This article provides a critical and philosophical assessment of arguments invoked for and against the constitutional protection of commercial expression and the regulation of commercial speech with a focus on the commercialization of unhealthy food products.

Este artículo busca responder a la siguiente pregunta: ¿Qué tipo de relación sostiene la Ciencia de la lógica con la tradición metafísica? Hay en ello un doble motivo de reflexión: por un lado, se trata de distinguir los sentidos de la crítica y los de la transformación científica de la metafísica tanto en Kant como en Hegel, y, por otro lado, de concebir el inicio [Anfang] y el principio [Prinzip] de la Lógica como dos modos de relación que permitirían hacer (...) tal distinción aunque únicamente de manera introductoria. El inicio de esta Lógica es así el primer fin de un círculo que vuelve a abrirse; anverso del límite, o estudio lógico de reverso fenomenológico; unidad de un carácter genitivo doble ‒de la Ciencia de la conciencia y del Concepto de la Ciencia‒, que hace del saber puro el fin del inicio fenomenológico, y al mismo tiempo el inicio de su propia exposición. Inicio inmanente al desarrollo de la Ciencia y que es por lo tanto un momento de saber-puro-ser. Es, dicho en breve, el inicio de una Lógica pura, objetiva y subjetiva, ya liberada de la oposición en sí/concepto, y que al ser el desarrollo del pensar objetivo se constituye en el “sistema de la razón pura”. Este trabajo analiza, desde una perspectiva sociodemográfica, el comportamiento de la mortalidad adolescente en Argentina, más allá de las causas externas, en los trienios 2005-2007 y 2015-2017. Para ello, se calculan y analizan tasas de mortalidad por sexo, grupo de edad, causas seleccionadas y regiones geográficas, con base en datos de la Dirección de Estadística e Información de Salud de la Nación y del Instituto Nacional de Estadísticas y Censos. También se calculan el Coeficiente de Gini y los Años de (...) Esperanza de Vida Perdidos a nivel regional para profundizar el análisis de la dinámica espacial de la mortalidad. Los resultados muestran una reducción de la mortalidad adolescente para el conjunto de causas no externas. Sin embargo, se observan además: (a) mayores tasas de mortalidad masculina; (b) un aumento de la mortalidad en la población de 15 a 19 años de ambos sexos; (c) el predominio de los tumores como principal causa de muerte no externa; (d) un aumento de la mortalidad por enfermedades del sistema nervioso central, del aparato circulatorio, respiratorias y causas maternas, fundamentalmente entre los 15 y 19 años; y (e) la persistencia de diferencias interregionales, mayormente en detrimento del Noreste y del Noroeste. Estos resultados refuerzan la importancia de emprender medidas focalizadas en las particularidades de cada región y los factores que inciden en la ocurrencia de las muertes registradas. Todo ello en favor de procurar una atención más integral de la salud de la población adolescente, y lograr así sociedades más saludables y sostenibles a futuro. (shrink)

As possibilidades do cinema no ensino das humanidades Resumo: Tradicionalmente usado como ilustração e sensibilização de conteúdos curriculares, propomos neste artigo um outro modo de usar cinema como recurso didático no ensino de humanidades. Em um primeiro momento, fazemos uma crítica acerca das práticas mais usuais, levantando o problema se com elas o cinema de fato pensa. Em um segundo momento, a partir da concepção proposta por Gilles Deleuze, propomos encarar o cinema como instaurador de processos mentais através de suas (...) técnicas de enquadramento, decupagem e montagem. Confrontamos a proposta de Deleuze com a de Julio Cabrera para analisar criticamente a relação do pensamento com o cinema. Discutimos teoricamente esta distinção e também apresentamos práticas didáticas possíveis relacionadas a ambos os procedimentos. O artigo procura refletir tanto sobre as teorias quanto as práticas possíveis tendo em vista a relação pensamento e cinema. Palavras-chave: ensino; filosofia do cinema; humanidades; cinema. The possibilities of cinema in humanities teaching Abstract: Traditionally used as an illustration and sensitization of curriculum content, we propose in this article another way of using cinema as a didactic resource in humanities education. At first, we criticize the most common practices, raising the issue of whether cinema really thinks with them. In a second moment, based on the conception proposed by Gilles Deleuze, we propose to face cinema as the instigator of mental processes through its framing, decoupage and editing techniques. We compare Deleuze's proposal with Julio Cabrera's to critically analyze the relationship between thought and cinema. We theoretically discuss this distinction and also present possible didactic practices related to both procedures. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

This reconsideration of Hume’s classic essay “Of Miracles” via the lens of American pragmatist ways of thinking about history and power shifts our attention from Hume’s epistemic concerns about the legitimacy of witnesses and testimony to his distaste for sacred history, his critical stance regarding the social force of revelation, and his disdain for religious authority. To view Hume’s essay both as an articulation of a critical philosophy of history and as an exercise in moral dynamism (social power or, authority, (...) is a result of epistemic transactions), is to intervene in both Hume studies and Contemporary Pragmatism. This paper aims to contribute to the existing literature on normative cognition by providing a lineage explanation of human social norm psychology. This approach builds upon theories of goal-directed behavioral control in the reinforcement learning and control literature, arguing that this form of control defines an important class of intentional normative mental states that are instrumental in nature. I defend the view that great ape capacities for instrumental reasoning and our capacity (or family of capacities) for shared intentionality coadapted to (...) each other and argue that the evolution of this capacity has allowed the representation of social norms and the emergence of our capacity for normative guidance. This thesis focuses on the evolution of human social norm psychology. More precisely, I want to show how the emergence of our distinctive capacity to follow social norms and make social normative judgments is connected to the lineage explanation of our capacity to form shared intentions, and how such capacity is related to a diverse cluster of prototypical moral judgments. I argue that in explaining the evolution of this form of normative cognition we also require an understanding of the developmental (...) trajectory of this capacity. For this purpose, the thesis is organized as follow. In the first chapter, I make some methodological remarks and provide the general overview and plan for the dissertation. In the second chapter, I explain what my explanatory target is and why it matters. On the view I am defending, shared intentional psychology gives rise to a special form of psychology that enables us to engage in social normative thinking. These norms are represented as shared intentional states. Moral psychology, in contrast, is more diverse. For moral judgments define a quite heterogeneous class of mental states—although some moral judgments may involve the representation and execution of norms, certainly not all of them do. I show that although much of our distinctive social norm psychology can be explained within the framework of shared intentionality, moral judgments cannot be unified in the same way. In the third chapter, I provide the baseline of social-cognitive capacities that serve as starting point for my lineage explanation. I argue that hominin social cognition was for a very long period of our evolutionary history essentially a matter of low-level cognitive and motivational processes. On this picture, bottom-up affective processes regulated the social lives of early hominins without requiring any special top-down mechanism of normative thinking such as a capacity for understanding and representing social norms. In the fourth chapter, I argue that human-like social norm psychology evolved as a result of the selective pressures that gave rise to shared intentionality, especially the demands that came from collective hunting. Yet collective hunting was not the whole story of the evolution of shared intentionality, for our capacity to form shared intentional mental states emerged from the interplay between the selective pressures that led to cooperative breeding in humans as well as organized, goal-oriented, collective hunting. Thus, I propose an evo-devo account of shared intentionality and its normative dimension since I argue that explaining the evolution of this particular form of normative thinking crucially depends on information about the developmental trajectory of this capacity. Finally, in the fifth chapter, I focus on how social norms are acquired and how the way we learn them gives rise to some prototypical cluster of moral judgments. Thus, this chapter returns to some of themes and arguments of the first chapter by explaining how the distinction between moral judgments and nonmoral judgments can be culturally transmitted. Peer competition and peer cooperation can be intuitively seen as opposing phenomena. However, depending on multiple factors, they might be complementary. In a population divided into groups, for instance, members of each group may cooperate with their peers in order to compete with neighboring groups. Alternatively, they may compete with their peers as a means of choosing the best cooperative partners and demonstrate that they are reliable cooperative partners. Drawing on recent findings, this study examines whether valence concordant electromyography (EMG) responses can be explained as an unconditional effect of mere stimulus processing or as somatosensory simulation driven by task-dependent processing strategies. While facial EMG over the Corrugator supercilii and the Zygomaticus major was measured, each participant performed two tasks with pictures of album covers. One task was an affective evaluation task and the other was to attribute the album covers to one of five decades. The Embodied Emotion Account (...) predicts that valence concordant EMG is more likely to occur if the task necessitates a somatosensory simulation of the evaluative meaning of stimuli. Results support this prediction with regard to Corrugator supercilii in that valence concordant EMG activity was only present in the affective evaluation task but not in the non-evaluative task. Results for the Zygomaticus major were ambiguous. Our findings are in line with the view that EMG activity is an embodied part of the evaluation process and not a mere physical outcome. (shrink)

Despite journalism’s commitment to ethical principles such as accuracy, humanity and diversity, compliance with the gender perspective in content is still minimal in approximately one hundred countries. This inequality reinforces misperceptions, imbalances, and perceived differences between men and women. To address this situation, from 2010 to 2021, eight Spanish media companies appointed a new editorial position responsible for self-regulating gender equality. This qualitative study focused on 10 journalists who currently exercise or have exercised that job, to detect, describe and propose (...) the implementation of this new professional role. This study suggests that gender editing has advanced equality in parity of sourcing and the presence of women in the opinion sections, but implementation of equality in overall content is more difficult. Gender editors’ daily work is hampered by a lack of management support and an absence of independence in editorial decisions. (shrink)

Resumen El objetivo principal del presente trabajo es analizar la atenuación en los actos asertivos en entrevistas sociolingüísticas a fin de entender cómo se construye la imagen de afiliación en la cultura mexicana. En este trabajo la imagen de afiliación se define como el deseo de ser aceptado por un grupo. Nos interesa determinar si la realización de estos actos asertivos son amenazas eventuales a la imagen social de los informantes y si tienen una función atenuadora. El corpus que se (...) analizó consistió en segmentos seleccionados de 12 entrevistas, 6 de hombres y 6 de mujeres, del corpus oral “El habla de Monterrey–PRESEEA” correspondientes a informantes entre 35 y 54 años que concluyeron sus estudios de licenciatura. El análisis de este corpus oral muestra aspectos importantes, a saber, nos presenta que existen similitudes y diferencias entre los dos grupos pues tanto hombres como mujeres utilizaron la justificación para atenuar su punto de vista. En cuanto a diferencias, las mujeres emplearon más estrategias de atenuación que los hombres. Por otra parte, el análisis de los datos sugiere que la atenuación, como categoría pragmática, contribuye a caracterizar la imagen de afiliación de nuestros informantes. (shrink)

In order to arrive at a coherent understanding ofthe Dialogues as a whole (...) and perhaps also to calm the sense of bafflement which the confrontation with this enigmatical text always provokes, many Hume scholars have taken as a point of departure and clue for unravelling it either one or two of Hume's principal philosophical doctrines or a presumedly unitary view of Hume's philosophy in general. Equipped with one or both of these instruments, they proceed to dissect the arguments of the Dialogues with the intention of determining what Hume's position really is. This task also almost invariably ends by assigning the victory in the dialectical struggle and the representation of the author's 'true' opinions to the character (sometimes even more than one) in whom they are more or less able to find the purest expression ofwhat theyhave previously decided is the kernel oressence ofHume's philosophy. Franco-Ferraz has taken a very different route. For her the key point of the Dialogues lies in the fictional setting in which the theological discussion takes place. She goes on to show that the literary form of the Dialogues is intrinsically connected with its philosophical content so as to serve to elucidate the precise nature ofthe conclusion which is established at the end, in Part XII. In other words, the theatrical structure facilitates a more profound and detailed investigation ofthe problems dealing with the existence and nature of God. El presente artículo tiene como objetivo fundamental explorar la posibilidad de un currículum de la Herstory del Arte, entendiendo por ésta, la visibilidad de las biografías y las contribuciones artísticas de las mujeres. Así pues, por un lado, este estudio aborda cómo deconstruir el currículum oculto, a través de una propuesta de currículum postmoderno que incorpore las her/stories del Arte. Por otro lado, se lleva a cabo un análisis cuantitativo de la presencia o ausencia de las mujeres artistas en el (...) currículum de las materias de Historia del Arte de las diferentes legislaciones españolas hasta desembocar en un estudio basado en el análisis crítico del discurso feminista del currículum de Fundamentos del Arte I y II de bachillerato. Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. Nonprofit organizations (NPOs), are quite complex in terms of organizational structure, diversity at the workplace, as well as motivational mechanisms and values rationality. Nevertheless, from an Organizational Psychology perspective, the systematic analysis of this context is scarce in the literature, particularly regarding conflicts. This qualitative study analyzes types, prevalence and consequences of conflicts in a large NPO organization considering as theoretical framework several consolidated Organizational Psychology theories: Conflict Theory, Social Comparison Theory and the Equity Theory. Conflicts were analyzed taking into (...) account volunteers’ perspective, who has been consistently protagonist on NPOs research, but also considering paid staff’s perspective, as one of the main stakeholders in these organizations, whose relative power has increase in the past decade due the professionalization of the NPO’s sector. Results confirmed the existence of four types of conflicts: task, process, status and relationship conflicts. Relationship conflict is the least reported type, revealing the protection factor that values and engagement with a social aim have on this organizational context. The most relevant finding is the strong difference between paid staff and volunteers in conflict perceptions, showing paid staff, overall, higher levels of conflicts than volunteers. A partir de los manuscritos tardíos de Husserl sobre ética, donde la dimensión afec- tiva de la experiencia del deber es reconocida con un estatus ético pleno, se busca analizar la concepción husserliana del amor como fuente de normatividad ética. Se aborda el amor ético y su distinción frente a las formas naturales e instintivas en las que arraiga, y se examina el tratamiento del mandato ético de amor al prójimo, con énfasis en lo relativo a su extensión universal.

Jorgensen’s dilemma has been analysed from various theoretical angles. However, it is not the aim of this essay to “theorize” but to “experiment” on the above mentioned dilemma; particularly to carry out attempts of deontic reproduction of a logical paradox substituting the value “truth” for the value “validity”. The relevance of the obtained results will be appraised from the point of view of Conte’s paradigm“syntactic validity” vs. “dianoetic validity”.

There are many ways of interpreting the so-called new technologies. One of the most interesting is that which stems from defining them as a social imaginary, and therefore, as collective beliefs, fears and hopes. It is common to attribute to technologies all manner of threats that, founded or not, are real in the measure that the society makes decisions and acts in a way consistent with this conviction.The fears and anxieties of society lead to a consideration of the limits of (...) the human that technologies transgress. Among the figures with which one speaks about these limits there is Frankenstein, the modern Prometheus, which threatens modern fantasies with its deformity. There is, however, another man-made creature that can serve to orient our reflection, the Golem.In 1609, 400 years ago, Rabbi Loew died. He is credited with the creation of a homunculus by combining of secret codes. The problem of the Golem was its imperfect soul made manifest in its lack of speech. Its silent presence was a source of great fear in the community that finally asked to get rid of the creature.These figures of monstrosity, Frankenstein and above all Golem, will help us to make technologies understand from the fear that society projects onto them, and this will lead us to the question concerning the imaginary fears of the technological system. According to a recent survey by the HR Research Institute, as the presence of artificial intelligence (AI) becomes increasingly common in the workplace, HR professionals are worried that the use of recruitment algorithms will lead to a “dehumanization” of the hiring process. Our main goals in this paper are threefold: i) to bring attention to this neglected issue, ii) to clarify what exactly this concern about dehumanization might amount to, and iii) to sketch an argument for why dehumanizing the hiring (...) process is ethically suspect. After distinguishing the use of the term “dehumanization” in this context (i.e., removing the human presence) from its more common meaning in the interdisciplinary field of dehumanization studies (i.e., conceiving of other humans as subhuman), we argue that the use of hiring algorithms may negatively impact the employee-employer relationship. We argue that there are good independent reasons to accept a substantive employee-employer relationship, as well as an applicant-employer relationship, both of which are consistent with a stakeholder theory of corporate obligations. We further argue that dehumanizing the hiring process may negatively impact these relationships because of the difference between the values of human recruiters and the values embedded in recruitment algorithms. Drawing on Nguyen’s (2021) critique of how Twitter “gamifies communication”, we argue that replacing human recruiters with algorithms imports artificial values into the hiring process. We close by briefly considering some ways to potentially mitigate the problems posed by recruitment algorithms, along with the possibility that some difficult trade-offs will need to be made. To explain the evolutionary emergence of uniquely human skills and motivations for cooperation, Tomasello et al. (2012, in Current Anthropology 53(6):673–92) proposed the interdependence hypothesis. The key adaptive context in this account was the obligate collaborative foraging of early human adults. Hawkes (2014, in Human Nature 25(1):28–48), following Hrdy (Mothers and Others, Harvard University Press, 2009), provided an alternative account for the emergence of uniquely human cooperative skills in which the key was early human infants’ attempts to solicit care and (...) attention from adults in a cooperative breeding context. Here we attempt to reconcile these two accounts. Our composite account accepts Hrdy’s and Hawkes’s contention that the extremely early emergence of human infants’ cooperative skills suggests an important role for cooperative breeding as adaptive context, perhaps in early Homo. But our account also insists that human cooperation goes well beyond these nascent skills to include such things as the communicative and cultural conventions, norms, and institutions created by later Homo and early modern humans to deal with adult problems of social coordination. As part of this account we hypothesize how each of the main stages of human ontogeny (infancy, childhood, adolescence) was transformed during evolution both by infants’ cooperative skills “migrating up” in age and by adults’ cooperative skills “migrating down” in age. Interviews, field observations and other qualitative methods are being increasingly used to inform the construction of arguments in normative political theory. This article works to demonstrate the strong salience of some kinds of qualitative material for cosmopolitan arguments to extend distributive boundaries. The incorporation of interviews and related qualitative material can make the moral claims of excluded others more vivid and possibly more difficult to dismiss by advocates of strong priority to compatriots in distributions. Further, it may help to promote (...) the kind of perspective taking that has been associated with actually motivating a willingness to provide aid by individuals. Illustrative findings are presented from field work conducted for a normative project on global citizenship, including interviews with unauthorized immigrants and the analysis of artefacts left behind on heavily used migrant trails. Hume did not criticize Hutcheson’s moral-empirical argument in his published philosophical works, even though he forcefully denied, especially in Parts X and XI of the Dialogues Concerning Natural Religion, that we could empirically prove the moral attributes of the Deity. Yet he seemingly rejected this particular reasoning in a famous letter to Hutcheson, dated March 16, 1740. Hutcheson’s claim that our moral sense is a likely to be expected effect of divine benevolence and Hume’s critique of this claim are analyzed (...) in this essay. It is argued that the particular criticism presented by Hume in that letter is not sufficient to refute Hutcheson’s argument. It is also suggested that Hume may be right after all in rejecting Hutcheson’s inference about God’s benevolent design on other grounds, that is, our deep-rooted knowledge of the annoying conspicuousness of evil in the world. En este artículo se propone un fundacionalismo confiabilista, inspirado en Goldman, aunque con cambios importantes respecto a su teoría. A diferencia de Goldman, considero que no todas las creencias tienen que ser verdaderas, ni toda justificación de las creencias requiere de la verdad. Adicionalmente, las creencias verdaderas, expresadas mediante oraciones asertóricas, estarían fundadas (...) en creencias aún más básicas, cuya justificación proviene del uso del lenguaje. (shrink)

In this paper, we examine how the availability of massive quantities of data i.e., the “Big Data” phenomenon, contributes to the creation, spread, and harms of online misinformation. Specifically, we argue that a factor in the problem of online misinformation is the evolved human instinct to recognize patterns. While the pattern-recognition instinct is a crucial evolutionary adaptation, we argue that in the age of Big Data, these capacities have, unfortunately, rendered us vulnerable. Given the ways in which online media outlets (...) profit from the spread of misinformation by preying on this pattern-finding instinct, we conceptualize the problem that we identify as a morally objectionable form of “epistemic exploitation.” As we argue, the consumer of digital misinformation is often exploited by having her pattern-recognition instinct used against her. This exploitation is morally objectionable because it deprives her of an epistemic good to which she has a right. This epistemic good is the integrity of the pattern-recognition instinct itself which, we argue, is a capacity that allows us to participate in uniquely human goods. While our primary goal is to bring attention to this form of epistemic exploitation, we conclude by briefly evaluating some general solutions to the growing problem of online misinformation. Many normative political theorists have engaged in the systematic collection and/or analysis of empirical data to inform the development of their arguments over the past several decades. Yet, the approach they employ has typically not been treated as a distinctive mode of theorizing. It has been mostly overlooked in surveys of normative political theory methods and methodologies, as well as by those critics who assert that political theory is too abstracted from actual political contestation. Our aim is to unearth this (...) grounded normative theory (GNT) approach – to identify its definitive practices and highlight its potential significance. We detail four overlapping commitments characteristic of GNT. These include commitments to expanding the comprehensiveness of input for normative arguments through original empirical research and/or analysis, recursivity in the development of normative claims, attentiveness to the systematic inclusion of a range of voices and ways of knowing, and accountability to those engaged by the theorist in empirical contexts. We discuss methodological distinctions within GNT, including between more- and less-solidaristic approaches. We discuss how GNT answers calls for theorists to engage more closely with empirical political dynamics and we consider responses to possible critiques. (shrink)
