Pour souligner le 30e anniversaire de la Convention internationale des droits de l’enfant (CIDE), le Groupe de recherche interdisciplinaire en droits de l’enfant (GRIDE) de l’Université de Moncton a organisé son premier colloque international du 26 au 28 novembre 2019, en collaboration avec le Bureau du défenseur des enfants et des jeunes du Nouveau-Brunswick. Ce colloque a permis de dresser un état des lieux éclairant, d’une part pour savoir si les objectifs énoncés dans la CIDE sont atteints avec l’application de (...) la Convention en droit interne et, d’autre part, pour évaluer les défis et les enjeux actuels de la mise en œuvre des droits de l’enfant dans une approche interdisciplinaire et interprofessionnelle. Les Actes du colloque regroupent dans le présent ouvrage cinq textes qui tentent de répondre à ces questions. Les contributions sélectionnées apportent un éclairage inédit sur les développements récents liés à l’application de la CIDE dans un contexte canadien, néo-brunswickois et international. (shrink)

Scott Soames argues that consideration of the practice of legal judgement gives us good reason to favor the partial-definition/context-sensitive theory of vagueness against epistemicism. Despite the fact that the value of power-delegation through vagueness is evidenced in practice, Soames says, epistemicism cannot account for it theoretically, while the partial-definition/context-sensitive theory is capable of it. In this paper, I examine the two possible arguments against epistemicism that can be extracted from Soames’s account: (i) an argument based on unknown obligations, and (ii) (...) an argument based on power-delegation through vagueness. The first argument tries to convince us that, as based on epistemicism, the law has already decided the borderline cases, so that judges have obligatory decisions even in such cases: therefore epistemicism is inconsistent with the discretion of judges in borderline cases. I show that even if we sympathize with Soames’s intuitions concerning the legal practice, the argument he offers is not conclusive since it is either invalid, unsound, or paradoxical. The second argument holds that only the gaps which the partial-definition/context-sensitive theory predicts give judges the possibility of lawmaking in borderline cases. However, by categorizing the vague laws as imperfect laws, the judges can claim the right of lawmaking without any need to refer to gaps in the law. By neutralizing these arguments, I argue that epistemicism is able to explain the phenomena just as well as the partial-definition/context-sensitive theory. (shrink)

We design a double-or-quits game to compare the speed of learning one’s specific ability with the speed of rising confidence as the task gets increasingly difficult. We find that people on average learn to be overconfident faster than they learn their true ability and we present an intuitive-Bayesian model of confidence which integrates confidence biases and learning. Uncertainty about one’s true ability to perform a task in isolation can be responsible for large and stable confidence biases, namely limited discrimination, the (...) hard–easy effect, the Dunning–Kruger effect, conservative learning from experience and the overprecision phenomenon if subjects act as Bayesian learners who rely only on sequentially perceived performance cues and contrarian illusory signals induced by doubt. Moreover, these biases are likely to persist since the Bayesian aggregation of past information consolidates the accumulation of errors and the perception of contrarian illusory signals generates conservatism and under-reaction to events. Taken together, these two features may explain why intuitive Bayesians make systematically wrong predictions of their own performance. (shrink)

The paper provides an overview of the evolution of Social Sciences with a focus on the Post-1945 period, known for major strides towards scientific, analytical, nonpartisan, multi-disciplinary and comprehensive study and research in different fields of Social Sciences. The paper discusses the gradual growth of Social Sciences in Pakistan in terms of increase in number of persons engaged in teaching, research and practice in various domains of Social Sciences, institutional facilities and availability of funds. There is a discussion of the (...) major features of the research work done in Social Sciences in Pakistan and its weaknesses and deficiencies. The paper argues that Social Sciences have become important for societies like Pakistan that face different types of social and political conflicts. The rise of religious extremism, violence and terrorism also requires that we benefit from the work done in different fields of Social Sciences for understanding the dynamics of societal trends, issues and conflict and how to address them. The paper also reviews teaching and research being done in Pakistani universities, especially since 2005, when more funds became available for study and research in Social Sciences. The universities have vastly expanded their Doctoral and M.Phil. porgrammes but the imperative of quality is often neglected. (shrink)

The role of state in the contemporary global system is greatly shaped by its inner or domestic strength that include economic resilience, socio-political harmony and a stable constitutional political order. These attributes cannot be achieved by a state unless it assigns the highest priority to human and societal development and promotion of egalitarian socio-economic arrangements that provide equal opportunities to all citizens irrespective of ethnicity, language, religion, caste, region or gender. The focus is on transforming human resources into human capital (...) through education, learning of technology and skills, and health care. There is now a greater emphasis on good governance and a fair and transparent political management and delivery of basic services to the society. This covers policy making and implementation regarding a host of key issues. It is also important to ensure that the fruits of economic growth are fairly distributed in the society. The state must work towards removing socio-economic inequities and disparities among people and regions. This paper examines the major factors responsible for the growing emphasis in state policy on human and social development as well as the historical evolution of this change. It is argued that the political developments in the 1990s and later contributed most in creating a global awareness about human and societal developments. These include, inter alia, the end of the Cold War, the collapse of some states, the rise of religious and cultural extremism and terrorism and the efforts of the various organs and agencies of the United Nations to promote human development and social stability. The paper also identifies the major obstacles in the developing countries, especially in Pakistan, to socio-economic development and distributive justice. (shrink)

Similar words and utterances in the Qurʾān are the subject of the technical term lafẓī mutashābih. The rephrasing of meanings (maʿnā) and use of different words (lafẓ) in the Qurʾān are dealt with under the rubric of the theme “Qurʾānic style.” The stylistic variations in the Qurʾān are expressed as takrār al-Qurʾān, tasrīf (Affix and Paraphrase), ʿudūl (inversion), and tafannun (stylistic variation). However, when compared with other terms of exegesis, “tafannun” remained in the background and its conceptualization was thwarted. This (...) could be attributed not only to other concepts brought to the fore but also to the fact that tafannun underwent semantic restriction and was confined to iftinān within the framework of badīʿ. This study aims to clarify the true meaning of tafannun which reflects stylistic variations in the Qurʾān and revealing the contribution of it to the proper interpretation of the Qurʾān, assessing its significance for tafsīr. The first chapter of this study deals with the etymology of tafannun, its historical background and conceptualization as well as the relationship between iʿjāz (inimitability) and tafannun in the history of tafsīr, while the second one identifies and illustrates the kinds of tafannun to expound on the true nature of this concept.According to the result of this research, iftinān means following various styles and genres (types), while tafannun denotes variations in styles and genres (types). In vernacular, these two terms are considered the same. The term iftinān was dealt with in some works under the subject of muhassināt al-maʿnaviyya within the framework of badīʿ. In the Arabic literature, when the definition of the term iftinān was given, the term tafannun was not defined under any section of any book or any other place in the rhetoric of science. Tafannun is used to express the way any action is carried out, as it is mentioned in the definition of iftinān.The word tafannun was used to demonstrate the expertise, depth and mastery of Islamic scholars in one or various fields of Islamic studies in the early works of Islamic literature. In later times, the term iftinān was used to show rhetorical and oracy skills of a person. Abū Hilāl al-ʿAskarī (d. 400/1009) define tafannun as “the variation in words while two paragraphs bear the same meaning.” His definition proved to be a turning point in the conceptualization process of the word tafannun. Al-Zamakhsharī (d. 538/1144) was the first Islamic scholar to refer to the word tafannun in the interpretation of the Qurʾān. He used the words iftinān and tafannun in the same sense in his works. He mostly regarded examples of iltifāt as iftinān. Abū Bakr al-Rāzī (d. 666/1268), establishing a connection between tafannun and repetition, stated that the term tafannun was used to avoid boredom of repetitive diction.Among other authors who used the term tafannun in their works, Bayḍāwī, (d. 685/1286), Nīsābūrī (d. 730/1329), Ibn Cemāʿa (d. 733/1333), Abū Ḥayyān (d. 745/1344), Samīn al-Ḥalabī (d. 756/1355), Zarkashī (d. 794/1392), Suyūṭī, (d. 911/1505), Ḥaṭīb al-Shirbīnī (d. 977/1570), Shihāb al-Dīn al-Khafājī (d. 1069/1659), Ālūsī, (d. 1270/1854), Muḥammad ʿAbduh (1849-1905)-Rashīd Riḍā (1865-1935) and Ibn Āshūr are the notable ones. Rather than merely defining the term tafannun, the majority of these commentators emphasized the function, benefit and aim of this word. Thanks to the use of this word by these commentators, a distinction was made between tafannun called iftinān as a literary device in the science of badīʿ and tafannun gaining a new meaning used to express stylistic variations. As a result, two words with the same dictionary definition were distinguished from each other during the conceptualization process. Among the authors using the word tafannun, Ibn Āshūr clearly defined the term and contributed significantly to its conceptualization. He defines the word tafannun as the uniqueness of the Qurʾān in employing stylistic variations by offering synonymous words in case of iʾtirāz (discursive), tanzīr, (resemblance), tazyīl (appendix) and takrār (repetition), creating the most comprehensive definition until that time.Tafannun is also defined as expression of the same meaning through re-signifying, stylistic variation in two verses, difference in the repetition of parables, variations in choice of diction and synonymous words, and avoidance of repetition. As a result of its definition, the word tafannun also denotes providing stylistic variations, using vivid language, avoiding prosaic diction, using denotative and connotative language, helping readers to grasp shades of meaning and read between the lines in the most clear and economic way.In the related literature, there are a lot of references to the word tafannun when demonstrating iʿjāz of the Qurʾān. When looked at the historical development of the relationship between iʿjāz and tafannun, it is observed that tafannun was accepted to be an element of iʿjāz. Defined as providing stylistic variation, tafannun is employed in various ways. The literary devices used to carry out tafannun are through ʿudūl, iltifāt, taqdīm and taʾhīr, change of utterances, use of synonymous words, objection, resemblance, and addition. In the proper interpretation of the Qurʾān, tafannun has a comprehensive usage, making many more academic studies a necessity with a view to making a significant contribution to a deeper and better grasp of words and shades of meanings employed in the Qurʾān. The issue of textual criticism/matn criticism in the Islamic world has started to be discussed, especially in modern times, when the issue of criticism of the holy books came to the fore in the West. However, when the history of Islamic sciences literature is examined, it is seen that the subject of criticism of hadith texts has been on the agenda of Muslims, even though it is not as central as isnad. One of the important pillars of the text-centered approach (...) as a method of hadith criticism is the Arabic language. In our study, it is aimed to determine the effect and the limits of the Arabic language in hadith criticism based on the text. While doing this, first of all, the discussions about the link between the language and criticism of the holy scriptures in the West will be discussed, and then the relationship between the hadith and the Arabic language will be revealed, especially in the context of istishhād and literature. Then, the place where the Arabic language stands as a method in the criticism of hadith texts will be determined and an evaluation will be made about its limits and possibilities. The evaluations about the limits and possibilities of the Arabic language will be discussed in terms of the narration of hadiths with meaning, the different approaches of linguists and schools, the conflicts between tribes, and the reliability of poetry as an istishhād method. In this study, particular examples obtained by examining Ibn Dureyd’s (d. 321/933) Jamhara al-luga ve Muhammad ibn Ahmad al-Azherī’s (d. 370/980) Tahzīb al-Luga Abū Aḥmad al-ʿAskarī’s (d. 382/992) Taṣḥīfāt al-muḥaddiṯīn and al-Ḫaṭṭābī's (d. 388/998) Iṣlāḥ ġalaṭ al-muḥaddiṯīn and Ṣafadī’s (d. 764/1363) Taṣḥīḥ al-taṣḥīf wa-taḥrīr al-taḥrīf. In addition, the subject has been examined by taking into account other linguistic sources, basic hadith texts and hadith commenta-ries. In this way, the reflection of the subject in the hadith literature will be revealed and it will be tried to determine the place where the Arabic language stands in hadith criticism, taking into account the problems of the language itself. This article analyzes the position of Ibn Hilāl, who is regarded as nāsıbī and ghālī, in the science of Shia rijāl, his reports and the validity of the accusations against him. It is found that narrators are criticized for various reasons in the science of Shiʻa rijāl. Some of them are the Shiite followers that the imams cursed and wanted to be kept away from their adherence. It is seen that the narrations reported by some of the narrators are included (...) in the main sources of Shiite hadith, albeit these narrators were cursed by the innocent imams. Ahmed Ibn Hilāl (d. 267/880) is one of these narrators cursed by the imams and his name is found in the report (the isnād) of many early narrations. Ibn Hilāl, one of the close companions of Shia's 10th imam Ali b. Muḥammed al-Hādī (d. 254/868) and 11th imam Ḥasan al-ʻAskarī (d. 260/874), was first cursed by the letter of al-Askarī allegedly sent, and the Shiite followers were ordered to move away from him. Ibn Hilāl refused to accept the ambassadoriality of Muḥammed b. Osman (d. 305/918), the ambassador of the 12th Imam. Thus, he was cursed by Muḥammad al-Mahdī as well. In later periods, Ibn Hilāl was accused of being nāsıbī and ghālī. However, there are also some Shiite scholars who supported (tavthîk) Ibn Hilāl. In the Shi'a tradition, Nāsibism indicated the meaning of hating ʻAli and Ahl al-bayt or feeling anger towards them. Later on, this meaning has been changed into a meaning including the haters of ʻAli and then the Shiʻa Nāsibism is regarded as a position towards Shiʻa outside of Shiʻa. Ghulāt is a form of a belief generally found in the Shi'a tradition. In the belief of Ghulāt, holiness is attributed to the imams. When the Shiite sources are examined, it can be seeb that Ibn Hilāl represents neither a ghālī nor a nāsıbī position. In the Shiʻa, when the narrator leaves his sect, his narrations are evaluated differently. Therefore, among Ibn Hilāl's narrations only those which narrated before he left can be accepted. The likely reason for this attitude can be those narrators such as Ibn Hilāl brought in many narrations to the Shiite hadith literature. Ibn Bābeveyh and Sheikh Sadūk reported many narrations that includes Ibn Hilāl in their report chain (the isnad). Among these narrations, they criticized only one. Again, in the 4th century of Hijrī, Numānī, al-Hazzāz, Ibn Qavlaveyh and Mufīd reported many narrations transmitted by Ibn Hilāl. However, none of them mentioned about the negative perception on Ibn Hilāl in any of these narrations. This shows that Ibn Hilāl was not regarded as nāsıbī or ghālī in the eyes of the these scholars. As regards to, Tūsī, in the 5th century after Hijra, claimed that Ibn Hilāl was a ghālī and he was accused of being an adherent to this religion. He narrated in sum fifty narrations that included Ibn Hilāl in the report chain, but Tūsī criticized only three of them because of including Ibn Hilāl. The reason why Ibn Hilāl was accused of being nāsıbī and ghālī, which Shiʻa deemed the worst, was probably related to the political conditions of that period. On the other hand, there is no report that Ibn Hilāl shared a nāsıbī and ghālī thought or had a tendency towards them. It is obvious that if Ibn Hilâl, who has an important place in the eyes of the Shiite community, does not accept the second ambassador of al-Mahdī, and that this would cause discord among the followers. This complex situation was tried to be remedied by letters alleged to have been written by the imams, cursing Ibn Hilâl and ordering them to stay away from him. Later, Ibn Hilāl was accused of being a nāsıbî or ghālī who expressed the attitudes and thoughts that Shiʻa saw the most distant from him. Sadūk first reported the narration that Ibn Hilāl was Nāsıbî. Tūsī, on the other hand, described Ibn Hilāl as ghālī in the 5th century (after hijra). This study tries to reveal that there is no explicit evidence that proves Ibn Hilāl’s nāsıbī or ghālī position. (shrink)
