The twentieth century was unprecedented in the scope and enormity of the terrible deeds that human beings perpetrated against their fellows. Oftentimes, the unjust detention, imprisonment, tortures, and executions were set in motion by the event of the arrest. This paper examines the phenomenon of the arrest as it is depicted in two of the century’s literary giants -- Franz Kafka and Alexander Solzhenitsyn. Uncanny correspondences can be detected particularly between Kafka’s novel The Trial and Solzhenitsyn’s memoir The Gulag (...) Archipelago. Moreover, through Kafka’s powerful literary imagination, he created works containing many features that were later to stand at the heart of the terror of totalitarian regimes. This paper analyzes and explores the arrest and, as a result, a philosophical typology of the arrest emerges. Due to the power and scope of Kafka’s genius, his work both prefigures and expresses many of the essential characteristics of totalitarian regimes that come to be enacted in flesh and blood later in the century. In The Trial, the arrest may be seen as an eerie and surreal foreshadowing of the millions of morally outrageous and legally spurious arrests that were to come in the twentieth century. (shrink)

Franz Brentano gilt als einer der einflussreichsten Philosophen an der Wende vom 19. zum 20. Jahrhundert. Dennoch sind die Philosophiehistoriker noch zu keinem endgültigen Urteil über seine Bedeutung gelangt. Der Grund hierfür ist vor allem darin zu suchen, dass Brentanos Werk bis heute nur unzureichend zugänglich ist, was vor allem daran liegt, dass der größte Teil davon nur in handschriftlicher Form existiert: Nach seinem unvollendet gebliebenen Hauptwerk, der Psychologie vom empirischen Standpunkt, hat Brentano keine größere Arbeit mehr veröffentlicht. Im (...) ersten Teil analysiert Binder die Gründe für Brentanos zurückhaltende Publikationstätigkeit, wobei einerseits der konfliktbehaftete biographische Hintergrund und die komplexe Persönlichkeit des Philosophen, andererseits theoretische Probleme, eine psychologische Einheitswissenschaft zu formulieren, die ihn an der Fertigstellung seines Hauptwerks scheitern ließen, im Vordergrund stehen. This book contains the definitive statement of Franz Brentano's views on meta physics. It is made up of essays which were dictated by Brentano during the last ten years of his life, between 1907 and 1917. These dictations were assembled and edited by Alfred Kastil and first published by the Felix Meiner Verlag in 1933 under the title Kategorienlehre. Kastil added copious notes to Brentano's text. These notes have been included, with some slight omissions, in the present edition; the (...) bibliographical references have been brought up to date. Brentano's approach to philosophy is unfamiliar to many contemporay readers. I shall discuss below certain fundamental points which such readers are likely to find the most difficult. I believe that once these points are properly understood, then what Brentano has to say will be seen to be of first importance to philosophy. THE PRIMACY OF THE INTENTIONAL To understand Brentano's theory of being, one must realize that he appeals to what he calls inner perception for his paradigmatic uses of the word "is". For inner perception, according to Brentano, is the source of our knowledge of the nature of being, just as it is the source of our knowledge of the nature of truth and of the nature of good and evil. And what can be said about the being of things that are not apprehended in inner perception can be understood only by analogy with what we are able to say about ourselves as thinking subjects. Tractatus 4.024 inspired the dominant semantics of our time: truth-conditional semantics. Such semantics is focused on possible worlds: the content of p is the set of worlds where p is true. It has become increasingly clear that such an account is, at best, defective: we need an ‘independent factor in meaning, constrained but not determined by truth-conditions’ (Yablo 2014, p. 2), because sentences can be differently true at the same possible worlds. I suggest a missing comment which, had it been (...) included in the Tractatus, would have helped semantics get this right from the start. This is my 4.0241: ‘Knowing what is the case if a sentence is true is knowing its ways of being true’: knowing a sentence’s truth possibilities and what we now call its topic, or subject matter. I show that the famous ‘fundamental thought’ that ‘the “logical constants” do not represent’ (4.0312) can be understood in terms of ways-based views of meaning. Such views also help with puzzling claims like 5.122: ‘If p follows from q, the sense of “p” is contained in the that of “q”’, which are compatible with a conception of entailment combining truth-preservation with the preservation of topicality, or of ways of being true. Introduction and translation of “The Four Phases of Philosophy” by Franz Brentano.

Brecht’s Life of Galileo provides elements for elaborating what I call “a theory of the encounter of practices”. The concept of the encounter pushes back against teleological theories that predestine modern science to operate as an instrument of domination. I argue that Life of Galileo stages the missed encounters in modernity between science, politics, and art at the same time as it foregrounds the emancipatory power of science. I trace the encounter of practices from the play’s opening scenes – highlighting (...) what I call Galileo’s “double life”. Then, I turn to the most important scene of the play, Scene 10, in which political and artistic practices repurpose Galileo’s novel inventions for their emancipatory desires. In the virtual potentialities of this encounter, that is, despite the missed encounter between Galileo and “the people”, Brecht’s Life of Galileo continues to be fruitful for theorizing the emancipatory power of science. I present a formal theory of the logic and aboutness of imagination. Aboutness is understood as the relation between meaningful items and what they concern, as per Yablo and Fine’s works on the notion. Imagination is understood as per Chalmers’ positive conceivability: the intentional state of a subject who conceives that p by imagining a situation—a configuration of objects and properties—verifying p. So far aboutness theory has been developed mainly for linguistic representation, but it is natural to extend it to (...) intentional states. The proposed framework combines a modal semantics with a mereology of contents: imagination operators are understood as variably strict quantifiers over worlds with a content-preservation constraint. We give a review and critique of jury theorems from a social-epistemology perspective, covering Condorcet’s (1785) classic theorem and several later refinements and departures. We assess the plausibility of the conclusions and premises featuring in jury theorems and evaluate the potential of such theorems to serve as formal arguments for the ‘wisdom of crowds’. In particular, we argue (i) that there is a fundamental tension between voters’ independence and voters’ competence, hence between the two premises of most jury theorems; (ii) (...) that the (asymptotic) conclusion that ‘huge groups are infallible’, reached by many jury theorems, is an artifact of unjustified premises; and (iii) that the (nonasymptotic) conclusion that ‘larger groups are more reliable’, also reached by many jury theorems, is not an artifact and should be regarded as the more adequate formal rendition of the ‘wisdom of crowds’. In what follows, I will provide some elements for constructing Mariátegui’s plural spatiotemporal conception of history. I will do so by focusing on the two books he published in his lifetime: The contemporary scene and Seven Interpretive Essays on Peruvian Reality. In a footnote in the Seven Essays, the reader encounters a concept that opens up the problem of plural temporality in Latin American Marxism: relativismo histórico (historical relativism). This will be the keystone concept upon which certain fragments of Mariátegui’s (...) writings will be put together to construct the concept of plural temporality. This involves taking a detour through what Mariátegui understood by relativismo (relativism). In that detour, we find that Mariátegui’s use of relativismo consists in translating and assimilating the insights of one of the pillars of contemporary physics: Einstein’s theory of relativity. For Mariátegui, the relativistic theory of spacetime undermined the old “absolutes” of the positivist unilinear philosophy of history. I then argue that Mariátegui, through his friend and comrade Hugo Pesce, assimilates and translates the “revolutionary” theory of spacetime as a weapon against the unilinear philosophy of history and as a resource to construct a concept of plural spatiotemporal concept of history. Re-situating Mariátegui’s work along this axis puts some pressure on certain Bergsonian and Sorelian readings that overemphasize the importance of Myth and Humanity as a “metaphysical animal” and thereby tend to underemphasize or outright suppress his creative assimilation and translation of the sciences of his time. Critics have argued that Rawls's account of self-respect is equivocal. I show, first, that Rawls in fact relies upon an unambiguous notion of self-respect, though he sometimes is unclear as to whether this notion has merely instrumental or also intrinsic value. I show second that Rawls’s main objective in arguing that justice as fairness supports citizens’ self-respect is not, as many have thought, to show that his principles support citizens’ self-respect generally, but to show that his principles counter the effects (...) of the market on lower class citizens’ sense of worth. This discussion establishes that Rawls, in the end, sees self-respect primarily as an intrinsic good. (shrink)

Unification was originally introduced in automated deduction and term rewriting, but has recently also found applications in other fields. In this article, we give a survey of the results on unification obtained in two closely related, yet different, application areas of unification: description logics and modal logics.

Hypothetical contracts have been said to be not worth the paper they are not written on. This paper defends hypothetical consent theories of justice, such as Rawls's, against the view that they lack justificatory power. I argue that while hypothetical consent cannot generate political obligation, it can generate political legitimacy.

In solving judgment aggregation problems, groups often face constraints. Many decision problems can be modelled in terms the acceptance or rejection of certain propositions in a language, and constraints as propositions that the decisions should be consistent with. For example, court judgments in breach-of-contract cases should be consistent with the constraint that action and obligation are necessary and sufficient for liability; judgments on how to rank several options in an order of preference with the constraint of transitivity; and judgments on (...) budget items with budgetary constraints. Often more or less demanding constraints on decisions are imaginable. For instance, in preference ranking problems, the transitivity constraint is often contrasted with the weaker acyclicity constraint. In this paper, we make constraints explicit in judgment aggregation by relativizing the rationality conditions of consistency and deductive closure to a constraint set, whose variation yields more or less strong notions of rationality. We review several general results on judgment aggregation in light of such constraints. (shrink)

In Equal Citizenship and Public Reason, Watson and Hartley dispute the claim that Rawls’s doctrine of political liberalism must tolerate gender hierarchy because it counts conservative and orthodox religions as reasonable comprehensive doctrines. I argue that their defense in fact contains two arguments, both of which fail. The first, which I call the “Deliberative Equality Argument”, fails because it does not establish conclusively that political liberalism’s demand for equal citizenship forbids social practices of domination, as the authors contend. "Today, more than three-quarters of a century after it was written, the critique of philosophy in this book is what makes it of such great interest.

Judgment-aggregation theory has always focused on the attainment of rational collective judgments. But so far, rationality has been understood in static terms: as coherence of judgments at a given time, defined as consistency, completeness, and/or deductive closure. This paper asks whether collective judgments can be dynamically rational, so that they change rationally in response to new information. Formally, a judgment aggregation rule is dynamically rational with respect to a given revision operator if, whenever all individuals revise their judgments in light (...) of some information (a learnt proposition), then the new aggregate judgments are the old ones revised in light of this information, i.e., aggregation and revision commute. We prove an impossibility theorem: if the propositions on the agenda are non-trivially connected, no judgment aggregation rule with standard properties is dynamically rational with respect to any revision operator satisfying some basic conditions on revision. Our theorem is the dynamic-rationality counterpart of some well-known impossibility theorems for static rationality. We also explore how dynamic rationality might be achieved by relaxing some of the conditions on the aggregation rule and/or the revision operator. Notably, premise-based aggregation rules are dynamically rational with respect to so-called premise-based revision operators. (shrink)

Democratic decision-making is often defended on grounds of the ‘wisdom of crowds’: decisions are more likely to be correct if they are based on many independent opinions, so a typical argument in social epistemology. But what does it mean to have independent opinions? Opinions can be probabilistically dependent even if individuals form their opinion in causal isolation from each other. We distinguish four probabilistic notions of opinion independence. Which of them holds depends on how individuals are causally affected by environmental (...) factors such as commonly perceived evidence. In a general theorem, we identify causal conditions guaranteeing each kind of opinion independence. These results have implications for whether and how ‘wisdom of crowds’ arguments are possible, and how truth-conducive institutions can be designed. (shrink)

Diesen Befund gilt es anhand eines intensiven Vergleiches beider Texte zu bestatigen. Erganzend werden Heideggers Arbeiten uber rund zwanzig Jahre von seiner Dissertation bis zu den "Beitragen zur Philosophie" verfolgt, um die Phasen einer Rezeption zwischen Aneignung, Widerspruch und Negation rekonstruieren zu konnen, die in der Geschichte der westlichen Rationalitat ihresgleichen sucht. Denn es wird sichtbar, (...) wie stark Heideggers Begrundung eines angeblichen seinsgeschichtlichen Auftrages der Deutschen von jenen Aussagen Franz Rosenzweigs gepragt ist, in denen dieser das judische Volk charakterisiert. Ein vertiefender Blick auf das Selbstverstandnis Martin Heideggers zur Zeit des Nationalsozialismus wird moglich, der dazu beitragen kann, die Frage seiner ideologischen Positionierung vor neuem Hintergrund zu stellen. Condorcet's famous jury theorem reaches an optimistic conclusion on the correctness of majority decisions, based on two controversial premises about voters: they are competent and vote independently, in a technical sense. I carefully analyse these premises and show that: whether a premise is justi…ed depends on the notion of probability considered; none of the notions renders both premises simultaneously justi…ed. Under the perhaps most interesting notions, the independence assumption should be weakened.

We propose a new account of indicative conditionals, giving acceptability and logical closure conditions for them. We start from Adams’ Thesis: the claim that the acceptability of a simple indicative equals the corresponding conditional probability. The Thesis is widely endorsed, but arguably false and refuted by empirical research. To fix it, we submit, we need a relevance constraint: we accept a simple conditional 'If φ, then ψ' to the extent that (i) the conditional probability p(ψ|φ) is high, provided that (ii) (...) φ is relevant for ψ. How (i) should work is well-understood. It is (ii) that holds the key to improve our understanding of conditionals. Our account has (i) a probabilistic component, using Popper functions; (ii) a relevance component, given via an algebraic structure of topics or subject matters. We present a probabilistic logic for simple indicatives, and argue that its (in)validities are both theoretically desirable and in line with empirical results on how people reason with conditionals. Der Dialog über die fachlichen und disziplinären Grenzen hinweg hat bei THESIS seit dessen Gründung im Jahre 1990 stets einen großen Raum eingenommen. Anderen Fächern Respekt und Interesse entgegenzubringen und sich nicht von stereotypen Vorurteilen leiten zu lassen, ist konstitutiver Bestandteil im Selbstverständnis des Netzwerkes. Selbstverständlich gibt es in einem solchen Verbund eine Reihe von Gelegenheiten (darunter auch den einen oder anderen entwicklungsfördernden Konflikt), (...) das eigene Bild vom Anderen und das andere Bild vom Eigenen zur Sprache zu bringen und zu hinterfragen. Auf der Basis dieser bestehenden Kommunikationsstrukturen trafen sich am 11. We present an abstract model of rationality that focuses on structural properties of attitudes. Rationality requires coherence between your attitudes, such as your beliefs, values, and intentions. We define three 'logical' conditions on attitudes: consistency, completeness, and closedness. They parallel the familiar logical conditions on beliefs, but contrast with standard rationality conditions like preference transitivity. We establish a formal correspondence between our logical conditions and standard rationality conditions. Addressing John Broome's programme 'rationality through reasoning', we formally characterize how you can (...) (not) become more logical by reasoning. Our analysis connects rationality with logic, and enables logical talk about multi-attitude psychology. (shrink)

Unter den person lichen treuge­ bliebenen Schiilern ist er einer der freieren; ohne daB er seinen Anschauungen nach gerade der Hegelschen Linken zuzurechnen ware, ist ihm doch manches mit ihr gemein; nicht bloB eine gewisse Selbstandigkeit gegeniiber der Systematik des Meisters, sondern mehr noch eine eigentiimliche Zersplitterung und Beweglichkeit des Empfindens, ein (...) unruhig stoffsiichtiges Hineingreifen in die Schatze der Zeit und Vergangenheit, ein starker Hang endlich zum geist­ reichen Widersinn stell en den Verfasser der "Asthetik des HaBlichen" fast eher in die Reihe der StrauB, Bauer, Feuerbach als zu den Marheineke, Gabler und Henning. Sein Hegelbuch zeigt von diesen Eigenschaften verhaltnismaBig wenig; sie sind da zuriickge­ drangt durch die fromme Achtung des Schiilers gegen den toten Meister und wohl auch durch den Ernst des BewuBtseins, sozusagen im amtlichen Auf trag der Schule zu schreiben: die Lebensgeschichte trat an die Offentlichkeit als Erganzungsband zu den Werken. Auch die Menge handschriftlichen Stoffes, die das Buch im Abdruck oder Auszug brachte, tat das ihre, dem Verfasser den Ratim fiir seine eigenen Fliige einzuengen. Immerhin wird der Leser des noch heute unentbehrlichen und urn seiner ausgepragten und zeitcharakteristi­ schen Eigenart willen wohl nie ganz iiberftiissig zu machenden Buchs noch genug wunderbare Einfalle darin finden.
