El objetivo del trabajo consiste en revisar dos versiones del argumento que concibe a la averiguación de la verdad como un factor que confi ere legitimidad al ejercicio de la función jurisdiccional penal: la de Ferrajoli y la de Laudan. Se sostiene que su estudio minucioso puede proporcionar bases racionales para decidir sobre la conveniencia de suscribir un garantismo extremo o uno de carácter más mesurado. El artículo revisa las aportaciones más trascendentes que Jordi Ferrer ha hecho a la tradición racionalista de la prueba jurídica y evalúa críticamente el limitado papel que, desde su óptica, le corresponde desempeñar a la epistemología en la discusión general sobre los estándares de prueba apropiados para las distintas ramas del derecho. Más específicamente, se analiza la irrelevancia que Ferrer parece atribuir a dicha disciplina –o el silencio que debe guardar–, respecto del establecimiento del estándar de prueba deseable en materia (...) penal. Se concede que, en efecto, le corresponde al pueblo tomar la decisión de qué estándar implementar. No obstante, se sostiene, ello no impide que la epistemología incida en el proceso de formación de dicha decisión mediante la realización de observaciones, el ofrecimiento de argumentos y la propuesta de metodologías adecuadas, con miras a que aquella se tome en un contexto mejor informado y sea lo más racional posible. La sociedad del conocimiento y la introducción en los procesos de enseñanza-aprendizaje de las tecnologías de la información y la comunicación, están exigiendo de quienes nos dedicamos a la educación en el ámbito universitario, la utilización de nuevas estrategias didácticas y la reinvención de algunas antiguas o no tan nuevas. Se trata de dar respuesta a la demanda social de “aprender de otra manera” para mejorar la inserción de los nuevos egresados en su ámbito profesional. Esta nueva forma de aprender (...) debe tener en consideración las exigencias de los nuevos contextos de enseñanza-aprendizaje, donde el protagonismo de los estudiantes es un elemento esencial y la relación de lo aprendido con sus posibilidades de aplicación en el contexto profesional es el otro. Casualmente el modelo de formación basado en competencias desde el enfoque socioformativo coincide en ambos protagonismos y el portafolio como estrategia didáctica que puede utilizarse en este modelo puede ayudar a dotar de protagonismo al que aprende haciéndole tomar conciencia de que el aprendizaje no se produce de manera automática sino a través de una serie de pasos y etapas que a la vez que se van consiguiendo nos permiten reflexionar el proceso. Una vez llevado a cabo este proceso de reflexión general, puede aplicarse en el ámbito médico para iniciar al estudiante a tomar conciencia de su semejanza con el diagnóstico clínico. El artículo aborda la pandemia del covid-19 como elemento contingente y su efecto de develamiento respecto de algunas manifestaciones contemporáneas de la ideología neoliberal en Latinoamérica. De esta forma, en base a conceptos filosóficos y psicoanalíticos de orientación lacaniana planteados fundamentalmente por Slavoj Žižek, se examinan los usos críticos de la noción de ideología en sus diversas manifestaciones: miedo al otro, imposición de la lógica del empresario de sí, destrucción de lazos sociales, extractivismo de recursos naturales y fetichización de los (...) discursos de unidad frente a la pandemia. La hipótesis radica en que la pandemia presenta una oportunidad para repensar la subjetividad contemporánea, mediante la confrontación con el Real que bordea a la simbolización y, en definitiva, a la captura ideológica, a fin de poner en cuestión la afirmación de que no hay alternativa. Ten countries have established quotas for female representation on publicly traded corporate and/or state-owned enterprise boards of directors, ranging from 33 to 50 %, with various sanctions. Fifteen other countries have introduced non-binding gender quotas in their corporate governance codes enforcing a “comply or explain” principle. Countless other countries’ leaders and policy groups are in the process of debating, developing, and approving legislation around gender quotas in boards. Taken together, gender quota legislation significantly impacts the composition of boards of directors (...) and thus the strategic direction of these publicly traded and state-owned enterprises. This article outlines an integrated model of three institutional factors that explain the establishment of board of directors gender quota legislation based on the premise that the country’s institutional environment co-evolves with gender corporate policies. We argue that these three key institutional factors are female labor market and gendered welfare state provisions, left-leaning political government coalitions, and path-dependent policy initiatives for gender equality, both in the public realm as well as in the corporate domain. We discuss implications of our conceptual model and empirical findings for theory, practice, policy, and future research. These include the adoption and penalty design of board diversity practices into corporate practices, bottom-up approaches from firm to country-level gender board initiatives, hard versus soft regulation, the leading role of Norway and its isomorphic effects, the likelihood of engaging in decoupling, the role of business leaders, and the transnational and international reaction to board diversity initiatives. Central to the purposes of this analysis is Homer’s role, more precisely, the artistic strategies and procedures of his poetics.

Inmersos en un ambiente sociocultural impregnado por la increencia, el creyente se encuentra hoy fuertemente confrontado: convocado para anunciar a Dios a sus contemporáneos, y a un tiempo persistentemente rechazado por ello. De ahí que sea una urgencia reflexionar sobre cuáles son las claves antropológicas del hombre contemporáneo que le han conducido a tal cerrazón en su estructura íntima hasta instalarlo en la increencia. El presente artículo aborda no sólo en el por qué el anuncio cristiano no interesa al hombre (...) contemporáneo, sino, más radicalmente, por qué Dios ha dejado de ser significativo al hombre. Si bien la obra de Joseph Ratzinger es rica en interpolaciones sobre la esperanza, carece sin embargo de una presentación sistemática. La presente investigación, recogiendo todo el corpus ratzingeriano, pretende ofrecer una sistematización del tema esperanza, su fundamento bíblico, su estructura antropológica y su composición teológica.

La lectura de obras literarias constituye una herramienta para contribuir al desarrollo cognoscitivo, valorativo y empático del estudiante, así como a la aprehensión y transformación de la realidad. Por lo que el objetivo consistió en valorar la importancia de los talleres de apreciación literaria como contribución a la praxis humana en la Educación Médica mediante el criterio de especialistas. Las universidades de Ciencias Médicas tienen el reto de graduar un profesional que posea una amplia cultura general integral. El diagnóstico y caracterización del estado actual de la formación socio-humanista de los estudiantes que ingresan a la Casa de Altos Estudios reveló las insuficiencias que existen, por lo cual el objetivo consistió en la elaboración de un sistema de talleres de apreciación literaria para la formación socio-humanista de los estudiantes de Medicina de primer año de la Universidad de Ciencias Médicas (...) de Camagüey que forma parte de un proyecto aprobado en el programa de ciencia, tecnología e innovación nacional número 2, Organización, eficiencia y calidad de los servicios de salud, con el código 152049. El mismo constituye un aporte al Trabajo Educativo y de Extensión Universitaria en la institución. Medical universities face the challenge of graduating a professional with a comprehensive cultural background. The diagnosis and characterization of the current situation in regards to the socio-humanistic education of the students entering Camaguey´s Medical University revealed several insufficiencies. Due to this, the objective of this research was to prepare a system of literary analysis workshops to enable the socio-humanistic education of first year Medical students at Camaguey´s Medical University. This investigation has been approved as a project belonging to a national science, technology and innovation program with the code 152049 and is a contribution to the educational work of the university. This paper examines whether a firm’s financial performance is associated with superior environmental, social and governance scores in emerging markets of multinationals in Latin America. The study addresses the current research gap on this issue; it develops hypotheses and tests them by applying linear regressions with a data panel drawn from the Thomson Reuters Eikon™ database to analyse data on 104 multinationals from Brazil, Chile, Colombia, Mexico and Peru between 2011 and 2015. The results suggest that the relationship between the (...) ESG score and FP is significantly statistically negative. Furthermore, in examining environmental, social and governance separately to accurately determine each variable’s relationship to multilatinas’ FP, the results reveal a negative relationship. Finally, the empirical analysis provides evidence for a moderating effect of financial slack and geographic international diversification on the relationship between ESG dimensions and firms’ FP. This study furthers understanding of the relationship between ESG dimensions and FP for the Latin American business context. (shrink)

The purpose of this article is to show how W.B. Gallie’s proposal on the essential contestability of political concepts ended up calling into question the very notion of essential contestability proposed by this author. In spite of this, we consider that such a notion can still be a contribution to the history of concepts if it is complemented by some aspects of Hegel’s philosophy, located in his Science of Logic, which can provide a foundation for such contestability from a self-referred (...) negativity open to semantic displacements, which allows us to receive Gallie’s proposal without having to accept all his theoretical commitments, radicalizing his proposal and providing some useful indications for the history of political concepts. En el siglo XX se ha realizado un " punto de inflexión " en la filosofía, que ha sido conocido por muy pocos, que ha sido abandonado apenas entrevisto. Este libro es el intento de tomarlo en serio y ensayar una visión de los problemas morales que no lo pase por alto; dicho con otras palabras, que no sea arcaico.

En las primeras páginas de la Ciencia de la lógica, el pensar tiene la pretensión de iniciar su propio movimiento sin aceptar ningún pensamiento dado o presuposición como la paradójica y pura autorreferencia del vínculo de ser y nada. De acuerdo conesto, proponemos una lectura que afirma la presencia de una negatividad que explica la actividad inmanente del pensar en el inicio de la Ciencia de la lógica.

El objetivo de este artículo es mostrar cómo en la novela Ciudad de cristal de Paul Auster tiene lugar una aproximación a lo singular mediante el lenguaje. Sin embargo, esta adecuación entre las palabras y las cosas tiene que sucumbir frente al movimiento y cambio constante de estas últimas, lo que produce que la adecuación perfecta de lo singular y el lenguaje no se pueda llevar a cabo, transformándose el lenguaje en silencio. Creemos que esto se confirma en la actitud (...) de dos de los personajes de esta novela, cuya única alternativa y escapatoria consiste en fundirse con la ciudad, convirtiendo el espacio en una nueva articulación lingüística. The aim of this article is to show how in Paul Auster’s novel City of Glass, an approach to singularity through language takes place. Nevertheless, this adjustment between words and things fails because of the constant movement and change of things, resulting in failure of the perfect adjustment between the singular and language, turning the language into silence. We think that this is confirmed in the behaviour of two of this novel’s characters, whose only alternative and escape consists of merging with the city, transforming the space into a new linguistic articulation. ABSTRACT The aim of this article is to demonstrate that Hegel in his Introduction to the Lectures on the Philosophy of World History proposes a new way of thinking historical time thanks to a notion of eternity understood as the negative reunion of the moments of time by questioning the idea of progress and introducing the notion of absolute pre-sent. ABSTRACT:Despite a significant increase in whistle-blowing practices in work organizations, we know little about what differentiates whistle-blowers from those who observe a wrongdoing but chose not to report it. In this review article, we first highlight the arenas in which research on whistle-blowing has produced inconsistent results and those in which the findings have been consistent. Second, we propose that the adoption of an identity approach will help clarify the inconsistent findings and extend prior work on individual-level motives behind whistle-blowing. (...) Third, we argue that the integration of the whistle-blowing research with that on ethics programs will aid in systematically expanding our understanding of the situational antecedents of whistle-blowing. En la actualidad es de suma importancia tener habilidades digitales y acceso a dispositivos tecnológicos para seguir aprendiendo. El presente estudio analiza la percepción de exclusión digital por estudiantes inscritos en un programa de posgrado en línea. Los resultados muestran que los estudiantes cuentan con acceso a dispositivos digitales e Internet, y que la percepción de exclusión es mayormente por la falta de competencias digitales. Los sujetos de estudio que no se sienten excluidos consideran la existencia de una brecha escolar, (...) debido a su mayor uso y conocimiento de herramientas digitales con respecto a la aplicación que hace la institución. Para ello, primero se muestra una sección donde trata de definirse qué es un principio y cuál es el principio de razón suficiente, para posteriormente pasar a los problemas que tiene la postulación de dicho principio desde la perspectiva de Leibniz.

The responses of 178 Latin dioceses in the United States Conference of Catholic Bishops (USCCB) to the Preparatory Document for the Synod on Synodality were synthesized in fourteen regional reports. From these reports, and a report of lay groups, the USCCB produced the US report, which was synthesized with 111 other national reports into the Working Document for the Continental Stage (DCS). The latter was provided to seven continental assemblies. North American participants discussed the DCS in virtual meetings, and a (...) writing team produced the North American report. The synthesized result of the continental assemblies’ reports was the synod’s 2023 Instrumentum laboris. This article discusses US diocesan participation and the North American response to the DCS as they contributed to the Instrumentum laboris’ statement relative to “the question of women’s inclusion in the diaconate.” It includes a table documenting US diocesan responses to questions of women’s participation in the Church. Can animals think? In this paper I address the proposal that many animals, including insects such as honeybees, have genuine thoughts. I consider one prominent version of this view that claims that honeybees can represent and process information about their environments in a way that satisfies the main hallmarks of human conceptual thought. I shall argue, however, that this view fails to provide convincing grounds for accepting that animals possess concepts. More precisely, I suggest that two important aspects of conceptual (...) thought, viz., concept individuation and the generality constraint, are not satisfied. (shrink)

Online Public Shaming is a form of norm enforcement that involves collectively imposing reputational costs on a person for having a certain kind of moral character. OPS actions aim to disqualify her from public discussion and certain normal human relations. We argue that this constitutes an informal collective punishment that it is presumptively wrong to impose on others. OPS functions as a form of ostracism that fails to show equal basic respect to its targets. Additionally, in seeking to mobilise unconstrained (...) collective power with potentially serious punitive consequences, OPS is incompatible with due process values. (shrink)

There is an affinity between Hegel’s philosophy and Neoplatonism that Hegel himself explicitly pointed out. We claim that this affinity is due to systematic reasons and involves theoretical and practical aspects of both philosophies. To argue in that direction, we address the thematization of Plotinus’s philosophy in the Hegelian Lessons on the history of philosophy. We seek to show that, according to Hegel, Plotinus elaborates in ancient times, for the first time, a complex synthesis of the philosophical principles that precede (...) his own thought, and for this reason Hegel’s speculative exposition ascribes to Neoplatonism the logical category of totality. In this synthesis of finite principles —which we will seek to determine in this paper—, Hegel recognizes tasks and problems close to those of his own philosophy. However, can it be asserted that Hegel’s philosophy is for this reason a modern Neoplatonism, or is there a point at which both projects are revealed to have a fundamental incompatibility? (shrink)

Las mujeres presas son un colectivo poco conflictivo y pequeño (el 8% de la población penitenciaria), y por lo tanto olvidado e invisible. Sin embargo, se trata de un grupo muy castigado ya que cuando una mujer entra en prisión sufre una triple condena: social, personal y penitenciaria.

White-collar crimes are illegal and unethical actions by agents of an organization. In this paper, we address two related research questions concerning white-collar crime—how did the language of white-collar crime evolve? And how did this language co-evolve with the investigation of white-collar crime? Building on research on institutional work, we find that key institutional actors such as the Presidential Office are likely to use frames and adopt a particular language in order to legitimize institutional practices . Conversely, less powerful actors (...) such as the law enforcement agencies are then likely to use narratives to shape language in order to mobilize other stakeholders to continue the adoption of the referent practice. We uncover these findings by using qualitative methodology and trend analysis. We conclude with a detailed theoretical discussion of the role of institutional actors in institutional work and the implications of our research. (shrink)

Edouard Machery has argued that the notion of concept should be eliminated from scientific theorising about cognition on the grounds that what psychologists call concepts do not form a natural kind and that keeping this notion would encumber scientific progress. His view is that the class of concepts really divides into three distinct yet co-referential kinds of bodies of knowledge typically used in distinct cognitive processes. The main purpose of this paper is to challenge Machery’s eliminativist conclusion on the grounds (...) that his alternative to concepts fails to be combined with any prominent account of content determination. As a case of philosophical scrutiny of a psychological proposal, the paper also intends to show how philosophical and psychological interests in concepts can be brought together. (shrink)

A recent study by McGee from the University of Oregon has led to discussions in international media and on the web. This study addresses an interesting question and applies advanced statistics for its analysis. However, we identify several methodological flaws that invalidate the results. First, McGee tests a hypothesis that does not correspond to his main question and which does not allow McGee to derive the conclusions that are drawn in his paper and reported in the media coverage. Second, the (...) data used are not adequate for the analysis because: i) the dependent variable does not reflect the greenhouse gas emissions characteristics of organic agriculture, ii) the explanatory variables neglect the livestock sector, and iii) trade aspects are missing. Third, McGee fails to discuss his findings in the light of quite a substantial body of experimental, bio-physical research from the US and elsewhere. (shrink)

We give examples of calculi that extend Gentzen’s sequent calculusLKby unsound quantifier inferences in such a way that derivations lead only to true sequents, and proofs therein are nonelementarily shorter thanLK-proofs.

To make the case for non-conceptualism, Heck draws on an apparent dichotomy between linguistic and iconic representations. According to Heck, whereas linguistic representations have conceptual content, the content of iconic representations is non-conceptual. Based on the case of cartographic systems, the authors criticize Heck’s dichotomous distinction. They argue that maps are composed of semantically arbitrary elements that play different syntactic roles. Based on this, they claim that maps have a predicative structure and convey conceptual content. Finally, the authors argue that, (...) despite their differences, maps and sentences can logically interact with each other through heterogeneous inferences. These considerations not only challenge the view that conceptual content and inferential processes necessarily involve linguistic representations; furthermore, they provide a new perspective for thinking about maps, their semantics and syntax, and their interaction with linguistic systems. The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem.
