Structural injustice exists when the influence of social structure exposes some groups of people to undeserved burdens while conferring unearned power to others. It has been argued that the responsibility for addressing structural injustices should be shared among those participating in the social structure and can only be discharged through collective action; however, the proper form of collective action does not happen easily. To address structural injustice effectively, we need to gain clarity on the practical challenges that are involved and (...) explore possible means of implementing shared responsibility. This chapter thus aims to contribute to the study of addressing structural injustice in the following two ways. First, building on previous studies, I categorize three forms of practical challenges that have been encountered by existing proposals for discharging shared responsibility for structural injustice. Second, I offer an alternative proposal, which I will refer to as the deliberative mini-public proposal, and argue that it has the potential to mobilize structural change and better overcome the identified practical challenges. This paper discusses the relationship between rational thought and rational action, between philosophy and politics, in a perspective in which this relationship, if properly understood, turns out to be decisive for the repoliticisation process that seems to impose itself as an urgent obligation of our time. It will be shown that the ancient Greek experience of understanding philosophy and politics, transformed in modernity in a certain way, is also relevant to the contemporary emancipation of our rational life. This paper argues that the value of openness to epistemic plurality and the value of social responsiveness are essential for epistemic agents such as scientists who are expected to carry out non-epistemic missions. My chief philosophical claim is that the two values should play a joint role in their communication about earthquake-related damages when their knowledge claims are advisory. That said, I try to defend a minimal normative account of science in the context of communication. I show that these epistemic (...) agents when acting as communicators may encounter various epistemic and practical uncertainties in making their knowledge claims. Using four vignettes, I show that the value of openness to epistemic plurality and the value of social responsiveness may best serve their epistemic and practical purposes across different contexts by reducing their epistemic and practical risks associated with the knowledge claims they communicated. The former may reduce the risks of prematurely excluding epistemic alternatives and is conducive to two types of epistemic plurality; the latter is supposed to reduce the risks of making self-defeating advisory claims and harmful wishful speaking by minimizing the values in tension that can be embedded in the social roles the epistemic agents play. The present study investigates Taiwanese graduate students’ general understanding and misunderstanding of Responsible Conduct of Research. A total of 580 graduate students responded to the self-developed Responsible Conduct of Research Reasoning Test. The results reveal that, first, students did not have sufficient knowledge to reason why a particular instance of research conduct was doable or not. Second, the statistical results show that female students, students majoring in the humanities or the social sciences, doctoral-level students, and students with RCR-related training outperformed (...) others. In addition, the misbehaviors that students judged relatively uncritically comprise the following nine categories: seeing authorship as a property or power, misinterpreting research coauthors’ responsibilities, inaccurately conducting the informed-consent process, fabricating and falsifying research data, misinterpreting the correct citation of research sources, holding vague concepts of self-plagiarism, misinterpreting the Taiwan Copyright Act, accepting duplicate-publication practices, and accepting piecemeal publication practices. The present study discusses participative students’ major misunderstandings of actual RCR-related practices. The study also presents further implications and suggestions based on the findings. A growing body of research has focused on the relationship between board diversity and firm performance. A series of empirical literatures have also examined a significant positive correlation between the two. But these results only demonstrate the relationship between the input of ‘diversity’ and the output of ‘firm performance’. Such research is more of a black box because board diversity must act on certain strategies or decisions to affect firm performance. Some scholars try theoretical analysis with the purpose of opening (...) the black box. In order to verify the relevant theoretical analysis results, this study uses the mediating effect analysis model in the field of psychology, through multiple regression, impulse analysis, variance decomposition and other methods, to thus empirically test the mediating effect of technological innovation in the process of board diversification promoting corporate performance. We found that board diversity can improve firm performance by enhancing the level of technological innovation. Among them, technological innovation has played a complete mediating role in the diversity of board members’ functional and occupational background, and played a partial mediating role in the diversification of directors’ part-time jobs. Technological innovation is a key indicator bridging board diversity and firm performance. This study can explore and explain the inner workings of the significant relationship between board diversity and firm performance, and link research findings on similar phenomena. The research results may make the existing board governance theories more systematic, expand the extension of theoretical research, and provide some empirical research references for academics and practitioners. In their examination of elementary science classrooms, Amerine and Bilmes (1988) found that following instructions requires students to understand the relationship between the projected outcome and the corresponding course of actions. One of the most important resources for instructions is the lesson plan, which prescribes the sequence of teaching. However, there is often a gap between what is planned and what actually happens in the classroom. This raises the question of how teachers come to terms with contingent variants and unexpected (...) outcomes that real-time interactions occasion and how lesson plans are configured into these processes. This study examines a teacher education program that uses lesson plans as a central resource for teaching mathematics. The results suggest that classroom teachers use lesson plans as communicative resources to identify problems, specify assumptions about their teaching and act on the evolving contingency of classroom interaction. The interactional contingency is the locus of teaching practices, not an obstacle to the application of procedures in lesson plans. (shrink)

Ours is a culture of 'happy endings' and, in this respect, most philosophers of today are the spokespersons of their time. Bradatan is a dissenter. His book approaches death head-on. Indeed, what makes this project fascinating is the fact that, while the book purports to be about (...) 'dying for an idea,' it in fact sings praise to life. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. This work raises the philosophical implications of the contemporary Taiwanese as a Chinese cultural people that socio-philosophically defined herself as a moral or ethical person. The political history of Taiwan has been marked by her struggle for self-determination. Self-determination based and reflected on a self-affirmation and self-identification that is internationally recognized and legitimized. This, no doubt, beyond the generalized bent by all nations towards globalization and multi-culturalism, there has been a more and more openness to the western nations. As she (...) looks towards the West, she ipso facto looks away from the Main Land China. This work is neither an investigation in political science nor a historical critique and reconstruction. It is rather a philosophical critique on the philosophical anthropology of a people that is fundamentally ethical, that is now facing and open to climes of which their philosophical anthropology is not in essence ethical. Put differently, it is an evaluation on the notion of “the Taiwanese person”. An evaluation on how “the Taiwanese person” from the standpoint of philosophical anthropology could still be claimed to be a Confucian. The question is: could the Taiwanese person today be said to be「仁者」, if Confucian philosophical anthropology asserts, 「仁者人也」? Hence, this work will attempt to respond to this question by a philosophical analysis of the notion of 「仁者」as an ethical person based on Karol Wojtyłian notion of the ethical person. To understand the notion of the “ethical” or “moral” person, the concept of “ethics” or “moral” and “person” ought to be exposed. Therefore, in this work Wojtyłian philosophy shall be employed as the epistemological foundation for the definition and explication of the concepts: ethics, moral and person. The writer considers the philosophy of Karol Wojtyłian as a plausible paradigm amongst the western philosophies in the exposition of Confucian ethics and philosophical anthropology. The conception of person as “Person-revealed-in-action” or as it is popularly known, the “Acting Person”, underpins properties of the human person that are very fundamental in the Confucian conception of the person. This “person- revealed-in-action”, is an ethical person, as 「仁者」is 「人」in the Confucian Philosophy. This is as a result of the similarity in the fundamental claims maintained both in the Confucian ethics and philosophical anthropology and in that of Karol Wojtyła. Cognitive architectures have often been applied to data from individual experiments. In this paper, I develop an ACT-R reader that can model a much larger set of data, eye-tracking corpus data. It is shown that the resulting model has a good fit to the data for the considered low-level processes. Unlike previous related works, the model achieves the fit by estimating free parameters of ACT-R using Bayesian estimation and Markov-Chain Monte Carlo techniques, rather than by relying on the mix of (...) manual selection + default values. The method used in the paper is generalizable beyond this particular model and data set and could be used on other ACT-R models. (shrink)

A theory is agent neutral if it gives every agent the same set of aims and agent relative otherwise. Most philosophers take act-consequentialism to be agent-neutral, but I argue that at the heart of consequentialism is the idea that all acts are morally permissible in virtue of their propensity to promote value and that, given this, it is possible to have a theory that is both agent-relative and act-consequentialist. Furthermore, I demonstrate that agent-relative act-consequentialism can avoid the counterintuitive implications associated (...) with utilitarianism while maintaining the compelling idea that it is never wrong to bring about the best outcome. This paper is an attempt to stage some questions concerning methodology and education, inspired by Ophelia in Shakespeare's Hamlet and by Jacques Derrida's poetic philosophical oeuvres. What are at stake are the long traditions of preferences of sanity over madness, friend over enemy, male over female and of clean, unambiguous univocal language over the poetic. I will argue that educators will have an extra responsibility towards challenging the ancient tradition of phallogocentrism, both in our teaching and in our research.

In this paper, we argue that deliberative democrats have too narrow a conception of the political, but that 'activism' as it is normally understood is not sufficiently broad, either. Politics is not reducible to coercion and contestation, but rather to the constitution of our shared world. We contend that active citizenship more often takes the form of working in a rape crisis center or a domestic violence clinic than participating in marches or town meetings.

Some say that consent is essentially just a state of mind. Others say it is essentially just a communication. Many say it is both. I say it is neither. Instead it is an act, or rather a pair of acts—an internal mental act in the first instance, an external performative act in the second. Each of those acts is an act of commitment, intrapersonally in the first case and interpersonally in the second. The content of the commitment is, familiarly enough, (...) to give permission to someone else to do something that it would be wrong for them to do without your permission. ABSTRACTOn 4 September 2015 asylum seekers who got stranded in Budapest’s Keleti train station began a march to cross the Austrian border. Their aim was to reach Germany and Sweden where they believed their asylum claims would be better received. In this article, I argue that the march should be characterized as an act of civil disobedience. This claim may seem to contradict common convictions regarding acts of civil disobedience as well as asylum seekers. The most common justifications are given (...) with reference to moral rights of citizens and concerns for enhancing justice or democracy within states. Asylum seekers are not members of the European public. How can they be entitled to break the law? I first show that the march displays features of a paradigm case of civil disobedience. Then, I identify moral reasons for asylum seekers to carry out the march acceptable from both strong and weak cosmopolitan perspectives. After that, I point out its corrective, stabilizing and democracy-enhancing roles in the European political landscape. I conclude by emphasizing that conceptualizing the march as an act of civil disobedience is significant in recognizing asylum seekers as political agents making claims within an evolving framework of refugee protection. Most philosophers assume (often without argument) that belief is a mental state. Call their view the orthodoxy. In a pair of recent papers, Matthew Boyle has argued that the orthodoxy is mistaken: belief is not a state but (as I like to put it) an act of reason. I argue here that at least part of his disagreement with the orthodoxy rests on an equivocation. For to say that belief is an act of reason might mean either (i) that it’s (...) an actualization of its subject’s rational capacities or (ii) that it’s a rational activity (hence, a certain kind of event). Background: Chronic Pain (CP) has serious medical and social consequences, and leads to economic burden that threatens the sustainability of healthcare services. Thus, optimized management of pain tools to support CP patients in adjusting to their condition and improving quality of life is timely. Although Acceptance and Commitment Therapy (ACT) is considered an evidence-based psychological approach for CP, evidence for the efficacy of online-delivered ACT for CP is still scarce. At the same time, studies suggest that self-compassion mediates the change (...) in disability and psychopathological symptoms in ACT interventions for CP, although self-compassion is not a specific target in ACT. Thus, an explicit focus on self-compassion might increase the efficacy of ACT interventions for CP, although this hypothesis has not been tested. This study aims to develop an eHealth ACT and compassion-based self-management intervention for CP, the iACTwithPain, and to compare its efficacy in improving health outcomes to a similar ACT-only intervention and a waiting list group. Methods: The eHealth platform that will host the interventions will be developed using a flat design identity and will be interactive. The iACTwithPain intervention will comprise 8 weekly self-management sessions, and will be developed taking into consideration the psychological flexibility model applied to CP, with the addition of explicit compassion-based components. To analyse whether the iACTwithPain intervention will present superiority in improving CP’s impact and related health markers over the two other conditions, this study will follow a RCT design with three arms. CP patients will be recruited through direct contact with patient associations and healthcare services and a national press release in Portugal. Outcome measurement will be conducted at baseline, post-intervention and at 3- and 6-months follow-ups. The interventions’ acceptability will also be assessed. Discussion: The iACTwithPain intervention is expected to improve CP patients’ psychosocial functioning, quality of life, and empowerment, by promoting adaptive disease management and regulation of pain-related internal experiences. Results will contribute to a better understanding on the pertinence of adding compassion elements to ACT for CP and to reach an optimized intervention for CP. (shrink)

Jewish law takes an approach to self-defense that differs dramatically from the conventional assumptions of Western secular legal systems. The central theme of Talmudic jurisprudence is that self-defense rests on a duty not to stand idly by while one's neighbor suffers. “Do not stand on the blood of one's neighbor,” as the point is cryptically put in Leviticus 19:16. This way of thinking about self-defense departs in two significant ways from common Western assumptions. First, it stresses that the roots of (...) self-defense are a duty rather than a right to act; second, it treats the case of third-party defense as logically prior to the first-party case of self -defense. In this essay, I distinguish two significant act-utilitarian theories of moral education: the traditional rule of thumb view and the Harian intuition view. I argue that there are problems with the traditional view and that an act-utilitarian ought to adopt a version of the Harian view. I then explain and respond to a major objection to the intuition view given by Bernard Williams. Williams argues that the system of moral thought which the Harian view advocates we teach is inherently unstable (...) and is certain to undermine itself. It begins with an overview of act consequentialism, including a description of the view’s principle of rightness (an act is right if and only if it maximizes the good) and a conception of the good focusing on the well-being of sentient creatures and rejecting temporal discounting. Objections to act consequentialism, and replies, are also considered. Next, the chapter briefly suggests that act consequentialism (...) could reasonably be regarded as the default moral theory of climate change, in the sense that a broadly act-consequentialist framework often seems implicit in both scholarly and casual discussions of the ethics of climate change. The remainder of the chapter explores three possible responses to the threat of climate change: having fewer children to reduce the number of people emitting greenhouse gases; taxing greenhouse-gas (GHG) emissions (commonly called a “carbon tax”) to discourage GHG-emitting behavior; and reducing poverty to lessen personal, familial, and community vulnerability to the harms of climate change. In a world filled with “ambient violence”, public protest is a vital signal of shared discontent. The essential compulsion at the heart of protest, however, is conventionally not recognised for what it is: solidarity with those suffering injustices. Amid authorities’ often-fierce efforts to curtail gatherings of people whose experiences of injustice propel them into the streets, a sharp rise in public protests has been perceived since the early 2000s. Thousands of column inches dedicated to reporting on protests are rivalled in (...) volume only by the reams of academic theories produced around causes. Despite this overabundance of discourses, it often remains unclear what protest, at heart, constitutes. That is, what are we talking about when we talk about protest, and why does this question matter? In this paper I consider the constituent parts of protest formation in the abstract, including grievances, gestures, and tactics, among other. Developing these constituent parts reveals protest to be, first and foremost, a manifestation of a nonhegemonic ethical commitment to justice, requiring courage and coordination, and whose outcome is always contingent, that is, an act of love. I also reflect on the nature of protest as a direct political action that sits on a continuum that ranges from opposition politics to civil war. This continuum offers a graded view ranking expressions of discontent by severity of outcome. (shrink)

A language, on the contrary, is something coming from the outside, from the speech community, something offered to the speaking subject from the tradition in the technique of speaking. The ‘messianic’ is one of philosophy’s most appropriated religious terms, yet one apparently now bereft of its historical religious particularity. This essay thus explores a genealogical approach to the ‘messianic’ which might prove helpful in uncovering the reasons for this transformation from the theological to the philosophical, and what role, if any, theology still has in determining the meaning and usage of this term. Accordingly, this essay traces the term through the work of Walter Benjamin, Jacques Derrida and Giorgio Agamben. (...) This development is made against the backdrop of another religious term which indirectly pervades the work of all three authors: the canon. The canonical is a term which lingers on the margins of these messianic discourses and needs to be explored further in the context of this work in order to provide a fitting foil to these otherwise ‘purely philosophical’ developments of the messianic. The necessity for invoking the canonical form will become clear as this analysis is extended to the work of Agamben in order to determine how canons remain an unstated factor in his attempt to eradicate all representation from a just ethical paradigm. In this attempt to articulate a model of understanding that goes beyond the universal/particular divide, he will in fact advance a movement from particularity to particularity which can be profoundly read as a genuine paradigm for articulating a theological principle of creation. Thus, this essay intends to point toward two related conclusions: first, that the triad of canon-creation-representation might be understood as a necessity for cultural intelligibility, yet one that must also be seen in relation to its messianic-redemptive-unrepresented elements; and, second, that even this epistemological framework can be undone through a bid to end all representations which nonetheless allows us to return to a more profound realization of creation. This paper focuses on eristic in political debate of the forensic, or confrontational, type. First, some findings on the enactment and persuasiveness of hostility in a series of Danish TV-debates 1975–85 are presented, including a list of the clearly hostile debater's characteristics and a subdivision of conspiracy arguments. This presentation serves to illustrate that hostility is less persuasive than argumentation practitioners and theorists tend to assume. Next, the widespread notion of debate as a genre half-way between the quarrel and the (...) critical discussion is challenged in a discussion of Douglas N. Walton's distinction between types of dialogue. It is maintained that the normative model of confrontational debate excludes the quarrel and that debate should not be perceived as second-rate critical discussion. (shrink)

This research examines the impact of implicit religious beliefs on work ethic in specific cultural contexts. Based on three studies, the authors found that thoughts related to religion impact work ethic, but only when the culture embraces religious values at work and in public environments. In a comparative setting, Moroccan participants primed with religious thoughts displayed greater work ethic, whereas similarly primed French participants exhibited less work ethic (Study 1). For North African–French biculturals, religious stimuli interacted with cultural identity to (...) predict work ethic (Study 2) and activated religious beliefs and cultural identity had a significant effect on their level of effort (Study 3). Our research reveals that implicit religious beliefs can predict work ethic in a manner contingent on a cultural setting. In cultures where religious values are historically embraced and encouraged, work ethic constitutes a religious construct that enhances work ethic. Conversely, in secular cultures, religious cues inhibit work ethic. We believe that within a multi-cultural, multi-religion work force, it is important to take note of these influences. (shrink)

This Article explores the process of discovering legal scholarship. One may read, read, and read cases and statutes and articles to generate one's own piece of scholarship. But research, though necessary, does not produce durable scholarship. Lasting scholarship is like discovering penicillin. It is like capturing a fleeting revelation. It is an experience reported in language. True legal scholarship is researched poetry of the highest order. Rumi, Frost, Keats would have been great legal scholars.
