BackgroundFew studies have identified the willingness rate of developing countries population to be enrolled in clinical trials.MethodsAll participants including patients, healthy volunteers and doctors completed a questionnaire to examine factors affecting the consent to participate in medical research.ResultsOverall, 80 % of the included population agree to participate in health research. This rate was lower for trials dealing with life-threatening diseases. Altruism and perceived risk of harm were the main reason to respectively accept or refuse to participate in clinical trials. Factors (...) significantly associated with willingness were: age <40 years 1.6 [95 % Confidence Interval 1.2-2.1]) and prior history of blood donation.ConclusionMost participants expressed their willingness to be included in medical research especially if they are young or if they have history of blood donation. This study examines the impact of board gender diversity on financial misconduct. The findings suggest firms with gender-diverse boards commit fewer financial reporting mistakes and engage in less fraud. The findings hold after accounting for the potentially endogenous nature of board demographic characteristics via instrumental variable approach. Furthermore, the findings are consistent in pre- and post-regulation periods and hold for firms with good and bad governance. The findings do not seem driven by differences in effort or quality, in terms of (...) independence and expertise, of female and male directors. The benefit derived from increasing the number of female directors on corporate boards seems to diminish at higher levels of gender diversity, indicating that impact of gender diversity on decreasing the likelihood of financial misconduct may be a result of a change to board group dynamics. Two great challenges for reform of education have to be addressed if Muslim society is to respond meaningfully to the threat of terrorism.Most Muslims are strongly opposed to acts of violence, in any form, undertaken in the name of religion. Consequently, it hurts us to constantly see the name of Islam, ‘the religion of peace’, linked with international terrorism. Nevertheless, as Muslims we must face the reality that if we fail to address the challenges before us we will find ourselves (...) constantly confronted with accusations of harbouring terrorists - regardless of how fair those generalized accusations might be. This study revolves around the configurations of Dou Mbawa [People of Mbawa] in Bima, West Nusa Tenggara, eastern Indonesia, mapped onto the three main sociocultural-religious groups of Muslims, Christians and Parafu [followers of local beliefs]. It focuses on the Raju ritual as a ‘text’, representing social structures and dynamics of religious tension among the Dou Mbawa, which has been understudied in the existing works of literature. The central position of the Raju ritual is highlighted, as it is born from the (...) cosmological worldview and simultaneously practised by all three religious groups annually. Such interwoven ambiguities occurred in the life of the Dou Mbawa, involving ideology, authority and agents or actors, generating tension and confrontation that have led to Raju’s transformation from religious expression to cultural adaptation. Using ethnographic data generated from 2019 to 2020, this study argues that a Raju ritual is a political act that merely reflects the ideology of its supporters and shapes their capital bases and communicative actions to respond to social segregations.Contribution: This article shows how the Raju ritual promotes cohesiveness and harmony for a religiously diverse community by creating a shared ethnic identity and exercising it as a cultural adaptation. Students’ Quality Circles (SQCs) are considered in the context of English Language Teaching in Pakistan, with a focus on oral expression. SQCs offer many educational benefits.

The coastal area of Bangladesh is one of the most ecologically productive and it contains a rich biodiversity which includes several species that are endemic to this region. Much attention has been focused on ship breaking industries in the coastal areas because of the threat they pose to this thriving biological communities along with their other environmental impacts and the perilous working environment of the workers. The coastal environment of Sitakunda is severely contaminated by various processes related to ship-breaking i.e. (...) the disposal of different toxic wastes into the sea water, deforestation by expanding ship breaking yard, changing land-use pattern and release of toxic substance into the soil. Moreover, the workers of this industry are exposed to an extremely risky and toxic working environment which makes them vulnerable to both physical and psychological disorder as well as to accidental deaths and injury. Still, workers embrace these risks for very poor wages and most of the profits go to the already rich businessmen. Despite various negativities, this industry has gained importance due to the increasing demand of raw material for re-rolling industries and employment opportunities for the people of the coastal areas. As this industry is indispensable due to its importance in the macro and micro economy of Bangladesh, a sustainable management approach should be taken to at least minimize the environmental and health impacts of ship breaking industries. The current paper aims to investigate the extent to which this industry is affecting the ship breaking yard labors and the environment, despite the growing concern nationally and internationally, and it uses both primary and secondary data. This article examines the “urang awak”, a term referring to the Minangnese who trace their origin to Minangkabau in West Sumatera, and their dakwah activism in diaspora. It problematises the relation of Islam activism and ethnic identity of a diasporic community in contemporary West-Java, Indonesia. It further argues that mosque has been central to the activities of dakwah activism of the urang awak in diaspora. As this article demonstrates, the Harakatul Jannah Mosque and Al-Anwar Mosque reserve as important bases for (...) dakwah activism of urang awak in a dominant culture of Sundanese and Javanese. Through these mosques, the urang awak attempt to preserve their ethnic identity, mainly expressed through the mosques’ architecture, language, and religious activities that clearly symbolise the identity of urang awak. The belief system of academicians has an impact on how religious education (RE) is carried out in public universities. The ideology of RE lecturers - whether it is moderate, radical, or liberal - is greatly influenced by their own religious beliefs. The purpose of this study was to explore the relationship between religious paradigm of religious education lecturers on interreligious tolerance and pluralism in public universities in Indonesia. The study sample comprised 142 lecturers drawn from ten public universities in Indonesia. (...) A mixed method research design guided this study, where qualitative data was used to reinforce or clarify the findings from the quantitative data. The data was statistically assessed using the nonparametric Mann-Whitney U-test to reveal whether the demographic profiles of RE lecturers was related to their religious paradigm regarding the relationship between religion-state, inter-religious relations and intra-religious relations. The study's findings indicate that the lecturer's personal beliefs about religion affect their opinions on the relationship between the state and religion, as well as the relationships within religious groups. Moreover, religious educators have a middling level of comprehension of their religious paradigm. To promote understanding and harmony among the academic community, it is suggested that a platform for religious moderation be established at public colleges where educators and students of various religions can converse and resolve fundamentalism. This study investigates structural influence of the Madrassah system on effectiveness of its students in terms of civic health, system thinking and professional development. The researchers constructed the instrument of survey after rigorous literature review, frequent interaction with scholars, clerics and policy makers. The survey was administrated to 600 Madrassah’s students from different schools of thought. By applying T-test and Kruskal Waliss Rank Test for measurement of effectiveness and Structural Equation Modeling methodology the researchers has explored the relationship between the (...) variables, and later analyzed with the help of selected model. Findings of the study demonstrate that education system followed in Madrassahs does not seem to be effective and need-based in contemporary times. Indicators of Madrassah structure such as curriculum and openness negatively influences the students while peda­gogy positively influences the effectiveness of students of Madrasah in Pakistan. In the end, it is recommended that curriculum and pedagogy of Madrassah should be reformed and updated in accordance with knowledge-based economy. This will not only upgrade the poor segment of society but also bring together the variety of individuals close enough to understand each other. (shrink)

Thoughts of Abdurrahman Wahid, the 4th president of Indonesia, on customs and practices of Islam in Indonesia.

The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)

Şeybânî (ö. 189/805), Şâfiî (ö. 204/820), İsâ b. Ebân (ö. 221/836) ve Buhârî (ö. 256/870) gibi sünnî ekolün tanınmış fıkıh ve hadis alimlerinin haber-i vâhid lehine ortaya koydukları çalışmalar bu noktada oldukça etkili olmuştur. Bu etkinin bir sonucu olarak başlangıçta haber-i vâhidi toptancı bir yaklaşımla reddeden Mutezili isimler, yerini zamanla Ebû Ali el-Cübbâî (...) Avicenna is a strong proponent of what some of the later ones call qāʻidat al-wāḥid or ‘rule of the one’ (RO). The gist of RO states: from the one only one directly proceeds. In the secondary literature, discussion of this Avicennian rule is usually limited to a particular application of it i.e., the issue of emanation. As result, it’s not really clear what RO means, nor why Avicenna endorsed it. In this paper, I try and remedy this situation by doing (...) two things – one on the taṣawwur front, the other on the tasdīq. First, explain just what the terms of RO amount to – that is, its subject and predicate. In doing this, I distinguish between a narrow and a broad understanding of RO, and the show that, on the Avicennian view, the scope of RO is broad; it is meant to be a general principle of efficient causality. This is why it is appealed to in various contexts to establish substantial philosophical theses. Second, I consider an argument Avicenna offers for RO in the Mubāḥathāt. In unpacking it, I uncover some of its realist presuppositions, and then further clarify it in light of a critique first raised by Bahmanyār and then later made famous by Fakhr al-Dīn al-Rāzī. I then conclude by seeing whether the Avicennian has the resources within the initial premises of the argument to meet the objection that’s raised. (shrink)

Muʻtazilite thinkers put forward the first systematic ideas for the relationship of essence and attributes, one of the most fundamental and complicated issues of Islamic theology, and comprehensive explanations to the question of God’s names. Although almost all the thinkers agreed on uṣūl al-khamsa, they differed in their approach to the principle of unity (tawḥīd). ‘Abbād b. Sulaymān, who lived in the period when these approaches emerged, is a scholar who reveals his distinctive view of God’s names and attributes in (...) which heslightly differs from his contemporaries such as Abu al-Hudhayl al-‘Allāf, Mu‘ammar b. ‘Abbād al-Sulamī and Ibrāhīm b. Sayyār al-Naẓẓām from the Basran Muʻtazila, by his extreme opinions on the Muʻtazilite principle of tawḥīd. He is one of thefour principle thinkers who presented original opinions in the early Basran Muʻtazila. Also he is the only known student of Hishâm al-Fuwaṭī and constitutes the last major circle of this tradition of knowledge that ended after him. This article aims to reveal the relationship between essence and attributes, the names and attributes of God in a holistic and systematic way in the thought of ‘Abbād b. Sulaymān. Unfortunately, his works have not survived to the present day and has not received the attention he deserves. Since his views were scattered in the classic books, our study was focused primarily on these classical sources. The modern literature was not ignored, either. The relevant records, analysis and criticism were re-contextualized. According to ‘Abbād b. Sulaymān, the view that “Allah is a thing” is the same with the view that “Allah is other (ghayr)”, he draws attention to a definite distinction between Allah and human beings. In his thought about the relationship between Allah and space, he rejects the idea that God could be related to space or anything spatial in order to refrain from an anthropomorphic conception of God. In the case of visibility (ru’ya) of Allah, he radically opposes the idea of “seeing Allah with the heart,” which was adopted by the majority of the Muʻtazila. He tries to solve the issue in his own terms by avoiding the terms essence (dhāt) and nafs in the relationship between God’s essence and His attributes. He reveals a unique classification of names and thus adopts the method of analogy. He does not accept essential attributes as the majority of the Mu’tazila did. On the other hand, he tacitly accepts that Allah’s names have their own meanings in a way that they are not merely words (aqvāl). By a true comparison or perfect analogy (fī ḥaqīqati’l-qıyās), while he rejects that God is ālim, qadīr etc., he tries to ground that human beings is ālim, qadīr etc. He does not admit that God is eternally samʻi and baṣīr. Without interpreting samʻi as His knowledge or baṣīr as His power, he accepts that each name has a distinctive functionality. He rejects the assumption that God knows conditionally. Regarding the issue of whether living beings are in the knowledge of Allah before they exist, it makes a dual distinction: “a direction that can be subject to the eternal knowledge” and “the direction in which it actually came to existence”. Because of his view of non-existent and creatures, Ibn al-Rāwandī and modern resources refer the view of the eternity of objects to him. However, when the relevant records are examined, it is seen that this claim is not valid. According to ‘Abbād, Allah is capable of creating possible things that he knows, although He does not create impossible things that he knows, even though He is capable of creating them potentially (bi-al-quwwa). Allah has not created evil, neither literally nor figuratively; so much so that He created only man, not faith and unbelief. It is not possible to talk about any good that he did not create. He defends the createdness of the Qur’an (Khalq al-Qur’ān) by saying that the Qur’ān was created of accidents. About God’s names, he states that God has the names indicating His relationship to the universe. He does not accept that in eternity He is a willing agent, creator etc. However, he also does not accept the otherwise. He emphasizes that creation is reserved only for Allah. On the other hand, according to him, Allah creates without secondary causes and thus does not create things for a specific purpose. Regarding the revealed attributes (or informative attributes, khabarī), he recites these expressions only when reading of the Quran.He states that these expressions should not be used for Allah under any circumstances. He avoids naming Allah as wakīl, kafīl, laṭīf, kā’in, fard and mutakallim as he says that the name wāḥid should be used only for praising Him. (shrink)

There is a prevailing opinion that conjectural knowledge (zann) cannot be taken as a basis in determining the fundamental theological principles among the theologians. However, from which sources and how to obtain certainty (yaqīn) and which types of knowledge are definitive (qat‘ī) have been discussed extensively. Certain and conjectural knowledge meet at a common point in terms of relying on evidence. Conjectural knowledge obtained via reasoning and/or religious scripture that do not express certainty. While conjectural knowledge has been essentially related (...) to the concepts of estimation, doubt, belief and knowledge, by its in term of value, it is stands closer to the concepts of knowledge and belief. Conjectural knowledge contains different degrees of certainty. When it is chosen to be more certain, it is considered as a valid conjecture, when it is disregarded, it is considered as erroneous conjecture. If there is no choice for its certainty, then it is called doubt (shakk). If the information/judgment obtained through reasoning becomes fixed, unchangeable and in a coherence that does not allow it to be otherwise, then it is called definitive (qat‘ī) knowledge. To achieve that, theologians generally used methods of argumentations like syllogism, induction, exhaustive investigation and disjunction (al-sabr wa’l-taqsīm) to provide such knowledge about divinity and prophethood. Theologians have used conjectural knowledge, which are based on endoxic (mashhūrāt), already granted (musallamāt) and acceptance of authority (maqbūlāt), in their dialectics to persuade their discussants, rather than to justify the fundamental theological issues of religion. While theologians mostly use rational proofs in theological issues, they also gave significant place to the scriptural narrative that determines the creed. In this context, theologians accepted the narrated evidence as binding and decisive, as long as it is certain in terms of both authenticity and implication. Ultimately, the fundamental theological principles of religion are based on these narrative evidences. Although the theologians do not accept single reports (khabar al-wahid) for their questionable authenticity, they also made inferences regarding subjects of traditions (sam‘iyyāt). Acting from this perspective, theologians tried to justify with narrative evidence rather than rational arguments on these issues such as torment in grave, intercession (shafā‘ah) and sirât, which are mostly matters of eschatology and the unseen (ghayb). Finally, it has been concluded that the conjectural knowledge is still valid in some secondary theological issues and the assumption that the conjectural knowledge has no deduction value in theology is not absolute. Kibir ile ortaya konulmuş her düşünce en temelde ahlaki sorunlar ortaya çıkaracağı gibi bir de, eksikliklerini kabul etmeyen dogmatik bir tutum (...) sergileyecektir. Kibir insana her yaptığının en doğru, en güzel, en kudretli olduğunu fısıldar durur. Bu fısıltı kişinin durup düşünmesine, aklın devreye girmesine izin vermedikçe de, hata yapılmaya devam edilir. This article discusses the haul stage which is held once a year on the date of death of the fourth former President of the Republic of Indonesia, namely Abdurrahman Wahid (Gus Dur), which demonstrates harmonious relations between adherents of different religions in Indonesia. Consequently, the haul rituals have become vehicles for affirming understandings of the interfaith dialogue. This study aims to map the use of haul rituals to promote interfaith value. Analysing YouTube videos, this study finds that interfaith dialogue (...) forms have been reflected in: (1) declarations of a cross-religious ideology, (2) the involvement of interfaith figures, and (3) the inclusivist discourses themselves. Gus Dur’s haul, thus, has provided collaborative spaces wherein interfaith dialogue value can be sustainably structured.Contribution: This research contributes to exploration of the haul stage, which takes place annually on the death anniversary of former Indonesian President Abdurrahman Wahid (Gus Dur). This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. (shrink)
