With the case of Belgium as a negative example, this paper will evaluate the legitimacy of using mentally incompetents as organ sources. The first section examines the underlying moral dilemma that results from the necessity of balancing the principle of respect for persons with the obligation to help people in desperate need. We argue for the rejection of a radical utilitarian approach but also question the appropriateness of a categorical prohibition. Section two aims to strike a fair balance between the (...) competing interests at stake and to define the conditions under which organ harvest from mentally incompetents might be morally acceptable. To this end, we morally assess the main requirements that have been put forward to allow organ removal from incompetent donors. We conclude that the current Belgian legislation is far too permissive and that national regulations that do not permit the harvest of non-regenerable organs from mentally incompetents in exceptional circumstances are too restrictive. On the basis of this discussion, we propose a number of guiding principles for decision-making in this area. (shrink)

How can Christian ethics make a significant contribution to health care ethics in today's Western, pluralistic society? Robin Gill examines the 'moral gaps' in secular accounts of health care ethics and the tensions within specifically theological accounts. He explores the healing stories in the Synoptic Gospels, identifying four core virtues present within them - compassion, care, faith and humility - that might bring greater depth to a purely secular interpretation of health care ethics. Each of these virtues is examined in (...) turn, using a range of topical issues including health care rationing, genetics, HIV/AIDS, withholding/withdrawing nutrition from PVS patients, and the empirical evidence which suggests a connection between religion and health. Professor Gill also argues that these four virtues are shared by other major religious and humanistic traditions and that, together with secular principles, they can enrich health care ethics even in a pluralistic society. Plato famously promised to complement the Sophist and the Statesman with another work on a third sort of expert, the philosopher--but we do not have this final dialogue. Mary Louise Gill argues that Plato promised the Philosopher, but did not write it, in order to stimulate his audience and encourage his readers to work out, for themselves, the portrait it would have contained. The Sophist and Statesman are themselves members of a larger series starting with the Theaetetus, Plato's investigation of (...) knowledge, and the whole series relies on the Parmenides, the second part of which presents a philosophical exercise, introduced as the first step in a larger philosophical program. Gill contends that the dialogues leading up to the missing Philosopher, though they reach some substantive conclusions, are philosophical exercises of various sorts designed to train students in dialectic, the philosopher's method; and that a second version of the Parmenides exercise, closely patterned on it, spans parts of the Theaetetus and Sophist and brings the philosopher into view. This is the exercise about being, the subject-matter studied by Plato's philosopher. Plato hides the pieces of the puzzle and its solution in plain sight, forcing his students (and modern readers) to dig out the pieces and reconstruct the project. Gill reveals how, in finding the philosopher through the exercise, the student becomes a philosopher by mastering his methods. She shows that the target of Plato's exercise is internally related to its pedagogical purpose. (shrink)

Is the mathematical description of the Universe quantum, classical, both or neither? The mandated assumption of rationalism is that if an argument is inconsistent, it is flawed for a conclusion. However, suppose the structural basis of the Universe is fundamentally inconsistent. In that case, paradoxes in the frameworks of logic and mathematics would not be anomalies. A geometric model with a counter-rational framework of inconsistent relationships is applied to analyze Hardy’s paradox, the fine structure constant, and the general relationship between (...) the correlated quantum and classical EPR-type structures. The model conjectures that the well-studied paradoxes found in theoretical arguments and empirically in EPR phenomena are not anomalies and instead point to a new framework for modelling universal structures that incorporates inconsistency. Il y a un peu plus de vingt ans, Marcel Gauchet livrait ses réflexions sur le long et lent processus de désenchantement du monde qui, de l’intérieur même de la compréhension religieuse du monde, a abouti à l’affirmation de l’autonomie humaine et à la prise en main par les hommes de leur destin collectif. Cette thèse a fait l’objet de nombreuses discussions et controverses qui portaient sur la validité de la reconstruction historique générale, sur la méthode guidant cette dernière, et (...) enfin sur la vérité du diagnostic final. Ces questions ont leur intérêt et ont été déjà vivement débattues. Ce livre sur et à partir de la pensée de Gauchet sera toutefois différemment orienté. Il porte davantage sur les effets du désenchantement sur la démocratie elle-même que sur l’origine du désenchantement du monde. Il semble en effet que la démocratie contemporaine, en gros la démocratie des individus et des identités, subisse à son tour les effets du désenchantement et qu’elle tende à devenir une démocratie "contre elle-même". C’est du moins dans ce sens que l’on pourrait lire les ouvrages plus récents de Gauchet, La religion dans la démocratie (1998), La démocratie contre elle-même (2002) et La condition politique (2007). L’avènement de cette démocratie désenchantée ouvre tout un ensemble d’interrogations qui seront au coeur de cet ouvrage : un tel diagnostic est-il juste? Jusqu’à quel point la démocratie peut-elle se retourner contre elle-même? Un régime politique qui effacerait toute trace de croyable est-il possible? Comment la démocratie doit-elle réagir devant les tentatives idéologiques de réenchantement du monde? Many terminally ill patients perceive themselves to be a burden to loved ones who care for them. The self-perception of being a burden can play a significant role in terminal patients’ decisions to take courses of action, such as ceasing life-sustaining treatment or requesting physician-assisted suicide, that hasten death. I will use the term ‘burden-based decision’ as a shorthand for cases in which a terminal patient’s perception that she is a burden to her loved ones influences her decision to hasten (...) death. When should we view a terminal patient’s inclination to make a burden-based decision to be an ethical problem or a failure of treatment? And when should we view it to be an acceptable response rather than a problem or failure? I argue here that such decisions are acceptable more often than many who write on this topic imply. (shrink)

Here, I lay the foundations of a high-level ontology of particulars whose structuring principles differ radically from the 'continuant' vs. 'occurrent' distinction traditionally adopted in applied ontology. These principles are derived from a new analysis of the ontology of “occurring” or “happening” entities. Firstly, my analysis integrates recent work on the ontology of processes, which brings them closer to objects in their mode of existence and persistence by assimilating them to continuant particulars. Secondly, my analysis distinguishes clearly between processes and (...) events, in order to make the latter abstract objects of thought (alongside propositions). Lastly, I open my ontological inventory to properties and facts, the existence of which is commonly admitted. By giving specific roles to these primitives, the framework allows one to account for static and dynamic aspects of the physical world and for the way that subjects conceive its history: facts account for the life of substances (physical objects and processes), whereas events enable cognitive subjects to account for the life story of substances. Firms located in communities in which people are, on average, more trusting enjoy some benefits in terms of the power of CEO contracts. We present two pieces of empirical evidence to support this claim: (1) higher average trust in a county is associated with “flatter” executive contracts and (2) when an exogenous shock occurs (such as a scandal involving an important social institution), both trust and contracting move in similar directions. We obtain the first result in a panel specification and (...) the second in a “difference-in-difference” specification that uses the revelation of sex scandals involving the Catholic Church across different U.S. localities. In the late 1980s and early 1990s a number of key writers within sociology and anthropology criticised much of the existing research on children within the social sciences as ‘adultist’. This has subsequently provoked attempts by academics to define new ways of working with, not on or for, children that have been characterised by a desire to define more mutuality between adult and children in research relationships and to identify new ways that researchers can engage with young people. This paper (...) aims to address some of the ethical complexities that this work has generated by focusing on five areas of ethical concern in relation to research with children in the environments of home and school: consent; access and structures of compliance; privacy and confidentiality; methodologies and issues of power; and dissemination and advocacy. While most of these issues are not necessarily unique to working with children, but underlie many research projects, they are refracted in particular ways in child-oriented research because of the unequal relationships of power between adults and children; the way that adults mediate access to children; the legal complexities of children's position as minors; and the particular nature of the environments—school and the parental home—in which researchers usually encounter young people.
