8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

Pain is a global problem whose social, economic, and psychological costs are immeasurable. It is now seen as the most common reason why people seek medical (including psychiatric) care. But what is pain? This article shows that the discourse of pain tends to suffer from the same problems of ethnocentrism and obscurity as the discourse of emotions in general. Noting that in the case of pain, the costs of miscommunication are particularly high, this article offers a new paradigm for communicating (...) about pain. It shows how the use of natural semantic metalanguage (NSM) techniques developed in linguistic semantics can help in this area, as in other areas concerned with human subjectivity, and can lead to a greater understanding between psychologists, psychiatrists, medical practitioners, social workers, and ordinary suffering mortals. Trope theory is the view that the world consists (wholly or partly) of particular qualities, or tropes. This admittedly thin core assumption leaves plenty of room for variation. Still, most trope theorists agree that their theory is best developed as a one-category theory according to which there is nothing but tropes. Most hold that ‘sameness of property’ should be explained in terms of resembling tropes. And most hold that concrete particulars are made up from tropes in compresence (for an overview, (...) including an introduction to some alternative versions of the view, cf. Maurin, 2014). D. M. Armstrong disagrees. He thinks the world is a world of immanent universals, the thin particulars in which those universals are instantiated, and the states of affairs that—thereby—exist. He holds that ‘sameness of property’ should be explained in terms of numerically identical universals or—if the resembling things are the universals themselves—in terms of partially identical universals. And he believes that concrete particulars are made up from ‘thin particulars’ in which a (sufficient) number of universals are instantiated. In spite of their disagreements, proponents of tropes owe Armstrong a debt of gratitude. First, for being one of the theory’s earliest, most serious, and—not least—most prominent, critics (Armstrong for the first time considers, and rejects, what he then labels ‘particularism’, in his 1978a). But also for being one of the theory’s most ardent champions. Already in his 1989a, Armstrong regrets his 1978-rejection of the view. Equivalence classes of exactly resembling tropes, he now admits, for most purposes “serve as an excellent substitute for universals” (Armstrong 1989a, 122). But then why isn’t Armstrong a trope theorist? In this paper, Armstrong’s main reasons for rejecting the trope view are critically scrutinized. All of them, it is maintained, fail to convince. If this argument is accepted, Armstrong seems to have no—or, at least, no good—reason for not accepting the existence of tropes. But, then, ought Armstrong to have been a trope theorist? If the ‘best’ version of the trope view turns out to be ontologically more parsimonious than Armstrong’s own theory of universals, then, yes. That there is a version of the trope view, a version that is not (or, at least not seriously) considered by Armstrong, that is ontologically more parsimonious than the universals view, is argued in the next section. Why none of Armstrong’s reasons for preferring universals to tropes manage to convince, is explained in the section after that. First, however, and in order to avoid a common misunderstanding of the trope view and, as a consequence, of why one ought to reject it, a few more words about the core-difference between tropes and universals, and about how this difference matters (as well as does not matter) to what—and how well—these theories explain. The debate over the objects of episodic memory has for some time been stalled, with few alternatives to familiar forms of direct and indirect realism being advanced. This paper moves the debate forward by building on insights from the recent psychological literature on memory as a form of episodic hypothetical thought (or mental time travel) and the recent philosophical literature on relationalist and representationalist approaches to perception. The former suggests that an adequate account of the objects of episodic memory will (...) have to be a special case of an account of the objects of episodic hypothetical thought more generally. The latter suggests that an adequate account of the objects of episodic hypothetical thought will have to combine features of direct realism and representationalism. Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. Este artículo analiza una fotografía de Fidel Castro que es muy lejana a la etapa épica del guerrillero, pero que forma parte de la iconografía en torno a este personaje. Se trata de un retrato de Fidel a los tres años, tomado en Birán, en 1929, estudiado con el objeto de comprender los intereses y las inten ciones alrededor de su producción, así como los usos actuales de esa misma imagen. Partiendo de la consideración de la fotografía como una práctica (...) social y cultural que integra significados, ella debe ser incorporada en el estudio de la historia como un documento que permite aportar información de sus contextos de producción y reproducción. A partir de estas consideraciones, se pudo observar el significado de la representación iconográfica de Fidel a los tres años, quien fue fotografiado utilizando convenciones que resaltaban las favorables condiciones económicas de las que gozaba la familia Castro Ruz, sin embargo, la investigación revela que se le han añadido significados en sus posteriores usos, producto de intereses políticos en torno a la trayectoria guerrillera de Fidel. The article is devoted to the analysis of the key directions of the study of the possible influence of the specifics of Chinese language culture on the content and nature of intellectual discourse, which is recognized as philosophical. Logic and ontology are the key areas of analysis of the possible influence of linguistic determinants on the intellectual discourse of China. Three main topics that attract the attention of researchers are the (...) structure of judgment, the semantics of lexical units, and the specificity of the pragmatics of the Chinese language. M e t h o d s. The author applied general scientific methods of analysis, synthesis, comparison and description of the works of researchers of Chinese philosophy, which justify and argue the fruitfulness of studying the peculiarities of Chinese language to explain the reasons of the fundamental difference between the problems actualized in the history of Chinese philosophy and those that formed the basis of the development of the history of philosophy in the Western world. R e s u l t s. It is generally accepted that for the worldview of representatives of Chinese culture, the world is a structural whole, consisting of elements that continuously interact in the dynamics of changes and transformations, we find a reflection of this feature in the semantics of the corresponding symbolic system. Polysemy in the Chinese language mostly reveals a complex and multi-layered "web" of associative and correlative connections between meanings, which in fact cannot be argued outside the context of the relevant cultural tradition indicating common features or similarities of the signified. The doubt about the typicality of understanding the denotations as fixed and atomized for the Chinese language culture is reasonable, even in those cases when it comes to the designation of empirically accessible objectivity. The main specific features of polysemy in the Chinese language are the complete heterogeneity of what is signified, and the lack of transparent grounds for identifying the genus-species subordination of the scope of general concepts. This can also serve as an explanation for the fact that we do not find a completely obvious and nondisputable analogue of the problem of universals of the Western model in the history of Chinese philosophy. C o n c l u s i o n s. Based on the peculiarities of the Chinese language culture, we can recognize as a reasonable a statement that the seemingly natural understanding of the essence – the subject, as something that remains the same (at least for a certain time), but it undergoes some changes through its manifestations – a predicate (properties and actions). It is not as necessary and axiomatic for Chinese thinkers as, for example, for ancient Greek philosophers. In addition, we can recognize the fact that the verb "to exist" does not fulfill the role of a necessary copula in judgments in the Chinese language, as a probable reason for the lack of fundamental problematization of the concept of "being" in the Chinese history of philosophy. In general, the context of the use of a certain word-sign in the Chinese language plays a determining role. The actualization of one or another meaning in an expression is formed not only by its integration into a certain text, but also by its purpose in accordance with the specific practice of application. Therefore, this can serve as an explanation for the absence of an original and axiomatic interpretation of truth as absolute, that is, unchanging and non-relative in the history of Chinese philosophy. This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions. Incluso el mismo autor puede ofrecer más de una definición de lo que entiende por argumentación; en parte, porque el problema de la argumentación no se circunscribe a un solo ámbito, ni del conocimiento ni de la vida práctica.

Mit den Fortschritten in Generativer Künstlicher Intelligenz, Large Language Models, Brain-Computer Interfaces und genetischen Eingriffen gewinnt auch der Transhumanismus an Relevanz. Der Transhumanismus ist ein beliebtes Thema der Medien und wird in Tages- und Wochenzeitungen sowie im Fernsehen gerne aufgegriffen. Außerdem gibt es inzwischen viele Filme, die den Transhumanismus thematisieren, z. B. die Dokumentation „Endlich unendlich“ (2021, Regie: Stephan Bergmann). Der Transhumanismus wurde in Österreich auch Gegenstand einer Verschwörungserzählung, über die der Bayrische Rundfunk aufgeklärt hat. Auf den Wahlplakaten der „Partei (...) für Gesundheitsforschung“ ist der Transhumanist Aubrey de Grey abgebildet, der ein in Cambridge lebender Brite ist, aber auf Plakaten in Deutschland dargestellt wird. Diese und weitere Entwicklungen machen es notwendig, sich mit dem Transhumanismus aus wissenschaftlicher Perspektive auseinanderzusetzen. Was ist der Transhumanismus? Alle sprechen von Transhumanismus, aber was der Transhumanismus letztlich ist, bleibt häufig unklar. Der Transhumanismus (TH) ist eine philosophisch-technologische Bewegung des 20. und 21. Jahrhunderts, die es sich zum Ziel setzt, mittels neuer Technologien den Menschen grundlegend zu transformieren. Wichtig ist dabei, dass sich der TH nicht mit den Optimierungsbestrebungen in der Gesellschaft oder technologischem Fortschritt gleichsetzen lässt. Vielmehr verstehe ich unter TH die Gruppe, die sich um die Organisation Humanity+ in Kalifornien versammelt und die Personen, die sich explizit alsVertreter*innen des TH verstehen. Der TH hat eine ganz eigene Agenda, eigene Institutionen, Organisationen und Publikationsorgane.4 Zu den Themen und Visionen gehören die Lebensverlängerung von mehreren Hundert Jahren bis zur Unsterblichkeit, Kryonik (das Einfrieren des Körpers, der wieder aufgetaut werden soll, wenn nach transhumanistischer Vorstellung Unsterblichkeit ermöglicht werden kann), umfassendes Enhancement und die Verschmelzung von Körper und Technik sowie Beseitigung allen Leids, aller Krankheiten und Aufhebung des Alterns. Der TH strebt danach, mittels Technik neue Sinnesfähigkeiten zu erlangen und neue (virtuelle) Erfahrungswelten zu erschließen. Außerdem wird von vielen Transhumanist*innen auch die hochspekulative Vision des Mind Uploading vertreten, die streng genommen dem Posthumanismus zugeordnet werden muss Gemäß dieser Vision soll durch das maschinelle Lesen des Gehirns der ganze Mensch auf ein externes Medium hochgeladen werden können. Die Vision des Mind Uploadings ist aus naturwissenschaftlicher Perspektive hochumstritten, ist aber ein sehr beliebtes Motiv, das auch außerhalb des TH Wirkung zeigt und in viele Science-Fiction- Filme Eingang gefunden hat (z.B. die Amazon Serie „Upload“, 2020, Regie: Greg Daniels). Das Bestreben des TH, den Menschen grundlegend zu transformieren, wirft zunächst die Frage auf, wie der TH den Menschen überhaupt versteht. Dieser Frage nach dem Menschenverständnis des TH habe ich mich in meinem Buch „Über-Menschen. Philosophische Auseinandersetzung mit der Anthropologie des Transhumanismus“ gewidmet. Philosophische Anthropologie bezeichnet die wissenschaftlichen, philosophischen Reflexionen auf den Menschen. Welches Menschenverständnis vertritt der TH und lässt sich unsere Anthropologie auf dieser Grundlage weiterentwickeln? Das Buch gliedert sich in drei Teile: Teil 1 führt zuerst in die Bewegung des TH ein, worauf Teil II aufbaut, der sich mit dem Menschenverständnis des TH beschäftigt. Teil III betrachtet schließlich heutige Optimierungsbestrebungen in der Gesellschaft sowie neue Ansätze für die Technikanthropologie (z. B. Kritischer Posthumanismus und Neuer Materialismus). Die nachfolgenden Kapitel dieses Aufsatzes sind ein Ausschnitt aus Teil II, der Untersuchung des transhumanistischen Menschenverständnisses. Dieser Aufsatz widmet sich dem „genetisch codierten Menschen“ im TH, also der transhumanistischen Sicht auf den Menschen als jemanden, die*der vollständig von ihren*seinen Genen bestimmt ist. Der genetische Diskurs ist nur einer von fünf im TH dominanten Diskursen, die das transhumanistische Menschenverständnis ausmachen. Zu den anderen Diskursen bzw. transhumanistischen Bestimmungen des Menschen gehören: der Diskurs um die „Natur des Menschen“, der Maschinendiskurs – die Bestimmung des Menschen als Maschine –, der neurowissenschaftliche Diskurs – die Gleichsetzung des Menschen mit dem Gehirn bzw. Neuronalem und zuletzt die metaphysischen Verhältnisbestimmungen von Geist und Körper (PUZIO, Über-Menschen, Kap. 4). Diese transhumanistischen Bestimmungen des Menschen werden am Ende ausgewertet. Ohne die Ergebnisse dieses Kapitels im Detail vorwegnehmen zu wollen, kann für die Gesamtuntersuchung des TH gesagt werden, dass das transhumanistische Menschenverständnis sich als hochproblematisch erweist. Die transhumanistischen Argumentationsstrukturen sind nicht tragfähig und der TH behauptet sich auf die Naturwissenschaften zu berufen, widerspricht allerdings den aktuellen Ergebnissen der Naturwissenschaften. Dies wird in den nachfolgenden Kapiteln gut deutlich werden. Der TH hat ein reduktionistisches Menschenverständnis und reduziert den Menschen beispielsweise auf „Information“. Viele Ausführungen sind diskriminierend z. B. gegenüber Kranken, Alternden und Menschen mit Behinderungen und letztendlich wird sogar jeder Mensch, auch der gesunde junge Mensch, gegenüber der Maschine abgewertet, die aus transhumanistischer Sicht den Menschen weit übertrifft. Im weiteren Verlauf der Arbeit werden sogar „ideologische Elemente“ im TH identifiziert. Daher wird in der Arbeit abgelehnt, den TH als Grundlage für die Weiterentwicklung der Anthropologie zu verwenden und stattdessen werden im letzten Teil der Arbeit alternative Ansätze für die Technikanthropologie präsentiert. Wie bereits erwähnt, richtet sich die Kritik am TH jedoch nicht gegen die heutige Optimierung in der Gesellschaft, die ebenfalls im letzten Teil der Arbeit diskutiert wird. Optimierungsbestrebungen hat es schon immer gegeben und sie werden nun durch neue Technologien weiter verändert, sie sind aber nicht mit der Bewegung des TH gleichzusetzen. Das Kapitel ist eingebettet zwischen dem Maschinendiskurs (Mensch als Maschine) mit seinen Ausführungen zu Information und Kybernetik und dem neurowissenschaftlichen Diskurs („Der Mensch ist ihr*sein Gehirn“). Es wird im Folgenden der genetische Diskurs im TH untersucht, also wie der TH den Menschen vollständig auf Gene zurückführt, und dies schließlich kritisch geprüft. Sind „gute Gene“ alles? Kann der Mensch vollständig über ihre*seine Gene bestimmt werden? Und was hat es mit der trügerischen „genetischen Information“ auf sich? Zunächst wird der genetische Diskurs im TH dargestellt, also die genetischen Ausführungen des TH präsentiert (Kap. 2), danach wird der Blick auf den Gebrauch der genetischen Metaphern im TH gerichtet (Kap. 3) und zuletzt werden die genetischen Vorstellungen des TH kritisiert (Kap. 4). Der Aufsatz schließt in Kap. 5mit einer (vorläufigen) Zusammenführung der Ergebnisse und einem Ausblick. (shrink)

In this paper art history and visual studies, the disciplines that study visual culture, are presented as a field whose conjectural paradigm can be used to understand the epistemic problems associated with abduction. In order to do so, significant statements, concepts and arguments from the work of several specialists in this field have been highlighted. Imaginatio creatrix inspires us to fabulate these facts into events and plots with personal significance attempting to delineate a life-course in life-stories within the ever-flowing stream – existence. Seeking their deep motivations, causes and concatenations, we fabulate relatively stabilized networks of interconnecting meaning – history. But to understand the meaning and sense of these networks’ reconfigurations call for the purpose and (...) telos of our endless undertaking; they remain always incomplete, carried onwards with the current of life, while fluctuating with personal experience in the play of memory. Facts and life stories, subjective desires and propensities, the circumambient world in its historical moves, creative logos and mythos, personal freedom and inward stirrings thrown in an enigmatic interplay, prompt our imperative thirst for the meaning of this course, its purpose and its fulfillment – the sense of it all. To disentangle all this animates the passions of the literary genius. The focus of this collection is to isolate the main arteries running through the intermingled forces prompting our quest to endow life with meaning. The philosophical debate around the nature of moods has mostly focused on their apparent undirectedness: unlike mental states such as perceptual experiences, thoughts, and emotions, moods do not seem to be directed at any specific object, and indeed they do not seem to be directed at anything at all. In this paper, I want to draw attention to a different feature of moods, one that is as important and in need of explanation as their apparent undirectedness, but which has been (...) overlooked by most participants in the debate: the fact that moods involve a particularly marked salience of the subjective aspect of experience. I argue that any adequate theory of moods should account for this fact. I call this the “subjective salience desideratum.” In the bulk of the paper, I articulate and motivate the desideratum, show that extant theories of moods do not satisfy it, and offer a preliminary overview of possible (yet unexplored) theories that have the subjective salience desideratum at their core. On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either point to a relevant difference between factors like (...) moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

In this article, I focus on the work of the Movement of Victims of State Crimes in Colombia. The work of Movice, I suggest, is an example of how the category of “victim” from international law discourse is adopted and used from below by victims of mass atrocities. I show that, through this category, Movice attempts to introduce an alternative narrative of the internal armed conflict in which the state is a perpetrator of violence against civilian population as part of (...) a practice of elimination of political opposition through violent means. To do this, I focus on three political opportunities in which Movice deployed the category of victim between 2005 and 2016. I suggest that Movice is an example of how a movement of victims can adopt categories of international law to frame their struggles and, in doing so, infuse them with new contents. (shrink)

Based on his Inclosure Schema and the Principle of Uniform Solution (PUS), Priest has argued that Curry’s paradox belongs to a different family of paradoxes than the Liar. Pleitz (2015, The Logica Yearbook 2014, pp. 233–248) argued that Curry’s paradox shares the same structure as the other paradoxes and proposed a scheme of which the Inclosure Schema is a particular case and he criticizes Priest’s position by pointing out that applying the PUS implies the use of a paraconsistent logic that (...) does not validate Contraction, but that this can hardly seen as uniform. In this paper, we will develop some further reasons to defend Pleitz’ thesis that Curry’s paradox belongs to the same family as the rest of the self-referential paradoxes & using the idea that conditionals are generalized negations. However, we will not follow Pleitz in considering doubtful that there is a uniform solution for the paradoxes in a paraconsistent spirit. We will argue that the paraconsistent strategies can be seen as special cases of the strategy of restricting Detachment and that the latter uniformly blocks all the connective-involving self-referential paradoxes, including Curry’s. Quoting Flaubert through time, Mieke Bal and Michelle Williams Gamaker’s Madame B brings Madame Bovary’s reflections on love and emotions to the present day, in a productive anachronism. Their work produces an intertemporal space where the past is relevant for the present, and the present enables us to understand the past. Intimacy and routine are central in their exploration of Flaubert’s contemporaneity. Those issues are precisely one of the keys in Karl Ove Knausgård’s project of literary autobiography, where he expands (...) narration foreclosing the ellipsis and giving visibility to small things and emotions; a project with some resonances with Munch’s crude-obscene uses of intimacy. This essay explores how both proposals, Bal and Williams Gamaker in film, and Knausgård in literature, can serve us to connect present and past sensibilities and, more than that, demonstrate resistances to the hegemonic discourses of temporality. Most recent philosophical theories of consciousness account for it in terms of representation, the bulk of the debate revolving around whether (suitably) representing something is sufficient for consciousness (as per first-order representationalism) or some further (meta-)representation is needed (as per higher-order representationalism and self-representationalism). In this paper, I explore an alternative theory of consciousness, one that aims to explain consciousness not in terms of representation but in terms of the epistemically and metaphysically direct relation of acquaintance. I call this the (...) Inner Acquaintance Theory of consciousness (IAT). Roughly, on IAT, what makes a mental state conscious is its subject being acquainted with it. Though not wholly unprecedented, IAT is still at the fringe of consciousness debates and remains largely underexplored. The main goal of this paper is to take some steps toward developing the details of IAT, illustrate its potential explanatory power, and put it forward as a plausible alternative to representational theories, with the hope that this will contribute to shifting IAT closer to the center of the debate. Here is how I proceed. In §2 I introduce a notion—inner awareness—that is crucial both to contextualize and to understand IAT. In §3 I provide some preliminary motivation for exploring IAT. In §4 I explain the notion of acquaintance and illustrate some of the features that are typically attributed to it in the literature. The details of IAT are then shaped through four main decision points. I address them in §§5-8, where I suggest a particular choice at each decision point, thereby progressively building up a view that I consider particularly promising. (shrink)

This paper explores the relationship between a prominent version of the relational view of memory and recent work on forms of unsuccessful remembering or memory errors. I argue that unsuccessful remembering poses an important challenge for the relational view. Unsuccessful remembering can be divided into two kinds: misremembering and confabulating. I discuss each of these cases in light of a recent relational account, according to which remembering is characterized by an experiential relation to past events, and I argue that experiential (...) relations do not adequately distinguish between remembering and unsuccessful remembering. This is because there are, on the one hand, cases of remembering that do not instantiate the relevant experiential relations, and, on the other hand, cases of confabulation and misremembering that do instantiate the relevant experiential relations. I conclude by suggesting that any successful relationalist attempt to explain remembering needs to come to grips with unsuccessful remembering. (shrink)

This article presents the development, validation and application of an instrument to measure everyday moral distress in different health care settings. The concept of moral distress has been discussed and developed over 20 years. A few instruments have been developed to measure it, predominantly in nursing. The instrument presented here consists of two factors: level of moral distress, and tolerance/openness towards moral dilemmas. It was tested in four medical departments and three pharmacies, where 259 staff members completed a questionnaire. The (...) two factors were found to be reliable. Differences in levels of moral distress were found between pharmacies and clinical departments, and between the youngest and oldest age groups; departmental staff and the youngest group experienced higher levels of moral distress. Departments reported less tolerance/openness towards moral dilemmas than pharmacies. The instrument needs to be tested further, but its strengths are the focus on everyday ethical dilemmas and its usefulness in different health care settings. (shrink)

For most people, animals are the most significant aspects of the nonhuman world. They symbolize nature in our imaginations, in popular media and culture, and in campaigns to preserve wilderness, yet scholars habitually treat animals and the environment as mutually exclusive objects of concern. Conducting the first examination of animals' place in popular and scholarly thinking about nature, Anna L. Peterson builds a nature ethic that conceives of nonhuman animals as active subjects who are simultaneously parts of both nature (...) and human society. Peterson explores the tensions between humans and animals, nature and culture, animals and nature, and domesticity and wildness. She uses our intimate connections with companion animals to examine nature more broadly. Companion animals are liminal creatures straddling the boundary between human society and wilderness, revealing much about the mutually constitutive relationships binding humans and nature together. Through her paradigm-shifting reflections, Peterson disrupts the artificial boundaries between two seemingly distinct categories, underscoring their fluid and continuous character. (shrink)

This article locates a theoretical reflection on the form of legal subjectivity against twenty-first century complexities and pressures, including the structural complexities visible in biotechnological developments, new hybridities and numerous contemporary theoretical and practical manifestations of heterogeneity, multiplicity and complexity emerging in a range of disciplines, including cybernetics, techno-theory, post-humanism and ecology. The author defends the theoretical and critical utility of understanding the legal subject as an explicit (and explicitly limited ) constructus . Criticising the constructed naturalism (and the historical (...) and contemporary exclusions) of the 'human being' of law, the author suggests that the language and concept of the 'legal entity' (rather than that of the 'legal person') draws attention to the patterned 'gap' between law and life (and to related injustices enacted by the form of the materialisation of legal subjectivity) while simultaneously providing the degree of theoretical plasticity now required by the mutable complexities of the twenty-first century and beyond. Both fostered critical thinking, intertwining in nuanced ways. Socinianism’s theological skepticism questioned established beliefs, while Tacitism scrutinized historical and political accounts. Their controversial nature resulted in covert existence among elite intellectuals, shaping socio-political discourse. Socinianism’s theological nonconformity, akin to Tacitism’s critique of traditional political narratives, often sparked conflicts with authorities, revealing the intricate (...) relationship between religion and politics in the Early Modern Era and influencing the development of secular thought. La profesión de carpintero de ribera, sus técnicas, las herramientas utilizadas, los productos finales: los barcos, así como los conocimientos necesarios para su fabricación forman parte del patrimonio cultural marítimo universal. La construcción en madera es un oficio milenario que está en peligro de desaparición, y con ella uno de los elementos identitarios más importantes de las regiones costeras europeas. La escasa historiografía académica sobre los carpinteros de ribera como protagonistas es el principal motivo de este trabajo, que se adentra (...) en sus raíces, dando a conocer algunos de los aspectos más relevantes que definen e identifican la importancia del tema, como las principales actividades desarrolladas, su contextualización histórica, las técnicas, herramientas y la lengua franca marinera que compartían. Por ello, el fin último es proporcionar una fuente de referencia a quiénes apuesten, tanto de manera teórica como práctica, por la recuperación y la conservación de esta profesión ancestral sobre la que apenas existe información e investigación. Se concluye que la recuperación y gestión de este patrimonio, con vinculaciones amplias con otras actividades relacionadas, puede abrir perspectivas de consolidación patrimonial y económica en espacios marítimos poco desarrollados, ya que puede servir para sentar las bases de un futuro turismo cultural en el que estas técnicas sean protagonistas y sirvan para potenciar la identidad marítima en las regiones litorales. Both Novalis and Günderrode provide grounds for a number of different kinds of hope. The first part of this chapter briefly sketches the most obvious of these: the hope for union with loved ones after death. This section also explains Günderrode’s metaphysics, which entails significant differences from Novalis in the other areas of hope that she identifies. Part two explores “epistemological hope”: the hope for knowledge or experience of that which lies outside the limitations of reason. Part three considers Günderrode’s (...) “moral hope,” which emerges from her critique of Kantian morality. Finally, parts four and five consider “political hope” and “ontological hope,” i.e., hope for improvement in the world as a whole and human society in particular. For Novalis, this famously takes the form of “raising,” “Romanticizing” or “cultivating,” effected by human beings. In Günderrode, this kind of improvement is largely beyond human control (although human beings can contribute to it), leaving us in a state of hopeful ambiguity regarding the possibility of the eventual realization of an “immortal ideal” for the earth and the establishment of ideal human communities. According to Johansson (2009: 22) an infinite regress is vicious just in case “what comes first [in the regress-order] is for its definition dependent on what comes afterwards.” Given a few qualifications (to be spelled out below (section 3)), I agree. Again according to Johansson (ibid.), one of the consequences of accepting this way of distinguishing vicious from benign regresses is that the so-called Russellian Resemblance Regress (RRR), if generated in a one-category trope-theoretical framework, is vicious and that, therefore, the (...) existence of tropes only makes sense if trope-theory is understood (minimally) as a two-category theory which accepts, besides the existence of tropes, also the existence of at least one universal: resemblance.1 I disagree. But how can that be? How can Johansson and I agree about what distinguishes a vicious from a benign regress, yet disagree about which regresses are vicious and which are benign? In this paper I attempt to answer that question by first setting out and defending the sense of viciousness which both Johansson and I accept, only to then argue that to be able to determine if a particular regress is vicious in this sense, more than features intrinsic to the regress itself must be taken into account. This is why, although the RRR as originally set out by Russell is vicious, the seemingly identical resemblance regress which ensues in a one-category (standard) trope-theoretical context is not (provided, that is, that we accept certain views about how the nature of tropes relates to the resemblance between tropes, and given that we set our theory in a truthmaker theoretical framework – all of which are standard assumptions for proponents of (the standard-version of) the trope-theory).2. Background Migrant live-in care workers are a main pillar of long-term care in many countries, including Germany. Several studies examining their working and living conditions reveal serious problems. However, a key element of live-in arrangements, namely the relationship between the individuals involved, has not yet been systematically investigated from an ethical perspective. Aim Building on previous socioempirical work that explored and set out the meaning of “care networks”, we start from the premise that live-ins are embedded in a network of (...) relationships which are essential for their employment and living situation. Methods The theoretical analysis draws on a network approach that takes care–ethical considerations into account. Using Joan Tronto’s four care–ethical phases, existing dependencies are described and reflected upon using the corresponding four care–ethical dimensions. The central questions are how dependencies in the live-in arrangement can be characterised based on the existing body of empirical studies and with a focus on the elements of power, dependency and trust in the ethical reflection on care. Results Based on this analysis, it becomes apparent that the ambivalence resulting from the simultaneity of different forms of asymmetry and mutual dependence is omnipresent in live-in arrangements and gives rise to seemingly contradictory forms of relationships and emotions. Responsibilities are vague and are constantly renegotiated on the basis of implicit assumptions and problematic role expectations and are also assigned without negotiation. Conclusions In the future, it will not only be necessary to better understand and clarify responsibilities at the micro level of the individual care arrangement from the various positions and roles and with a view to the changing processes of caring for another, but also to address the pressing ethical questions and problems in live-in arrangements at the meso and macro levels—enriched by care–ethical perspectives. Einrichtungen der Altenpflege weisen spezifische ethische Spannungsfelder und ethische Fragestellungen auf. Das Strukturinstrument EMMA (Ethik Multiprofessionell Methodisch Anwenden) zur Moderation einer Ethik-Fallberatung wurde für den Einsatz in Einrichtungen der Altenpflege konzipiert. Inhaltlich werden die Besonderheiten dieses Settings unter Bezugnahme auf den Schlüsselbegriff Privatheit in den Mittelpunkt gestellt. EMMA eignet sich aufgrund seiner Kontextsensitivität darüber hinaus zum Einsatz in der Ethik-Fallberatung in unterschiedlichen außerklinischen Settings.
