory choice (as underdetermined by facts). Science remains our best way to separate our factual beliefs from our other kinds of beliefs. (shrink)

Taking the ‘Fridays for Future’ movement as its starting point, this article conceptualizes and defends youth disobedience, understood as principled disobedience by legal minors. The article first argues that the school strike for climate can be viewed as civil disobedience. Then, the article distinguishes between various forms of youth disobedience. Building on the democratic rationale for civil disobedience, the remainder of the article argues that there is a special justification for youth disobedience. To show this, it argues that children are (...) wrongfully excluded from political participation and that principled law-breaking can be an important remedy to this exclusion. The upshot is that adults should engage seriously and leniently with youth disobedience. (shrink)

In this paper, I argue that causal theories of memory are typically committed to two independent, non-mutually entailing theses. The first thesis pertains to the necessity of appropriate causation in memory, specifying a condition token memories need to satisfy. The second pertains to the explanation of memory reliability in causal terms and it concerns memory as a type of mental state. Post-causal theories of memory can reject only the first (weak post-causalism) or both (strong post-causalism) theses. Upon this backdrop, I (...) examine Werning’s (2020) causalist argument from probabilistic correlation. I argue that it doesn’t establish the necessity of appropriate causation and thus it can only target strong post-causalist theories. I end up by presenting some general considerations, suggesting that memories may not always be causally linked to past experiences. (shrink)

This article explores contemporary biopolitics in the light of Michel Foucault's oft quoted suggestion that contemporary politics calls `life itself' into question. It suggests that recent developments in the life sciences, biomedicine and biotechnology can usefully be analysed along three dimensions. The first concerns logics of control - for contemporary biopolitics is risk politics. The second concerns the regime of truth in the life sciences - for contemporary biopolitics is molecular politics. The third concerns technologies of the self - for (...) contemporary biopolitics is ethopolitics. The article suggests that, in these events, human beings have become `somatic individuals': personhood is increasingly being defined in terms of corporeality, and new and direct relations are established between our biology and our conduct. At the same time, this somatic and corporeal individuality has become opened up to choice, prudence and responsibility, to experimentation, to contestation and so to a politics of `life itself'. The Galilean explanatory style is characterized by the search for the underlying structure of phenomena, the positing of "deep" explanatory principles, and a view of the relation between theory and data, on which the search for "crucial data" is of primary importance. In this paper, I trace the dynamics of adopting the Galilean style, focusing on the science of episodic memory. I argue that memory systems, such as episodic and semantic memory, were posited as underlying competences producing the observable phenomena (...) of memory. Considered in idealized isolation from other systems, episodic memory was taken to underlay the ability of individuals to remember events from their personal past. Yet, in reality, memory systems regularly interact, standing in many-to-many relations to actual memory tasks and experiences. Upon this backdrop, I explore a puzzle about the increasing prominence of the notion of autonoetic consciousness in Tulving's theory of episodic memory. I argue that, contrary to widespread belief, the prominence is not best explained by the purported essential link between autonoetic consciousness and episodic memory. Rather, it is explained by the fact that autonoetic consciousness, hypothesized to uniquely accompany episodic retrieval, was considered a source of crucial data, predictable only from theories positing a functionally distinct episodic memory system. However, with the emergence of a new generation of theories, positing wider memory systems for remembering and imagination, the question of the relation between episodic memory and autonoetic consciousness has been reopened. This creates a pressing need for de-idealization, triggering a new search for crucial data. (shrink)

In the philosophy of memory, singularism is the view that episodic memories are singular mental states about unique personally experienced past events. In this paper, I present an empirical challenge to singularism. I examine three distinct lines of evidence from the psychology of memory, concerning general event memories, the transformation of memory traces and the minimized role temporal information plays in major psychological theories of episodic memory. I argue that singularist views will have a hard time accommodating this evidence, facing (...) a problem of transitional gradation. I then look at some potential consequences for the larger debate, highlighting the way in which singularism has featured in three important recent arguments in the philosophy of memory. (shrink)

Global sourcing largely occurs from so-called emerging markets and developing economies. In these contexts, substantial leverage effects for sustainability in supply chains can be expected by reducing adverse impacts on society and minimising related risks. For this ethical end, an adequate understanding of the respective sourcing contexts is fundamental. This case study of South Africa’s mining sector uses institutional theory and the notion of institutional uncertainty to empirically analyse the challenges associated with establishing social sustainability. The case study research is (...) informed by 39 semi-structured interviews with top management representatives and various state and non-state decision makers in SA. Our findings suggest that sustainability in the institutional field is mainly shaped by the Social and Labour Plan institution, induced by state actors and mining companies’ practices. However, four weakening factors were identified that adversely affect this regulative institution, drive institutional uncertainty and allow for mining companies’ gradual decoupling. Contrastingly, complementing pressures of non-state actors limit institutional uncertainty and push toward mainstreaming the stipulations of the institution. This study contributes to the business ethics literature by providing an in-depth exploration of institutional uncertainty’s drivers and barriers within an upstream SC setting and shedding light on multiple actors’ interplay and relevance in sector-wide sustainability. The findings are condensed into three main propositions as well as an analytical framework as a basis for follow-up research. This case study helps practitioners understand and manage complexity that results from actor plurality and institutional uncertainty in EMDEs. (shrink)

In this chapter, we examine the naturalist approach in the philosophy of memory through the lens of the simulation theory of memory. On the theory, episodic memory is a kind of constructive simulation performed by a functionally specialized neurocognitive system. Taking naturalism to be a kind of methodological stance characterized by a cluster of epistemic guidelines, we illustrate the roles these guidelines have played in the development of the theory. We show how scientific evidence has guided both the selection of (...) the research question and the initial elaboration of the theory. We demonstrate how such evidence has led the simulationist to reject a familiar, commonsense picture of memory. We also trace the recent radicalization of the theory, highlighting the simulationist's continual reflection on their concepts and assumptions. In the spirit of such reflection, we end by outlining some outstanding challenges for the theory. (shrink)

The Hard Question of memory is the following: how are memory representations stored and organized so as to be made available for retrieval in the appropriate circumstances and format? In this essay, I argue that philosophical theories of memory should engage with the Hard Question directly and seriously. I propose that declarative memory is a faculty performing a kind of cognitive triage: management of information for a variety of uses under significant computational constraints. In such triage, memory representations are preferentially (...) selected and stabilized, but also systematically modified and integrated into generalized, model-like representational structures. Further, I propose a hybrid theory of remembering, which takes into account both the nature of the cognitive processes underlying remembering and the norms that govern representational success in relevant cognitive/epistemic contexts. This article discusses Sven Ove Hansson’s corpus model for the influence of values (in particular, non-epistemic ones) in the hypothesis acceptance/rejection phase of scientific inquiry. This corpus model is based on Hansson’s concepts of scientific corpus and science ‘in the large sense’. I first present Hansson’s corpus model of value influence with some introductory comments about its origins, a detailed presentation of the model with a new terminology, an analysis of its limits, and an appreciation of its handling of controversial (...) non-epistemic values. I conclude that it is a very good candidate for managing value influence, because contrary to other models in the literature it is fairly simple, it provides a universal and systematic procedure for dealing with values, and it syste- matically preserves the epistemic integrity of science. I then study some difficulties associated with the model’s central feature of taking the maximum level of evidence required by the applications of a claim in order for the latter to enter the scientific corpus: the difficulty to identify this maximum requirement; the non-optimality of this requirement with respect to other less demanding requirements; the potentially detrimental consequences of the preference for false negatives over false positives on which it relies; and the issue of whether there can nevertheless be requirements higher than this maximum. I show that these issues may potentially challenge the corpus model. Finally, I call for empirical work (in particular, an investigation of scientists’ and engineers’ own normative views) in order to better assess these issues. (shrink)

We live, according to some, in the century of biology, where we now understand ourselves in radically new ways as the insights of genomics and neuroscience have opened up the workings of our bodies and our minds to new kinds of knowledge and intervention. Is a new figure of the human, and of the social, taking shape in the 21st century? With what consequences for the politics of life today? And with what implications, if any, for the social, cultural and (...) human sciences? These are the issues that are discussed in this article, which argues that a new relation is requred with the life sciences, beyond commentary and critique, if the social and human sciences are to revitalize themselves for the 21st century. My aim in the paper will be to better understand what faultless disagreement could possibly consist in and what speakers disagree over when they faultlessly do so. To that end, I will first look at various examples of faultless disagreement. Since I will eventually claim that different forms of faultless disagreement can be modeled semantically on different forms of context-sensitivity I will, in a second step, discuss three different semantic accounts that all promise to successfully accommodate certain forms of context-sensitivity: (...) Indexical Contextualism, Nonindexcal Contextualism and Radical Relativism . Focussing on the controversy between Indexical and Nonindexical Contextualists the remainder of the paper will be devoted to the question which theory is best suited to handle what kind of disagreement. People can have or lack ‘integrity’. But can public institutions? It is common to speak of the ‘integrity’ of such institutions: in popular discourse, legal decisions, law and regulations, and also increasingly, political theory, and proximate disciplines. Such integrity is often said to be at risk of being ‘subverted,’ ‘corroded,’ and ‘corrupted,’ by both forces within and without. Furthermore, the implication is that this is a very worrying thing. The integrity of our institutions, at least, needs to be preserved, supported, (...) and defended; against money, politics, power, and populists. However, despite such common usage, the concept itself has attracted little theoretical reflection. What can it mean, if anything sensible, for an institution itself – instead of a person (or even say, a body, process, territory or a bridge) – to have ‘integrity’? And, why might it be so important? This is the subject of this paper. It puts forward a substantive moral conception of institutional integrity as the robust disposition of an institution to pursue its purpose efficiently, within the constraints of legitimacy, consistent with its commitments. It argues that it is important because it provides the strongest grounding for a ‘duty of support’ owed by citizens to the institution. The strength of such support owed also gives content to a scalar dimension of the institution’s normative legitimacy, that is, the ‘strength’ (or weakness) of such legitimacy. Further, it illustrates how such a conception of institutional integrity will helpfully advance the current debate regarding institutional corruption. (shrink)

Since the global financial crisis in 2008, corporations have faced a crisis of trust, with growing sentiment against ‘elites and ‘big business’ and a feeling that ‘something ought to be done’ to re-establish public regard for corporations. Trust and trustworthiness are deeply moral significant. They provide the ‘glue or lubricant’ that begets reciprocity, decreases risk, secures dignity and respect, and safeguards against the subordination of the powerless to the powerful. However, in deciding how to restore trust, it is difficult to (...) determine precisely what should be done, by whom, and who will bear the cost, especially if any action involves a risk to overall market efficiency and corporate profitability. The paper explores whether corporations have a moral duty to be trustworthy, to bear the cost of being so and thus contribute to resolving the current crisis of trust. It also considers where the state and other social actors have strong reason to protect and enforce such moral rights, while acknowledging that other actors have similar obligations to be trustworthy. It outlines five ‘salient factors’ that trigger specific rights to trustworthiness and a concomitant duty on corporations to be trustworthy: market power, subordination (threat and intimidation), the absence of choice, the need to preserve systemic trust, and corporate political power which might undermine a state’s legitimacy. Absent these factors and corporations do not have a general duty to be trustworthy, since a responsible actor in fair market conditions should be able to choose between the costs and benefits of dealing with generally trustworthy corporations. This paper offers a modeling account of episodic representation. I argue that the episodic system constructsmental models: representations that preserve the spatiotemporal structure of represented domains. In prototypical cases, these domains are events: occurrences taken by subjects to have characteristic structures, dynamics and relatively determinate beginnings and ends. Due to their simplicity and manipulability, mental event models can be used in a variety of cognitive contexts: in remembering the personal past, but also in future-oriented and counterfactual imagination. This paper attempts to philosophically articulate empirical evidence on the positive effects of illness within the wider context of a discussion of the positive aspects of vulnerability. The conventional understanding holds that to be vulnerable is to be open to harms and wrongs; it is to be fragile, defenseless, and of compromised autonomy. In this paper, we challenge the assumption that vulnerability consists of nothing but powerlessness and dependence on others. This paper attempts to: (1) outline the theoretical conceptualisation of (...) the positive aspects of coping with illness, while simultaneously showing how these findings provide empirical support for some classical philosophical ideas; (2) influence a change in the manners in which the ill are usually perceived (as weak, dependent, robbed of a good life) and (3) point to the importance of modernising the prevalent biomedical conception of illness with the subjective dimension of health. Biomedical understanding of illness focuses on the vulnerable experience of the sufferer, suggesting the importance of philosophical additions. (shrink)

This essay investigates the notion of simulation and the role it plays in Kourken Michaelian's simulation theory of memory. I argue that the notion is importantly ambiguous and that this ambiguity may threaten some of the central commitments of the theory. To illustrate that, I examine two different conceptions of simulation: a narrow one (simulation as replication) and a broad one (simulation as computational modeling), arguing that the preferred narrow conception is incompatible with the claim that remembering involves the simulation (...) of past episodes. Investigating possible solutions, I suggest that, despite some relatively serious consequences, the theory may be better off subscribing to the broad notion of simulation. (shrink)

Like artists, important writers defy unequivocal interpretations. Gao Xingjian, winner of the Nobel Prize in literature, is a cosmopolitan writer, deeply rooted in the Chinese past while influenced by paragons of Western Modernity. The present volume is less interested in a general discussion on the multitude of aspects in Gao's works and even less in controversies concerning their aesthetic value than in obtaining a response to the crucial issues of freedom and fate from a clearly defined angle. The very nature (...) of the answer to the question of freedom and fate within Gao Xingjian's works can be called a polyphonic one: thereare affirmative as well as skeptical voices. But polyphony, as embodied by Gao, is an even more multifaceted phenomenon. Most important for our contention is the fact that Gao Xingjian's aesthetic experience embodies prose, theater, painting, and film. Taken together, they form a Gesamtkunstwerk whose diversity of voices characterizes every single one of them. (shrink)

Metafora, kao jedan od najvaznijih izvora motivacije u jeziku kako je vidi kognitivna lingvistika je jedna od osnovnih formi ljudske konceptualizacije. Prvi deo rada predstavlja pregled najvaznije teorije o imenu. Drugi deo rada opisuje osnovne principe kognitivne lingvistike i odnosa (...) prema metafori. The human body was made legible long ago. But what of the human mind? Is it possible to ‘read’ the mind, for one human being to know what another is thinking or feeling, their beliefs and intentions. And if I can read your mind, how about others – could our authorities, in the criminal justice system or the security services? Some developments in contemporary neuroscience suggest the answer to this question is ‘yes’. While philosophers continue to debate the mind-brain problem, (...) a range of novel technologies of brain imaging have been used to argue that specific mental states, and even specific thoughts, can be identified by characteristic patterns of brain activation; this has led some to propose their use in practices ranging from lie detection and security screening to the assessment of brain activity in persons in persistent vegetative states. This article reviews the history of these developments, sketches their scientific and technical bases, considers some of the epistemological and ontological mutations involved, explores the ecological niches where they have found a hospitable environment, and considers some implications of this materialization of the readable, knowable, transparent mind. In February 2021, the French Minister of Higher Education and Research, Frédérique Vidal, ordered an inquiry – to be led by the French National Centre for Scientific Research – about the alleged “Islamo-leftism” which, according to her, was corrupting French academia. Vidal's concern was, purportedly, to distinguish “what falls under academic research and what falls under militancy and opinion”. She had in mind, in particular, recent interdisciplinary fields in the social sciences, such as Postcolonial Studies. Her statements caused a controversy (...) in French academia as well as outside. The goal of this paper is to present this controversy and analyse it in light of the philosophical literature on autonomy of, and values in, science. After recalling the political and institutional context of the controversy, I present Vidal’s intervention and various reactions to it, which can roughly be classified pro and contra Vidal's statements. I then provide a philosophical discussion of the controversy, by recalling the philosophical debate to which it is related, and analysing the assumptions, arguments and actions of both camps. I show in particular that a political intervention inside the very production of academic knowledge implies a strong risk of censorship, and that letting academia self-regulate itself with respect to the validation of knowledge remains the best way to go. I conclude with the deeper questions raised by this controversy: the social role of universities, and the institutional aspects of scientific knowledge validation. (shrink)

Straightening the current ‘value-laden turn’ (VLT) in the philosophical literature on values in science, and reviving the legacy of the value-free ideal of science (VFI), this paper argues that the influence of extra-scientific values should be minimised—not excluded—in the core phase of scientific inquiry where claims are accepted or rejected. Noting that the original arguments for the VFI (ensuring the truth of scientific knowledge, respecting the autonomy of science results users, preserving public trust in science) have not been satisfactorily addressed (...) by proponents of the VLT, it proposes four prerequisites which any model for values in the acceptance/rejection phase of scientific inquiry should respect, coming from the fundamental requirement to distinguish between facts and values: (1) the truth of scientific knowledge must be ensured; (2) the uncertainties associated with scientific claims must be stated clearly; (3) claims accepted into the scientific corpus must be distinguished from claims taken as a basis for action. An additional prerequisite of (4) simplicity and systematicity is desirable, if the model is to be applicable. Methodological documents from international institutions and regulation agencies are used to illustrate the prerequisites. A model combining Betz’s conception (stating uncertainties associated with scientific claims) and Hansson’s corpus model (ensuring the truth of the scientific corpus and distinguishing it from other claims taken as a basis for action) is proposed. Additional prerequisites are finally suggested for future research, stemming from the requirement for philosophy of science to self-reflect on its own values: (5) any model for values in science must be descriptively and normatively relevant; and (6) its consequences must be thoroughly assessed. It has become somewhat a commonplace in recent political philosophy to remark that all plausible political theories must share at least one fundamental premise, ‘that all humans are one another's equals’. One single concept of ‘basic equality’, therefore, is cast as the common touchstone of all contemporary political thought. This paper argues that this claim is false. Virtually all do indeed say that all humans are ‘equals’ in some basic sense. However, this is not the same sense. There are not (...) one but two concepts of basic equality, and they reflect not a grand unity within political philosophy but a deep and striking division. I call these concepts ‘Equal Worth’ and ‘Equal Authority’. The former means that each individual’s good is of equal moral worth. The latter means that no individual is under the natural authority of anyone else. Whilst these two predicates are not in themselves logically inconsistent, I demonstrate that they are inconsistent foundation stones for political theory. A theory that starts from Equal Worth will find it near impossible to justify Equal Authority. And a theory that starts from Equal Authority will find any fact about the true worth of things, including ourselves, irrelevant to justifying legitimate action. This helps us identify the origin of many of our deepest and seemingly intractable disagreements within political philosophy, and directs our attention to the need for a clear debate about the truth and/or relationship between the two concepts. In short, my call to arms can be summed up in the demand that political philosophers never again be allowed to claim ‘that all human beings are equals’ full stop. They must be clear in what dimension they claim that we are equals—Worth or Authority. (shrink)

Social theory has much to gain from taking up the challenges of conceptualizing ‘mental health’. Such an approach to the stunting of human mental life in conditions of adversity requires us to open up the black box of ‘environment’, and to develop a vitalist biosocial science, informed by and in conversation with the life sciences and the neurosciences. In this paper we draw on both classical and contemporary social theory to begin this task. We explore human inhabitation – how humans (...) inhabit their ‘ecological niches’ – and examine a number of conceptual developments that ‘deconstruct’ the binary distinction between organism and environment. We argue that we must understand the neurological, ecological and social pathways and mechanisms that shape human (mental) life if we are to address the central concerns of our discipline with inequity and injustice as these are inscribed into the bodies and souls of human beings. Since the global financial crisis in 2007, social banks have been flooded with deposits. Previous studies have indicated that customers hold deposits with social banks due to social banks' special placement of assets. However, to date it has been far from clear how social banks select their investments, and consequently to what extent the placement of assets meets depositors' preferences. The purpose of this paper is, therefore, to investigate whether the characteristics of social banks’ placement of assets are relevant to (...) depositors’ choice of social banks. A two‐stage study is conducted, using data collected via a document analysis of social banks' investment criteria, a survey of social banks, and an online survey of 609 depositors. The results imply that the characteristics of social banks' placement of assets are indeed relevant to depositors' choice of social banks, but do not explain customer behaviour entirely. Furthermore, the findings indicate that a relevant proportion of customers hold deposits with social banks to avoid “evil” rather than necessarily creating “good.” Based on the findings, a theoretical framework of depositors' choice of social banks is presented that goes far beyond previous explanations by considering various types of social depositors, banks, and borrowers. Business Ethics: A European Review, EarlyView.

This paper tries to reconstruct Ernst Cassirer's potential reception of the EPR argument, as exposed by Einstein in his letter to Cassirer of March 1937. It is shown that, in conformity with his transcendental epistemology taking the conditions of accessibility as constitutive of the quantum object, Cassirer would probably have rejected the argument. Indeed, Cassirer would probably not have subscribed to its separability/local causality presupposition (which goes against his interpretation of the quantum formalism as a self-suf!cient condition constitutive of the (...) quantum object, without any reliance on spatial intuition), nor to its completeness requirement (as his partial endorsement of Bohr's complementarity, and his rejection of the Kantian "idea of complete determination", illustrate). By rejecting both of its premises, Cassirer's philosophy of physics thus enables to escape the EPR dilemma, and exhibits what, in Kantian terms, might be called a "negative utility" with respect to physical science. A further investigation of the anti-reductionist utility of Cassirer's systematic philosophy with respect to physics and other "symbolic forms" is !nally suggested. (shrink)

This article argues that a new diagram is emerging in the criminal justice system as it encounters developments in the neurosciences. This does not take the form that concerns many ‘neuroethicists’ — it does not entail a challenge to doctrines of free will and the notion of the autonomous legal subject — but is developing around the themes of susceptibility, risk, pre-emption and precaution. I term this diagram ‘screen and intervene’ and in this article I attempt to trace out this (...) new configuration and consider some of the consequences. (shrink)
