Duty of care is the core ethical responsibility of healthcare workers. Getting the workforce vaccinated will provide safety to the public, protect the vulnerable population and provide a safe working environment. While most agree that healthcare workers should be prioritised in the vaccination programme, mandatory vaccination remains a complicated and contentious issue with political, legal and ethical dimensions. This study aims to determine the ethical considerations associated with mandatory vaccinations among healthcare workers. A total of 152 abstracts were identified of (...) which, 142 were excluded based on abstracts because they did not meet the inclusion criteria. The remaining ten articles were further evaluated with three articles that fit the inclusion criteria specifically discussing mandatory vaccination among healthcare workers and the ethical issues. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were used as a framework to discuss the ethical considerations which resonated both directly from the included papers, as well as more generally from the other literature associated with this search. There is limited literature on the topic of ethical considerations associated with COVID-19 mandatory vaccination of healthcare workers, as a systematic review identified only 3 papers. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were among the seven ethical considerations identified and discussed. (shrink)

BackgroundThe COVID-19 pandemic has presented extraordinary challenges to worldwide healthcare systems, however, prevalence remains low in some countries. While the challenges of conducting research in high-prevalence countries are well published, there is a paucity from low COVID-19 countries.MethodsA PRISMA guided systematic review was conducted using the databases Ovid-Medline, Embase, Scopus and Web of Science to identify relevant articles discussing ethical issues relating to research in low prevalence COVID-19 countries.ResultsThe search yielded 133 original articles of which only 2 fit the inclusion (...) criteria and aim, with neither specific to low prevalence. Most of the available literature focused on clinical management and resource allocation related to high prevalence countries. These results will be discussed under the ethical dimensions of equity, individual liberty, privacy and confidentiality, proportionality, public protection, provision of care, reciprocity, stewardship and trust..ConclusionsA systematic review failed to identify articles relating to COVID-19 research ethics, specific to low prevalence countries. It shows that there is a significant gap in the literature that warrants further investigation. Common ethical principles were used to present a distinct set of challenges experienced by a country with a low prevalence of COVID-19. This unique perspective of some of the common ethical problems surrounding research, may help guide further discussion and guide research in similar countries. (shrink)

State and international laws have often been instruments of oppression against Indigenous peoples, enabling and casting a veil of legitimacy over state actions that dispossess, assimilate, and discriminate. In the contemporary setting such law has, at times, come to be harnessed to support or protect Indigenous interests, including addressing Indigenous health deficits and associated injustices.

This article explores the claim that law is characteristically in search of the past. We argue that the structure of memory defines our relationship with the past and this relationship, in turn, has important implications for the nature of law. The article begins by examining the structure of memory, drawing particularly on the work of Henri Bergson. It then draws out the implications of Bergson’s theory for the interplay of past and present, highlighting the challenges this poses for law’s project (...) of retrieval. Law, as an artifact, seeks its origins in human action, but this often yields a static view of legal discourse as the retrieval of pivotal moments. Bergson, by contrast, shows us that past and present influence each other dynamically, giving rise to an integrated whole. The article concludes by exploring the potential for law to transcend the structure of memory. We argue that even beyond the limits of memory legal reasoning encounters a kind of residue left by the ethical foundations of law. Law searches vainly for the past, but what it finds is itself. This volume, edited by three leading proponents and practitioners of human science psychology, serves as an invitation to readers new to this approach while also renewing that invitation to those who have long embraced and advanced research in the field from this perspective. It is a timely and important invitation. In 2009, the American Psychological Association declared psychology to be a core STEM (science, technology, engineering, mathematics) discipline and advocated the teaching and practice of psychology with this natural science understanding (...) in mind, but in 2014 further reaffirmed alternative methods by adding a new journal, Qualitative Psychology. The varied essays in this volume, certainly, bolster the view that a purely STEM-centered vision would ignore much about the very experience of being human.In fact, it would be dangerous to rely solely on the methods of the natural sciences to study human beings, who operate in the realm of meanings, lived experience, and complex and complicated relationships with self and others. We create societies and belief systems, orient ourselves in time, experience beauty and pain. The Qualitative Vision for Psychology: An Invitation to a Human Science Approach argues that because we have aspects that are distinctly and uniquely human -- we are not rats, hydrogen, or rocks, for example -- this necessitates a distinctly human science, one that regards persons as humans rather than objects of study. The laws and formulas of the natural sciences simply do not take into account that particularly human way of being in the world.There are few comprehensive books on psychology conceived as a human science, even though it has a long history with roots in phenomenology, existentialism, psychoanalysis, humanistic psychology, and hermeneutics. In recent years, as these essays discuss, the field has been transformed through its contact with feminism, critical historical analysis, and deconstruction, and it has continued to examine new challenges. Further, we see here its specific applicability to issues as diverse as empathy, cultural history, apartheid, sexual assault, fetishes, and our natural environment. (shrink)

Emily Elizabeth Constance Jones was an English logician and contemporary of Bertrand Russell, as well as Mistress of Girton College, Cambridge. In this book, originally published in 1911, she argues for the existence of another fundamental law of thought to join the Law of Contradiction and the Law of Excluded Middle: the Law of Significant Assertion. This book will be of value to anyone with an interest in logic or in Jones' work.

Even in the Netherlands, where the practice of physician-assisted death (PAD) has been legalized for over 20 years, there is no such thing as a ‘right to die’. Especially patients with extraordinary requests, such as a wish for PAD based on psychiatric suffering, advanced dementia, or (a limited number of) multiple geriatric syndromes, encounter barriers in access to PAD. In this paper, we discuss whether these barriers can be justified in the context of the Dutch situation where PAD is legally (...) permitted for those who suffer unbearably and hopelessly as a result of medical conditions. Furthermore, we explore whether there are options to address some of the barriers or their consequences, both within the Dutch legal framework or by adjusting the legal framework, and whether these options are feasible. We conclude that although there are insufficient arguments to overrule the doctor’s freedom of conscience in the Netherlands, there are ways to address some of the barriers, mainly by offering support to doctors that would be willing to support a request. Moreover, we believe it is morally required to reduce or mitigate where possible the negative consequences of the barriers for patients, such as the long waiting time for those who suffer from psychiatric disorders, because it is unlikely the adjustments suggested to the system will ensure reasonable access for these patient groups. In “On the Nature of Logical Judgment” (published 1893) and A New Law of Thought and Its Logical Bearings (published 1911), E. E. Constance Jones developed a view on which we can think and talk about the round-square. On her view, the round-square has a kind of existence; otherwise, sentences about it wouldn’t be meaningful. But it doesn’t exist in space, since it’s both round and square, and nothing in space is both. Although it has a kind of existence (...) in what she calls “a Region of Supposition,” we can truly say that it “doesn’t exist,” if what we mean is that it doesn’t exist in space. It plays a role in reasoning, since we need to be able to reason about it to conclude that it doesn’t exist in space. And, although the round-square is both round and square, the Law of Contradiction needn’t be violated, provided that it’s understood in light of Jones’s distinction between two kinds of negation. We point out that the acceptance of the relativity principle together with the homogeneity and isotropy of space and the homogeneity of time inevitably leads to the Lorentz spacetime transformation with a universal limiting speed σ. Speculations on possible new four-dimensional symmetries involving a variable “speed of light” such as that proposed by Hsu must therefore be dismissed on such a basis alone. In this paper we draw attention to some logical inconsistencies in Hsu's attempt at establishing a new space-light (...) transformation law, and follow with a discussion on why such an attempt must necessarily fail. This paper presents an Anscombian alternative to the traditional deontic conception of ought. According to the Anscombian conception of ought developed here, ought is general as opposed to ‘peculiarly moral’, norm-referring instead of law- or obligation-referring, and ‘heroic’ in the sense that it does not presuppose that individuals can do or be as they ought. Its connection to matters of fact can, moreover, be clearly stated. In the first part of the paper, I describe some significant logical characteristics of this (...) conception, and argue that it provides a more suitable account of the oughts of ethics as compared to the deontic conception. One particular strength of the Anscombian conception of ought is that it does justice to the possibility of tragedy in human life, where tragedy is understood as the possibility that a thoroughly well-intentioned individual might sometimes ensure her own moral imperfection, precisely by doing what is morally right or best at every step along the way. To motivate this feature of the view, I sketch a corresponding picture of responsibility for actions in terms of ownership of one’s deeds. This conception of responsibility allows that what one ought to do is not always constrained by what one can do, while saving the intuitions about fairness and the practical scope of moral norms that principally motivate ‘ought implies can’. In this issue, Constance Kassor describes Gorampa's attitude to contradictions as they occur in various contexts of Buddhist pursuit. We agree with much of what she says; with some things we do not.First, some preliminary comments, and a fundamental disagreement. Kassor says:Based on . . . [the assumption that Nāgārjuna has a coherent system of thought] one must resolve apparent contradictions in Nāgārjuna's texts in order to maintain the coherency of his logic. The problem with contradictions is that if (...) they are introduced into a classical logical system, that entire system can break down. From the early days of philosophy, ethics and justice, there is wide consensus that the constancy of the laws establishes the legal system. On the other hand, the rate at which we accumulate knowledge is gaining speed like never before. Due to the recently increased attention of academics to climate change and other environmental issues, a lot of new knowledge has been obtained about carbon management, its role in nature and mechanisms regarding the formation and degradation of organic matter. A (...) multidisciplinary techno-economic assessment of current composting standards and laws that took into account the current state of knowledge about carbon management was carried out as a case study. Economic and environmental damage caused by outdated laws was revealed. In addition, it was found that the introduction of the best composts into the market is permitted, causing additional negative environmental as well as economic impacts. (shrink)

The Parmenides is notorious for the criticisms it directs against Plato's own Theory of Forms, as presented in the middle period. But the second and major portion of the dialogue has generally been avoided, despite its being offered as Plato's response to the problems; the text seems intractably obscure, appearing to consist of a series of bad arguments leading to contradictory conclusions. Carefully analyzing these arguments and the methodological remarks which precede them, Meinwald shows that to understand Plato's response we (...) need to recognize his important distinction between two kinds of predication. Read in the light of this distinction, the arguments can be seen to be sound, and the contradictions merely apparent. Meinwald then proceeds to demonstrate the direct application of Plato's crucial innovation in solving the problems of the first part of the dialogue, including the infamous Third Man. On Meinwald's interpretation, the new distinction is associated with developments in metaphysics which take Plato well beyond the problems commonly thought to tell against Platonism. (shrink)

This paper argues for a view that maximizes in the Stoics' epistemology the starkness and clarity characteristic of other parts of their philosophy. I reconsider our evidence concerning doxa (opinion/belief): should we really take the Stoics to define it as assent to the incognitive, so that it does not include the assent of ordinary people to their kataleptic impressions, and is thus actually inferior to agnoia (ignorance)? I argue against this, and for the simple view that in Stoicism assent is (...) either, in the case of the fool, doxa = agnoia, or alternatively, in that of the sage, epistêmê (knowledge). This view, together with reflection on the appropriate sense of "between" in the relevant reports of SE and Cicero, yields a sympathetic reading of an otherwise problematic challenge Sextus reports Arcesilaus as having prepared for the Stoic claim that katalêpsis, which is the criterion of truth, is between knowledge and opinion; on my view each side is proceeding in a philosophically legitimate way. Local knowledge (both technological and sociological) and communication systems represent a logical starting point and a rich body of resources for successful agricultural research, development, and extension (RD&E). Drawing upon concrete examples from Asia, Africa, and Latin America, this essay presents an overview of definitions, topics, and applications of local knowledge in agricultural RD&E. Also noted are caveats, future research and training needs, and human values issues related to the study and utilization of local knowledge systems and their products.

Religion and spirituality seem to be very important for HIV-positive patients believers. Indeed, a recurring number of studies show strong correlations between religiosity/spirituality of individuals and different dimensions of health. The majority of these studies show most positive associations of religiosity/spirituality to physical health through reducing emotional distress, reduced rates of depression, greater optimism, better psychological adjustment, better preservation of CD4 cells, better control of viral load. The objective of this research is to understand the nature of the relationship between (...) religiosity and emotional health among HIV-positive patients, migrants from sub-Saharan Africa. Religiosity, the frequency of depressive episodes and subjective health 81 asymptomatic HIV patients regularly followed, were evaluated. Regression models and mediation, backed by a resampling procedure were tested. From mediation analyzes, the results show that through the mediating effect of subjective health, religiosity explains a decrease in the number of depressive episodes in people with HIV migrants from sub-Saharan Africa. In this paper the authors seek to contribute to a new ontology of an embodied, desiring subject through an exploration of their own subjectivities and of the ways in which subjectivities are produced and transformed through affective attachments to place. Using the method of collective biography (Davies, Gannon 2006) and drawing on Deleuze and Guattari’s concepts of desire and territorialization they examine their affective responses and attachments to place: Australia and the Czech Republic. As a point of departure for their (...) analysis, the authors ask: What does it mean to be homesick for a place which is not one’s home? What does it mean to desire a place? What of the other place is inscribed in the body? In asking this, the authors show the extent to which place is a zone of immanence in which a continual play of de- and re-territorialization occurs. Four hundred seventy-six nuclear power plants are in operation or under construction around the world. Are concepts for designing and operating plants safely sufficient? Conventional approaches are premised on expectations of predictability and control of radiation release and on assumptions that plant operations are closed systems. Field observations in the industry find, however, that the periodic necessity to refuel, test safety equipment, and continuously upgrade plant designs introduces challenges to control not originally calculated. The social and cultural contexts of markets, (...) regulation, and work systems create additional contingencies. In this dynamic environment, reactor operations produce invaluable data about the states of the entire technology and organizational system. Rereading these dynamics as "experiments" suggests an alternative epistemol ogy that synthesizes science's values of doubt, discovery, and documentation with engineering's values of efficiency, optimization, and problem solving. This redefines plant-based risk handlers as ethologists, geologists, and anthropologists of an ecology of visible and invisible hazards. (shrink)

The Madhyamaka school of Buddhist philosophy is grounded in the theory of the two truths. This theory posits the existence of two levels of reality :1 the conventional truth corresponds to the way that things appear, and the ultimate truth corresponds to the way that things really are. Nāgārjuna, the second-century Indian scholar credited with founding the Madhyamaka tradition, frames the relationship between the two truths as follows: "Without relying on the conventional, the ultimate cannot be demonstrated. The critical studies in the Sociology of Agriculture can be generally divided into four questions: Agrarian, Environmental, Food, and Emancipatory. While the four questions overlap and all address social justice concerns, there is a chronological sequence to the studies. In this presidential address presented at the joint meetings of the Agriculture, Food, and Human Values Society and the Association for the Study of Food in Society held in June 2008 in New Orleans, LA, I provide an overview of the four (...) questions and call for researchers and activists in agrifood studies to engage as public social scientists to bring about a more just and equitable agrifood system. The Agriculture, Food and Human Values Society and the journal _Agriculture and Human Values_ provided a crucial intellectual space for the early transdisciplinary critique of the industrial agrifood system. This paper describes that process and presents the concept of “The Doctors of Agrifood Studies” as a metaphor for the key role critical agrifood social scientists played in documenting the unsustainability of conventional agriculture and working to create an alternative, ethical, sustainable agrifood system. After the introduction, the paper details the “Critical (...) Turn” in agrifood studies, followed by a reconsideration of my “Four Questions” framework, focusing on the current tension between the food security and food sovereignty discourses and movements.
