The COVID‐19 pandemic has raised important universal public health challenges. Conceiving ethical responses to these challenges is a public health imperative but must take context into account. This is particularly important in sub‐Saharan Africa (SSA). In this paper, we examine how some of the ethical recommendations offered so far in high‐income countries might appear from a SSA perspective. We also reflect on some of the key ethical challenges raised by the COVID‐19 pandemic in low‐income countries suffering from chronic shortages in (...) health care resources, and chronic high morbidity and mortality from non‐COVID‐19 causes. A parallel is drawn between the distribution of severity of COVID‐19 disease and the classic “Fortune at the bottom of the pyramid” model that is relevant in SSA. Focusing allocation of resources during COVID‐19 on the ‘thick’ part of the pyramid in Low‐to‐Middle Income Countries (LMICs) could be ethically justified on utilitarian and social justice grounds, since it prioritizes a large number of persons who have been economically and socially marginalized. During the pandemic, importing allocation frameworks focused on the apex of the pyramid from the global north may therefore not always be appropriate. In a post‐COVID‐19 world, we need to think strategically about how health care systems can be financed and structured to ensure broad access to adequate health care for all who need it. The root problems underlying health inequity, exposed by COVID‐19, must be addressed, not just to prepare for the next pandemic, but to care for people in resource poor settings in non‐pandemic times. This article is aimed at introducing a French discourse analysis model, e.g. the ‘star model’, initiated by the LAA team led by Robert Vion in Aix-en-Provence, to English-speaking researchers. It will be argued that language activity is multi-dimensional and can be traced at various heterogeneous levels of speech productions belonging to macro as well as micro orders. Speakers achieve different varieties of positioning which result in negotiating an interactional space within a pre-given situation. The model is precisely designed to (...) offer a unified and comprehensive view of such heterogeneous phenomena in constant interconnection. In this study, we also intend to illustrate our approach through the analysis of two different corpora. Speakers’ strategies under extreme conditions will be analysed; the various sequences used were taken from a special corpus which we were asked to study as part of a national research programme. In order to illustrate interactional space shifts, we will also use the transcript of a meeting which took place between a patient and a medical investigator in a hospital in Marseilles. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

Biological evolution provides a creative fount of complex and subtle adaptations, often surprising the scientists who discover them. However, because evolution is an algorithmic process that transcends the substrate in which it occurs, evolution’s creativity is not limited to nature. Indeed, many researchers in the field of digital evolution have observed their evolving algorithms and organisms subverting their intentions, exposing unrecognized bugs in their code, producing unexpected adaptations, or exhibiting outcomes uncannily convergent with ones in nature. Such stories routinely reveal (...) creativity by evolution in these digital worlds, but they rarely fit into the standard scientific narrative. Instead they are often treated as mere obstacles to be overcome, rather than results that warrant study in their own right. The stories themselves are traded among researchers through oral tradition, but that mode of information transmission is inefficient and prone to error and outright loss. Moreover, the fact that these stories tend to be shared only among practitioners means that many natural scientists do not realize how interesting and lifelike digital organisms are and how natural their evolution can be. To our knowledge, no collection of such anecdotes has been published before. This paper is the crowd-sourced product of researchers in the fields of artificial life and evolutionary computation who have provided first-hand accounts of such cases. It thus serves as a written, fact-checked collection of scientifically important and even entertaining stories. In doing so we also present here substantial evidence that the existence and importance of evolutionary surprises extends beyond the natural world, and may indeed be a universal property of all complex evolving systems. L’article entend confronter la théorie moderne de l’art au phénomène d’esthétisation de la sphère marchande mis en évidence par la sociologie, en prenant pour cadre de référence l’esthétique de la réception de Hans Robert Jauss. Bien que s’appliquant surtout à la littérature, la théorie de Jauss n’est pas sans concerner aussi les arts plastiques. La synthèse qu’elle opère entre, d’un côté, le formalisme russe du début du xx e siècle, qui, le premier, s’employa à isoler les propriétés internes des (...) œuvres d’art, et, de l’autre, l’historicisme d’inspiration marxiste qui s’attacha pour sa part à rendre compte de leurs évolutions en fonction de l’histoire générale de la société, semble particulièrement propice à l’abord d’un problème qui est à la fois symbolique, esthétique et historique. En effet, dès lors que de nombreux produits et services de consommation tendent à adopter certaines caractéristiques de l’œuvre d’art, l’analyse formelle, qui constitue l’arc-boutant de l’approche esthétique moderne, entre dans un périmètre d’application beaucoup plus large que celui dont participe l’histoire de l’art. Dans ce cas, l’importance accordée à la forme des objets, prise en ce sens esthétique, devient en elle-même une composante de l’histoire sociale, dans la mesure où elle ne concerne plus seulement les évolutions de la production artistique, mais intéresse aussi, en leurs principes, celles plus générale de la production marchande. Moyennant un approfondissement de leur versant social – ceci en se demandant, non pas comment l’expérience artistique transforme le monde vécu, mais comment le monde vécu transforme lui-même le monde artistique – les analyses de Jauss nous permettent ainsi de reformuler, en des termes propres à la théorie de l’art, la question de la convergence catégorielle mise en évidence par la sociologie, et, de là, d’engager une réflexion nouvelle sur les transformations de la sphère artistique à l’heure du capitalisme esthétique. Environmentalism has been a part of the ideological landscape of liberal societies for nearly three decades. Classical liberals have not yet succeeded, however, in articulating a coherent response that would be relevant to politically active environmentalists, as well as to liberals receptive to postmodern ideas. Robert C. Paehlke argues that, conservative liberals being in fact hostile to environmental thinking, moderate progressivism and environmentalism should enter into a close alliance. This paper challenges both assertions. Admittedly, not all currents within contemporary (...) conservative liberalism could play a part in the development of a neoliberal environmentalist movement. One current, however, the skeptical tradition, whose origin can be traced back to the Scottish Englightenment, is remarkably well suited to this task. Progressivism, on the other hand, could end up smothering the environmental movement under the weight of its own certainties. (shrink)

Fiduciary duty is not restricted merely to the property of shareholders but includes ethical obligations to a wider constituency stakeholders in terms of power. Several approaches to corporate social responsibility (CSR) are considered in terms of their respective orientations to the external world. Robert Greenleaf's notion of "service to others" or "servant-leadership" is considered as a case of the fifth level approach to CSR. An historical perspective offers a precedent for reclaiming corporate charter grants as a means for reinstating (...) the corporation's responsibilities to the wider community. On November 14th, 1770, the young chemist Antoine-Laurent Lavoisier (1743–1794) read his ‘Sur la nature de l’eau’ to the Académie des Sciences. Eventually published in the Académie’s journal in 1773, the two-part memoire challenged a widely held view of earlier experimenters: the transmutability of matter. Specifically, experimenters such as Jean-Baptiste Van Helmont (1580–1644), Robert Boyle (1627–1691), and Ole Borsch (1626–1690) had noted that when distilled water was heated in a glass vessel, a small amount of earthy residue remained, (...) seemingly demonstrating the transmutation of water into earth. Antoine-Laurent designed an experiment to determine whether it was really to the ‘destruction of a portion of the water that this residual earth owed its origin, or if it was to that of the glass.’ In partial agreement with Jean-Baptiste Le Roy (1720–1800), a fellow academician, Antoine-Laurent aimed to disprove the antiquated belief – the transmutation of one element into another – by using a glass vessel from the alchemist’s cabinet: the pelican. The Swiss philosopher Anton Marty (Schwyz, 1847 - Prague, 1914) belongs, with Carl Stumpf, to the first circle of Brentano’s pupils. Within Brentano’s school (and, to some extent, in the secondary literature), Marty has often been considered (in particular by Meinong) a kind of would-be epigone of his master (Fisette & Fréchette 2007: 61-2). There is no doubt that Brentano’s doctrine often provides Marty with his philosophical starting points. But Marty often arrives at original conclusions which are diametrically opposed to (...) Brentano’s views. This is true of his views about space and time and about judgment, emotions and intentionality. In the latter case, for example, Marty develops Brentano’s view and its implications in great detail (Mulligan 1989; Rollinger 2004), but uses them to formulate a very unBrentanian account of intentionality as a relation of ideal assimilation (Chrudzimski 1999; Cesalli & Taieb 2013). Marty’s philosophy of language, on the other hand, is one of the first philosophies worthy of the name. In what follows, we contrast briefly their accounts of (i) judgment and states of affairs and of (ii) emotings and value (two topics of foremost significance, for Brentano and Marty’s theoretical and practical philosophies respectively) (§1), and their philosophies of language (§2). Brentano’s view of language is based on his philosophy of mind. Marty takes over the latter and turns a couple of claims by Brentano about language into a sophisticated philosophy of language of a kind made familiar much later by Grice. Marty’s philosophy of states of affairs and value and of the mind’s relations to these also takes off from views sketched by the early Brentano, views forcefully rejected by the later Brentano. This is the first volume of a two-volume project whose aim is to publish all the known Middle English manuscript translations of the French Somme le mi, a thirteenth-century manual of religious instruction offering teaching on the Decalogue, the seven deadly sins and their remedies, compiled by the Dominican friar Laurent of Orleans. The project extends and deepens our knowledge of the influence of this popular French text, known today only from the versions entitled The Ayen bite of Inwit (...) and The Book of Vices and Virtues, published in 1866 and 1942, respectively. This volume presents the versions extant in BL MSS Royal 18. A. x and Add. 37677; the second will cover the versions in Cambridge, Corpus Christi College, MS 494, Oxford, Bodleian Library, MS Ashmole 1286, and Oxford, Bodleian Library, MS e Musaeo 23. The texts of both volumes have been prepared with the help of the recently-published edition of the French text, a circumstance from which the earlier English editions were unable to benefit. It is likely that the versions edited here for the first time will make a considerable contribution to our understanding of the processes of textual transmission and to that of translation itself in English literary circles of the fifteenth century. On interprète assez souvent le succès actuel des médecines parallèles comme une réaction à une double insatisfaction que la médecine scientifique laisse au patient dans nos sociétés occidentales. D'une part, la difficulté d'être entendu comme sujet dans sa maladie, comme une personne globale affectée dans la totalité de son être, dans le sens qu'elle donne à sa vie, à ses relations, etc. Et d'autre part, la difficulté d'être appréhendé d'une manière unitaire par le médecin, corps et esprit réunis. Les différents (...) auteurs de cet ouvrage, qu'ils soient théologiens, philosophes, médecins ou historiens de la médecine, ont tous pris au sérieux ces appels à dépasser ce que l'on peut appeler les impasses de la biomédecine en proposant, selon différentes inspirations, une anthropologie renouvelée du corps humain. En particulier, s'il s'agit de faire droit aux convictions du patient et du professionnel de santé, à quelles conditions - épistémologiques mais aussi politiques - un dialogue entre l'Eglise et la science peut-il s'avérer légitime et fécond? Que peuvent nous apprendre les écrits hippocratiques et les textes bibliques pour construire une autre représentation du corps humain et de la maladie? Le modèle des soins palliatifs ne pourrait-il pas fournir à la biomédecine un nouveau paradigme de prise en charge du patient où celui-ci reste un sujet, capable de relation, une personne jusqu'au bout? This chapter provides a brief overview of the increasing importance of experimentation in the life sciences from the seventeenth century to the present day. In the wake of the Scientific Revolution initiated in physics, numerous scientists have regularly attempted to introduce experimentation and the quantification of phenomena into the life sciences. These attempts have been difficult and have systematically come up against the fact that living organisms are individuals, i.e. both totalities that are difficult to decompose and transient results of (...) an evolutionary process that gives them specific characteristics. L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. Ce livre propose alors une réflexion épistémologique sur l'un des grands enjeux de l'historiographie juridique contemporaine : peut-on penser l'ordre juridique médiéval et moderne à partir des catégories juridiques contemporaines? This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

Le " dialogue " entre (...) la tendance de toute cellule à se laisser disparaître & la suspension de cette tendance chez toute cellule qui reste en Vie ne réfute-t-il pas l'antique suprématie - de Platon au néodarwinisme - de la vie sur la mort? Les recherches contemporaines sur l'auto-effacement cellulaire - sur l'" apoptose " et la Mort cellulaire " programmée " - permettent d'aborder ces questions en détail. Elles supposent, avec l'équivocité des phénomènes Vitaux, une dialectique Vie-Mort dont l'issue n'est nullement acquise d'avance. Elles nous invitent à repenser le sens même de la conservation, incorporant y compris en ses forces les plus Vives quelque chose comme l'a-Mort. En définitive, les concepts issus de la recherche en biologie cellulaire et l'interprétation épistémologique et philosophique qu'il est possible d'en donner ne concernent pas exclusivement des processus et des entités cellulaires. Notre Vie déployée dans la connaissance, dans l'art ou dans l'amour de la Vie jusque dans la Mort, répond, elle aussi, d'une telle équivocité. (shrink)

Ce monde qui est unique selon Platon, sans qu'il soit double par le monde intelligible dont parlera le neoplatonisme, est rendu possible par la rencontre de l'intelligible et du sensible. Ainsi, le logos, par quoi l'homme a acces aux Formes, est ce qui permet d'operer la deliaison proprement philosophique du corps et de l'ame, selon les termes du Phedon, sans qu'il faille poser un (...) dualisme cosmique qui se retrouverait dans l'homme. De meme que le sensible s'intelligibilise par la Participation et ainsi se maintient comme phenomene stable, de meme l'homme peut avoir un usage harmonieux de son corps et de ses sensations. Deliaison n'est pas rupture. L'enfance, la sexuation, le sommeil, les reves, la mort et la parole, ici interroges, montrent que l'anthropologie de Platon ne condamne ni le plaisir, ni le corps. La vie de la pensee ne s'absente pas des mouvements corporels qu'elle accompagne. C'est pourquoi le corps est le signe de l'ame. (shrink)

Retrace l'histoire du néant en Occident en étudiant ses étapes décisives et ses principales désignations.

Toutes les democraties egalitaires, detribalisees et secularisees d'Occident sont confrontees aux memes defis du communautarisme et de la reislamisation d'une partie de l'immigration - accrus par un continuel afflux de clandestins : le probleme de l'integration se pose donc moins en termes franco-francais de Republique que plus globalement de societe ouverte. Dans la perspective de Karl Popper et en usant de la liberte d'esprit et de parole chere a Jean-Francois Revel, il s'agit ici, a partir des faits, de montrer que (...) cette situation critique resulte d'abord de la forfaiture morale et parfois juridique de politiques qui n'ont pas voulu faire respecter ledroit commun democratique. Mais, surtout et en amont, de l'emprise d'une ideologie pretendument antiraciste, sans-frontieriste et acquise au relativisme multiculturel qui a perverti les valeurs de tolerance et d'ouverture: en elle se retrouvent les veritables et paradoxaux nouveaux ennemis de la societe ouverte. Faisant grand cas de l'emergence d'une resistance intellectuelle de tradition anti-totalitaire a cette bien-pensance et du combat emancipateur des musulmans libres, cette reflexion pointe le pathos masochiste qui fait oeuvrer les societes ouvertes contre elles-memes. This book addresses current practices in customary law. It includes contributions by scholars from various legal systems (the USA, France, Israel, Canada et cetera), who examine the current impacts of customary law on various aspects of private law, constitutional law, business law, international law and criminal law. In addition, the book expands the traditional concept of the rule of law, and argues that lawyers should not narrowly focus on statutory law, but should instead pay more attention to the impact of (...) practices on "real legal life." It states that the observation of practices calls for a stronger focus on usage, customs and traditions in our legal systems - the idea being not to replace statutory law, but to complement it with customary observations.
