: Understanding Helmholtz's philosophy of science requires attention to his experimental practice. I sketch out such a project by showing how experiment shapes his theory of perception in three ways. One, the theory emerged out of empirical and experimental research. Two, the concept of experiment fills a critical conceptual gap in his theory of perception. Experiment functions not merely as a scientific technique, but also as a general epistemological strategy. Three, Helmholtz's experimental practice provides essential clues to the interpretation of (...) his theory of perception. A case study from experimental investigation of hearing shows how he designed such studies in accordance with the epistemological commitments of the theory of perception. Yet, while the theory was important to his experiments, the soundness of the experimental strategy was epistemically independent of those commitments. Secondly, the case study illustrates how Helmholtz consistently held that causal inferences underwrite reference to a real, but indirectly experienced external world. (shrink)

A class of ordered relational topological spaces is described, which we call orthomodular spaces. Our construction of these spaces involves adding a topology to the class of orthomodular frames introduced by Hartonas, along the lines of Bimbó's topologization of the class of orthoframes employed by Goldblatt in his representation of ortholattices. We then prove that the category of orthomodular lattices and homomorphisms is dually equivalent to the category of orthomodular spaces and certain continuous frame morphisms, which we call continuous weak (...) p‐morphisms. It is well‐known that orthomodular lattices provide an algebraic semantics for the quantum logic. Hence, as an application of our duality, we develop a topological semantics for using orthomodular spaces and prove soundness and completeness. (shrink)

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. A limiting factor in ethics education in medical training has been difficulty in assessing competence in ethics. This study was conducted to test the concept that content analysis of pediatric residents’ personal reflections about ethics experiences can identify changes in ethical sensitivity and reasoning over time. Analysis of written narratives focused on two of our ethics curriculum’s goals: 1) To raise sensitivity to ethical issues in everyday clinical practice and 2) to enhance critical reflection on personal and professional values as (...) they affect patient care. Content analysis of written reflections was guided by a tool developed to identify and assess the level of ethical reasoning in eight domains determined to be important aspects of ethical competence. Based on the assessment of narratives written at two times (12 to 16 months/apart) during their training, residents showed significant progress in two specific domains: use of professional values, and use of personal values. Residents did not show decline in ethical reasoning in any domain. This study demonstrates that content analysis of personal narratives may provide a useful method for assessment of developing ethical sensitivity and reasoning. (shrink)

This chapter examines Soren Kierkegaard's views and reception of romanticism. It suggests that Kierkegaard was ambivalent toward romanticism and explains that while he criticized the concept of irony, he also modeled some of his works on the writings of romanticists Friedrich Schleiermacher and Joseph Freiherr von Eichendorff. In addition, he was also engaged with romantic aesthetics, and analysed and transformed its key concepts. In recent years, there has been a growing anti-feminist, conservative movement across many parts of the world known as the anti-gender movement. This movement has been especially strong in Central Eastern Europe, where anti-gender actors have framed ‘gender’ as a static, foreign concept imported from ‘the West’ and destructive to ‘traditional’ societies. Utilising a postcolonial feminist approach, I examine the concept of ‘gender’ in Czechia, drawing attention to the role played by Czech academics, activists and policymakers in negotiating the use (...) of the term ‘gender’. This article traces the history of the term from the 1990s when ‘gender’ was first introduced to a Czech academic audience, through public seminars and lectures hosted by the Prague Gender Studies Centre, to the present-day inclusion of gender mainstreaming discourse in Czech policy documents. I reveal that ‘gender’ is not a timeless, clearly defined, fixed term wholly imported from ‘the West’ but rather a concept with a variable and complicated history. Thus, this crucial term, first developed in Anglo-academia, is not uncontested or uncritically accepted, contrary to the claims made by anti-gender actors. The findings presented in this article hold implications critical to transnational feminist dialogue and activism during the current period of growing global anti-feminist sentiment. (shrink)

As we approach the end of the twentieth century, humanity is facing a crisis in definition and ways of thinking across the boundaries of identity, politics, and culture. This paper briefly addresses unusual forums and forms for expressing the anxiety surrounding change and the ability to analyze it, forms linked to the media and its intensive focus on particular “human interest” stories, but also to the uncertainty that a lack of precedent for thinking creates. One of the questions that most (...) interests me is how the malaise of society and the malaise of political change is expressed through the debates around maternity, birth, and the custody of children, how socio-political problems are made intelligible through dramatization of individual struggle involving family relations. What is compelling is the way in which certain stories followed by the media gravitate around facts that speak of what we do not know. Recent advances in reproductive technologies have put into question the belief (whether implicit or explicit) that biology, as a teleological process, can hold cultural chaos in abeyance. The doors have been opened wide as the definition and status of mother, father, and child have all been deeply questioned. Yet at the very moment when the so-called nuclear family is endangered, it is the extraordinarily powerful metaphor of the family that rings insistently in social and political discourse. There is a sense that the threat to the family signals a disintegration of order, leaving the contemporary sense of self bereft of a discourse that can represent universal order. (shrink)

The aim of this article is to fill a certain gap in the assessment of relativism by drawing on Joseph Ratzinger’s (1927–2022) criticism of the normative transformation since Kant. During the Enlightenment, Natural Law was doubted as a cultural feature of Christianity that had no bearing on pluralist society. Consequently, this jurisprudential tradition underwent de-Hellenization and branched out in radical directions, the most decisive of which was Kant’s post-metaphysical system of natural values. Positivism and German Idealism attempted to restore (...) the unity of philosophy that Kant’s philosophy had disrupted. Yet even more influentially, in the nineteenth and twentieth centuries it was Marxism that relativized the doxological aspect of normativity by emphasizing the importance of praxis. Since philosophy became neither an exact science as Kant had conceived it to be, nor a practical programme for social justice as Marxism had promised, the Existentialists, and particularly Sartre, advocated a more radical philosophy of freedom. Ratzinger argues that despite the nuances of post-Kantian philosophy, Positivism, Existentialism, and Marxism failed to comprehend the human condition and that the positivist method resulted in an overwhelming relativism that has reduced normativity to a matter of correct procedures rather than regarding it as the foundation of the inviolable dignity of the human being. Arbery; 255 pp. Wilmington, Delaware: ISI Books, 2001, $24.95. Over the last decade or so, there has appeared an increasing number of books critical of the profession of literary studies. Such criticism has typically been directed (...) at literary theory and its preoccupation with the politics of race, class, and gender. To a limited extent, Glenn Arbery's Why Literature Matters: Permanence and the Politics of Reputation can be classified as belonging to such a "genre." Early in the book, for example, Arbery argues in favor of the "old-fashioned" idea, as he calls it, that literature is a "mode of knowledge" with the potential to open up transcendent modes of experience. Yet Why Literature Matters is so short on polemics and so long on incisive, sometimes brilliant readings of works ranging from the poetry and fiction of Seamus Heaney, Tom Wolfe, Toni Morrison, and Emily Dickinson to Shakespeare's Othello and Homer's Iliad, that such a characterization is insufficient at best and distorting at worst. Notwithstanding its title, this book is devoted less to advancing a polemic about "why literature matters" than to dramatizing, with performative power and grace, why most of us, politically oriented or not, are already quite sure that it does.Such performative power can be felt throughout Why Literature Matters, but [End Page 373] its presence is especially strong in the final, lengthy chapter on the Iliad, "The Sacrifice of Achilles." Bringing to bear his training as a classical scholar, Arbery contends that the Iliad is "about" a single event: the death or "sacrifice" of Achilles. Achilles, Arbery notes, was not just the greatest hero of the Iliad. He was also the greatest hero of the entire classical world: "Achilles has no rival in glory, either in the generation of heroes before him (not even Herakles), or in the ages after him. According to Plutarch, Julius Caesar wept because he had not accomplished as much as Alexander at the same age, but Alexander the Great envied Achilles."Why, then, does Arbery refer to Achilles' death as "sacrificial"? Drawing on a version of the Greek myth whose source is Pindar rather than the more commonly cited Hesiod, Arbery observes that Achilles' sacrificial death, which is not in fact narrated in the Iliad but is everywhere taken for granted, was necessitated by Zeus' successful plan to forestall a prophecy. According to agent-based approaches to virtue ethics, the rightness of an action is a function of the motives which prompted that action. If those motives were morally praiseworthy, then the action was right; if they were morally blameworthy, the action was wrong. Many critics find this approach problematically insensitive to an act’s consequences, and claim that agent-basing fails to preserve the intuitive distinction between agent- and act-evaluation. In this article I show how an agent-based account of right action can be (...) made sensitive to an act’s consequences. According to the approach which I defend, an action is right just in case it realizes an agent’s morally praiseworthy motive. Conversely, an action is wrong just in case it realizes a morally blameworthy motive. Specifying act-evaluation in terms of the realization, rather than the expression, of an agent’s motives allows an agent-based approach to distinguish between agent- and act-evaluation. This is because an agent may act from a morally praiseworthy motive, but fail to realize that motive. This paper looks at conflicts of interest in the not-for-profit sector. It examines the nature of conflicts of interest and why they are of ethical concern, and then focuses on the way not-for-profit organisations are especially prone to and vulnerable to conflict-of-interest scandals. Conflicts of interest corrode trust; and stakeholder trust (particularly from donors) is the lifeblood of most charities. We focus on some specific challenges faced by charitable organisations providing funding for scientific (usually medical) research, and examine a case (...) study involving such an organisation. One of the principal problems for charities of this kind is that they often distribute their funds within a relatively small research community (defined by the boundaries of a small region, like an American state or Spanish Autonomous region, or a small country), and it often proves difficult to find high-level researchers within the jurisdiction to adjudicate impartially the research grants. We suggest and recommend options appropriate for our case study and for many other organisations in similar situations. (shrink)

My argument is that poststructuralist and postmodernist theory carries on and intensifies the main lines of a characteristically modern tradition of aesthetics whose most important point of reference is not French structuralism – as the term, ‘poststructuralism’, implies – but the tradition of 18th-century German romanticism and idealism that culminated in the work of Heidegger during the Weimar period in Germany between the world wars and afterward. What characterizes this modernist tradition of aesthetics is its valorization of language as a (...) mode of being possessed of an ‘ontological’ status. I place the term ‘ontology’ in quotes in order to highlight the distinction between ‘metaphysics’, with its Aristotelian and neo-Platonic connotations of a ‘chain of being’, and the more modern term ‘ontology’, which was coined in the 17th century and which became widely used during the 18th century by Leibnizian philosophers Christian Wolff and Alexander Baumgarten; the latter, not incidentally, also helped to establish modern usage of the term ‘aesthetics’. ‘Metaphysics’ and ‘ontology’ have their roots, respectively, in those two most major currents of our western heritage, the Graeco-Roman and Judaeo-Christian. These currents, although inextricably linked to one another in innumerable ways, have nonetheless been engaged, as Nietzsche put it, ‘in a fearful struggle on earth for thousands of years’ that has been obscured by Heidegger’s and Derrida’s accounts of the history of western philosophy. Such accounts have projected what is basically a romanticist critique of Enlightenment values and thought on to a totalizing account of the history of Western thought since Plato. My purpose in emphasizing the distinction between metaphysics and ontology is to provide a conceptual framework within which our understanding of the development of modern aesthetics, and the concept of language that informed that development, can be related to the larger philosophical issues at hand. Literary theorists in the United States, by endorsing Heidegger’s and Derrida’s self-serving accounts of their writings as assaults on the entire history of Western philosophy, and by failing to judge them critically as outgrowths of that history, have not only obscured these developments. They have also sustained the central tenet of American literary theory since the 1960s: that there is such a thing as a ‘Western philosophical tradition’ on the ‘other’ side of which, through an endless series of linguistic coinages and ‘erasures’, we may maneuver ourselves. My claim is that to the extent that there is such an other side, we are already on it, and that we fundamentally misunderstand our situation if we regard it as ‘other’ to the Western philosophical tradition. In the recent literature of environmental ethics, certain criticisms of pragmatism in general and Dewey in particular have been made, specifically, that certain features of pragmatism make it unsuitable as an environmental ethic. Eric Katz asserts that pragmatism is an inherently anthropocentric and subjective philosophy. Bob Pepperman Taylor argues that Dewey’s naturalism in particular is anthropocentric in that it concentrates on human nature. I challenge both of these views in the context of Dewey’s naturalism. In this paper, I outline both a nonanthropocentric and non-subjective theory of intrinsic value which incorporates pragmatism in environmental ethics in a novel way. The theory, which I call creative actualization, is a non-hierarchical, nonsubjective theory of value which includes the value of nonhuman species and the biosphere. I argue that there are conditions to such values. These limitations include evaluations of actual improvement and reciprocity as conditions. These conditions are necessary limitations upon actions, i.e., duties. I incorporate a deontological (...) ethic thereby as an alternative to utilitarian and other ethical theories in environmental ethics. Duties are to species and to habitats, not to individuals. I conclude that the distinction between ethics and ecological ethics is no longer tenable, given a theory of obligation which is truly universal rather than speciesist. Ecological ethics is the ethics of the future, embracing a way of life, duty, and questions of ultimate worth. (shrink)

We examine the occurrence of ethicsrelated terms in 10-K annual reports over 1994-2006 and offer empirical observations on the conceptual framework of Erhard et al. 2007). We use a pre-Sarbanes-Oxley sample subset to compare the occurrence of ethics-related terms in our 10-K data with samples from other studies that consider virtue-related phenomena. We find that firms using ethics-related terms are more likely to be "sin" stocks, are more likely to be the object of class action lawsuits, and are more likely (...) to score poorly on measures of corporate governance. The consistency of our results across these alternative measures of ethical behavior suggests that managers who portray their firm as "ethical" in 10-K reports are more likely to be systematically misleading the public. Over the past decade, corporate scandals have proliferated. These scandals, along with the emergence of the #MeToo movement and Environmental, Social, and Corporate Governance (ESG) mandates, have increased the scrutiny of corporations’ ethics culture. How have companies responded in terms of the language appearing in their public ethics documents? We compare the Code of Ethics in 2008 versus 2019 for a sample of S&P 500 firms. For the vast majority of firms, their Code of Ethics lengthened, with the average 2019 (...) code having 29% more words (about 1760 words) than the 2008 average. The language of the codes has also changed. Words such as _bribery, corruption, sustainability, speak up, bullying, slavery,_ and _human rights_ all saw significantly higher usage in the later period. We review possible reasons for the dramatic changes and suggest what questions remain about the motivations behind them. Whether the changes we observe are primarily intrinsically motivated or simply market responses to public pressures is yet to be determined. What is clear from our findings is that society seems to be entering a new age of increasingly moral—or, at least, moralized—corporate governance. (shrink)

Drawing from Carlos Castaneda's writings about Don Juan and the sense of "body-knowing," Pearce explores the varieties of nonordinary consciousness that can help us return to the unencumbered consciousness of our infancy. He shows that just as we each create our own cosmic egg of reality through cultural conditioning, we also innately create a "crack" in that egg. Ultimately certain shifts in our biological development take place to offset acculturation, leaving an avenue of return to our primary state. Pearce examines the creation of the "egg" itself and ways to discover its inherent cracks to restore wholeness to our minds, release us from our fear of death, and reestablish our ability to create our own realities through imagination and biological transcendence. The tension between beauty and technology is evinced in the modern distinction within technē itself between technology and “fine art.” Yet while beauty,as Kant observes, is never a means to an end, neither is it an “end in itself.” Beauty points beyond itself while refusing subordination to human interests. Both its noninstrumentality and its self-transcending character I trace to the intrinsic necessity of the beautiful, which is essentially impersonal while paradoxically being an object of love. I suggest that we conceive (...) of beauty as an “anonymous voice,” and I relate the latter to Heidegger’s critique of modern technology as a projection upon nature of “resource being.” I conclude that technology can be creative rather than destructive of beauty when it lets natural ends, which are inescapably in conflict with one another, transcend themselves through self-sacrifice.
