This is the first complete, one-volume English translation of the ancient Chinese text Xunzi, one of the most extensive, sophisticated, and elegant works in the tradition of Confucian thought. Through essays, poetry, dialogues, and anecdotes, the Xunzi articulates a Confucian perspective on ethics, politics, warfare, language, psychology, human nature, ritual, and music, among other topics. Aimed at general readers and students of Chinese thought, Eric Hutton’s translation makes the full text of this important work more accessible in English than ever (...) before. Named for its purported author, the Xunzi has long been neglected compared to works such as the Analects of Confucius and the Mencius. Yet interest in the Xunzi has grown in recent decades, and the text presents a much more systematic vision of the Confucian ideal than the fragmented sayings of Confucius and Mencius. In one famous, explicit contrast to them, the Xunzi argues that human nature is bad. However, it also allows that people can become good through rituals and institutions established by earlier sages. Indeed, the main purpose of the Xunzi is to urge people to become as good as possible, both for their own sakes and for the sake of peace and order in the world. In this edition, key terms are consistently translated to aid understanding and line numbers are provided for easy reference. The cultural turn in copyright law identified authorship as a rhetorical construct employed by economic interests to strengthen claims to property rights. Grassroots intellectual property political movements have been seen as both a means of countering these interests’ everexpanding proprietary control of knowledge and establishing a more public regarding copyright system. This Article examines one of the most notable intellectual property political movements, the emergence of late nineteenth-century agitation to provide copyright protection for foreign authors as a social movement. It (...) places this political and legal activism within the larger framework of Progressive Era reform. During this period, activists promoted the idea of the public — and not simply the author — as primary to the workings of American copyright. The framing of the purposes of copyright, the appeal to a broader public, and the complex negotiations surrounding the passage of an international copyright act after a long period of gestation was formative to the creation of modern United States copyright law. Ironically, the movement for international copyright also sharpened the identification of interest groups. The first modern American comprehensive copyright legislation, the 1909 Copyright Act, was drafted by gathering together these groups for negotiations remarkably similar in style to those which led to the protection of the rights of foreign authors — but which would strongly embrace a proprietary model. Die Forschung zu Eduard Hanslicks Vom Musikalisch-Schönen (1854) ist in der deutschsprachigen Diskussion auf die historischen Hintergründe von Hanslicks Argument fokussiert. Während die frühesten Deutungen von Hanslicks Standpunkt seine systematischen Berührungspunkte mit dem ahistorischen Formalismus von Johann Friedrich Herbart konstatierten, akzentuierte die deutsche Forschung der 1970er und 1980er seinen starken Konnex mit Georg Wilhelm Friedrich Hegel. Dahlhaus betonte speziell, dass Hanslicks Argument eine Bekanntschaft mit dem Hegelianismus als der »herrschenden Philosophie der 1830er und 1840er« nötig mache. Dahlhaus’ Hypothese wird bei (...) der gewissenhaften Rekonstruktion der österreichischen Hegelrezeption jedoch schwierig. Habsburgische Bildungsplaner befanden dagegen den Deutschen Idealismus für politisch untragbar, was die Entlassung von mehreren Professoren nach sich zog, die den ›gefährlichen‹ Hegelianismus propagierten. Diese Lage wird von uns als geeigneter Ansatzpunkt für die detailgetreue Untersuchung der hegelianischen Theorieelemente von Hanslicks Abhandlung benutzt, welche vor dem Hintergrund der ablehnenden Grundhaltung ›Österreichs‹ zum Deutschen Idealismus sorgsam erfolgen muss. Hanslicks VMSTraktat umfasst dennoch mehrere wichtige Elemente der hegelianischen Ästhetik-diskussion, die nicht einzig Hegels System, sondern ebenso hegelianische Kunsttheoretiker (Kahlert, Krüger, Vischer etc.) umfänglich einbeziehen muss. Hanslicks Standpunkt, der die ahistorische Ausrichtung des Herbart’schen Formalismus niemals aufgriff, ist vor allem durch Vischers Annahme zur historischen Entwicklung des musikalischen Grundmaterials geprägt worden. Wir sehen somit Hanslicks VMS-Traktat als die ›eklektische‹ Verschmelzung von heterogenen theoretischen Diskursfeldern, womit dieser Herbartianismus und Hegelianismus als ästhetische Gegenpole des neunzehnten Jahrhunderts miteinander ausgleichen konnte. German-speaking scholarship on Eduard Hanslick’s aesthetic treatise »On the Musically- Beautiful« (1854) is primarily concerned with the historical background of Hanslick’s argument. Whereas contemporary investigations into Hanslick’s aesthetics emphasised theoretical overlaps with Johann Friedrich Herbart’s ahistorical formalism, German scholars of the 1970s and 1980s highlighted similarities to Georg Wilhelm Friedrich Hegel. In this respect, Dahlhaus specifically accentuated that Hanslick’s doctrine implies an exposure to Hegelianism as the »reigning philosophy of the 1830s and 1840s«. By reconstructing the historical reception of Hegel’s system in Austria, however, Dahlhaus’s premise becomes thoroughly problematic. Habsburg authorities considered German Idealism to be politically intolerable, thereby prompting numerous sackings of Austrian university lecturers on account of ›dangerous‹ Hegelianism. We take this historical framework as a suitable starting point for a comprehensive investigation of Hanslick’s Hegelian leanings that have to be carefully explored in the light of ›Austria’s‹ critical attitude towards speculative philosophy. »On the Musically-Beautiful«, however, comprises important elements of Hegelian aesthetics that are not limited to Hegel’s system but rather extend to Hegelian aesthetics in general (Kahlert, Krüger, Vischer etc.). Vischer’s hypothesis regarding the historical development of musical material particularly influenced Hanslick’s aesthetic outlook, who did not share the ahistorical conception of Herbartian formalism. Thus, we interpret Hanslick’s aesthetic treatise as an ›eclectic‹ fusion of diverse theoretical frameworks, ultimately reconciling Herbart and Vischer as the opposing extremes of mid-19th century aesthetics. This Article addresses a different sort of legal transplant — one in which outside legal doctrines are imported in order to be cabined, treated as normative counterpoints, and identified as the legal other. Legal primitivism is a kind of anti-transplant. It heightens the persistent differences between a dominant legal system and its understanding of primitive rules. An often ignored legal literature depicting legal primitivism emerged in the second half of the nineteenth century and in the early twentieth century. Mapping the (...) differences between America’s modern legal system and its antecedents, this immense literature, which included works by OliverWendell Holmes, James Coolidge Carter, and John Henry Wigmore, described an archaic legalism which sometimes belonged to tribal societies, and sometimes was simply conjured out of thin air. Exploring the project of constructing geographies of legal knowledge assists in our understanding of American law in a period of significant change. What elements of primitive law were valorized? Which were seen as archaic or repugnant? And what was the purpose of constructing a legal doppelgänger? By examining these cultural negotiations, and holding legal primitivism up as a mirror to modern law, it is possible to uncover the anxieties of legal modernism. (shrink)

Information can be public among a group. Whether or not information is public matters, for example, for accounts of interdependent rational choice, of communication, and of joint intention. A standard analysis of public information identifies it with (some variant of) common belief. The latter notion is stipulatively defined as an infinite conjunction: for p to be commonly believed is for it to believed by all members of a group, for all members to believe that all members believe it, and so (...) forth. This analysis is often presupposed without much argument in philosophy. Theoretical entrenchment or intuitions about cases might give some traction on the question, but give little insight about why the identification holds, if it does. The strategy of this paper is to characterize a practical-normative role for information being public, and show that the only things that play that role are (variants of) common belief as stipulatively characterized. In more detail: a functional role for “taking a proposition for granted” in non-isolated decision making is characterized. I then present some minimal conditions under which such an attitude is correctly held. The key assumption links this attitude to beliefs about what is public. From minimal a priori principles, we can argue that a proposition being public among a group entails common commitment to believe among that group. Later sections explore partial converses to this result, the factivity of publicity and publicity from the perspective of outsiders to the group, and objections to the aprioricity of the result deriving from a posteriori existential presuppositions. Traditionally, empathy is conceived of as a cognitive function that governs how people think during social interactions, and is considered as largely impervious to change. However, developments in psychology and neuroscience show that empathy is grounded in neural substrates of emotionally communicative behaviour and so is learned through imitation and other forms of cultural learning. This also means that abnormal patterns of empathic function can develop through adverse life experiences, or that empathy may fail to develop in young people with (...) neurodevelopmental disorders. Nevertheless, by focussing on empathy as a quality of social interaction and affective expression in the here and now, and by appreciating that it is as a special form of sensorimotor skill, pathways to training and fostering better development of empathy can be identified. The AGI alignment problem has a bimodal distribution of outcomes with most outcomes clustering around the poles of total success and existential, catastrophic failure. Consequently, attempts to solve AGI alignment should, all else equal, prefer false negatives (ignoring research programs that would have been successful) to false positives (pursuing research programs that will unexpectedly fail). Thus, we propose adopting a policy of responding to points of philosophical and practical uncertainty associated with the alignment problem by limiting and choosing necessary assumptions (...) to reduce the risk of false positives. Herein we explore in detail two relevant points of uncertainty that AGI alignment research hinges on---meta-ethical uncertainty and uncertainty about mental phenomena---and show how to reduce false positives in response to them. In a recent article Duncan Purves, Ryan Jenkins, and B. J. Strawser argue that in order for a decision in war to be just, or indeed the decision to resort to war to be just, it must be the case that the decision is made for the right reasons. Furthermore, they argue that this requirement holds regardless of how much good is produced by said action. In this essay I argue that their argument is flawed, in that it mistakes what (...) makes an agent morally good for what makes an act morally good. I argue that the main thrust of Purves et al.’s argument in fact undermines the conclusion they wish to draw, and that the reasons for one’s action do not make an in principle difference to the morality of actions in war. I further argue that this position undermines the traditional ad bellum just war constraint of right intention, and that the morality of actions in war is, at core, only concerned with outcomes. I conclude by clarifying that one’s reasons for action do in fact matter when deciding to enter war or kill in war, but only because one’s reasons significantly impact the way in which one acts. The purpose of this paper is to clear the theoretical space by showing why intentions/reasons do not in principle matter when assessing the morality of war (or killing), but this should not be taken as an argument that we should ignore intentions/reasons altogether. He later drew more than half of his remarks for Part II of Philosophical Investigations from this Dublin manuscript. A direct continuation of the writing that makes up the two volumes of Remarks on the Philosophy of Psychology, this collection offers scholars a glimpse of Wittgenstein's preliminary thinking on one of (...) his most important works. Studies of coexistence are based ultimately on the assumption that competitive exclusion is a general and accredited phenomenon in nature. However, the ecological and evolutionary impact of interspecific competition is of questionable significance. Review of three reputed examples of competitive exclusion in the field (Aphytis wasps, red and grey squirrels, and triclads) demonstrates that the widely-accepted competition-based interpretations are unlikely, that alternative explanations are overlooked, and that all other reported cases need critical reinvestigation. Although interspecific competition does undoubtedly occur, the (...) evidence suggests it is usually too weak and intermittent a force to achieve competitive exclusion or any other ecologically-significant result, except perhaps rarely and on a minor scale. Coexistence and community structure are therefore not ecological conditions to be especially accounted for, especially since their inherently comparative methods generate information that is largely superficial. Alternative questions that relate directly to species, the units of diversity, are discussed and they emphasize the primary habitat requirements of species, which are fixed during speciation. Neither the comparative approach of coexistence studies, nor the investigation of pattern is likely to be profitable, since the acquisition of species-specific characteristics during speciation requires historical research. At least one alternative theory of ecology, based on the close adaptation of organisms to the environment, is available. (shrink)
