In many spheres, the law takes the legal concept of causation to correspond to the folk concept (the correspondence assumption). Courts, including the US Supreme Court, tend to insist on the "common understanding" and that which is "natural to say" (Burrage v. United States) when it comes to expressions relating to causation, and frequently refuse to clarify the expression to juries. As recent work in psychology and experimental philosophy has uncovered, lay attributions of causation are susceptible to a great number (...) of unexpected factors, some of which seem rather peripheral to causation. One of those is the norm effect (Knobe & Fraser, 2008): Agents who, in acting as they do, break a salient norm, are more likely to be considered as having caused a certain consequence than when they do not violate a norm. According to some (e.g., Alicke, 1992) this constitutes a bias. According to others (e.g., Sytsma, 2020), the folk concept of causation is sensitive to normative factors, and there’s nothing wrong with that. In this paper, we explore the question whether the norm effect should be considered a bias from the legal perspective on the one hand, and from the psychological perspective on the other. To do this, we test whether norms which are nonpertinent to the consequences or outright silly also impact causation judgements. The data from two preregistered experiments (total N=593) clearly show they do. This, we argue, makes the bias interpretation plausible from the psychological perspective, and both plausible and problematic from the legal perspective. It also shows that the law should abstain from unreflectively assuming conceptual correspondence between legal and ordinary language concepts. (shrink)

L'examen des présupposés et des thèses philosophiques de la Théorie pure du droit de Hans Kelsen et du Concept de droit d'Herbert Hart permet de s'orienter dans ces débats. Les deux auteurs proposent des théories distinctes d'une même réalité : la mise en vigueur, dans des collectivités, de règles possédant une forme (...) d'objectivité. Leurs descriptions du fonctionnement des systèmes juridiques obligent à reconduire à ses fondements l'examen de la nature et de la connaissance des normes. De ce fait, la comparaison des doctrines doit permettre de mieux comprendre, en particulier, l'articulation entre le registre du devoir-être et la prise en compte de la réalité de la vie sociale organisée par le droit. La philosophie de la nature de l'Encyclopedie des sciences philosophiques fut, jusqu'a une date recente, presque ignoree par les etudes hegeliennes. Hegel s'y serait rendu coupable d'une pretention a concurrencer les sciences positives sur leur propre terrain et a rivaliser avec elles, en revelant a la fois son incomprehension de la scientificite la mieux etablie et la faible rationalite de son propre projet. Une lecture attentive permet de rectifier ces prejuges, en montrant non seulement que Hegel s'y trouve attentif et (...) respectueux du savoir positif de son temps, mais encore qu'il tente d'y definir les modalites d'une collaboration methodologiquement reglee entre philosophie et sciences. En quoi consiste le projet d'une science speculative? En quoi consiste chez Hegel la deduction speculative de la verite? En quoi consiste la comprehension hegelienne du statut et des formes du discours des sciences de la nature? Quelle attitude la speculation doit-elle adopter face aux controverses scientifiques? La théorie critique de la société, telle qu'elle s'est développée dans le cadre de ce qu'on appelle parfois l'école de Francfort, se caractérise notamment par le fait qu'elle donne toute son importance aux dominations et aux conflits dans son analyse du monde contemporain. L'une de ses figures aujourd'hui centrales, Axel Honneth, est aussi l'auteur de la théorie de la reconnaissance sans doute la plus systématique et riche en perspectives théoriques et critiques. C'est de cette théorie qu'Emmanuel Renault part dans (...) cc livre, tout en lui apportant des inflexions justifiées d'une part par l'histoire de la théorie critique, d'autre part par l'analyse du temps présent. L'analyse de l'imbrication de la reconnaissance, de la domination et du conflit demande une approche spécifique : l'apport du pragmatisme américain et les débats sociologiques contemporains, en particulier Dewey et Bourdieu, complètent ici le modèle hégélien et les intuitions de Marx. Quelques exemples choisis parmi des objets souvent délaissés par les sciences sociales la conduite oppositionnelle d'un groupe de punks squatters, le langage protestataire de jeunes de banlieues populaires mettent à l'épreuve la capacité d'analyse de l'approche proposée par l'auteur, celle d'une philosophie sociale conçue comme une hybridation de la philosophie et des sciences sociales. Extant research has shown that ordinary causal judgments are sensitive to normative factors. For instance, agents who violate a norm are standardly deemed more causal than norm-conforming agents in identical situations. In this paper, we explore two competing explanations for the Norm Effect: the Responsibility View and the Bias View. According to the former, the Norm Effect arises because ordinary causal judgment is intimately intertwined with moral responsibility. According to the alternative view, the Norm Effect is the result of a (...) blame-driven bias. In a series of five preregistered experiments (N = 2688), we present evidence that predominantly favours the Bias View. In particular, and against predictions made by the Responsibility View, we show that participants deem agents who violate nonpertinent or silly norms – norms that do not relate to the outcome at hand – as more causal, and that this effect cannot be explained in terms of plausible mediators such as the agent’s foreknowledge and desire, or the foreseeability of harm. We close with a discussion regarding the implications of these findings, in as regards the just assessment of proximate cause in the law. (shrink)

Lorsqu'elles sont missionnaires et prétendent détenir la vérité sur Dieu, le monde et l'homme, le caractère systématique de leurs énoncés théologiques et juridiques qui excluent les autres systèmes ne redouble-t-il pas ces conflits? Comment dans ces conditions le dialogue interreligieux pourrait-il aller au-delà des rencontres et du dialogue de vie? Peut-on penser du point de vue (...) théologique une ouverture à l'autre qui assoie l'unité entre les religions, leur communion et leur réconciliation au niveau de la doctrine sans obliger chacune à renoncer aux énoncés de sa foi?0Pour envisager ces questions fondamentales qui concernent tous les acteurs impliqués dans le dialogue interreligieux ou la théologie du pluralisme religieux, plusieurs théologiens ont interrogé George Lindbeck afin d'évaluer si les principes qu'il avance pour repenser l'oecuménisme sont transposables au niveau de l'interreligieux. En effet, conscient de l'enjeu des différences doctrinales entre les Églises chrétiennes, Lindbeck a questionné la nature d'une doctrine et a proposé un modèle post-libéral privilégiant la praxis, l'articulation entre l'action et le langage, la réactivation et la réadaptation constante des identités. Ces recherches montrent qu'en dépit de bien des limites de son modèle, on trouve chez le théologien luthérien une approche originale et féconde pour répondre à bien des défis contemporains. (shrink)

A growing body of literature has revealed ordinary causal judgement to be sensitive to normative factors, such that a norm-violating agent is regarded more causal than their non-norm-violating counterpart. In this paper, we explore two competing explanations for this phenomenon: the Responsibility View and the Bias View. The Bias View, but not the Responsibility View, predicts features peripheral to the agent’s responsibility to impact causal attributions. In a series of three preregistered experiments (N = 1162), we present new evidence that (...) the Norm Effect arises from such peripheral features, namely from nonpertinent or entirely silly norm violations. Furthermore, we show that this effect cannot be explained by recourse to the agent’s foreknowledge or desire of the outcome, nor by its foreseeability: the Norm Effect arises even when participants judge the norm-violating agent’s doing as equally foreseeable. We investigate synonymy in the strong sense of content identity. This notion is central in the philosophy of language and in applications of logic. We motivate, uniformly axiomatize, and characterize several “benchmark” notions of synonymy in the messy class of all possible notions of synonymy. This class is divided by two intuitive principles that are governed by a no-go result. We use the notion of a scenario to get a logic of synonymy which is the canonical representative of one division. (...) In the other division, the so-called conceptivist logics, we find, e.g., the well-known system of analytic containment. We axiomatize four logics of synonymy extending AC, relate them semantically and proof-theoretically to SF, and characterize them in terms of weak/strong subject matter preservation and weak/strong logical equivalence. This yields ways out of the no-go result and novel arguments—independent of a particular semantic framework—for each notion of synonymy discussed. This points to pluralism about meaning and a certain non-compositionality of truth in logic programs and neural networks. And it unveils an impossibility for synonymy: if it is to preserve subject matter, then either conjunction and disjunction lose an essential property or a very weak absorption law is violated. La première partie de l’article analyse la manière dont Dewey défend une conception processuelle, interactionnelle et intégrative de la nature humaine. La deuxième partie analyse la fonction classificatoire du concept de nature humaine et la troisième la manière dont Dewey attribue une fonction explicative à ce concept en discutant les références politiques conservatrices ou progressistes, voire révolutionnaires, à la nature humaine.

Elle va plus loin aussi, en proposant de comprendre (...) systematiquement Siewerth a partir du concept de l'etre comme idee donnee, comme amour. L'auteur nous fait toucher la pensee siewerthienne a la fois dans sa grandeur - dans ce qui doit imperativement en etre conserve - et dans ses limites rigoureusement discernees. Il nous entraine enfin a penser Siewerth apres Siewerth, c'est-a-dire a elaborer le projet d'un realisme spirituel integral de l'amour, inspire par Ravaisson, et permettant un nouveau deploiement speculatif du thomisme. Over the last decade, businesses, policymakers, and researchers alike have advocated the need for value creation through inter-organizational collaboration. Researchers have widely argued that organizations that are engaged in collaborative processes create value. Because researchers have tended to focus on the identification of organizational motivations and on key success factors for collaboration, however, both the nature and processes of value creation in inter-organizational collaboration have yet to be examined. A recent theory by Austin and Seitanidi :726–758, 2012a; Nonprofit Volunt Sect (...) Q 41:929–968, 2012b) has proposed an analytical framework for analyzing value creation in inter-organizational collaboration, based on four types of value. The purpose of this current study is to empirically test this framework, and to provide key pointers for analyzing the nature of value, particularly in relation to learning. Our detailed empirical research is based on a 6-year retrospective case study of an inter-organizational partnership within an international development project for local economic development in Guatemala. The study’s contributions are twofold. First, it provides evidence of the critical path of the creation of diverse types of values in a collaborative process; second, it links the different types of value creation with the types of learning that occur in an inter-organizational process. It is universally agreed that involuntary unemployment is an evil for unemployed individuals, who lose both income and the non-pecuniary benefits of paid employment, and for society, which loses the productive labor that the unemployed are unable to expend. It is nearly as widely agreed that there is at least a prima-facie case for alleviating this evil – for reasons of justice and/or benevolence and/or social order. Finally, there is little doubt that the evils of involuntary unemployment cannot be adequately (...) addressed in contemporary societies without state intervention – whether through monetary or fiscal policies, cash payments or other subsidies to the unemployed, direct provision of employment by the state, or some combination of these measures. ABSTRACT Many philosophers who wish to defend abortion, but who have become frustrated by the resistance of the personhood question to yield to any nonarbitrary solution welcomed Judith Thomson's ‘A defense of abortion.’Thomson argues that abortion is sometimes justifiable even if the foetus is a person. In this paper I argue that Thomson's argument is a defense of abortion, rather than merely extraction without death, only because of the current state of medical technology. Once the technology is in place to (...) extract foetuses while preserving their lives and to allow them to develop to full term outside the uterus, Thomson cannot defend the killing of the foetus. If she is right, however, a woman will still have the right to have a foetus extracted from her body. Finally, it is pointed out that the source of the problem with Thomson's argument is the major premise in most arguments for the permissibility of abortion: a woman's right to control her own body. If the defence of abortion is to entail a defence of the termination of the foetus, then this premise, understood as the right to remove an unwanted entity from one's body or the right to alter one's body as one wishes, simply will not do the trick. Heidegger’s key word Ereignis is frequently translated as “event,” “event of being,” or “event of appropriation.” No ordinary event in the realm of beings, it is an event in which the meaning of being is recognized in difference from beings. In the history of philosophy, this insight into being set in motion the inception of a philosophical discourse within which we are still thinking. Inspired and guided by his philosophy of history, Heidegger hoped our own reflections on being could likewise (...) appropriate and set in motion preparations for another inception, another experience and understanding of what it means for something to be. Whereas, for the early Greek philosophers, their insight was an experience of awe and wonder, and perhaps also dread, for us of today that insight can set in motion a more “inward” turn, a process that puts in question who we are as human beings and who we want to become, and stirs us to acknowledge our responsibility for being in response to a time when being is under assault. Shareholder activism has become a force for good in the extant corporate governance literature. In this article, we present a case study of Nigeria to show how shareholder activism, as a corporate governance mechanism, can constitute a space for unhealthy politics and turbulent politicking, which is a reflection of the country’s brand of politics. As a result, we point out some translational challenges, and suggest more caution, in the diffusion of corporate governance practices across different institutional environments. We contribute to (...) the literature on corporate governance in Africa, whilst creating an understanding of the political embeddedness of shareholder activism in different institutional contexts—i.e. a step closer to a political theorising of shareholder activism. The history of ideas is an interdisciplinary field that began as an offshoot of the history of philosophy and was transformed by notions of perspective and cultural context drawn from the tradition of historical studies. The result is the practice of intellectual history, which has been carried out between the poles of inquiry commonly known as internalist and externalist, corresponding to mental phenomena and collective behavior in cultural surroundings. These are not opposed but rather complementary methods, and intellectual history may (...) be seen as the inside of cultural history and cultural history as the outside of intellectual history, the intellectual historian's task being to bring the two into alliance. As Emmanuel Levinas states in the preface to Existence and Existents, "this study is a preparatory one. It examines . . . the problem of the Good, time, and the relationship with the other [person] as a movement toward the Good." First published in 1947, and written mostly during Levinas's imprisonment during World War II, this work provides the first sketch of his mature thought later developed fully in Totality and Infinity and Otherwise than Being, or Beyond Essence. This (...) new edition marks the first time this important work has been made available in an inexpensive paperback edition. Levinas's project in Existence and Existents is to move from anonymous existence to the emergence of subjectivity; to subjectivity's practice, theory and morality; to its encounter with the alterity of the other person. He is concerned here primarily with the time of the solitary subject; time is the inner structure of subjectivity, of the movement of existing. "Levinas's work," says Alphonso Lingis, "contains not only wholly new analyses of the forms of time of the present, the past, the future but also a new conception of the work of time." Beginning with Existence and Existents, then, it is possible to begin tracing the progressive "alterization" of time as it unfolds across the development of Levinas's entire philosophy. As a "preparatory" study, Existence and Existents introduces the major themes and concerns that occupied Levinas throughout his career.
