Is there a duty to prosecute grave international crimes? Many have thought so, even if they recognize the obligation to be defeasible. However, the theoretical literature frequently leaves the grounds for such a duty inadequately specified, or unsystematically amalgamated, leaving it unclear which considerations should drive and shape processes of criminal accountability. Further, the circumstance leaves calls to end impunity vulnerable to skeptical worries concerning the risks and costs of punishing perpetrators. I argue that a qualified duty to prosecute can (...) be substantiated on the basis of a single class of reasons, though also that standard justifications of international criminal law (as currently conceived) are not up to the task. The account exploits the expressive dimension of punishment, but locates the central good of criminal accountability in its capacity to appropriately enable an agential stance on the part of subjects in transitional circumstances. It can legitimate, in a way to be specified, hope. The approach also displays the cynicism of an anti‐impunity ethos in the absence of a robust commitment to securing basic human rights in transitional circumstances. (shrink)

Given his view that the modern world is ‘radically evil’, Adorno is an unlikely contributor to business ethics. Despite this, we argue that his work has a number of provocative implications for the field that warrant wider attention. Adorno regards our social world as damaged, unfree, and false and we draw on this critique to outline why the achievement of good work is so rare in contemporary society, focusing in particular on the ethical demands of roles and the ideological nature (...) of management’s self-understanding. Nevertheless, we show that Adorno’s comments on activities such as art and philosophy mean that it is possible to draw on his work in a way that contributes constructively to the conversation about good and meaningful work within business ethics. I examine the status of Aristotle’s science of soul and argue that it is trans-generic in the way that Aristotle's universal mathematics is. For just as the branches of the latter differ considerably, so too do the sciences of life: botany, zoology, psychology, and (in Aristotle’s view) astronomy and theology. Discovering the correct definition of soul, which is their starting point or first principle, as with other scientific starting points, involves both induction and dialectic. Induction uses scientific observation of living (...) things to move toward this starting point. Dialectic enables the scientist to assemble endoxa, or reputable beliefs, that allow us to solve each puzzle (aporia) that clouds our understanding (nous) of the starting point that induction enables us to reach. To address the underrepresentation of women in philosophy effectively, we must understand the causes of the early loss of women. In this paper we challenge one of the few explanations that has focused on why women might leave philosophy at early stages. Wesley Buckwalter and Stephen Stich offer some evidence that women have different intuitions than men about philosophical thought experiments. We present some concerns about their evidence and we discuss our own study, in which we attempted to replicate their (...) results for 23 different responses to 14 scenarios . We also conducted a literature search to see if other philosophers or psychologists have tested for gender differences in philosophical intuitions. Based on our findings, we argue that that it is unlikely that gender differences in intuitions play a significant role in driving women from philosophy. (shrink)

We provide a taxonomy of the two most important debates in the philosophy of the cognitive and neural sciences. The first debate is over methodological individualism: is the object of the cognitive and neural sciences the brain, the whole animal, or the animal--environment system? The second is over explanatory style: should explanation in cognitive and neural science be reductionist-mechanistic, inter-level mechanistic, or dynamical? After setting out the debates, we discuss the ways in which they are interconnected. The demand for female labor is a central explanatory component of macrostructural theories of gender stratification. This study analyzes how the structural demand for female labor affects gender differences in labor force participation. The authors develop a measure of the gendered demand for labor by indexing the degree to which the occupational structure is skewed toward usually male or female occupations. In an age in which the lack of independent public intellectuals has often been sorely lamented, the historian Tony Judt played a rare and valuable role, bringing together history and current events, Europe and America, what was and what is with what should be. In When the Facts Change, Tony Judt's widow and fellow historian Jennifer Homans has assembled an essential collection of the most important and influential pieces written in the last fifteen years of Judt's life, the (...) years in which he found his voice in the public sphere. Included are seminal essays on the full range of Judt's concerns, including Europe as an idea and in reality, before 1989 and thereafter; Israel, the Holocaust and the Jews; American hyperpower and the world after 9/11; and issues of social inclusion and social justice in an age of increasing inequality. Some sensory modalities, such as sight, touch and audition, are arguably spatial, and one way to understand these spatial senses is to investigate spatial representations in them. Here I focus on a specific element in this area— the interplay between perspectival variation and spatial constancy—and discuss recent interdisciplinary works on this topic. With these relevant experimental works, we will see clearly how traditional controversies in philosophy, for example, whether we perceive perspectival shapes as well as objective shapes, and whether any (...) sensory field should be postulated in senses other than vision, can benefit from considerations in empirical sciences. The non-identity problem arises when an intervention or behavior changes the identity of those affected. Delaying pregnancy is an example of such a behavior. The problem is whether and in what ways such changes in identity affect moral considerations. While a great deal has been written about the non-identity problem, relatively little has been written about the implications for physicians and how they should understand their duties. We argue that the non-identity problem can make a crucial moral difference in some (...) circumstances, and that it has some interesting implications for when it is or is not right for a physician to refuse to accede to a patient's request. If a physician is asked to provide an intervention (identity preserving) that makes a person worse off, then such harm provides a good reason for the physician to refuse to provide the intervention. However, in cases where different (identity-altering) interventions result in different people having a better or worse life, physicians should normally respect patient choice. (shrink)

ABSTRACT Issues concerning the putative perception/cognition divide are not only age-old, but also resurface in contemporary discussions in various forms. In this paper, I connect a relatively new debate concerning perceptual confidence to the perception/cognition divide. The term ‘perceptual confidence’ is quite common in the empirical literature, but there is an unsettled question about it, namely: are confidence assignments perceptual or post-perceptual? John Morrison in two recent papers puts forward the claim that confidence arises already at the level of perception. (...) In this paper, I first argue that Morrison’s case is unconvincing, and then develop one picture on perceptual precision with the notion of ‘matching profile’ and ‘supervaluation’ : 481–495.), highlighting the fact that this is a vagueness account, which is similar to but importantly different from indeterminacy accounts : 156–184.). The contemporary astrophysicist today deals with questions that bear on the area known to traditional philosophy as “metaphysics.” Consequently, it is tempting to cross the threshold. One can allow oneself to be tempted by the idea that science is in a position to provide solutions to ancient and venerable metaphysical quests. One can even imagine, according to the wish expressed two thousand years ago by Epicurus, that it can calm our “metaphysical anxieties.”.

Endeavours to map out a piece of the intellectual history of this century which once almost faded from memory. In 1941 William Temple, then Archbishop of York, called for a Christian social philosophy and in so doing voiced a concern that had been gathering momentum all through the 30s, sharpened by the challenge of authoritarian regimes, left and right, and had formed the focus of the Oxford Conference of Church, Community and State in 1937.

This article examines the confessional booth as an architected space that, by serving as a geo-epistemological enclosure, prefigures digital forms of data capture and production. In conversation with critical scholarship about ‘confessional culture,’ it analyzes how confessionals and digital enclosures embody different historical iterations of a cultural technique that promises absolution – understood as a cleansing process of transparent exposure. It argues that, with digital enclosures, the renunciative self-mortification that lies at the heart of classic Christian confession is reprogrammed into (...) what Byung-Chul Han calls a ‘pornographic self-presentation.’ The self-death dealt by the confessional thus becomes an apparently voluntary self-exploitation for the social media subject. In both cases, however, absolution governs via rituals of cathartic transparency, submitting interiority to processes of legible exteriorization and articulating the subject via an exhibitive logic that blurs the boundaries between communicative freedom and compulsory self-exposure. Heidegger's Polemos: From Being to Politics. New Haven: Yale University Press, 2000. Pp. xvi + 302. Cloth, $35.00. That an outstanding philosopher could align himself with a monstrous ideology has always been a scandalous puzzle: but since Farias's Heidegger and Nazism (1989), it is impossible to dismiss Heidegger's "political episode" as the reprehensible but (...) forgivable lapse of a backwoods academic without political sense. Learning that Heidegger not only was a dedicated Nazi, but engineered a postwar cover-up of his involvement, was for many Heideggereans like entering a beloved office and finding swastikas spraypainted over everything. Consternation has hardly died down in the years since. Philosophers have struggled either to repudiate Heidegger's thought entirely or argue that the parts of it he pledged to Nazism were inconsistent with the rest. It isn't that such people deny (or not out loud) what would seem to be an obvious fact: that a bad man can be a good philosopher. They fear that something in Heidegger's thinking somehow "entails" fascism. A dilemma gets set up: either Heidegger's philosophy is contaminated by his actions, or to engage in those actions, Heidegger must have ignored his philosophy.Fried's book on polemos in Heidegger navigates between these horns: on the one hand, Fried dismisses as "absurd" any simple claim that Heidegger's work entails fascism (5), but on the other hand, he attempts to trace, throughout Heidegger's "middle period" (roughly Being and Time to the end of World War II), a notion he believes is consistent with embracing Nazism, not to argue that Heidegger's political decisions were correct or unavoidable, but that they were predictable—though fatally hubristic—responses to the European situation as Heidegger saw it. More, Fried wants to endorse Heidegger's understanding of polemos as valuable for politics today, not because it is insulated against fascism but because fascism is still a possibility we need to confront, even while we attempt to preserve Enlightenment ideals and liberal-democratic institutions in a "nihilistic" world.Heidegger bases his views about polemos ("struggle," "confrontation") on Heraclitus Fragment 53, where it is called "father and king of all." As he explores Heidegger's [End Page 453] treatment, Fried stresses that "what is of interest is not whether Heidegger's interpretations are philologically correct, but rather how these readings shed light on his own way of making sense of history and of politics" (29). And "confrontation" is the closest thing to a consistent political doctrine in Heidegger. He understands it as a respectful opposition that allows each "side" to appear in all its validity and therefore potential risk to the other "side." Confrontation is a principle of interpretation, dialogue between individuals, and interaction between nations (see 79-80). Fried insists that this idea is a crucial part of a number of central Heideggerean concepts, as well as how Heidegger viewed his own task, and Germany's, when National Socialism appeared with its promise of a new spiritual mission for the German Volk. That Heidegger's "romantic" hopes in Nazism were unfounded does not diminish the usefulness of his work on polemos, Fried thinks, because "postmodernist" thinkers, molded by Heidegger, have nothing better to offer as they "confront" the dying or dead "modern" world with dreams of a new society. Some respect for "liberal" values will still be necessary if postmodernist "deconstruction" of oppressive structures is not to leave inroads for new, opportunistic forms of fascism.Fried's is an important study, by a sympathetic but undazzled scholar of Heidegger, of a concept that may be as basic and fruitful as he claims: but his insistence on making everything in "middle Heidegger" depend on it causes him in many places to conflate separate projects and periods in Heidegger's work that were better left distinct. By admitting that economics is not exactly a picture of health at the moment, Lawson hopes that we can move away from the bafflingly intransigent belief that economics is at its core reliant upon mathematical modelling. The social sciences often fail to examine in any systematic way the nature of their subject matter. Demonstrating that this is a central explanation of the widely acknowledged failings of the social sciences, not least of modern economics, this book sets about rectifying matters. In this paper, we introduce and defend the recurrent model for understanding bodily spatial phenomenology. While Longo, Azañón and Haggard (2010) propose a bottom-up model, Bermúdez (2017) emphasizes the top-down aspect of the information processing loop. We argue that both are only half of the story. Section 1 intro- duces what the issues are. Section 2 starts by explaining why the top- down, descending direction is necessary with the illustration from the ‘body-based tactile rescaling’ paradigm (de Vignemont, Ehrsson and Haggard, (...) 2005). It then argues that the bottom-up, ascending direction is also necessary, and substantiates this view with recent research on skin space and tactile field (Haggard et al., 2017). Section 3 discusses the model’s application to body ownership and bodily self-representation. Implications also extend to topics such as sense modality individuation (Macpherson, 2011), the constancy- based view of perception (Burge, 2010), and the perception/cognition divide (Firestone and Scholl, 2016). Punktem wyjścia rozważań jest teza głosząca, że kategoria wolności w teorii republikańskiej jest ściśle związana z namysłem i ustaleniami dotyczącymi istoty i celu wspólnoty politycznej, określanej w tradycji rzymskiej mianem civitas libera. Wolność jest pochodną dobrze urządzonego, wolnego ładu politycznego, w którym kluczową rolę odgrywa prawo i cnota. Analizując ideę wolności republikańskiej przez pryzmat dwóch kontekstów: klasycznej tradycji republikańskiej i jej ustaleń oraz (...) ładu społeczno-ustrojowego Rzeczypospolitej, wskazuję, że łączy się ona ściśle z innymi kluczowymi dla teorii republikańskiej kategoriami, takimi jak res publica, sprawiedliwość i prawo, cnota, ustrój mieszany oraz obywatelskość, wyrażana w ideale vita activa, i dopiero w połączeniu z nimi możliwe jest ukazanie pełnego rozumienia wolności i jej uwarunkowań. The first part of the paper introduces the varieties of modern constructive mathematics, concentrating on Bishop's constructive mathematics (BISH). it gives a sketch of both Myhill's axiomatic system for BISH and a constructive axiomatic development of the real line R. The second part of the paper focusses on the relation between constructive mathematics and programming, with emphasis on Martin-L6f 's theory of types as a formal system for BISH.

Street art is an art form that entails creating public works incorporating the street physically and in their meaning. That physical property is employed as an artistic resource in street art raises two questions. Are street artworks necessarily illegal? Does being illegal change the nature of production and aesthetic appreciation? First, I argue street artworks must be in the street. On my view, both the physical and sociocultural senses of the street can be constitutive of meaning. Second, I argue that (...) illegality is a prototypical and paradigmatic feature of street art. While illegality alone does not make works better than sanctioned street art, it affects the production process and changes what is available to appreciate. (shrink)

Recently, there is a renewed debate concerning the role of perspective in vision. Morales et al. (2020) present evidence that, in the case of viewing a rotated coin, the visual system is sensitive to what has often been called “perspectival shapes.” It has generated vigorous discussions, including an online symposium by Morales and Cohen, an exchange between Linton (2021) and Morales et al. (2021), and most recently, a fierce critique by Burge and Burge (2022), in which they launch various conceptual (...) and empirical objections. Although Morales and Firestone (2022) have responded to them recently, and we are in agreement with Morales and Firestone in general, there are further problems in Burge and Burge (2022) that are worth highlighting. The main point of this comment is that what the Burge–Burge team call “viewpoint-dependent relational properties” are simply instances of what the Morales–Firestone team call “perspectival shapes”; the confusion arises from Burge and Burge’s misconstrual of Morales et al.’s claims. This shows that conceptually, the two teams are in large agreement, as Morales and Firestone (2022) also point out, and the focus should be put on the empirical disagreements, which has been covered by Morales and Firestone (2022). Relatedly, we argue that Burge and Burge (2022) misinterpret Morales et al. (2020) as supporting a new entity in perception science, and that this misinterpretation is a primary source of their apparent disagreement. This is worth pointing out because such misunderstanding generates many unnecessary quarrels that hinder progress. (shrink)

We study the equilibrium behavior of informed traders interacting with market scoring rule (MSR) market makers. One attractive feature of MSR is that it is myopically incentive compatible: it is optimal for traders to report their true beliefs about the likelihood of an event outcome provided that they ignore the impact of their reports on the profit they might garner from future trades. In this paper, we analyze non-myopic strategies and examine what information structures lead to truthful betting by traders. (...) Specifically, we analyze the behavior of risk-neutral traders with incomplete information playing in a dynamic game. We consider finite-stage and infinite-stage game models. For each model, we study the logarithmic market scoring rule (LMSR) with two different information structures: conditionally independent signals and (unconditionally) independent signals. In the finite-stage model, when signals of traders are independent conditional on the state of the world, truthful betting is a Perfect Bayesian Equilibrium (PBE). Moreover, it is the unique Weak Perfect Bayesian Equilibrium (WPBE) of the game. In contrast, when signals of traders are unconditionally independent, truthful betting is not a WPBE. In the infinite-stage model with unconditionally independent signals, there does not exist an equilibrium in which all information is revealed in a finite amount of time. One of the least understood aspects of the world-wide “greening of markets” is the emergence of local “ethical marketplaces” and the subset of alternative business models described as “ethical businesses.” But previous research has demonstrated the ability of local politicians to encourage their regions toward more ethical marketplaces. This paper explores the impact radical centrist third party representation has on the emergence of ethical businesses across Great Britain. To understand this relationship, we utilize a novel data set of organizations with (...) membership in Ethical Junction, the United Kingdom's largest network for ethical businesses. We use a zero-inflated Poisson regression to model the connection, and find a meaningful relationship, between third-party political representation on British local councils and the presence of ethical businesses within local authorities. This presents an example of the way in which radical political change may be part of a wider social movement toward greening markets. (shrink)
